Irwindale settles wrongful termination suit

Vergara v. California ruling; State officials appeal Judge Treu’s final ruling on tenure in California schools

Art Alas blasts Covina City Council for spying on residents’ homes and businesses

BY SHEL SEGAL A former Irwindale police department dispatcher received a $125,000 settlement from the Irwindale City Council, ending her wrongful termination and harassment lawsuit she filed against the city, according to a published report. Sarah Curtis, who lives in Alta Loma, was fired by then-police chief Dennis Smith in December 2012, according to a lawsuit she filed in Los Angeles County Superior Court. Curtis appealed the firing to an arbitrator, who decided she should not have been fired and should be allowed to return to work, the report said. But his decision is not binding, paving the way for City Manager John Davidson to “upheld the termination in July 2013 after an attempt to settle the claim informally,” the report said. Congressional Candidate Arturo Alas made the following statement about the City of Covina’s plan to spend more than $300,000 on a controversial surveillance programs: “It is wrong for the city of Covina to spy on its own residents, shoppers and business people. It has been shown consistently that surveillance cameras do not improve public safety or prevent crime. At best, cameras help to investigate and prosecute crimes after the fact. At worse, they are a serious breach of our rights and civil liberties.” “The City Council of Covina was wrong to implement this surveillance and spend more than $300,000 of our money without prior notice to the people of Co-

BY TERRY MILLER Last week, California Democratic Gov. Jerry Brown appealed a recent state judge’s ruling that ends tenure and other union protections for public school teachers.

The appeal, filed Friday, contends that Los Angeles County Superior Court Judge Rulf Treu’s final decree lacks detail and fails to provide the legal basis for his verdict. Treu issued the final ruling Thursday, after

Mayor Bill Bogaard will not run for re-election Popular Mayor has served Pasadena for 16 years City of Pasadena Mayor Bill Bogaard has announced his decision not to seek reelection after serving nearly 16 years as the City’s first, and (until now) only directly elected mayor in the City’s history. Bogaard is sending a two-page letter to many of his long-time friends and supporters in which he shares with them “a reluctant decision” not to seek re-election for a fifth term as Mayor. A copy of the letter is attached with this news release. “There is never a good time for a decision like this

and so, after lots of thinking and often conferring with many of you, I have reached a reluctant decision not to run for re-election,” Mayor Bogaard wrote. “I don’t want to look back and find I stayed too long and I want to go on to other activities which will include much more time spent with Claire (Mrs. Bogaard) and the other members of our family.” Mayor Bogaard shared that the ongoing economic challenges means this is not the perfect time for him to step away, but he encouraged City officials

to continue maintaining a strong fiscal condition and “pursue a strong local economy” plus youth development programs; strong public education; affordable housing and homeless services; renewable energy sources, water conservation; and planning and zoning guidelines “that protect and strengthen the character of our city.” City Manager Michael J. ister at Live Oak Annex by Monday, Sept. 15 will receive a free gift. Check-in on the day of the event begins at 2:30 p.m., with the walk beginning at 3 p.m. For more information, contact the Parks and Recreation Department at (626) 285-2171, ext. 2361.

Police warn of ‘Grandparents Scam’ In the typical scenario, a grandparent receives a phone call from a scammer claiming to be one of his or her grandchildren. Callers go on to say that they are in some kind of trouble and need money immediately. They claim to have been in a car accident, are having trouble returning from a foreign country or they need bail money. The grandparent may get a call from two people, one pretending to be their grandchild and the other pretending to be either a police officer or a lawyer. They will ask ques-

tions prompting for personal information. The grandparent will then be asked to wire money through a money transfer company or to buy some pre-paid debit cards and are asked to give up the card numbers so they can be funded by the scammer. Often, victims don’t verify the story until after the money has been sent. In some cases, scammers pretend to be your old neighbor or a friend of the family. Generally, the emergency scam is directed at the elderly in our community.

If you or someone you know is being scammed please have them contact the Pasadena Police Department, Financial Crime Unit at 626-744-4576. If the money has not yet been wired or funded, cease all communications with the scammers and do not send the money, then contact the police. Contact: The Financial Crime Unit at (626) 744-4576 for further information or contact the Federal Trade Commission at: http://www. consumer.ftc.gov/scam-alerts.

California Senate passes new gun violence restraining order in wake of Isla Vista Shooting Bill now goes to the State Assembly California’s state senate passed the “Gun Violence Restraining Order (AB 1014),” legislation that would allow family members or law enforcement to petition a court to remove firearms from someone temporarily if they believe there is a possible risk of injury or death. This legislation has been a priority for the California Chapters of the Brady Campaign and is supported by a large and diverse list of supporters including the California Partnership to End Domestic Violence, the California State Sheriffs Association, Disability Rights California, the City of Los Angeles, Attorney General Kamala Harris and the California Psychiatric Association. A similar law is in place in Connecticut and Indiana. The legislation reached the senate floor in

the wake of the attention after the Isla Visa shooting in May that killed six college students. Before the Isla Vista shooting occurred, the parents of the shooter contacted law enforcement because they felt their son posed a serious risk to himself. Law enforcement could not act because he didn’t meet the criteria for any further intervention. Current state law allows police intervention if a subject meets the criteria for an involuntary civil commitment to mental health treatment. A “Gun Violence Restraining Order” would allow families in similar situations to seek a court order to temporarily restrict a person’s access to guns. The issue would later go to a noticed hearing where future access to firearms would be ruled on.

“While we hope this restraining order would rarely be necessary, when a family member shows certain warning signs of a potential for violence, this legislation will prevent shootings before they happen and save lives,” said Nick and Amanda Wilcox, legislative co-chairs of the California Chapters of the Brady Campaign to Prevent Gun Violence. “Today’s passage of the ‘Gun Violence Restraining Order’ legislation moves us one step closer to giving families and law enforcement another tool to reduce the risk of mass shootings and gun violence both in the home and on our streets.” The “Gun Violence Restraining Order” legislation now goes to the full assembly before going to Governor Brown for his signature.

Orbitting Saturn the Cassini/Huygens spacecraft In July 2004 the most ambitious planetary exploration mission ever, began with insertion of the Cassini/Huygens spacecraft into orbit about Saturn. In January 2005 the Huygens probe landed on the surface of Saturn’s smog enshrouded moon Titan— the most distant landing ever accomplished. Titan has been revealed to be a world in many ways similar to the early Earth, awash in seas of liquid methane and organic molecules, the building blocks of life. The Cassini craft continues to orbit Saturn, returning spectacular images of the moons, rings, and Saturn itself. Highlights include the discovery of huge liquid water geysers erupting from the tiny moon Enceladus and the startling conclusion that Titan may Earth’s closest analogue in the solar system. The pace of discovery shows no sign of slowing down and a fully spectacular mission end is planned in 2017. Our speaker is John Smith, who has spent 29 years designing missions

and operating spacecraft at JPL. He has worked on successful missions to Venus, Mars, Vesta, and Saturn, and is looking forward to adding the dwarf planet, Ceres, to the list. He was designer of the four year Cassini tour of the Saturn system completed in 2008 and recently contributed to the design of the Cassini mission extensions through 2017. Vergara v. California ruling Continued from page 1

get out of control, came to school unprepared and demeaned and humiliated students. State Superintendent of schools Tom Torlakson issued a press release last week on Vergara Lawsuit and said, “No teacher is perfect. A very few are not worthy of the job.” He added, “The people who dedicate their lives to the teaching profession deserve our admiration and support. Instead, this ruling lays the failings of our education system at their feet. “We do not fault doctors when the emergency room is full. We do not criticize the firefighter whose supply of water runs dry. Yet while we crowd our classrooms and fail to properly equip them with adequate resources, those who filed and support this case shamelessly seek to blame teachers who step forward every day to make a difference for our children. “No teacher is perfect. A very few are not worthy

of the job. School districts have always had the power to dismiss those who do not measure up, and this year I helped pass a new law that streamlined the dismissal process, while protecting the rights of both teachers and students. It is disappointing that the Court refused to even consider this important reform. “In a cruel irony, this final ruling comes as many California teachers spend countless unpaid hours preparing to start the new school year in hopes of better serving the very students this case purportedly seeks to help. “While the statutes in this case are not under my jurisdiction as state Superintendent, it is clear that the Court’s ruling is not supported by the facts or the law. Its vagueness provides no guidance about how the Legislature could successfully alter the challenged statutes to satisfy the Court. Accordingly, I will ask the Attorney General to seek appellate review.”

Waste Management encourages parents to teach recycling habits as school begins Five easy ways to make this school year the greenest ever for children

School is back in session for kids and Waste Management of Southern California would like to encourage everyone to kick off the new school year by being green, both in classrooms and at home. “Back to school is an exciting time for everyone and a great opportunity to recommit to good recycling habits,” said Eloisa Orozco area communications manager for Waste Management of Southern California. “Fostering good recycling habits among children at an early age can help develop the next generation of environmental champions so that together, we can conserve earth’s precious resources.” Waste Management would like to share the following tips to reduce, reuse and recycle this school year: • Purchase products made from recycled materials: A new

school year means new notebooks, binders, paper and printer ink all of which are available with recycled content. • Pack a lunch with reusable gear: Packing a lunch is a healthy habit for everyone in the family. Buying lunch at school or eating out often means more calories, more money and more waste, whereas packing a lunch gives you an opportunity to use leftovers and save money. By utilizing reusable gear, like a fun lunch box or environmentally friendly water bottle, you can also save on waste. • Utilize carpools or public transportation: While cars may be convenient, traffic and high gas prices certainly are not. Taking advantage of school buses to transport children to and from school is not only costeffective, it can also save you time. Or, take a break from driving by organizing

a neighborhood carpool or consider green options like walking or biking as a family. • Turn off and unplug appliances when you are not using them: Computers, printers, fax machines and other wired devices cost money when not in use, even when they are in sleep mode or turned off. Help conserve energy by unplugging these appliances when you are not using them. Encourage kids to get involved too and make them responsible for doing one last check before leaving the house to make sure all lights and small appliances are turned off and unplugged. • Donate last year’s clothes to charity: A new back to school wardrobe is many students favorite part of summer’s end but don’t forget about last year’s clothes! Encourage children to donate old outfits to charity and help give their wardrobe a second life.

Bingo had a record crowd in the air conditioned parish center as people at the fiesta enjoyed seeing neighbors, friends and co-workers in a fun atmosphere full of great spirit and happiness.” “Our 400 plus volunteers happily worked together as they served the fiesta visitors whether preparing and serving delicious international foods, operating game booths, performing on stage or the very important setting up and taking down of the fiesta. A few dozen of our tireless volunteers that showed up on Labor Day morning to clean the grounds by lunchtime made it look like there was no event during the past weekend, amazing hard-working people, just like our clean up volunteers throughout the fiesta. We have an amazing group of 400 plus volunteer people who really care about our visitors having a great time, Lyons emphasized. “And our volunteers had fun

also.” On Friday, Aug. 29, the Ringing of the Bells Ceremony started the fiesta at 6 p.m. at the mission bell wall, followed by the Blessing of the fiesta grounds. Saturday, Aug. 30, festivities started at 6 a.m. with Walk or Bike to Los Angeles to re-enact the group that left San Gabriel Mission to go start the City of Los Angeles. Hundreds of walkers and bicyclists traveled from the mission to El Pueblo de Los Angeles by Olvera Street, where the City of Los Angeles celebrated its 233rd birthday. The Children’s and Pet’s Costume Contest, Blessing of the Animals, Gabrieleno Tongva indians and re-enactors of history and art show in the mission gardens, and a birthday cake at the fiesta stage rounded out Saturday’s activities. On Sunday, Aug. 31, the Founders’ Memorial Mass at 9:30 a.m. was in the old mission church, followed by the day two of the Art and Photography Show in the gardens. Among the traditions of the fiesta are the Royal

Court Contest and the Fiesta Royal Court members representing the mission at its fiesta and throughout the year at church, civic and social events. This year’s Royal Court includes Queen Sarah Hauffen-Salgado of Gabrielino High School, Princesses Marla Cueva of Cal State Los Angeles, Gissele Mercado of Temple City High School, Jessica Moreno of Rosemead High School and Anne Renderos of Pasadena City College. The fiesta included religious, historical and cultural festivities, small and large rides, game booths, international foods, entertainment in the evenings, and prize drawings totaling more than $9,000 on Aug. 31, to close the fiesta. Xavier Vargas, fiesta executive director, emphasized “the fiesta success is due to the participants enjoying all parts of the fiesta, and the 400 plus volunteers that made it possible, along with generous sponsors from small companies to national companies supporting this oldest end of summer celebration in the Southland.”

major accomplishment in Pasadena over the past 15 years. Pasadena would not be recognized as a national role model city without Mayor Bogaard’s leadership,” Beck said. “Mayor Bogaard embodies the best qualities that people want in an elected official.” Mayor Bogaard began his first four-year term as Pasadena’s first directly elected mayor in 1999. He is currently completing his fourth four-year term. He

Dolphin Bay Resort & Spa in Pismo Beach By Greg Aragon California has tons of great hotel rooms and Dolphin Bay Hotel & Residences in Pismo Beach is up there with the best of them. In fact, for sheer luxury and location, the property is one of my favorites. Perched atop the rugged cliffs of California’s central coast, midway between San Francisco and Los Angeles, the oceanfront resort overlooks the crashing Pacific Ocean with incredible panoramas, while offering 60 spacious 1- and 2-bedroom suites with all of the amenities of a home. The resort also boasts a gourmet restaurant, a full-service spa, fitness center, swimming pool, and more. The rooms are very spacious and range from 900 to 2018 sq-ft, with seven different floor plans to choose from. Each comes with professional-grade appliances, natural stone floors, granite and marble in the kitchen and bathrooms, as well as plasma screen televisions.

The “mini-mansion” that a friend and I recently stayed in was of the two-room, 2,000 sq-ft variety. It featured everything a comfortable, fully-stocked, modern house on the beach should have. The gourmet kitchen was equipped with a Wolf stove, fine dishes and silverware, a dishwasher, wooden dining table, granite bar and lots of counter space. Beyond the dining area, we found a contemporary living room with a large plasma TV, a sound system with DVD, surround sound and CD functions controlled the entertainment. A leather couch, bamboo coffee table and chair, indoor tree and classy lamps, rounded out the room. Looking out the living room, we found our favorite retreat - a large balcony overlooking the rocky Pismo Beach coastline. Connecting to the bedroom, the 20-ft.-long balcony, with table and chairs, was a great place to watch the sun fall and rise into the ocean. Our next favorite spot was the master bedroom, where we found another plasma television, a king-sized bed, a huge walk-in closet, and a

sliding glass door with still more magnificent ocean views. Other room highlights included an elegant master bathroom with reclined, Jacuzzi tub, and a spacious second bedroom, with full bathroom and walk-in glass shower; high-speed Internet; and an all-in-one, onepiece washer/dryer. When we were able

to drag ourselves from the room, we strolled over to the resort’s Lido Restaurant, where we sat on the patio and enjoyed coastal wine country cuisine and a memorable view of Pismo Beach. Our meal began with watermelon-mint gazpacho, with balsamic reduction and fried ginger and Seared Day Boat Scallops, candied bacon, herb

dried tomatoes and cayenne beurre blanc. For the main course we devoured wild Alaskan halibut, with coconut risotto, tomato confit, and crispy shallots; and a succulent grilled Colorado lamb TBone, with fennel polenta, bloomsdale spinach, mint and gremolata. After dinner we walked down stairs cut into the cliffs

and explored the tide pools below Dolphin Bay. We concluded the day with a swim in the pool and a soak in our in-room Jacuzzi tub. Dolphin Bay Resort and Spa is located at 2727 Shell Beach Road, Pismo Beach (about 3 hours drive from Pasadena). Two defendants sentenced for identity theft and conspiracy as part of scheme to file false income tax returns U.S. Attorney Karen L. Loeffler announced today that Jameane Bolton-Williams, 39, and Joe Murl Douglas, Jr., 54, both of California, have been sentenced in federal court by U.S. District Court Judge Timothy M. Burgess, as the result of their respective roles in a scheme to steal identities and file false tax returns. Bolton-Williams will serve 82 months in prison and pay restitution of at least $91,927.65, and Douglas will serve 57 months and pay restitution in the amount of $43,043.55. Bolton-Williams and Douglas conspired with two others to obtain identity information, such as names, dates of birth, and social security numbers, which were then used to prepare false IRS Forms W-2 that

contained fabricated wage and withholding amounts. The co-conspirators then took the identity information and falsified documents to tax return preparation services in Anchorage, Eagle River, and Palmer, Alaska, as well as in Los Angeles and Orange Counties, California, to have tax returns prepared and electronically submitted to the IRS. The false returns requested refunds totaling between $1,400 and $8,600 each. In many cases, the defendants applied for refund anticipation loans and had the fraudulently obtained tax refunds loaded onto reloadable stored value cards allowing them instant access to the money even if the IRS later rejected

the falsely filed returns. The fraudulently obtained tax refunds were used to purchase personal items, including a 2002 Mercedes E320 Sedan. Co-defendant Lucille Stansberry was previously sentenced by Judge Burgess to 36 months and one day in prison. She was also ordered to pay restitution in the amount of $48,619.95. The fourth co-defendant charged in the case, Demetrick Ruffin, remains a fugitive. This case was prosecuted by Assistant US Attorneys Retta-Rae Randall and Stephanie C. Courter. IRS Criminal Investigation investigated the case. Ms. Loeffler commends the IRS Criminal Investigation for the investigation leading to the convictions in this case.
