A Word from Our President: BMHBA Says Goodbye to Retiring Bismarck Building Official Ray Ziegler On August 12, Bismarck building official Ray Ziegler submitted a letter of resignation to the City of Bismarck effective September 13. Ray has worked for the city for 13 years in the Inspection Division and served as Building Official since 2007. While we wish Ray all the best in his new endeavors, I know his presence and Eric Brenden abilities will be greatly Board President missed by many in the building industry. The local building official oftentimes has a thankless job, caught in the middle between concerns of the public, the city and contractors. However, in my personal experience with Ray, he was always willing to listen to our concerns. “No” was not his first response to a question. The building codes can be quite complex, and there are many gray areas in the code book that require different answers based on the individual circumstances. With the record-setting building activity of the last couple of years, Ray listened to our concerns and was able to increase his staff. Even with the added staff, however, the inspectors have been hitting up to 25 stops a day. Some of the goals that Ray listed that he attained during his tenure as Building Official include: • Consistency among inspectors • Mechanical licensing program
• Increasing staff numbers • Weekly meetings • Flood plain management for CRS rating • Public awareness of building codes • Strategic plan for the future • Responsible budgeting • Realistic Zoning Enforcement • Customer satisfaction at an all time high Ray felt his greatest accomplishment has been achieving a higher rating for commercial and residential construction from the Insurance Services Office. “With this higher rating, property owners can realize lower insurance premiums in the City of Bismarck, City of Lincoln and Burleigh County. ISO issues this rating based on my management of the Building Inspection Division.” On behalf of the Home Builders Association, I would like to thank Ray Ziegler for all his hard work and good luck to him in the future.

Committee Highlight: Membership Committee
The membership committee has had a lot of new additions in the last couple months, so the committee is just starting to get rolling on some great new membership initiatives. The goal of the membership committee is to identify the selling points/benefits of BMHBA membership and use those to recruit new members and retain current members of the association while promoting involvement in association programs and activities. A few ways the committee works to achieve that goal is through contacting members in danger of cancellation, recruiting new members, helping to redesign our membership materials, and working with the events committee to come up with new methods for getting the membership involved at events. The committee is currently working on new recruitment documents and implementing some new member initiatives for upcoming events. There is also a new member orientation event planned for sometime in the near future. The committee and BMHBA staff are open to

Warning: FBI Computer Virus & How to Fix It Computer viruses, let’s face it, there are some nasty ones out there. The worst one we’ve seen recently is the “FBI” or “Moneypak” virus. The FBI virus, also referred to as the FBI Moneypak virus is dangerous malware categorized as ransomware first discovered in 2012 that cyber criminals use in an attempt to disguise themselves as the FBI. The FBI virus utilizes Trojan in order to gain access and lock computer systems. The FBI virus tries to persuade or scare unsuspecting victims to pay a fine by making fraudulent claims that the computer has been involved in illegal activity (downloaded or distributed copyrighted material or viewed child pornography, etc.) and demands a penalty fine of $100, $200, $300,
or more to be paid in order to unlock the computer system within the allotted time of 48 to 72 hours by use of Moneypak cards. This infection gets inside the system through security vulnerabilities found when the user visits infected websites or downloads infected files. OK, but how do you fix it? The best way is to restore from a previous state. You could try and run some antimalware software, but if you can’t log in then you are stuck. Want an easier solution? Go to this website: http://malwaretips.com/blogs/remove-fbivirus/ and follow the steps. They are pretty easy stepby-step instructions. If you are having problems, feel free to contact us at 701-221-0948.

BMHBA Membership Updates
Sept. 2013
September is Membership Madness! This September, the BMHBA is participating in Membership Madness - a membership drive contest through the National Association of Home Builders. How the contest works is this: Any member who recruits a new member in the month of September will receive triple Spike points for that member. Also, if you recruit more than one member, you’ll be entered to win a trip to the 2014 International Builders’ Show in Las Vegas! The winner will receive five nights at the Encore Hotel to be used during the 2014 International Builders’ Show, economy airfare for two people (value up to $1,000), and a $100 gift card. Members receive one entry for each new member they recruit after their first recruit. Local home builders’ associations are also up for prizes in this contest. Five awards will be given out in each HBA size category ranging from $2,500 to $500. We all know there are new builders and associates in our community - you are probably doing work with some of them. Take a couple minutes and tell them about what the BMHBA has to offer to a company like theirs. Not sure what to say? First, your own membership story is the best selling tool you have. Second, the BMHBA staff have resources to fill you in on everything you need to know - or just have the prospective member give us a call. Best of luck, and let’s build this association!
MEMBERSHIP CHEAT SHEET
Before you go out recruiting new members, here’s a cheat sheet of basic terms and facts you should know.
Annual Membership Dues Builder/Associate: $375 Affiliate: $50
Membership Definitions
Builder: These companies do hands-on construction work, whether it is building homes, doing remodels or commercial building. Associate: These companies include any company not technically “building.” That would include anything from electricians and plumbers to mortgage companies to suppliers. Affiliate: These members are employees of a current member company (builder or associate) who wish to be listed individually and receive their own correspondence from the association. This membership is great for real estate agents whose brokerage is a member or companies with multiple branches or individual sales people, for example.
REMINDER! Verify Your Contact Info in the BMHBA Member Survey The member survey has been sent out to all BMHBA members to allow you to verify your contact information, business categories, and give some feedback on BMHBA membership. If you have not received the survey, make sure to check your junk email box. The email may appear that it is sent from Survey Monkey. The survey information will be used to ensure that member information in the hard copy directory (to be published Jan. 2014) and online is as accurate as possible. We will also take into account your membership feedback in determining future BMHBA programs and events. Thank you to those who have already responded, and we encourage those who haven’t to take a minute to fill out this helpful survey.
Thank you so much for your help!

Mark Your Calendars for OSHA Training This Fall
OSHA Presents Multi-State Fall Protection Training Session
Falls are the leading cause of death in construction, accounting for one third of all work-related deaths in the industry. To underscore the top priority they have of protecting workers, the OSHA regional office has partnered with HBAs and the Associated General Contractors across North Dakota to host a voluntary Stand Down for workers from industries with employees who work at heights. A voluntary Stand Down can be very helpful in focusing all workers on the importance of safe work practices. The session will be broadcast as a webinar across multiple states and there will be host sites in Fargo and Bismarck. The Falls Stand Down session will be October 1 from 9 a.m. to 11 a.m. Be on the lookout for more info as the date approaches.

City Beat: Departing Thoughts as the Building Official for the City of Bismarck By Ray Ziegler, Bismarck Building Official
As I start to clean out 13 years worth of files, it reminds me of all the lives this position has had an impact on. I often think about all the do-it-yourselfers that finally made the decision to put their dreams of a new home of a major remodel into action. I would start by explaining to them the requirements on the application, the ordinances, and the building code requirements. Telling them to make sure they check out their subdivision covenants, asking if their sub-contractors are licensed and had they contacted the utility companies, etc. Typically, when they would get a little color back in their faces, I would calmly prepare them for the ride they would soon be taking with this type of project; telling them it may take several years and a couple bottles of aspirin to get to the final completion, that’s if they don’t take a vacation and work through the holidays. There were also hard times, when I’ve had to condemn property due to lack of maintenance. It’s the reasons why it got to that point which has always bothered me. It may have been no money, physically unable, vandalism or the loner who committed suicide and went undiscovered for over a month. There were the condemnations when social services had to be called in because of small children living in unsanitary conditions or the hoarders that caused the floor to cave in. There were the disasters like fire, flooding and wind damage. When disasters did hit and a fire wall performed like it should by keeping a fire in the garage, or the roof withstood 90 mph winds and no lives were lost, I know that it was built to code and my inspectors did their job. That’s gratifying. Then there are all the files dealing with the constant battle of trying to be proactive. It is a simple word – proactive – that is easy to say, but almost impossible to keep up with. I can only think of two years when we were actually working our way out of reactive mode. New permits were being processed quickly, old permits where getting closed out, staff was in a great mood, zero turn over and caught up on training. I have been fortunate to see the quiet times when 10 inspections was an average day and the inspectors had a little time to work with a contractor. You could enjoy your vacation time and not think about what was waiting for you when you got back. These last several years have put us all in the reactive position of just trying to keep up, inspectors hitting 25 stops a day and feeling guilty about taking a day
off because it puts a greater workload on their peers. These bountiful times we are in are also very trying times that come with a price tag. Time will tell if I did my job, if the life safety provisions of the codes have been implemented to the best of my abilities, if my inspectors were able to take enough time to be accurate and the training I helped to provide was adequate. As I close out my final files for the City of Bismarck on September 13th, I will find the answer to my own question on whether I was successful. Like my two predecessors before me asked, do I feel as strongly today about the impacts of this job as I did when I first accepted it? The answer is “absolutely.” I am surrounded by a wonderful staff, been relied on by contractors, architects and engineers, and settled thousands of disputes. But the last file is where I have kept all the thank you cards from over the years, from boss’s day, to departing employees, to someone I had helped. That is what I will depart from this job with. A very sincere thank you to the Home Builders Association.
The BMHBA thanks Ray for his service as Building Official and for being so willing to work with the local builders and the association along the way.
We wish him the best of luck in the future. See Eric Brenden’s President’s Letter on page 3 for more.

N.D. considers amendments to building code
At the end of July, North Dakota Association of Builders’ members attended a public hearing for adoption of Jason Eid the North Dakota State Building Code. NDAB President This event is coordinated by the Building Code Advisory Committee, made up of appointed officials from multiple elements of the building and development industry: one representative each from the plumbing, mechanical contracting, electrical, architectural, home building and engineering fields, along with one building official and one fire official. This input can be from a member of jurisdictions that follow either the North Dakota State Building Code or a modified version per a Home Rule charter; input can be from anyone, not only a city’s designated building official. allowed until April 30 for any code-abiding jurisdiction to submit amendment proposals to any of the 2012 International Code Committee's five separate construction codes, including the International Residential Code (IRC), which is used for all one- and two-family dwellings. The Advisory Committee’s recommendations were distributed Aug. 12 to the eligible towns, cities, counties and committee members that make up the voting assembly. This assembly has about three weeks to review all of the proposed amendments before finalizing. This meeting will occur Sept. 4-5 at the North Dakota Department of Commerce’s offices. Only the assigned representative from each jurisdiction (usually a senior building official) will be authorized to vote; however, if any individual amendment fails to receive two-thirds’ approval, a revote will occur using votes apportioned towards that community’s population. Once all voting has been completed, the final approved amendments will be published this fall, distributed to code-participating communities statewide, and take effect Jan. 1, 2014. As always, we encourage members to take part in this process and be informed on how our state’s code is developed. If you have interest in the future, please contact me: (701) 237-0510 ext. 160 or jasoneid@eid-co.com.

BMHBA Building Buzz
Sept. 2013
Builder confidence rises 3 points in August August 15, 2013 - Builder confidence in the market for newly built, single-family homes rose three points to 59 on the National Association of Home Builders/Wells Fargo Housing Market Index (HMI) for August, released today. This fourth consecutive monthly gain brings the index to its highest level in nearly eight years. “Builders are seeing more motivated buyers walk through their doors than they have in quite some time,” said NAHB Chairman Rick Judson, a home builder from Charlotte, N.C. “What’s more, firming home prices and thinning inventories of homes for sale are contributing to an increased sense of urgency among those who are in the market.” “Builder confidence continues to strengthen along with rising demand for a limited supply of new and existing homes in most local markets,” noted NAHB Chief Economist David Crowe. “However, this positive momentum is being slowed by the ongo-
ing headwinds of tight credit and low supplies of finished lots and labor.” Derived from a monthly survey that NAHB has been conducting for 25 years, the NAHB/Wells Fargo Housing Market Index gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores from each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. Two of the HMI’s three components posted gains in August. The component gauging current sales conditions rose three points to 62, while the component gauging sales expectations in the next six months gained a single point to 68 and the component gauging traffic of prospective buyers held unchanged at 45.
