City of Glendale prevails in ‘Comfort Women’ lawsuit United States District Court Judge Percy Anderson recently dismissed a lawsuit against the City of Glendale, which sought the removal of a monument in Glendale’s Central Park that memorializes the more than 200,000 Dutch and Asian women who were coerced into sexual slavery by the Japanese Imperial Army between 1932 and 1945. The Lawsuit (Michiko Shiota Gingery, et al. v. City of Glendale, et al.) was filed against the City by Michiko Shiota Gingery, a Glendale resident and the so-called Global Alliance for Historical Truth (GAHT-US), a nonprofit corporation. cumbed. Not even a week into their North American invasion, the infectious fainting, frenzy, and fanaticism of Beatlemania that had incubated in Europe had already spread to L.A., the mecca of the recording industry. And rock and roll
André Birotte Jr. sworn in as United States District Judge for the central district of California United States Attorney André Birotte Jr. was sworn in as a federal district judge for the United States District Court, Central District of California. Judge Birotte was nominated by President Barack Obama on April 3, 2014. He was confirmed unanimously by the Senate on July 22, 2014, and received his commission on August 8, 2014. Judge Birotte will preside over matters in Los Angeles in the Court’s Western Division in Courtroom 790 of the Edward R. Roybal Federal Building and Courthouse.

L.A. River Inaugural Fly Fishing Derby Sept. 6 in search of Steelhead Trout The sport of fly fishing conjures up images of wild mountain streams far from civilization, but on Saturday, September 6th, the urban setting of the Los Angeles River will for the first time play host to professional and beginner anglers in the firstever Friends of the Los Angeles River “Off tha’ Hook” Fish Derby. “When I began carp fishing the L.A River four years ago, I never imagined that the fates would converge to give the city its first fishing derby in the 21st or any other century,” said Jim Burns, proprietor of the blog lariverflyfishing.com. “The sudden rush of events from its designation by the EPA as navigable to the Corps decision to seek $1 billion in funding makes the revival of this beautiful, lush waterway for fishing, boating and family recreation a forgone reality.” The establishment of the recreation zones along the Los Angeles River beginning in 2011 opened the river to uses that few would have previously associated with the 51-mile channel
and its concrete beds. Since then, summers along the river have seen visitors and neighbors hiking along the river or exploring it in kayaks. And fishing has been legal with the purchase of a state fishing license. In addition to celebrating the river’s availability for fishing, “Off tha’ Hook” will demonstrate stewardship for would be anglers, informing the public about the responsibility to clear all lines, hooks, and trash from the river and its environs. To attract interest from all levels of fishers, “Off tha’ Hook” will be held on one of two “free” days designated by the California Department of Fish and Wildlife, when licenses are not required. After an 8:30am press conference featuring the elected officials who made this happen, Flyfishing and Traditional Derbies will begin at 9 a.m. sharp. At 10 a.m. a “Family Fish” will begin for children with supervising adults. An awards ceremony will be held at 11 a.m. In addition to calling attention to the river’s recreational possibilities, the fishing
derby’s haul will help scientists understand the health of its riparian ecology. While fly fishing as a sport has long focused on catching trout in quiet hard-toreach settings, urban fly fishing has developed in recent years, with carp tournaments in Denver and Seattle. The Los Angeles River Fish Derby will be the most urban yet, in a city who until recently was more likely to think of its river as a concrete storm drain that a diverse wildlife habitat. “When people hear ‘fly fishing’ they probably don’t think of Atwater Village as the place to be,” said Karen Barnett, River Committee Chair of the Atwater Village Neighborhood Council. “But our community is a great place to live, to work and to play, and because ‘A River Runs Through It,’ that’s about to include the first annual L.A. River fishing derby. It was a kind of cultural exchange between the Arcadia musicians and the Italian audience. The young musicians performed in very old historical buildings which incited passion in the young “CEMALINOS” to play with their maximum effort!! The experience was amazing because it was like uniting Los Angeles with Italy. The Italian people were astonished of such an early age such a talent can be witnessed and to show the Italian people that as LA based youth musicians can play extremely well at a very young age! It was an experience that they will remember for the rest of their lives. The laughter, the dedication, the success, the fun, the hard work, all these elements when put together would best define the 2014 Italy concert tour and it would also best define CEMALA in general, because CEMALA is simply a special place for any artist because it is very rare to see an actual music school that nurtures talent to the point where there is no limit , because in CEMALA anything is possible. The director Magdolna Berezvai is willing to bring down the stars from the sky if that what it takes! Magdolna’s desire is to give something back to the students using
her talent, knowledge, has strong recall and loyalty amongst the wider community in a very broad demographic around the world lifelong learning opportunities. The program helps develop early their love for music and sustain their discipline for achievements in their personal and professional lives. These young musicians are very rare and this is why CEMALA will continue to grow and grow with no limits. Traveling from Rome to Florence to Venice was simply an experience both musically and spiritually, because for young musicians to get invited back to Italy is simply an experience. When the concert was over in each city the audience said “We want them back!! They felt honored and it was very nice to hear because the kids really did play absolutely fantastic which blew away the audience! From Arcadia to Rome to Florence to Venice! Long flight! But every second was enjoyed to the fullest which is the most important element in an artist’s life is to enjoy his/her craft to the maximum because it is passion that motivates an artist to perform. These young children understand this passion which is what makes them unique.

ference with the federal government’s Foreign Affairs Power. In response to the City’s motion to dismiss the case, the court ruled in the City’s favor. Preliminarily, the court ruled that the plaintiffs did not have “standing” to bring suit as they suffered no tangible harm from the City’s placement of the monument in the park. Substantively, the court ruled that the plaintiffs could not articulate a clear conflict between the City’s approval of the monument and the federal government’s policies regarding recognition of the plight of the Comfort Women. The court noted that, even according to the facts in the plaintiffs’ complaint, “Glendale’s placement of the statue is entirely consistent with the federal government’s foreign policy.”
The judge also dismissed the plaintiffs’ procedural claim as being outside federal jurisdiction. Michael Garcia, Glendale’s City Attorney, stated that, “The City Attorney’s Office and the attorneys from Sidley Austin LLP, the firm who provided pro bono legal services to assist the City’s litigation efforts, always believed that this lawsuit was without merit.” He stated, “We are pleased that the Court recognized our City Council’s right to make public pronouncements on matters important to our community.” Andrew Rawcliffe and Miah Yun of the Glendale City Attorney’s Office defended the City in the case, along with the Sidley Austin team of Bradley H. Ellis, Frank J. Broccolo, Christopher S. Munsey, and Laura L. Richardson.
OIR report on McDade shooting handed over to City of Pasadena – No word on content Pasadena city officials met with the Office of Independent Review Group last Friday for the purposes of receiving its report related to the officer-involved shooting of Mr. Kendrec McDade. The City currently has the report and is reviewing it. The city press release sent out states: “ As of today, no determination has been made if any of it can be disclosed to the public or press. Consistent with
our earlier statements, the City does plan to present the report’s recommendations, along with the Police Department’s responses, at an upcoming City Council Public Safety Committee meeting.” The City had requested that the OIRG provide an independent investigation and evaluation, with recommendations, about the thoroughness and objectivity of the Pasadena Police Department’s post-
shooting investigation; the officers’ training and, as a result, a review of the tactics they used, plus any other “lessons learned” from this event. The report’s recommendations are the key part of the report. Police Chief Phillip Sanchez stated, “The Pasadena Police Department requested the independent review by OIR Group and the OIR report recommendations will be taken very seriously.”

would write? That an upstart band of Liverpool lads would hypnotize a generation and redefine not only rock ‘n’ roll but also popular culture? That America would splinter from itself and emerge from its own revolutions of civil rights, women’s liberation and the Vietnam War as a nation not entirely recognizable? That John Lennon and George Harrison and Brian Epstein would not be with us reflecting those early years of the mid twentieth century. In 1964, as a foreign correspondent for the London Daily Express, I traveled with the Beatles on their first North American tour. I had unrestricted access to John, Paul, George and Ringo. I flew with them on their private jet, stayed in the block of hotel rooms booked for the entourage (usually an entire floor for security purposes), and crossed this great nation playing Monopoly and poker with the Beatles into the wee hours of the night. The tour began in San Francisco on August 18, and by the time it wrapped up thirty-four crazy days later in New York, “Beatlemania” had become part of the American vernacular. But the establishment hadn’t entirely bought in. L.A.’s Ambassador Hotel turned the Beatles down as guests, worried that the band would be more trouble than they were worth. So the boys rented in Bel Air. They reluctantly rubbed elbows with the Hollywood glitterati, but partied with a handful of celebs whom they really wanted to meet, including Burt Lancaster who entertained them at his home (Ringo was wowed by Burt’s indoor–outdoor swimming pool). The Beatles were unpretentious and great company, and looking back I sometimes can’t believe it all happened. John Schlesinger the late British film director once told me, “The trouble with living in California is that you go to bed when you are twentyfive—and when you wake up the next day you’re seventy-five.” And he was right because it all flashed by so alarmingly fast. From my perspective today, I would be disingenuous if I told you that in 1964 I fully grasped the

profundity of the history I was witnessing — indeed was living a part of. Back then the Beatles were just another pop group from England and communication was so much simpler: It was, after all, an era when John Lennon called people twits, and twitter was something only birds did. Their song lyrics were lollipop stuff — “puerile” — as one critic declared. They performed for less than half an hour — and then were gone. Not that you could hear much anyway over the din of non-stop shrieking. Even today — with half a century of context behind me — when I’m asked why the Beatles had such a massive impact I find no pat answers. From my front row seat during that summer of 1964, I watched a nation go absolutely bonkers to the same twelve-song set played at every concert. At the end of the tour, Ringo, who had matured markedly during those thirtyfour days, shone a beam of insight on the phenomenon when he observed that the fans didn’t come to hear the Beatles sing; they came simply to see the Beatles. It was more pilgrimage than cultural experience. Perhaps it is precisely
because the early Beatles tunes had little substance beyond snappy melodies or catchy lyrics that there might be wisdom in the notion that the music was simply a joyous release. The first Beatles singles hit American airwaves in the dark weeks after President Kennedy’s assassination. They released their final album, “Let It Be,” in May 1970, four days after Kent State. In between was — to put it simply — the sixties. Apollo and Soyuz. Race riots. The Voting Rights Act. The Tet Offensive and My Lai. The promise and tragedy of Martin Luther King. Another Kennedy assassination. Who could blame us for lapping up all their loving and wanting to hold their hands? Looking back from this end of the arc, there are a few things I do know. The Beatles laid the anthemic soundtrack to the dreams and fears and changes that were afoot during that pivotal period. And we are still celebrating them half a century later. Summer adventure in Big Bear Lake By Greg Aragon Big Bear Lake is a summer paradise. From hiking, mountain biking and rope climbing in the forest, to relaxing on the lake or in a charming, rustic cabin, the alpine area has got it all. A friend and I recently escaped to the 7,000-ft-high city for a day and night of adventure and discovery. Our getaway began at Creek Runners Lodge, where we checked into a romantic room with a full kitchen, a tub and shower, a comfy king bed and a huge, inviting Jacuzzi in the middle of the room. Located across from the lake and a 10 minute walk to downtown, the lodge is a great place to stay while exploring the area. And did I mention that our cabin had a big Jacuzzi in the living room? After unpacking and testing the spa tub, we took the Scenic Sky Chair at Snow Summit to the top of Big Bear mountain. This breathtaking, mile-long journey takes guests on ski lift
chairs up to an 8,200-ft oasis of hiking and mountain biking trails, while offering incredible aerial views of the San Bernardino National Forest and Big Bear Lake. At the top of the mountain, we enjoyed a homemade BBQ lunch of Alaskan salmon, an Angus hamburger, and salad on the outside deck at View Haus restaurant. We then hiked the Skyline Trail, which opened last year. Boasting awesome views of Mt. San Gorgonio and Big Bear Lake, this moderately difficult trek passes through pine and oak forests filled with wild life and rare plants. The trail is also popular with mountain bikers. In fact, Big Bear was put on the map in the 1990s as a mountain biking Mecca when it hosted national mountain bike races including National Off-Road Bicycle Association (NORBA) National Championship Series. Big Bear’s network of more than 100 miles of trails has been ridden by both professional riders and recreational weekend warriors who return for all levels of fun. Mountain bike enthusiasts appreciated the great selection of single track
trails. Cross country bikers also love the trails. One of the most popular is Skyline Ridge (2N10), which also passes through Snow Summit Ski Resort. After hiking we took the Scenic Sky Chair down the mountain and headed back to Creek Runners Lodge to rest before having dinner at The Himalayan (www.himalayanbigbear.com). Featuring authentic and delicious Indian and Nepalese food from Nepal and Tibet to the North of India, the restaurant
was packed with locals when we sat down by the window. Our meal was highlighted by Chicken Vindaloo with boneless chicken in a tasty Himalayan-styled sauce made from tomatoes, potatoes, onions, garlic, ginger, and lime juice; and lamb curry with boneless lamb in a succulent garlic, onion and ginger sauce. Back at Creek Runners Lodge we soaked in our inroom Jacuzzi and sipped champagne. In the morning we found the curious kid in-
side of ourselves and climbed a tree with Action Tree Rope Climbing Tours (ATRCT) (www.actiontreeropeclimbing.com). California legislature passes Asm. Holden’s bill to recognize President Obama in high school textbooks The California Legislature has given overwhelming, bi-partisan approval to Assemblymember Chris Holden’s bill to encourage California schools to teach the story of President Barack Obama’s trailblazing election. Today’s vote in the Assembly on concurrence in language changes was approved unanimously – 73 to 0. Last Thursday the Senate overwhelmingly approved AB 1912. The bill now goes to Governor Brown for signature.
AB 1912 asks the State Board of Education and the Instructional Quality Commission to include the significance of President Barack Obama’s election in the state’s history and social science standards for grades seven to twelve. “The election of President Barack Obama is a significant part of history and should not just be a mere footnote within textbooks,” said Assemblymember Holden. “This bill would create an opportunity for our children to learn about the historical significance of electing our first
African-American President. Children need to understand that for years intimidation and physical violence prevented millions of African Americans from voting and alienated them from the electoral process, making the 2008 election of President Obama even more noteworthy.” California has not updated its standards for nine years due largely to the state’s fiscal crisis. The State Board of Education is expected to review instructional materials during the 2015-2016 school year.
