San Bernardino o cials mull city charter amendments

Members of a San Bernardino committee are considering changes to the city's charter that would give more power to the mayor, according to a legal analysis of proposed amendments.

In a June 9 memo to the Charter Review Committee released to the public last week, attorney Albert Maldonado from the firm Best Best and Krieger reported that six proposals aim to significantly change the city’s style of government and suggested the City Council step in to frame what committee members eventually vote on as official recommendations.

"These proposals appear to potentially be inconsistent with the Committee’s purview and it is recommended, should you wish to do so, that Council authorization should be obtained prior to being considered," Maldonado wrote. "If you would like additional authority to consider proposed changes to the Charter that would include elements of a strong mayor system, in whole or in part, you may seek additional authority from the City Council."

One proposed amendment calls for designating the mayor as the chief executive policy officer and requiring the city manager to submit quarterly reports on policy implementation.

"This proposal seems to propose the Mayor as the chief, and only, policy officer (and) ... would be inconsistent with the CouncilManager form of government because the legislative

body of the City Council would lose or be weakened in its legislative policy-making authority," Maldonado wrote. "This proposal would also potentially have impacts on administrative/executive power being removed from the City Manager which would need to be a part of a proposal if this is to be considered.

An amendment to require policy reports from the city manager "is something the Charter could include and would be consistent with the Council-Manager form of government; the City Council could require such updates without Charter change," Maldonado counseled.

Another proposed amendment seeks sole authority for the mayor to nominate a city manager candidate for eventual approval by the mayor and council.

"This proposal would be inconsistent with the Council-Manager form of government," according to Maldonado. "The City Council is the legislative body and needs to have nominating authority for the City Manager. The unilateral power to nominate is akin to having unilateral authority to hire. A single individual like the Mayor having unilateral nominating authority could deprive the legislative body from hiring a City Manager of their choice."

Maldonado also raised questions about termination, which would mean the mayor's nomination for a new hire must follow termination of the existing manager that still requires a majority vote of the mayor and council members.

An amendment for a mayoral "line-Item veto" would allow the mayor to reject specific items in the city's annual budget.

"This proposal is in the gray area of the Council-Manager form of government," according to Maldonado. "A single individual like the Mayor having unilateral line-item veto power could overcome the will of the majority of the legislative body, the city council.

"The three remaining proposals would not technically be inconsistent with the Council-Manager form of government, however I raise other practical concerns about them," he wrote.

Nature preserve starts phased reopening following wildfire

Thelargesttrail coursingthrough the Hidden Valley Wildlife Area in Jurupa Valley reopened Saturday following almost a month of work to restore the path, which was damaged during a 1,473acre brush fire.

The Santa Ana River Trail, which begins in San Bernardino County and ends at the sea in Orange County, had been closed to the public where its link runs through the Hidden Valley preserve since the last week of May.

On Saturday morning

the Riverside County Regional Park and Open Space District, or RivCoParks removed all barriers to hikers and bicyclists, enabling free use of the pathway again, according to the agency.

The reopening is part of a "phased" recovery effort stemming from impacts tied to the Bain Fire.

mong the Fourth of July celebrations planned Saturday will be a Palm Springs Air Museum event recognizing more than two centuries of French-U.S. alliances, featuring a flyover by historic warbirds on a flight plan encompassing the entire Coachella Valley.

The public is invited to experience the Saturday afternoon affair, dubbed "America 250: Allies in Liberty," which is slated to begin at 2 p.m., boasting music, food, special presentations, exhibits and photo opportunities.

The museum published details via social media and its web portal, noting the gathering will be a "unique ceremony" to join with officials from the French Embassy in Washington, D.C.

French warships and troops were sent to aid the colonists in the United States' War for Independence toward the end of the 18th century, and the U.S. went to France's aid in World Wars I and II.

Berger Foundation awards $25K grant to Pathfinder Ranch

More than 20 Coachella Valley kids and teens will be able to attend a summer camp designed for outdoor exploration thanks to a $25,000 grant, officials announced Monday.

The H.N. and Frances C. Berger Foundation awarded an impact grant to Pathfinder Ranch, located in the San Jacinto Mountains, which will provide youth aged 7-17 an opportunity to take part in team-building activities and nature exploration in a "screen-free environment," officials said.

"Pathfinder Ranch has been transforming young lives through outdoor education for generations," Catharine Reed, vice president of charitable programs for the organization, said in a statement.

The grant will also benefit Pathfinder's equine educa-

tion program, which provides campers with self-confidence and empathy skills through hands-on experiences with horses.

"These scholarships will give many children the opportunity to discover strengths they never knew they had, and support for our equine education program will benefit

every camper this summer and into the fall," Executive Director of Pathfinder Ranch

An explosion scare, then a warehouse fire: Californians want answers about hazardous chemicals

Manuel Valle, 84, jumped on his bike and rode through his Boyle Heights neighborhood despite the protests from his worried children. The air was smoky, for the fifth day in a row; he pushed through fits of coughing to pass out 50 N95 masks to his neighbors.

The same day, officials told residents that the air was not dangerous, and that the smoke was clearing out. Valle didn’t agree.

“This is a state emergency,” he said. “Treat it like a state emergency.”

Fire had ignited at a facility, operated by the company Lineage, which stores food before it’s shipped off to restaurants and grocery stores. Lineage uses the toxic refrigerant anhydrous ammonia, which posed a health risk in the early hours of the fire.

Weeks earlier and miles away, the Orange County Fire Authority issued an evacuation order affecting 50,000 Garden Grove residents when

fire officials realized a tank at an aerospace manufacturing facility could either explode or leak large amounts of a toxic chemical into the air.

In both cases, records show state and local regulators knew the facilities; they had inspected them, approved plans, and resolved violations.

How they used their authority is now a central question for neighbors in the surrounding areas seeking accountability.

A lawmaker has proposed some reforms to chemical policy. But prosecuting companies for failing to follow environmental laws is difficult, and how far cities may go to protect residents isn’t clear.

“I don’t know what the local government is waiting for — for a tragedy to occur or something more serious or what … on top of what is already going on,” said Miguel Ocegueda Castillo, who lives near the Lineage warehouse.

designed to help prevent hazardous chemicals from escaping into surrounding neighborhoods. But records show that these two facilities, one in Orange County and one in Los Angeles County, had accumulated violations over years and continued operating.

In 2021 the South Coast Air Quality Management District issued GKN Aerospace multiple notices of violation, including for failing to maintain the required emissions records and operating some equipment without proper permits. The company later signed a settlement with air regulators and paid more than $900,000 — without admitting liability.

During the emergency, authorities gave residents conflicting information about whether the chemical methyl methacrylate had leaked.

“When you go home, you can feel safe. There was no contamination … There was no leak,” Regina ChinsioKwong, Orange County Public

Health Officer told residents during one press briefing, even though early reports characterized the incident as a leak.

Days later, Orange County health officials walked back that statement.

In Boyle Heights, the Lineage facility stores more than 12,000 pounds of anhydrous ammonia, according to the Environmental Protection Agency. The chemical is a refrigerant that, if inhaled, can cause severe eye and respiratory irritation, shortness of breath, nausea, vomiting, and, at high concentrations, death.

In the early hours of the fire on June 17, the Los Angeles Fire Department told residents to shelter in place because of the risk of the chemical being released into the air. The order was lifted, and then imposed again.

Lineage said in a statement that it “proactively took steps to pump out the ammonia and transport it offsite” and that no measurable ammonia concentra-

tions had been recorded in the community since the fire began.

Los Angeles Mayor Karen Bass told residents the air was not dangerous. But on the sixth day of the fire, an air monitor detected a hazardous spike of air pollutants.

Federal records show that the state Division of Occupational Safety and Health inspected Lineage in Boyle Heights the day the fire started. It wasn’t their first visit.

In 2020, Cal OSHA opened an investigation into the facility for violations of multiple safety standards. After Lineage lodged an administrative appeal, regulators fined the company $2,250 for violations related to process safety and respiratory protection.

“The health and safety of our employees and the communities we serve is our top priority,” she added. “Our industry is heavily regulated and inspected, with over 200 routine regulatory inspections by various agencies conducted of our North American operations alone between 2024 and 2025.”

The Los Angeles Fire Department is investigating the cause of the June 17 fire. The city department of Building and Safety is also investigating, and the workplace safety investigation remains open.

Luck, rather than strong protections, has saved residents from catastrophe in both Orange and Los Angeles counties, said Jane Williams, executive director of California Communities Against

Rebecca Liu Morales, a spokesperson for Lineage, said the company stores food, not hazardous materials, and said it was not responsible for the fire. She said the fire started when a contractor was working on the rooftop solar array, which provided power to the city.

At 1 a.m., a battery was reported in the 200 block of West Cypress. Officers arrived and made contact with the parties involved. An investigation revealed two sisters were involved in a verbal dispute which led to a physical altercation. Both parties sustained minor injuries. The party determined to be the aggressor was arrested and taken into custody.

At 9:54 p.m., an employee from a facility in the 800 block of Ocean View reported a male subject fled the facility. He was entered into the missing persons system. This investigation is continuing.

At 10:06 p.m., an officer patrolling the 100 block of West Foothill was flagged down by a group of juveniles who reported a male subject threatened them with a knife and fled. Officers located the subject nearby. An investi-

gation revealed he was in possession of the knife. He was arrested and taken into custody.

June 20

At 12:06 p.m., a caller in the area of Royal Oaks and Mountain reported a male subject passed out. Officers arrived and made contact with the subject. An investigation revealed he was in possession of drug paraphernalia. He was arrested, cited, and released at the scene.

At 6:38 p.m., an employee from a business in the 700 block of East Huntington reported a shoplifting incident. Officers arrived and determined the suspect was gone prior to their arrival. This investigation is continuing.

At 7:25 p.m., a shoplifting incident was reported in the 500 block of East Huntington. Officers arrived and made contact with the suspect. He was arrested and taken into custody.

June 21

At 6:52 a.m., a victim in the 200 block of West Walnut reported that her children's father walked into her home and assaulted her. Officers arrived and made contact with the male subject. An investigation revealed the subject pushed the victim. He was arrested and taken into custody.

At 8:19 a.m., a resident in the 200 block of Prospect reported the window to his vehicle was shattered and property was taken. This investigation is continuing.

June 22

At 1:25 p.m., a victim walked into the MPD lobby to report that someone used her identity to register and pay for schooling. This investigation is continuing.

At 2:01 p.m., a caller in the area of Magnolia and Evergreen reported seeing a male and female subject walking into the backyard of an abandoned residence. Officers arrived and found three individuals at the location. They were arrested and taken into custody.

At 4:41 p.m., a victim in the 600 block of West Duarte reported a burglary at her residence. This investigation is continuing.

At 5:23 p.m., an employee from a business in the 400 block of West Huntington reported a suspicious vehicle with several occupants. Officers arrived and made contact with the subjects. Two of the subjects were found to be in possession of a controlled substance and drug paraphernalia. They were arrested and taken into custody.

At 9:08 p.m., officers were dispatched to the area of Primrose and Palm regarding a suspicious subject. Officers arrived and located the subject. An investigation revealed the subject was too intoxicated to care for himself. He was arrested and transported to the MPD jail to be held for a sobering period.

June 23

At 1:32 p.m., a caller in the 300 block of South Primrose

reported a subject causing a disturbance. Officers arrived and made contact with the subject. The subject became confrontational. An investigation revealed he was too intoxicated to care for himself. He was arrested and transported to the MPD jail to be held for a sobering period.

At 2:58 p.m., a residence in the 1000 block of Norumbega reported that his wife’s bank account was used by an unknown subject. This investigation is continuing.

At 8:15 p.m., a caller reported a male subject was shooting a pellet gun in a parking lot in the 700 block of East Huntington and had just driven away. The vehicle was located, a traffic stop was conducted and the driver was contacted. An investigation revealed the subject and the victim were involved in a verbal argument when the subject discharged the pellet gun at two victims. Further investigation revealed the subject was under the influence of alcohol. He was arrested and taken into custody.

At 11:17 p.m., a resident in the 1400 block of Alamitas walked into the lobby to report his adult daughter missing. She had stepped outside to talk on the phone and didn't return. She was entered into the Missing Persons System database. She returned home several hours later and was then removed from the MPS database.

At 2:53 p.m., officers responded to a hotel in the 700 block of West Huntington regarding a male subject trying to break into a hotel room.

Officers arrived and learned that the subject damaged a door and window attempting to gain entry. The caller did not desire prosecution. The subject was found to be in possession of burglary tools. He was arrested and taken into custody.

June 14

At approximately 9:30 a.m., an officer responded to SpringHill Suites by Marriott, located at 99 N. Second Ave., regarding a battery investigation. The officer discovered a male suspect battered a female acquaintance for no apparent reason. A records check revealed the 34-year-old male from West Covina was on parole. He was arrested and transported to the Arcadia City Jail for booking.

June 15

At approximately 11:43 a.m., an officer responded to a residence in the 2200 block of South Santa Anita Avenue regarding a forgery report. The victim stated someone unlawfully obtained a check intended for the victim, changed the payee, and cashed the check.

June 16

At approximately 12:15 p.m., an officer responded to the CVS parking lot, located at 1401 S. Baldwin Ave., regarding a vehicle burglary report. Sometime between 12 p.m. and 12:15 p.m., someone smashed one of the windows and stole cash from inside the center console.

June 17

At approximately 5:23 p.m., an officer responded to The Shops at Santa Anita, located at 400 S. Baldwin Ave., regarding a robbery report. An investigation revealed a team of five suspects worked in concert to steal a gold chain from the victim. The suspects were located nearby while attempting to flee. A 19-year-old Asian male from Tustin, an 18-yearold Hispanic male from San Gabriel, an 18-year-old Black male from Carson, an 18-year-old Hispanic male from Carson, and a 17-year-old Asian male from Rosemead were arrested and transported to the Arcadia City Jail for booking.

June 18

At approximately 9:32 a.m., an officer responded to the front counter of the Arcadia Police Department regarding a fraud report. The victim stated he lent the suspect money, a 44-year-old Asian female from Arcadia, and when she went to repay the loan, she knowingly issued checks on an overdrawn account. The investigation is ongoing.

June 19

At approximately 9:03 a.m., an officer responded to a residence in the 00 block of West Rodell Place, regarding a fraud report. An investigation revealed the victim believed she was investing in a Taiwan-based airline. When she attempted to withdraw her investment, she discovered she was a victim of a scam.

And here’s what catches everyone off guard: Even when inflation calmed down following the post-pandemic spike, rent didn’t. That’s because housing inflation typically lags behind other inflation. So, while groceries and gas costs settle down, it takes rent much longer to reset.

Today, the most expensive places to rent include California, Hawai‘i, and Washington D.C., with the median rent being around $1,600 to $1,900. For the least expensive states to rent in, we have West Virginia, Arkansas, and South Dakota, where medium rent is under $1,000. But regardless of where you live, the question is, can your income keep up with rising rent costs?

Income vs. Rent Prices Over Time

For decades, the path was simple. Rent for a few years, save up, buy a house. Your parents probably did it. Your grandparents definitely did. That was the ladder everyone climbed. But recently, something happened to knock millions of people off the ladder. The culprit, mortgage rates doubled from 3% to 6% in less than two years. And at the same time, housing prices surged.

Here’s what that means.

A $400,000 home that would have cost you $1,700 a month in 2020, that same house now costs you $2,400 a month with the higher rate and higher price. That’s a $700 a month increase, which prices out millions of buyers. As a result, millions of Americans remained in the rental market longer than expected. More renters are all competing for the same units for longer periods of time. More demand, same supply. You know what happens next? Higher prices. You’ve probably noticed this, too. New apartment buildings are popping up everywhere. Cities, suburbs, it doesn’t matter. So, one would think that there’s enough space available to see rent prices start to go down, right? But more buildings don’t automatically mean lower rent. And this is where things get counterintuitive.

Luxury Apartments vs. Affordable Housing

Now, let’s tackle the uncomfortable question everyone’s thinking. Why is there more luxury housing and not more affordable housing? Is it because landlords are just greedy? Of course, landlords and builders want to make more money, but they’re raising rents for two main reasons.

1. Building costs have gone up with inflation.

Building is far more expensive for these devel-

opers than it used to be. So, they priced these luxury units higher from day one in hopes of making their money back ASAP.

2. Costs for landlords have also gone up.

Property taxes in most states have skyrocketed, especially in places like New Jersey, Illinois, and Connecticut, where property taxes are already high, and they’re only continuing to climb. Colorado, Georgia, and Florida have seen some of the biggest property tax hikes in recent years, with Colorado seeing an increase of 10.6%. Insurance costs in places like Florida and Texas have also surged. We’re talking about a 75% increase in just a few years. And guess what? That entire increase gets passed straight to you.

Here’s an example of landlords passing costs on to tenants in New York City. Most rentals are done through real estate agents due to intense competition. They just passed a ruling in 2025 that requires landlords to pay a rental broker fee. This was something that used to be paid by the renter. So many units saw a 5.3% increase just to cover that fee. And here’s the hard truth: Rent prices are expected to remain elevated in many markets, and it’s likely to continue to rise.

“I don’t think anybody really thought: Wait, we have these warehouses, a warehouse here, a warehouse there, and what happens if there’s an earthquake and we lose containment at four anhydrous ammonia tanks in one square mile at the same time?” Williams said.

Filling in regulatory gaps

Federal and California laws are designed to protect communities from accidental releases, when a spill or an explosion or a leak releases hazardous chemicals into air, soil or waterways.

The federal Clean Air Act’s Risk Management Program requires companies handling dangerous chemicals in significant amounts to develop preventive and emergency plans for just these situations — and file those plans with regulators. California goes even further: its risk management program sets stricter thresholds and more demanding requirements than federal law — meaning California law holds facilities to a higher standard, and state regulators have more tools and more authority to act than their federal counterparts.

But critics say even California’s stronger standards have significant gaps that state officials have allowed to persist.

Reactive chemicals, such as the methyl methacrylate stored at GKN, often fall outside of both the federal and state accidental release programs. In Garden Grove, regulators required no risk management plan.

Anhydrous ammonia is a different story. It’s a listed chemical, one of the core hazards state and federal programs aim to regulate. Federal and state environmental protection officials confirmed Lineage in Boyle Heights is part of both programs.

Hazardous chemicals

Local agencies must inspect those facilities regularly and keep emergency plans on file, so that a fire department showing up to a warehouse blaze should already know what’s inside.

Neither local agency has fully disclosed its oversight of these facilities. In Los Angeles, the Los Angeles Fire Department did not answer questions about its oversight of Lineage Logistics, despite repeated requests by CalMatters.

In Garden Grove, records obtained by CalMatters reveal that the Orange County Healthcare Agency has inspected GKN more than a dozen times over the last decade and issued violations related to hazardous waste regulations that were later corrected. The facility had emergency plans that were approved in May, weeks before the incident, records show.

State Sen. Tom Umberg, a Democrat whose district includes Garden Grove, introduced Senate Bill 883 in the weeks after the GKN episode. It would require the state Office of Emergency Services to maintain a statewide inventory of facilities storing reactive chemicals, add methyl methacrylate to the state’s risk management program, require CalEnviroScreen tool to track facilities that pose an explosion risk and update current environmental review law to ensure that storage sites that have a risk of explosion aren’t exempt from review.

“We must learn from this incident, address the gaps it exposed, and take steps to ensure it never happens again,” Umberg said, in a statement announcing the legislation.

The bill is moving through Assembly policy committees.

The GKN emergency prompted a federal response. The Federal Bureau of Investigation searched the facility on June 10 — but experts say determining whether anyone committed a crime is often difficult after an industrial accident.

Legal remedies are a challenge

Local agencies called Certified Unified Program Agencies are the layer of oversight closest to the ground. In California, they’re responsible for knowing what hazardous chemicals companies store where, and in what quantities.

Criminal prosecution requires more than proving a rule was broken. Prosecutors need evidence of deliberate deceptions — falsifying reports, hiding violations, deceiving regulators.

The federal government goes after “those that are lying, cheating, and stealing,” said Ethan Ware, an attorney who represents companies investigated for environmental crimes. “There’s more to it than just the environmental violation. There’s some effort to deceive, or to hide, or to get enriched by lying on documents.”

That bar gets even higher when no specific rule is broken — when prosecutors argue a company has a general duty to keep people safe. “What the government is saying is you have complied with all of these hundreds and thousands of regulatory requirements, but we still think you pose a risk to the community,” Ware said. “That’s a hard sell to a jury, to a judge, to anybody.”

A federal criminal investigation into an industrial accident is unusual — and the Garden Grove investigation may not lead to charges. The broader federal enforcement landscape has also changed.

A 2026 report by the Environmental Integrity Project found that the number of civil lawsuits filed by the U.S. Department of Justice in cases referred by the EPA dropped to just 16 in President Donald Trump’s first year in office — 76% less than in the first year of the Biden administration. Only 12% of facilities with air pollution violations received any kind of enforce-

He and other residents wanted to know why the city wasn’t doing more to ban GKN and other facilities like it from their city.

That federal shift matters for Lineage, which has faced at least three civil enforcement actions in recent years, but none that resulted in criminal charges.

Last year, the Occupational Safety and Health Administration fined the company $37,500 for three violations at a Riverside facility, two related to its handling of hazardous materials and emergency plans.

Also last year, the company paid $3,420 to settle alleged violations at a Vernon facility, including that the company didn’t correct a critical safety system deficiency it identified during a 2021 audit.

In 2023, the EPA fined Lineage more than $172,000 for alleged violations of the federal Risk Management Program at an Iowa facility. The EPA said in a news release that the company “failed to correctly document the worst-case scenario in its risk analysis, failed to comply with accidental release prevention requirements, and failed to document emergency response coordination with local authorities.”

In 2024, a Lineage warehouse in Washington burned for 60 days. Hundreds of neighbors to the warehouse reported health problems, and some residents filed civil claims. But the company has not faced criminal charges.

The limits of local power

Weeks after an evacuation sent tens of thousands of people from their homes in Garden Grove, GKN Aerospace came to a city council meeting. The company had not spoken publicly since the evacuation.

Miles away in Boyle Heights, Lineage neighbors are also raising concerns about their schools, homes and playgrounds being so close to warehouses and other industrial facilities.

“We shouldn’t wait until after this disaster for Boyle Heights residents to know what was in the facility in their backyard,” said local council woman Ysabel Jurado.

The frustration in both cities points to a hard truth. The people with the most immediate stake, both residents and city officials, may have the least power after a facility is already operating.

City officials can update their general plans and rezone property to keep facilities they consider a threat to public health and safety away from their residents.

But the Constitution limits how far that authority extends to facilities that are already there. Businesses have a general right to not be over-regulated out of existence, said David Waite, an attorney who specializes in local land use law.

“Where it gets tricky is we have existing uses — such as the GKN facility — that were duly permitted and duly authorized under the existing zoning on that property,” Waite said. “That rezoning effort cannot just simply bar that existing use without running afoul of constitutional takings arguments.”

Cities can try revoking a facility’s permit by proving it is a public nuisance. But that requires showing an ongoing threat, not a one-time event, Waite said.

In Garden Grove, the city’s response has been cautious.

Garden Grove spokesperson Johnathan Garcia said the city is “exploring with its attorneys and engaging in the deliberative process regarding its options in consideration of its authority under the constitution, federal and state laws.”

“What is the point of bemoaning that you don’t have more local control if you don’t use the authority you do have in times like this?” Mai Nguyen Do, a research and policy manager for the Harbor Institute for Immigrant and Economic Justice, asked the council.

In Los Angeles, Jurado is calling for an investigation into what went wrong at the Lineage facility and introduced a package of motions including calls for a public report on the cause of the fire and the facility’s compliance history, increased public transportation service in the area to reduce the amount of time residents are outdoors and funding for neighborhood councils to distribute air purifiers and other protective equipment.

“When a major industrial fire happens here, it’s not viewed as an isolated incident. Residents see it as part of a larger pattern,” Jurado said. “That’s why I have said from the beginning that this is not just a fire response issue. It’s a public health issue, it’s an accountability issue, and it’s an environmental justice issue.”

Time on or before July 30, 2026 for the project listed below. A bid submitted after the time set shall not be considered. The proposed work consists of pavement rehabilitation, removal and replacement of curb ramps, concrete curb, gutter, sidewalk, driveway and retaining wall and signing and striping replacement within the area of the City of El Monte, as set forth in the Contract Drawings and Technical Specifications for the project. The City Engineer’s estimate for the project is approximately Three Million Six Hundred Thousand Dollars ($3,600,000).

Completion of Work: All work shall be completed within one hundred twenty (120) working days from the date designated on the Notice to Proceed exclusive of procurement periods. Contractor will be given sixty (60) calendar days for material procurement time after the City’s authorizes a Notice to Procure.

Payment of Prevailing Wages On Public Works Projects: PROJECT LABOR AGREEMENT. The City has entered into the “Project Labor Agreement” (“PLA”) Contract No. 24PW01001 AND 24PW01001.1A with the Los Angeles and Orange Counties Building and Construction Trades Council, which is attached hereto as Attachment 4, requiring the payment of prevailing wages on general public works contracts of greater than $750,000 and specialty contracts of greater than $150,000 and certain labor compliance provisions. Specialty contracts are entered into between the City and specialty contractors as defined in Business and Professions Code Section 7058, including Sections 832.02 through 832.62 of Title 16 of the California Code of Regulations. The Contractor awarded the Contract for the Work and all Subcontractors must agree to be bound by the PLA prior to performance of any Work by submitting a completed and executed Letter of Assent. If awarded a Contract, the successful Contractor shall comply with provisions of the PLA, including without limitation: (1) craft labor hiring practices; (ii) alternative dispute resolution procedures for Site grievances and jurisdictional disputes; and (iii) prevailing wage rate responsibilities. The PLA shall not apply if the City receives funding or assistance from any Federal, State, local or other public entity for the Construction Contract if a requirement, condition or other term of receiving that funding or assistance, at the time of the awarding of the contract, is that City not require, bidders, contractors, subcontractors or other persons or entities to enter into an agreement with one or more labor organization or enter into an agreement that contains any of the terms of the PLA. Public Works projects not covered by the PLA shall be subject to the prevailing wage requirements of the California Uniform Public Construction Cost Accounting Act which has been adopted by the City. In accordance with Labor Code Section 1770 et seq., the Project is a “public work.” The selected Bidder (Contractor) and any Subcontractors shall pay wages in accordance with the director’s general prevailing wage determinations by the State of California Department of Industrial Relations (DIR) whichever is higher. Contractor's License: Bidder must possess a current Class ”A” - General Engineering Contractor license issued by the State of California, at the time the bid is submitted.

Contractor Registration: All Bidders and listed subcontractors must have registered with the California State Department of Industrial Relations pursuant to Labor Code section 1725.5 prior to submitting a Bid. Furthermore, a Contractor and all subcontractors must be registered pursuant to Labor Code section 1725.5 before entering into a contract to work on a public project.

City’s Right to Postpone Opening of Bids. The City reserves the right to postpone the date and time for the opening of Bids at any time prior to the date and time initially announced in this Invitation to Bid in accordance with applicable law.

Opening of Bids. Bids will be received by the City via the electronic submission up to the date and time shown in the Notice of Inviting Bids. The City will be responsible for bid tabulations. Disqualification of Bidder: If there is a reason to believe that collusion exists among any Bidders, none of the Bids of the participants in such collusion will be considered and the City may likewise elect to reject all bids received.

Wage Rates: Bidders are hereby notified that the California Department of Industrial Relations has determined the general prevailing rate of wages for each craft, classification, or type of worker

needed to execute the work. Copies of the current schedules for prevailing wages applicable to this project are on file in the City’s office. It shall be mandatory for the Contractor and any subcontractor under it to pay not less than the said specified rates to laborers and workmen employed by them in the execution of the Contract. The contractor’s duty to pay State prevailing wages can be found under Labor Code, Section 1770 et seq. Labor Code Sections 1775 and 1777.7 outline the penalties for failure to pay prevailing wages and employ apprentices including forfeitures and debarment.

Conflict of Interest: In the procurement of supplies, equipment, construction, and services by sub-recipients, the conflict-ofinterest provisions in 24 CFR 85.36, OMB Circular A-110, and 24 CFR 570.611 shall apply. No employee, office, or agent of the subrecipient shall participate in the selection, award, or administration of a contract supported by federal funds if a conflict of interest, real or apparent, would be involved.

Bonds: The successful Bidder will be required to furnish a payment bond in an amount equal to one hundred percent (100%) of the Contract price, and a faithful performance bond in an amount equal to one hundred percent (100%) of the Contract price.

"Where budgets are set not by City Charter but instead by annual action by the legislative body, the City can be flexible to make sound fiscal decisions based on current and forecasted economic conditions and available resources. This would likely need to be further defined to be considered for a Charter amendment."

Another proposed change is allowing the mayor to place items directly on council meeting agendas, but Maldonado observed that this power already exists.

He cited a 2021 council resolution: “The City Manager shall determine the items and order of such items on the City Council Meeting agendas, subject to direction from the Mayor and City Council. The

City Manager shall include any agenda item requested by the presiding officer of the City Council for discussion and further direction from a majority of the City Council.”

The attorney suggested adding this proposal to the charter may provide clarity.

On a suggested amendment to set term limits for the mayor and City Council members, Maldonado said, "The Charter may include term limits for both the Mayor and members of the City Council. The Committee asked for guidance regarding whether or not such term limits could be retroactive."

Citing the California Government Code, Maldonado noted "that charter cities may impose term limits on members of the city council and/or the mayor but that 'any proposal to limit the number of terms a member of the city council may serve on the city council, or the number of terms an elected mayor may serve, shall apply prospectively only.'”

Report reveals highest paid on Riverside County payroll

The 10 highest paid officials in Riverside County government last year were working almost entirely in public health, according to a report released Tuesday by the California State Controller's Office.

The agency on Tuesday published its 2025 Government Compensation in California analysis, showing how taxpayer funds were spent in the previous year, and who was receiving what for being on the public payroll.

The data is available at publicpay.ca.gov.

As in 2024, the individual who received the largest income in county government was an unnamed staff psychiatrist for the Riverside University Health System's Department of Behavioral Health. That doctor received a total $608,296, a large part of which may have been related to overtime claims.

Amounts documented by the controller's office include base pay, overtime and lump sum disbursals, which are often tied to banked vacation and sick leave time that went unused, sometimes for years, then

cashed out.

PROJECT DESCRIPTION: The Planning and Community Development Department is bringing forward Amendments to Title 17 (the Zoning Code) of the Pasadena Municipal Code (PMC) and the City’s Central District Specific Plan. This includes changes to the following:

1) Chapter 17.26 (Special Purpose Zoning Districts) – Update the list of permitted uses and development standards for the Open Space (OS) and Public/Semi-Public (PS) zoning districts;

2) Chapter 17.30 (Central District) and the Central District Specific Plan – Add development standards for Granite Drive (e.g., sidewalk width, parkway, street setback, ground floor frontage type);

3) Chapter 17.42 (Inclusionary Housing Requirements) – Reduce the eligibility thresholds for inclusionary housing from 10 units to five units;

4) Chapter 17.43 (Density Bonus, Waivers and Incentives) –Adopt a Model Density Bonus Ordinance; include procedures and findings to approve Concessions and Waivers;

PROJECT LOCATION: Citywide and within the Central District Specific Plan (roughly bounded by the 210 Freeway to the north, Pasadena Avenue and A-Line to the west, Del Mar and California Boulevards to the south, and Mentor and Wilson Avenues to the east).

ENVIRONMENTAL DETERMINATION: The Planning Commission will consider whether adoption of the proposed Amendments are exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15061(b)(3), under the “Common Sense” exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The proposed Amendments will not increase development capacity on properties or add uses that will generate impacts on surrounding properties. The Amendments will implement programs of the General Plan Housing Element related to inclusionary housing, density bonus and concessions/waivers, adaptive reuse, and streamlining the review process for housing projects. Other Amendments focus on clarifying and cleaning up text related to special purpose zoning districts and signs.

APPROVALS NEEDED: The Planning Commission will conduct a public hearing and consider the proposed Zoning Code Amendments and environmental determination. The Planning Commission recommendation will be forwarded to the City Council, who will make a final decision at a separately noticed public hearing.

Over a roughly three-day period, beginning May 19, the Bain Fire burned through heavy vegetation around the Santa Ana River bottom, spreading across the Hidden Valley preserve. The blaze's forward progress was stopped on May 22, but it was not declared 100% contained until two days later.

"The fire caused signifi-

cant damage to natural habitats, trails, visitor amenities, educational spaces and other critical infrastructure throughout the Hidden Valley Wildlife Area," according to a RivCoParks statement. "Restoration efforts are focused on repairing damaged facilities, restoring wildlife habitat, improving public safety and returning visitor access as conditions allow."

The agency continues to welcome volunteers interested in helping clear fire-damaged vegetation and restore other parts of the 1,500-acre site.

Nature preserve

"No prior experience is required, and all training and supplies will be provided," RivCoParks officials said. "Flexible volunteer opportunities are available for individuals, families, students and community groups interested in making a meaningful impact."

The next goal is to reopen the Hidden Valley Nature Center at 11401 Arlington Ave. That's tentatively set for July 7 if sufficient progress is made with the cleanup and restoration.

At 4:30 p.m., a "firefighter hosedown" featured the deployment of Murrieta Fire and Rescue apparatus' powerful hoses for water recreation.

At 5 p.m., there was an outdoor concert by the country band PHT and later Paging the 90s. Food vendors, a kids' play zone and other entertainment were additionally on the slate, with pyrotechnics after nightfall in California Oaks Sports Park, 40600 California Oaks Road.

The July 4th holiday falls on a Saturday this year, and some municipalities plan to host pyrotechnics spectaculars immediately before and after that date.

On Thursday, July 2, Coachella is scheduled to host a spectacular after sundown in Bagdouma Park, 51-251 Douma St., while on the same day and around the same time, the city of Perris will host a fireworks display in Morgan Park, 600 E. Morgan St.

On Friday, July 3, the Jurupa Area Recreation and Park District has scheduled its traditional fireworks show after dark in Vernola Family Park, 5211 Wineville Ave.

Also on Friday, from 7-9 p.m. Riverside National Cemetery will host a free Concert for Heroes at the Amphitheater, featuring patriotic music, with a fireworks show after dark over

the pond in the middle of the cemetery, located at 22495 Van Buren Blvd.

On July 4, Corona's traditional Main Street U.S.A. Parade is set to begin at 9 a.m. at Ontario and Main streets, featuring law enforcement units, fire engines, marching bands, military hardware and show animals. The procession, which typically draws around 4,000 spectators, will travel a mile, concluding at Olive and Main streets around noon. A fireworks show is set for 9 p.m. in Santana Regional Park.

Moreno Valley's Fourth of July Parade will get underway at 9:30 a.m. at

family-friendly event is planned, featuring food vendors and kids' activities. Fireworks are scheduled after sunset.

At 10 a.m., Temecula's Star Spangled Parade will proceed, featuring the Temecula Valley Mounted Posse, Veterans of Foreign Wars, members of the American Legion, the Riverside County Fire Department, the Boy Scouts of America and other organizations. The parade will run about two hours northbound along Old Town Front Street. There will be pyrotechnics in Ronald Reagan Sports Park after dark.

The city of Desert Hot Springs will hold its celebration after dark on July 5 in Mission Springs Park, 14-510 Palm Drive.

In Riverside County, private parties are prohibited from using fireworks except in Blythe, Coachella, Desert Hot Springs and Indio, where so-called "safe and sane" fireworks,

certified by the state fire marshal, can be sold to the public.

The devices are mostly the type that don't explode or fly, including sparklers, ground spinners, fountains, snappers and caps.

Under county Ordinance 858, which was amended by the Board of Supervisors in response to an outbreak of blazes in 2020, fines for illegally storing, transporting or setting off fireworks can range from $1,000 to $5,000.

Any person who triggers a brush fire due to the illegal use of fireworks can be held responsible for all suppression costs.

Despite the potential penalties imposed by the county and cities, fireworks are routinely set off in large numbers by individuals in unincorporated communities and municipalities countywide every Fourth of July.

Bill ends free rides for defendants seeking mental health diversion

Legislation backed by the Riverside County District Attorney's Office to prevent potentially violent criminal offenders from exploiting courts' mental health treatment allowances by using claims of psychiatric disorders to avoid incarceration is now enshrined in state law.

Gov. Gavin Newsom on Monday signed Assembly Bill 46, introduced by Assemblywoman Stephanie Nguyen, D-Sacramento, and sponsored by the California District Attorneys' Association. It was immediately chaptered by the Office of the Secretary of State, becoming part of the state's statutory scheme.

"Our office was proud to stand with the coalition of public safety advocates that worked for years to advance these important reforms," Chief Deputy District Attorney Ivy Fitzpatrick said, adding that AB 46's provisions will "better protect victims, support treatment and enhance public safety."

Earlier this year, Riverside County District Attorney Mike Hestrin emphasized the need for changes to state law

"after repeated tragic cases in which dangerous defendants committed new violent crimes while on mental health diversion."

Diversion is permitted under Penal Code section 1001.36, which provides criteria for when an offender is eligible for mental health treatment in lieu of jail or prison. In recent years, a high volume of cases, often involving violence, have been removed from the criminal adjudication process in Riverside County and assigned to diversion.

The main requirement for judicial approval of diversion generally consists of affidavits from at least one mental health specialist affirming the defendant has a psychological disorder that likely contributed to perpetration of the crime. Additionally, the defendant, through his or her attorney, is supposed to submit a specific plan for treatment of the disorder, usually involving therapy.

However, even without a treatment plan, some judges have been subject to appellate review and invalidation of their decisions to reject diversion, according to

supporters of AB 46.

The bill established a new standard that must be met before pretrial diversion can be permitted: "The defendant will not pose a substantial and undue risk to the physical safety of another person, if treated in the community" and out of custody.

Judges will now be free to consult with prosecutors, defense attorneys, victims, as well as scrutinize a defendant's criminal history, before making a decision on whether to grant psychiatric treatment.

In a 2024 case out of San Diego County, a judge attempted to squash diversion for a repeat criminal offender, Jeanette Sarmiento, who tried to rob a person but used a post-traumatic stress disorder diagnosis and other factors to argue that mental health diversion was a viable option in lieu of standard criminal adjudication. But she did not come forward with a specific treatment plan. The California District Attorneys' Association cited the case as an example of excessive leniency favoring an offender.

"The record showed that

the defendant 'for many years has been under the care of a psychiatrist or other physician and has been treated for PTSD and depression or has been offered treatment, and despite such treatment or offers, she continued to abuse methamphetamine and to commit crimes,'" the CDAA stated.

The judge's cancellation of diversion led the defendant to appeal, culminating in the state Court of Appeals for the Fourth District, a jurisdiction that includes Riverside County, countermanding the lower court judge's decision and permitting Sarmiento to proceed with a non-specific diversion plan.

The CDAA cited multiple instances in which defendants placed in diversion had failed to curb their criminal conduct, sometimes with fatal results.

In Sacramento County, a defendant who perpetrated two takeover robberies in 2024 was nonetheless granted diversion, only to fatally stab a 40-year-old man, apparently without provocation, the organization said.

In Orange County, a defendant who served seven years behind bars for assault with a deadly weapon stabbed a pedestrian with a machete for no reason. After he was later granted diversion in

that case disposed in Orange County Superior Court, "he absconded from his treatment program and stabbed another bystander 34 times with a box cutter in Los Angeles," the CDAA said. That victim survived. In Stanislaus County, a defendant granted diversion in a neighboring jurisdiction after he admitted carjacking a senior went on to use his vehicle to run over and kill his girlfriend — whom he was charged with assaulting on several prior occasions, according to the CDAA. Defendants who complete diversion programs can still have their offenses expunged from criminal records.

Repairs to roads on northern tier of Desert Hot Springs underway

Aseries of road repairs in a community on the northwest end of Desert Hot Springs began Monday, and will periodically interrupt travel for a few months to make for a smoother ride after the project is finished.

"This project will fix up a substantial number of streets in this unincorporated community (of Mission Lakes)," Riverside County Supervisor Manuel Perez said. "This road work is a significant improvement that will be long lasting after it's completed."

Perez's Fourth District encompasses the Mission Lakes Country Club. According to his staff, a total of 25 streets covering 5.7 miles

are due for upgrades as part of the Mission Lakes Area Resurfacing Project, which was slated to begin at 7 a.m. Monday and continue for about three months.

Crews generally will be on the job Monday to Friday, between 7 a.m and 6 p.m., officials said.

Jurupa Valley-based LCR Earthwork & Engineering Corp. was awarded the project contract, the total budget for which is $3.3 million, according to Perez's office.

"This is very significant in our community's over 50-year history that the roads are being totally re-done up here," Mission Lakes Country Club General Manager Eric Charos said. "This will be

a big improvement for our residents, and all who visit to golf, enjoy our restaurants and amenities, with some of the best views in the (Coachella) Valley."

Officials said residents impacted by street repairs will be given 48 hours' notice to ensure street parking doesn't impede work and vehicles aren't exposed to potential damage.

The anticipated length of travel delays, and on which roads, as well as possible detours, have not been announced yet.
