Lawsuit cost district more than $70,000 Documents shed light on council decision to settle pharmacy case

Newly released documents by the District of Mission show the municipality spent more than $60,000 unsuccessfully defending itself in a lawsuit it eventually concluded it was destined to lose. A settlement reached in early 2013 – prior to the presiding judge making a final ruling – also saw the district pay $8,199 for the legal costs of the plaintiff, who alleged

the municipality failed to comply with the Local Government Act and acted in bad faith when it changed a bylaw to prohibit a pharmacy from opening on First Avenue. The total cost to the district was $70,028, with staff time not included in that number. In November of 2014, prior to the municipal election, council unanimously voted to release documents relating to the court case. Those documents, including emails from

the district’s lawyers and minutes from closed sessions of council, shed new light on the origins of the bylaw, and the resulting legal action. In February 2012, a group approached the district to inquire about the likelihood of obtaining a business licence for a medical marijuana dispensary downtown, according to the documents. Two months later, on April 17, the district received an application

to build a medical clinic and pharmacy for a First Avenue property. There was no mention made of marijuana, but the district began inquiring about how it could block the application. Two weeks later, on May 2, council ordered staff to prepare to overhaul its zoning bylaw to prohibit pharmacies and medical clinics in the downtown area. The company working to establish the pharmacy said they had no

intentions to be involved in medical marijuana and filed a lawsuit, saying it had received assurances such an operation was allowed and alleging the district had operated in bad faith. The company said it was losing $17,500 per month because it had already recruited a pharmacist and pharmacy technician and was paying mortgage and other building costs. Mission woman killed in car crash

A single-vehicle crash on Boxing Day claimed the life of a 26-year-old Mission woman. Police say a 2009 Chevrolet Aveo went off the road in the 11700 block of Dewd-

ney Trunk Road on Dec. 26 around 6:30 p.m. and came to a stop in a ditch after striking a tree on the driver’s side of the vehicle. The driver was the only occupant. She was

extracted from the car by firefighters and taken by air ambulance to Royal Columbian Hospital where she was treated for severe injuries. She succumbed to her injuries three days later.

The driver has been identified as Ashley Crouch. The cause of the crash has not yet been determined and investigators are still awaiting a mechanical report on the vehicle involved. Police

say the area of the roadway where the crash occurred is flat and straight, but did not have any lights. “It was dark and there was light rain at the time,” said Sgt. Shaun Wright.

Lawyers also warned a ruling could have “political ramifications,” noting that “there would be of course discomfort in reasons issued which imply or conclude that the district acted unfairly or improperly.” After council received the report,Tilbury tabled a motion for the district

to pursue a settlement with the plaintiffs prior to a ruling. The motion passed, with Mayor Ted Adlem and Coun. Dave Hensman opposing any settlement that didn’t involve the district buying the property in question. According to the minutes of that meeting, Stevens, who at the time was still a member of CRMG, “registered her objection to the way in which this matter was discussed, characterizing the mayor’s behaviour, in some cases, as aggressive and intimidating.” Stevens would later leave CRMG, along with Couns. Tony Luck and Jeff Jewell. Two weeks after telling counsel to pursue a settlement, Stevens, Luck, Jewell, Tilbury and Coun. Larry Nundal voted to approve a deal. Adlem and Hensman again voted against, and “expressed their strong opposition,” according to meeting minutes. The initiative left the district on the hook for the plaintiff’s legal costs, but avoided a costly finding of bad faith and the awarding of significant damages.

Today, three years after graduating from Heritage Park secondary school in 2011, Lloyd continues to be involved in the issue, thanks in part to local programs like the Rotary Youth

“It was great to see people who had done everything that I want to do and it was inspiring to know I could do it too if I really tried,” Lloyd said. “It was great to be in that atmosphere with people who wanted to make a difference in the world.” While there is no International RYLA in 2015, Rotary District 5050 holds an annual four-day RYLA event in Washington State, where participants meet at a retreat to grow as leaders and listen to professional speakers. Lloyd previously attended the event and said it also provides an experience that is hard to find. “You exchange ideas and you do activities together in those four days. It’s really intense.” Lloyd – who was a founding member of the Fraser Valley Rotaract club – said she developed friendships and remains in touch with people she met during the event. “When you’re between the ages of 18 and 30 … your life changes a lot. Mission council meeting times are being changed and topics for discussion during question period are being broadened. Beginning at the next council meeting on Jan. 19, committee of the whole meetings will take place at 1 p.m. inside council chambers, and regular council meetings, including public hearings, will start at 7 p.m. on the same evening. The Monday meeting dates remain unchanged. Previously, committee of the whole meetings were held at 6 p.m., followed by the regular council meet-

ings. Wednesdays were also reserved for meetings on larger issues or overflow items from the week’s agenda. Council approved the changes this week, but one councillor was opposed to the meeting time changes. Coun. Jenny Stevens said changing the meeting times back to the way it used to be more than 10 years ago is “not a good idea.” Stevens believes it would make it more difficult for councillors and the public who work during the day to participate. “I would like for (meetings) to remain in the evening,” said Stevens.

Conducting the committee of the whole meetings in the afternoon is more economic and more efficient, noted Mayor Randy Hawes. “I have concerns about staff being here all day, and now are here at night,” said Hawes, who added staff only need to be at the meeting when items from their department come up. Coun. Jim Hinds noted having one designated meeting day will allow councillors to attend community events on other days. Allowing open dialogue during question period will make council more accessible

to the public, Hawes added. “(People) don’t have to be there that night,” he said. In the past, the public was only allowed to ask questions related to the night’s agenda. According to the district’s policy on question period, each member of the public will have up to three minutes to ask a question, and council reserves the right to defer a response if the information is not available. Question period is limited to 15 minutes at the end of each meeting.

Affordability creeping away

The new year will be another expensive one in B.C. The Canadian Taxpayers Federation is advising residents to brace for tax and fee hikes. In B.C., there will be at least four such increases. MSP is going to cost a family of three or more another $96 per year as of Jan. 1. B.C. Hydro customers will see electricity fees go up six per cent, or $72 per home, on average, as of April 1. B.C. Ferries will also start charging 3.9 per cent more in fares that day, too. ICBC, meanwhile, is expected to hike basic auto insurance about $36 per car sometime in 2015. EI and CPP taxes are going up $23, as well. And sometime in the new year, Metro residents could be asked on a referendum if they want to add half a per cent to the provincial sales tax to pay for transportation and transit improvements. That could cost the average household $150 to $250 a year – the latter would be the single biggest tax increase in the country in 2015.

We won’t yet start discussing property taxes, but it’s not like they’ve gone down in the past decade or so. And where is all this money supposed to come from? The same place as usual: your bank account. Hopefully your boss was good to you this year. If not, you’ll have a little less discretionary income for the foreseeable future. Remember that the next time our elected representatives consider giving themselves a raise. For all their talk about affordability, B.C. just keeps getting to be a more expensive place to live. The referendum will be an interesting result – will Metro residents agree to hand over more of their money for the betterment of the region, or tell politicians to take a hike and go find, amongst themselves, another way? If you make just one resolution, could it be to not buckle every time one level of government or another pleads poverty? – Black Press

The U.S. is ripping us off on water Tom Fletcher

B.C. Views The U.S. has Canada over a barrel on water as well as oil these days, but the tide is turning. Last week I mentioned a new book called The Columbia River Treaty – A Primer by members of Simon Fraser University’s climate adaptation team. This slim volume makes the case that B.C. has ended up with a shockingly bad deal from this 1964 treaty, which concerned itself entirely with flood control and hydroelectric power. In those days there was little or no environmental assessment. Agriculture, fish habitat and aboriginal impacts were ignored. More than a decade after the disastrous flood year of 1948, once Ottawa stopped its bureaucratic delays, U.S. public and private power utilities paid B.C. $254 million to build three dams on the Columbia system.

Those dams (and one at Libby, Montana that mostly floods B.C. land) hold back the huge spring runoff from the Rockies and then dole out water for power production in B.C. and for the 15 hydro dams previously built downstream in the U.S. The U.S. payment was for half the power over 30 years, which B.C. didn’t need at the time. Then our American cousins cut us another cheque for $64 million, an estimate of the value of flood protection from 1968 all the way to 2024. Boy, did we get taken. The SFU team calculates the value of that flood control to the U.S. at more like $32 billion. That’s not even the worst of it. The Kootenays were once the leading fruit and vegetable growing area in B.C., bigger than the Okanagan. Now in the Arrow Lakes and other reservoirs, levels rise and fall dramatically to steady the flow south. In addition to the large areas permanently flooded by the Mica, Duncan and Hugh Keenleyside dams, this renders more of B.C.’s prime bottom land impassable. B.C. is paid precisely zero for this sacrifice, while Washington state has developed a $5-billion-a-year farm economy

using our stable irrigation source. That has helped their tree fruit growers push some Okanagan orchardists out of business. As U.S. billionaires continue to bankroll

The U.S. Army Corps of Engineers and its private power partners dammed everything they could find, exterminating a fishery bigger than the Fraser that had sustained aboriginal people on both sides of today’s border for thousands of years. B.C. Energy Minister Bill Bennett and

SFU’s Jon O’Riordan both described to me their experience at the Columbia River Basin conference, held last October in Spokane. Their main impression was that Americans, including traditional tribes, want those salmon runs restored. Vast amounts have been spent on hatcheries and habitat to speed recovery below the Grand Coulee dam, which stands like a giant tombstone for migratory fisheries above it. Should the Americans ever manage to get salmon above their biggest dam, it will largely be up to B.C. to provide sufficient cool water to keep them alive. That service has an increasing value to the U.S. as well as an ongoing cost to B.C. Bennett surprised some in Spokane when he said the U.S. needs to pay more for the benefits from the Columbia River Treaty. The flood control agreement expires in 2024. The treaty requires 10 years’ notice for either country to exit. Climate shifts are expected to make B.C. water more important than ever. Your move, Uncle Sam. tfletcher@blackpress.ca

Keep planning progressive, moving forward The Downtown Business Association has every right to be concerned when deja vu 1990s is facing them in the face again. Then, many were optimistic Mission would rise out of the ashes of despair and finally commence some downtown/waterfront development. Sadly, the mayor and council of the day did not have the appetite nor apparent vision to demonstrate needed leadership and the project was shelved until recently. Add to this initiative the branding component to complement progressive development. I raised the prospect

of eliminating trucks from downtown with our MLA, and proposed commencing the much touted bypass and temporary diversion of trucks at Horne. Our MLA dismissed the idea, ending with the cliche, “trucks operate best going in a straight line.” Citizens rejoiced when CRMG commenced a development plan for downtown and we were all optimistic of some visionary leadership. But while right to buy the old Buy-Low store, the notion of a non-tax revenue university or lowcost lease for IT business was folly. Buying the Canada Post building is a no-brainer and should

be purchased post haste. Unfortunately, lack of visionary leadership again prevails, as the new council decides to shelve the downtown project. Instead of being the purview solely of council, Mission needs a leadership development group, such as a downtown revitalization action committee, including informed members of the DBA, chamber, municipal staff, two to three council members and an equal number of public at-large to develop projects, who will instead keep positive and progressive planning moving forward. I suggest the DBA

and new council members assertively engage the mayor and demand action, not more delay, in the overall best interests of all Mission citizens, who will be proud what a new downtown revitalization plan will elicit. Surely not all the 10-point action plan must be shelved a year or more just awaiting Canada Post plans instead of continuing the assertive work on the remaining eight points or adding additional components, given the $5.8-million exclusion of highway relocation has been determined. Think about shut-ins getting mail I am writing about the changing of house to house mail delivery to community mail boxes in Mission. I understand why rural areas have community boxes because, first, the houses are spread apart, and second, they are spread in a wide area. But in the city, the houses are close. Contraband seized

A Boxing Day bust at Mission Institution’s medium security unit has led to a large seizure of contraband items. Correctional Service Canada said the contraband included amphetamines and methamphetamines. The estimated “institutional value” of the seizure is nearly $20,000, according to officials. In a release, CSC noted that it uses various methods to prevent drugs from being smuggled into its correctional institutions. “These tools include ion scanners and drug-detector dogs to search buildings, personal property, inmates and visitors,” the release states. “CSC is strengthening measures to prevent contraband from entering its institutions in order to help ensure a safe and secure environment for everyone. CSC also works in partnership with the police to take action against those who attempt to introduce contraband into correctional institutions.”

The popularity of hunting in B.C. continues to increase, from about 81,000 licences issued in 2003 to more than 100,000 last year, which means more resident hunters are losers in regional hunting lotteries. BCWF compiled statistics for moose, the most popular big-game target. Moose populations have declined in some areas while both applications from resident hunters and the share reserved for guides has risen. In 2005 there were 56,000 applications for moose, with only one out of five successful. By 2013, there were nearly 67,000 would-be resident moose hunters, 54,000 of whom were refused a moose tag.

The top Platinum would be my choice because it’s interior is so different from the Dodge, something that truly separates the two cars plus it has all the latest safety features including the autonomous braking system when a crash is detected. Much has changed in 10 years for the 300 but the same goodness that was in the 2005 model is still here; it is the refinement that makes this a modern sedan. If you leave your vehicle with your tools or valuables in it for just a moment, you might as well advertise free equipment for the taking. At job sites, fences have to be erected to keep people out and many end up hiring security guards so crooks can’t get at the valuable building products at night. Despite the level of awareness for the need for tighter security at building sites, too often it doesn’t extend to the vehicles used to transport the valuable equipment and materials. I have seen trucks and vans with upwards of $50,000 worth of equipment lying on the floor without any real security. People that drive open bed pickup trucks have a real challenge when it comes to security. You can buy a canopy and secure it that way, but sometimes you need to

carry large and unusual shape objects and the rear gate of most canopies are not designed to be left open while driving. There are a few ways you can solve this problem. One way is to install a permanent toolbox that mounts to the rails of your truck box, and has either two lids or one large lid that opens from either side or back to front. These toolboxes are available in plastic, steel, and aluminum. I recommend steel or aluminum, which will cost you between $550 and $850. This type of toolbox works well for people that

carry smaller amount of tools and supplies around. If you transport larger amounts of these items, then I suggest a job-site box, which is a large container that can be left at a job site. They are very secure and come in a variety of sizes. Van drivers can outfit their vehicles with shelving units down one or both sides. These also come in differing sizes and configurations enabling you to tailor them to your specific needs. You can also incorporate small parts bins to organize fittings and larger ones to house small tools – they will keep your stuff from rolling around on the floor. You should also think about installing a steel bulkhead partition behind the driver seat, because

I have seen tools launch themselves like missiles toward the driver as the vehicle comes to a sudden stop. Actually, it’s not really a matter of choice because Worksafe BC requires companies to install these protective barriers in commercial vehicles. To secure a van from intruders you can buy what’s called a hasp-nlock. This type of lock is a puck style lock with two plates of steel around it. When installed correctly, it is almost impossible to remove and keeps your tools and equipment safe. It is available at most locksmiths and costs about $175. One more idea is to install window screens to prevent any smash and grabs from happening. It sounds like a lot of work, but remember, it just takes a split second and everything is gone. Be proactive instead of reactive and stop crime before it happens. Esther (Mary) Enns, passed away Friday. January 2, 2015 at Cheam Village, Agassiz, BC at the age of 94. Born January 19, 1920 in Burwalde, MB. Esther was the firstborn child of Peter P. and Margaretha Wiebe. She is survived by sisters Alvina of Parksville, BC and Marjorie of Winkler, MB. Esther married William Enns of Altona, MB September 3, 1944 and settled in their first home in Altona. They later moved to Kronsgart and Plum Coulee where Bill worked for Pool Elevators. In 1968 they moved to Abbotsford, BC where they built their last home together. Six children; Franceen, Carcross YK; Bill, Chilliwack, BC; Marlene,Chilliwack,BC; Kit, Leucadia,CA; Ted, Dallas, BC; Peter, Mission,BC. Grandmother to 14 and great grandmother to 31. She was a very talented seamstress, among many other creative talents. Her gift of writing notes and letters brought encouragement to many. Never afraid to make a long distance phone call, she stayed in touch with siblings, daughters, and friends. Her home was always open to those travelling through and served a simple,tasty faspa of her delicious homemade buns and plum jam. She was predeceased by husband Bill (1994) and brother Frank (2008). FISHER Robert Andrew Robert passed away peacefully at home in Chilliwack, BC on December 25, 2014. He was born on April 21, 1932 in Parry Sound, Ontario and his parents were James and Alice Fisher. Robert was the youngest of 12 children. He was predeceased by his wife Margaret and his grandson Grayson. He will be forever missed by his children; Jean (Brian), Russell, Mark (Sandra), Colin (Nicole), Fiona, Derek (Tara); grandchildren; Morgan (Jamie), Jordan, Raelene, Kimberly (Devon), Marlee, Amelia; great grandchildren Mckenzie and Serah. Robert left Ontario when he was a young man and moved to Vancouver where he met and married Sonia Reese and started his family. He did various jobs until settling into a truck driving job at Imperial Oil Ltd., where he worked for over 25 years. In 1972 Robert moved to Abbotsford and then in 1976 he got the long haul itch and bought his first truck. He spent the rest of his career on the road. In 1985 Robert married Margaret Jessop. Later in his career when the children were older Robert and Margaret would go trucking together, travelling all over the States and Canada; having many fun times stopping over in Vegas or Reno. Robert and Margaret moved to Chilliwack when he retired to be close to children and grandchildren. There will be a Celebration of Life held for Robert at Jubilee Hall, 7989 Bradner Road, Abbotsford on January 31, 2015 from 1:00 - 4:00 pm. Jean passed on to be with the Lord after several years struggle with Alzheimer’s Disease. She is lovingly remembered by her husband Peter and her two sons Bradley (Bridgit); their children Brandon and Maya; Dean and his children Jordan and Jessica. Jean was born in Prince Rupert to an Air Force family. Her family was posted to Europe for Jean’s early years and she became fluent in several languages. They returned to Vancouver for Jean’s high school years. After graduation, she married and had her two sons. Jean got her degree in nursing at University of Victoria after she became a single parent. She had a variety of careers while raising her sons. These included: RN at Cowichan Valley and Shaughnessy hospitals, private investigator, bodyguard, care giver in a group home and prison matron. In her leisure time Jean enjoyed reading her bible, cycling, walking her dog “Oreo”, cross country skiing, watching hockey and soccer. Special thanks to Valhaven Rest Home and staff, Abbotsford, for the kind and attentive care given to Jean the last two years. A memorial service will be held at Sardis Community Church, 45625 South Sumas Rd., Chilliwack, on Friday, January 9, 2015 at 2:30pm. She was born in Speers, Saskatchewan April 30, 1929 to David and Barbara Friesen along with 2 brothers and 3 sisters. She married William (Bill) Rempel in 1947 and had 6 children. Most of her adult life was spent in Mission raising her family, serving the Lord in the church, working as a volunteer for MCC and visiting family and friends. She loved to travel to see relatives and was a great host to those who returned the visit. Barbara was predeceased by Bill in 1968. She was also predeceased by an infant son, her parents, brothers Jake and Isaac and sister Betty and many in-laws. She is survived by daughters Connie (Dan) Schubert and Debbie (Wayne) Perry and sons Rob, Phil (Elsie), and Dan (Linda), brother David Friesen, sister Sarah Bueckert, sister-in-law Mary Nickel, 16 grandchildren and spouses, 26 great grandchildren and many other cousins, nieces, nephews and friends. A Visitation will be held at Woodlawn Mission Funeral Home 7386 Horne Street, Mission on Wednesday, January 8th from 6:30 8:00 pm. Graveside Service will take place at 11:00 am on Friday, January 9th at Hatzic Cemetery 34867 Cemetery Road, Mission, followed by a Memorial Service at 1:00 pm at the Cedar Valley Mennonite Church 32840 Janzen Avenue, Mission. It is with great sadness that we announce the passing of Al Yaworski on December 27, 2014. Al was born on the homestead near Bruno, SK on 2-22-22. He was predeceased by his loving wife, Margaret. After serving with the Edmonton Fusiliers during World War II, he went to work with the CPR. He spent his whole working career with railway construction; his last few years working for Pete Siemens. He was a member of the Royal Canadian Legion and The FO Eagles. He is survived by his children Diane (Gary) Mussel of Swift Current, Bernadette (Doug) McMullin of Balfour, Clarence of Cranbrook, Linda (Dan) O’Grady of Kitchener, and David (Tisha) of Fernie. He is also survived by his step-children Ron (Rose) Schaufert of Abbotsford, Gary (Tecia) Schaufert of Abbotsford and Dennis Schaufert of Mission. He had many grandchildren and great-grandchildren. He will be greatly missed by his cousin, Francis Shynkaruk of Saskatoon. We would like to thank his family Doctor Scaman and his doctor from the Cancer Agency Dr. Galbraith for their care.
