Clarifying protections against retaliation in the workplace awaits Governor’s signature Assemblymember Roger Hernández announced AB 2751 passed the Assembly Floor on a 53-1 concurrence vote. This measure makes a number of clarifying and clean-up changes to AB 263 (Employment retaliation: immigration-related practices) signed into law last year. “Last year, with the passage of my bill AB 263 employers are prohibited from using immigration status against workers who exercise their rights under the California Labor Code or local ordinances. With the Fourth of July holiday on its way and summertime road trips on the minds of many California drivers, the California State Board of Equalization (BOE) announced today that starting July 1, 2014, the excise tax rate on gasoline will go down to $0.36 per gallon. The new rate of $0.36 – down from $0.395 – was reached after the Board voted unanimously at its February 2014 meeting to lower the rate for the 2014-2015 fiscal year, which ends June 30, 2015. While Californians will be paying less in state excise tax at the pump starting July 1, that doesn’t necessarily mean it will translate into lower gasoline prices. Other factors, such as world crude oil prices, also affect California’s gasoline prices. “I wish we could lower the excise tax rate on gasoline even more, and that it would result in a corresponding decrease in gas prices,” said BOE Chairman Jerome

Local educational agencies can now see the highly anticipated first official calculations of $42 billion in school funding they will receive under the Local Control Funding Formula (LCFF), State Superintendent of Public Instruction Tom Torlakson announced today. The calculations for school districts and charter schools are displayed in the traditional funding exhibits, plus a new “LCFF Funding Snapshot.” “California’s new funding formula puts more deci-

sions about education funding where they belong—in the hands of schools, parents, and teachers—and dedicates more resources to students most in need,” Torlakson said. “The information we are providing today will help administrators, teachers, and parents as they work together to help all students succeed.” The LCFF was enacted as part of the 2013 Budget Act and provides a new method of funding local educational agencies (LEAs). LEAs now receive

base funding for all students and additional funding if they serve students who are learning English, in foster care, or are low income. For most of this current year, LEAs have been receiving funds based on estimates by California Department of Education staff, while the state agency reprogrammed its systems and LEAs gathered and reported the data required to do the new LCFF calculations. Film and Television Job Creation Act passes final policy committee AB 1839, the California Film and Television Job Retention and Promotion Act of 2014, cleared a major legislative hurdle today, passing the Senate Governance and Finance Committee by a vote of 6-0. The legislation, authored by Assemblymen Raul Bocanegra (D-Pacoima) and Mike Gatto (D-Los Angeles), and co-authored by more than 65 other legislators, would expand and improve the state’s current program to keep production jobs in California. “I remember when our communities lost all the good aerospace jobs,” said Gatto. “Losing major employers really harms local families and our state economy. This effort is a rare example of government taking proactive steps to ensure well-paying jobs stay in our communities.” California’s film and television industry has faced increasing competition in recent years from subsidies by other states and countries. more pedestrian-friendly and sustainable community,” said Michael Nilsson, Senior Mobility Planner in the City’s Community Development Department (CDD). The Public Works Department will work closely with CDD to plan, design and construct the City’s first Green Street Demonstration project. It will consist of the installation of trees, bioswales within curb extensions and midblock crossings within the project area, focusing on improving water quality, pedestrian safety, and aesthetics in the area. One specific project proposed as part of the grant is an enlarged pedestrian crossing with a new landscaped parkway on the southern end of Harvard Street at Maryland Avenue. This

improvement will result in a shortened pedestrian crossing that will directly connect the proposed main entrance of the Central Library with the Marketplace Parking Garage, further enhancing improvements associated with Central Library’s renovation. The estimated cost of the demonstration project is approximately $2.9 million. Additional funding sources have been identified including $1.9 million in State of California Gas Tax Funds, which will be utilized to complete the project. It is anticipated that planning for the project will occur from late 2014 through mid-2015, with construction of the project to begin sometime in midlate 2015.

Also, the $10,000 civil penalty enacted in AB 263 is to be paid directly to the aggrieved worker who filed the claim. Last year, AB 263 was signed into law which allows a civil action by an employee or other person who is the subject of an unfair immigrationrelated practice, and would authorize a court to order a suspension of the business license for up to 14 days of a person who violates these provisions for a first violation, up

to 30 days for a second violation, and up to 90 days for a third or subsequent violation. This bill also protects against retaliatory practices such as an employer to e-verify a worker, or even re-verify the worker. Immigrant workers are more likely to experience wage and work hour law violations. Approximately 76 percent of immigrant workers worked off the clock without pay, while over 85 percent did not receive overtime pay. AB 2751 now heads to the Governor’s Desk to await his signature.

NASA sets new dates, media coverage for saucer-shaped test vehicle flight NASA's Low-Density Supersonic Decelerator (LDSD) project plans to fly its rocketpowered, saucer-shaped landing technology test vehicle into near-space from the U.S. Navy's Pacific Missile Range Facility (PMRF) on Kauai, Hawaii, later this week. NASA has identified five potential launch dates for the high-altitude balloon carrying the LDSD experiment: June 28, 29, 30, July 1 and 3. The launch window for Saturday, June 28 extends from 8:15 to 9:30 a.m. Hawaii Standard Time (11:15 a.m. to 12:30 p.m. PDT / 2:15 to 3:30 p.m. EDT). The test will be carried live via Ustream and simulcast on NASA Television. The vehicle originally was scheduled for its first test flight earlier in June, but unacceptable weather conditions prevented the launch. On launch attempt days, journalists are invited to PMRF to watch the liftoff and flight. Journalists who did not previously acquire base clearance but would like to attend the event must arrange access in advance by contacting the U.S. Navy's Pacific Missile

change thing was part of the new regime because we’re doing so many different things here, besides the speedway,” Stokes said. “Things like car shows, the X Games … yesterday, we had 200 people going to the stockcar school. And besides Saturday night races we have our advanced driving dynamics thing. It’s a street survival school.” And while NASCAR racing every Saturday night from April through October is still the center’s bread and butter, Stokes said there is another type of racing that brings fans out in droves. “We’re called the House of Drift,” he said. “There’s a big drift event every year. It sells the place out, 20,000 people. They kind of make a bunch of smoke and turn cars sideways. It’s an acquired taste, but it’s cool.” Stokes added he really can’t believe how big drifting is getting. And it’s really good for the center. “We have a deal where guys come out – we’re not training them – but they come out and do some practice and we had 850 pay 10 bucks a person and watch drift guys practice,” he said. “They can talk to them and (the drivers are) like heroes. Almost 20 cars came to practice.” He added weekly drag racing is also big at the center. “(Recently,) we had a couple hundred cars and a couple thousand people

watching,” he said. “It’s just amateur people who are having fun driving their cars an eighth of a mile – which is only 660 feet – against the lights.” While NASCAR races were not run during the 2012 season, Stokes said that was the lone aspect of the center that took a year off. “We never really closed,” he said. “There was a transitional period a few years ago when our former operators filed (for bankruptcy). The fella now who has the master lease on everything – whose name is Jim Cohan – had the driving school. “The day (of the bankruptcy) he went to the property owners and talked to them about keeping the driving school going. He had bookings he needed to keep … We did this in a partnership with the property owners and we had the drag strip. That never shut down.

Illegal fireworks include sky rockets, bottle rockets, roman candles, aerial shells, firecrackers and other types that explode, go into the air, or move on the ground in an uncontrollable manner. It is illegal to sell, transport, or use fireworks that do not carry the “Safe and Sane” seal, as well as possess or use any fireworks in a community where they are not permitted. If convicted, a violator could be fined up to $50,000 as well as sent to jail for up to one year. There are nearly 300 communities within California that allow “Safe and Sane” fireworks. “Every year CAL FIRE and fire departments across California respond to fireworks-related incidents that hurt people and cause dam-

age to property and natural resources, ” said State Fire Marshal Tonya Hoover, CAL FIRE – Office of the State Fire Marshal. “If you are going to use fireworks, check with your local fire department first to make sure they are allowed in your area. On June 18, 2014, the Upper San Gabriel Valley Municipal Water District and the San Gabriel Valley Water Company partnered together to present the Baldwin Park City Council with a $100,000 water efficiency grant for retrofit of the Barnes Park Splash Pad. Director Bryan Urias, representing Division 5 of Upper District, which includes the City of Baldwin Park, was joined by Dan Arrighi, Water Resources Manager for the San Gabriel Valley Water Company, for the joint check presentation to the city council. With this grant, the City of Baldwin Park will retrofit the existing spray pool at Barnes Park with a water recirculating system that will reduce the city’s water usage at the site. “Saving water is very critical, especially in times of drought,” stated Director Urias before the council. “We must do everything we can to reduce our overall consump-

tion of water so that we may weather these dry times and preserve the precious resources we have.” Construction of the project is currently underway and is expected to be completed in early August 2014. Once completed, the retrofit will allow the Barnes Park Splash Pad to operate as a more water efficient system. The new water efficient pump is anticipated to save approximately 25,000 gallons of water per day, which equates to an approximate city saving of $8,000 per year in water costs. Despite significantly less water being used each day, the Barnes Park Splash Pad will continue providing the residents and children of Baldwin Park with a fun and safe activity to enjoy the cool waters on hot summer days. The water efficient retrofit of the Barnes Park Spray Pool will serve as a model to the greater community showing that the

Student access to quality computer science education prevails Assemblyman Curt Hagman’s (R-Chino Hills) computer science education bill, Assembly Bill 1539, was unanimously passed by the Senate Education Committee, with a vote of 5-0. AB 1539 would encourage the Instructional Quality Commission of the Department of Education to develop content standards for teaching computer science in grades K-12 and recommend them to the State Board of Education for adoption by July 31, 2019. “I would like to thank

the members of the committee for their support of this measure,” stated Assemblyman Hagman. “Guaranteeing that computer science education is being taught throughout our schools is critical given the growth and influence of California’s technology sector. Currently, enrollment in computer science in California is extremely low, as is continued interest in the subject. Sierra Madre Civic Club participates in the Fourth of July Festivities With the Fourth of July fast approaching Sierra Madre’s Fourth of July Committee is finalizing plans for two days of festivities. The Sierra Madre Civic Club has again volunteered to coordinate the Fourth of July games. At 11:00 AM, following the parade, there will be a community picnic and celebration in Sierra Vista Park, 611 E Sierra Madre Blvd, Sierra Madre. The games will begin at 12:30PM. Participants will take part in everything from three-legged races, sack races, wheelbarrow races, and the bunny hop (for ages 6 and under) to the shoe toss, the egg (not hard-boiled!) toss and the water balloon toss. Chair Pat Alcorn emphasizes that the games are for the entire family since with the exception of the bunny hop, all the races and the shoe toss have different contests for participants in different age groups. Indeed, some of our fiercest competitors last year were the adults while the kids were the ones who laughed the

most. The egg toss and the water balloon toss are for competitors of all ages and, as the messiest of the contests, generally attract the most participants and elicit the most shouts and laughter. Ribbons will be awarded to the winners in all age groups, but really, everyone who participates comes away with a smile looking for all the world like a winner. In addition to coordinating the games in the Park, the Sierra Madre Civic Club will again be selling their famous (at least in Sierra Madre) confetti eggs- hollowed out egg shells, filled with confetti, and covered with tissue paper. Look for Club members in Memorial Park on July 3, pulling a little red wagon along the parade route on July 4, and in Sierra Vista Park at the community picnic and celebration. Rep. Schiff op-ed in the Advocate: Ride on in the fight against HIV and AIDS By Adam Schiff Published June 23, 2014 Life-changing, moving, inspiring – just some of the words that my constituents used to describe the AIDS/ LifeCycle ride when I announced that I would be a cyclist on the 545-mile bike ride down California’s coast. They were right, and then some. Let me tell you how this story began. I have the honor of representing a large LGBT community, and I had been to the Los Angeles LGBT Center and seen the amazing work it does every day. It is no exaggeration to say that the center not only improves the lives of my constituents but, in many cases, has saved those very lives. The ALC ride benefits the L.A. LGBT Center and the San Francisco AIDS Foundation. To some, this is a disease that is on the decline and is becoming less deadly — but the reality is much different. While dramatic improvements have been made in treatment and prevention, there are still more than 1.1 million people in the United States living with HIV, more than 30 million worldwide, and another 50,000 are diagnosed every year. While the quality of life and longevity of those with HIV have improved dramatically since the early days of the epidemic, the disease still compels our dedication to fight here and around the world. A little more than a year ago, Lorri Jean — the incredible executive director of the L.A. LGBT Center — invited me to speak at the closing ceremony of ALC, dedicated to the riderless bicycle. The riderless bicycle is a deeply moving and potent symbol for those that we’ve lost to AIDS, who can no longer take the ride. I remember reading the script and being touched so deeply: “As this riderless cycle passes you, please take the hands of those around you. As our connection builds, it symbolizes our strength not only to remember, but to come together to ensure that the lives we’ve lost are not lost in vain.” Afterward, as I talked with the riders and constituents who had participated, I remember thinking that if the legislative calendar ever allowed me to participate in the ride, I would love to do so.

As fate would have it, and much sooner than I expected, I discovered that this year’s ride coincided with a district work period without votes in Congress. So I signed up with only a few weeks to prepare. The ALC takes months of training, a good working relationship with your bike, and enough time to raise a respectable amount of money for a good cause — eradicating AIDS in our lifetime and supporting those living with HIV. I batted an impressive 0-3 on all counts. While I had done several triathlons over the last few years and was a regular biker, the races I had done were only Olympic distance — meaning the biking component was only 25 miles. On the ALC, we would be biking an average of 80 miles a day for seven days, and clocking over 108 on day 2 alone. I was seriously unprepared. On top of that, the bike that I rode during training for the ride never made it to San Francisco, so I would be setting out on this trek on a bike without even knowing how many gears it had. Nonetheless, I set off. What an adventure. From an early start at the Cow Palace in San Francisco, we made for the coast — almost 2,500 riders and a host of roadies who did everything from set up camp, haul gear, prepare food, and take care of medical needs to cheer and inspire us all the way. It was an extraordinary group and an incredible production. We road through hills and scenic valleys, along the coast to Half Moon Bay and on to Santa

Cruz, then it was off to farm country — Salinas and Atascadero — before returning to the coast of Ventura, down to Malibu and concluding in West Los Angeles. At night we camped on the beach, at county fairs or state campgrounds. We ate our meals together, compared injuries together, mourned accidents together, told “war stories” and off-key jokes. And we were inspired together, by the beauty of the state which we appreciated all the more because it came with each hard-earned revolution of our wheels, and by the grit and wit of our fellow riders and roadies. We were a traveling community, raising an impressive $15 million to fight HIV and AIDS, with many riders sporting bicycles adorned with laminated photos of lost loved ones. Last year, Lorri Jean told me the story of a mother who had disowned her son when he revealed to her that he had AIDS and was dying. That mother later came to recognize the tragic nature of that decision. That story, more than anything else, made me want to ride. His pain, dying alone and without her. Her pain, losing a son, and the agony of her regret. At the top of one of the last big hills of the ride, a simple sign said, “Your pain is tribute to their suffering.” To me, that said it all — let’s put an end to HIV and AIDS. Ride on. REP. More than 3 million students participate in trial run of modern computer-based tests to be in place next year Smarter Balanced Field Test has concluded, capping 12 weeks of test-driving new computer-based assessments that will be fully operational next year, State Superintendent of Public Instruction Tom Torlakson announced. More than 3.1 million California students—among four million nationwide—took part in the tryout of the new assessments. “Thanks to this trial run, California’s students and schools are headed into our new assessments next year with confidence about what they can expect,” Torlakson said. “The field test gave us an opportunity to measure the quality of test items, determine our technological readiness, and experience a whole new way of testing. Now we know that the system as a whole is in very strong shape, and we know where local challenges lie in time to address them.” Student responses from California, 20 other states, and the Virgin Islands will undergo a rigorous evaluation process to gauge the accuracy and fairness of the nearly 20,000 test questions before the Smarter Balanced assessment becomes operational in the spring of 2015. This is to ensure that the Common Core-aligned assessments are valid, reliable, and fair measurements of college- and career-readiness for all students. The Smarter Balanced Assessment Consortium (SBAC) is enlisting participants who will help determine achievement levels, also known as performance levels, for each grade and subject area through both an In-

Person Panel and an Online Panel. SBAC will convene approximately 500 educators from the member states to determine these levels. Like other member states, the California Department of Education (CDE) and California higher education segments have recruited California educators to be included in the SBAC In-Person Panel. The selected participants will be assigned to a specific segment depending on their content area expertise, experience, and/or grade levels taught. The Online Panel will allow for broad participation by parents, teachers, school and district administrators, college faculty and administrators, and business/community leaders. Participants must register prior to September 19 at the Online Panel for Achievement Level Setting Web page. In addition, the CDE will be distributing post-testing surveys and conducting focus groups to provide a look into local educational agencies’ experience with the testing systems, best practices, and perceptions of readiness for online testing in 2015. Various stakeholders will be included in the surveys and focus groups, including district and county testing and technology coordinators, teachers, parents, and students. Results will help determine what additional resources or assistance might be needed to prepare for future online testing. During this spring’s trial run, students in grades three through eight and most eleventh graders, plus a sampling of ninth and

tenth graders, completed tests in English-language arts and mathematics based on California’s Common Core standards. The new standards were adopted by California in 2010 to encourage critical thinking, complex problem solving, and deeper knowledge of subjects. Students also engaged in performance tasks, which were extended activities that measured their ability to integrate knowledge and skills across multiple standards—a key component of collegeand career-readiness. Each school had been assigned a six-week window during which students took the test that was estimated to take approximately 3.5 hours per student to complete. The test was administered over multiple sessions of 45-minutes each or in shorter or longer sessions as appropriate for the students and the school. No student, school, district, or statewide scores will be produced from this year’s assessment. Rather than a sampling of students, California tested all of its eligible students, resulting in the largest field test by far of any participating state in the nation. The state had sought and was subsequently granted a waiver by the federal government in March that allowed it to forego the usual state accountability assessments thus avoiding a “doubletesting” of its students. swap requires revenue neutrality, meaning motorists pay no more or less state tax on gasoline purchases than they would have paid prior to the swap. The new laws lowered the sales tax on gasoline to 2.25 percent and raised the excise tax by an amount projected to equal the sales tax that otherwise would have been collected under the old tax structure (see graphic at above for ex-

Do you foresee any potential problems? I appreciate the positive feedback. Let me reiterate the importance of keeping IRA beneficiary forms up to date. Many events may require beneficiary changes: retirement, marriage or divorce, new children or grandchildren, or converting to a Roth IRA. Beneficiary forms can get lost, forgotten or neglected over time. Also, longtime account holders sometimes make changes that effectively open new accounts with new account numbers. When no beneficiary form is located, the IRA may have to go through probate court.

Don’t rely on your financial institution’s recordkeeping; keep personal copies of all your financial documents. IRA owners should give their heirs copies of beneficiary forms ahead of time, because missing the RMD deadline for an inherited IRA imposes an onerous 50% penalty. Now, to address your question: The devil’s always in the details and I don’t know enough about your particular situation. Generally, your wife as your beneficiary has more flexibility when assuming control of your IRA. She can remain the beneficiary and easily access the account if she’s younger than 59 ½. Alternatively, she can rollover your IRA into her preexisting or newly created IRA and postpone mandatory distributions until she’s 70 ½. The rules remain the same as if this account were hers all along. She will pay a 10% penalty for withdrawing before 59 ½. When the beneficiary of an IRA is not a surviving spouse, a few new rules come into play. First, your granddaughter cannot rollover your IRA directly into her name. The IRA must be retitled to indicate that this is now an inherited IRA. If funds are moved into a new IRA account, your granddaughter must initiate a "trustee to trustee" transfer. Otherwise, the IRS will

consider the transfer as a total distribution subjected to full taxation and effectively ending the IRA. Non-spouse beneficiaries must begin taking distributions by Dec. 31 of the year after inheriting. However, your granddaughter can stretch the withdrawals across her own life expectancy. Smaller withdrawals taken over many years can allow the IRA's pretax value to increase and postpone taxable distributions. Finally, your wife can chose to disclaim your IRA as her inheritance. She has up to 9 months after your passing to do so. In this case, ownership would transfer to the contingent beneficiary - assumably your granddaughter. This option would postpone the need to make this important decision now. Your family could delay assessing the pros and cons affecting your IRA’s transfer (e.g. Generation Skipping Taxes) until the time comes. Kyle Hausmann-Stokes is a former U.S. Army Staff Sgt. who served five years in the Army’s Airborne Infantry and as a Squad Leader and Convoy Commander during a yearlong combat tour in Iraq. Hausmann-Stokes was awarded the Bronze Star for his actions under fire. “I am proud to honor Kyle Hausmann-Stokes for his heroic deeds in combat and his continuing efforts to aid his fellow soldiers who are struggling to adjust following their return from combat,”
