Since opening in 2010, Vinyl Music Hall has been downtown Pensacola’s premier venue for contemporary live music. From George Clinton to Diplo to Big Boi, Vinyl has hosted some big names in its short history and built a name for itself within the industry. But downtown Pensacola has undergone a dramatic transformation in the eight years since Vinyl opened its doors. Palafox Street is more popular than ever, and the city’s reputation as a hotspot for nightlife is spreading. Now, owners Harry and Evan Levin have big plans to transform the modest venue to accommodate bigger crowds and, hopefully, brighter stars. “When we first started we were kind of part of that revitalization,” Evan said. “Now it’s just awesome to see that energy all the way down Palafox, and going past Garden Street. You see people outside sitting at tables and all the foot traffic seven days a week. So, I think it’s the right time for us to grow as downtown is growing.”
Vinyl closed its doors July 22 to undergo a top-to-bottom renovation that will increase capacity from 525 to 860. The main addition will be that of a wraparound mezzanine stretching from the rear of the venue around and behind the stage. The front of the venue will be pushed out as well, and the entrance and box office completely redone. Inside on a recent Tuesday, a small army of welders and construction workers from Brownsville Welding and Chastain & Co. scurried to complete the renovations ahead of the planned reopening show by the Chris Robinson Brotherhood tomorrow, Sept. 6. “We basically gave ourselves six weeks to do everything,” Evan said. “The goal was to minimize how
long we had our doors closed, but it’s a lot to do in a short amount of time.” With the capacity for larger crowds, Vinyl will be able to pursue acts for whom the previous capacity would have made performing here economically unfeasible. The Levins aren’t keen to say just who they may pursue, only that the renovations should make them a much more attractive option to wide variety of acts. “We talked about it for several years; about what we’d like to do and this made the most sense,” Evan said. “It’s going to allow us to go after bigger acts that may have had to pass us over in the past.” Many may not know that the original plan for the building that houses Vinyl was condos. Built in the early 20th century, it was originally a Masonic Lodge and had sat empty for years before the Levins bought it in 2005. When the housing market collapsed in 2007, the Levins offered the building up for lease, but with no tenants by 2010, the cousins decided they’d try to bring a musical element that had been lacking from the downtown landscape. “We wanted to bring something to downtown that didn’t currently exist,” Harry said. “We didn’t want to open a competing restaurant or bar. We wanted to bring something that was kind of a fresh new
concept and we had been to a couple similar venues in other cities and talked about how that’s what Pensacola was missing. We wanted to try to do something unique to the area.” It was never a sure thing that a dedicated music venue would work in downtown Pensacola, but the Levins’ gamble has paid off. Vinyl has hosted a slew of sold-out shows over the years, including Steve Earle, Postmodern Jukebox, Dr. John and many more. Part of their success, the Levins said, is

those diverse crowds has been a boon not just for Vinyl, but for all of downtown. “People don’t come here because they’re fans of the venue, they come here to see whoever’s on stage,” Harry said. “And if they want to see that person bad enough, they’re coming from Mobile, from Panama City – we get people in from Birmingham, from Orlando. So you’ve got a new crowd coming downtown every time we open our doors. We don’t serve food or anything like that, so the people that are coming here are staying at hotels and eating at restaurants and going to bars after the show, so they’re really getting a feel for all of downtown. So I thinks its great for everybody.” As they look to the future, the Levins say they’re excited about Vinyl’s growth and the opportunities it will allow. The renovations are not coming cheap, but they say that they’re confident that the demand exists to make them worthwhile. As for where they go from here, Harry said they’ll continue to do as they’ve done since opening and let their audiences guide their decision-making. “It took us eight years to take this next step, so we’re going to let our crowds dictate where it goes from here,” Harry said.

Annual Fenner Ride to benefit Big Brothers Big Sisters of Northwest Florida
Pensacola Interstate Fair announces this year’s entertainment lineup Pensacola’s biggest and longest-running annual agricultural and entertainment tradition returns for its 84th season Oct. 18 through Oct. 28, bringing with it the excitement of attractions and screams from exhilarating rides, exhibits, fair food, fun and shows for the whole family. For the third year in a row, the Fair’s musical line up kicks off opening night with the “Cat Country 98.7 BIG Lip Sync Battle Finals,” an epic showdown Oct. 18, starting at 7 p.m. Twelve winning acts will battle it out on stage to become the 2018 Lip Sync champion. The Pensacola Interstate Fair welcomes back local band White Tie Rock Ensemble Oct. 26, at 7:30 p.m. as they present a tribute to Led Zeppelin. The local group of musicians recreates classic rock albums with the precision and detail of a symphony. Expect to hear hits like “Whole Lotta Love,” “Black Dog,” and “Stairway to Heaven.” American country music singer and songwriter Craig Campbell will bring his soulful songs to the stage Oct. 27, at 7:30 p.m. to close out the fair concert series. Manna’s The Clover Pick A Bowl, Fill A Bowl event slated for Sept. 7
Join Manna in the fight against hunger at their annual fundraiser, The Clover Pick A Bowl, Fill A Bowl. The event hosted by Pensacola State College will be held Sept. 7, from 6 p.m. to 8 p.m., at the Lou Ross Center. This unique event with an artsy twist features the work of local artists, a silent auction, and the fare of local vendors. Choose a one-of-a-kind clay bowl to keep and sample some of the best soups in town. The annual event has been renamed in honor and memory of longtime supporter Bill Clover. Clover, a Pensacola State College Visual Arts Professor, was instrumental in starting and sustaining the 11-year event that has raised money to help thousands of hungry people. More than 400 cyclists from around the region are expected to participate in the annual Fenner Ride in Milton, Oct. 20. The century ride, benefiting Big Brothers Big Sisters of Northwest Florida, begins at Guy Thompson Community Center at 5629 Byrom St., Milton. A portion of the ride will be on the Blackwater State Heritage Trail, selected as one of Florida’s most scenic greenways. The ride routes are broken down into four distances of 18, 40, 62 and 100 miles. Early registration is $45 through Oct. 17, $55 thereafter, and includes a T-shirt, rest stops, limited sag support and a post-ride meal. Registration on the day of the ride begins at 6:30 a.m. at Guy Thomp-

the West Florida Wheelmen. A hit-and-run driver killed Dr. Fenner McConnell, a medical examiner for a four-county district in the Panhandle, in 1998 as he rode his bicycle across Bob Sikes Bridge. Matt Wantz was tragically killed while working in a local bike shop. Big Brothers Big Sisters of Northwest Florida has been the area’s leader in one-to-one mentoring for 29 years by serving children ages 6 to 18. Our mission is to provide children facing adversity with strong and enduring, one-to-one relationships that change their lives for the better, forever. More than 23,000 businesses in Escambia County to receive renewal notices Scott Lunsford, Escambia County Tax Collector, announced his office mailed Business Tax Receipt (BTR) renewal notices to 23,700 businesses in Escambia County. Businesses may renew their BTRs anytime between now and Sept. 30 without penalty. Echecks and credit cards can be used for online transactions. “Online renewals and our new Business Tax Express option make renewing and purchasing BTRs easier than ever,” Lunsford said. “Renewing and applying online is easy and secure, and there is no wait time.” “There are many new online options for business owners,” Lunsford continued. “Our goal is to provide multiple options in an ongoing effort to meet and exceed the customer service expectations of the citizens we serve. We understand that our customers’ time
is valuable and feel that by offering convenient online options for application, payment and updating, we help alleviate some of the time constraints on them – it’s a win-win for both of us.” Businesses also can make payments by mail or at one of four convenient offices. Additionally, business owners are encouraged to take advantage of the installment plan for tangible personal property tax payments. By utilizing this plan, business owners with a tangible personal property tax bill of at least $100 can make four quarterly payments instead of one lump sum payment. Each quarterly bill will receive a different discount for early payment, as prescribed by Florida Statutes. The quarterly payments are due by the last day of June, September, December and March. Businesses can apply online until
April 30, 2019 for the 2019 installment plan. “The installment program not only helps ease the financial burden on taxpayers by allowing them to spread out the payments, it also provides a discount for making payments on time,” Lunsford said. Customers who do need to visit the offices can join the line online at EscambiaTaxCollector.com and manage their time their way. Citizens select an office location and type of service, receive a message with approximate service time and then continue their regular activities until the service time approaches. IHMC lecture series announced IHMC will host a lecture series which will include Richard Kohler and Evan Kovacs on “The Talk: From the Seafloor to the Stars,” today, Sept. 5 at 6 p.m. A reception will be held at 5:30 p.m. before the lecture and will be hald at 40 S Alcaniz St. Exploring together for over 30 years, Kohler and Kovacs have documented some of the most historically significant shipwrecks and underwater mysteries around the globe, including the RMS Titanic, the USS Arizona and the Andrea Doria. They have filmed and co-hosted 56 episodes of the History Channel program “Deep Sea Detectives” and numerous other documentary films detailing their exploits in uncovering underwater enigmas and natural wonders. In “Seafloor to the Stars” they detail a decade of exploration on the RMS Titanic and the recent discovery and recovery of the Apollo spacecraft’s F-1 engines. Richie Kohler is an author and shipwreck explorer whose 40 years of diving experiences have taken him to all corners of the globe. These exploits have been detailed in documentary films and in a NY Times best-selling book, Shadow Divers, by Robert Kurson. Kohler hosted fifty-six episodes of the popular History Channel program “Deep Sea Detectives” and numerous other television programs detailing his explorations on some of the most famous shipwrecks in the world, including the Andrea Doria, RMS Titanic, and the HMHS Britannic. Utilizing submersibles and cutting-edge diving equipment, Kohler’s focus in underwater exploration has been on the human aspect of shipwreck tragedies, correcting fractured or missing history and in doing so, providing answers and closure to family members. Locating and identifying lost warships such as the USS Murphy, USS Lagarto, U-215 and U-869 and reaching out to these people has been the real reward in shipwreck exploration. Kohler’s recent work on a forgotten WWII submarine battle helped bring posthumous recognition to American Naval Captain in an award ceremony at the US Pentagon.
A fellow in the Explorer’s Club, Kohler continues to lead expeditions worldwide in search of lost ships and the mysteries they hold. He has written numerous magazine articles about shipwrecks, deep diving and diver safety and in 2017, published his first book, Mystery of the Last Olympian detailing a decade of work on Titanic’s sister ship Britannic. Over the years he has made numerous presentations at schools, libraries, diving conventions and symposiums promoting diving safety, education and awareness. Evan Kovacs a world class diver, passionate explorer, and perpetual imaginer, began his work with subsea imagery in 2003 while working with the History Channel. He is one of very few people to film – in both 2D and 3D – the RMS Titanic and her sister ship, HMHS Britannic. Over the course of his career, he has participated and led expeditions to survey and film wrecks, caves, and archaeological sites across the United States, to the islands of the South Pacific, the English Channel, the jungles of Mexico and the Dominican Republic, the D-Day beaches of Normandy, the Mediterranean, Thailand, Antarctica. His underwater and topside work can be seen on National Geographic, History Channel, Discovery Channel, PBS NOVA, CBC, NHK, and elsewhere. In 2009, he was nominated for an Emmy in videography for the NOVA program Lost and Found: Legacy of the USS Lagarto and in 2013 was underwater cinematographer and camera engineer on the Apollo 11 Rocket Engine Recovery with Jeff Bezos. Since 2006, he has partnered with the Woods Hole Oceanographic Institution Advanced Imaging and Visualization Lab to build and operate imaging systems for filming both above and below water for broadcast television, archaeological expeditions, and esteemed research institutions around the world. He has filmed around the world with numerous the deep submersibles like Alvin, the Pisces submersibles, Tritons and numerous remotely operated vehicles (ROVs).
Fall Prevention Expo set for Sept. 21
The Santa Rosa County Fall Prevention Expo 2018 will be held Sept. 21 from 8 a.m. till noon at the Guy Thompson Community Center located at 5629 Byrom Street in Milton. At the Fall Prevention Expo you can take advantage of free health screenings and learn more about how to prevent a fall, which is a major issue facing seniors today. In 2017, 2,271 falls were reported as the reason for injuries in Santa Rosa County, which was more than were due to motor vehicle accidents, violence and poisoning added together (1,782). Of the 2,271 fall related injuries 1,541 involved men and women 65 years of age and older, which is an increase of over 300 accidents compared to 2016 in Santa Rosa County. Falls can be very costly to people, especially seniors when you look at the injury itself along with
the possible medical bills, a hospital stay, and other costs associated with the accident. This is why the 2018 Fall Prevention Expo is so important. An opportunity to learn ways to not only improve your balance from health professionals from Santa Rosa Medical Center, but to also reduce the number of risks in and around your home. Members of the Santa Rosa Medical Center staff also will be conducting free screenings for items like blood pressure, breast self-exam education, diabetes education, smoking cessation, weight management, and other individual health related issues. During this year’s expo, seniors will have the opportunity to visit with a variety of local businesses and community organizations designed to help serve the areas older residents. Some of these groups include “Shine,” which serves
the health insurance need of elders, Legal Services of North Florida, American Red Cross, who will be offering all residents free smoke detectors, the Santa Rosa County Emergency Operations Center, who will be handing out information on how to stay safe during times of disasters, Assisted Living Locators, a free community oriented service to assist seniors in locating the best elder care option’s, information and resources available, as well as many other groups. If your group or organization would like to be a part of this year’s expo, booth space is available. This year the Fall Prevention Expo is hosted by the Retired Senior Volunteer Program and the City of Milton. Baths offered by Humane Society Bowser needs a good, long bath and a flea treatment to get through the dog days of summer. The Pensacola Humane Society continues its 2018 doggie bathe-in season Sept. 15, from 9 a.m. to 2 p.m. Bathe-ins offer low-cost dog bathing and flea dips during the warm weather season, and groomings are available on a first come, first served basis. Nail trims will be available for $5 between noon to 2 p.m. during the bathe-in. Events are held the third Saturday of the month until October. The last day will be Oct. 20. Charges for baths and groomings are based on the dog’s weight. Bring your own towels or you may rent a towel for a one dollar donation. The Pensacola Humane Society is located at 5 North Q Street. What my candidacy offered was, quite frankly, a foil for all those issues to say, you know what, we can talk about those issues, excite voters, and give them something to vote for, and not just against.” Among registered voters in Florida, Democrats and Republicans are almost evenly split, and those with no party affiliation – who are shut out of voting in primaries – make up about 27 percent of the electorate. Gillum’s challenge in November lies in wooing independent voters and more mainstream Democrats, according to experts. “He’s going to have to put together an Obama-esque coalition,” University of Florida political-science professor Daniel Smith told the News Service. “He can’t just do it with progressives. He can’t just do it with AfricanAmericans. The key is to look at Hispanic voters in Florida. Who’s going to be his running mate? You’re going to have to energize this growing group of moderate
Hispanics.” Gillum will have to “try to define himself to a broader general electorate than Democratic primary super voters” to pull off a November win, Smith predicted. The key for Gillum, as with most Democratic candidates in midterm election years like 2018, is to “get the base out,” said Florida Democratic consultant Matthew Isbell, who supported Graham. “At the end of the day, you don’t know what the white moderate independents are going to do,” Isbell said. “You need to get your base out because DeSantis is certainly going to galvanize his base.” Gillum can sway white, working-class voters by emphasizing that the GOP, which has had control of the governor’s mansion and the state Legislature for nearly two decades, “hasn’t done much for them,” and that “the quality of life has eroded under their watch,” Isbell advised. Gillum needs to generate excitement among Democrats and gin up animosity toward DeSantis, who is “a pretty strong bogeyman for progressives and moderates,” Isbell said. “This is a test,” Isbell continued. “The argument from progressives was that you needed a dynamic candidate to bring people out. Well, now is the test. This is the laboratory of that test. In the thirdlargest state of the nation, we have nominated a dynamic liberal who excites a lot of people. TALLAHASSEE – State Rep. Matt Caldwell topped a four-way Republican primary for agriculture commissioner Aug. 28, while lawyer and medical-marijuana lobbyist Nikki Fried had an easier time emerging from a field of three Democrats to become her party’s nominee for the Cabinet post. The two will now go head-tohead in November to replace termlimited Agriculture Commissioner Adam Putnam, who lost a bid for governor Aug. 28. Caldwell, R-North Fort Myers, won the GOP primary with nearly 35 percent of the vote, as state Sen. Denise Grimsley of Sebring and former Rep. Baxter Troutman of Winter Haven each grabbed about 26 percent. Mike McCalister, a palmtree farmer and retired Army colonel from Plant City, rounded out the voting with almost 13 percent. Caldwell noted he traveled more than 90,000 miles to visit each of Florida’s 67 counties in the past year and said his victory “bucked the GOP establishment.” “My campaign has been grounded on hard work, conservative principles, and grassroots support --- nothing more, nothing less,” Caldwell said in a prepared statement. Caldwell had the backing of groups such as the National Rifle Association and from U.S. Sen. Marco Rubio, R-Fla. Caldwell’s campaign and political committee spent nearly $2.7 million on the contest, compared to more than $3 million by both Grimsley and Troutman. Troutman put $3.25 million of his own money into the contest. McCalister, running his third statewide race, spent just over $20,000. Fried received nearly 60 percent of the vote as she defeated Homestead Mayor Jeff Porter and environmental scientist Roy David Walker in a contest that struggled for money and attention. Fried topped the field
in spending with just over $200,000. “Florida needs new leadership at the department (of Agriculture and Consumer Services) who will advocate for expanded patient access to medical marijuana, fix Adam Putnam’s failures in overseeing concealed weapons permits, and work to protect both consumers and our clean water, land and coasts,” Fried said in a statement. Fried was able to score some lastminute free media in announcing that Wells Fargo closed her campaign account because of her links to the cannabis industry. Caldwell, 37, is a real-estate appraiser who has a degree Florida Gulf Coast University. He traces his family back seven generations in Florida and was elected to the House in 2010. While in the House, he spearheaded water bills for former House Speaker Steve Crisafulli, R-Merritt Island, and has been a go-to lawmaker on a number of environmental issues for GOP leaders. Fried, 40, is a Miami native who received her bachelor’s, master’s and law degrees at the University of Florida, where she served as student-body president in 2002 and 2003. Before heading into private practice, she worked for the Alachua County public defender’s office. As a lobbyist during the 2018 legislative session, she represented the Florida’s Children First socialservice advocacy agency; the Broward County School Board; and San Felasco Nurseries, which was one of the first medical-marijuana licenseholders in the state. She said in a campaign biography that she is running for the statewide job because politicians failed Floridians in implementing medical marijuana “despite 72 percent of Floridians voting to approve a medical marijuana law.” She was referring to a 2016 constitutional amendment that broadly legalized medical marijuana in the state, though legal and regulatory battles continue about the way the amendment is being carried out.

MODEST INSURANCE HIKES COME AMID HEALTHCARE DEBATE By CHRISTINE SEXTON NEWS SERVICE OF FLORIDA
TALLAHASSEE – Florida Democrats vowing to make healthcare a priority in the November elections got a jolt of surprising news this week that could reshape the ongoing back-and-forth over former President Barack Obama’s health-care overhaul. The state Office of Insurance Regulation late Tuesday released data that showed health-insurance premiums will not balloon as much as some had feared amid moves by the Trump administration to dismantle the Affordable Care Act. The office reported on average that rates will increase 5.2 percent for individuals who receive coverage through the federal healthinsurance exchange, beginning in January. That means the premium for a 28-year-old adult living in Monroe County earning $27,000 annually should be an average of $115 month for a “silver” plan. That’s the lowest average rate in the state, according to an OIR chart.
Conversely, the highest costs for the plan will be in Okeechobee County, where that 28-year-old person would pay, on average, $333 a month for the same policy. The rate increases are some of the lowest ever requested by Florida insurance companies since the federal health law passed in 2010. The law, often referred to as Obamacare, requires insurance companies to issue policies to people regardless of any pre-existing conditions. It also provides cost-sharing reductions for people who qualify. But the federal law also required insurance companies to cover certain health benefits and prevented companies from limiting coverage. Those changes apply to all insurance policies, including those sold to employers in the private market through group plans. For individual policies, carriers submitted rate requests to the Office of Insurance Regulation ranging from a high of a 10.5 percent increase submitted by Blue Cross and Blue Shield of Florida to a low of 5.6 percent, submitted by
Florida Health Care Plans. On average, regulators instead approved a 5.2 percent increase for individual policies. The costs of group health insurance increased by an average of six percent for the 2019 year, according to the OIR data. Those policies are not bought on the federal exchange and are not subsidized. The program Florida Covering Kids and Families at the University of South Florida works with state agencies and others to advocate and conduct outreach to help people have access to affordable health coverage. Jody Ray, the director of the organization, didn’t know “what to expect” when it came to insurance rates for the 2019 year. “This is really good news for Florida,” she said. An insurance premium is the amount of money that an individual or business must pay for a policy. Premiums reflect the expected health care costs of the risk pool as well as the costs of the care. Brown said in a statement that the recent rate approval is in line with medical inflation and “indicates an overall market stabilization.” Congress this year eliminated a mandate included in the federal health law that people must buy insurance policies or face tax penalties. The move raised concerns that, without the mandate, only those who are unhealthy would continue to purchase health insurance through the federal exchange. Moreover, the Trump administration has made clear that it will not defend the Affordable Care Act against the latest legal challenge brought by 20 Republicanled states, including Florida. Gov. Rick Scott and other Republican leaders have consistently opposed the sweeping law, which has helped lower the percentage of uninsured citizens in the state and nation. Florida’s uninsured rate in 2013, the year before Obamacare plans became available, was 20 percent and one of the highest in the nation. In 2016, the rate was 12.5 percent. Florida also has consistently led
the nation in the number of people who enroll in the federal exchange under the law. Last year, more than 1.7 million Floridians entered the marketplace to buy a plan. The vast majority, more than 90 percent, received federal financial help to reduce their monthly premiums. State regulators, who work for an agency controlled by Scott and three other Republicans, released the health-insurance data the same day as Florida’s primary elections. Tallahassee mayor Andrew Gillum captured the Democratic nomination for governor edging out four opponents, and Republican Congressman Ron DeSantis won the GOP nomination. Gillum supports Obamacare, while DeSantis has voted to repeal the law. In a conference call on Wednesday, some of the state’s top Democrats made clear that they would ensure health-care access is a priority issue. “Make no mistake, health care is on the ballot this November,” Congressman Ted Deutch, whose district includes parts of Broward and Palm Beach counties, said.

TALLAHASSEE – The Florida Supreme Court heard arguments Wednesday in a legal fight about whether voters should cast ballots in November on a proposed constitutional amendment aimed at ending greyhound racing at pari-mutuel facilities. The hearing came after Leon County Circuit Judge Karen Gievers this month sided with the Florida Greyhound Association, a group of breeders, owners and trainers, and ruled that the proposal should not go on the ballot because it was misleading. The state appealed Gievers’ ruling, setting up the Supreme Court arguments little more than two months before the Nov. 6 general election. Jordan Pratt, a state deputy solicitor general, disputed that the proposal is misleading and urged justices to overturn Gievers’ decision. Backers of the measure, known as Amendment 13, sat in part of the courtroom listening to the arguments and said afterward that the measure should go before voters. “This amendment should go and be voted upon,” said Stephen Turner of the proamendment Committee to Protect Dogs. “It’s clear that the people have a right to choose whether they want a gambling activity of greyhound racing, which is cruel to animals, to continue. It’s that simple.” But former Supreme Court Justice Major Harding, representing the Florida Greyhound Association, told the court that the ballot title and summary – the wording that voters see when they go to the polls – did not properly disclose information about the effects of the amendment. Harding and Jack Cory, a lobbyist for the association, said that means the proposal should be kept off the ballot. “The vague ballot language and the vague title do not disclose everything to the people of the state of Florida that’s included in the proposed amendment,” Cory said after the hearing. The Florida Constitution Revision Commission this spring placed the proposed dog-racing ban on the November ballot after years of legislative debates about the future of greyhound racing in the state. The 37-member commission has unique author-
ity to place proposed constitutional amendments on the ballot, but its proposals this year have faced a series of legal challenges. The Supreme Court is focused on the wording of the ballot title and summary to make sure they accurately reflect the effects of the proposal. Gievers’ ruling cited a series of problems with the wording, describing the proposed amendment as “misleading and inaccurate and incomplete, while adding up to a ‘hide the ball,’ ‘fly a false flag’ and outright ‘trickeration,’ ” The ballot title and summary say: “ENDS DOG RACING. – Phases out commercial dog racing in connection with wagering by 2020. Other gaming activities are not affected.” But a major point of discussion during Wednesday’s arguments was part of the broader text of the proposed amendment that says, “The humane treatment of animals is a fundamental value of the people of the State of Florida.” Harding said the ballot title and summary fail to disclose that the amendment would make the humane treatment of animals a “fundamental value.” As a result, he said, voters would not be informed that the provision is included in the potential constitutional changes. “The people will not know that they are incorporating that in the Constitution if it is not in the ballot title and the summary, because that is all that is on the ballot,” Harding said. But some justices questioned that argument. For example, Justice Alan Lawson questioned what the legal effect of the “fundamental value” part of the amendment would be. Even if it passed, he said lawmakers would have to take some action to give it legal effect. “If you can’t identify a legal effect, then it sounds like political rhetoric, it’s just a fluff label,” Lawson said. “And we have cases that say you can’t put political rhetoric on a ballot summary. So, I think that if they had put it on (the ballot summary), your argument would be that it has no legal effect and it’s political rhetoric and it should come off.” It was not immediately clear how soon justices could rule in the case.
