Deputies Find Missing Girl in Sex Offender’s Santa Clarita Garage The parents of a young teenage girl reported her missing to the Santa Clarita Valley Sheriff’s Station Tuesday, July 14, 2015, at 9:30 p.m. after they discovered her missing from home. Due to the minor’s age, the missing girl was considered to be a “Critical Missing Person.” Deputies from Santa Clarita Sheriff’s Station began a search operation to locate the girl. While patrol deputies searched the community, investigators checked her phone records. Deputies called a phone number found on her phone records, and a man, later identified as suspect Kaene Dean, answered the phone.

He denied knowing the whereabouts of the missing girl. Sheriff’s deputies went to the home of the suspect, where they were allowed inside by the suspect’s par-
ents. Deputies soon found the victim inside the garage prior to 2 a.m. The victim told deputies she had been befriended by the suspect the previous day while at a grocery store in the Santa Clarita area and that he had sexually assaulted her. Suspect Kaene Dean is a 26 year-old Filipino male resident of Santa Clarita. Suspect Dean is a registered sex offender due to a conviction for indecent exposure in the City of Glendale. PUSD Ponders Peeping at Pupils’ Social Media By Terry Miller Pasadena Unified School District is having “preliminary conversations” about the use of software that is available to monitor student’s social media. Adam Wolfson, outgoing Public Information Officer for PUSD, had this to say in an email last Wednesday: “There have been very preliminary conversations among the district’s Child Welfare, Attendance and Safety Department but there is no timetable for a decision on whether to use such software. “The district has an anonymous tipping system where staff, students,
parents or members of the community can send a text message to 888777 with the phrase “tip pusd” and a description of the issue or click on the tipping button at pusd. us.” Wolfson added that the district was not considering the issue, just in discussion mode. “Considering is an overstatement. We are aware of their use of it and our Child Welfare, Attendance and Safety office have had very preliminary discussions concerning its use,” he clarified. Glendale Unified and Monrovia Unified have both invested in the software from
a company called Geo Listening. “Geo Listening’s unique monitoring service will process, analyze, and report the adverse social media from publicly available student posts. The service provides a daily report that illuminates the social and emotional needs of students in the many ways that may present itself. Governor Signs Gatto’s Bill Granting Children Access to Ailing Parents On July 15th, Assemblyman Mike Gatto’s (D-Glendale) legislation to provide access for adult children who wish to visit an ailing parent was signed into law by Governor Brown, culminating almost two-year’s worth of work on this issue. The legislation, AB 1085, will provide legal recourse for children who are denied access to a parent, by their parent’s current spouse or another family member. With divorce and remarriage common, there is a possibility of conflict between a subsequent spouse and a child from an ailing parent’s previous marriage. Current law provides no remedial mechanism for children or relatives to petition a court for visitation. “Conflict among family members is the last thing our loved ones want to see as they approach their final hours,” said Gatto. “I hope this bill will help decrease the heartache and stress of families already facing difficult circumstances.” AB 1085 would give judges authority to direct, or grant, a conservator the power to enforce senior’s right to receive visitors, telephone calls, and personal mail. This will be an important mechanism for families attempting to connect with elders for what is often the last time. The measure also will require caretakers
to give notice of an elder’s death to certain family members. Assemblyman Gatto developed the legislation with several adult children who have been denied access to their ailing parents, including radio and television personality Kerri Kasem, current co-host of the “Protect Your Family” and “Gurvey’s Law” talk shows on KABC Radio. Kerri is an outspoken advocate of visitation rights for adult children as a result of her struggle to see her beloved father, broadcasting legend Casey Kasem, who struggled with poor health before his passing last year. After sharing her struggle to see her father on various media outlets, Kerri and Assemblyman Gatto received thousands of communications from across the country of similar stories of heartache. Recently, FoxNews.com reported about how other states are following Assemblyman Gatto’s footsteps on this legislation. “AB 1085 will provide hope to families experiencing isolation of a loved one by giving the court a way to provide visitation,” said Kasem. “I want to thank Assemblyman Gatto, and the Kasem Cares team that worked closely with him, for bringing more awareness to the issue of elder abuse through the passage of this important legislation.”

This is about student welfare, not spying,.” She said. “ Keeping our kids safe and letting us intervene when necessary…is what GEO Listening enables us to do a little better.” According to GEO’s

Our goal is to help you keep your students focused on their education and on the path to success in a safe and supportive environment.” The California Legislature, reacting to Glendale’s foray into a new frontier of electronic surveillance, recently passed a bill setting boundaries for such programs. For instance, districts had to inform parents and students before monitoring began – something Glendale apparently did not do. The American Civil Liberties Union was opposed to social media monitoring, but staff attorney Brendan Hamme said Assembly Bill 1442 “was a step in the right direction for California school districts.” Other safeguards for students’ privacy now in place due to AB 1442 include: • Allowing students the opportunity to examine information collected about them. • Requiring that any such information be destroyed within one year of a student turning 18 or leaving the district. “Geo Listening reports public posts made to social networks that raise concern and violate student code of conduct. Reports are made to designated school staff, thereby enabling more timely and effective interventions. “We will gladly share success stories that are not specific to any given client so
the public. The reasoning, they were told, was that a public announcement might cause kids to mark all their accounts private, making it difficult for investigators to monitor.” Such fears indicated a serious lack of superiority regarding how social networks work. Twitter becomes effectively pointless if the settings are set to private, and Facebook’s privacy settings are so secretive that a teen who sincerely tried to lock down his or her page would only be able to get so far. The Glendale Unified School District had hired the Hermosa Beach Company to monitor public social media posts made by its students to find out when teens may in trouble or causing it. Superintendent Richard Sheehan said Geo Listening was analyzing the posts of 13,000 students at eight Glendale middle and high schools. The goal is to give school administrators critical information as soon as possible, according to GEO Listening. Basically, the software just monitors for keywords where if a student is considering harming themselves, harming someone else. During the pilot service in 2013, Geo Listening and the district were able to intervene with a suicidal student, according to their reports. Chris Frydrych, the CEO of Geo Listening said, “We have provided information to school districts, which has led to numerous successful interventions on behalf of students that intended self-

harm, suicide, bullying, truancy, substance abuse, and vandalism. We monitor only public posts to social networks. We do not monitor privatized pages, SMS, MMS, email, phone calls, voicemails.” Frydrych says his company is “not big brother” and that the company is in existence solely to help kids. A new California Appellate case just published August 8, 2013, “Glaski v. Bank of America”, holds that a homeowner can challenge his lender’s right to foreclose by showing that the Deed of Trust never made it into the securitized trust until after the trust’s closing date. This issue is now squarely before the California Supreme Court in Yvanova v. New Century Mortgage Corp. This is the case in most loans made in the last 12 years. The Los Angeles-based plaintiff’s trial law firm McNicholas & McNicholas obtained a $10 million settlement against the California Department of Transportation (Caltrans) on behalf of the family of Connor Nolan, a four-year-old who ingested lead-based paint at Caltrans’ residential rental property at 1010 Hope Street in South Pasadena. The plaintiff alleged the lead exposure left him with permanent neurological damage, rendering him unable to speak. However, the defendant had expert witness testimony to contradict that position, putting forth the conclusions that it could have been an autism spectrum disorder. The Superior Court of California approved the settlement on Wednesday, July 15th. Caltrans, among other things, acquires land in order to undertake transportation related projects, like proposed future freeway extensions and expansions. The rental home at issue was one such property. It was maintained and operated by an arm of Caltrans. The Plaintiff had evidence that the property manager ignored multiple complaints by the Plain-
tiff’s mother that there was paint chipping off the floors and walls which might be dangerous to her child. The on-site manager told her the problem was “cosmetic in nature” even though the structure was built in the early 1900’s. “As result of the litigation, the parties reached a settlement that will help the young Plaintiff make his way through life. Not being able to speak will be a huge hurdle to overcome, especially when the condition starts in infancy,” said lead counsel Matthew McNicholas. “After undergoing very thorough discovery, Caltrans stepped up and resolved a tough case for a great kid. Also, Caltrans has implemented new and improved training standards for its employees that monitor and maintain its rental properties, specifically focusing on potential lead exposure.” Caltrans, which owned the property since 2008, rents residential properties pending the approval of its freeway expansion projects. The boy’s grandmother, Cynthia Wright, had been living on the property since 2005. Connor and his mother, Heather Nolan, moved into the
property in October 2010 when Connor was just one month old. Chipped and peeling paint throughout the exterior and interior of the property was readily visible to Caltrans property inspectors starting in 2009. The family also reported the deteriorating paint in 2011. Despite the obviously deteriorating conditions at this older home, Caltrans decided to treat the matter as cosmetic and therefore, not warrant budget for repair. Even when a test for lead purchased by Wright and Nolan at a hardware supply store turned out positive, no action was taken by Caltrans. Connor had been exposed to lead-based paint hazards at the property since his infancy. By the time he was 16 months old, Connor could no longer form words. Connor will require extensive care for the rest of his life, costing millions of dollars.
Legislature Approves Holden’s Consumer Bill to Protect Used Car Buyers at ‘Buy Here, Pay Here’ Lots On July 16, the state Assembly gave final approval to Assemblymember Chris Holden’s (D-Pasadena) bill to rein in predatory used car dealerships. AB 265 – Buy Here, Pay Here – now goes to Governor Brown for signature. “There is a growing segment of the used car business that targets low income workers with poor credit – these are the lenders of last resort for many Californians. But the cost for this kind of credit is steep and defaults are common,” stated Assemblymember Holden. “This measure provides hard working Californians the extra flexibility they need to make payments, stay in
their vehicles, and provide for their families.” Under AB 265, Buy Here, Pay Here dealerships must provide a five to 10day notification period before a remote kill device can be used to disable a car for lack of payment. Current law requires only a 48 hour warning before a car can be disabled due to late payments, or insurance cancellation or even a clerical error. The bill also increases penalties for violations of these laws. According to the National Alliance of Buy Here, Pay Here Dealers, the aver-

Sheriff Relieves More Jail Personnel of Duty and Launches Internal Investigation of Inmate Allegations of Abuse On Friday last, ten jail personnel with the Los Angeles County Sheriff’s Department were relieved of duty and a number of others were reassigned to other duties pending further investigation. The personnel relieved of duty include two lieutenants, one sergeant, one senior deputy, four deputies and two custody assistants. “I expect every member of the Los Angeles County Sheriff’s Department to perform at the highest standards of professionalism. Immediately upon learning of troubling allegations of possible neglect of an inmate at the Inmate Reception Center, my Department’s executives relieved ten jail employees of duty, including supervisors. The investigation into this incident is ongoing and will be thorough. It will not only focus on employee actions, but also on corrective
policies and procedures,” said Sheriff Jim McDonnell. The alleged incident began when the involved inmate was booked in at the Inmate Reception Center (IRC) on June 19, 2015. Allegations included the inmate not being provided food and being handcuffed for a lengthy period of time following a force incident during which the inmate reportedly assaulted a female deputy. The inmate ate upon entry to the jail, but was allegedly restrained for approximately 32 hours; during that time he received medical attention and a cup of water. On June 27, 2015, the inmate filed a complaint and an investigation began. The complaint was brought to the attention of Sheriff McDonnell on Thursday, July 9th and a decision regarding personnel actions was made
within 24 hours. The Sheriff’s Internal Criminal Investigations Bureau and Internal Affairs Bureau have been asked to investigate the entire matter. The Office of Inspector General and Federal Bureau of Investigation were also notified. Notification was sent yesterday to all custody personnel assigned to IRC reminding them of protocols regarding restraint, checks and feeding of inmates and additional training has been ordered. Further corrective action is pending. “I am deeply committed to providing the highest levels of constitutional care to those in our charge and will quickly address and remedy any conduct, policies or practices that do not meet this expectation and high standard,” added Sheriff Jim McDonnell.

California Philharmonic Presents Phantom/Les Miz July 25 Popular Concert Mingles the ‘ Best’ Music From the Stage
California Philharmonic and Maestro Victor Vener present “Phantom/Les Miz,” this weekend at Santa Anita Park. Among the many people looking forward to attending both concerts are the special guests: Broadway stars Tracy Miller Schell and Darren Ritchie, both of whom will be making their California Philharmonic debut. Tracy, whose work spans from performing in Hairspray on Broadway to Julio Iglesias’ world tour to Les Misérables in Europe, is also looking forward to partnering with Darren Ritchie, “one of her favorite people to work with.” And the feeling is mutual. “Tracy and I did Dracula on Broadway together and have done concerts and readings as well. She is not only a tremendous talent, but a great friend,” echoed Darren, who is especially eager to sing “Music of the Night” from Phantom of the Opera and “Bring Him Home” from Les Misérables. “I am humbled and beyond excited to perform at both of these awesome venues. The best part is that we will be sharing these wonderful songs with the orchestra and the audience all together.” Equally important to Darren, whose many credits include starring in Les Miz,

Mike Gatto, joined by members of the Assembly Committee on Privacy and Consumer Protection, has authored AB 1116, a bill that would protect Californians from voice-recognition features that surreptitiously record private conversations in the home. The measure to keep television manufacturers and third-party providers from secretly tuning in to private living rooms across the state was approved by the Senate Judiciary Committee by a 7¬-0 vote. The bill will require manufacturers to ensure their televisions voicerecognition feature cannot be enabled without the consumer’s knowledge or consent. AB 1116 also prohibits manufacturers from utilizing recordings for a use not intended by the consumer. As such, it preserves the ability to control
