USAID/ USA-2 Re-Engages in Nepal to Assist Victims Following 7.3 ‘Aftershock’

No sooner did a group of Pasadena firefighters (part of a rescue team) return from a trip to Nepal to assist victims in the massive quake three weeks ago than another potent earthquake shook eastern Nepal on Tuesday, shattering recovery efforts . By late afternoon, Nepal’s National Emergency Operation Center had reported 42 deaths and 1,117 injuries from Tuesday’s

was in Kathmandu, Nepal, when a 7.3 magnitude struck the Dolakha District in the Central Region of Nepal. The U.S. Geological Survey considers this earthquake to be an aftershock following the April 25 magnitude 7.8 earthquake. USAID deployed the DART to Nepal on April 25 to coordinate the U.S. government’s response efforts, conduct disaster assessments, and

provide search and rescue capabilities. The DART comprises 133 people, including 22 USAID disaster experts, a 54-person USAR team from Fairfax, Virginia, a 57-person USAR team from Los Angeles County, and 12 canines. After Tuesday’s earthquake, all members of DART—including the 57 members of USA-2—are safe and accounted for. Members of the USAID

DART—including its USAR personnel—are conducting aerial assessments of Dolakha and the surrounding areas in coordination with the U.S. military to view the extent of the damage. USAR members of the USAID DART are also on the ground in Dolakha and Kathmandu conducting active search and rescue operations to find survivors. Please see page 3

Shooting Death in South El Monte Monday Los Angeles County Sheriff Department Homicide Detectives are continuing their investigation into the circumstances surrounding the shooting death of a man in South El Monte. On Monday, May 11, 2015, at 5:30 a.m., deputies responded to the 2500 block of South Continental Avenue, El Monte (Unincorporated) in response to a gunshot victim at the location. Upon their arrival, they discovered the victim, a male Hispanic, 31 years old, lying on the floor of his apartment suffering from a gunshot wound. Baldwin Park Man Gets Jail Time for Killing Poodle A Pomona Superior Court judge on Tuesday sentenced a Baldwin Park man to a year in county jail and four years probation for beating to death his miniature tan poodle. Sarah Ardalani, a public information officer for the District Attorney’s Office, said the court also ordered Jason Vaca to attend 26 anger management classes and a year of classes dealing with animal cruelty. The 35-year-old Vaca also cannot own, possess, live with or care for an animal for 10 years, according to Ardalani. On Saturday, May 9, Hollywood came to Pasadena as Union Station Homeless Services took a new spin on its annual “A Place to Call Home” benefit gala. The nonprofit hosted a Tonight Show-themed evening of entertainment, comedy, music, and fun for all with a great cause. Master of Ceremonies Gildart Jackson (The Young and the Restless, General Hospital), played the latenight talk show host for the night’s program, with actor and producer Blake Adams Bailey as the show’s announcer. One-on-one interviews were conducted with the honorees, as well as a formerly homeless individual who found a place to call home through the work of Union Station. The evening’s entertainment included musical guest Melora Hardin (The Office, Transparent), who performed an original song with Byron Miller and the Psycho Bass Band, the official house band for the night. Over 400 guests, businesses and community leaders walked the red carpet at the Langham Huntington in Pasadena while posing for photos and enjoying a wine reception, hosted by Rob and Leslie Levy (owners of The Raymond), as they bid on silent auction items.

Congresswoman Judy Chu and representatives from the office of Supervisor Michael D. Antonovich were among the many supporters attending this year’s gala. The event honored the contributions of Charlie and Rene Chiara and Jim and Tina Hart, long-time supporters and distinguished members of the entertainment industry who have used their talents to benefit the organization. “We were thrilled with the turnout for this event as we honored the Harts and Chiaras,” says Marv Gross, CEO of Union Station Homeless Services. “It was our most successful ever. Gildart Jackson, Melora Hardin, Blake Bailey and the Psycho Bass Band were exceptional in adding so much entertainment and fun to a great evening.” Over $460,000 was raised to continue the programs provided by Union Station Homeless Services to help homeless men, women, and children rebuild their lives and end homelessness in the community. The U.S. military—and other international actors—are transporting injured people to Kathmandu by air, where some are being treated by USAID DART personnel, which include members of Los Angeles County Fire Department. The DART in Nepal, as well as the Washingtonbased USAID Response Management Team, continues to track the situation in coordination with U.S. military personnel and U.S. government staff in Kathmandu. Monday, the Pasadena City Council honored several of its firefighters for work above and beyond the call of duty. The three include Fire Engineer Dave Marquez, Paramedic Matt Caffey, and Captain Tim Okimura. They went to Nepal on their own time to help in the disaster zone after the initial 7.8 Nepal quake. According to fire de-

partment spokeswoman Lisa Derderian, "They provided medical care to over 400 people, set up food distribution sites, water systems and left tents and other supplies to help them rebuild." They went as part of a team from Reach Out Worldwide. Reach Out Worldwide, ROWW, is a non-profit that was started by the late actor Paul Walker. Its website www.roww.org states "Reach Out Worldwide is committed to fulfilling the legacy of our founder, Paul Walker. Delivery of essential aid to those affected by a disaster can be lifesaving... teams of medical experts and disaster relief professionals immediately respond when disaster strikes." Walker's brother Cody took over the CEO position after the actor died. On the site are many pictures and tributes to Paul Walker.

Two education measures authored by Senate Minority Leader Bob Huff (R-Diamond Bar) received unanimous support during a Senate Floor vote and will now move to the State Assembly. The measures extend the School District of Choice program and removed antiquated laws from the California Education Code. “Our children deserve the highest quality education we can give them,” said Senator Huff. “These modest measures help deliver on this promise. These bills provide better choices for parents and students -- no matter where they live.” SB 597 extends the 22year running School District of Choice program, which fosters public school choice by allowing parents to transfer their children to participating school districts without a transfer agreement.

California’s District of Choice program gives both parents and students the right to decide which school is best for them and their academic needs (especially helping those who want to get out of underperforming school districts). It also compels many schools and districts to regroup and make positive changes to ensure that both students and their parents desire to remain within the district they reside. Without the enactment of SB 597, the School District of Choice program will end in July of next year. Senator Huff’s legislation will keep the program running until July, 2017. “There are many school districts in California that enroll a great number of students from outside of their district boundaries under this program,” said Senator

Huff. “Ending the District of Choice program right now could, and mostly likely would, send several small districts into a chaotic, death spiral of declining enrollment.” The Senate also voted unanimously to approve another Huff bill, SB 416, which amends the CA Education Code to remove code sections that were dropped during adoption of the Local Control Funding Formula through the state budget process last year. SB 416 is sponsored by the California School Boards Association. Senator Huff serves as the Senate Minority Leader and represents the 29th Senate District covering portions of Los Angeles, Orange and San Bernardino Counties. A new California Appellate case just published August 8, 2013, “Glaski v. Bank of America”, holds that a homeowner can challenge his lender’s right to foreclose by showing that the Deed of Trust never made it into the securitized trust until after the trust’s closing date. This issue is now squarely before the California Supreme Court in Yvanova v. New Century Mortgage Corp. This is the case in most loans made in the last 12 years. If the bank foreclosed we should be able to get the homeowner money damages and/or the house back. Or a lawsuit could be filed and a court ruling obtained preventing the court from foreclosing. Recently enacted Sections 2924(a)(6) and 2924.19 of California Civil Code provide the same relief to homeowners. When Felix and Oscar of “The Odd Couple” come to life at the Sierra Madre Playhouse, it’s as if they never went away during the five decades since their first appearance on Broadway. This iconic American comedy with its “neat-freak vs. slob” plot is as hilarious as ever. When Felix’s wife tosses him out, he shows up in utter despair at his old pal’s New York apartment. What can Oscar do but invite him to stay a few days? That stretches into weeks…. From the start, the men are at odds. Oscar Madison, having been divorced a couple of years, has settled into his easy-going “bachelor” life. But obsessive Felix Unger can’t help himself—he tosses out Oscar’s empty pizza boxes and half-spoiled leftovers; he fluffs the pillows and picks up dirty socks. All of which drives Oscar crazy. Brad David Reed as Felix has exactly the right air of prissiness and selfrighteousness to justify his ubiquitous tidying up. Meanwhile, Jack Sundmacher plays a laid-back Oscar who has no intention of reforming his lifestyle. In an effort to drag Felix out of his doldrums, Oscar promotes a double-date with the attractive Pigeon sisters from an upstairs apartment. Flibbertigibbets both, Gwendolyn and Cecily steal the show with their giggles and their expressive, coy-but-come-on looks. It helps that costume designer Angela Nicholas has outfitted the young ladies in startlingly colorful, even bizarre, ensembles. In a nod toward diversity in these roles, Kari Lee and Jane Lui play Gwen-

dolyn and Cecily, respectively. Every one of the men’s wisecracking, poker-playing friends stays true to his character: Vince DonVito as Speed, Steve Bean as Murray, Joe Langer as Roy, and Richard Van Slyke as Vinnie. Their boisterous insults, put-downs and ribbing belie the long-time camaraderie they enjoy. John Vertrees has designed the bachelor’s living room with circa ’60s touches. A copy of “Life” in a vintage magazine rack, college pennants on the wall, a dial phone…. Every bit of clutter is well-chosen to convey Oscar’s inattention to orderliness. Even the ferns are dead—until the second act, by when Felix has replaced them with fresh ones! In the past 50 years, various Odd Couples have entertained us: Walter Matthau and Art Carney in its Broadway debut in 1965, followed by two movies starring Matthau with Jack Lemmon. Moreover, there have been three TV series. You’ll be delighted to know that these actors at the Playhouse are the perfect pair to step into Felix’s and Oscar’s shoes. We are fortunate to have such a polished performance to regale us. Their impeccable timing, along with that of their cronies, allows for the audience’s peals of laughter to roll. Playwright Neil Simon is a master at creating repartee that brings laughter in unexpected places. Yet beyond the humor, he also plumbs the depths of human foibles and relationships. The neat vs. slob ploy is an over-simplification. This play is built on the men’s

constant antagonism, yet their underlying caring for each other blunts the sharpness of their confrontations. As Alan Brooks in his directorial debut at the Playhouse says, “A bedrock of affection for each other grows, and from it come the bone-deep laughs that give the play substance as well as humor.” Allow time to appreciate the foyer exhibits relating to the drama itself. Diane Siegel as lobby curator has cleverly decorated one wall with items typical of Oscar, and the opposite wall defining Felix (would you believe dustpans?) Co-producers of “The Odd Couple” are Sherrie Lofton, Christian Lebano, and Estelle Campbell. Stage manager is Kristin Bolinski, with Emily Hopfauf assisting. Again this year La Canada Presbyterian’s annual “Americana Concert” is on Memorial Day weekend, as part of the City of La Canada-Flintridge’s Fiesta Days celebration. We shall celebrate our American heritage, history and culture as we wave our flag in three cheers for the Red, White and Blue with spectacular and inspirational American music presented by the La Canada Presbyterian Church Chancel Choir and LCPC Orchestra, numbering over 100 singers and instrumentalists on Saturday, May 23 at 7:30 p.m. in our sanctuary at 626 Foothill Boulevard, La Canada. The concert is a multimedia affair with the music being accompanied by inspirational videos showing images from American history and famous places around our great picturesque country. The concert opens with John Williams stunning “Liberty Fanfare” written for the centennial celebration of the Statue of Liberty in 1986. Recently, local stroke survivors enjoyed a morning of golf instruction at Brookside Golf Club in Pasadena. The event, sponsored by Huntington Memorial Hospital, was part of “Saving Strokes,” a rehabilitationthrough-golf program of the American Heart/American Stroke Association, offering stroke survivors the oppor-

tunity to add golf as a mental, physical and emotional rehabilitation tool in their journey to recovery. Participants spent the morning working with golf pros and later enjoyed a luncheon with fellow survivors, physical therapists, and other members of the Huntington Hospital stroke center team.

F.The FDA asserts that electronic cigarettes should be regulated as drug delivery devices. G.Based upon reports from the FDA and the State of California, there are no objective scientific reports demonstrating that electronic cigarettes can help smokers to quit smoking. H.While the City Council previously amended the MPMC to help regulate electronic cigarettes, the City anticipates receiving applications for placing “Vaping Stores” (as defined below) within the City’s jurisdiction based upon the decision by neighboring jurisdictions to

adopt interim land use regulations affecting electronic cigarettes. I.The provisions of the MPMC that may regulate the construction and placement of Vaping Stores in the City are inadequate and need review, study, and revision. The current provisions also fail to fully take into account the impacts related to the location and manner of construction of Vaping Stores, and the related public health, safety, and welfare concerns. J.Additionally, the City Council has concerns about the construction and installation of Vaping Stores and the impacts they may have on parking, surrounding uses, and the community. K.The City Council further desires to evaluate and enhance the public works and aesthetic standards regarding such facilities, if necessary. L.Without the enactment of this Ordinance, multiple applicants could receive entitlements that would allow the installation of Vaping Stores that pose a threat to the public health, safety, and welfare. M.The City Council determines that the MPMC requires updating to protect the public against health, safety, and welfare dangers caused by multiple applicants each constructing separate Vaping Stores. The City needs additional time to prepare, evaluate and adopt reasonable regulations regarding the placement and construction of Vaping Stores and to ensure such regulations are applied in a nondiscriminatory manner. N.In order to prevent frustration of these studies and the implementation of new regulations, the public interest, health, safety, and welfare require enactment of this Ordinance. The absence of this Ordinance would impair the orderly and effective implementation of contemplated MPMC amendments, and any further authorization of these uses within the City during the period of the moratorium may be in conflict with or may frustrate the contemplated updates and revisions of the MPMC. O.Based on the foregoing, the City finds that that this Ordinance is necessary in order to protect the City from the potential effects and impacts of uncoordinated and conflicting construction of Vaping Stores in the City, potential increases in crime, fire hazards, multiple obstructions of traffic and commerce on City streets, impacts on parking availability in the business areas of the City, the aesthetic impacts to the City, and other similar or related effects on property values and the quality of life in the City’s neighborhoods. P.The City Council further finds that this moratorium is a matter of local and City-wide importance and is not directed towards any particular business that currently seeks to construct a Vaping Store. Q.The City Council finds that this Ordinance is authorized by the City’s police powers. The City Council further finds that the length of the moratorium imposed by this Ordinance will not in any way deprive any person of rights granted by state or federal laws, because the moratorium is short in duration and essential to protect the public health, safety and welfare. SECTION 3:Environmental Assessment. Adoption of this Ordinance is exempt from further environmental review under the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA Guidelines (14 California Code of Regulations §§ 15000, et seq.) because it establishes rules and procedures for operation of existing facilities; minor temporary use of land; minor alterations in land use; new construction of small structures; and minor structures accessory to existing commercial facilities. This Ordinance, therefore, is categorically exempt from further CEQA review under CEQA Guidelines §§ 15301; 15303, 15304(e); 15305; and 15311. Further, the adoption of this Ordinance is also exempt from review under CEQA pursuant to CEQA Guidelines § 15061(b)(3) because the Ordinance is for general policies and procedure-making. This Ordinance does not authorize any new development entitlements, but simply establishes policies and procedures for allowing the previously approved project to be constructed. Any proposed project that will utilize the changes set forth in this Ordinance will be subject to CEQA review as part of the entitlement review of the project. The Ordinance will not adversely impact the environment and is therefore exempt from the provisions of CEQA. SECTION 4:Interim regulations. The following provisions are adopted as interim requirements for issuing permits pursuant to the MPMC for construction or operation of Vaping Stores, and any construction or operation in the City in conflict with these provisions is expressly prohibited: A.Restricted Activities. For a period of 10 months and 15 days after adoption of this Ordinance, the City will not issue a permit or land use entitlement to any person for constructing, placing, or operating new Vaping Stores within the City’s jurisdiction. The City Manager, or designee, must review any application for a permit or land use entitlement to determine compliance with the provisions of this Ordinance. City staff, including City boards and commissions, are directed to refrain from accepting or processing any application for any land use entitlement, including, without limitation, use permits, variances, building permits, licenses and certificates of occupancy, necessary for constructing, placing, or operating Vaping Stores within the City’s jurisdiction, and to refrain from issuing any land use entitlement for any pending applications already received. These prohibitions will remain effective for 10 months and 15 days following adoption of this Ordinance. B.Definitions. In addition to the definitions contained in the MPMC, the following words and phrases will, for the purposes of this Ordinance, be defined as follows, unless it is clearly apparent from the context that another meaning is intended. Should any of the definitions be in conflict with the current provisions of the MPMC, the following definitions will prevail: 1.“Electronic Cigarette” has the same meaning as set forth in Health and Safety Code § 119405 and similar devices intended to emulate smoking, which permit a person to inhale vapors or mists that may or may not include nicotine. 2.“Vaping Retailer” means any person that operates a store, stand, concession, or other place at which sales, or other exchanges for value, of electronic

cigarettes are made to purchasers for consumption or use. 3.“Vaping Store” means a vaping retailer that devotes at least ten percent (10%) of the floor area of its business to the use, display and sale of electronic cigarettes. SECTION 5:Construction. This Ordinance must be broadly construed in order to achieve the purposes stated in this Ordinance. It is the City Council’s intent that the provisions of this Ordinance be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Ordinance. SECTION 6:Enforceability. Repeal of any provision of the MPMC does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before this Ordinance’s effective date. Any such repealed part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Ordinance. SECTION 7:Validity of Previous Code Sections. If this entire Ordinance or its application is deemed invalid by a court of competent jurisdiction, any repeal or amendment of the MPMC or other city ordinance by this Ordinance will be rendered void and cause such previous MPMC provision or other the city ordinance to remain in full force and effect for all purposes. SECTION 8:Severability. If any part of this Ordinance or its application is deemed invalid by a court of competent jurisdiction, the city council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Ordinance are severable. SECTION 9:Publication.The City Clerk is directed to certify the passage and adoption of this Ordinance; cause it to be entered into the City of Monterey Park’s book of original ordinances; make a note of the passage and adoption in the records of this meeting; and, within fifteen (15) days after the passage and adoption of this Ordinance, cause it to be published or posted in accordance with California law. SECTION 10:Report. Pursuant to Government Code § 65858, the City Manager, or designee, must prepare a report for City Council consideration describing the measures taken to address the conditions which led to adoption of this Ordinance. This report must be provided to the City Council so that it may be considered and issued not later than 10 days before this Ordinance expires. SECTION 11:Effective Date. This Ordinance will become effective immediately upon adoption pursuant to Government Code §§ 36937 and 65858 for the immediate preservation of the public peace, health, safety, and welfare. After adoption, this Ordinance will be repealed by operation of law on March 21, 2016, unless a subsequent ordinance is adopted by the City Council that extends this date.
