Trail group reacts to B.C.’s new seniors’ advocate

Appointing a provincial seniors’ advocate is a step in the right direction, according to a local group advocating for seniors health care. But the president of Trail’s Society for the Prevention of Cruelty to Seniors (SPCS) is disappointed to learn that the new position will report directly to the Minister of Health. “(This) presents almost a conflict of interest situation as many seniors’ concerns are about how health care services are presently delivered,” said SPCS president Candy Parrilla. “I would see her primary focus as looking firstly at the Ombudsperson’s report and the very limited movement by the government in acting on the recommendations in the report.” Kootenay West MLA Katrine Conroy couldn’t agree more. When was the last time a volunteer group was asked to raise 50 per cent of the costs for a children’s park in Trail? That’s the question skate park enthusiasts are asking. Park fundraiser Scott Daniels is shaking his head and questioning how to roll forward with the long awaited but nowhere in sight allwheel Silver City skate park, following a recent decision by Trail council.

Two years ago, council committed to fund 50 per cent of the $550,000 skate park capital project once the skate park fundraising committee reached its $275,000 goal. To date, the committee has raised in excess of $61,000 in cash commitments from the community, but in these less than stellar economic times, a more realistic goal is needed to push the project forward, according Daniels. He approached the city in December with a request to reduce the committee’s goal to a more achievable $100,000, and after a three month wait, was disappointed to learn that Trail council turned down that appeal earlier this month.

“We were very disappointed to receive notice that the skate park is not included in the 2014 budget,” said Daniels. “The committee needs a realistic and achievable goal.” Given the extensive list of capital projects planned this year, the absence of the committee’s portion of funding meant the inclusion of the project would result in the deferral of another priority project. “Given that the park would not be constructed this year, allocating funding to this project is not the preferred approach,” explained David Perehudoff, Trail’s chief administrative officer. “As noted, council did not agree to reduce the funding

goal given that the project will not proceed in 2014.” The city will consider revisiting the skate park plan for 2015 but with Trail’s overall financial challenges with respect to recreation, funding the major project would be difficult, the CAO added. The skate park project gained momentum last fall after the Trail Parks and Recreation Master Plan recommended the initiative as a priority for youth in Trail, citing a near 50 per cent response rate to 1,000 mail-out surveys, with 23 respondents and six agencies providing written and verbal comments in support of prioritizing the skate park project. The New Democrat health critic said she supports the creation of the position, but the post requires more teeth to allow the advocate to work more independently of government. An independent person would be able to investigate the individual and systemic needs of B.C.’s seniors, Conroy said in a statement to the Canadian Press. “There is a very real need for this position, as seniors across the province face both individual and systemic problems and struggle to get the care they need and deserve,” she said. “We also have called for a strong and independent advocate that would be able to stand up for seniors without being encumbered by the reality of being employed by the people whose decisions she is evaluating.” Isobel Mackenzie was appointed Wednesday by Health Minister Terry Lake to head the Office of the Seniors Advocate, fulfilling a government promise to ensure a strong voice for the province’s 700,000 elderly residents. Child and spousal support payments

T

ax policy surrounding child and spousal support payments is one of the more contentious topics when it comes to helping people prepare their tax return. And considering the frequency of relationships ending in separation, this tax issue arises frequently. Child support is reported on both parents’ returns but does not factor into tax calculations. It’s a reporting and tracking mechanism used by Canada Revenue Agency (CRA). Agreements set prior to April 1997 are exempted. For these older agreements, child support is included in tax calculations. Spousal support is not so straight forward. In general, if there is a court order requiring “regular periodic basis payments” that permit

the recipient “discretion as to the use of the amount,” then the payer deducts the spousal payments as an expense from income and the recipient claims the spousal payments as income. An occasional lump sum spousal support payment as a rule is not reported by either party on their tax return. However, if the lump sum spousal support payment is an arrears payment to catch up a delinquent payer, or is an acceleration payment to secure future funds for a recipient, these are reported on the tax returns. Also, regularly or irregularly timed lump sum non-discretionary directed spousal support payments as a rule are not reported by either party except in the case of a court order specifying this type of payment

for identified expenses like rent, mortgage, medical, tuition, and the like.

Tax Tips & Pits Then CRA will waive the “periodic” and “discretion” requirements and treat this spousal support as deductible for the payer and claimable for the recipient. It’s worthy to add, until a court order is in place, spousal support payments are not reported to CRA by either party, unless the court order once completed states a retro-

active reporting requirement, and in that case, once the order is in effect, it’s applicable to the current and preceding calendar year’s payments only. Confused? Now let’s add child support twists. If child support payments are in the mix with spousal support, any shortfall on the total support paid is assumed to be a shortfall of spousal support. In other words, the kids’ cash comes first which means a lower than court ordered spousal support amount is reported as the actual spousal support paid and received on the two tax returns. So, the shortfall becomes spousal support in arrears, not child support in arrears. Further, if a court order providing both spousal and child support doesn’t identify

a specific amount as spousal support, all support paid is considered child support. This means the parents’ tax returns only report child support and there is no claim of spousal support expense by the payer or spousal support income by the recipient. It’s likely abundantly clear how this area of tax policy can become an emotional quagmire for separated couples. There may be equal clarity regarding the importance of properly drafted legal paperwork so as to settle things for the parties involved ... and for CRA since a review of these documents is sometimes required to finalize tax assessments. also resulted from a sweeping report by Ombudsperson Kim Carter who made 176 recommendations to improve the lives of B.C.’s elderly. Carter’s 448-page report, The Best of Care: Getting it Right for Seniors in British Columbia, also contained 143 findings.

It concluded a threeyear investigation into seniors care in B.C., making recommendations to improve home and community care, home support, assisted living and residential care services for seniors. The government responded to Carter’s report promising to focus on six areas, including establishing the position of a seniors advocate. About 130 people were considered for the position. The SPCS is a nonprofit, volunteer-based seniors’ health care advocacy group located in Greater Trail. Though troops capped off a 12-year mission in Afghanistan last week, there remains another kind of Canadian presence. Steve McVicar, a Trail orthopedic surgeon, is just finishing up the last leg of volunteer medical work in northern Afghanistan’s Kunduz province, about 70 kilometres from the Tajikistan border. He’s volunteering on a six-week stint with Medecins Sans Frontieres (Doctors Without Borders), working as an orthopedic surgeon and teaching Afghan doctors. “The country here is becoming increasingly dangerous with a general election only weeks away; Luckily, I will be coming home just before the election in two weeks,” he told the Times via email. “Amongst the political rhetoric and propaganda,

there is still a population here trying to survive this country and they do need basic health care. “The trauma and violence is staggering.”

After stabilizing and operating on 10 gunshot patients with more on the way, McVicar is called to the emergency room to see a patient whose X-ray shows a bullet lodged right beside the brain stem. Amazingly, the patient is neurologically intact. The volunteer is then informed the hospital is full — one dose of antibiotics and a Band-Aid and the patient is discharged home.

This is McVicar’s reality as he clocks 12-16 hour days in a generally full 90-bed hospital. He’s got his hands full as the facility’s orthopedic surgeon, working alongside a Danish general surgeon and an American anesthetist. This is not the first time the Rossland resident has left his peaceful life behind. Last year he signed up for the same experience with Doctors Without Borders and prior to that he was with the Canadian Army in Kandahar in 2007 and with the U.S. Army, also in Kandahar, in 2010 — both times as a civilian surgeon under contract. McVicar has learned a lot since his first experience as a doctor overseas, where he performed trauma surgery on Canadian soldiers, Afghan police, Afghan civilians, the Afghan Army and even some Taliban members. The surgical experience and satisfaction he gets from

saving lives keeps him dedicated to the job, which is a natural choice for the former marine engineer with the military. But this doesn’t mean his work isn’t difficult. He’s forced to amputate a baby’s right foot when a mother brings in her child whose legs were badly burned about a month ago. The electricity suddenly goes out and the backup generators don’t kick in. He’s in total blackness in the operating room until nurses use three iPhones to light the room so he can finish the procedure. It’s late and he needs to get back to the compound to sleep because tomorrow is another day. Doctors Without Borders is an organization dedicated to helping people worldwide where the need is greatest, delivering emergency medical aid to people affected by conflict, epidemics, disasters or exclusion from health care.

Just after the B.C. government released its principles for negotiation of the Columbia River Treaty renewal, the Ktunaxa Nation is urging negotiators to keep salmon restoration on the table. “While we have achieved a remarkable amount of consensus, our negotiators have not reached common ground with B.C. on all matters relating to the possible renewal of the treaty,” said Ktunaxa Nation Council Chair Kathryn Teneese. “We have sharply divergent views on whether the restoration of upper Columbia salmon is a matter that should be addressed within a renegotiated Columbia River Treaty. “Our view is that salmon restoration is largely about the management of dams which currently block fish passage and the management of river

flows on both sides of the border, and both of these management issues are at the heart of the Columbia River Treaty.” Ratified in 1964, the Columbia River Treaty is a management agreement between the two countries that allowed for four dams to be built on the Columbia River, three in B.C. and one in the U.S. – Libby Dam on Koocanusa. Columbia Basin Trust, a Crown corporation, was created in 1995 to support social, economic and environmental wellbeing in the Columbia River Basin using some of the proceeds of the treaty. Following the twoyear treaty review process, Energy and Mines Minister Bill Bennett, Kootenay East’s MLA, announced on March 13 that B.C. wants to continue the treaty, The U.S. is yet to state its position.

Committee to meet to discuss path forward From page 1 Since that time, regional recreation cost sharing with neighbouring communities has collapsed, leaving the city with a $300,000 budgetary shortfall. “Ultimately the loss of funding from the Beaver Valley and Warfield does impact the city’s capacity,” said Perehudoff. “Council will need to grapple with the construction of what would most likely be a regionally used facility without any sort of funding assistance.” Daniels conceded that the current political situation is a “financial quagmire,” affecting present and future recreational opportunities in Greater Trail. “Although the committee has had regular monthly meetings for more than two years now,” he continued, “they will be meeting again this weekend to discuss a path forward.”

The G7 nations have issued the statement following today’s emergency meeting in the Netherlands. The leaders say they are ready to “intensity actions” against Russia if Moscow escalates the conflict further. Ukraine today told its remaining troops in the Crimean peninsula to leave the Black Sea region, formally annexed by Russia last week, because it’s too dangerous to remain.

The gathering began at about 6:30 p.m. local time on the sidelines of the Nuclear Security Summit, and went about a half hour longer than expected. U.S. President Barack Obama was the first to arrive and was greeted by Dutch Prime Minister Mark Rutte at his official residence. The G7 leaders joked and laughed together briefly before getting down to business - what to do about Russia’s aggression in eastern Europe amid the worst crisis for the region since the Cold War. Earlier in the day, Harper said economic concerns will have to take a back seat as the West determines how to respond to Russian aggression. “Within the context of Canadian foreign policy, we will do what we can to maximize the commercial opportunities for our firms,” the prime minister told a roundtable with Dutch business representatives. “But,” he continued, “we will not shape our foreign policy to commercial interests.” When it comes to a global security crisis such as that

unfolding in Ukraine, Harper said, “business people have to be aware that there may be risks to them and the government will take those risks, because at those points in times the government’s foreign and security policy priorities become paramount.” The remarks likely foreshadowed what Harper would say at the summit itself. The meeting came shortly after Russia announced a travel ban on 13 Canadian politicians and officials in retaliation for travel and economic sanctions Canada imposed earlier this month. Harper has called for a “complete reversal” of Russia’s annexation of Crimea and has also warned long and loudly that Russian President Vladimir Putin cannot be trusted amid the worst crisis for the region since the Cold War. White House officials have said Obama is prepared to launch widespread penalties against key sectors of Russia’s economy, including its energy industry, if Putin dares move into southeastern Ukraine.

OBITUARIES CONZON, VITTORIO (VIC) ANGELO – It is with heavy hearts that the family of Vittorio (Vic) Angelo Conzon announce his passing on March 17, 2014, due to leukemia. Vic was born on April 21, 1925 in Monastier, Tr e v i s o , Italy and came to Canada with his two sisters in 1933. He worked on his uncle’s dairy farm and went to Webster School “graduating” after grade six. He then worked in a bakery, later starting at Cominco and retiring in 1983, after 33 years there. Vic happily collected many retirement cheques, all the while continuing the life-long pursuits that gave him great joy: gardening for food (because you can’t eat flowers) and spending time in the great outdoors, preferably with gun, fishing rod or bucket to be filled with huckleberries, asparagus or mushrooms. He loved family, especially his grandchildren. Vic whiled away the winters with books, and planted tomato seeds in pots on the kitchen window sill in February to get a head start on the very serious business of producing a bumper crop. Vic was predeceased by his brothers Rino and Mario in Italy and his sisters Dina Brown and Rita Mallette. His is survived by Mary, his loving wife of nearly 56 years and his children Grace (John Feesey), Gloria (Greg Tomecek) and Grant (Carla Mauro) and his beloved grandchildren Vanessa and Julia Conzon and Peter and Alec Tomecek, all of whom he taught to fish at secret locations on the Columbia River. Vic is also survived by numerous nieces and nephews and many cousins, as well as many hunting and fishing buddies, especially Andy Gagliani. Vic enjoyed life immense-

He enjoyed many hours fishing in Beaver Creek and hunting in the area in his younger years, and he loved cars. He only managed to gain a grade 8 education but after a few odd jobs he took a carpenter apprenticeship taking his schooling in Vancouver, and was proud to have been the youngest journeyman in B.C. at the time. He apprenticed with Stang Construction, with whom he worked for many years starting at the age of 16. When Stang Construction closed up he was self-employed for a few years before starting with the City of Trail in August 1981.

He worked there until going on disability leave on June 24, 2005. He would have officially retired from the city in May 2014, upon his 65th birthday. One of his most treasured jobs and experiences when he took a brief hiatus from Stang Construction was his time up north working with his cousin Lidio on the Liard Hot Springs, near the Alaska Highway. He always dreamed of going back there. He met the love of his life in the early 70s and they were soon joined at the hip. They were married in 1977 and in 1979 he built their family home, mostly himself with some help from friends and family. This home saw three daughters brought home and countless hours of joy and laughter. Years later saw the addition of three sons-in-law and seven grandchildren. He – along with his laugh – was a fixture in Skands Campground in Christina Lake, where he spent countless hours in the water playing with his kids, their cousins and friends, and any other kid who wanted to wait in line for a jump off his shoulders. Jerry will be remembered for his hard work, his laughter, his compassion, and his determination. But most of all, he will be remembered for the great love that he had for his family. Councils demonstrate fiscal responsibility by pulling out of recreation agreements

am encouraged to see the level of participation and interest among so many community members lately on issues that impact all of us, specifically our recreation opportunities. This is true community engagement and it is good to see. I write in response to an editorial about “Parochial attitudes hurting entire region,” from the March 20 paper. First; no one enters politics with a goal to divide and separate communities. In fact, the aim would be the opposite; to unite and grow as communities. We all have friends and family in each of the Lower Columbia communities. We work and play in each other’s back yards. Despite municipal boundaries we share many things. Second, when one submits their name for consideration on the ballots at election time, we do so because we feel that we

have something positive to offer. We want to make a difference now, and for our future generations. We want to make sure that our kids and their kids can enjoy a good life, HERE, in the Lower Columbia as we do. For the most part, the majority of us get along quite well. We spend countless hours together, establish great relationships, attend many meetings together, and share an understanding and respect for each other’s opinions at the regional table. At this time, while our respective recreation programs are the focus of local attention, I am reminded of Einstein’s words, that “from discord, find harmony [and that] in the middle of difficulty lies opportunity.” In seeking harmony and looking for opportunity, I am curious about some things. I wonder why three separate councils, and

Area A director an electoral area director have decided not to renew recreation agreements with the City of Trail? As has been consistently reported, the same reason seems to underlie all four decisions to not renew recreation agreements. That reason is the lack of accountability and responsiveness on questions specific to recreation contributions, which have been put to the city on numerous occasions. Also consistently

reported are the questions from the three councils and area director that remain to be answered. Specifically, in the spirit of transparency and accountability: How are all the funds “held” by the City of Trail allocated and spent? What do our individual (municipal) tax contributions for recreation return to our municipalities and residents, in other words; what is the actual usage of the TRP cards? Our taxpayers have a right to know. Each of the elected representatives have clearly demonstrated fiscal responsibility in asking these questions, and ultimately, in deciding to withdraw their contributions. Without an accounting of how municipal and resident taxes are spent, the three councils and director were left with the difficult choice: continue submitting annual contributions, no-questions-

asked and no accounting for spent dollars, or, to take a stand and insist on an account. Two meetings between the Beaver Valley and the City of Trail permitted the BV representatives to explain their position, which was to continue with a resident reimbursement program, develop our own data base, and then find a fair and accountable contribution amount for a future council to consider. I am also curious, and pose the question to Trail City Council, “Can you provide the information that we are all looking for?” Ali Grieve is the director of the Regional District of Kootenay Boundary’s Area A, which includes the rural areas bordered on the west by the Columbia River, on the south by the Canada / U.S. Border and on the north by Champion Lakes.

Kudos to seniors dancing team Thank you for the story on dancing at the Columbia View Lodge (Sessions get seniors dancing, Trail Times March 18). The write-up by Sheri Regnier was very well done. However, there are a few things I would like to add. The people who help with the dancing are like a team, and they do an excellent

job. Although I started this, my dance friends do as much as I do and I would like them to have equal recognition. They are: Janice Alexander, Jeff Alexander, Barry Benner, Karen Lees, Ann Lucarelli, and Hanne Smith. Margo Wright and Monty Roblin are the staff

members who make it all possible every week. They make sure the residents are safe and having fun, and they participate in dancing too. The residents of Columbia View Lodge are a great bunch to work with. They are so much fun that they make the whole night great. So many residents want to dance

NDP’s survival on the line

T

he B.C. NDP leadership contest is officially underway, with the entry of Vancouver Island veteran John Horgan in a reluctant reprise of his 2011 run against Port Coquitlam MLA Mike Farnworth. Unfortunately for them, weekend campaign events were overshadowed by revelations of flagrant abuse of taxpayers’ money by the executive and board of the Portland Hotel Society. A pair of audits finally released last week on this network of Downtown Eastside social agencies revealed systematic looting of the $28 million a year in taxpayers’ money that has kept this supposed charity running. Alas for the NDP, local MLA Jenny Kwan not only failed to keep an eye on it, her recently separated husband was one of the executives who took part for years, and she benefited to the tune of $35,000 in luxury travel. That’s what we know about, since much of the evidence wasn’t produced for the auditors. When this Lifestyles of the Rich and Famous scheme finally came to light, Kwan hastily paid back the $35,000 and announced she’s taking an unpaid leave of absence. Her tearful claim that she believed nothing was wrong is simply not credible. She not only must have known of her husband Dan Small’s jet-set ways, she participated in at least two trips, one to Vienna and Bristol, England to do “research” and attend a poverty conference from high-end hotels. If it wants to retain any

shred of credibility as it spouts misleading poverty statistics and simplistic solutions, the party must get rid of Kwan, who has two years left to max out her MLA pension.

MLA pensions were a factor in the 2010 ouster of Carol James, who infuriated the old guard by trying to defuse a public backlash against a generous pay and benefits package worked out in private between the NDP and the B.C. Liberals. Kwan would later take a leading role in the caucus revolt that forced James out as leader. Long-time political watchers will see the PHS abuse as a bigger, uglier version of the Nanaimo Commonwealth Holdings Society scandal. There the siphoning off of bingo funds from charities cost Mike Harcourt his job as premier. In that case, NDP MLAs sat on the board, took their monthly cut and kept quiet. There’s more. Horgan became enraged last year at the reporter who took a tip from the B.C. Liberals to reveal

the NDP was skimming constituency office budgets to pay for its own “ethnic outreach” operation in Vancouver. Horgan had rubberstamped the plan with a sincedismissed legislature accountant, and thought he had kept it secret after the AuditorGeneral blew the whistle. His willingness to assess its ethics remains in question to this day. Then there is Craig Keating, who took over as party president from Moe Sihota last year. Did he inherit the $72,000 salary negotiated by Sihota with the B.C. Federation of Labour and two of its largest unions? If so, do Horgan and Farnworth think this is appropriate? Will the party’s joined-atthe-hip relationship with government unions even be discussed in the carefully staged leadership contest that’s about to begin? Then there’s the policy shipwreck left behind by Adrian Dix. His plan to use environmental assessment as a weapon to torpedo industrial projects remains popular with the party’s urban base. Farnworth and Horgan have paid lip service to the notion that projects like the Trans Mountain pipeline expansion should be properly assessed. Meanwhile the federal NDP fights to keep stacking public hearings with preselected protesters. The party may wish to consider what would give its next B.C. leader any hope of governing. Getting up and active with PAL Spring is the perfect time to turn over a new leaf and start getting active. Introducing regular physical activity into your life is an important first step towards better health, a happier mindset, and more. The whole family will benefit from increased activity and getting on the road to a healthier lifestyle. There are so many known benefits to physical activity and an active lifestyle. Among them are a reduced risk of heart disease, premature death and stroke. Being active has also been proven to help improve self-esteem and confidence, help you sleep better, increase your energy and reduce depression, among many other things. Furthermore, it helps maintain functional independence, mobility, and bone health. For many of us, it can be quite daunting to take that first step towards an active lifestyle. And it can be more challenging to start something new without any help. The good news is residents of BC have access to a free physical activity counselling service called the Physical Activity Line (PAL). Through a phone call or online, qualified exercise professionals are available to provide exercise and physical activity advice and help you develop a customized physical activity plan for every member of the family, from children to older adults. When it comes to physical activity, more is better. To achieve the health benefits, it is important to try and progress towards the Canadian Physical Activity Guidelines, which recommend at least 60 minutes of physical activity per day for children and youth and 150 minutes of moderate-to-vigorous intensity activity each week for adults. Adults and older adults should also add muscle- and bone-

strengthening activities that work the major muscle groups at least twice a week to help with balance and prevent falls for those with mobility impairments. Physical activity doesn’t have to mean playing a sport or going to the gym. Playing a family game of tag, going for a swim or taking a walk outside with the family pet or to the store to get groceries count towards the physical activity recommendations. Try out something new; you may find your new favourite activity! In any case, you’re bound to have some fun and feel like a happier and healthier you. Fruitvale native Ella Matteucci and the Clarkson University Golden Knights shocked the heavily-favoured Minnesota Gophers on Sunday as they skated to a 5-4 Frozen Four final victory and their first NCAA championship. A breakaway goal by Shannon MacAulay with under five-minutes remaining in regulation, vaulted the number-2 ranked Golden Knights into the NCAA Div. 1 women’s hockey stratosphere, eclipsing the number-1 ranked defending champion Gophers for the coveted title. “Just thrilled beyond belief,” co-head coach Matt Desrosiers

said in a post-game interview. “The girls believed in themselves all year, even coming into tonight I had a feeling about the way they were going to come out and play. They weren’t going to back down and they proved that tonight. I thought they stuck with it very well tonight and I’m just thrilled and speechless right now.” The goal gave the Knights a 5-3 lead, and despite ceding a Gopher marker with 3:41 to play, the team would hold on for the victory. “No one wanted it more than us, we’ve wanted it all year and we worked so hard for it,” said MacAulay. It’s the first national title

for Clarkson, 31-5-5, of any kind, and Matteucci played in all 41 games for the Knights this season. The 21-year-old defenceman anchored a blueline that was the stingiest in the NCAA, allowing just 1.12 goals per game, and played a major role in the final match, with the Golden Knights icing just four defencemen for the final game. The Knights defeated Mercyhurst University 5-1 in the semifinal. Matteucci received a scholarship to play for the Potsdam, N.Y. team while attending the Athol Murray College of Notre Dame in Wilcox, Sask. where she won a national title with the Hounds in 2011.

Dear Annie: I have played in a local poker league for 10 years and have built solid friendships with these people. Three years ago, a new crew joined our crowd. At first, they were friendly, but in the past two years, one of them began having home poker parties. I was completely caught off guard when I started noticing Facebook posts with all of our friends, and my husband and I were not on the invite list.
