The hit and run occured around 7:30 p.m. Sunday at the intersection of Orange Grove Avenue and Columbia Street in South Pasadena, according to police reports. The driver of a newer model, dark-colored SUV hit “the 40-year-old husband, the 30-year-old mother, their 4-month-old daughter, who was being held in her mother’s arms, and the family dog,” while they were in the crosswalk. The seventh and final deputy in the Los Angeles Sheriff’s Department convicted of obstruction of justice for interfering with a grand jury investigation into misconduct at the Men’s Central Jail was sentenced this morning to 18 months in federal prison. James Sexton, 30, was sentenced by United States District Judge Percy Anderson, who said the defendant “lost the courage to stand up when he knew things were wrong.” After his case was severed from the other six defendants in the case, Sexton was found guilty in September of attempting to quash an investigation by the FBI into civil rights abuses at jail facilities operated by

the Sheriff’s Department. The jury determined that Sexton was part of a broad conspiracy to obstruct justice—a plot in which conspirators, including two lieutenants, attempted to influence witnesses, threatened an FBI agent with arrest and concealed an FBI informant who should have been turned over to federal authorities. Sexton was found guilty of conspiring to obstruct justice and obstruction of justice. The conspiracy to obstruct justice began in the summer of 2011 after sheriff’s deputies assigned to the Men’s Central Jail learned that a jail inmate was an FBI informant and was acting as a cooperator in a federal Please see page 5

two boys this Christmas. Fournier stepped in and in a matter of weeks she and her fellow caring Arcadia firefighters were in on the plan to make Valerie Babinski’s Christmas a little brighter. On Thursday December 11, Arcadia Firefighters delivered a firehouse dinner and Christmas toys to a local single mom who is battling brain tumors and cancer. Valerie Babinski has two young boys ages eight and 10, Colin and Noah. Valerie was diagnosed with Glioblastoma brain tumors after suffering a seizure while training to run the NYC Marathon. She was an avid marathon runner and ironman participant and was highly involved in the local Little League. During brain surgery to remove the tumor a mere three weeks ago, doctors at UCLA discovered a secondary brain tumor that is inoperable. Valerie is currently dealing with deficits left from her seizure and brain surgery and will begin radiation and chemo therapy shortly. The Arcadia Firefighters Association would like to raise awareness of an online fundraiser that has been established by Valerie’s friends to help the Babinski family during this difficult time. It is their desire to encourage Valerie and her young boys during this holiday season. The firefighters who delivered the present Thursday also took the two boys on a ride in Arcadia’s coolest Fire Truck. According to her friend

Amanda Gentry, “Valerie is continuing to recover from her surgery. She has ‘found her legs’ again and is moving without the use of a walker. Every day she continues to improve with the use of her right hand. She still has a few dexterity issues; however, she does better daily. The last couple of weeks have been a barrage of doctors’ appointments. Just yesterday she spent five hours... yes, five hours in a chair at UCLA having her blood filtered. It was explained to me, it was a similar experience to dialysis. At the end of the day Valerie also went home three bags of blood lighter: platelets, WBC’s and plasma. This was all part of the clinical trial she is involved in. Essentially the trial is to develop a vaccine for her brain tumor. This treatment is already approved in parts of Europe and having amazing results, so for Valerie to be a part of this is AMAZING! The blood specimens had to be collected BEFORE Valerie starts her Chemo/Radiation... which should commence next week.” Last weekend Valerie had the opportunity to get out amongst some of her running friends. Her oldest son, Noah, ran in the Holiday half 5K race. It was his very first race and he did amazing. He finished in 32 minutes and some change. Originally Valerie was supposed to run with Noah; however, with all the recent events it was not possible. So, Valerie’s amazing friend, Helen Crutchfield, stepped in and ran with

him. Valerie was so proud of Noah... as were we all! It was a good morning and Valerie was glad to be out and see some of her running friends! The next phase of getting Valerie well is six weeks of full brain radiation in conjunction with pill-for chemo. The doctors feel Valerie will tolerate the treatments well. Probably fatigue will be the worse side-effect along with some nausea. But Valerie knows what is in store and she remains optimistic, vigilant and has maintained her amazing sense of humor throughout this.

AHS student golfer files suit against Arcadia Unified School District An AHS student golfer has filed suit against Arcadia Unified School District after a fall from a second story school balcony left her confined to a wheelchair. Michelle Cheung of Arcadia filed the negligence suit Friday in Los Angeles Superior Court. She seeks unspecified damages. According to the complaint, Cheung suffered two fractures to her right pelvis and broke several bones in her spine after falling from the second story balcony of the main building at Arcadia High School on Jan. 7, 2014. The complaint alleges the district did not maintain the balcony railing in a safe con-

dition, but does not elaborate further on how the student fell. Cheung was taken to Huntington Memorial Hospital in Pasadena and underwent surgery two days after her fall, the suit states. Two metal rods and eight screws were inserted into her back, according to her complaint. She still does not have full mobility, requires the use of a wheelchair and it is uncertain whether she will fully recover or play golf again, the suit states. The AUSD superintendent’s office did not immediately return a call for comment.

On Friday December 19, the FBI provided the media with an update on the status of their investigation into the cyber attack targeting Sony Pictures Entertainment (SPE). In late November, SPE confirmed that it was the victim of a cyber attack that destroyed systems and stole large quantities of personal and commercial data. A group calling itself the “Guardians of Peace” claimed responsibility for the attack and subsequently issued threats against SPE, its employees, and theaters that distribute its movies. The FBI has determined that the intrusion into SPE’s network consisted of the deployment of destructive malware and the theft of proprietary information as well as employees’ personally identifiable information and confidential communications. The attacks also rendered thousands of SPE’s computers inoperable, forced SPE to take its entire computer network offline, and significantly disrupted the company’s business operations. After discovering the intrusion into its network, SPE requested the FBI’s assistance. Since then, the FBI has been working closely with the company throughout the investigation. Sony has been a great partner in the investigation, and continues to

work closely with the FBI. Sony reported this incident within hours, which is what the FBI hopes all companies will do when facing a cyber attack. Sony’s quick reporting facilitated the investigators’ ability to do their jobs, and ultimately to identify the source of these attacks. As a result of our investigation, and in close collaboration with other U.S. Government departments and agencies, the FBI now has enough information to conclude that the North Korean government is responsible for these actions. While the need to protect sensitive sources and methods precludes us from sharing all of this information, our conclusion is based, in part, on the following: • Technical analysis of the data deletion malware used in this attack revealed links to other malware that the FBI knows North Korean actors previously developed. For example, there were similarities in specific lines of code, encryption algorithms, data deletion methods, and compromised networks. • The FBI also observed significant overlap between the infrastructure used in this attack and other malicious cyber activity the U.S. Government has previously linked directly to North Korea. For example, the FBI discovered that several Internet protocol

(IP) addresses associated with known North Korean infrastructure communicated with IP addresses that were hardcoded into the data deletion malware used in this attack. • Separately, the tools used in the SPE attack have similarities to a cyber attack in March of last year against South Korean banks and media outlets, which was carried out by North Korea. We are deeply concerned about the destructive nature of this attack on a private sector entity and the ordinary citizens who worked there. Further, North Korea’s attack on SPE reaffirms that cyber threats pose one of the gravest national security dangers to the United States. Though the FBI has seen a wide variety and increasing number of cyber intrusions, the destructive nature of this attack, coupled with its coercive nature, sets it apart. North Korea’s actions were intended to inflict significant harm on a U.S. business and suppress the right of American citizens to express themselves. Such acts of intimidation fall outside the bounds of acceptable state behavior. The FBI takes seriously any attempt – whether through cyberenabled means, threats of violence, or otherwise – to undermine the economic and social prosperity of our citizens.

Man Charged after Major Car Crash in Alhambra-Faces 20 Years Prosecutors today charged an alleged drunken driver involved in a vehicular collision that injured more than a dozen bystanders looking at Christmas decorations in Alhambra, the Los Angeles County District Attorney’s Office announced. Ismael Soto, 28, of Los Angeles has been charged with four counts: driving under the influence of alcohol causing injury within 10 years of two other DUI offenses; driving with a .08 percent blood alcohol content causing injury within 10 years; driving when privilege suspended or revoked for DUI conviction; and driving a vehicle not equipped

with an ignition interlock device when driving privilege was restricted. He is charged in case GA095378. The defendant is scheduled to be arraigned Friday at the Los Angeles County Superior Court in Alhambra, Department 5. Prosecutors will recommend that his bail be set at $526,200. The felony complaint further alleges that Soto inflicted great bodily injury to more than one victim in the commission of the crime; the defendant drove at an excessive speed; and Soto had a blood alcohol content in excess of 0.2 percent. Additionally, the charging document alleges that the defendant

was previously convicted in 2013 of driving while having a 0.08 percent or higher blood alcohol and driving when privilege suspended or revoked. Prosecutors said on the evening of Dec. 14, Soto drove while inebriated and crashed his car into parked vehicles and a group of people near Fremont Avenue and Poplar Boulevard in Alhambra. Soon after the incident, the defendant was arrested in connection with the crash. If convicted as charged, Soto faces a maximum sentence of more than 20 years in state prison. The evidence showed that the defendants learned that the inmate received a cellular phone from a deputy sheriff who took a bribe and that the inmate was part of a federal civil rights investigation. Those involved in the obstruction scheme took affirmative steps to hide the cooperator from the FBI and the United States Marshals Service, which was attempting to bring the inmate into federal custody pursuant to an order issued by a federal judge. As part of the conspiracy, records were altered to make it appear as if the cooperator had been released, but he was re-booked under different names. The jury heard evidence that Sexton, who was part of a gang intelligence unit called Operation Safe Jails (OSJ), changed the name of the informant and his booking number in the jail

computer system, which allowed members of the conspiracy to hide the informant from the FBI. Sexton’s lieutenant “called him into the OSJ office and asked defendant Sexton to use his expertise in navigating the archaic LASD computer system to help [hide the informant] from the federal authorities,” prosecutors wrote in a sentencing document filed with the court. “Defendant knew he was being asked to become an essential part of a criminal plan. Defendant knew that he would be taking part in wrongdoing, and, as the con-

spiracy progressed, he knew time after time that the actions he took and those taken by his co-conspirators were wrong and illegal.” Following the 1½-year prison term, which Judge Anderson ordered to begin on February 16, 2015, Sexton will be on supervised release for one year. Six co-conspirators who were tried separated were found guilty of obstruction of justice and other charges earlier. They were sentenced in September to federal terms of up to 41 months.

A new California Appellate case just published August 8, 2013, “Glaski v. Bank of America”, holds that a homeowner can challenge his lender’s right to foreclose by showing that the Deed of Trust never made it into the securitized trust until after the trust’s closing date. Thursday a Pasadena court dropped all charges against PETA supporter Amanda Slyter, who was arrested in January and charged with “interfering with a special event” for using her body to block the SeaWorld float at the Rose Parade. As you may recall, Slyter was prepared to use the rarely seen “necessity” (or “lesser of two evils” or “greater good”) defense. Her counsel argued that the cruel capture and lifetime confinement of orcas to SeaWorld’s tiny concrete tanks constitute an emergency that necessitated action—in Slyter’s case, her disruption of SeaWorld’s propaganda plan. “This trial is just one step in the vigorous and growing movement to free the orcas who are cruelly confined at SeaWorld and denied everything that is natural and important to them at SeaWorld,” says Slyter. “More and more people are demanding that SeaWorld move the orcas to a coastal sanctuary where they would enjoy some semblance of a natural life.” Since the release of the documentary Blackfish, SeaWorld’s stock has dropped 47 percent, and in just the last week, the company’s CEO resigned and more than 300 other employees were laid off.
