ithout the luxury of sheltering at home as some have experienced these past few months, essential workers are experiencing unprecedented levels of stress and anxiety, according to mental health experts. This of course includes the massively overburdened frontline health care workers. Nearly half of all American adults say the COVID-19 pandemic is hurting their mental health, according to a recent KFF Health Tracking poll. But those numbers could be much higher for critical workers, Alison Holman, a psychologist and nurse, told the American Heart Association. Essential workers such as restaurant servers suffered yet another setback last week when a second round of closures was ordered by Governor Gavin Newsom. uring public comment at Tuesday’s July 7 Zoom council meeting, a number of issues were discussed, primarily in deep support of setting up a Monrovia Human Relations Equity Commission to address systemic racism at home and address the recent Black Lives Matter (BLM) movement and protests at Library Park. However, several commented on the July 4 virtual celebration video the city put out. In particular, several residents called out Mayor Pro Tempore Alex Blackburn and asked for his immediate resignation. Resident Ruthie Yule said Blackburn was tone deaf and she had lost her faith in the mayor pro tem for comments on that video that implied he was telling people how to protest politely in a civil

manner. Melissa Taylor also took exception with the July 4 video comments Blackburn made and pointed out that he has refused to publicly say the words “Black lives matter.” Blackburn countered, “I did not critique Black Lives Matters.” He went on to say he believed all people protesting should choose their words carefully to better get their message across. Another angry resident, Jessica Williams, asked
Blackburn to “step down.” The majority of the letters for public comment however were on more positive notes regarding the importance of honoring BLM and all people in the community through the creation of a city commission which will focus on positive rhetoric to create equity for all Monrovians. PASADENA POLICE RESPOND TO CLAIMS THAT CONSTITUTIONAL RIGHTS WERE VIOLATED The City of Pasadena received two claims from an attorney asserting that the Constitutional rights of two people were violated by Pasadena Police officers when they searched an apartment after responding to a call. The Pasadena Police Department (PPD) is releasing officer body worn camera and a 911 recording of the incident. The recordings detail what transpired on July 22, 2019 when the Police Department’s Communications Center received a call from a despondent male, threatening suicide after losing a large sum of money to an apparent scam. LASD Homicide Assisting Arcadia PD With Murder Suicide Investigation At approximately 10:33 p.m. on Monday, Los Angeles County Sheriff’s Department Homicide Bureau detectives responded to the 500 block of Los Altos Avenue in Arcadia to assist Arcadia Police Department personnel investigate the circumstances surrounding the death of a female adult. Officers responded to a possible suicide call. When they arrived, they found a male Asian adult deceased in the garage. When they entered the home, they found a female Asian adult deceased also. They were both pronounced dead at the scene. The male located in the garage is 75 years-old and the female located inside the home is 68 years-old. They are husband and wife.
They were discovered by a relative at the location. Evidence at the scene has revealed this is a possible murder suicide. The investigation is still ongoing. Anyone with information about this incident is encouraged to contact the Los Angeles County Sheriff's Department's Homicide Bureau at (323) 890-5500. Each year, the Monrovia Community Garden reopens the application process for plots. Monrovians and families enrolled in the Monrovia Unified School District can apply to rent a raised bed for the second year of the program which will run from October 2020 to October 2021. Applications are due by the end of August. There is a fee of $60 annually but scholarships are available. Accepted applicants are responsible for the upkeep, maintenance and appearance of the plots under their responsibility. They must also
attend one to two educational classes a year. If not accepted for this year, applicants can be placed on a waitlist. Experience level does not matter as the program welcomes first time gardeners. The volunteer leadership will help newcomers every step of the way and the program provides necessary materials. Classes, including one coming up on July 18, will keep running and are open to all. Applications can be found at monroviacommunitygarden.org.

Pasadena Police Seek MOUNTAIN LION CAPTURED Shooting Suspect Who IN MONROVIA DIES Injured Two 7-Year-Olds Early Tuesday morning, shots rang out on Lincoln Avenue in Pasadena. A gunman shot several rounds at a Pasadena apartment unit with a woman and six children inside. While not hit by bullets, the two boys received minor injuries: one 7-year-old by some broken glass while another child, also 7, sustained
an injury during a fall during the ordeal. The boys were treated at the scene but did not need further medical attention, according to published reports. There is no known motive behind the midnight shooting on the 600 block of Lincoln Avenue. The suspect is still at large
A seemingly malnourished mountain lion that was captured under the crawl space of a Monrovia home two weeks ago after roaming the area for days has died, a wildlife official announced Monday morning. The big cat had reportedly suffered serious injuries to its neck and was being treated by veterinar-
ians. He was also being treated for other health issues including dehydration and kidney problems. According to a spokesperson for the California Department of Fish and Wildlife, a necropsy is scheduled to be done and will offer more details on the animal’s untimely death.

alph Walker is many things — a KGEM host, a friend around town, a reader and thinker — but what he is most is an African American male. He said, “I could hardly watch it. I knew George Floyd would die. That officer that had his knee on Floyd’s neck, he had the look of death. I knew. There are so many already on ‘The List’ of victims that if you name one, you do injustice to all the others. There have been so many men, so many women, and even so many children whose names are on The List.” Some other men of color on The List include Mark Edward Allen of Monrovia; Lt. Col. Allen Allensworth who was mysteriously killed on Myrtle in 1914; and Gilbert Kiihoa and James O’Balles who were beaten by Monrovia Police in December of 1947. Walker said, “I admit I’m obsessed with Mark Allen. I want Monrovia to remember that name. Mark was only 13 when he was found dead in the Monrovia jail in 1971. I can show you his grave at Live Oak Cemetery.” Walker continued, “I’m so tired of people suggesting there are just a few ‘bad apples’ in police departments. Let’s admit that most police departments are corrupt. Dr. King said, ‘There comes a time when silence is compliance.’ And too many police and people in authority don’t want to cross the blue line. They put more value on hurt feelings and their own pensions than they do on the lives of African Americans.” Ralph was made to understand that he was Black when he was about 8 years of age. “We were coming home from school, and we saw this overwhelming crowd at the AA Rayner Funeral Home on 71st

Street in South Chicago. My mother then had me and my siblings sit down to watch the TV coverage of the funeral of Emmett Till. Mama showed us that Jet magazine article. I then looked at the color of my own skin, and I realized that it is dangerous to be Black — even in the North.” Ralph said, “My grandmother was born in Hattiesburg, Miss., and she knew racism. She told us a lot of stories.” Still, Grandma would not be intimidated. “She would take me on the bus with her to go to downtown Chicago’s State Street. She would warn me not to say anything. Grandmother purposefully sat in the front of the bus. We got a lot of looks but she wasn’t going to move.” Grandmother was an entrepreneur that ran O Boy Ice Cream and a wig-weaving business, Mayes Hair Box, in South Side Chicago. Young Ralph saw the fury
of the Chicago Police against the demonstrators at the 1968 Democratic National Convention. “My friend, Cornell Rycraw, and I were there but we were afraid to get out of the car. We knew the police would beat Blacks unmercifully.” Also in 1968, Ralph got drafted to go to the Vietnam War. “I wasn’t going to go. If Mohammed Ali wouldn’t go, I wouldn’t go either. I was found guilty, and the judge sentenced me to three years federal probation. I couldn’t get jobs but I attended Malcolm X Junior College before graduating from Loyola University of Chicago. After the 1979 Chicago blizzard, I had enough. I left for Los Angeles.”

MONROVIA STUDENTS CAN ENROLL IN IMMACULATE CONCEPTION’S NEW STEM ACADEMY Elementary school students in Monrovia have a new resource to prepare them for the ever-changing world they live in. Beginning in August 2020, Immaculate Conception School in Monrovia will be Immaculate Conception STEM Academy. The new STEM (science, technology, engineering, and mathematics) curriculum at the academy will equip and empower STEM proficient students that will be able to answer complex questions, investigate global issues, develop solutions for challenges and real-world problems using rigorous science, technology, engineering, and mathematics content. The upgrade comes after the TK-8 Catholic elementary school was accepted as part of the second cohort of schools to the Archdiocese of Los Angeles STEM Network. “Our staff and parents are thrilled about joining the STEM Network because it means that we can start early to prepare students for the millions of jobs that remain unfilled or that have yet to be created, while also nourishing their faith,” said Carmela Lovano, principal of Immaculate Conception STEM Academy. “This is an opportunity no parent in our community should miss. We’re confident these foundational skills of creative thinking and problem solving and the expansion of our STEM curriculum will give students the successful futures they deserve.” The new school-wide approach to STEM focuses on real-world problem solving through a Catholic social justice lens and features parent engagement, university and community partnerships, and flexible indoor and outdoor learning spaces and environments. Immaculate
Conception STEM Academy will follow a program model focused on STEM, with key features like specialized math and science teachers, starting from kindergarten. By implementing a system of block scheduling, the schools allow an authentic, real-world learning system. In the first year of the program, one grade band will follow the STEM path. After three years, the school expects to be fully STEM-integrated. The STEM Network was launched in 2018 by the Archdiocese of Los Angeles Department of Catholic Schools to formalize and implement STEM education in elementary schools throughout Los Angeles, Santa Barbara and Ventura counties. New Arcadia Transit App Coming July 28 The new Arcadia Transit app will launch on July 28, 2020. The user-friendly app will provide information on routes, schedules, and bus arrival updates for fixed routes throughout the city. Users can get real time information and track bus locations, allowing for easier trip planning. There’s also a notification feature that alerts users of their approaching bus. The current Arcadia Transit app will no longer be available starting July 28, 2020, and will
be replaced with the new app available through the DoubleMap Bus Tracker. Users will need to download DoubleMap Bus Tracker on the App Store or Google Play first and then select Arcadia as the transit system to view. ARCADIA June 28 At 2:50 a.m., officers responded to Arcadia Park Pharmacy, located at 301 W. Huntington Drive, regarding an audible alarm activation. Officers determined the suspect(s) smashed a window, looked inside a miniature refrigerator, and fled with an unknown amount of property. At 4:20 a.m., an officer responded to the area of 150 Las Tunas Drive regarding a traffic collision involving a vehicle that had crashed into a tree. Upon contacting the driver, the officer detected a strong odor of alcohol emitting from the driver’s person. In addition to performing poorly during the Standardized Field Sobriety Tests, the driver had a blood alcohol content of .193%. The officer also discovered the driver had never been issued a license. The 25-year-old male from Temple City was arrested. June 29 At 6:58 a.m., an officer responded to Royal Oaks Liquor Store, located at 511 N. First Ave., regarding a commercial burglary report. An investigation revealed the unknown suspect(s) cut a lock to the security gate, smashed the front glass door, stole more than $1,000 in cash and thirty cans of chewing tobacco. The investigation is pending a review of the surveillance footage. At 11:12 a.m., an officer responded to a residence in the 1800 block of El Vista Circle regarding a residential burglary report. the home, she discovered the front door was unlocked and the office had been ransacked. The loss is unknown at this time. June 30 At 8:15 a.m., an officer responded to a residence in the 1000 block of Balboa Drive regarding a vehicle burglary report. The officer determined that sometime during the previous night, unknown suspect(s) smashed two windows and fled with a tablet. At 12:16 p.m., an officer responded to a residence in the 1100 block of South Second Avenue regarding a vandalism report. The victim discovered his rear kitchen glass door had been shattered, but not broken entirely, and the suspect(s) did not attempt to enter the home. July 1 At 9:44 a.m., an officer responded to Hampton Inn, located at 311 E. Huntington Drive, regarding a stolen vehicle report. Surveillance footage revealed the victim left his car unlocked and the suspect, who was also staying at the hotel, entered the vehicle multiple times before successfully stealing the vehicle. Baldwin Park Police Department later located the vehicle. At 10:15 a.m., officers responded to a residence in the 400 block of North Old Ranch Road regarding an audible alarm activation. The officers determined the suspect(s) entered the home by smashing a rear sliding glass door. Once inside, the suspects ransacked multiple rooms, and fled with an unknown amount of property.

The officers determined an argument between a husband and wife turned violent when they both began hitting each other. The husband was determined to be the primary aggressor and was arrested. The 39-yearold male from Arcadia was arrested. July 3
At 1:36 a.m., officers responded to a residence in the 1400 block of South Sixth Avenue regarding a residential burglary report. An investigation revealed unknown suspect(s) gained entry to the residence by unknown means, and once inside, the suspects forced open a bedroom door and fled with miscellaneous electronics, clothing, credit and debit cards, a karaoke machine, and handbags. The suspects also stole two vehicles from the driveway. At 7:30 a.m., an officer responded to the 300 block of North Santa Anita Avenue regarding a stolen vehicle report. Sometime during the previous night, suspect(s) stole the victim’s Chevrolet truck from the gated parking lot. There is no suspect information at this time.

At 6:44 a.m., an officer responded to Burger King, located at 84 Las Tunas Drive, regarding a commercial burglary report. Surveillance footage revealed a suspect entered the business at approximately 12:45 a.m. and attempted to open the office but was unsuccessful. The suspect ultimately fled with four tablets. At 3:50 p.m., the Arcadia Police Department received an electronically submitted report for a stolen bicycle. June 25 At 4:59 a.m., a resident in the 700 block of West Colorado called police to report a large mountain lion under her house. Officers responded along with the State Fish and Wildlife Warden and a biologist. At approximately 8 a.m., detectives sent a robot under the house, which allowed the warden to tranquilize the lion and safely bring it out from under the house. The suspect had left a BB gun in the vehicle, but nothing was taken. Officers responded and collected the BB gun as evidence. At 12:17 p.m., a resident in the 300 block of East Olive called police to report his brother was at the location in violation of a restraining order which requires him to stay away from the resident and the home. Officers arrived and
found the subject on the front porch of the home and he was refusing to leave. He was arrested for violation of the restraining order. At 12:40 p.m., an employee of a business in the 100 block of South Myrtle walked outside to his parked vehicle and discovered someone had gained entry and took his laptop, wallet and other items. Officers responded and searched the area, locating all of the property nearby, except the wallet. At 4:08 p.m., an employee of a hotel in the 700 block of West Huntington called police to report unusual activity in one of their rooms. Multiple people were seen entering and leaving the room over a period of two days. Officers responded and contacted the renter of the room. An investigation found he was in possession of a controlled substance. He was arrested. June 28 At 1:30 a.m., an officer was conducting a traffic stop of a vehicle in the 600 block of Norumbega for unsafe backing. As the officer spoke to the two occupants of the vehicle, he noticed a significant amount of mail inside the car. Neither of the occupants lived in the area. Further investigation revealed the occupants were in possession of stolen mail. The female driver also had multiple warrants for her arrest and the male passenger was in possession of a controlled substance, as well as drug paraphernalia. Both subjects were arrested and taken into custody. The victims of the stolen mail were contacted and had their mail returned.

Russell Lee Lightfoot was the only son of James and Julia Lightfoot. He was born on Nov. 18, 1965 in Los Angeles, Calif. where he became the youngest to siblings Kevin, Carole and Linda. He was also a much-loved uncle to Carole's son Alexander. Russell passed away in a fatal car accident on June 19 at 12:47 p.m. He was popular with his peers and much loved by all who knew him. He was a very intelligent boy and man. His great need to learn and understand intricate subjects was so impressive it was no surprise that he would attain his Bachelor of Arts in economics at Cal State, Long Beach, and onwards to achieving his Master of Arts degree at Virginia Polytechnical Institute and State University. Russ was the “go-to-guy” when you needed advice or information. Music was his passion and his vast
knowledge of all genres was admired by many great musicians. His other passion was his wife Sabrina Lightfoot (who passed away alongside him in the accident) and the step-family he fell in love with. His last days on earth were fulfilled with love, laughter, and content. Sabrina and Russ were inseparable and did everything together, which is why it only makes sense that they entered into heaven side by side. This has been a great loss to his family and friends. He will be missed by many forever. The family will be holding a ceremony for family and friends to pay their respects in the near future, but the date and location is not set at present. The family asks that everyone lift them in prayer.

Sabrina was born at Duke University Medical Center and left us at 9:34 p.m. on Friday June 19, 2020 at the same hospital. Sabrina Lightfoot left behind three sons (Joshua Campbell, Bradley Campbell, and Ryan Knight), two sisters (Audrey Perry and Stephanie Richardson), her father and stepmother (Kenneth and Jan Perry), as well as three grandchildren (Owen Campbell, Brooklyn Knight, Aleah Birkley), two nieces and a nephew (Lindsay Blackwell, Natalie Perry, and Caleb Carroll), a great-niece (Haylee Collins), and a soon-to-be-daughter in law (Brittany Fortier). Sabrina’s mother, Brenda Louise (Daniels) Separk, passed before her on Jan. 25, 2010. Sabrina’s husband, Russell Lightfoot, passed away
alongside her in the accident. Sabrina lived her life for her family and friends. She was full of love and laughter and was known for putting anyone and everyone before herself. Sabrina loved Russ more than words could ever express and the two shared a life full of love and they did everything together, which is why it only made sense that they entered heaven together. Sabrina and Russ were at their happiest times when they passed, living their lives to the fullest. County Caltrans to Replace Concrete Median Barrier on US 101 Caltrans will replace the concrete median barrier on US 101 spanning 19.3 miles between Hollywood and Woodland Hills in Los Angeles. The National Community Reinvestment Coalition (NCRC) has ranked cities on gentrification during a five-year between 2012 and 2017. According to their findings, San Francisco-Oakland took the top spot. Other California cities in the top 20 include San Jose (8), Sacramento (10), San Diego (14) and Los Angeles (15). The report also found that while a small number of cities were booming, most were not. NCRC found that
“gentrification and displacement was highly concentrated, and that most lowincome neighborhoods, and the vast majority of cities, continued to deal with a chronic lack of investment.” Overall, NCRC found that gentrification remains a significant threat to minority and lowand moderate-income families in some of the largest and most prosperous parts of the country.

Proposed Amendment to the City of El Monte Citizen Participation Plan: The City of El Monte adheres to the citizen participation process when conducting program planning and reporting for the CDBG, HOME and ESG programs. The U.S Department of Housing and Urban Development (HUD) released a memorandum to waive Community Planning and Development (CPD) Grant Program and Consolidated Plan Requirements to prevent the spread of COVID-19 and mitigate economic impacts caused by COVID-19. Given the need to expedite actions to respond to COVID-19, HUD waives 24 CFR 91.105(c)(2) and (k), 91.115(c)(2) and (i), in order to balance the need to respond quickly to the growing spread and effects of COVID-19 with the statutory requirement to provide reasonable notice and opportunity for citizens to comment on substantial amendments concerning the proposed uses of CDBG, HOME, or ESG funds.

The City of El Monte seeks to adopt thresholds of significance under the California Environmental Quality Act (CEQA), pursuant to State CEQA Guidelines Sections 15064(b) (2) and 15064.7. The proposed thresholds would address a project’s potential to impact transportation by the amount and distance of automobile travel attributable to a project, referred to as Vehicle Miles Traveled (VMT) for land use and transportation projects.

When a project is not exempt from CEQA, the City of El Monte will use a methodology to streamline land use project review, to presume less than significant impacts for projects in a transit priority area, a low VMT area or that meet the project type criteria for inherently local serving uses. The proposed thresholds of significance being considered for adoption would provide that a land use project would result in a potentially significant project-generated VMT if certain conditions are met. When a project is not exempt from CEQA, the City of El Monte will use a screening methodology to streamline transportation project review, to presume less than significant impacts for projects that reduce or have no impact on VMT. Projects not screened from further analysis, including those that have the potential to directly increase VMT or the potentially induce vehicle travel causing new or longer vehicle trips, will be evaluated for potentially significant impacts on VMT. The transportation project’s effect on VMT would be considered potentially significant for purposes of determining a cumulative impact if certain conditions are met. If adopted, these thresholds of significance would apply to proposed projects and plans that require discretionary approval from the City and would facilitate compliance with CEQA Guidelines 15064.3, which establishes that VMT, rather than automobile delay (also referred to as Level of Service (LOS)), is generally the most appropriate basis for determining environmental impacts regard-

Although LOS will no longer be considered an environmental impact for traffic purposes, the City may still require the LOS analysis of project delay outside of CEQA review for a broader transportation purposes, or for reasons unrelated to CEQA traffic impacts such as land use adjacency, general plan consistency, safety, community benefits, and/or public health pursuant to the City’s existing general plan. California Environmental Quality Act Program Environmental Impact Report The proposed 2020 LA River Master Plan (Project) builds on the adopted 1996 Master Plan and other regional planning studies since then and is intended to create 51 miles of connected open space along the LA River to improve health, equity, access, mobility, and economic opportunity for the diverse communities of Los Angeles County while still providing flood risk management. The update process began in 2018 and is being led by Los Angeles County Public Works and supported by several other Los Angeles County departments, as well as a 41-member steering committee representing agencies, non-profit organizations, and other governmental and non-governmental entities providing input and technical expertise related to the Project's three integrated themes: water, people, and the environment. Los Angeles County Public Works is preparing a Draft Program Environmental Impact Report (PEIR) to assess the potential environmental impacts of implementing the 2020 LA River Master Plan. We are soliciting input from members of the public, organizations, and government agencies on the scope and content of the information to be included and analyzed in the PEIR.

THE CITY COUNCIL DOES ORDAIN AS FOLLOWS: SECTION 1. Monterey Park Municipal Code (“MPMC”) § 2.04.010 is amended to read as follows: “2.04.010 Meetings. A. Regular meetings of the city council will be held on the first and third Wednesday of each calendar month at 6:30 p.m. in the city council chambers of City Hall, located at 320 West Newmark Avenue or such location designated on an agenda in accordance with Government Code § 54954. If the date of any such meeting falls on a holiday, the regular meeting will be held the next succeeding day at the same time and place.

This Ordinance must be broadly construed in order to achieve the purposes stated in this Ordinance. It is the City Council’s intent that the provisions of this Ordinance be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Ordinance. SECTION 4. Enforceability. Repeal or supersession of any provision of the MPMC does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before this SECTION 5. Validity of Previous Code Sections. If this entire Ordinance or its application is deemed invalid by a court of competent jurisdiction, any repeal or amendment of the MPMC or other ordinance by this Ordinance will be rendered void and cause such previous MPMC provision or other the city ordinance to remain in full force and effect for all purposes. SECTION 6. Severability. If any part of this Ordinance or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Ordinance are severable. SECTION 7. Electronic Signatures. This Resolution may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature. SECTION 8. The City Clerk, or his duly appointed deputy, is directed to certify the passage and adoption of this Ordinance; cause it to be entered into the City of Monterey Park’s book of original ordinances; make a note of the passage and adoption in the records of this meeting; and, within 15 days after the passage and adoption of this Ordinance, and cause it to be published or posted in accordance with California law. Monterery Park City Notices ORDINANCE NO. 2178 AN UNCODIFIED URGENCY ORDINANCE ADOPTING NON-LAND USE REGULATIONS FOR IMPLEMENTING THE MONTEREY PARK BUSINESS RECOVERY PROGRAM. THE COUNCIL DOES ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds, determines and declares as follows: A.

On March 11, 2020, at 7:00 p.m., the City declared a state of local emergency due to the COVID-19 Pandemic (the “Emergency”). That Emergency was ratified by Resolution No. 12142, adopted March 18, 2020; extended on April 15, 2020 by Resolution No. 12151; and further extended on June 3, 2020 by Resolution No. 12164; An additional local emergency was declared on May 31, 2020 related to the unrest associated with the tragic death of George Floyd in Minneapolis, MN. That emergency was ratified on June 3, 2020 by Resolution No. 12165 (also part of the “Emergency”); The City Council takes notice of the well-documented secondary effects of the Emergency include record-high unemployment rates, bankruptcy, and other disastrous effects upon the national, state, and local economies. It will be many months before the complete extent of this economic devastation is clarified; The City Council believes that it is in the public interest for the City to implement regulations to facilitate the rapid recovery of the local economy, promote additional economic growth, and mitigate the effects of the Emergency;

Regulations are needed to efficiently implement development projects that will create jobs, invest in the local economy, assist in recovery, and protect the public welfare;

The City Manager and City Planner may recommend changes to this Ordinance – including codification within the Monterey Park Municipal Code – when it is practicable;

Because of the findings set forth above, the City Council finds that this Ordinance should be adopted on an urgency basis to preserve the public health, safety, and welfare in accordance with Government Code §§ 36934 and 36937(b); and The regulations adopted by this Ordinance are intended to be implemented temporarily in order to accelerate City approvals and promote local businesses. This Ordinance will be uncodified and referred to as the “Monterey Park Business Recovery Program.”
SECTION 3. Monterey Park Business Recovery Program. The Monterey Park Business Recovery Program (the “Program”) attached as Exhibit “A,” and incorporated by reference is adopted by the City Council as if fully set forth. SECTION 4. Conflicts. In the event of a conflict between the provisions of this Ordinance and the provisions the MPMC, any other ordinance, or any resolution, the provisions of this Ordinance and the Program govern. The City Planner is authorized to resolve any ambiguities in the manner set forth in the MPMC. Any such determination must be forwarded to the City Council as an informational item when practicable. SECTION 5. Environmental Review. This Ordinance was reviewed pursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq., “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regulations §§15000, et seq., the “CEQA Guidelines”). Based upon that review, this Ordinance is exempt from further review pursuant to CEQA Guidelines § 15269(a) because the protection of public and private property is necessary to maintain service essential to the public, health and welfare. 1 Additionally, this Ordinance is exempt pursuant to CEQA Guidelines §15061(b)(3) because it can be seen with certainty that there is no possibility that the Ordinance may have a significant effect on the environment. SECTION 6. Sunset Clause. The Council finds that it is in the best interest of the public safety, welfare and convenience of the City to implement this Ordinance during, at least, the Emergency. To ensure that the City Manager reviews the MPMC as contemplated by this Ordinance, this Ordinance will automatically be repealed and will become ineffective on December 31, 2020, unless the City Council takes additional action to extend the effectiveness of this Ordinance or supersedes it via a subsequently adopted Ordinance amending the MPMC. SECTION 7. Construction. This Ordinance must be broadly construed to achieve the purposes stated in this Ordinance. It is the City Council’s intent that the provisions of this Ordinance be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Ordinance. SECTION 8. Severability. EXHIBIT A MONTEREY PARK BUSINESS RECOVERY PROGRAM BRP1 Reg. 010. Definitions. Notwithstanding any definition set forth in the Monterey Park Municipal Code (“MPMC”) and unless the contrary is stated or clearly appears from the context, the definitions set forth below govern the construction of words and phrases used in the Monterey Park Business Recovery Program. Words and phrases not defined below will be as set forth in the MPMC. “ABC license” means the license issued by the California Department of Alcoholic Beverage Control. “Building Official” means the Building Official of the City of Monterey Park as designated by the City Manager. “City Planner” means the City Planner as designated within the MPMC or such person authorized by the City Manager in writing. “Discretionary Permit” means any discretionary permit or action required by the MPMC or by any Specific Plan. “Entertainment or entertainment establishment” means the organized action of providing amusement or enjoyment to invited members of the public. Such entertainment may be provided free of charge or for a fee. “Licensed Design Professional” means the California Licensed Architect or Engineer, as applicable, identified as such on the building permit application and accompanying plans. “Outdoor Temporary Event” includes Temporary Outdoor Dining and Temporary Outdoor Retail Sales Events.
E.
Fees. Except as otherwise provided by federal, state, or local laws, or other City Council authorized restrictions, all fees applicable to this Program including, without limitation, fees for using public places, will be established by City Counci Resolution.
F.
Temporary Outdoor Dining Permits. Temporary Outdoor Dining permits are subject to the following:
“Program” means this Monterey Park Business Recovery Program. “Public place” means an area open to the public, or an alley, plaza, park, or parking lot, or an automobile, whether moving or not, or a building open to the general public including one that serves food or drink, or provides entertainment. “Self-Certification,” “Self-Certify” or “Self-Certified” means a submittal to the Building Official that is (1) made by a Licensed Design Professional identified in the building permit application; (2) accompanies plans filed with the Building Official by that Licensed Design Professional; and (3) for which the Licensed Design Professional attests such plans (a) do not contain any false information; (b) comply with all applicable law including, without limitation, the MPMC; and (c) were prepared by or under the direct supervision of, and signed and stamped by, that Licensed Design Professional. “Temporary Outdoor Dining” means outdoor dining located within the City right of way pursuant to a permit and/or is required to secure off-site parking or other outdoor dining for which the property does not have the required number of onsite parking spaces. Temporary Outdoor Dining is only allowed in conjunction with a permitted restaurant and is only be permitted to utilize Temporary Outdoor Structures/Facilities. Temporary Outdoor Dining requires a permit and is only allowed for such time commensurate with the time that temporary parking is provided. “Temporary Outdoor Retail Sales Events” means outdoor retail sales events conducted outdoors on the same premises as, and are consistent in character with, an existing retail store use. These events require a permit and may be allowed up to a total of 30 days in any twelve-month period. Temporary Outdoor Retail Sales Events can only be permitted to utilize Temporary Outdoor Structure/Facilities and must comply with the temporary parking requirements. “Temporary Outdoor Structure/Facilities” includes awnings or canopies made of material or wood, tents, shade umbrellas, and similar types of structures that can be constructed and removed within a seven day period. Temporary Outdoor Structure/Facilities also include lighting and heating improvements that can be constructed and removed within a seven day period. Any applicant for Temporary Outdoor Structure/Facilities must sign an acknowledgement that the Temporary Outdoor Structure/Facilities can be removed within a seven day period. All Temporary Outdoor Structure/Facilities must meet all zoning, building, fire, health and other applicable law. “Temporary Use Permits” are permits allowing Temporary Outdoor Dining, Temporary Outdoor Retail Sales Events, and temporary parking associated with such uses.
G.
BRP1 Reg. 020. Outdoor Temporary Event Permits. A.
The City Planner is authorized to receive applications, issue and revoke temporary use permits, and otherwise implement the Business Recovery Program as set forth in this Section.
B.
Persons who obtain a permit pursuant to this Section are not also required to obtain separate permits in the MPMC, e.g., encroachment permits.
C.
Permits Required. It is unlawful for any person to conduct, sponsor, or knowingly participate in any outdoor temporary event without a valid permit issued pursuant to this Program. Possessing a valid temporary use permit does not excuse any failure to otherwise comply with this code or other applicable law.
D.
Nature of the Permit. Permits issued pursuant to this Program are subject to the following limitations: 1.
Permits are personal to the applicant not to the premises upon which the event is conducted. No other individual may conduct an event under the authority of a permit issued to another. For purposes of this Program, a permit is not deemed transferred or assigned if the permittee is a corporation or partnership which remains under the control of the same individual or individuals who controlled it at the time the permit was approved;
2.
Permits cannot be transferred or assigned;
3.
No property rights are conferred to the permittee;
4.
There is no right of renewal; and
5.
Permits are specific to the location for which it is applied. A new permit

1.
Permits cannot be issued for outdoor dining in a street or alley;
2.
To provide for adequate pedestrian circulation, temporary outdoor dining must maintain a minimum of four feet of clearance between dining furnishings and any curbline, street furniture, or above ground utilities. A minimum of 50 feet of clearance must be maintained between dining furnishings and the centerline of intersecting perpendicular driveways, alleys or streets to provide for adequate vehicle sight, unless a lesser distance is determined by the City Planner to be adequate for the protection of the public safety.
3.
Tables and chairs used for outdoor dining must be of substantial materials. Tables may be a maximum of three feet in diameter if round and three feet along the longest side if rectilinear. All such furnishings must be stored indoors after hours of operation unless otherwise determined by the City Planner.
4.
Temporary Outdoor Structure/Facilities, without lettering, may also be permitted by the City Planner.
5.
No outdoor dining, including furnishings and signs, may block visibility of display windows or signage of adjacent businesses unless written consent of any affected adjacent business owner to block visibility is obtained by the applicant and provided to the City Planner.
6.
The permittee must maintain the outdoor dining area in a clean and safe condition at all times, including properly disposing of all trash generated by the operation.
7.
The City may charge a rental fee for use of public places.
8.
An applicant must submit a diagram drawn to scale and dimensioned showing the proposed location of the outdoor dining with all seating and signage.
9.
An applicant must submit a graphical depiction, such as sample photographs, depicting the appearance of the chairs, tables, and other equipment proposed to be used in the outdoor dining area.
10.
An applicant must submit the proposed days and times of operating the outdoor dining area.
Application for Permit. 1.
Permit applications must be filed by a natural person.
2.
Permit applications must be in a form prescribed by the City Planner, signed under penalty of perjury, and, for all permits, will contain all of the following information: the name, mailing address, and daytime and evening telephone numbers of the person filing the application; if the permit is obtained on behalf of an organization, the name, mailing address, and daytime telephone number of the organization; and if requested by the City Planner, written documentation of the authority under which the applicant is applying for the permit on behalf of the organization; the name, mailing address, and daytime and evening telephone number of an alternate person to contact if an emergency arises and the applicant is unavailable; and such additional information required by the City Planner.
Review by City Departments. After an application is filed, the City Planner wil immediately forward the application to the following city departments for review: 1.
The fire department;
2.
The police department; and
3.
The public works department.
Special Conditions. Upon receiving an application, these departments wil consider the application, conduct any necessary investigation, and provide the City Planner with written recommendations regarding: 1.
Any special conditions for a permit; and
2.
Any additional recommendations.

Time for review. Except as provided in this Program, completed applications for a permit authorizing an event should be denied, approved, or conditionally approved by the City Planner within 14 business days after receiving the completed application. Unless otherwise provided, the applicant’s acceptance of the approval or conditional approval must be received by the City Planner within five business days after the applicant was served with notification of the decision and before any entertainment or outdoor dining may occur.

Subsequent Conditions. The City Planner may condition previously issued permits upon learning or discovering facts not previously disclosed or reasonably

Display of permits. The permit issued pursuant to this Program must at all times be posted in a conspicuous place and be immediately produced upon the request of any police or code enforcement officer of the city.
Q.
Emergency Suspension of Permit. The City Planner and any sworn public safety officer may temporarily suspend a permit whenever there is an emergency that requires such action to protect public safety.
Issuing Permits. The City Planner should issue a permit if 1.
The application was complete in accordance with this Program;
2.
There are no grounds for denying the permit; and
3.
The applicant accepts the permit approval or conditional approval in writing.

The application is incomplete;
2.
The applicant failed to provide reasonable supplemental application information requested by the City Planner;
3.
Information submitted by the applicant is materially false;
4.
The application is submitted by a person with a suspended permit or whose permit was revoked;
5.
The location of the proposed temporary outdoor event does not conform to the requirements of this Program;
6.
Issuing the permit would endanger public health, safety, or welfare as determined by the City Planner.
A.
Purpose: To expedite building permit approvals by allowing Licensed Design Professionals to voluntarily self-certify building plans.
B.
Eligible Participants: To participate in the Program, applicants must be registered and be in good standing as a Licensed Design Professional with the State of California.
C.
Insurance Requirements: For a project to be accepted for Self-Certification, the Licensed Design Professional is required to furnish the City Planner insurance in accordance with the City’s requirements and not less than the valuation of the permitted project.
D.
Optional Prescreening Process: The Licensed Design Professional who intends on filing an application with a Self-Certification may meet with the City Planner, or designee, for a courtesy prescreening of the proposed project to ensure the submittal is complete.
E.
Submittal Requirements: The Licensed Design Professional who intends on filing an application with a Self-Certification must submit that application to participate in the program to the Building Official. Self-Certified plans must contain all the information listed in the corresponding City of Monterey Park handout regarding building design criteria. A Self-Certification form and a “hold harmless” letter, in a form approved by the City Attorney, must be completed in its entirety and submitted for each project by the design team and the property owner. The SelfCertification program will be all inclusive, i.e., all construction trade work that requires permits for the project must be Self-Certified. Each page of the plans submitted, must be wet stamped and signed by a Licensed Design Professional for each applicable trade.
F.
Non-Building Division Approvals: The Licensed Design Professional who intends on filing an application with a Self-Certification must provide documentation to the Building Official demonstrating final approvals from any affected City department before the Building Official issues a permit. That Licensed Design Professional must also provide documentation to the Building Official appropriate approvals of any applicable “outside” agency. Those outside agencies include, without limitation, the following: Los Angeles County Health Department and affected school districts.
G.
Fees: All fees required by the Program will be established by City Council resolution.
H.
Permit Issuance: Applications that have met all the criteria of this voluntary SelfCertification program will be issued a building permit the same day of completed and approved application submittal.
I.
Inspection Protocol: All code-required State of California or City of Monterey Park inspections are required.
J.
Audits: All Self-Certified plans are subject to auditing by the Building Official to determine whether plans comply with the applicable California and City of Monterey Park laws, codes, rules, and regulations. If plans are found not to comply, then the Licensed Design Professional who intends on filing an application with a Self-Certification will ensure compliance. If compliance is not obtained within a reasonable amount of time, then the Building Official may report the non-compliance items to the appropriate licensing board with the State of California.
General Permit Conditions. 1.
Unless suspended or revoked, permits issued pursuant to this Program have a term of 30 days. Should a permit expire, the permittee must comply with this Program to obtain a new permit.
2.
Permittees must enter into a hold harmless agreement, in a form approved by the city attorney, with the city which will, in part, indemnify city, its officers, employees, and agents, from any liability arising from a permit issued pursuant to this Program. Insurance Requirements. Permittees must obtain liability insurance in accordance with City Council resolution.
g
Alcohol Related Conditions. For Temporary Outdoor Events with an ABC license, the permit will include the following conditions: 1.
The exterior lighting of the parking area must be kept at an intensity of between one and two foot-candles so as to provide adequate lighting for patrons while not disturbing surrounding residential or commercial areas.
2.
The applicant must obtain and maintain all licenses required by the Alcohol Beverage Control Act (Business & Professions Code §§ 23300, et seq.).
3.
The applicant must post a sign in a clear and conspicuous location listing a phone number at which a responsible party may be contacted during all open hours of the entertainment establishment to address any concerns of the community regarding noise at the entertainment establishment. Said contact's name and phone number must also be available through entertainment establishment staff at all times.
4.
If complaints are received regarding excessive noise, lighting, building access, or other disturbances associated with alcohol service, the City Planner may, in its discretion, take action to review the permit including, without limitation, adding conditions or revoking the permit.
Appeals. The City Manager’s decision is final. There is no right to a City Council appeal. The final decision will inform the appellant that the decision is a final decision and that the time for judicial review is governed by Code of Civil Procedure § 1094.6.

A new Chapter 5.88 is added to the Monterey Park Municipal Code MC”) to read as follows: “CHAPTER 5.88 HOTEL REGISTRIES 5.88.010
Definitions.
Unless the contrary is stated or clearly appears from the context, the following definitions govern the construction of the words and phrases used in this Chapter. “Guest” means any person or persons seeking to rent or let a hotel room or suite within the city’s jurisdiction. “Hotel” means any building or portion of any building with access provided through a common entrance, lobby or hallway to one or more guest rooms which are designed, occupied, used or intended to be used, rented or hired out as temporary or overnight accommodations for guests. “Official identification card” means a driver’s license or other official picture identification card issued by a government entity. “Responsible person” means any owner, manager, or proprietor of a hotel. 5.88.020
Guest Register Required; Time to Retain.
Every responsible person will keep a guest register for registering guests. The guest register will be preserved for at least two years and will be subject to inspection by any law enforcement officer in accordance with this chapter. A responsible person may not let, rent, or furnish any hotel room to any guest who fails to register in the guest register as required by this chapter. 5.88.030 A.

Contents of Guest Register – Verification. Each guest register must contain:
1.
The name, address, and date when a guest registered;
2.
The hour that the guest arrived and the time the guest departed or,
3.
The number of the room or suite assigned to the guest;
4.
If the guest has a motor vehicle, the vehicle license number, the name of the state issuing such license, the year, make, and model of the vehicle; and
5.
The guest’s signature.
if the exact time of departure is unknown, the date and time that the responsible owner ascertained the guest departed.
The responsible person must verify that the information entered in the guest register corresponds with the guest’s official identification card. No person may erase or alter any entry on a guest registry or allow erasure or alternation to occur.
5.88.040
Registration by Fictitious Name.
It is unlawful for a guest to provide false information, register under a fictitious name, or show or use a forged, altered, or counterfeit official identification card when renting a room. 5.88.050
Limitation on Hotel Stay.
Except for residential hotels, no guest may stay at a hotel for more than 30 days of any 90-day period. Any hotel guests must re-register before 30 days elapse. 5.88.060
Registry Inspection.
A sworn law enforcement official may request to review hotel registries at any time. The responsible person may either voluntarily provide such information to a sworn law enforcement official or refuse. Except under exigent circumstances, as defined by applicable law, upon refusal, the sworn law enforcement official may, in addition to any other lawful means of obtaining such information including a legislative subpoena, seek a search warrant issued by a court of competent jurisdiction.” SECTION 2. MPMC § 21.04.481 is amended to read as follows: “21.04.481 Hotel. “Hotel” means any building or portion of any building with access provided ugh a common entrance, lobby or hallway to one or more guest rooms which are gned, occupied, used or intended to be used, rented or hired out as temporary or night accommodations for guests. Hotel facilities include banquet and meeting
rooms, restaurant, coffee shops, retail uses, and lobby and entertainment bars. No person(s) shall inhabit or shall be permitted to inhabit any unit or any combination of guest units of such facility for more than thirty (30) days of any ninety (90) day period. The owner and/or operator shall allow authorized representatives of the City to inspect the books and records of the hotel during reasonable business hours for the purpose of determining compliance with the provisions of this title. The owner and/or operator of each hotel shall maintain a written record which indicates the date and time each and every customer checks into and out of the hotel. The owner and/or operator shall allow authorized representatives of the City to inspect such record during reasonable business hours for the purpose of determining compliance with the provisions of this chapter.” SECTION 3. Construction. This Ordinance must be broadly construed to achieve the purposes stated in this Ordinance. It is the City Council’s intent that the provisions of this Ordinance be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Ordinance. SECTION 4. Enforceability. Repeal of any provision of the MPMC does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before this Ordinance’s effective date. Any such repealed part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Ordinance. SECTION 5. Validity of Previous Code Sections. If this entire Ordinance or its application is deemed invalid by a court of competent jurisdiction, any repeal or amendment of the MPMC or other city ordinance by this Ordinance will be rendered void and cause such previous MPMC provision or other the city ordinance to remain in full force and effect for all purposes. SECTION 6. Reliance on Record. Each and every one of the findings and determinations in this Ordinance are based on the competent and substantial evidence, both oral and written, contained in the entire record relating to the project. The findings and determinations constitute the independent findings and determinations of the City Council in all respects and are fully and completely supported by substantial evidence in the record as a whole. SECTION 7. Severability. If any part of this Ordinance or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Ordinance are severable. SECTION 8. Electronic Signatures. This Ordinance may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature. SECTION 9. Recording. The City Clerk, or her duly appointed deputy, is directed to certify the passage and adoption of this Ordinance; cause it to be entered into the City of Monterey Park’s book of original ordinances; make a note of the passage and adoption in the records of this meeting; and, within 15 days after the passage and adoption of this Ordinance, cause it to be published or posted in accordance with California law. SECTION 10. Effective Date. This Ordinance becomes effective on the 30th day following its passage and adoption. PASSED, APPROVED, AND ADOPTED July 1, 2020.

A.
AN URGENCY ORDINANCE AMENDING THE MONTEREY PARK MUNICIPAL CODE TO REVISE THE DUTIES AND RESPONSIBILITIES OF THE PLANNING COMMISSION AND DESIGN REVIEW BOARD.
For projects referred to it by the City Planner, the Planning Commission, or the City Council, the design review board will: 1.
Recommend to the Planning Commission regarding the design of new buildings and structures and modifications to existing buildings and structures and facades, signage, landscaping, open space, pedestrian walkways and appurtenances, and the use of colors, materials, and construction requirements.
2.
Advise the Planning Commission regarding high quality design standards in buildings and development projects to conserve the value of buildings, encourage the most appropriate use of land and maintain a proper relationship between the taxable value of real property and cost of providing municipal services.
THE COUNCIL DOES ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds, determines and declares as follows: A.
On March 11, 2020, at 7:00 p.m., the City declared a state of local emergency due to the COVID-19 Pandemic (the “Emergency”). That Emergency was ratified by Resolution No. 12142, adopted March 18, 2020; extended on April 15, 2020 by Resolution No. 12151; and further extended on June 3, 2020 by Resolution No. 12164.
B.
An additional local emergency was declared on May 31, 2020 related to the unrest associated with the tragic death of George Floyd in Minneapolis, MN. That emergency was ratified on June 3, 2020 by Resolution No. 12165 (also part of the “Emergency”).
C.
The City Council takes notice of the well-documented secondary effects of the Emergency include record-high unemployment rates, bankruptcy, and other disastrous effects upon the national, state, and local economies. It will be many months before the complete extent of this economic devastation is clarified.
D.
The City Council believes that it is in the public interest for the City to implement regulations to facilitate the rapid recovery of the local economy, promote additional economic growth, and mitigate the effects of the Emergency.
E.
Regulations are needed to efficiently implement development projects that will create jobs, invest in the local economy, assist in recovery, and protect the public welfare.
F.
Because of the findings set forth above, the City Council finds that this Ordinance should be adopted on an urgency basis to preserve the public health, safety, and welfare in accordance with Government Code §§ 36934 and 36937(b).
G.
A review of the Monterey Park Municipal Code (“MPMC”) suggests that land use planning and permitting should be more efficient. While the City Council believes that it is in the public interest for land use powers to be exercised by the Planning Commission, the City Council is ultimately responsible for implementing the General Plan (and Land Use Element) for the public welfare. Accordingly, the City Council should retain certain land use authority so that it can directly exercise the City’s Planning Agency powers.
H.
Further review of the historical functions of the design review board (“DRB”), and its effect on land use projects, suggest that its role should be revised and updated. Standards that it is charged with implementing are more than 30 years old and unlikely to meet current land use expectations. Moreover, authorizing the DRB to exercise certain land use powers – after the Planning Commission or City Council have already considered a project – provides unnecessary cost and expense to property owners who seek to develop their properties. Its role should be advisory to the Planning Commission and, under some circumstances, the Planning Commission.
SECTION 2. Chapter 2.56 of the MPMC is amended in its entirety to read as follows: “Chapter 2.56 MONTEREY PARK PLANNING AGENCY 2.56.010. Planning Commission. Pursuant to Government Code § 65100, a planning commission is created. Except as otherwise provided, the City Council delegates authority to the Planning Commission as follows: A.
The Planning Commission may act as the City’s Planning Agency in accordance with Government Code §§ 6500, et seq.
B.
The Planning Commission must receive and expeditiously act on all assignments made by City Council resolution or minute order.
C.
The Planning Commission may make recommendations to the City Council regarding land use regulations including, without limitation, amendments to the General Plan or this Code.
D.
The Planning Commission may administer Title 21 of this Code as specified.
2.56.020. Exceptions. Notwithstanding any other regulation in this chapter, the City Council will act as the City’s Planning Agency as follows: A.
By resolution for any particular project or land use consideration.
B.
For all public projects requiring findings of General Plan consistency in accordance with Government Code § 65402.
C.
For all projects requiring a zone change; zone map amendment; or development agreement.
D.
For any project appealed to the City Council from the Planning Commission.

2.56.040. Design Review Membership. Notwithstanding any other provision of this Code, members of the design review board may either be residents of the city or persons maintaining a business license in the city. It is recommended members have a background as an architect, planner, landscape architect, civil engineer building contractor, or a practicing licensed electrician.” SECTION 3. All references in MPMC Title 21 to “design review board” are changed to “Planning Commission.” MPMC Chapter 2.78 and § 21.02.080 are repealed. SECTION 4. Conflicts. In the event of a conflict between the provisions of this Ordinance and the provisions the MPMC, any other ordinance, or any resolution, the provisions of this Ordinance and the Program govern. The City Planner is authorized to resolve any ambiguities in the manner set forth in the MPMC. Any such determination must be forwarded to the City Council as an informational item when practicable. SECTION 5. Environmental Review. This Ordinance was reviewed pursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq., “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regulations §§15000, et seq., the “CEQA Guidelines”). Based upon that review, this Ordinance is exempt from further review pursuant to CEQA Guidelines § 15269(a) because the protection of public and private property is necessary to maintain service essential to the public, health and welfare. 1 Additionally, this Ordinance is exempt pursuant to CEQA Guidelines §15061(b)(3) because it can be seen with certainty that there is no possibility that the Ordinance may have a significant effect on the environment. SECTION 6. Construction. This Ordinance must be broadly construed to achieve the purposes stated in this Ordinance. It is the City Council’s intent that the provisions of this Ordinance be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Ordinance. SECTION 7. Severability. If any part of this Ordinance or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Ordinance are severable. SECTION 8. Recordation. The City Clerk, or his duly appointed deputy, is directed to certify the passage and adoption of this Ordinance; cause it to be entered into the City of Monterey Park’s book of original ordinances; make a note of the passage and adoption in the records of this meeting; and, within fifteen (15) days after the passage and adoption of this Ordinance, and cause it to be published or posted in accordance with California law. SECTION 9. Declaration of Urgency. Based on the findings set forth in Section 1, this is an Urgency Ordinance adopted for the immediate preservation of the public peace, health, safety and welfare. SECTION 10. Electronic Signatures. This Ordinance may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature. SECTION 11.
Effective Date. This Ordinance will become effective immediately
upon adoption pursuant to Government Code §§ 36934 and 36937 for the immediate preservation of the public peace, health, safety, and welfare. Pursuant to those statutes this Ordinance is adopted by fourth-fifths vote of the City Council.
