Patients with appointments at the Osprey Medical Clinic got a rude surprise when they got a phone call saying the clinic had closed. A notice on the door now reads: “Osprey Medical Clinic is now closed. If this is an emergency: Please go directly to the hospital or call 911.” “We were unable to reach an agreement with the doctors that would make this a self-sustaining business,” said Ken Gadicke, a Creston accountant who owns Osprey Medical Clinic in partnership with his former accounting firm partner, Rick Minichiello. “It is unfortunate that it has come to this but we couldn’t keep it going. We had no choice but to close it.”

Doctors say contracts breached From page 1 A message being distributed to patients by three physicians who worked out of the clinic at the Creston Valley Mall, Drs. Raphael Elemuo, Tara Guthrie and Susan Hopkins isn’t quite so diplomatic: “The owners of Osprey Medical Clinic breached our contracts in January of this year. In response to our request that they honour the terms of our contract, they have locked us out and closed the clinic without notice. “We are currently working to find an interim solution that would allow us to serve our patients while we relocate. Should you have an urgent medical problem during this time, please attend the emergency department at the Creston Valley Hospital. “As your physicians, we sincerely regret the inconvenience to you and appreciate your patience and understanding during this difficult time. We would like to assure you that we continue to be committed to our patients and will keep you informed as further information becomes available.” “There was no notice,” Elemuo said when the three physicians met to speak with the Advance on Monday. “We didn’t even tell our patients.” Elemuo immigrated from South Africa and started his practice in Osprey Medical Clinic on Oct. 3, 2011. His contract with the clinic is for three years, he said. Hopkins and Guthrie said their contracts do not have end dates. Guthrie said the clinic’s finances were brought up by Gadicke in a meeting with the doctors last March. “Then we didn’t hear another thing until January,” when, the physicians said, their contracts were breached. Under the terms of their contracts, doctors work for the clinic, which bills the health system for their services in return for 30 per cent of all billing generated within the clinic. The 30 per cent is meant to fund the clinic’s staff, management, equipment and rent. “When I was doing my research before relocating to Creston I found that the 30/70 split was a standard practice in most clinics,” Hopkins said. Hopkins said that once the doctors believed the clinic had breached their contract they sought representation by a law firm.

“We knew things might not work out, but we expected at the very worst we would have a month’s notice to relocate,” she said. On Friday afternoon, the clinic’s locks were changed. Guthrie, the only doctor working in the clinic at the time, was busy seeing patients and was unaware of the lock change when she left work that day. “I don’t lock up and nobody told me,” she said. “I can’t even describe how I feel about getting zero notice that the clinic was closing. And now I feel terrible because I left another clinic to work at Osprey and my patients are being affected.” While the doctors’ access to patient medical records had not been locked out on Monday morning, they said there was no certainty about what it would take to assure their access to the files in the near future. “The files are electronic and there is no concern for their security,” Guthrie said. “But we need to find a way to continue to look after our patients. No one in the medical system seems to know what to do next as they haven’t seen this situation happen before.”

“This is an unusual situation,” Hopkins admitted. “We appreciate all the efforts that have been made by the [Creston Health Working Group] to recruit us to Creston and we know that everyone is trying to find a solution that is best for our patients.” “We are shocked, completely taken aback,” Elemuo said. Creston Mayor Ron Toyota said that the health working group and elected officials would not get involved with what has become a legal dispute. “But we will work to ensure that patients are able to get the treatment they deserve from their doctors,” he said. “I know that temporary alternatives have been offered and that no one will rest until patients’ needs are being met.” Regional District of Central Kootenay Area B director John Kettle, who also chairs the Kootenay East Regional Hospital District board, said on Monday that there is no role for the hospital district to play in the dispute. “But a temporary premises in the hospital has been offered and I know that our health care system will cooperate in finding a solution that works for the patients,” he said.

An unusually crowded public gallery at the Jan. 28 regular town council meeting emptied quickly when a public hearing was recessed at the request of a zoning amendment applicant. Jeffrey, Marcie and Jake Taylor, owners of a property at 418 Ninth Ave. S. that now has a duplex, have applied to rezone the property from R-1 (single family residential) to R-5 (multifamily residential). Approval of the application would allow for expansion of the existing building to create a fourplex. Of the 40 neighbours who received notices about the proposal, nine expressed concerns about the development and others attended a meeting with the applicants to voice their opinions. Concerns expressed by nearby residents, said Coun. Wesly Graham, who conducted the public hearing, included parking (the proposal includes six on-site parking spots), increased traffic, lowering of property values and obtrusive security lighting at the back of the existing building. “The applicant has requested that this public hearing be recessed until the Feb. 11 council meeting,” advised Ross Beddoes He explained that it was the Taylors’ desire to meet with neighbours in an attempt to address their concerns before proceeding with the rezoning application. By unanimous vote (Coun. Tanya Wall was absent), the public hearing was recessed.

Untraceable 911 calls still coming to RCMP BY LORNE ECKERSLEY Advance Staff

What police thought last week was a simple answer about untraceable 911 calls hasn’t turned out to be as effective as they had hoped. Creston RCMP received another eight calls from several different cell towers last week, all of which were from cellphones no longer connected to a service plan and therefore impossible to trace back to the caller. “I guess we just keep trying,” Staff Sgt. Bob Gollan sighed on Monday. Police Beat Creston RCMP responded to 62

calls for service from Jan. 27-Feb. 2, Gollan said. January 27 •Police determined that a complaint from a customer banned from a business was a civil matter. •A person who lost a soft-covered notebook on Canyon Street reported the loss to police in the hope that it will be found and turned into the police station. •A well-being check on a Highway 3 resident indicated a male was OK. January 28 •A truck popped out of gear on Vancouver Street and rolled back into a fire hydrant. •A child walking to school saw a cougar on 26th Avenue and ran home to report the sighting to her parents.

No trouble was evident at the Highway 3 residence. •A male reported being assaulted by two unknown people while he was walking in the 2800 block of Highway 3. January 29 •A driver sustained a minor injury in a single vehicle accident on Highway 3A near Sirdar. •No injuries were reported when a vehicle that stopped for a pedestrian on Canyon Street at 14th Avenue was rear-ended. •Well-being checks to residents on Fifth Avenue North and 16th Avenue North indicated they were OK. •A turning vehicle clipped a parked car on Canyon Street at 10th Avenue North. No injuries resulted. •A semi slid off an icy Lower Wynndel Road when the driver pulled over to put chains on. February 1 •A suspicious vehicle was reported on Seventh Avenue North. •Police are investigating a report of an assault involving two males on 19th Avenue North. •A well-being check at a 33rd Avenue North residence found no one home and the resident was later found to be in the hospital. •A Canyon Street resident complained about “negative comments” on Facebook. •When police checked on the well-being of a Highway 3 resident she said she was fine but that it was just too cold to go out. •Another in a series of barking complaints was made by an Erickson resident. February 2 •An Erickson Road resident made three calls to police in a short period. The first reported an abandoned child on a neighbour’s deck, which turned out to be a large doll. He then complained about two suspicious vehicles near his home, and then reported a break and entry. Police were unable to verify either report as being true. He was later taken to hospital for an assessment.

Committee to decide fate of environmental sustainability service GREG NESTEROFF Nelson Star An environmental service that some members of the Regional District of Central Kootenay want to withdraw from will survive intact for at least another year. Following a staff presentation last week, chair John Kettle said the consensus was that the sustainability service be left alone for now. However, he plans to name a four-member select committee to review it and recommend by September whether to "revamp, change, or punt." The committee hasn't officially been established, but Kettle said he plans to ask directors from two municipalities that want out — New Denver's Ann Bunka and Nakusp's Karen Hamling — to sit on it with two directors who want to stay in — rural Castlegar's Andy Davidoff and rural Nelson's Ron Mickel. While the committee mulls the issue, the service will draw no new taxation and its existing projects will be paid for out of reserves. The service, established four years ago, was meant to deal with things like energy conserva-

tion and reducing greenhouse gas emissions. However, Nelson refused to join, and now several areas suggest the scope has grown beyond what was originally intended yet they receive little benefit. In all six areas, including Salmo, Castlegar, and rural Creston, have served formal notice of withdrawal and Kettle said three or four others "are on the fence." "That's why it's critical to look at this. If you add four more to the nay column, that probably kills the service. We might as well take one last chance at fixing it. If not, it will be what it will be." Municipalities and electoral areas are required to give two years written notice to withdraw from a service, which also requires provincial approval. However, the service could also be effectively killed during budget discussions.

So he and his wife, Grace, bought the machine and installed it in Overwaitea on Christmas Eve. Currently the machine is stocked with about 150 movies, including current hits and a range of older films. All are on DVD, and Gilmour has started offering Blu-ray discs, as well, and is looking into games. Video Fix is catching on slowly, he said. Some customers have commented that they feel intimidated by the machine, but the process is quite simple: Movies are selected on a touch screen, then customers swipe

their credit card to pay for the rental, which is due back the next day. Video rentals are important locally, said Gilmour — while many people use Netflix and other services, Internet bandwidth limitations can make that difficult for others. And while the box looks very similar to Redbox, which has 40,000 North American kiosks, Gilmour doesn’t have to worry about the larger company trying to cut into his business. “They won’t come into small communities,” said Gilmour. “They need large volume.”

Perception is everything

What a difference 48 years makes. When the announcement came last week about folk singer Pete Seeger’s death at the age of 94, I thought about how well he had lived his life, and what an extraordinary run he enjoyed, being involved with so many of the important social and political issues for most of his time on Earth. Then, on Sunday, I felt only anger upon learning that Philip Seymour Hoffman had died. Hoffman was one of a very few actors whose movies I watch simply because they have a role. Katherine Keener, John Cusack, Penelope Cruz and James Gandolfini come to mind. My response to Hoffman’s death, of course, was purely selfish. But anger turned to sadness as I processed the circumstances. To die with a heroin needle in his arm was all the more pathetic knowing that he had been drug free for more than 20 years until a prescription medication helped his addiction regain a foothold a couple of years ago. If a generation should ever have a hero, Pete Seeger would have served quite nicely for mine. As children we saw him on TV variety shows as a member of the Weavers and as a solo performer. But my real discovery of his work came when I ordered Pete Seeger’s Greatest Hits album from the Columbia Record Club when I was a teenager. On the cover is a photo of Seeger seated on a piano stool, guitar lying flat on his lap. Seeger wears a vest and he holds his glasses as though he has just removed them to look into the camera lens. A banjo lies on the floor beside him.

I played that album hundreds of times, and that particular version of We Shall Overcome still sends shivers down my spine. During the sing-along, Seeger says, “But the

To the Editor: We, the opponents to the fire protection scheme in West Creston, have failed miserably because we were complacent, too kind and too naive, and expected kindness in return. At the first moment the existence of the illegal sign was brought to our attention, we should have sounded alarm bells and shouted for a full mobilization of every able body. We should have “occupied” the two entrances to West Creston and to Mr. Binks’s house, and demanded immediate removal of the immoral sign, a prompt count of returned petitions and the discounting of any petitions signed Jan. 1 and after. Sadly, in our ignorance and security of abysmal returns, we totally underestimated the will of the powerful and their determination to get this monster of a tax wrapped around our necks. In hindsight, we were to have a bonfire, fireworks, hot toddies and counting the signatures, and celebrating this ugly and repulsive trial behind us. And while we, the gullible and naive denizens, waited for the triumphant announcement to be displayed, a devious scheme was being hatched and to this moment is vehemently denied. Everybody swears he is innocent, all is well, justified and kosher, except the dead dog, spilled garbage and shredded relations. How tragic and pitiful in this so blessed corner! So, if the righteous are so correct and justified, why is there no sign of victory? Why are the insurance companies not beating on our doors with refund cheques or at least offering the promised fabulous discounts? Can we

Fire service will be useless To the Editor: West Creston has seen a serious subversive effort in the past 10 years to slap us with yet another tax via an absolutely useless fire service. First came the fancy idea of a $1 million fire hall. We exposed them, and they backed off. A freshly repainted carrot emerged, somewhat withered, but with the cost upped to $1.5 million, as if this world has never heard of it. We sent them packing. There was a forest fire a few years back. Those fake firefighters were sipping coffee on “standby” while some of our Good Samaritan firefighters extinguished it. The forest and properties were saved. Since then, those fake firefighters mock us. The fire protection society got tax dollars for a metal garage. Snow destroyed it! They got their next pile of money. A tree fell on the building and the uninsured fire truck, destroying it once again. Do you think they quit in shame? No! A petition came door to door. It did not go well and was cancelled. A bigger propaganda gun was needed, this time an official one, running until Dec. 31. Several scaremongering fliers were sent out. They even got an article in the Advance. The petition failed, but was that the end of the story? No! A hell-sent extension was provided.

By this time, the propaganda brigade was in overdrive. At last, Russian roulette might succeed. To hell with those who don’t want it, don’t need it or can’t afford it. We, the targeted victims, were simply shut out, bulldozed away. We didn’t get an Advance interview, never mind two. Consider Creston Fire Rescue, with $2 million worth of equipment and 70 dedicated volunteers. Did they save any structure on fire 50-500 metres away? How will they help us with a truck sitting in the middle of nowhere, five or 10 kilometres away? By the way, can’t the Creston fire chief and deputy be volunteers? That’s a savings of nearly $200,000 a year. Do you really believe that fire insurance will be cheaper? Once the fire protection tax is in place, won’t new tricks emerge? Rich people and opportunists, are we obligated to pay for your bells and whistles? Why don’t you buy a fire truck for yourselves from your hoarded millions? Fires have been around long before those smarties appeared and will be around long after they’re gone. The propaganda brigade can run around, scare people that the sky is falling, scream that we cannot live without you and wring innocent necks all they want to. And the cherry on the cake? Before you get there, your earthly harvest might come. Remember how you have been jumping to the high heavens when similar smarties of your kind wanted to make a water bottling plant in your backyard? What goes around, comes around. The real reason for fire service: “We cannot let people have land for free. We must load land with taxes.” Fear mongers do not give a damn about a fire “service. Motivation easy to find at community complex

I wanted to write a column about motivation but was having trouble getting around to starting it. So, seeing as the deadline was looming within hours, I resorted to entering the pit of meditation, the birthplace of philosophy, the cradle of intelligence — all otherwise known as the hot tub. I found a solitary patron who looked reasonably cognitive considering it was 6 a.m. and posed the question, “What motivates you to come here?” I had thought it would initially be centered on health benefits but the answer turned out to be, “It’s easy to come here.” The

So figure out what you want, power through the pain period and start being who you want to be; whether it is an improved you through fitness and healthy eating, learning to play an instrument or learn another language, or making a difference in your community or someone’s life by providing your time and expertise. Have you ever wondered what is offered in the adult upgrading program at the College of the Rockies’ (COTR) Creston campus? Our adult basic education (ABE) program offers a variety of courses for adults who want to do any of the following things: complete high school

Many ABE students complete entrance requirements for the health care assistant (HCA) program, carpentry, hairstylist, practical herbalist and other programs offered onsite here in Creston. One of our past students, who took ABE biology and math with us, completed the veterinarian technician program online and is now working at the vet clinic. Many other students completed Math 10 and English 10 to enter our HCA program and are now working at Swan Valley Lodge and Crest View Village as care aids. It is awesome seeing our past ABE graduates out working in various jobs around Creston, too. They may not have specialized in one area, but they have an adult graduation diploma and found meaningful work. Other high school graduates have completed just Biology 12 and/or Chemistry 11 here that they needed for entering nursing at COTR or other programs at different colleges or universities.
