Investigation reports retaliation against El Monte city employee union president

An El Monte department chief retaliated against a longtime code enforcement officer for activities related to the officer's role as president of the union representing civilian city employees, according to documents and sources familiar with a recent investigation that also involves allegations of corruption against the city manager.

Ed Rardin, a neighborhood services officer and president of the El Monte unit of SEIU Local 721, claims City Manager Alma Martinez instructed Steve Fowler, the Community and Economic Development Department director, and Jaime Saldaña, Rardin's immediate supervisor, to initiate disciplinary action against him in retaliation for public allegations of criminal corruption against the city's top administrator.

A somewhat vaguely worded memo to Rardin — dated June 4 from Rigo

Gutierrez, director of human resources and risk management — summarizes an independent investigator's report following a complaint filed with HR last year.

Rardin'sallegations against Martinez include an illegally fenagled increase of $150,000 to her $280,000 salary and arranging an extension to a $30 million contract precluding competitive bidding for her husband's trash collection business, Valley Vista Services. In an email to Los Angeles County prosecutors, Rardin wrote, "The city properly acquired a firm, (Public Sector Personnel Consultants), to do a class (compensation) study for ALL employees, which included the City Manager. That study shows that the salary of the City Manager was 'at market' with a salary of $294,000, then $280k with an expected 5% COLA. It is my belief ... that she

got the results, didn’t like her findings, and solicited a separate vendor to give herself more of a favorable comparison at that (May 14, 2025) Council Meeting, using different comparative cities as a justification.

"No taxpayer should accept any justification for someone going from $250,000 to $367,500, a 47% increase, within 18 months. And, also worth noting, if you look at the agenda for that council meeting ... no documentation is given for the CM’s raise. Not even a staff report and nothing identifying the appraiser, the origin of the contract, his findings, or even his full name mentioned in the presentation. All key elements which warrant and deserve an investigation."

Rardin has also alleged that the city manager distributed gift cards valued at approximately $14,500

to 290 city employees in November, comparing it to extortion because vendors with city contracts paid for the cards.

“At the lunch, she read a lengthy list of vendors who contributed and stated that our Finance Director had obtained the gift cards from Target,” he said in an email to the Los Angeles District Attorney's Office. Rardin argued that the money was given because businesses feared that if they didn't contribute, "they might lose whatever contract they had or would not receive favorable decisions when dealing with city management.”

After reporting that to a slew of local, state and federal authorities, Rardin alleges Martinez made his departmental and immediate supervisors issue reprimands and harass him.

Kwan: Arcadia budget doesn't show 'full picture' of city's finances

Arcadia CouncilwomanSharonKwan voted against the recently approved nearly $97 million budget, questioning whether spending is actually under control or if delayed purchases, vacant staff positions and pushing projects into the future is balancing the city's books.

City officials and the council majority, however, don't agree with her fiscal analysis.

City Manager Dominic Lazzaretto proposed a fiscal year 2026-27 General Fund Operating Budget with revenues of $96.6 million and expenditures of $100.1 million that include new programs requiring one-time funding transferred from dedicated savings accounts, according to his report to the council prior to the 4-1 vote June 16. The General Fund is expected to end FY 2025-26 with a net balance of $276,000, with a “projected Fund Balance of the General Fund Operating Budget” of

$21.7 million.”

Lazzaretto told council members when all savings accounts transfer in, actual revenue for FY '26-27 will total close to $105 million. In a statement to HeySoCal.com, Kwan said she understands officials' and her council colleagues' assertions that focus "on accounting explanations, transfers and fund categories. I understand those explanations. But the real issue is much simpler: Is Arcadia truly controlling spending, or is the city making the budget look balanced by delaying purchases, leaving positions vacant and pushing important projects into the future? That is why I voted no."

An explosion scare, then a warehouse fire: Californians want answers about hazardous chemicals

Manuel Valle, 84, jumped on his bike and rode through his Boyle Heights neighborhood despite the protests from his worried children. The air was smoky, for the fifth day in a row; he pushed through fits of coughing to pass out 50 N95 masks to his neighbors.

The same day, officials told residents that the air was not dangerous, and that the smoke was clearing out. Valle didn’t agree.

“This is a state emergency,” he said. “Treat it like a state emergency.”

Fire had ignited at a facility, operated by the company Lineage, which stores food before it’s shipped off to restaurants and grocery stores. Lineage uses the toxic refrigerant anhydrous ammonia, which posed a health risk in the early hours of the fire.

Weeks earlier and miles away, the Orange County Fire Authority issued an evacuation order affecting 50,000 Garden Grove residents when

fire officials realized a tank at an aerospace manufacturing facility could either explode or leak large amounts of a toxic chemical into the air.

In both cases, records show state and local regulators knew the facilities; they had inspected them, approved plans, and resolved violations.

How they used their authority is now a central question for neighbors in the surrounding areas seeking accountability.

A lawmaker has proposed some reforms to chemical policy. But prosecuting companies for failing to follow environmental laws is difficult, and how far cities may go to protect residents isn’t clear.

“I don’t know what the local government is waiting for — for a tragedy to occur or something more serious or what … on top of what is already going on,” said Miguel Ocegueda Castillo, who lives near the Lineage warehouse.

designed to help prevent hazardous chemicals from escaping into surrounding neighborhoods. But records show that these two facilities, one in Orange County and one in Los Angeles County, had accumulated violations over years and continued operating.

In 2021 the South Coast Air Quality Management District issued GKN Aerospace multiple notices of violation, including for failing to maintain the required emissions records and operating some equipment without proper permits. The company later signed a settlement with air regulators and paid more than $900,000 — without admitting liability.

During the emergency, authorities gave residents conflicting information about whether the chemical methyl methacrylate had leaked.

“When you go home, you can feel safe. There was no contamination … There was no leak,” Regina ChinsioKwong, Orange County Public

Health Officer told residents during one press briefing, even though early reports characterized the incident as a leak.

Days later, Orange County health officials walked back that statement.

In Boyle Heights, the Lineage facility stores more than 12,000 pounds of anhydrous ammonia, according to the Environmental Protection Agency. The chemical is a refrigerant that, if inhaled, can cause severe eye and respiratory irritation, shortness of breath, nausea, vomiting, and, at high concentrations, death.

In the early hours of the fire on June 17, the Los Angeles Fire Department told residents to shelter in place because of the risk of the chemical being released into the air. The order was lifted, and then imposed again.

Lineage said in a statement that it “proactively took steps to pump out the ammonia and transport it offsite” and that no measurable ammonia concentra-

tions had been recorded in the community since the fire began.

Los Angeles Mayor Karen Bass told residents the air was not dangerous. But on the sixth day of the fire, an air monitor detected a hazardous spike of air pollutants.

Federal records show that the state Division of Occupational Safety and Health inspected Lineage in Boyle Heights the day the fire started. It wasn’t their first visit.

In 2020, Cal OSHA opened an investigation into the facility for violations of multiple safety standards. After Lineage lodged an administrative appeal, regulators fined the company $2,250 for violations related to process safety and respiratory protection.

“The health and safety of our employees and the communities we serve is our top priority,” she added. “Our industry is heavily regulated and inspected, with over 200 routine regulatory inspections by various agencies conducted of our North American operations alone between 2024 and 2025.”

The Los Angeles Fire Department is investigating the cause of the June 17 fire. The city department of Building and Safety is also investigating, and the workplace safety investigation remains open.

Luck, rather than strong protections, has saved residents from catastrophe in both Orange and Los Angeles counties, said Jane Williams, executive director of California Communities Against

Rebecca Liu Morales, a spokesperson for Lineage, said the company stores food, not hazardous materials, and said it was not responsible for the fire. She said the fire started when a contractor was working on the rooftop solar array, which provided power to the city.

At 1 a.m., a battery was reported in the 200 block of West Cypress. Officers arrived and made contact with the parties involved. An investigation revealed two sisters were involved in a verbal dispute which led to a physical altercation. Both parties sustained minor injuries. The party determined to be the aggressor was arrested and taken into custody.

At 9:54 p.m., an employee from a facility in the 800 block of Ocean View reported a male subject fled the facility. He was entered into the missing persons system. This investigation is continuing.

At 10:06 p.m., an officer patrolling the 100 block of West Foothill was flagged down by a group of juveniles who reported a male subject threatened them with a knife and fled. Officers located the subject nearby. An investi-

gation revealed he was in possession of the knife. He was arrested and taken into custody.

June 20

At 12:06 p.m., a caller in the area of Royal Oaks and Mountain reported a male subject passed out. Officers arrived and made contact with the subject. An investigation revealed he was in possession of drug paraphernalia. He was arrested, cited, and released at the scene.

At 6:38 p.m., an employee from a business in the 700 block of East Huntington reported a shoplifting incident. Officers arrived and determined the suspect was gone prior to their arrival. This investigation is continuing.

At 7:25 p.m., a shoplifting incident was reported in the 500 block of East Huntington. Officers arrived and made contact with the suspect. He was arrested and taken into custody.

June 21

At 6:52 a.m., a victim in the 200 block of West Walnut reported that her children's father walked into her home and assaulted her. Officers arrived and made contact with the male subject. An investigation revealed the subject pushed the victim. He was arrested and taken into custody.

At 8:19 a.m., a resident in the 200 block of Prospect reported the window to his vehicle was shattered and property was taken. This investigation is continuing.

June 22

At 1:25 p.m., a victim walked into the MPD lobby to report that someone used her identity to register and pay for schooling. This investigation is continuing.

At 2:01 p.m., a caller in the area of Magnolia and Evergreen reported seeing a male and female subject walking into the backyard of an abandoned residence. Officers arrived and found three individuals at the location. They were arrested and taken into custody.

At 4:41 p.m., a victim in the 600 block of West Duarte reported a burglary at her residence. This investigation is continuing.

At 5:23 p.m., an employee from a business in the 400 block of West Huntington reported a suspicious vehicle with several occupants. Officers arrived and made contact with the subjects. Two of the subjects were found to be in possession of a controlled substance and drug paraphernalia. They were arrested and taken into custody.

At 9:08 p.m., officers were dispatched to the area of Primrose and Palm regarding a suspicious subject. Officers arrived and located the subject. An investigation revealed the subject was too intoxicated to care for himself. He was arrested and transported to the MPD jail to be held for a sobering period.

At 1:32 p.m., a caller in the 300 block of South Primrose

reported a subject causing a disturbance. Officers arrived and made contact with the subject. The subject became confrontational. An investigation revealed he was too intoxicated to care for himself. He was arrested and transported to the MPD jail to be held for a sobering period.

At 2:58 p.m., a residence in the 1000 block of Norumbega reported that his wife’s bank account was used by an unknown subject. This investigation is continuing.

At 8:15 p.m., a caller reported a male subject was shooting a pellet gun in a parking lot in the 700 block of East Huntington and had just driven away. The vehicle was located, a traffic stop was conducted and the driver was contacted. An investigation revealed the subject and the victim were involved in a verbal argument when the subject discharged the pellet gun at two victims. Further investigation revealed the subject was under the influence of alcohol. He was arrested and taken into custody.

At 11:17 p.m., a resident in the 1400 block of Alamitas walked into the lobby to report his adult daughter missing. She had stepped outside to talk on the phone and didn't return. She was entered into the Missing Persons System database. She returned home several hours later and was then removed from the MPS database.

At 2:53 p.m., officers responded to a hotel in the 700 block of West Huntington regarding a male subject trying to break into a hotel room.

Officers arrived and learned that the subject damaged a door and window attempting to gain entry. The caller did not desire prosecution. The subject was found to be in possession of burglary tools. He was arrested and taken into custody.

June 14

At approximately 9:30 a.m., an officer responded to SpringHill Suites by Marriott, located at 99 N. Second Ave., regarding a battery investigation. The officer discovered a male suspect battered a female acquaintance for no apparent reason. A records check revealed the 34-year-old male from West Covina was on parole. He was arrested and transported to the Arcadia City Jail for booking.

June 15

At approximately 11:43 a.m., an officer responded to a residence in the 2200 block of South Santa Anita Avenue regarding a forgery report. The victim stated someone unlawfully obtained a check intended for the victim, changed the payee, and cashed the check.

June 16

At approximately 12:15 p.m., an officer responded to the CVS parking lot, located at 1401 S. Baldwin Ave., regarding a vehicle burglary report. Sometime between 12 p.m. and 12:15 p.m., someone smashed one of the windows and stole cash from inside the center console.

June 17

At approximately 5:23 p.m., an officer responded to The Shops at Santa Anita, located at 400 S. Baldwin Ave., regarding a robbery report. An investigation revealed a team of five suspects worked in concert to steal a gold chain from the victim. The suspects were located nearby while attempting to flee. A 19-year-old Asian male from Tustin, an 18-yearold Hispanic male from San Gabriel, an 18-year-old Black male from Carson, an 18-year-old Hispanic male from Carson, and a 17-year-old Asian male from Rosemead were arrested and transported to the Arcadia City Jail for booking.

June 18

At approximately 9:32 a.m., an officer responded to the front counter of the Arcadia Police Department regarding a fraud report. The victim stated he lent the suspect money, a 44-year-old Asian female from Arcadia, and when she went to repay the loan, she knowingly issued checks on an overdrawn account. The investigation is ongoing.

June 19

At approximately 9:03 a.m., an officer responded to a residence in the 00 block of West Rodell Place, regarding a fraud report. An investigation revealed the victim believed she was investing in a Taiwan-based airline. When she attempted to withdraw her investment, she discovered she was a victim of a scam.

And here’s what catches everyone off guard: Even when inflation calmed down following the post-pandemic spike, rent didn’t. That’s because housing inflation typically lags behind other inflation. So, while groceries and gas costs settle down, it takes rent much longer to reset.

Today, the most expensive places to rent include California, Hawai‘i, and Washington D.C., with the median rent being around $1,600 to $1,900. For the least expensive states to rent in, we have West Virginia, Arkansas, and South Dakota, where medium rent is under $1,000. But regardless of where you live, the question is, can your income keep up with rising rent costs?

Income vs. Rent Prices Over Time

For decades, the path was simple. Rent for a few years, save up, buy a house. Your parents probably did it. Your grandparents definitely did. That was the ladder everyone climbed. But recently, something happened to knock millions of people off the ladder. The culprit, mortgage rates doubled from 3% to 6% in less than two years. And at the same time, housing prices surged.

Here’s what that means.

A $400,000 home that would have cost you $1,700 a month in 2020, that same house now costs you $2,400 a month with the higher rate and higher price. That’s a $700 a month increase, which prices out millions of buyers. As a result, millions of Americans remained in the rental market longer than expected. More renters are all competing for the same units for longer periods of time. More demand, same supply. You know what happens next? Higher prices. You’ve probably noticed this, too. New apartment buildings are popping up everywhere. Cities, suburbs, it doesn’t matter. So, one would think that there’s enough space available to see rent prices start to go down, right? But more buildings don’t automatically mean lower rent. And this is where things get counterintuitive.

Luxury Apartments vs. Affordable Housing

Now, let’s tackle the uncomfortable question everyone’s thinking. Why is there more luxury housing and not more affordable housing? Is it because landlords are just greedy? Of course, landlords and builders want to make more money, but they’re raising rents for two main reasons.

1. Building costs have gone up with inflation.

Building is far more expensive for these devel-

opers than it used to be. So, they priced these luxury units higher from day one in hopes of making their money back ASAP.

2. Costs for landlords have also gone up.

Property taxes in most states have skyrocketed, especially in places like New Jersey, Illinois, and Connecticut, where property taxes are already high, and they’re only continuing to climb. Colorado, Georgia, and Florida have seen some of the biggest property tax hikes in recent years, with Colorado seeing an increase of 10.6%. Insurance costs in places like Florida and Texas have also surged. We’re talking about a 75% increase in just a few years. And guess what? That entire increase gets passed straight to you.

Here’s an example of landlords passing costs on to tenants in New York City. Most rentals are done through real estate agents due to intense competition. They just passed a ruling in 2025 that requires landlords to pay a rental broker fee. This was something that used to be paid by the renter. So many units saw a 5.3% increase just to cover that fee. And here’s the hard truth: Rent prices are expected to remain elevated in many markets, and it’s likely to continue to rise.

So when these increases hit, and they will, you need

Industrial infrastructure has grown near residential communities, Williams said. But state and local oversight of hazardous substances has not kept up.

“I don’t think anybody really thought: Wait, we have these warehouses, a warehouse here, a warehouse there, and what happens if there’s an earthquake and we lose containment at four anhydrous ammonia tanks in one square mile at the same time?” Williams said.

Filling in regulatory gaps

Federal and California laws are designed to protect communities from accidental releases, when a spill or an explosion or a leak releases hazardous chemicals into air, soil or waterways.

The federal Clean Air Act’s Risk Management Program requires companies handling dangerous chemicals in significant amounts to develop preventive and emergency plans for just these situations — and file those plans with regulators. California goes even further: its risk management program sets stricter thresholds and more demanding requirements than federal law — meaning California law holds facilities to a higher standard, and state regulators have more tools and more authority to act than their federal counterparts.

But critics say even California’s stronger standards have significant gaps that state officials have allowed to persist.

Reactive chemicals, such as the methyl methacrylate stored at GKN, often fall outside of both the federal and state accidental release programs. In Garden Grove, regulators required no risk management plan.

Anhydrous ammonia is a different story. It’s a listed chemical, one of the core hazards state and federal programs aim to regulate. Federal and state environmental protection officials confirmed Lineage in Boyle Heights is part of both programs.

Hazardous chemicals

Local agencies must inspect those facilities regularly and keep emergency plans on file, so that a fire department showing up to a warehouse blaze should already know what’s inside.

Neither local agency has fully disclosed its oversight of these facilities. In Los Angeles, the Los Angeles Fire Department did not answer questions about its oversight of Lineage Logistics, despite repeated requests by CalMatters.

In Garden Grove, records obtained by CalMatters reveal that the Orange County Healthcare Agency has inspected GKN more than a dozen times over the last decade and issued violations related to hazardous waste regulations that were later corrected. The facility had emergency plans that were approved in May, weeks before the incident, records show.

State Sen. Tom Umberg, a Democrat whose district includes Garden Grove, introduced Senate Bill 883 in the weeks after the GKN episode. It would require the state Office of Emergency Services to maintain a statewide inventory of facilities storing reactive chemicals, add methyl methacrylate to the state’s risk management program, require CalEnviroScreen tool to track facilities that pose an explosion risk and update current environmental review law to ensure that storage sites that have a risk of explosion aren’t exempt from review.

“We must learn from this incident, address the gaps it exposed, and take steps to ensure it never happens again,” Umberg said, in a statement announcing the legislation.

The bill is moving through Assembly policy committees.

The GKN emergency prompted a federal response. The Federal Bureau of Investigation searched the facility on June 10 — but experts say determining whether anyone committed a crime is often difficult after an industrial accident.

Legal remedies are a challenge

Criminal prosecution requires more than proving a rule was broken. Prosecutors need evidence of deliberate deceptions — falsifying reports, hiding violations, deceiving regulators.

The federal government goes after “those that are lying, cheating, and stealing,” said Ethan Ware, an attorney who represents companies investigated for environmental crimes. “There’s more to it than just the environmental violation. There’s some effort to deceive, or to hide, or to get enriched by lying on documents.”

That bar gets even higher when no specific rule is broken — when prosecutors argue a company has a general duty to keep people safe. “What the government is saying is you have complied with all of these hundreds and thousands of regulatory requirements, but we still think you pose a risk to the community,” Ware said. “That’s a hard sell to a jury, to a judge, to anybody.”

A federal criminal investigation into an industrial accident is unusual — and the Garden Grove investigation may not lead to charges. The broader federal enforcement landscape has also changed.

A 2026 report by the Environmental Integrity Project found that the number of civil lawsuits filed by the U.S. Department of Justice in cases referred by the EPA dropped to just 16 in President Donald Trump’s first year in office — 76% less than in the first year of the Biden administration. Only 12% of facilities with air pollution violations received any kind of enforce-

He and other residents wanted to know why the city wasn’t doing more to ban GKN and other facilities like it from their city.

That federal shift matters for Lineage, which has faced at least three civil enforcement actions in recent years, but none that resulted in criminal charges.

Last year, the Occupational Safety and Health Administration fined the company $37,500 for three violations at a Riverside facility, two related to its handling of hazardous materials and emergency plans.

Also last year, the company paid $3,420 to settle alleged violations at a Vernon facility, including that the company didn’t correct a critical safety system deficiency it identified during a 2021 audit.

In 2023, the EPA fined Lineage more than $172,000 for alleged violations of the federal Risk Management Program at an Iowa facility. The EPA said in a news release that the company “failed to correctly document the worst-case scenario in its risk analysis, failed to comply with accidental release prevention requirements, and failed to document emergency response coordination with local authorities.”

In 2024, a Lineage warehouse in Washington burned for 60 days. Hundreds of neighbors to the warehouse reported health problems, and some residents filed civil claims. But the company has not faced criminal charges.

The limits of local power

Weeks after an evacuation sent tens of thousands of people from their homes in Garden Grove, GKN Aerospace came to a city council meeting. The company had not spoken publicly since the evacuation.

Miles away in Boyle Heights, Lineage neighbors are also raising concerns about their schools, homes and playgrounds being so close to warehouses and other industrial facilities.

“We shouldn’t wait until after this disaster for Boyle Heights residents to know what was in the facility in their backyard,” said local council woman Ysabel Jurado.

The frustration in both cities points to a hard truth. The people with the most immediate stake, both residents and city officials, may have the least power after a facility is already operating.

City officials can update their general plans and rezone property to keep facilities they consider a threat to public health and safety away from their residents.

But the Constitution limits how far that authority extends to facilities that are already there. Businesses have a general right to not be over-regulated out of existence, said David Waite, an attorney who specializes in local land use law.

“Where it gets tricky is we have existing uses — such as the GKN facility — that were duly permitted and duly authorized under the existing zoning on that property,” Waite said. “That rezoning effort cannot just simply bar that existing use without running afoul of constitutional takings arguments.”

Cities can try revoking a facility’s permit by proving it is a public nuisance. But that requires showing an ongoing threat, not a one-time event, Waite said.

In Garden Grove, the city’s response has been cautious.

Garden Grove spokesperson Johnathan Garcia said the city is “exploring with its attorneys and engaging in the deliberative process regarding its options in consideration of its authority under the constitution, federal and state laws.”

“What is the point of bemoaning that you don’t have more local control if you don’t use the authority you do have in times like this?” Mai Nguyen Do, a research and policy manager for the Harbor Institute for Immigrant and Economic Justice, asked the council.

In Los Angeles, Jurado is calling for an investigation into what went wrong at the Lineage facility and introduced a package of motions including calls for a public report on the cause of the fire and the facility’s compliance history, increased public transportation service in the area to reduce the amount of time residents are outdoors and funding for neighborhood councils to distribute air purifiers and other protective equipment.

“When a major industrial fire happens here, it’s not viewed as an isolated incident. Residents see it as part of a larger pattern,” Jurado said. “That’s why I have said from the beginning that this is not just a fire response issue. It’s a public health issue, it’s an accountability issue, and it’s an environmental justice issue.”

The proposed work consists of pavement rehabilitation, removal and replacement of curb ramps, concrete curb, gutter, sidewalk, driveway and retaining wall and signing and striping replacement within the area of the City of El Monte, as set forth in the Contract Drawings and Technical Specifications for the project. The City Engineer’s estimate for the project is approximately Three Million Six Hundred Thousand Dollars ($3,600,000).

Completion of Work: All work shall be completed within one hundred twenty (120) working days from the date designated on the Notice to Proceed exclusive of procurement periods. Contractor will be given sixty (60) calendar days for material procurement time after the City’s authorizes a Notice to Procure.

Affirmative Action: The City of El Monte hereby notifies all bidders that it will affirmatively ensure that in any contract entered

Payment of Prevailing Wages On Public Works Projects: PROJECT LABOR AGREEMENT. The City has entered into the “Project Labor Agreement” (“PLA”) Contract No. 24PW01001 AND 24PW01001.1A with the Los Angeles and Orange Counties Building and Construction Trades Council, which is attached hereto as Attachment 4, requiring the payment of prevailing wages on general public works contracts of greater than $750,000 and specialty contracts of greater than $150,000 and certain labor compliance provisions. Specialty contracts are entered into between the City and specialty contractors as defined in Business and Professions Code Section 7058, including Sections 832.02 through 832.62 of Title 16 of the California Code of Regulations. The Contractor awarded the Contract for the Work and all Subcontractors must agree to be bound by the PLA prior to performance of any Work by submitting a completed and executed Letter of Assent. If awarded a Contract, the successful Contractor shall comply with provisions of the PLA, including without limitation: (1) craft labor hiring practices; (ii) alternative dispute resolution procedures for Site grievances and jurisdictional disputes; and (iii) prevailing wage rate responsibilities. The PLA shall not apply if the City receives funding or assistance from any Federal, State, local or other public entity for the Construction Contract if a requirement, condition or other term of receiving that funding or assistance, at the time of the awarding of the contract, is that City not require, bidders, contractors, subcontractors or other persons or entities to enter into an agreement with one or more labor organization or enter into an agreement that contains any of the terms of the PLA. Public Works projects not covered by the PLA shall be subject to the prevailing wage requirements of the California Uniform Public Construction Cost Accounting Act which has been adopted by the City. In accordance with Labor Code Section 1770 et seq., the Project is a “public work.” The selected Bidder (Contractor) and any Subcontractors shall pay wages in accordance with the director’s general prevailing wage determinations by the State of California Department of Industrial Relations (DIR) whichever is higher. Opening of Bids. Bids will be received by the City via the electronic submission up to the date and time shown in the Notice of Inviting Bids. The City will be responsible for bid tabulations. Disqualification of Bidder: If there is a reason to believe that collusion exists among any Bidders, none of the Bids of the participants in such collusion will be considered and the City may likewise elect to reject all bids received.

Wage Rates: Bidders are hereby notified that the California Department of Industrial Relations has determined the general prevailing rate of wages for each craft, classification, or type of worker

needed to execute the work. Copies of the current schedules for prevailing wages applicable to this project are on file in the City’s office. It shall be mandatory for the Contractor and any subcontractor under it to pay not less than the said specified rates to laborers and workmen employed by them in the execution of the Contract. The contractor’s duty to pay State prevailing wages can be found under Labor Code, Section 1770 et seq. Labor Code Sections 1775 and 1777.7 outline the penalties for failure to pay prevailing wages and employ apprentices including forfeitures and debarment.

Conflict of Interest: In the procurement of supplies, equipment, construction, and services by sub-recipients, the conflict-ofinterest provisions in 24 CFR 85.36, OMB Circular A-110, and 24 CFR 570.611 shall apply. No employee, office, or agent of the subrecipient shall participate in the selection, award, or administration of a contract supported by federal funds if a conflict of interest, real or apparent, would be involved.

Bonds: The successful Bidder will be required to furnish a payment bond in an amount equal to one hundred percent (100%) of the Contract price, and a faithful performance bond in an amount equal to one hundred percent (100%) of the Contract price.

"The investigator found that the timing and content of (a May 21, 2025) email, coupled with Fowler’s knowledge of Rardin’s emails to (union) membership encouraging them to attend City Council meetings, creates an inference that Fowler was, more likely than not, motivated by Rardin’s union activities in having Saldaña issue this email to Rardin," according to the city staff memo, which said the email was "about Mr. Rardin’s failure to close cases without corresponding code enforcement action."

Also "sustained" were reprimands for using his office for church-related work on his day-off — Rardin is a local Church of Latter Day Saints bishop — along with failing to notify Saldaña that he was attending union-related meetings during work hours and a request to vacate his office, according to the memo.

City officials will issue Rardin a "revised written reprimand consistent with the investigator’s findings and will return" him to his office.

In a June 11 letter union officials expressed concerns about the investigation to Martinez.

"The report drafted by the City of El Monte, which was meant to summarize the findings of the investigation based on claims raised by Ed, appears to cover up and dilute the full results of the claims initially raised," SEIU Local 721 Regional Coordinator Charles Leone and Worksite Organizer Chase Daseler wrote. Rardin said his "quest" to hold Martinez accountable that has gone on now for over a year "started because of a series of alarming interactions between our upper union leadership and our City Manager," he wrote in an April 8 letter to the City Council. I never would have anticipated the City Manager would continue to provide such blatantly questionable decisions, like her salary increase or the premature trash contract renewal. All this while I was seeking a criminal complaint from the LA Public Integrity Unit, LA FBI Field Office and (the state Fair Political Practices Commission). I truly believe the bigger story lies with these agencies and their utter refusal to investigate, even though it is clearly their mandated responsibility. ...

"It is not as if these agencies have an ongoing investigation or they determined my accusations were false or not a violation of law," according to Rardin. "They simply refused to look."

Rardin, who is also a lifelong El Monte resident, asked council members to bring his "retaliation complaint to resolution and address those concerns I called out as a whistleblower."

Rardin quoted the "termination for cause" clause in her employment agreement, which states, “Any other action or inaction by Employee that materially and substantially impedes or disrupts the performance of City or its organizational units, is detrimental to employee safety or public safety, violates properly established rules or procedures, adversely affects the reputation of City, its officers or employees, or has a substantial and adverse effect on City's interests. ...

"To make the city whole, I would suggest treating El Monte like any Prosecutor’s office when it’s discovered that one of their own acted maliciously," Rardin wrote. "I call for a complete forensic review of all personnel and contract decisions which occurred during the City Manager’s tenure. There are too many civil lawsuits and employees experiencing retaliation, some even placed on excessive extended leave. ...

"And lastly, I ask that the city contact those agencies referenced in the whistleblower files and demand that they do their thorough investigations so we can once again establish public trust," Rardin added. "What does the city have to hide? ...

"I recognize these are grandiose and possibly unrealistic suggestions, but may I offer — no more so than expecting employees to abide by rules and policies in which their leadership refuses to abide."

City officials did not respond to requests for comment.

CouncilmanMartin Herrera declined to speak on matters pertaining to city personnel.

As of publication a public records request was pending for the investigator's report on Rardin's complaints.

He requested council members help him obtain the independent investigator's full report that Guitierrez's memo summarized. He also called for the council to terminate the city manager's employment contract.

Bass vows accountability as odor lingers at Boyle Heights warehouse

Mayor Karen Bass said Monday that thoseresponsible for the massive Boyle Heights warehouse fire will be held accountable, as a foul odor from millions of pounds of rotting food spread through the neighborhood and the city prepared to transition the emergency into a lengthy cleanup and recovery effort.

Also on Monday, the Los Angeles Fire Department was expected to return control of the fireravaged Lineage cold-storage warehouse to its operator, allowing the company to begin removing an estimated 85 million pounds of spoiled food from the facility while city officials shifted their focus to environmental remediation and community recovery. The handover had been expected last week, but still-smoldering flames deep inside the building have delayed the transfer.

Bass on Monday announced two executive orders aimed at speeding up remediation and recovery efforts, as well as mobilizing additional resources for Boyle Heights.

"Those who know Boyle Heights know that this fire did not happen in a vacuum," Bass said. "Boyle Heights deserves transparency and accountability.

"These Emergency Executive Orders will mobilize additional resources that impacted residents,

workers, and business owners need, implement aggressive oversight over the remediation process and long-term environmental monitoring, and ensure this community gets the answers it deserves," Bass added.

The first order directs the establishment of a community resource center, an increase in the deployment of buses for Boyle Heights and East LA, free transit services for the affected area, as well as for LAFD, LA Sanitation, and Department of Water and Power to continue monitoring the incident.

LAFD is expected to report within 90 days on the status of ongoing investigations as to the source or cause of the fire, and request that the Environmental Protection Agency initiate a federal-local dual audit of the facility's risk management program.

The second order establishes a Boyle Heights Unified Recovery Command for coordinating remediation oversight, monitoring, and enforcing compliance, and to conduct community meetings to hear from impacted residents. It also directs the city attorney to pursue, where appropriate, all available legal rights to compel abatement and remedies.

The LAFD has implemented an incident action plan that includes deploying crews around the clock

to maintain a "firewatch" and respond if significant flare-ups occur. The crews will work on a rotating schedule.

The property owner has contracted with a private fire company that is using a water cannon to keep smoldering areas in the center of the building from flaring up. The company is expected to remain on site throughout the remediation process to respond to any hot spots as needed.

LAFD's Certified Unified Program Agency will remain involved throughout the remediation process to oversee the removal of hazardous materials, including lithium-ion batteries.

Although the blaze that erupted June 17 at 1400 S. Los Palos St. was knocked down a week later, City Councilwoman Ysabel Jurado said the crisis is far from over for Boyle Heights residents.

"As 85 million pounds of spoiled food are removed from this site, my priority is making sure the cleanup is safe, transparent, and accountable to the people of Boyle Heights — not just to the agencies or the company responsible for this property," Jurado, who represents Boyle Heights, said in a statement.

"Residents deserve clear testing results, strong public health protections, real resources, and a recovery process shaped

by the community most impacted," the councilwoman added.

Firefighters saved roughly half of the nearly 500,000-square-foot warehouse, although the entire facility sustained extensive smoke and water damage. The section most heavily damaged by the fire was largely dismantled during firefighting operations and will likely be demolished, officials said.

City officials said the food waste is being transported to landfills in Ventura and Riverside counties. Trucks hauling the food waste will avoid residential streets by using existing hauling routes already used by a nearby recycling facility, according to the mayor's office.

City officials said the goal is to minimize the impact on surrounding neighborhoods. Lineage estimates it will need to remove about 5,000 truck-

loads of food waste from the site.

In a statement Thursday, Lineage officials said the company has already hired Signal Restoration Services, "an industry-leading cleanup firm," to spearhead cleaning efforts at the site.

"To move forward as quickly as possible, we urge the government agencies involved to promptly address any permitting or other approvals necessary to begin cleanup," according to the company.

Lineage noted that no hazardous materials are stored at the facility, and "robust plans for disinfection, odor control and pest control will be implemented."

"We are exploring multiple avenues to minimize disruption to the community, including the use of water-tight trailers and containers to transport waste offsite," according to the company.

LAFD Chief Jaime Moore noted there is still substantial work remaining to overhaul the structure — most notably disposing of the frozen food that was in the warehouse.

City officials noted there are ongoing efforts related to odor mitigation, pest control, air quality testing, stormwater and groundwater testing, and ensuring drinking water remains safe.

PROJECT DESCRIPTION: The Planning and Community Development Department is bringing forward Amendments to Title 17 (the Zoning Code) of the Pasadena Municipal Code (PMC) and the City’s Central District Specific Plan. This includes changes to the following:

1) Chapter 17.26 (Special Purpose Zoning Districts) – Update the list of permitted uses and development standards for the Open Space (OS) and Public/Semi-Public (PS) zoning districts;

2) Chapter 17.30 (Central District) and the Central District Specific Plan – Add development standards for Granite Drive (e.g., sidewalk width, parkway, street setback, ground floor frontage type);

3) Chapter 17.42 (Inclusionary Housing Requirements) – Reduce the eligibility thresholds for inclusionary housing from 10 units to five units;

4) Chapter 17.43 (Density Bonus, Waivers and Incentives) –Adopt a Model Density Bonus Ordinance; include procedures and findings to approve Concessions and Waivers;

PROJECT LOCATION: Citywide and within the Central District Specific Plan (roughly bounded by the 210 Freeway to the north, Pasadena Avenue and A-Line to the west, Del Mar and California Boulevards to the south, and Mentor and Wilson Avenues to the east).

ENVIRONMENTAL DETERMINATION: The Planning Commission will consider whether adoption of the proposed Amendments are exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15061(b)(3), under the “Common Sense” exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The proposed Amendments will not increase development capacity on properties or add uses that will generate impacts on surrounding properties. The Amendments will implement programs of the General Plan Housing Element related to inclusionary housing, density bonus and concessions/waivers, adaptive reuse, and streamlining the review process for housing projects. Other Amendments focus on clarifying and cleaning up text related to special purpose zoning districts and signs.

APPROVALS NEEDED: The Planning Commission will conduct a public hearing and consider the proposed Zoning Code Amendments and environmental determination. The Planning Commission recommendation will be forwarded to the City Council, who will make a final decision at a separately noticed public hearing.

At the June 16 meeting, Kwan noted the Arcadia Police Department's seven vacant police officer positions, which she called "a very serious public safety concern." The APD currently has 53 police officers, 73 total sworn personnel, and 99 total department employees, Kwan said, adding that Lazzaretto confirmed seven fewer police officers on the payroll creates more than $2 million in savings annually.

"That is exactly my concern," Kwan told HeySoCal. com. "If the city is saving more than $2 million by not filling police officer positions, then residents deserve to know that. Those savings are not magic. They come from positions that are not filled. They come from public safety capacity that is not being provided. To me, public safety should not be used as a hidden balancing tool."

Kwan said the same issue resurfaces in spending for infrastructure and equipment upgrades.

"The city’s own equipment carryover report shows millions of dollars in approved equipment and vehicle purchases that were not completed in the same budget year," Kwan said. "I understand some projects take longer because of bidding, manufacturing, supply chain delays or installation. But the result is still the same: when spending is delayed, the budget looks better in the short term."

According to the District 2 councilwoman, "That does not mean the city’s long-term financial picture is healthier. It only means the bill has been pushed into the future."

Referring to the city's "Equipment Replacement Budget Carryover Status Report," Kwan pointed to "numerous projects that were approved in prior years but had not yet been completed, including police vehicles, fire vehicles, communications equipment, technology upgrades, and other capital purchases," she said. "Many projects were delayed due to

supply chain issues, manufacturing delays, vendor issues, project dependencies, staffing changes or other factors.

"I am not suggesting that every delay was avoidable or improper. However, I believe residents deserve to understand that a budget can appear stronger in the short term when major expenditures are deferred or carried forward into future years," Kwan continued.

"My concern has always been whether Arcadia's financial position is being strengthened through long-term structural improvements or whether some of the improvement is the result of delayed spending obligations that will eventually need to be paid," she said.

The Carryover report "was one of the factors that contributed to my concerns regarding the city's long-term financial sustainability and why I ultimately voted against the budget," Kwan added.

"The question is not whether staff can explain the accounting. The question is whether residents are being shown the full picture," Kwan said.

"For example, if a family says, 'We balanced our household budget this year,' but they did it by delaying car repairs, not fixing the roof, not hiring needed help and pushing bills into next year, that family did not truly solve its financial problem. It only delayed it," Kwan observed. "That is what concerns me about Arcadia’s budget."

Employee compensation was another issue Kwan raised.

"The city approved significant employee compensation increases in 2024, including raises of more than 18% for employee groups," she said. "Those decisions create longterm costs. Once salaries and benefits increase, those costs continue year after year. They also affect pension costs and future budgets.

"At the same time, we are seeing vacant police positions, delayed equipment purchases, delayed capital projects, and important public safety improvements that have not been completed," Kwan said. "I have repeatedly asked about

a police drone program. I keep hearing that the city is studying it or working on it. I have also raised concerns about Wilderness Park and other long-delayed priorities. Residents hear promises, but year after year, progress is slow."

Going beyond the numbers and spreadsheets, Kwan added that curtailing spending "is not just a budget issue. That is a service issue," she said. "A budget is not just a spreadsheet. A budget reflects priorities.

"If the city has money for large compensation increases but still has seven vacant police officer positions, no completed drone program, delayed equipment purchases and long-delayed capital projects (to improve infrastructure), then residents have every right to ask whether the city’s priorities are in the right place," Kwan continued. "I am not saying every delay is improper. I am saying residents deserve honesty about the tradeoffs."

She acknowledged the city does not use reserve funds to balance the budget during times of reduced revenue.

"I agree that reserves should not be used for ongoing expenses, but that statement does not solve the larger issue," Kwan said. "If spending obligations continue to grow faster than recurring revenue, then eventually the city will face difficult choices: cut services, delay more projects, raise taxes, leave positions

Kwan observed that many cities in financial trouble do not get to that point "overnight," fiscal decline usually starts "with small warning signs" — "spending grows faster than revenue, vacancies become normal, projects get delayed, equipment replacement gets pushed back. Leaders say everything is fine because the budget still technically balances.

"Then, a few years later, the city has fewer options and residents pay the price," Kwan said. "Arcadia is still financially strong today. That is exactly why we should be careful now. Fiscal discipline is easiest before a crisis, not after."

Kwan, who faced a council censure action last year, said her budget dissent "was a vote for honesty, transparency, public safety and longterm financial responsibility. I voted no because I believe residents deserve a budget that is not only balanced on paper, but sustainable in real life."

Officials dispute Kwan's budget analysis

Deputy City Manager Justine Bruno challenged an assertion Kwan previously made that the city's General Fund revenues are projected to rise from $94 million to $96.6 million, about a 2.6% increase, while during the same period expenditures rose from $92.3 million to $99.6 million, approximately

8%.

"In other words, spending is growing more than three times faster than revenue," according to Kwan.

Bruno countered that the $92.3 million and $99.6 million in spending includes one-time capital and equipment purchases of approximately $7 million in each year.

"Capital and equipment spending is supported by annual transfers into the Capital and Equipment funds, based on the average 10-year spend," Bruno said in an email to HeySoCal. com. "The purpose of these funds and making annual transfers to them is to ensure large one-time expenses don’t compromise the ability to fund ongoing city operations."

The $94 million and $96.6 million in General Fund revenue "do not include those annual transfers to support capital and equipment purchases, which, when excluded, make it appear that expenses are outpacing revenues. In short, the summary that was provided shows the full General Fund expenses but does not show the full General Fund revenues," Bruno said, citing Slide 23 of the budget presentation provided to the City Council on June 16.

If the revenue that supports infrastructure spending and equipment purchases had been included in the numbers presented, the amounts would have been, respectively, $100.1 million

— up from $94 million — and $106 million — up from $96.6 million, the deputy city manager said.

"It’s also important to clarify that the city does not use its reserves to balance its budget," Bruno added. "Using reserves to pay for ongoing expenses is unsustainable and would not be in alignment with the purpose and intent of those funds."

Mayor Pro Tem David Fu said, “You can’t just look at General Fund expenditures. The Equipment and Capital Improvement funds transfer funds to the General Fund for disbursement to address long and medium term improvements earmarked for payment under those additional reserve funds.

"Thus, looking at the General Fund solely tends to inflate what appear to be expenses because revenues are not budgeted to address those costs," Fu said. "Long and medium term Capital Improvements and Equipment purchases are budgeted under their respective accounts. Simply transferring those amounts to the General Fund when earmarked for disbursement does not indicate deficit spending.”

LAHSA sues Trump administration over decision to suspend HUD funding

TheLosAngeles HomelessServices Authority on Monday filed a lawsuit against the Trump administration, challenging a decision to suspend federal funding over allegations of fraud and widespread mismanagement.

LAHSA officials said they are attempting to prevent any interruption of federal resources that support housing and services for more than 11,000 people across Los Angeles County.

In addition to the federal complaint, LAHSA filed an application for a temporary restraining order to prevent HUD from suspending funding while the matter is reviewed in court.

"We are taking this step to protect formerly unhoused people who found a permanent home," Gita O'Neill, LAHSA's interim CEO, said in a statement.

"The people who will be harmed by this decision are not bureaucrats. They are families, veterans, seniors, and formerly homeless Angelenos who rely on these resources to remain housed. We must do everything in our power to ensure those funds continue reaching the people who rely on them,"

O'Neill added.

On June 11, the U.S. Department of Housing and Urban Development announced it had suspended federal funding to LAHSA.

HUD Secretary Scott Turner said in a statement that HUD had "uncovered evidence of LAHSA's false statements and its irresponsible actions and failures," including a lack of financial management and lack of safeguards against conflicts of interest.

The Los Angeles Continuum of Care, led by LAHSA, has received nearly $1 billion in taxpayer dollars over the last five years.

Despite federal assistance, LA remains the epicenter of

the nation's "drug-fueled" homeless crisis, according to Turner.

HUD cited prior financial reviews despite extensive corrective actions already undertaken by the countycity homeless agency, and ongoing efforts to modernize its financial systems and strengthen internal controls, according to LAHSA officials.

LAHSA's lawsuit strongly disputes the legal and factual basis for the suspension.

The suit alleges several inaccuracies and misrepresentations in HUD's notification letter to LAHSA, including improperly attributing a failure to spend over

$500 million in homeless services funding to LAHSA when the source does not mention the agency.

Other inaccuracies in the HUD letter include conflating reviews, assessments, public comments, and media statements — which do not follow rigorous, established standards — with formal audits; misrepresenting the context of corrective actions or cooperation; and suggesting wrongdoing without evidence, LAHSA argued.

"We have worked to build real transparency at LAHSA. Weaponizing old, corrected financial reviews to suddenly strip housing from thousands of people makes no sense — legally or practi-

cally," LAHSA Commission Chair Amber Shiekh said in a statement.

"LAHSA cannot stand by while an unjustified federal decision threatens to pull the rug out from under Los Angeles's homeless services system," Shiekh added.

Despite the allegations that Los Angeles has failed to reduce homelessness, recent data showed significant progress.

In June, Gov. Gavin Newsom announced California achieved the largest reduction in unsheltered homelessness in the nation last year, and saw the largest decline in unsheltered homelessness since 2009, citing HUD's data.

Los Angeles experienced a 10.3% drop in unsheltered homelessness, with the largest regional drop nationwide, according to HUD's data.

The data reflected what seems to be an ongoing trend since 2024, when the LA. region saw the first decline in homelessness.

LAHSA's 2025 point-intime count showed there was a 4% decrease in homeless people across the county, while in the city of Los Angeles, there was a 3.4% drop.

Data showed that unsheltered homelessness in the county declined by 9.5% in 2025 compared to the prior year, and it has dropped by 14% over the last two years. Additionally, there has been about an 8.5% increase of unhoused individuals entering interim housing, such as shelters and other forms of temporary housing. In the city of LA, unsheltered homelessness declined by 7.9% in 2025, and it has dropped by 17.5% over the last two years. LAHSA reported there has been a 4.7% increase in unhoused individuals entering temporary housing in the city.

West Nile virus detected in San Gabriel Valley mosquitoes

ThefirstWestNile virus-positive mosquitoes of the year have been detected in the San Gabriel Valley, with an infected mosquito sample collected in Alhambra, officials announced Monday.

The San Gabriel Valley Mosquito and Vector Control District said the virus was detected in mosquitoes collected from a surveillance trap in the city. The agency will continue monitoring mosquito activity and conducting control efforts in public areas through inspections and treatments as needed.

"West Nile virus is a recur-

ring concern in our region because it is endemic to our area," Director of Scientific Programs Tristan Hallum said in a statement. "There is no cure or human vaccine for WNV. The key to staying safe and protecting your health is to prevent mosquito bites."

Officials said West Nile virus activity typically increases during the warmer months, when higher overnight temperatures accelerate mosquito breeding and virus transmission.

The district urged residents to eliminate standing water around their homes by emptying containers weekly and discarding unused items

that can collect water. Residents also were advised to use insect repellents containing CDC-recommended ingredients, including DEET, picaridin, oil of lemon eucalyptus or IR3535.

According to the Los Angeles County Department of Public Health, West Nile virus is spread through the bite of an infected mosquito. About one in five infected people develop symptoms such as fever, headache, body aches, nausea or a skin rash, while about one in 150 people develop severe illness requiring hospitalization.

Older adults and people with weakened immune systems face the greatest risk of serious complications, officials said.
