How your home sale can fall apart

One reason Sellers like subject-free offers is that they make it almost impossible for a sale to collapse. But, subject-free sales are very rare. A subject is a condition that must be satisfied before the sale can go through. If a subject can’t be satisfied, the Buyer can usually withdraw from the contract without any financial penalty. Inspection pitfalls The biggest reason that home sales fall apart these days is because of defects discovered by the Buyers during inspections of the property by a qualified home inspector. A “subject to inspection” contingency gives the Buyers permission to inspect the property to their satisfaction. The Buyers pick their own licensed home inspector and pay the bill before making up their mind to complete the sale. When defects are discovered that the Buyers are unwilling to accept or correct at their own expense, the contract comes up for re-negotiation. In this situation, the Buyers usually give the Sellers a set of conditions under which they will remove their “subject to inspection” contingency and complete the sale. This may involve a price reduction or a promise from the Sellers to repair some or all of the defects. If the Buyers and Sellers can’t come to an agreement, the deal is off.
