T
uesday’s state press conference in Sacramento was soberly optimistic, to paraphrase Governor Gavin Newsom. He announced modifications to the statewide stay-at-home order to allow more businesses in California to reopen, including dine-in restaurants, shopping malls and offices. Stressing that 70 percent of the state has at least partially reopened, Newsom stressed in no uncertain terms the importance of testing and contact tracing as the key figures in getting back to business. Newsom said that the figures of COVID-19 patients are showing signs of stability and stressed that the latest numbers are “encouraging.” Stressing the importance of reduced capacity and social distancing for restaurants, Newsom said it is not a “one size fits all.” Every restaurant is different and flexibility in spacing is just one part of the state’s guidelines published in PDF form Tuesday. So far only two counties, Butte and El Dorado, have met the state requirements to move further into phase 2 of reopenings. In order to be ready to open for dine-in
service, restaurants must adhere to the following, according to state guidelines: • Have disposable menus or post menus online so diners can view them on their own devices. • Cutlery, napkins and cups should not be "pre-set" on the table before diners sit down. • Avoid use of shared condiments. • Pre-roll utensils in napkins before giving them to customers. • Takeout containers for leftovers must be filled by customers. • Thoroughly clean tables, chairs, etc. after each group's use. • No table-side food preparation. • Bar areas inside restaurants should stay closed. Diners should also wear masks inside restaurants when they aren't eating, the guidelines stress, plus many more suggestions to keep customers and staff safe. Thursday week, scores of Monrovia Kiwanians took to a local park to video tape a birthday message for the upcoming virtual Monrovia Days project sponsored by the city and chamber of commerce. Donning masks of every size shape and color — the ever-present bear included —participants prepared for a truly unique moment in Monrovia history to celebrate the city’s 134th birthday. Many of the Kiwanians hadn’t seen one another for over two months due to the stay-athome mandate and were stunned and delighted when they noticed one long-time member, Hal Leavens, had grown a rather distinguish white beard. After the applause and laughter died down to a dull roar, Leavens joined his colleagues for the main event. Over 100 Monrovians have submitted short videos like that of the Kiwanis to be part of the annual celebration, albeit virtual and from a safe distance. This year the city will be creating a commemorative video with birthday wishes from you, our community that will be aired during a special Facebook Watch Party on May 16, 2020. Cluster of COVID-19 Cases in Pasadena Traced to Birthday Party The Pasadena Public Health Department (PPHD) recently identified a cluster of COVID-19 cases among attendees of a birthday party. Through contact tracing, the PPHD disease investigation team discovered more than five laboratory-confirmed COVID-19 cases and many more ill individuals. Contact tracing is the process of identifying individuals who may have come into contact with an infected person and collecting information about these contacts. The party was attended by a large number of extended family members and friends after the Safer at Home Order was issued. The index case, or the first patient in the outbreak identified with the disease, was coughing and not wearing a face covering at the party. Guests were also not wearing face coverings or practicing social distancing. As a result, COVID-19 spread among party attendees.
“This is an example of how good contact tracing can identify disease clusters and tell us more about the spread of disease in our community,” said Dr. Matthew Feaster, PPHD epidemiologist. “We’re grateful to our large team of public health nurses, case investigators, and contact tracers who help track the virus and prevent the disease from spreading to other members of our community.” “Pasadena residents who stay home keep themselves and their loved ones protected from COVID-19,” said Dr. Ying-Ying Goh, director and health officer of PPHD. “Although we are moving forward with small modifications to the Safer at Home Order, gatherings of people who do not live in the same household are still prohibited. The virus remains highly contagious. Social distancing, frequent hand washing, and wearing face coverings remain our best defenses against the
further spread of COVID-19 in our community.” It is still recommended that those with underlying medical conditions and those ages 65 and older do not participate in public recreation or retail curbside pickup, and continue to be safer at home. Pasadena residents experiencing symptoms, even mild symptoms, are encouraged to get tested for COVID-19. Recently, the Centers for Disease Control and Prevention (CDC) expanded known coronavirus symptoms to include fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, and new loss of taste or smell, cough, and shortness of breath or difficulty breathing. have changed the city’s voting requirements so much that it is hard to vote for someone you are not familiar with. Therefore, some voters told Arcadia Weekly they simply don’t vote anymore.
The recent council meeting was, indeed, contentious, as one of my colleagues wrote last week. And it appears there’s a push to change the political environment back to at-large voting.
The redistricting of Arcadia has seen more of a division on council in recent years and the votes so often are 3-2. A few years ago the voters in Arcadia found themselves with unacceptable and often impracticable redistricting which subsequently left out thousands of potential votes. In response to renters with limited means affected by COVID-19, the Los Angeles County Board of Supervisors authorized the Los Angeles County Development Authority (LACDA) to utilize Community Development Block Grant Program coronavirus (CDBG-CV) response funds to create and administer the COVID-19 Emergency Rental Assistance (COVID-19-ERA) Program. CDBG-CV funding is made possible by the Coronavirus Aid, Relief, and Economic Security Act or CARES Act, which was signed by the
president on March 27, 2020, and is distributed to eligible states and local governments by the U.S. Department of Housing and Urban Development. The County Board of Supervisors created the COVID-19-ERA Program with CDBG-CV funding to provide emergency rental assistance grants to incomeeligible households economically impacted during the COVID-19 pandemic through job loss, furlough, or reduction in hours or pay. L.A. Metro to Require Use of Face Coverings on Metro Transit System Consistent with the countywide public health order requiring the use of face coverings in public places, as of Monday the Los Angeles County Metropolitan Transportation Authority (Metro) requires all transit riders to wear face coverings when using the Metro bus and rail system. The requirement follows a revision of Metro’s earlier policy from April 6 that strongly recommended that riders wear face coverings to help prevent the spread of COVID-19 at Metro stations and on transit vehicles.
To inform the public, Metro will implement a new, multi-media education effort that will include additional signage and social media announcements, among others. Metro will enforce the requirement to the “extent that is practical and will be considering the best way to enforce this rule going forward,” according to a news release from Metro.

Suspect in Pasadena Officer Involved Shooting Identified On Friday, May 8, 2020, at approximately 3:35 p.m., Pasadena Police Department personnel were in the area of Walnut Street and Meridith Avenue when they attempted to conduct a traffic stop on a 2015 Mitsubishi Mirage for a vehicle code violation. Lloyd Nelson Jr., the 47-year-old male driver and solo occupant of the vehicle failed to yield, and a vehicle pursuit ensued. Nelson drove recklessly through city streets, and officers discontinued their direct pursuit while the Pasadena Police helicopter monitored the suspect from above. Even though Nelson was no longer being actively pursued by ground personnel, he continued to drive in a reckless manner. In response, ground officers once again began to actively pursue the suspect. The pursuit was ended through the use of a pursuit intervention technique (PIT) at Corson Street and Allen Avenue, resulting in the death of the suspect and one officer sustaining a gunshot wound to the leg. the scene and immediately commenced an investigation, scouring the area for witnesses and evidence. Preliminarily, the investigation has revealed that the suspect shot at officers immediately at the conclusion of the vehicle pursuit, resulting in the exchange of gunfire and the suspect’s ultimate death. Three firearms were located inside

George Junenemann, a longtime resident of Temple City and Arcadia, died April 5, 2020 at the age of 84. After St. Luke's Grammar School, George attended and graduated from San Gabriel Mission High School in 1954. After four years in the U.S. Air Force serving in the states and Japan he joined the U.S. Post Office and was a Temple City mail carrier from 1959 until his retirement. While employed with the post office, he attended and graduated from East Los Angeles College with honors. Mail carriers in Temple City elected him steward of their union over the years. He was loyal, faithful, and dedicated to employees and customers alike.
As a retiree he served on the executive board of Angel City Branch #24 in Los Angeles for the National Association of Letter Carriers. George was preceded in death by his parents, Elsie and John Juenemann of Temple City. He is survived by his four siblings: Robert Juenemann S. M. of San Jose, Jeanne Antonellis of Pacific Grove, Joan Juenemann of Sierra Madre, and Mary Ann Flanagan of Eureka. He is also survived by step-daughters, Twinkle Espinosa of Phoenix, Ariz., Sherrie Yardley of Los Angeles, and Shanna Beanblossom of Jonesboro, Ark. George was a private person; there will be no services per his wishes.

ARCADIA May 3 At 9 a.m., an officer responded to an alley near the 300 block of East Laurel Avenue regarding an unresponsive male subject lying on the ground. The subject was breathing but he was unable to identify himself or state where he lived. Shortly after, Arcadia Fire responded and transported the male subject to Arcadia Methodist Hospital for treatment. The subject is described as a 30 to 45-yearold white male between 5-foot-10 and 6 feet tall. May 4 At 9:13 a.m., an officer was dispatched to Licha Construction, located at 124 N. First Ave., regarding a vandalism report. Surveillance footage revealed the suspect purposefully cut and damaged the hedges on the north side of the property, adjacent to the gates of the Metro Link tracks. The suspect is described as a 30 to 45-year old male, Hispanic or Asian, and he was seen wearing a white T-shirt, jeans, and tennis shoes. May 5 At 11:33 a.m., an officer was parked near the intersection of Fairview Avenue and Holly Avenue when he was flagged down by a victim of a battery. The victim, a local transient, stated that when she rejected her male acquaintance’s sexual advances, he became angry and hit her in the face. The suspect was identified as a 51-year-old local transient. He was arrested in the field and issued a citation. At 3:48 p.m., an officer responded to CVS, located at 1401 S. Baldwin Ave., regarding a mail theft report. While the postal worker was inside CVS delivering mail, a witness saw the suspect steal mail through an open window of the mail delivery truck. The suspect fled with two trays of stolen mail. The investigation is ongoing. May 7 At 7:46 a.m., an officer took a telephonic report of a vehicle burglary that occurred

near the intersection of Huntington Drive and Golden West Avenue. Sometime during the previous night, an unidentified suspect forced open the camper shell and fled with miscellaneous construction tools. There is no suspect information as of the time of this report. May 8 At 9:28 a.m., an officer responded to 24 Hour Fitness, located at 125 N. First Ave., regarding a commercial burglary investigation. On April 20, the location was vandalized and the front glass windows had been smashed. The company installed a piece of plywood to temporarily secure the business. On May 8 at 1:50 a.m., surveillance footage revealed two suspects used a tool to cut the plywood barrier and ultimately fled with approximately 10 barbell weights, a reported loss valued at $1,000. Due to the poor video quality, the officer was unable to determine the suspects’ race, gender, or other identifiable information.

MONROVIA April 30 At 12:52 p.m., an officer responded to a single motorist collision at the intersection of Myrtle and Olive. Motorist collided into a light pole; officer found accident was caused by a medical condition. The driver was transported to a nearby hospital for treatment.
At 4:42 p.m., an officer responded to a traffic collision at the intersection of California and Huntington. Officer found two motorists had collided and two passengers had minor injuries. Paramedics provided medical first aid to the injured passengers. The driver found to be at fault was issued a citation. May 2
At 10:01 p.m., officers responded to a residence in the 600 block of West Lemon Avenue regarding an audible alarm activation. The officers determined the suspect(s) entered by shattering a kitchen window; then once inside, they searched through cabinets and drawers, but likely fled emptyhanded since the house is primarily empty. The owner of the residence is out of the country and unable to
At 6:33 p.m., officers responded to the 1200 block of S. Primrose regarding a battery incident that had just occurred between a husband and wife. The wife had a visible mark on her face and reported the husband slapped her across the face while they were arguing. The husband was arrested for domestic violence and taken into custody.

May 9 At 1:53 a.m., an officer was flagged down by a victim and a witness in the area of Duarte Road and First Avenue in regard to a battery report. An investigation revealed the suspect, a homeless man, became agitated when he was confronted by the security guard for laying down on the property. The interaction turned violent when the suspect hit the security guard in the chest. The suspect fled on foot but was located by assisting officers. He was identified as a 28-year-old male transient. He was transported to Arcadia Methodist Hospital for medical clearance due to his complaints of methamphetamine withdraws and nausea.
At 6:43 a.m., a theft was reported in the 300 block of W. Cypress. The victim reported that someone took his mailbox sometime during the night. This investigation is continuing.
At 7:12 a.m., an officer responded apartment complex in the 1300 block of S. Alta Vista. A resident discovered his apartment had been burglarized. A report was held after money and several items were missing. The suspects entered through an unlocked sliding glass door. This investigation is continuing. At 4:08 p.m., an officer responded to a traffic collision in a church parking lot in the 1300 block of S. Magnolia. The driver advised he attempted a U-turn in the parking lot, but was traveling too fast and the motorcycle went down in the parking lot. Both parties had visible injuries but declined to be transported to a hospital for treatment. May 5 At 5:50 p.m., officers responded to a collision near the intersection of Mountain and Duarte. The victim was driving her vehicle near the intersection when she was hit by a tan Toyota Corolla. The suspect vehicle fled the area. This investigation is continuing. May 6
At 8:42 p.m., dispatch received a 9-1-1 hang-up call from the area of Magnolia and Huntington, stating a female subject was having a baby in a vehicle. Officers responded, located the vehicle and found a female subject in labor. Officers had the subject move to the back seat of the vehicle and moments later, the baby was delivered before paramedics could arrive. The officers assisted the female in delivering her baby girl.
PASADENA April 19 Officers responded to the 100 block of North Raymond Avenue regarding a male reportedly suffering from a gunshot wound. Officers located the injured victim, who claimed he had been shot near the 400 block of North Garfield Avenue and had walked to his current location. Officers went to the area described and found evidence of the shooting. The area was canvassed and no additional victims were located. The victim was transported to the hospital in stable condition. The investigation is ongoing. April 21 Officers responded to the 1100 block of North Fair Oaks Avenue regarding an armed robbery that had occurred. The two victims were sitting in a parked car when they were allegedly approached by two suspects. One suspect displayed a firearm and demanded money from the victims. When the victims refused, the suspects
assaulted one of the victims and removed a bag from the car which contained a significant amount of money. The victims drove away from the location and called to report the incident to police. A search of the area for the suspects was conducted by officers, but they were not able to immediately locate them. April 24 Officers were dispatched to the 300 block of East Washington Boulevard regarding a family disturbance and the suspect was reported to be armed with a knife. Upon their arrival, officers located the suspect outside and detained him. Officers learned the victim and suspect became involved in a verbal argument resulting in the suspect assaulting the victim with his hands and threatened him with the knife. The victim sustained minor injury and was treated by paramedics. The suspect was arrested for assault with a deadly weapon. April 25 Officers responded to the 500 block of Union Street in regards to a possible assault. The officers contacted the victim who reported the suspects had thrown a rock at her, which struck her in the leg. Officers located the suspect in the area and detained him. The victim identified the suspect and he was arrested for the assault. The victim suffered minor injuries that did not require medical attention. The suspect, who possibly suffers from a mental illness, later spat on police and while in custody, provided a detailed plan on how he intended to kill an officer. April 26 Officers responded to the reported theft of a city vehicle from the area of Villa Park. The vehicle was subsequently located in the 400 block of Carmelo Avenue. The vehicle was parked and occupied by one individual. The occupant was arrested for auto theft. The vehicle was not damaged and returned to the city employee. April 27 Officers responded to

the 600 block of North Oakland Avenue on the report of a man who was strangling a young child. By the time the officers arrived, the mother had fled the location with the child to a safe location while they waited for officers. Paramedics were summoned to treat the child. The father, who was believed to still be inside the family residence, was subsequently taken into custody and booked for attempted murder. The child was transported to a local hospital where he was treated and released back to his mother. April 28 Officers responded to a restaurant located in the 700 block of North Lake Avenue in regards to an attempted carjacking that had occurred while the victim was in the drive-thru line of the business. The suspect had approached and tried to force open the front passenger door of the victim's vehicle. The victim feared the suspect was trying to carjack him so he drove away as the suspect held on to the vehicle. The suspect eventually released his hold of the vehicle and was taken into custody by arriving officers. He was arrested for the attempted carjacking. Less than two weeks earlier, the same suspect was arrested for stealing a vehicle from a local car dealership. April 29 Officers responded to a hotel located in the 2100 block of Colorado Boulevard regarding two subjects who had threatened to assault a hotel employee. The victim had asked the men to leave and when they refused, he advised the subjects he was going to call the police. The suspects threatened to assault the victim if he made the call to police. Fearing for his safety, he locked himself in a closet and made the call. When officers arrived to contact the two suspects, one of the suspects made similar threat towards the officers. Additional officers assisted and after a short struggle, both suspects were arrested. Multiple officers sustained minor injuries as a result of the altercation.

County News Inmates Appear to Purposely Infect Themselves With COVID-19 A group of inmates at the Pitchess Detention Center-North County Correctional Facility deliberately attempted to infect themselves with COVID-19, reports Sherriff Alex Villanueva. Multiple men were seen through video surveillance sipping from a single bottle of hot water for two reasons: To falsely elevate their oral temperature moments before having their temperature taken by a nurse, and to spread the potential of infection. The bottle and a secondary cup of hot water were passed among the men inside of a day room. The county currently operates four drive up testing sites – Indio, Perris, Riverside and Lake Elsinore – and those who want to be screened do not have to have symptoms, although they do need an appointment. As part of this project, the California Department of Toxic Substances Control (DTSC) plans to implement the “National Association for County and City Health Officials Protocol for Assessing Community Excellence in Environmental Health,” which is community-based process for understanding and addressing local environmental health concerns. f you take an early morning walk in South Pasadena like I do, your senses are rewarded daily with the sweet scents of jasmine and orange blossom. You are greeted by violet bearded irises standing at attention in your neighbor’s front yard and lazy lavender wisteria draped over a fence. The woodpecker’s percussive Morse code sends out a signal that the day has indeed begun. It is springtime here and normally this is a time of year to delight in and celebrate the abundant gifts of nature. But this spring brought an unwelcome and unpredictable guest. The current COVID-19 pandemic has turned our world upside down and instead we are left feeling scared, angry, and helpless. As a licensed marriage and family therapist, I am accustomed to collaborating with clients as they seek to create self-awareness, heal from emotional wounds, and learn coping skills for anxiety, depression, and grief. But the changes brought about by

the current pandemic have increased symptoms and severely challenged everyone’s sense of well-being. From a clinical perspective, what we are experiencing now as a community and individually is precisely what trauma looks and feels like. Trauma can be described as anytime our sense of safety and security is compromised, whether that be emotionally or physically. It includes the sting of unpredictability and uncertainty which fuels difficulty with trust and an overwhelming sense of helplessness. It can be disorienting as we struggle with responses of fight, flight, or freeze. When something from outside is thrust upon us
with no warning, it can really make us feel powerless. Each one of us will have a different reaction to it depending upon one’s genetic make-up, family influence, cultural influence, and a series of life experiences. It’s important to recognize there is no one “right” way of managing it. Let yourself explore and feel whatever comes up for you as we all navigate this challenging time. However, when the storm subsides and all is well again, it's comforting to know that many kind souls will not forget those who still suffer and are fighting a great battle which no one sees. OPEN LETTER TO PASADENA COUNCIL FROM PASADENA CHAMBER OF COMMERCE PRESIDENT Thank you for considering steps to reopen Pasadena businesses. The first step is for Pasadena’s Public Health Department to determine it is safe to do so, even on a limited basis. Like restaurants, I think
most retailers could be able and willing to do curbside pick-up of goods. I expect they would welcome guidelines for safety, cleanliness and protective equipment that might be necessary. That would come from the Public Health Department and should be clearly written and provided to all retailers at no cost. Please, as you consider steps to reopen commerce in Pasadena do not place any burden on the businesses and do not do anything at all to delay or impede that opening. As an example, other jurisdictions are going to allow restaurants to reopen, when it is safe to, for dine-in customers without requiring in-person health inspections. Restaurants will be able to self-certify over the phone or via email or online fillable form, that they have sanitized the establishment, been treated for vermin (as required) and have necessary safety equipment and procedures in place to protect customers. Requiring a health inspector to visit each establishment will mean delays and, most likely, additional costs for anyone wanting to reopen. This is not the time to pile on delays and costs for any business in Pasadena. A recent survey found that as many as 25% of small local businesses will fail for lack of $10,000 to $15,000. That amount is enough to keep them open over through the next five months. Please do not add any costs or place any impediments in the way of reopening for those retailers and restaurants who are significant employers in our community and contribute so
much to Pasadena’s character and attractiveness for visitors and local residents alike. This is a more than precarious circumstance for 80% of your locally owned businesses. It is a disaster. Anything that delays reopening or adds costs to reopening may mean fewer are able to reopen at all.

This extraordinary pandemic is seriously affecting just about every business sector, which in turn directly affects local newspapers’ ability to cover news and information. We have to re-think how we communicate with our colleagues to ensure continued performance and, importantly, morale,” this, according to Forbes. It’s odd to think that only 57 days ago, the very word “virtual” was not really part of our lexicon and yet now, some parts of our lives appear to be
computer-generated, in some shape or form. Dentists are now offering virtual visits as are regular general practitioners. (Now, that I really like. Pain free, indeed.) I believe we’re close to virtually not touching or seeing anyone in person, unless we absolutely have to or want to. We have virtual meetings via Zoom or conference calls and virtual happy hours (not really sure how that works). Virtual reality (VR) is a simulated experience that can be similar to or completely different from the real world. Applica-
tions of VR can include entertainment and educational purposes. Currently, standard VR systems use either headsets or multiprojected environments to generate realistic images, sounds and sensations that simulate a user's physical presence in a virtual environment. A person using the equipment may be able to look around the artificial world, move around in it, and interact with virtual features or items.

Behind the scenes, restaurant industry groups have been pressuring the administration to issue nationwide standards that won’t cost an arm and a leg. In that same meeting, Trump appeared mindful that half-full restaurants and businesses wouldn't provide a sense of normalcy. "I had one restaurant owner come up to me and said, 'Sir, you

know I'm going to be opening up but if I distance too much I have 50 percent of the restaurant I had,' " Trump said. "I said, and you'll also have a worse atmosphere,” according to a CNN report. Local Restaurants Adapt In California, restaurants and local chambers of commerce have been fighting hard for the county and state to relax the laws. According to the California Restaurant Association, 20 to 30 percent of all restaurants in the state might not survive the pandemic. Additionally, the constantly
changing guidelines and differing government levels have caused confusion and uncertainty among many restaurant owners. Take one restaurant, for example, and see how many people it not only serves, employs and how that restaurant circulates the cash in the local economy. We asked Peggy Simonian, the owner of the popular Lucky Baldwin’s Pubs in Pasadena and Sierra Madre, how her life has changed since the stay-at home mandate. It was obvious during our interview that the frustrations of running
such a business before March 17 were already a challenge. But this added, unprecedented pandemic turned her world upside down. Q: How are you coping with the new ‘normal’? A: Yes, this has been a massive challenge for us all. It’s been really difficult to get to this point, and now that we’ve set up a path to work within, it’s all changed again. There has been talk about opening up 50 percent capacity, disposable utensils (no different from takeout). Will it be disposable pints? Not sure. At this point there is so much change and so much talk that I try not to get too involved or even think about something that is not here yet. Just trying to deal with this day-by -day and try to live in the moment. Q: What are the guidelines for opening up again? A: Until I receive notification from the Health Department, as to what the guidelines are, only then can I see how I can adapt my business.

California Leaders Ask Congress for Additional Federal Funding for States With the impact of COVID-19 deepening and the May Revision of the state budget on the horizon, Governor Gavin Newsom was joined by Senate President pro Tempore Toni G. Atkins (D-San Diego), Speaker Anthony Rendon (D-Lakewood) and Assembly Republican Leader Marie Waldron (R-Escondido) in sending a letter to U.S. Congressional leadership, asking them to authorize $1 trillion in direct and flexible relief funding to states and local governments. The additional aid would preserve core government services, such as public health, public safety, and public education, and would help get Californians back to work, according to Atkins’s office. “The economic fallout of this crisis is severe, from the toll it has taken on individuals and families to the damage it has done to our local and state budgets. This federal assistance will help prevent further harm to our people and our communities, and protect the resources and services that are critical to our daily lives,” said Atkins. On Monday, Newsom said the state’s budget deficit is now in the tens of billions of dollars directly caused by the impact of COVID-19. Last Thursday, Newsom announced that California faces a $54 billion deficit. Just 90 days ago the state projected a $6 billion budget surplus but since March 12, 4.5 million Californians have filed for unemployment and pandemic unemployment assistance and the state has distributed $13.1 billion in unemployment, $3.4 billion just last week. Newsom warned that an unemployment rate between 20-25% is likely when the new numbers are released.

which is on file in the office of the City Clerk and incorporated herein by reference. 3. Annual Rate Determination. The City Council is hereby further authorized each year, by resolution adopted as provided in Section 53340 of the Act, to determine the specific special tax rate and amount to be levied on each parcel of land in the District for the then current and future tax years, except that the special tax rate to be levied shall not exceed the maximum rates set forth in the Rate and Method, but the special tax may be levied at a lower rate. Such resolution is to be filed by the clerk with the County Auditor-Controller of the County of Los Angeles on or before August 10 of the same tax year. 4. Exemption of Government Property. Properties or entities of the state, federal, or other local governments shall be exempt from the above-referenced and approved special tax only to the extent set forth in the Rate and Method, and otherwise shall be subject to tax consistent with the provisions of Section 53317.3 and 53317.5 of the Act. 5. Use of Collections. All of the collections of the special tax shall be used only as provided for in the Act and in the Resolution of Formation. The special tax shall be levied only so long as needed for its purpose as described in the Resolution of Formation. 6. Collection. The special tax shall be collected in the same manner as ordinary ad valorem taxes and shall be subject to the same penalties and the same procedure, sale and lien in any case of delinquency as applicable for ad valorem property taxes; provided, however, that the special tax may be collected by direct billing by the City of the property owners in the District or in such other manner as may be provided by the City Council. 7. Authorization. The specific authorization for adoption of this Ordinance is the provisions of Section 53340 of the Act. 8. Severability. If for any reason any portion of this Ordinance is found to be invalid, or if the special tax is found inapplicable to any particular parcel within the District, by a Court of competent jurisdiction, the balance of this Ordinance, and the application of the special tax to the remaining parcels within the District shall not be affected. 9. Publication. The City Clerk shall cause this Ordinance to be published at least once in a newspaper of general circulation, published and circulated in the City within fifteen (15) days after its passage in accordance with Section 36933 of the Government Code, shall certify to the adoption of this Ordinance and shall cause this Ordinance and the City Clerk’s certification, together with proof of publication. 10. 5/14/20 CNS-3364664# MONTEREY PARK PRESS CITY OF MONTEREY PARK ORDINANCE NO. 2171 AN UNCODIFIED URGENCY ORDINANCE AUTHORIZING DIGITAL AND ELECTRONIC SIGNATURES FOR OFFICIAL CITY DOCUMENTS THE COUNCIL DOES ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds, determines and declares as follows: A. On March 11, 2020, at 7:00 p.m., the City declared a state of local emergency due to the COVID-19 Pandemic (the “Emergency”). That Emergency was ratified by Resolution No. 12142, adopted March 18, 2020 and extended on April 15, 2020 by Resolution No. 12151; B. Among other things, the Emergency is a significant threat to public welfare and the well-being of the City’s employees. As a result, the Governor and the Los Angeles County Department of Public Health implemented requirements as to physical distancing. Accordingly, the City ordered the closure of all public facilities; cancelled in-person public meetings; and is taking numerous additional steps to help ensure that the likelihood of being exposed to COVID-19 is significantly reduced; C. Since the start of the Emergency, it became apparent that the City must improve its protocols in order to facilitate the timely processing of documents while also adhering to State and County requirements of physical distancing; D. California Government Code § 16.5 expressly authorizes municipalities to use digital signatures with appropriate security standards in place of traditional ink signatures (“wet signatures”) for all official documents; E. Civil Code §§ 1633.1, et seq. , the Uniform Electronic Transactions Act, provides standards that govern electronic records and electronic signatures relating to the conduct of business, commercial, or governmental affairs; and F. The Council finds that it is in the best interest of the public safety, welfare and convenience of the City to implement the use of electronic and digital signatures during, at least, the Emergency. Because of the findings set forth above, the City Council finds that this Ordinance should be adopted on an urgency basis to preserve the public health, safety, and welfare in accordance with Government Code §§ 36934 and 36937(b). SECTION 2. The City Clerk may utilize the following standards when processing all City documents including, without limitation, ordinances, resolutions, and contracts: “DIGITAL AND ELECTRONIC SIGNATURES I. Definitions. Unless the contrary is stated or clearly appears from the context, the following definitions will govern the construction of the words and phrases used in these standards: A. “Acceptable technology” means technology, acceptable for use in the State of California, capable of creating signatures and which conforms to the requirements in both Government Code § 16.5 and 2 California Code of Regulations § 22003. B. “Digitally signed communication” means a message that is processed by acceptable technology in such a manner that ties the message to the signer. C. “Electronic document” means all records retained by the City in its regular course of business that are specifically designated by the City Council, City Manager, City Clerk, or City Attorney as being eligible for execution via an electronic signature. Such designation must be set forth in the body of a record and substantially read as follows: “This Document may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature.” D. “Electronic signature” means an electronic symbol or process attached to or logically associated with an electronic document and executed or adopted by a person with the intent to sign the electronic document. For purposes of these standards, a “digital signature” as defined in Government Code § 16.5 is a type of electronic signature. E. “Message” means a digital representation of information intended to serve as a written communication provided to the city by a public entity or private entity. F. “Person” means a human being or any organization capable of signing a document, either legally or as a matter of fact. G. “Public entity” has the same meaning as Government Code § 811.2. H. “Signer” means the person who signs a digitally signed communication with the use of an acceptable technology to uniquely link the message with the person sending it. I. “Technology” means the computer hardware and/or software-based method or process used to create digital signatures. II. Digital signatures. A. Digital signatures may be used for electronic documents. Only digital signatures created by an acceptable technology will be deemed valid. B. Before accepting a digital signature, the City Clerk, or designee will determine acceptable technologies and vendors to provide the means for employing digital signatures under these standards, consistent with industry best practices, to ensure the security and integrity of the data and the signature; including, ensuring that: 1. The level of security used to identify the signer of a document and transmit the signature is sufficient for the transaction being conducted; and 2. The certificate format used by the signer is sufficient for the security and interoperability needs of the public entity. C. The use of a digital signature compliant with this section will have the same force and effect as the use of a manual signature using ink applied to paper (aka
“wet signature”). III. Electronic signatures. For any electronic document consisting of an agreement with the City, in which a signature is required or used, the City may authorize the use of an electronic signature by any party, so long as the electronic transaction complies with the requirements of Civil Code §§ 1633.1, et seq.” SECTION 3. This Ordinance was reviewed pursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq ., “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regulations §§15000, et seq ., the “CEQA Guidelines”). Based upon that review, this Ordinance is exempt from further review pursuant to CEQA Guidelines § 15269(a) because the protection of public and private property is necessary to maintain service essential to the public, health and welfare. [1] Additionally, this Ordinance is exempt pursuant to CEQA Guidelines §15061(b) (3) because it can be seen with certainty that there is no possibility that the Ordinance may have a significant effect on the environment. SECTION 4. Declaration of Urgency . Based on the findings set forth in Section 1, this is an Urgency Ordinance adopted for the immediate preservation of the public peace, health, safety and welfare.
