Proposed mixed-income development in Shady Acres concerns nearby citizens By Betsy Denson betsy@theleadernews.com

Starting in May, Houston neighborhoods should see far fewer “Coming Soon” and “Non-MLS Listing” real estate yard signs. The practice of pre-marketing listings before they are officially on the market or publicly listed on the Multiple Listing Service (MLS), which in Houston is the familiar HAR.com, has been commonplace for many years. Similarly, “pocket listings” are homes that an agent can market without ever putting them on the MLS. The rise of mega-brokerages emphasizing technology and branding, along with an increasing push to right past wrongs in equal housing opportunity, has given the National Association of Realtors and the U.S. Department of Housing and Urban Development reason to revisit the broader impact of marketing homes to a limited pool of buyers. This is often done via brokerage websites, neighborhood signs, and targeted advertising. According to real estate broker and owner of Boulevard Realty Bill Baldwin, this practice has always been a dubious way to serve home sellers. “Pre-marketing or marketing homes off the MLS has always been pitched to sellers as being in their best interest for extra or niche exposure, but I would argue that it is the opposite,” Baldwin advises. “It is really in the interest of the listing agent, who is almost always leveraging a pocket listing to pick up buyers.” Effective May 1, MLSs and Realtor associations like the Houston Association of Realtors (HAR) must implement and enforce what is known as a “Clear Cooperation Policy” by which all homes advertised for sale by any agent or broker must be made publicly available on the MLS within one day of being promoted in any way. Baldwin, who is also a member of the HAR task

force assigned to implement the policy in Houston, says it has long been the policy of his firm to avoid non-MLS sales. “The main reason a non-MLS sale is a disservice to sellers is because real estate prices are entirely dictated by the market,” he explains, adding, “How can a seller or agent know what a home is truly worth without exposing it to the widest pool of buyers on the MLS? It seems highly unethical to advise a seller to accept any offer without really seeing what the market will yield.” Baldwin further warns of the intrinsic inequality of not immediately listing homes for sale on the MLS. “Marketing a pocket listing to a select group of buyers or realtors is inherently discriminatory,” expresses Baldwin, who devoted a large portion of Boulevard’s annual sales summit for its agents to addressing fair housing concerns, unconscious bias, and anti-discrimination. While the Fair Housing Act of 1968 bans outright housing discrimination and racially selective deed restrictions, Baldwin expresses his concern that limiting exposure places a de facto limitation on who has access to a neighborhood, “It may seem harmless to try to attract the ‘ideal buyer’ without having to go through the hassle of a lot of showings or having the inside of your home virtually open for all to

see, but the reality is that this perpetuates our country’s history of highly unequal housing opportunity.” With HUD’s renewed focus on keeping the housing market as level a playing field as possible, other regulations—like how homes can be advertised using Facebook targeting—have gone into effect as well. While these policies are meant to address more structural market forces in residential real estate, they will have a direct impact on brokerages whose business model relies on having “exclusive” listings or who use that as a tool to entice sellers into listing agreements. After May 1, any Realtor who advertises a listing without reporting it to the MLS may face stiff penalties. At Boulevard Realty, the policy is already in full effect. “At a certain point, we have to focus on what is best for our sellers, home buyers, and our need to have equitable, diverse neighborhoods,” expresses Baldwin. “If it means we have to adapt to what is already a fairly lax regulatory environment when it comes to housing, I think that is a worthy cause.” This article is part of The Leader Experts series, where companies pay for editorial space on topics inportant to the community. Resolution of support Kamin said that fair housing regulations do not allow the city to withhold support from applications simply because they lack community support. “(It’s) quite the contrary, withholding support could not only go against the city’s voluntary compliance agreement with the U.S. Department of Housing and Urban Develop-

clubs, nonprofits, HOAs, so community engagement is in the developer’s interest,” Newport said. The meeting with ITEX took place Tuesday, Feb. 11. Newport said Dooley reached out to her, and Newport invited Dooley to attend. “I hate to see her business displaced,” Newport said. “I was surprised that her landlord hadn’t previously informed her of the market listing and potential sale.” Harris County Appraisal District records list Yaggi Real Estate Partners LLP as the longtime owner of both 2505 Ella Blvd and adjacent 1706 W. 26th St., which is the address for the ITEX development. The total appraisal for the two properties is about $1.5 million. Preston Yaggi, of Lee & Associates, said that although he does not own the

Community Affairs (TDHCA), which looks at a variety of factors in the application process. One of these factors, according to newly elected District C council member Abbie Kamin, is municipal support. “Developers seeking the City of Houston’s support must submit an application to the city’s Housing and Community Development Department,” Kamin said. “The department evaluates the applications on various criteria including access to public transportation, economic opportunity (and) strong schools.” Kamin said the application must meet a minimum of eight criteria, out of a possible 24, to receive a resolution of support. “The tax subsidy criteria awards points for community letters of support, from civic

Oak Forest’s Susan Dooley, the owner of dog daycare Polka Dot Dogs, has leased her 2505 Ella Blvd location for a decade and enjoyed success there. So it came as a blow when one of her customers told her about a developer’s intent to purchase the land that included her business location. A subsequent talk with a representative for her landlord confirmed what Dooley had heard. A subsequent talk with her landlord confirmed what Dooley had heard. The developer, the ITEX Group, is proposing a mixedincome, 180-unit project at 1718 W. 26th St., according to ITEX Director of Development Ali Morris. The working plan is for 55 percent of those units to be offered at discounted rates to those below a certain income threshold while the rest would be market rate. “We want (the development) to look and feel like the neighborhood,” Morris said. Shady Acres Civic Club board member Allison Newport said former District C Houston City Council Member Ellen Cohen referred ITEX to her as a contact and that the board met with ITEX in January. “The developer was interested in getting design input, and (learning) how they can help the neighborhood, both of which are amiable goals,” Newport said. Because ITEX is seeking to build affordable homes, it can apply for 9 percent federal tax credits funded by the Texas Department of Housing and

was the closing of her business, others at the meeting voiced concerns about the nature of the development itself. “I hoped that after voicing displeasure about the potential change, our neighbors would eventually embrace the unique opportunity to provide design input and appreciate the community benefits offered by ITEX,” Newport said. These benefits included unifying signage for the area as well as other proposed improvements. “I liked that (ITEX) said they’d be willing to help with Little Thicket Park,” civic club president Dena Musfy said. Newport said that since she’s been active with the civic club, there has been no other developer that has proactively engaged with it about a proposed project. “There are multi-family developments at 23rd and Beall, 26th and Durham, and several more in the works along

Area teams stay alive in basketball playoffs By Landan Kuhlmann landan@theleadernews.com Multiple high school basketball teams from around the area won their first-round playoff matchups earlier this week. Three teams were in action Tuesday as the St. Thomas boys scored a chance at revenge, while the Lutheran High North girls and Heights boys thumped their way to the next round. On the boys side, St. Thomas flew past Austin St. Dominic Savio 65-53 in the opening round of the TAPPS 6A playoffs. The Eagles (18-13) got 26 points from Johnathan Massie and another 23 from Maddox Kopp in the victory, which secured their second straight trip to the regional final. The Eagles face a tall task. They will face off against defending TAPPS 6A state champion San Antonio Antonian Prep (33-7), which ended the season ranked fourth in TAPPS 6A by the Texas Association of Basketball Coaches. Tip-off for that game is scheduled for 4 p.m. Saturday at A&M Consolidated High School in College Station. In girls action, District 18-6A champion Heights took down Houston Memorial 63-37 Tuesday night at Delmar Fieldhouse to advance to the Class 6A area round for the third time in four seasons. After taking a 13-point lead into halftime, the Lady Bulldogs overwhelmed the Mustangs in the third quarter, outscoring them 20-4 in the period.

Heights was scheduled to face Fort Bend Bush (20-13) on Thursday for the chance to advance to the regional quarterfinals. In private school action, the Lutheran High North Lady Lions defeated San Antonio Lutheran 69-28 on Tuesday night. Making their eighth consecutive trip to TAPPS postseason play under head coach John Slomcheck, LHN will face the winner of Pasadena First Baptist and Waco Reicher Catholic in the regional final.

Proposal, from P. 1B ment, a legally binding document, but it could also potentially violate the Fair Housing Act,” Kamin said. There is a resolution of support on this week’s city council agenda for three developments in District C, none of which involve any contribution of city funds. The Ella project by ITEX is one. The second is Dian Street Villas at 1433 Dian St. which proposes 100 family units. And the third is Heritage Senior Residences at Center and Moy streets, which would provide 135 total units for those age 55 and older. “The agenda item before council merely provides the city’s official support for tax credits allocated by the state,” Kamin said. At the Tuesday session for public comment, Dooley spoke about what she felt was a lack of transparency in the process.

“No one knew except for the civic club,” Dooley said. Chris Akbari, the CEO of ITEX, also shared details about its design process, particularly with regard to flood mitigation. Akbari said the lowestlevel garage is designed to let floodwaters in during significant floods like those caused by Hurricane Harvey. Also, the lowest inhabitable floor will be a minimum of 2 feet above the 500-year base flood elevation, which is about 4 feet above grade. Akbari said ITEX would offer relocation assistance to those uprooted. This would include both Polka Dot Dogs and HTX Made, which designs and fabricates custom products for businesses, architects and artists. He also said there were plans to add commercial space to the development that perhaps could be utilized by the businesses.

Kamin said that overall, she supports increasing the supply of affordable housing, both in the city and in District C, where housing costs are rising rapidly. “I am proud that District C has the opportunity to ensure those in our neighborhoods can afford to remain there,” Kamin said. “I also believe the city needs to abide by the objective scoring process that the housing department put in place to ensure that we do not allow discrimination and segregation to divide our city.” Dooley said she knows she can’t control what happens with the land and that her future on Ella was never guaranteed. “But we’ve been there 10 years,” she said. “They say they want people to be close to where they work, but they’re displacing a business where people are working.”

More than 40 years into her real estate career, Janet Schmidt’s fine-tuned philosophy hasn’t wavered. She tells it like it is, and believes her clients appreciate the bluntness and honesty when buying or selling their homes. “I shoot straight, and tell them the truth. There’s no building a big story, she said. “If it’s good it’s good, and if it’s bad it’s bad. I just tell you how it’s going to be, and that’s what you’ve got to do. Currently with Berkshire Hathaway HomeServices Premier Properties, Schmidt has been a licensed real estate agent since 1977. And though her path was gradual, she wouldn’t have it any other way. After graduating high school in the late 70s, Schmidt accepted her father’s offer to stay home in Timbergrove and attend real estate school. In no time, she was hooked. “I did, I loved it, and I’ve been doing it ever since, she said. A Houstonian by birth, Schmidt possesses extensive and intimate knowledge of area neighborhoods such as Oak Forest, Garden Oaks, Timbergrove/ Lazybrook and Rice Military along with Shepherd Park Plaza, Candlelight Plaza, Shepherd Forest, Candlelight Estates, and the Heights. That knowledge, she said, plays a key role in maintaining a connection with the neighborhood and in turn her clients, helping guide them to the spot best suited for them on their budget. “I have experience, and I think that’s a big deal, because you can see all the ups and downs in the market, she said. Over the last year, Schmidt said there have been a few distinct trends that have shaped how she reaches out to potential buyers and sellers. The biggest shift, she said, has simply been the demographic of her target neighborhoods of Lazybrook/ Timbergrove, Oak Forest and Garden

Oaks. As a result, she has shifted gears a bit with ideas and marketing campaigns toward that incoming younger crowd with families and young children in order to best serve the evolving area. “The people are moving back into the neighborhoods and going back to neighborhood schools, which really helps them, she said. “Then young families are wanting to move in because the schools are getting better. However, she also still believes in the importance of maintaining that generational connection with those she has known since before she dipped her toe into real estate. “I try to make (people) aware that I know this area extremely well, she said, having previously noted she thrives on repeat business. As the years have gone by, Schmidt has also undergone change on another front to adapt with the times. Whereas in the beginning worked primarily in residential listings, she now offers nearly a 50/50 mix of buying and selling. “Either way, I can take care of their needs, she said. In the end, she believes clients and customers appreciate her integrity, professionalism, and patience. Adding to her vast knowledge of local markets is her willingness to go the extra mile for her clients with the well-tested, no-nonsense pitch. And seeing as the straight-shooting approach has helped her become one of the area’s top agents – including the top producer for Berkshire Hathaway HomeServices Premier Properties two of the last three years – she believes there’s no reason to change. “Just having the knowledge of knowing people in the neighborhood personally from when I was a kid, I think that helps out a whole lot, she said. Anyone wishing to buy or list a home with Schmidt can reach out to her at 713419-7918 or via email at homes@janetandcecil.com.

XCL Resources signs lease at M-K-T in the Heights By Betsy Denson betsy@theleadernews.com XCL Resources, LLC, a private oil and gas company, has signed a lease for 16,328 square feet of office space at M-K-T in The Heights, according to a news release from real estate company JLL. XCL Resources will relocate in the fall of 2020 to the upcoming mixed-use development. “XCL is a modern, technology-driven energy company with a best-in-class local management team, and we are honored that they have selected M-K-T as the future home for their growing business, said Steve Radom, managing principal at Radom Capital, one of the developers for M-K-T. “The XCL team will add daytime vibrancy to our project and enjoy a variety of walkable amenities including onsite dining, health, and fitness options. According to the release, M-K-T is roughly halfway through its conversion from an industrial complex into a mixed-use destination. “XCL Resources was focused on finding non-traditional office space that balanced productivity and

Submitted by Windrose Land Services on behalf of Hines Multifamily division, the approved variances were: to allow a 20-foot right-ofway dedication along Gardendale Drive as opposed to the code-required 30 feet; to allow an alternate right-ofway turnaround configuration at the terminus of Gardendale Drive in lieu of a cul-de-sac; and to allow a reduced building setback of 10 feet along Gardendale Drive (local street) as opposed to

Campus Corner

COSMETIC DENTISTRY

Area schools need your support By April Petronella aprilpetrofox@gmail.com Editor’s note: This is the first in a monthly series called Campus Corner, in which April Petronella of the Greater Heights Area Chamber of Commerce Education Committee writes about topics important to area schools, students and their families. Representatives from Heights-area schools, nonprofits and businesses meet monthly as a committee to exchange ideas, network and form partnerships. Local schools rely on these community partnerships to implement important campus programming. There are numerous opportunities for both local businesses and individuals to get involved. Here are just a few: Scholarship opportunities The Greater Heights Area Chamber of Commerce is accepting applications for 2020 scholarship awards. Applicants must be seniors at a Heightsarea school and have plans to attend a college or vocational school in the fall. Local businesses are also needed to help sponsor scholarships for deserving Heightsarea students. Scholarships are both need- and merit-based and provide crucial financial assistance to allow young people to continue their education. Contact us for a list of qualifying schools and for application and sponsorship information. Free financial education Free financial education events are available from Houston Highway Credit Union for schools, parent-teacher organizations and other community organizations that serve local residents. Financial education

programs are ongoing at Garden Oaks Montessori Magnet, Helms Elementary and Katherine Smith Elementary. These events focus on financial literacy and budgeting — important life skills that are essential for a productive future. Please contact us if your school or organization would like to host such an event. Singing, dancing and cheering! The chamber’s Annual Crawfish Festival in the Heights, scheduled for Saturday, March 7, will feature several local school groups: • Helms Elementary Cheer

and Drum Line • Katherine Smith Cheer and Choir • Garden Oaks Montessori Singers and Cheerleaders • Sinclair Elementary Ballet Folkorico and Cheer • Oak Forest Elementary Rock Band These schools eagerly await a captive audience of smiling faces, so community support is essential. The event will be held March 7 from 10:30-6 p.m. in the parking lot at 411 W. 20th St., and schools will be performing at intervals throughout the day.

Because of increased demand, support for many local schools from organizations that provide essentials like food and hygiene supplies has become limited. Many students and their families are now counting on the community for help. The current needs at campuses in the area include: • Easy-Mac • Fruit cups/apple sauce • Peanut butter and jelly • Granola/protein bars • Cereal • Oatmeal • Baby formula • Diapers/wipes • Cleaning and hygiene supplies • Softball equipment (for a school that hopes to start a softball team) Items are being collected and distributed to schools through the Greater Heights Area Community Fund, a nonprofit organization. Contact us for more information on dropping off donations. Local schools also need community expertise and volunteerism. Career days at elementary campuses along with externship programs at certain middle schools provide an opportunity for community members to share their work experiences with young people. Schools also consistently request other volunteer help: reading to young students, assisting teachers, staffing special events, etc. Contact us to find out how your talents can make a difference in a child’s life! For more information about any of these opportunities, contact Cindy Reibenstein at rcreibenstein@aol.com or Wille Deifenbach-Jones at willie_diefenbach@yahoo.com.

IN MEMORIAM

Mildred E. Holeman

M

Chic, Western Stylish Clothes

RODEO SPECIALS

OCTOBER 13, 1926 – FEBRUARY 12, 2020

ildred Maxine Holeman, age 93, surrounded by family and friends, burst through heaven's gates on February 12, 2020, at 10:20 p.m. She was a force, a brilliant, creative, loving and complex mother, grandmother, aunt and friend. Mildred was born in Smart's Bottom, between Logansport, LA, and Carthage, TX. She had difficulty getting her passport because the address was in Louisiana, yet she was actually born in Texas to newly widowed Gracie Neal. Mildred attended Carthage schools and was mentored by loving teachers who realized her poverty and her genius. Her story is a true overcomers story. Mildred came to Houston as soon as she could. She worked several jobs, but the one that really paid off was as a waitress at Simpson's Dining Car, where she met her husband, Billie Jack Holeman. Together they raised four children with the help of her mother. Mildred was a working mother with an insatiable desire to succeed and live a life that counts. She worked as a legal secretary for attorney L. A. Kucera for 35 years where she was not only trained in law, but also became involved with the SPJST Lodge. Because of everything he taught her she developed a real estate and an insurance business and served on many governing boards. She spent many years continuing to help his clients and their families, all who became her extended family. Love God, love people, know your gifts, serve your community was her MO. She could never say "No". She was the fund-raising queen for her beloved church, Our Savior Lutheran. Her civic service included Shepherd Park Civic Club, Houston and Texas Association of Legal Secretaries (President), SPJST LODGE 88 in Houston (Board Chairman and

others) and Czech Heritage Museum in Temple, Texas (Board Member). One of her greatest joys was being selected as the 2015 Carthage ISD Distinguished Alumni Hall of Fame. From Mildred: "Reflecting back on my life I must profess the goodness of God in my life. I know that God had his hand on my head since my birth. He knew me in my mother's womb as I was being knitted together. He knew me and what I would do with my life. He has been gracious to me at all times, whether I was accepting second-hand clothes in Carthage, or washing the school cafeteria's towels at home and waiting for them to dry on the wood heater overnight to take back to school in return for a free lunch (I generated my own free lunch program). When I was young, I was ashamed of it. Today I am grateful. I am grateful that God has allowed me to live, to teach Bible classes, to be an encourager, to pray for and help the sick and needy, and to do all these things I could not have done them without the wonderful people God has put in my path. No matter how many bad things befall us, we know that God is in charge, and through his son Jesus Christ we are all healed. I know that even greater things await all of us when we are reunited in Heaven. How great will that be?" Mildred was preceded in death by her loving husband, Billie Jack and son, James. She is survived by her daughter Billie Brinkley and husband David; sons Greg and wife Renee; Henry and wife Laura; grandchildren: Travis, Bryan, Wendy and Adam; great grandchildren Kenley, Bannan and Jaxon. She will be missed by a host of beloved friends. Thanks to Ana and Sandra Latigo, two cherished employees and those who helped during her long illness.
