NOTICE TO TOWNSHIP RESIDENTS Winter is just around the corner - or is it already here to stay? Whichever, Belvidere Township Highway Department is prepared to start their snow removal season. We wanted to share some information with you so that we can do a better job of clearing snow from our roads in a timely and economic way.
Belvidere Township is dedicated to doing the best job of snow removal possible, within the restrains of reasonable cost. By its nature, there will always be someone who is plowed first or last. We operate on routes designed to best utilize our equipment and to give the fastest economic service possible. Conditions such as: When snow starts and stops, how wet or deep, and or how windy affect the timing, method and success of snow removal. There are times when it is impossible to make progress and we may have to delay starting or pull off the road. And there are times and conditions where we may only plow to keep roads open. Your understanding and cooperation is very important to our efforts. With the best planning and efforts, there are still things that go wrong. If you need to report special problems, please call 815-544-2029 and leave a message. Snow crews can operate all hours of the night, so patience and understanding can go a long way. Here are some specific issues you may need to deal with from time to time: OBSTRUCTION: Some residents like to landscape their yards close to the roads. For the safety of our snowplow crew, items such as rocks, bushes, fences, hedge walls and timbers should NOT be placed in the right-of-way. Homeowners who have such objects may be liable for any damages or injuries that those objects may cause. You should be aware there are rather deep right-of-ways in front of all homes, which the homeowner does not own. These right-of-ways serve many purposes including allowing crews to push snow off the pavement several feet to make room for future snowfall. Damage to any obstructions (railroad ties, boulders, posts of any kind, cars, etc.) on the right-of-way will be the responsibility of the homeowner, as these obstructions are in violation of State Statute. MAILBOXES: Winter is hard on mailboxes. By their nature, they are in conflict with the efforts to clear snow from the roads. At times, heavy slush discharges from a plow will knock down a mailbox. Most mailboxes, if properly placed and installed, will withstand heavy slush. The Township will NOT be responsible for damage to mailboxes knocked down by heavy snow or slush. There are times, under difficult winter conditions we may knock down a mailbox. In the event that damage is caused by a plow, a supervisor will investigate the claim. Upon finding a Belvidere Township snowplow at fault and providing the mailbox complies with postal regulations, the township will repair the mailbox, or replace mailbox/post if necessary, with a standard wooden post and box according to postal regulations (sorry, no fancy replacement). Each property owner is responsible for the condition of their mailbox and the approaches to them. Poorly maintained mailboxes may be lost to conditions other than damage by a plow. DRIVEWAY: An unavoidable result of plowing snow is a ridge of snow along the road and at the end of driveways. Operators do what they can do to minimize this when possible. You can help yourself by piling the snow you clear from your driveway to the right side (the side away from approaching traffic) this will minimize the snow ridge on your drive. NOTE: Redistributing the snow from your driveway into the road is prohibited. CUL-DE-SACS are wonderful peaceful places to live, but you will have to pay an additional price for your privacy. They are difficult to plow and cause many problems for the homeowner. Please be understanding of the additional problems they cause for snow removal crews. STUCK VEHICLES: Please do not ask or expect us to assist in pulling out stuck vehicles, we do not accept the liability nor do we have the proper equipment to do this. You should be prepared to call a local towing service should you get stuck. For those of you who are newcomers, especially from cities or southern states, you should make yourself aware of the differences in conditions, in removal methods and in responsibilities. There are a number of government agencies responsible for roads within Boone County. Knowing who to contact for a road problem could help expedite any problems you may experience. Belvidere is also a rural community that may dictate harsher snow conditions for both the resident and snow removal crew. Your proper preparation and driving techniques will help avoid problems for everyone. Please slow down and drive carefully during adverse conditions. ZBA & PZB Recommendations to the County Board – Support the WECS Text Amendment • In Boone County, we have a bedroom community. • Wind farms create an industrial overlay. • It is not good to place an industrial overlay where people live. • We heard testimony of the horrible things that are happening to people who live in wind farms, including: a. People moving out of the project. b. People taking on second mortgages because they couldn’t sell their homes. c. Children not doing well in school because they couldn’t sleep in their homes. d. People who suffer from the poor placement of turbines being ostracized in their community. • In Boone County, our current Wind Ordinance calls for a 1,000 ft. setback from homes. • Our current Wind Ordinance was written by wind developers for their own benefit. • Other counties in Illinois are making revisions and increasing setbacks for wind turbines. • We need to learn from these people who testified and other Illinois counties and increase our setbacks in Boone County. • We have had a tremendous amount of evidence submitted during the past 8 or so months of hearings regarding the Cleverdon/Kenney text amendment. • No Boone County citizen has submitted any evidence in opposition to this text amendment. • The manifest weight of the evidence submitted is in support of the text amendment. • We have the reports from the following Boone County Government entities: a. The Regional Planning Commission voted 4:1 that the Comprehensive Plan supports the proposed text amendment. b. Manchester Township formally submitted a letter in favor of this text amendment. c. No Boone County Township came forward via written or verbally to voice their opposition to the text amendment. d. The Planning Department was the only Boone County entity that has come out against the text amendment, but were not able to support their position when cross-examined. • The question we have before ourselves tonight is - Is this evidence submitted by the Boone Co. Citizens credible, or not? • We heard from 5 families who live near wind turbines, who: a. Represent 4 different wind projects, b. Represent 3 different states in the Midwest including Illinois, c. And who have suffered similar consequences to their health, safety & welfare. • We did not hear from, or were able to cross examine anyone who lives near wind turbines that has not suffered similar consequences. • Some have said that anecdotal evidence is inferior evidence. • But as ZBA members, that is usually the evidence we hear; we hear from real people in real situations. • Some of these families brought supporting documentation from experts to verify what they testified. a. Lawsuit Settlement – 19 individuals experienced health effects including sleep disruption, noise, flicker, ear problems, anxiety, and headaches and sued the developer. All 19 landowners lived closer than 2,640 ft. to the nearest wind turbine. b. Easement in Gross attached to the sale of their home which stated that the new owner could not sue the wind developer for anything related to the wind turbines including: Noise, vibration, air turbulence, shadow flicker, and view impact. c. Board of Health declaring their homes a “Human Health Hazard”. Dr. Jay Tibbetts, vice chair of the Brown County Board of Health submitted a letter that they had received 80 complaints of adverse health effects of which 50 were by sworn affidavits from people living within four miles of the Shirley Wind Farm. • After cross examining, we had no reason to doubt what they said was accurate. • We also heard from other experts. 1. Mr. Michael McCann, an Illinois Certified Review Appraiser, testified to the property value losses for residential dwellings in wind projects in Illinois. a. He showed that home sales within 2-3 miles of the wind projects in Lee, DeKalb and Livingston Counties were on average 23% - 33% less than comparable sales which were greater than 2-3 miles from the wind energy project. 2. We heard from Iroquois County, Illinois, Board Member – Mr. John Shure who testified: a. Iroquois County started with a Wind Ordinance similar to Boone County with setbacks of 1,000 ft. from primary structure for both participants and non-participants. b. Iroquois County has experience with two wind projects, Settlers Trail and Pioneer Trail, which were built when the ordinance had 1,000 ft. setbacks. c. They had complaints regarding noise and shadow flicker from these 117 - 396 ft. wind turbines. d. The health effects from low frequency noise and shadow flicker cannot be ignored. e. Iroquois County wished to site turbines where they would do no harm to its citizens so they have increased their setbacks to 12 rotor diameters from property lines with a waiver. 3. We heard from Dr. Schomer, a world renowned noise expert, who lives in Champaign County, IL and participated in writing the Illinois Pollution Control Board Noise Standards. a. He testified that these noise standards will not protect Illinois Residents from wind turbine noise. b. Dr. Schomer recommends for audible noise from wind turbines that public officials should require that the maximum A-weighted sound level at any residence be < 39dBA. c. A distance of approximately 1/2 mile from ONE turbine will give a 39dBA noise limit. If there is more than one turbine in the project, a greater distance is needed because acoustical power adds when there is more than one noise source. 4. Mr. Kevon Martis reminded us of the Illinois State Statue 55 ILCS 5/5-12020 Sec. 5-12020 which states: a. Illinois counties may regulate wind plants. “A county may establish standards for wind farms and electric generating wind devices. The standards may include, without limitation, the height of the devices and the number of devices that may be located within a geographic area.” b. Illinois law grants counties the right to regulate any land use “For the purpose of promoting the public health, safety, morals, comfort and general welfare, conserving the values of property throughout the county...” c. Wind developers ask communities to adopt zoning language that essentially awards free safety and nuisance (health, safety and welfare) easements across non-participating properties. d. A two-stage setback with a waiver empowers residents to negotiate on their own behalf with the wind developer. e. If setbacks are large enough and to the property lines then everyone involved has equal bargaining rights. 5. We also heard testimony regarding Boone County Lots of Record. a. Our current WECS Ordinance imposes a serious determent to those owning an undeveloped lot of record. b. It affords them no protection and actually limits where this lot can be developed when a wind turbine is located on an adjacent property. c. This text amendment supports property lines. We have heard some say that this text amendment bans wind turbines – that has proven to be false. A developer can: a. Lease more land b. Purchase land like Chrysler and Walmart did in Boone County c. Sign waiver agreements d. Use smaller turbines We have heard some say that requiring people to sign waivers is unconstitutional. a. Throughout Illinois, counties are using waivers in wind ordinances. b. Waivers allow County Boards to: 1. Protect citizen’s property rights, 2. Allows the developer to purchase property rights (Good Neighbor Agreements) and 3. Allows the citizens the right to choose between retaining their property rights 4. Or selling them to the developer. • The Zoning Board of Appeals is the Board that holds the public hearing and hears the evidence. • Then the ZBA votes up or down based on the evidence and sends that recommendation to the County Board on whether or not the proposed amendment should be adopted. On Tuesday, October 27, 2015, the ZBA voted 5-0 in favor of the Cleverdon/Kenney Text Amendment. On Wednesday, November 4, 2015, the PZB voted 4-1 in favor of the Cleverdon/Kenney Text Amendment.
