Coalition Claims CleanTech’s New Facility Violates Zoning
CAL FIRE and California National Guard Train in the Air
VOLUME 3, NO. 16
BY MARIELA PATRON
A coalition made up of environmentalists, community volunteers, and religious leaders in defense of the Santa Fe Dam Recreational Area continued their fight against CleanTech Environmental Inc.’s new used-oil treatment and hazardous waste storage facility last week. The coalition signed a letter asking the Irwindale City Council to rectify alleged incorrect zoning code information the Department of Toxic Substances Control obtained while assessing the Environmental Impact Report for CleanTech’s new facility. As California enters its fourth year of drought, CAL FIRE and the California National Guard held their annual fire aviation training in preparation for the peak fire season ahead. The training this year was held last week at the CAL FIRE
Academy in Ione and Lake Pardee in Amador County. “As the drought continues to create extreme fire conditions, it is more important than ever to train with our partners in order to be prepared for our state’s inevitable
wildfires,” said Chief Ken Pimlott, director of CAL FIRE. “During years of high fire activity, the assistance from the California National Guard has been vital in aiding us battle large, damaging fires.” CAL FIRE and the Cali-

In a moving ceremony Monday at the State Capitol, Assemblymember Chris Holden (D-Pasadena) honored Holocaust survivor Ike Langholz of Pasadena, whose nightmarish journey through the Nazi occupation of Poland was recounted on the Assembly floor as part of Holocaust Remembrance Week. “I am honored to be able to share Ike Langholz’ story of survival in the face of incredible pain and suffering at the hands of the Nazis,” said Assemblymember Holden. “Ike lived through extreme persecution and horrific experiences during this agonizing dark history. The number of survivors is dwindling, so we are here today to raise awareness of these dark events and honor Ike for his courage and his willingness to tell his story.”

I will draw from my work as a public safety officer, businesswoman, and an educator to find solutions to the challenges facing California.” Riddle’s campaign team will be led by Doug Herman of The Strategy Group, David Pruitt of David Pruitt Consulting, and David Binder of David Binder Research. Have you ever seen magic left over from a rainstorm? Have you ever walked in a forest and thought you saw something little and enchanting out of the corner of your eye? Do you believe in Faeries? As children we believed in magic and knew in our hearts there was something enchanting out there; hidden, kind, beautiful, and filled with goodness. Do you remember these feelings? The yearning? If so, you too may have glimpsed Fairyland. A Faery Hunt, the Nickelodeon winner for “Best Children’s Theater in Los Angeles” will be creating Fairyland right here at the Los Angeles County Arboretum and Botanic Garden on Saturday April 18. From 9:30 a.m. - 12:30 p.m. you can enjoy lovely fairies with singing, dancing, a treasure hunt, and storytelling, along with enchanting guided tours through the magnificent Celebration Garden. The fairies will weave the magic of the stories of Fairyland, as the children are reminded to protect the earth and keep it safe. “Here are my friends the water fairies,” says Fairy Sedona as she points out the Watering Wall in the Celebration Garden.
“The water fairies remind us that we are in a draught right now, so we need to use our water carefully and not be wasteful.” Sedona then has a dialogue with the children about protecting the environment and asks them what they can do. The children and their families then take the fairy pledge to protect the earth and keep it safe. Children are encouraged to come in their favorite fairy, princess or super hero costume! Maybe some of the parents would like to join in on the fun and come in costume too. Reservations are suggested at (626) 821-4623. Walk-ups are welcome. $10 a ticket per person for members. $15 a ticket per person for non-members.

For 67 years member of a local volunteer organization have worked to raise money to support music programs in the community. Over those years they have donated more than 20 million dollars in “gifts and grants to support the Los Angeles Philharmonic, Walt Disney Concert Hall, other non-profit organizations and local symphonic, cultural and educational musically oriented programs for youth,” according to the group’s website. In addition, the group funds a Music Mobile, a van equipped with musical instruments that has visited over 100,000 third graders throughout the area. It has also provided for over 250,000 fourth graders to attend concerts by the Los Angeles Philharmonic, first at the Pasadena Civic Auditorium and now at the Walt Disney Concert Hall. If all this were not enough, there is also a Instrumental Music Competition with monetary awards (to date over $500,000 in prize money has been given). Originally known as the Pasadena Junior Philharmonic Committee, for 51 of those years they have raised that money by working with local designers to produce what is probably the best know “showcase” house in the country; hence the change in the group’s name to the Pasadena Showcase House for the Arts. This year, the group’s work with those designers has result in the transformation of 1910 Pasadena estate designed by Fernand Parmentier. The house is an interesting mix of Tradition Tudor combined with touches of the then popular Craftsman movement. With Honduran mahogany beams and moldings. The main house has 9,400 sq feet with an entry hall, formal living and dining rooms, a library and bath,
kitchen and mudroom/ laundry on the lower level. The upper level has three bedrooms. four baths, a family room, reading room and an artist’s retreat. As the all infomercials say, “But wait, there’s more.” There is also a 2.600 square foot with an upstairs apartment that formerly held rooms for the chauffer and coachman. The lower level was a combination garage and stables. The one and one half acre property has five distinct garden areas including an entry garden, a swimming pool, koi pond, garden kitchen/BBQ area, and wisteria arbor. As always, outside the house itself, Showcase has provided a shopping area and a restaurant. There is even a small pub next to the Shops at Showcase for those who prefer a drink to shopping. Showcase opens this Sunday, April 19 and will be open through May 17. The house opens each day on 9:00 a.m. On Mondays Tuesdays and on the weekends, the tours continue until 3:30 pm with the house closing at 6 pm. On Wednesday and Thursday the tours end at 6:30 pmwith the house closing at 8 pm. On Fridays the tours will end at 7 and the house closes at 8:30 pm. The house is closed to the public on Mondays. Tickets are available on line via the showcase website: www.pasadenashowcase.org The cost is from $35 to $45 depending on the time of day and whether the tickets are purchased in advance. As always, parking for the showcase on most days is at the Rose Bowl with free shuttle service to the house. There is no parking in the neighborhood of the showcase house out of respect to the neighbors. Next week, look here for a more detailed description of the house itself.

Ike’s story began as 8-year-old along the Poland/ Ukraine border. Following the Nazi conquest of Poland in 1939, any sense of normalcy became impossible. Jews were beaten and forced to work in labor camps or killed simply because they were Jews. Three of Ike’s six brothers and sisters, as well as his mother, grandmother, and other family members, were killed by the Nazi SS. Ike and his brother Sam ran away from the labor camp where they had been forced to work as slave labor and hid in the woods, surviving on potatoes and sugar beets and their own skills. With the liberation of the camps by Russian troops in the waning days of World War II, Ike and his brother, two sisters and their father made their way to a displaced persons camp in Germany. There he learned a trade as an electrician and said he “learned to be hu-

Detectives Seeking Public’s Help in Locating Possible Additional Victims
Los Angeles County Sheriff’s Department Special Victims Bureau detectives are seeking the public’s help in identifying possible additional victims. On Wednesday, April 8, 2015 at approximately 3:00 a.m., a 25 year-old female was kidnapped and raped in the city of Arcadia. A Joint effort from Special Victims Bureau and Temple Station personnel resulted in the arrest of 29 year-old Philippe Lutete on the 2800 block of Mayflower Avenue, Arcadia (unincorporated), last night without incident. The investigation began yesterday, on April 8, 2015, when a citizen reported a domestic violence call on the 2900 block of Spruce Court in the unincorporated area of Arcadia. The deputies arrived on scene and heard the victim screaming for help from the rear second floor window of a residence. As deputies entered the building, the suspect fled from the location leaping from the second story, to an adjacent first story building. The victim immediately disclosed that she had been kidnapped and raped. She said she was abducted while walking in the vicinity of Longden Avenue and Peck Road, Arcadia, near the ARCO Gas Station. The suspect grabbed and carried the victim into his car. He drove the victim to his home where he continuously sexually as-

Coalition Claims Zoning Violation

“The DTSC has abandoned the people that it is supposed to protect from toxic harm,” Liza Tucker, consumer advocate for Consumer Watchdog, said. “It is a matter of being ignored.” The letter claims CleanTech’s facility goes against the permitted use of the area and does not have a needed conditional use permit. It also classifies the new facility as large processing, which, according to the zoning code, is not allowed to process hazardous materials or expand without modifying the required permit. Irwindale Community Development Director Gus Romo said CleanTech does not qualify as a large processing facility because by definition a facility of the sort collects and processes recyclable materials and occupies at least 25,000 square feet of gross collection, processing and storage area. CleanTech installed two tanks in February—one for treating used oil and the other for storing non-RCRA wastewater. DTSC Media Information Officer Russ Edmondson said tanks are only allowed to be installed in CleanTech’s existing 18,240 square foot warehouse. The coalition says it is concerned with the facility’s quarter mile proximity to the Santa Fe Dam Recreational Area because it will increase the risk of oil spills and pollution. “I wish we could more seriously consider the wellbeing of all people and of the Earth itself and not let corporations guide the health of the planet,” said Rabbi Jonathan Klein, executive director of CLUE Los Angeles. “It’s painful to see it’s an undeserved Latino community that faces the wrath of toxic polluter.” CleanTech President Bob Brown said oil cannot reach the recreational area. “We’ve got many layers of new concrete, multiple pro-

tection barriers around all the tanks included,” Brown said. “There’s no way that anything can impede or harm the Santa Fe Dam.” However, Tucker said the community is being taken advantage of. “I think the DTSC minimized the potential effect of spills and trucks coming in and out of deliveries,” Tucker said. “I think they wanted to come out with this result to ram it down the throats of that community.” Advocates are reaching out to neighboring cities for support against CleanTech’s facility. Beatriz Sandoval, volunteer coordinator for L.A. Voice PICO, said she is scared the same oversight that occurred in Vernon, California will happen in Irwindale. In March, an Exide Technologies battery recycling plant officially shut down in Vernon as a result of lead emissions. According to status updates from advocates on the Save the Santa Fe Dam Rec Area Facebook page, the DTSC ignored Exide Technologies’ operations for years. Tucker said the DTSC knows how to use loopholes to the advantage of companies. “There is a revolving door of people that leave the DTSC and then go represent industry,” she said. Brown said the new facility benefits the community. “It’s creating green jobs and improving the environ-
ment by lowering our carbon footprint for the state,” Brown said. “It is the cleanest facility for recycling used oil in the state of California because it is done indoors.” Before installing the facility, CleanTech transported used-oil to Veolia Environmental Services in Azusa. CleanTech submitted an application for its waste storage and treatment facility to the DTSC in 2010. The permit issued December 2012 was appealed, and it prompted the DTSC to do an Environmental Impact Report instead of the initial Negative Declaration, Edmondson said. Deputy Director of the Planning and Development Agency of Los Angeles Norma Garcia said the department reviewed the Environmental Impact Report draft and found the facility would not cause a significant environmental impact on the recreational area. In addition, Romo said the city determined in 2012 that a conditional use permit was not needed because the new facility is considered a supplementary part of CleanTech’s business as a registered manufacturer and of its hazardous waste management programs. Upon completing the Environmental Impact Report, the DTSC granted CleanTech the necessary permit in February. The DTSC denied all appeals to the final decision.

the year so we’ll be ready when fire season inevitably arrives,” said Maj. Gen. David S. Baldwin, Adjutant General of the California National Guard. “But this is a team effort, and the annual training in Ione is critical in making sure we stay in sync with CAL FIRE and all our partner agencies in keeping Californians safe.” The most effective way to teach crews is by utilizing the tools they will have while fighting a wildfire, including water. In order to conserve the water the crews will use, the staff will work closely with local water districts to identify drop areas in ravines and drainages that will allow the water to work its way back into the lake. CAL FIRE will hold similar trainings with the United States Marine Corps and Navy. “Military pilots have skills we can draw upon when we need assistance on firefighting missions,” said Chief Ken Pimlott. CAL FIRE has the largest aerial firefighting fleet in the world, with over 50 aircraft, including 11 UH1H Super Huey helicopters.

Phlunte’ Riddle Opens Campaign for State Senate District 5
A new California Appellate case just published August 8, 2013, “Glaski v. Bank of America”, holds that a homeowner can challenge his lender’s right to foreclose by showing that the Deed of Trust never made it into the securitized trust until after the trust’s closing date. This issue is now squarely before the California Supreme Court in Yvanova v. New Century Mortgage Corp. This is the case in most loans made in the last 12 years. If the bank foreclosed we should be able to get the homeowner money damages and/or the house back. Or a lawsuit could be filed and a court ruling obtained preventing the court from foreclosing. Recently enacted Sections 2924(a)(6) and 2924.19 of California Civil Code provide the same relief to homeowners. It is highly suggested that homeowners take this window of opportunity to get relief before the banks get Congress to close this door with national legislation. Contact us so we can help you.
