Looking Forward As I step into my new role as your 2019 BATC-Housing First Minnesota president, I’m looking forward to expanding the success of our advocacy efforts to more key constituents, elected officials, regulatory agencies and local government.
IS THERE A HOUSING AFFORDABILITY CHALLENGE?
WHY IS IT SO EXPENSIVE TO BUILD IN MINNESOTA?
There are multiple data points that make this claim undeniable.
Our association’s Housing Affordability Institute is about to unveil powerful, groundbreaking research that dives deeply into the cost drivers. This is landmark work that has never been done before — not only here, but anywhere in the country.
The delta between newly built homes and resale homes in the Twin Cities is in the top five in the entire country. The mix of homes being built in the more affordable space is far smaller in the Twin Cities than it is in many similar Midwest markets such as St. Louis and Nashville. Nearly 80 percent of Americans believe they can’t afford more than 50 percent of the homes in their neighborhood. We have not recovered housing production to levels that are necessary since the Great Recession, even as employment has soared, real wages have begun to rise and consumer confidence is strong. It costs 26 percent more to build an identical house in Minnesota versus just across the border in Wisconsin. Hardly a day passes in which the issue of housing affordability isn’t mentioned. It’s in the headlines everywhere. Gov. Mark Dayton’s Housing Task Force came to the same conclusion and offered two key solutions, among others. 1
First, we need to build 300,000 more homes in the next 10 years — that’s 30,000 homes per year.
2 Second, we need to look comprehensively at the regulations impacting our industry to make homebuilding easier.
solving with key stakeholders, with the goal of reducing the regulatory cost of housing and increasing production.
This research will create an easy-to-understand dashboard that highlights the key drivers of cost. And it will redefine and standardize the way in which we talk about housing inputs. We believe strongly that shining a light on this little-studied area and creating greater transparency will drive better decisions around affordability. Why is this so vital? Well, if we can’t effectively address the challenge of home affordability, I’m truly fearful that our children and future generations won’t be able to achieve the American dream. And we know that homeownership brings tremendous benefits to communities — better engagement, better educational outcomes, better health and creation of wealth.
This is difficult, painstaking work. Excessive regulations, long drawn out entitlement processes, and various impact fees are hidden in the cost of a lot and a home making them difficult for policy makers and the general public to understand. These costs are also difficult for our members to grasp due to a highly complex tangled web of regulations and fees that are far from being transparent. But if we can’t bring the cost of newly built housing down, we’ll prevent this next generation from enjoying the dream of and benefits of homeownership. So take an active role in sharing the research as its released. Get engaged in the association by coming to Housing Day at the Capitol on March 4 where we will share our data and conclusions with lawmakers. Take a look at the research in detail on LetsFixItMN.org and join with us.

That’s why BATC-Housing First Minnesota is launching a powerful issue advocacy campaign to share the results of this research to lawmakers, city council members, mayors, regulators and the general public. We recognize that the building community must work collaboratively with state and local governments to find solutions that allow our members to build affordable homes. REMODELING CONUNDRUM: WHEN THE ORDER MATTERS

THE “CLIFF” Is it possible to upgrade a home in such a way that the renovation might push it over the cliff? The “cliff” is a metaphor for what might happen if a house is moved too close to the cliff, where it might become unstable and fall. This “failure” could refer to an efficiency, durability, indoor environmental quality, or health and safety problem. The effect of any proposed change is twofold. First, homeowners must consider the type of change they are making. If they are simply changing light bulbs,
the change is unlikely to significantly affect how the house system is performing. On the other hand, if homeowners add insulation or a large range hood, the change could result in significant consequences. Second, homeowners must consider the robustness of the current house. Some houses are so stable that even large blows to the system will be absorbed. Other houses are much more fragile, however, and small changes can have a larger effect and move the house more quickly toward the cliff.
MOVING FORWARD WITH OUR EXISTING HOMES How can we take lessons learned over the decades in new construction and apply them to the decision-making process for upgrading our existing housing stock? A good example is the current U.S. Department of Energy Building America program for existing homes, which focuses on reducing energy use by 30 percent by accelerating the adoption of high-performance technologies using a systems engineering and integrated design approach. It is inclusive of a “do no harm” promise to ensure that safety, health, and durability are maintained or improved. The following three overarching strategies that could be employed are built upon the lessons of the past and should mitigate undesirable consequences.

CONCLUSION
FOLLOW THE PROPER (OR SAFE) ORDER The first strategy simply follows a sequence that is unlikely to cause unintended consequences. If combustion backdrafting and spillage are properly addressed (ie. sealed combustion), subsequent changes in ventilation or airtightness will be accommodated. If they install whole-home ventilation, there should be little concern for future air-sealing of the building enclosure. If they properly implement water management and air sealing, adding insulation will be of little risk.
TEST IN AND TEST OUT What happens if the above order is highly impractical or prohibitively expensive? A second strategy that is widely promoted today uses testing to determine the current condition of the house and how fragile it might be. That information can be used to better inform and guide the work being contemplated. After the work is concluded, testing is repeated to ensure proper performance of the house and its systems. This approach should reduce unforeseen consequences and leave the home in a better place than where it started.
COMBINED SYSTEMS-GUIDED APPROACH The last strategy focuses on the type of work being proposed and its probability of negatively affecting the performance of the house. In essence, it is a blend of the first two strategies. If the upgrade is unlikely to cause issues with the current house systems, it is given a green light to move forward without testing. Items like changing to more efficient light bulbs, upgrading to a more efficient refrigerator, or using a programmable thermostat can improve efficiency and have potential system interactions, yet, they are highly unlikely to push a house over the cliff. Other items such as adding insulation, installing a new furnace, or implementing whole-house air sealing, however, have large system interactions and have the potential for major changes in house durability, indoor air quality, and combustion safety. These proposed changes would get a red light to encourage homeowner and contractors to “stop, look, and listen” to see if the house could be pushed over the cliff with any of these changes. Of course, some measures will always fall in between or perhaps very robust houses are unlikely to be moved very far. These would get a yellow light, requiring due caution throughout the process and perhaps a quick or abbreviated test at the completion of the work to ensure the home is left in a safe condition.
We can, and must, do better this time around. There is simply no reason for the remodeling, renovation, and home improvement industries to repeat the mistakes of the past. While recognizing the clear challenges and limitations with remodeling, retrofitting, and installing energy upgrades, the basics principles and processes still apply. These lessons and their application, however, may need to be brought to the market by a whole new set of contractors. Those who set out to improve the performance of our existing housing stock must incorporate these lessons and solutions into their daily procedures and practices.

New Year, New Biennium, New Governor, New House As the legislature gavels in to begin a new legislative biennium, many issues are on the docket waiting to be addressed. Housing affordability is poised to be one of the key issues.

The challenge of addressing housing by state lawmakers will be met by a new legislative landscape following the 2018 elections. Atop state government will be former Congressman Tim Walz who was elected governor. He will be joined by the legislature who make up the only split body in the country. The Minnesota House flipped majority control to the DFL, while the Senate majority remains with Republicans.
The legislature convened on Jan. 8 and has until May 20 to finish its work.
The hard work of addressing the cost drivers impacting housing affordability now enters a new phase. As the leading voice for homebuilding and remodeling, BATC-Housing First Minnesota is pleased to see other stakeholders ready to join us in addressing this critical challenge facing all Minnesotans. “The new legislature and Gov. 2018 Elections Elevate Housing BATC-Housing First Minnesota elevated the housing industry during the 2018 elections, which concluded with dozens of housing champions elected to local and state offices throughout Minnesota.
the political landscape in Minnesota. Democrats gained control of the Minnesota House, while the Minnesota Senate remained under Republican control by one vote. Congressman Tim Walz was elected governor.

REGULATORY ADVOCACY
Plumbing Code The Minnesota Board of Plumbing began reviewing changes to the Uniform Plumbing code in October. BATC-Housing First Minnesota submitted a proposal to remove the dishwasher air gap requirement in December. The Board of Plumbing’s Ad Hoc Rulemaking Committee will continue its work throughout the first quarter of 2019.
Energy Code When the Minnesota Department of Labor & Industry’s Construction Code Advisory Council met in 2018, it decided to delay recommending any action on a new energy code until after the United State Department of Energy has analyzed the 2018 International Energy Conservation Code. BATC-Housing First Minnesota has been in constant contact with DLI and no review has been published. Additionally, BATC-Housing First Minnesota’s regulatory affairs manager sent a memo to DLI in October outlining how energy efficient Minnesota’s new homes are and how a costlier energy code is not needed. BATC-Housing First Minnesota is also in the final stages of preparing its own performance path for the Minnesota Energy Code, fulfilling its pledge to DLI that it would place affordability at the forefront the state should not adopt a costlier energy code.

Harstad v. Woodbury Update: Industry and Cities Respond The unanimous ruling in the Harstad v. Woodbury case has caused some cities to reexamine how they fund infrastructure, but it did little to change the options left to cities, as cities never had the authority to collect those fees. With the ruling, cities can still levy an area-wide assessment, pay for projects out of the city’s budget, bond for projects or deny projects. Immediately following the court’s decision, BATC-Housing First Minnesota sent a letter out to the state’s top 25 growth cities, to see which cities had previously relied on impact fees to fund infrastructure and how cities that had used impact fees planned to proceed following the ruling. The majority of cities responding to the request had either not used impact

fees or had ceased using them due to the court case, with no intention to reconfigure their fees to recoup revenue not allowed under Minnesota law. The city of Dayton, a city that had relied on impact fees, enacted a year-long development moratorium on Sept. 26, 2018. Under the moratorium, no new developments can proceed forward in Dayton unless preliminary plat was approved by the city council prior to the moratorium. As of printing of this issue, the city of Dayton’s one-year development moratorium has not been lifted. The city of Woodbury has begun requiring new traffic studies on proposed development following the court’s decision.

Research on Affordability
Following the landmark Harstad v. Woodbury ruling, the city of Dayton voted unanimously to enact a one-year development moratorium on Sept. 26, 2018, the longest allowed by state law.
The Housing Affordability Institute, a non-profit housing policy research entity formed by BATC-Housing First Minnesota in 2018, has been working with cities for the past several months to better understand how much of a home’s final prices emanates from local government. BATC-Housing First Minnesota’s research team has requested data and met with several high-growth cities to better understand how these cities fund growth.
Nick Erickson, BATC-Housing First Minnesota’s regulatory affairs manager, attended the meeting to speak in opposition to the mortarium, which stops any new developments-residential or commercial-from coming online until the moratorium is lifted.

As a residential roofing contractor I have heard recently that some of the asphalt shingles sold in the marketplace do not meet the Minnesota code for wind resistance. What should we be looking for on the shingle package or in the manufacturer’s installation instructions?
Q
The Minnesota Residential Code, in IRC Section R905, addresses these requirements. Shingles in Minnesota are required to be rated for 3-Second Gust Winds at 90 mph. If the shingles were tested based on ASTM Standard D 7158, then the shingles are to be rated as Class D, G or H. If the shingles were tested based on ASTM D 3161, then the shingles are to be rated as Class A, D or F. The wind rating needs to be on the shingle package and in many cases the manufacturer only notes the warranty wind rating which may have nothing to do with the requirements in the code.
I have a 100-year-old brick house that has a limestone basement wall. The wood floor joists for the first floor sit on top of the limestone itself with no rim joist. The limestone foundation goes up probably 12” to 24" above grade level and huge amounts of cold air are leaking into the house between the floor joists.
Q
What can I do to insulate between the joists in my foundation? How does one prevent heat loss by insulating a leaky limestone foundation in Minnesota while making sure the joists do not rot? First, your inquiry addresses best practices, building science and building codes. From a building code standpoint, that being that it is an existing structure, there are no building codes or energy codes that require this house to be updated to meet any current code. If you choose to install insulation, then the building code may address some of the products related
to flame spread index and smoke-development when foam plastic insulation products are used, along with thermal barrier fire-separation from the interior space. Before you consider investing in any possible solutions to your inquiry, I would suggest that you look into having a building science/energy professional analyze your house, which may include blower-door testing or infrared evaluation. The results of this analysis might include recommendations for the installation of an exterior water-resistive barrier and/or insulation designed for exterior use including groundcontact. It might even include the use of a closedcell spray foam insulation (high-density). Other recommendations may include the installation of a cement-based plaster/diamond mesh on the exterior extending below grade along with an application of an appropriate water-proofing material that would most likely seal up the exterior to reduce air movement toward the top of the limestone wall. It is very important to prevent the infiltration of exterior surface-borne moisture (rain and snow) as a step in the right direction to drying out the inside of the basement. The top of the limestone wall on the interior side could be insulated with an open- or closed-cell spray foam that would serve as an insulator and air sealer. Fiberglass insulation is an excellent insulating material but it is not considered an air-sealing material and it appears that the top of your limestone wall may be a source of free air-movement. If the basement floor is gravel or dirt, the installation of a new concrete floor poured on top of a 6-mil poly vapor retarder may prevent additional moisture from entering from below. If the basement floor is currently a concrete slab than additional measures to seal all penetrations (plumbing penetrations, etc.) and the perimeter where the concrete slab meets the limestone basement wall could be taken as a means to prevent more moisture penetration from below.

A BIG
NIGHT TO REMEMBER Nearly 900 members gathered for the annual Building Industry Gala For five years, BATC-Housing First Minnesota has hosted the Building Industry Gala (BIG Night) as an evening to honor the best projects and companies of the year while celebrating the entire housing industry. “I think we’ve really positioned ourselves as an industry celebration, not just an awards event,” said Nicole Coon, meeting and event manager at BATC-Housing First Minnesota. “The awards are obviously such an important part of it, but it’s also an opportunity to get the industry together and share camaraderie while celebrating the successes of the year.” Before the BIG Night, there were separate events for the Reggie Awards and Remodeler of Merit Awards (ROMAs). In 2014, all the awards were brought together in one culminating event, the BIG Night. Half a decade later, the event has grown substantially, with nearly 900 BATC-Housing First Minnesota members attending the 2018 BIG Night at the new Mystic Lake Center. The evening started with drinks,

food and networking before leading into the presentation of more than 150 awards. Jerry Decker, sales at Brushmasters, chairs the BIG Night committee and is encouraged by the increasing number of members getting involved each year. “The excitement for me has been watching this event grow the past few years and seeing so many of the members participating,” explains Decker. “When you see builders and associates coming together with this kind of volume to honor the best of the best in our industry, it shows the value that they see in the event and the opportunity they have to have a good time.” The BIG Night committee helps plan the event and provides member insight to help guide the details. Every aspect of the night is considered — from the venue to the menu to the music and everything in between. And although the committee influences the decisions, they’re really driven by feedback from all the members.

TRILLIUMS “The BIG Night committee does review and take into consideration all of the survey responses we get back, and we use that info in planning the following year,” says Decker. “So we always appreciate members taking those few minutes to complete the surveys after the event.” WCCO’s Jason DeRusha was back again this year to emcee the awards portion of the event. A crowd favorite, this was his fourth year emceeing. “Everyone loves having Jason emcee,” says Coon. “He’s a great personality that everyone can recognize and relate to. Plus, he’s super quick on his feet and understands the housing industry. He just gets us.” By the end of the night, 189 awards were handed out including 16 ROMAs, 22 Reggies, and 137 Trillium Awards. “The night is what it is because of our members,” adds Coon. “Members generously volunteer their time on the committee to really bring the evening to that next level, and then everyone that enters the awards and attends the event brings their positive energy to make it a night to remember.”

Housing Industry Gives to the Max On Nov. 15, 2018, supporters of the BATC-Housing First Minnesota Foundation rallied together for Give to the Max Day and donated $7,000 to help build, remodel and renovate transitional housing for those experiencing homelessness in Minnesota. Every donation made during Give to the Max Day went twice as far thanks to the Lennar Foundation. They generously matched donations for the BATC-Housing First Minnesota Foundation and the Minnesota Assistance Council for Veterans, up to $15,000.

A Home For Our Heroes After months of work, the BATC-Housing First Minnesota Foundation/HomeAid Twin Cities and Lennar completed a brand-new home in Maplewood, MN for the Minnesota Assistance Council for Veterans (MACV). This five-bedroom home is providing transitional housing services to homeless women veterans, a population of the community that is in growing need of services. “This project leveraged the resources and partnership of an anonymous private donor, a REALTOR®, two foundations, a national builder, and nonprofit service organization to provide transitional housing specifically for Minnesota homeless women veterans,” said Donnie Brown, manager of the BATC-Housing First Minnesota Foundation. “As a foundation, we are pleased to know that this partnership will make a difference in the lives of those who need it most every day and for years to come.” The project is a shining example of the generosity of the housing industry. So many companies and organizations came together

to donate time, talent and resources. The land for this project was contributed by an anonymous donor to the Minneapolis Area Association of REALTORS® Foundation who then transferred the lot to the BATC-Housing First Minnesota Foundation. Lennar worked with numerous trade partners that were eager to help those who have served our country. “As we reached out to our trade partners and those associated with this project, I can’t express to you enough their willingness to contribute to such a worthy cause and make a difference,” said Bill Burgess, president of Lennar Minnesota, at the ribboncutting ceremony. This home will provide a safe environment for homeless women veterans and sets the groundwork as they take steps toward housing stability. While in the home, residents work with MACV case managers to overcome their housing, employment and legal barriers. This critical program gives homeless veterans the support and confidence to find success once again.

A GROWING NEED The number of homeless women veterans in Minnesota is increasing, according to MACV. But, that doesn’t dishearten the organization. In fact, it motivates them. That means word is getting out that there is an organization to help, and with the completion of this home, even more homeless veteran women will have a safe place to call home. “The number today is at 20. There are five bedrooms in this house,” said Jon Lovald, chief operating officer for MACV, at the ribbon-cutting ceremony. “You do the math, we’re taking that down by a quarter.”

Our sympathies to the family of Ken Reinhardt, past president and housing industry enthusiast. Ken passed away peacefully on Oct. 28. He was an avid Vikings fan and loved boating and gardening. Ken loved his business to the fullest and will be dearly missed by all who knew him.
Our hearts go out to Mary Schweich, executive admin for BATC-Housing First Minnesota, who’s sister Pam Peine died peacefully on Oct. 23 following a 15-month battle with cancer. Pam is the youngest of seven. She will always be remembered for her dedicated love to her husband and sons, her selfless acts of kindness, and loyalty to her friends.

Nicolle will be working to secure strategic partnerships and looks forward to establishing relationships that benefit our members and the industry. Previously, Nicolle worked for Wells Fargo Home Mortgage, supporting the company’s relocation program. She brings a blend of business development, organizational leadership and communications experience to BATCHousing First Minnesota. Nicolle enjoys traveling, reading, and being active outdoors. She still considers herself a “Scony” even though she has had a MN driver’s license for over 10 years. She loves being a homeowner and is excited to be a part of BATC-Housing First Minnesota.

She will be coordinating Contractor University courses, Artisan Home Tour staffing, as well as numerous other projects. Her diverse professional background has seen her working in television, radio, consumer, events, social media, promotions, theater, destination management, and human resources and administration. Most recently, she was using her multitasking skills to care for her twins that recently turned three. Professionally, Mary Beth was last working for metroConnections in transportation and administrative roles, as well as taking volunteer positions with Minnesota Valley Mothers of Multiples. Along with her twins, Mary Beth resides in Savage with her husband Jason. She enjoys reading, spending time with friends and family, and quiet time.

Our 2019-21 association strategic plan is nearly complete. This plan is powered by a diverse, forward-thinking group of our volunteer leaders who came together for our planning retreat in early December. You’ve probably seen quotes from industry experts telling us more has changed in the past 10 years in housing and building than in the previous 50. And what’s stunning is that experts predict that rate of change to accelerate. In short, we’ll see even faster and more disruptive change in the next 10 years than we’ve seen in 60 years for our industry. Recognizing this, our industry leadership gathered to set a course for BATC-Housing First Minnesota for next three years. Here are five key things to look for from your association:

POWERFUL, SOPHISTICATED AND INNOVATIVE MARKETING OF NEW AND REMODELED HOMES. We have tremendous plans for the Parade of Homes event, magazine, website, and our consumer marketing. Technology continues to advance and our team will continue to bring newer technologies into our tour. Watch for an exciting refresh of our Parade of Homes magazine and the launch of several new consumer products into the marketplace. We think you’ll be very pleased.
NEW FEATURES FOR THE BRS TRADE SHOW. We’ve reintroduced dinner for all attendees and we’re spreading the spread. Dinner and desserts will be located across the show floor, driving traffic throughout the aisles. We’re also launching a new youth-build activity in the back of the show floor with Skills USA, which will bring the workforce development efforts to the fore and add energy to our show floor.
GREEN PATH DESIGNATED BUILDER. Green Path has now produced more than 15,000 Home Performance Reports and nearly 70 percent of the homes on the Parade of Homes are Green Path tested. Obviously, interest in our Green Path program continues to grow. Now, our committee is preparing to launch the Green Path Designated Builder program in early 2019. For those builders who commit to having at least 75 percent of their homes energy tested and pursue some continuing education, we’ll honor them as Green Path Designated Builders.
