A Year of Progress We’ve arrived at the month of June and it’s been a very busy and productive first half of the year. I wanted to give you a progress report on our activity for the year.

DAVID SIEGEL :: EXECUTIVE DIRECTOR BATC-HOUSING FIRST MINNESOTA

ADVO CACY Our advocacy program continues to strengthen as we strive to make our industry as vital in government and politics as we are to Minnesota’s economy. For any organization to be best in class with its advocacy efforts, we see five major areas of activity that create a modern comprehensive advocacy program. Here’s a quick update on each of these areas: REGULATORY ADVOCACY Wow, what a busy first half of the year. We’ve been deeply involved with the Minnesota Department of Labor and Industry as it has reviewed the 2018 codes — energy code, building code and more. Through the work of BATC-Housing First Minnesota, we’re pleased to report that the new codes will have a nominal impact on cost. In fact, the DLI has taken our recommendation not to adopt an energy code for 2018 given the dramatic cost drivers that appeared in the previous energy code. We’ve also been heavily involved in the Construction Stormwater Permit, putting forward reforms that make the permit process less onerous and pushing against unreasonable cost impacts. Again, we’ve had outstanding success in ensuring that Minnesota’s new home buyers don’t face additional costs driven by this regulation. LEGAL ADVOCACY BATC-Housing First Minnesota joined with Rochester developer Frank Kottschade and NAHB in filing an amicus brief in support of the Harstad v. Woodbury case before the Minnesota Supreme Court. This landmark case regarding roadway impact fees will have a significant bearing on costs to develop land, which ultimately affects home prices for buyers.

In addition to the Harstad case, we’ve formed the Housing Affordability Institute, a nonprofit 501(c)(3), which will tackle other important legal cases on behalf of affordability in the future, and produce industry-leading research on homeownership and the cost drivers behind our growing affordability challenge. ELECTORAL ADVOCACY BATC-Housing First Minnesota vetted all candidates for governor, Democrats and Republicans. In total, 11 candidates engaged in housing-focused discussions.

Our industry-wide newspaper, Housing Industry News, which reaches every building official, every legislator, every mayor, all licensed contractors and key associates is a great example of issue advocacy. We’ve just completed our first full year of publication (four issues) and the response is outstanding.

We’ve also begun to identify key Minnesota House races and local council and mayoral races throughout Minnesota so that we can direct our Housing First electoral dollars toward candidates who understand and support our industry. As always, our goal is to elevate housing and homeownership to create a better environment for our builders and remodelers to provide safe, durable homes for Minnesota families at a price they can afford in communities they love. LEGISLATIVE ADVOCACY We enjoyed success in this arena as well. Our bill seeking legislative review of any code impacting homeowners over $1,000 was heard in multiple committees and made it deep into the legislative process. It undeniably elevated the

ISSUE ADVOCACY This is an area that perhaps is confusing to many. Issue advocacy involves making the public and influencers aware of the key issues facing our industry. Think of it broadly as a public awareness campaign running all year for multiple years highlighting the significance of building and remodeling to Minnesota’s economy. We engage in issue advocacy year-round, through social media, media relations, paid advertising and a variety of other channels.

DAY AT THE CAPITOL We also enjoyed a tremendous Housing Day at the Capitol in conjunction with the Minnesota Association of REALTORS. Nearly 400 were on hand covering well over two-thirds of the Legislature talking about the importance of homeownership to our Minnesota legislators. This is one of the largest days at the capitol annually and we look forward to another great day in 2019, especially significant because we’ll have a new governor and many new legislators in the Minnesota House of Representatives.

Legislature Adjourns: Session Rounds Out Successful Biennium for Housing Following a historic 2017 session for housing, BATC-Housing First Minnesota entered the 2018 session poised to continue the housing affordability discussion in St. Paul. Housing First Minnesota worked throughout the session to defend the industry against harmful proposed legislation and proposed two initiatives that would positively impact housing.

Affordability Leads Building Code Report The Minnesota Department of Labor and Industry (DLI) released its initial building code recommendations on May 15, and the report includes major affordability recommendations from BATC-Housing First Minnesota. From January through March, 10 Technical Advisory Groups (TAGs) comprised of subject matter experts carefully reviewed the 2015 and 2018 model code changes and considered proposed amendments to be incorporated into Minnesotaâ€™s building codes. During the TAG meetings and in written comments, BATC-Housing First Minnesota advocated for affordability in the code process. The report includes several key victories for the housing industry on which BATCHousing First Minnesota led the charge, including defeating an attempt to mandate sprinklers in all new homes and BATC-Housing First Minnesotaâ€™s recommendation not to adopt a costlier and more restrictive energy code. BATC-Housing First Minnesota praised the report in its comments to DLI, and staff will be at the June 21 Construction Codes Advisory Council meeting reviewing the report, supporting our message of affordability. DLI expects the new building codes to take effect in March 2020.

BATC-Housing First Minnesota Input Leads to Improved Stormwater Permit The Minnesota Pollution Control Agency (MPCA) released the draft 2018 Construction Stormwater Permit in April, and incorporated BATCHousing First Minnesota’s suggestions into the draft. The new permit will have a slight increase in construction costs, slightly more than $300 per home, with much of the price increase due to changes at the federal level. The current permit, by comparison, increased construction costs by more than $3,500 per home when it went into effect in 2013. The 2018 permit has been completely rewritten and reformatted and includes BATC-Housing First Minnesota’s suggestion from April 2017 to change the repair timeframe to three days (or before the next rain event). Amending the Stormwater Pollution Prevention Plan to include cost-saving best management practices providing the same protections has also been made easier in the 2018 Permit. While the initial draft was a victory for housing affordability, it also broadened the MPCA’s enforcement powers. BATC-Housing First Minnesota, in its written comments to the MPCA and in conversations with MPCA staff, requested the 2018 Permit retain the existing enforcement language The final 2018 Construction Stormwater Permit will be released this summer before taking effect on Aug. 1.

Governor’s Housing Affordability Task Force Nears Completion Since January, Gov. Mark Dayton’s Task Force on Housing has been working to discuss various solutions to Minnesota’s growing housing affordability crisis. BATC-Housing First Minnesota has attended all the general sessions of the task force and meetings of the Homeownership Workgroup. Answering the task force’s call for

ideas, BATC-Housing First Minnesota submitted a report, “Solutions to the High Cost of Housing,” which pointed to regulatory reform, increasing the construction workforce through Project Build Minnesota, and waiving local fees for affordable housing projects as ways to increase housing affordability. The task force report will be released in July.

MnDOT Spring Load Restrictions This year’s unusual spring caused headaches for builders and developers once MnDOT’s spring load restrictions went into effect in the Twin Cities on March 5. BATC-Housing First Minnesota’s advocacy team was in contact with MnDOT, closely monitoring when the department would lift restrictions. MnDOT’s Spring Load Restrictions for the Twin Cities area ended on May 1.

Harstad v. Woodbury Case Heard By Minnesota Supreme Court BATC-Housing First Minnesota member Marty Harstad’s suit against Woodbury’s traffic fees was heard by the Minnesota Supreme Court on May 8. Members Jason McCarty and Tony Weiner joined the BATC-Housing First Minnesota advocacy team in attending the oral arguments. Harstad v. Woodbury is the most important land use case to come before the court in the past two decades. A victory for Harstad would reaffirm cities’ limited taxing authority and prohibit cities from forcing builders and developers to consent to unauthorized fees as a condition of project approval. BATC-Housing First Minnesota, the National Association of Home Builders and member Frank Kottschade of Rochester filed an amicus brief in favor support Harstad. The Supreme Court’s decision will be released later this summer.

BATC-Housing First Minnesota Launches the Housing Affordability Institute At its May meeting, the BATCHousing First Minnesota executive board voted to incorporate the Housing Affordability Institute (formerly the organization’s Legal Defense Fund) as a separate entity. Led by Steering Committee Chair Jason McCarty, the Housing Affordability Institute has also applied for 501(c)(3) non-profit status from the IRS. The mission of the organization is to examine and propose solutions to the burdens government places on homebuyers and the housing industry.

Local Spring Load Restrictions As members were concerned with MnDOT’s spring load restrictions and their effect on construction, BATCHousing First Minnesota staff reached out to local government entities across the Twin Cities and Minnesota to ensure that no additional local restrictions would be put in place after MnDOT lifted restrictions. Of the 25 cities and counties contacted by BATC-Housing First Minnesota, none planned to keep restrictions in place after MnDOT’s lifted the regional restrictions.

BATC-Housing First Minnesota Stops Turn Lane Fee in Scott County In addition to BATC-Housing First Minnesota’s work against turn lane fees at the Legislature, BATC-Housing First Minnesota staff discussed the issue with a township board supervisor, county and township staff, and the developer pushing for the change. Spring Lake Township in Scott County was seeking the creation of mandatory turn lane fees, to be paid for by homebuyers and developers. Throughout our conversations, BATCHousing First Minnesota illustrated that other financing routes exist and that the legislation, benefiting a single developer, would have far reaching consequences of authoring traffic impact fees.

Local Government Issues Group Discusses Best Practices and Local Regulations The BATC-Housing First Minnesota Local Government Issues Working Group (LGIWG) chaired by Paul Heuer, Pulte Homes, held its second meeting of the year on May 3. Formed in 2017 as part of BATC-Housing First Minnesota’s advocacy program, the LGIWG examines the growing regulatory pressures placed on the industry and homeowners by cities, counties, watershed districts and other local government entities. Members attending the LGIWG meeting discussed local regulatory trends, city fees, stormwater enforcement and how the various components of BATC-Housing First Minnesota’s advocacy program are used to assist members with local issues. The group has begun curating best practices for local government housing regulation and policies, aimed increasing housing affordability and consistency in local regulations in the Twin Cities and across Minnesota as a whole.

After months of policy discussions on a variety of housing issues, BATC-Housing First Minnesota leaders have concluded their gubernatorial candidate discussions. The final two meetings featured Congressman Tim Walz and former Governor Tim Pawlenty. The meetings capped a months-long series of conversations that touched on three major themes: balancing regulatory costs with the need to improve housing affordability; addressing the construction workforce crisis; and assessing the proper role of the Metropolitan Council to ensure affordable land costs and housing options. These conversations are part of an effort by BATC-Housing First Minnesota leaders to keep housing as a top-tier policy issue.

Matt held a variety of jobs during his high school career and worked alongside his dad growing up. With a long list of academic, volunteer and extracurricular achievements, Matt is ready to use what he has learned to take the next step in his career.

When his family moved during his junior year of high school, Jake was intrigued by all the different trades involved in building their new home, leading him to take a construction occupations course through his school. He has worked side-byside with instructors and contractors from various trades, and has since enrolled in the HVAC program at his college of choice.

The plumbing industry was something that really piqued my interest, [so I] sought out ways to become more involved and learn even more.

After his father called on a local HVAC company to work on their furnace, Charles developed an interest in pursuing it as his career. Talking to people in the field has only heightened his interest and prompted him continue his education in the trades, eventually leading him to shadow at that same HVAC company.

After joining a plumbing union post high school graduation, and then obtaining a plumbing degree in 2008, John went into the recession looking for other ways to obtain a skilled professionals position. He ended up going back to school and received an EMT diploma, only to reaffirm his love for construction. John is now going back to school to obtain his construction management degree so that he gets back to working with his “real passion.”

Cole knows that hard work and setting goals can take you far. He has attained academic achievements, held various hands-on working positions, and accomplished many personal goals in his high school career. He decided to focus on carpentry after rebuilding the inside of his family barn.

It has given him the feeling of importance to be a part of this industry.

The Avivo Project A BEAUT I F UL P LAC E F OR DIF F IC U LT WOR K

Initially, plans were in place to complete four apartments in 2018 and the remaining four apartments in Avivo’s facility in 2019. But after the first four were completed, the Foundation knew it was important to adjust their timelines and renovate the remaining units as soon as possible. Working with some incredibly generous build partners, Crystal Kitchen Centers, The Kingdom Builders and Soderberg Apartment Specialists, all eight apartments in the brownstone building were completed in 2018. The renovations included new cabinets, appliances, lighting, flooring, trim, fresh paint and fully remodeled bathrooms. This Avivo apartment complex is home to women and their children who participate in Avivo’s family treatment program. Housing is critical for mothers to focus on recovery, go back to school, and find employment. The major renovations to these apartments will provide a better quality of living to help Avivo’s women and children achieve their goals of life-long wellness and success.

PHASE 1 :: THE START OF SOMETHING BEAUTIFUL The first half of the project was completed with build partners The Kingdom Builders and Crystal Kitchen Centers. BATC-Housing First Minnesota Foundation/HomeAid Twin Cities celebrated the completion of the first four units in April. “The quality of this renovation elevates our apartment homes to an entirely different level,” said Kelly Matter, Avivo president & CEO. “These homes will help increase the wellness

of the families we serve as we provide housing that’s critical for mothers to succeed at recovery.” And the women that live in the apartments couldn’t be more grateful. “I think that’s an important thing, to be able to be somewhere that feels like home,” said Diamond, one of the residents living in the apartment. “When you’re working so hard in recovery, it feels good to come into a place that’s brand new.”

PHASE 2 :: BUILDING BLITZ Soderberg Apartment Specialists stepped up as the build partner for the four remaining units in the building. With their expertise remodeling apartments on incredibly tight timelines, they were able to finish all four apartments in less than a week. “We thought we would potentially help Avivo renovate these units next year, but then Soderberg Apartment Specialists stepped up and said they could get it done in just four days,” said Bob Bennett, manager of the BATC-Housing First Minnesota

Foundation. “We are thrilled that we will could do this for the residents that are living in these units.” “As happy and as thankful as I was to move into my apartment, I was so glad when they started to do the upstairs so the other girls could feel the same thing we felt,” added Diamond, an Avivo resident. The BATC-Housing First Minnesota Foundation/HomeAid Twin Cities celebrated the completion of the final four units this May. Thank you to all who made this project possible!

Second Home Underway for MACV The BATC-Housing First Minnesota Foundation along with build partner Lennar kicked off the construction of a second home to be donated to the Minnesota Assistance Council for Veterans (MACV) with a special groundbreaking in April. Organization leaders and elected officials joined together to celebrate the construction of the new home in Maplewood. The Maplewood lot for this home was donated by the Minneapolis Area Association of REALTORS® Foundation. The five-bedroom home will be used by MACV to house homeless female veterans, a population of the community that MACV says is in growing need. The home is scheduled to be completed in August. Lennar helped the BATCHousing First Minnesota Foundation complete a similar home for MACV last year that was built to house homeless veterans along with their families.
