Jazz for Justice Supporting Our Community, One Jazz Note at a Time

In downtown Pensacola, Seville Quarter has always been an exciting experience for visitors and a Sunday tradition for live jazz music. Legal Services of North Florida (LSNF) and Seville Quarter are combining forces to bring nationally recognized jazz artists to the already popular Seville Quarter Sunday Jazz Brunch for the fourth annual Jazz for Justice. The sound of sultry saxophone riffs and sweet percussion sounds will be combined with the lure of beignets, a decadent brunch and a custom bloody mary bar. Even the most wayward soul will want to see what’s reverberating Nov. 11 from 11 a.m. until 7 p.m. For more than two decades, LSNF has hosted Jazz for Justice in the panhandle, and LSNF staff, board members and volunteers are deeply rooted in justice issues which blend with the traditional and historical roots of jazz and blues music. By tapping into these roots, Jazz for Justice brings the spirit of LSNF’s mission to the streets of Pensacola. By hosting this event every year, LSNF’s Jazz for Justice brings hope and justice for all who need civil legal representation. “This is a free event for the community, the only way we could put this on every year is through the help and support of the legal and business community in Pensacola. Jazz for Justice reminds all of us that most important thing we can do for our community, is to help those who need it the most. The vision of LSNF is to provide hope and justice for all, and although we can’t serve everyone in our community, we want people to know there is a place to turn to when they need help,” LSNF Senior Attorney Christine Kelly Fausel said. Access to courts for low-income individuals can be difficult or nearly impossible when you cannot afford attorney fees or navigate the complicated legal system. LSNF provides the critical link needed between clients who might be only a day or two away from no home or food, fighting for their children and so much more. LSNF works with the Pensacola legal community

to recruit volunteer lawyers to assist those in need of legal services, some of whom are facing serious, life-changing civil legal problems. LSNF provides their clients free legal advice and representation. LSNF’s Jazz for Justice has roots that date back more than two decades. The event started in Tallahassee when a group of LSNF supporters with ties to the jazz community thought it would be fun way to raise awareness for the organization and its services. The event has grown strong roots in the Pensacola community over the last four years, bringing thousands of attendees downtown to network and watch nationally recognized jazz artists perform. Jazz for Justice offers Pensacola residents a unique and fun opportunity to support pro bono legal services, and meet the organizations and their families that help so many people in our community. The event is free for adults, children, grandparents and families of all ages. For the fourth year in a row, Jazz for Justice is partnered with Foo Foo Festival, a 12-day arts and entertainment festival in the Pensacola that honors the community’s unique culture and creativity. Jazz for Justice is proud partner of Foo Foo Festival and strong supporter of the local arts, music and cultural events taking place during the first 12 days in November. “Jazz for Justice is a truly a unique way to celebrate the critical importance of access to justice, the role LSNF has in improving that access within our community, and the impact of that work on not just our clients individually, but the community as a whole,” said LSNF Executive Director, Leslie Powell Boudreaux. Each year, LSNF provides legal assistance to over 5,000 individuals and families through dedicated employees and staff attorneys, along with the numerous pro bono attorneys who give their time. The mission of LSNF staff and pro bono attorneys is to offer a chance at justice for income-eligible residents. LSNF services help clients to succeed

and directly impact the economy for communities throughout Florida. A 2016 study by Legal Services Corporation (LSC) found that investments made in pro bono legal services organizations like LSNF and other partner agencies, not only resulted in thousands of individuals receiving legal benefits, but also millions of dollars being reinvested in the local economy. These kinds of benefits are tangible for our community and for the clients being served. In fact, in a 2016 LSC CostBenefit analysis, investments in legal services in Florida resulted in the creation of 2,243 new jobs and $274.8 million increase in business income throughout Florida. Jazz for Justice committee member and attorney Sean Seely noted that “those that work in the legal field and in social services know that receiving pro bono legal advice to resolve a legal matter, can be a real life saver. There are many parents, children, families, veterans and victims of domestic violence in our community that LSNF helps who cannot resolve their legal problem on their own, and don’t have the funds to hire a lawyer. That is where LSNF comes in.” This year’s Jazz for Justice includes several events and activities including a Jazz Brunch, VIP Experience, silent auction and of course live music throughout the day. sports memorabilia, theme park, restaurant and travel packages to some of the hottest destinations. • Main Stage – 3 p.m. to 7 p.m.: Chris Godber will be the first to hit the stage at 3:00 p.m. Despite being told by doctors he wouldn’t be able to play the saxophone due to of the severity of his asthma, Godber took to it anyway. Picking up the sax in middle school band at age 12, Godber has been leaving others breathless ever since. Now, he is a talented sax player whose albums have landed on the Amazon Best Selling charts and the Top 50 charts of smoothjazz. com. Godber’s songs are played daily on Sirius XM’s Watercolors. His sound is all his own with a dose of R&B and Gospel roots showing through. • Big Daddy and Red Hot Java will perform their original blues, soul and jazz blend starting at 4:30 p.m. They have performed their music overseas in several countries over the years. Randall “Big Daddy” Webster has conducted Blues seminars and workshops at Florida State University, University College Cork Ireland and University of London Kingston (UK), among other institutions. • K.C. and the Irresistibles will perform their unique blend of jazz and funk starting at 6 p.m. Formed by enigmatic Flow Tribe lead vocalist and trumpeter K.C. WSRE is producing 13 new episodes of “Nightmare Theatre” that will be airing Saturdays at 10 p.m and streaming online at wsre.org. In celebration of the series launch, WSRE and Great Southern Restaurant Group are teaming up to present a film screening which will feature “Plan 9 From Outer Space” on the big screen, a Merrill Movie Museum exhibit, a costume contest and the stars of “Nightmare Theatre”—Mike Ensley as the Baron Mondo Von Doren, Chip Chism as El Sapo de Tempesto and Lemmie Crews as Mittens the Werewolf. Recent inductees of the Horror Host Hall of Fame, the costumed trio have been presenting horror films since 2001, when “Nightmare Theatre” was first broadcast by Cox Media. Since then, there have been film festivals, other cable access broadcasts and a national appearance on SpikeTV’s “Ghouls Gone Wild” in 2006. The program last aired on WUWF-TV in 2016. Upon arrival to the Nov. 9 launch event, guests will be welcomed by the “Nightmare Theatre” cast, including the new Museum Curator played by Julio Diaz, the real-life collection curator of the Merrill Movie Museum. Maintenance crews hit the road to assist Bay County schools Escambia County School District schools continue with efforts to raise funds for Operation: Helping Our Neighbors’ Schools. On Oct. 29, fifteen members of the ECSD Maintenance team traveled east to assist in supportive roles. An offer to help with the recovery of the damaged schools was extended by ECSD following the storms, but the districts affected were still assessing their immediate needs. Last week, they were ready and asked for assistance from the ECSD’s Maintenance Department. “Last week. we were contacted by Bay County’s School District and they needed help with installing two miles of new fencing and help with getting lighting, inside and out, ready so they can reopen schools,” said Jim Higgins, Assistant Director of ECSD’s Maintenance Department. “Monday morning, before dawn, 15 members of our staff drove out with a variety of vehicles and equipment. They will camp out in the gym at Mowat Middle School and do all they can to help during the day,” Higgins said. “They will stay through Friday.” This deployment is phase two of Operation: Help Our Neighbors’ Schools announced earlier by Escambia County’s School Superintendent Malcolm Thomas. “Hurricane Ivan taught us what it takes to recover as a school district from severe storm damage; which is why we feel we can help,” Thomas said. “We began by asking our schools to conduct fund raisers to contribute to our Escambia County Public Schools Foundation for Operation: Help Our Neighbors’ Schools. All of those funds will go to the education foundations in Bay and Gulf County, so they can focus on their needs.” “Our Maintenance Department has been on stand-by, ready to assist, but waiting for Bay and Gulf Counties to assess their damage, create a plan of action, and order supplies. What they need now is manpower,” Thomas continued. “We are more than happy to assist our neighbors this way as well.”

Crews took along scissor lifts, bucket trucks, a back hoe, a dump truck and fuel. The fifteen employees will work in three teams and focus on the schools’ primary needs, lighting and security. The schools will have to be open extra hours to support a split session and accommodate students from two schools in one, making exterior lighting even more important for student and staff safety. “Helping them install two miles of fencing will help them keep their campus secure and will hopefully help their students and their families feel safe,” Higgins said. The fifteen crew members includes three team supervisors: Vince Childers, Tommy Silvers and Ken Barth. The crews are experienced with electrical work, lightning and fence installation. “Our planning goal was to be sure our crews will be able to work and live independently, to be self-sufficient. They took along food, water, camping gear and even a refrigerator truck. They will be there all week,” Higgins said. “Later this week we will also determine if we need to get ready to send a second set of workers next week.” Video of the caravan’s departure will be posted on Facebook on the page Escambia Schools Public Relations. Volunteers sought for Escambia County Value Adjustment Board

Fire Rescue HAZMAT Team benefits from donated response unit The week of Oct. 23, Escambia County Fire Rescue’s Hazardous Materials Team conducted training for the first time with a response vehicle donated to the county by Okaloosa County via the Ocean City Wright Fire Department. The new apparatus allows the HAZMAT team to transport up to six Hazardous Materials Technicians and a wide variety of equipment for detection and mitigation to an incident all in one vehicle, which greatly reduces response time for the citizens of Escambia County. The 2000 Pierce Hazardous Material Response Unit is equipped with a command and research area, power generator, scene lighting and compressed air for responders. Previously, the HAZMAT team used multiple utility pick-up trucks and trailers to respond with similar equipment. By decreasing the time needed to arrive on scene and being equipped with a more capable response unit, the county will be able to reduce the exposure and impact to citizens and the environment during a hazardous materials incident. Fire and EMS Chief Rusty Nail stressed the benefit of the new unit by saying, “We are ecstatic about this acquisition. Our Special Operations Teams will now be more effective than ever, as we continue to make Escambia County one of the safest places to live, work, and visit. Escambia County Fire Rescue is very grateful to both the Okaloosa and Escambia County Com-

missions for making this possible for our team and region.” Strategically located between the interstate, railways and many industrial companies, Escambia County’s HAZMAT Team is housed at the Ensley and Cantonment Stations. With at least eight hazardous materials technicians on duty 24 hours a day, Escambia County has the capability and equipment to decontaminate, treat and transport victims of chemical or biological exposure. The team can respond to a wide variety of calls from household propane gas leaks, rail or transportation accidents involving chemicals, industrial leaks of materials like acid, gasoline, or chlorine; spills caused by a natural disaster like a hurricane, to an act of terrorism like dangerous biological materials found in the mail. When not responding to or training for hazardous materials emergencies, team members respond to day-to-day fire and medical emergencies. Escambia County Fire Rescue’s HAZMAT team is a state regional asset and is one of only 20 in Florida qualified to respond to Type 1 and Type 2 hazardous materials incidents. Gillum’s tax plan would increase the corporate income-tax rate, which he says would affect just 2 percent of the state’s largest businesses and would raise more than $1 billion. The Democrat wants to use the money to raise teachers’ salaries. Gillum is “against a lot of the things that I am for,” Bougie said. But at Marie’s Place, a Tamarac hair salon not far from the DeSantis rally, first-time voter Cristina De Paula said Gillum’s proposals have earned her endorsement. De Paula, 18, attended high school not far from the Parkland campus where 14 students and three faculty members were killed in one of the country’s worst school shootings. De Paula said she frequently attended events at Marjory Stoneman Douglas High prior to graduating this year. But it’s also Gillum’s demeanor and “his way of handling situations” that appeals to the Florida Atlantic University student. “He’s been going to a lot of colleges,” De Paula, who was born in Florida and whose mother, salon owner Maria, immigrated to the United States from the Dominican Republic more than two decades ago, said. Gillum’s call for stricter gun

laws in the wake of the school shooting – which De Paula said had “a very, very, very big impact” on her election decisions – helped cement her allegiance to the Democrat. “On certain issues, we didn’t feel heard. … We expected something very different,” she said, referring to students’ futile attempt to force Florida lawmakers to ban assault-style weapons in the aftermath of the Parkland massacre. “I’m not saying we have to ban guns. For me, I don’t understand why you have to have a full arsenal at home,” De Paula said. Of Gillum, she said, “we’ve been able to make that connection with him and hopefully we’ll be able to really make our vote count.” On Saturday, former teacher Elise Kohen stopped to chat before casting her first ballot as a Floridian. Kohen, who retired to the Sunshine State from New Jersey, said she eagerly endorsed Gillum. “I want to vote for the person that will best represent the issues I believe in,” Kohen, 67, said outside a public library in Tamarac. Kohen said immigration and racism are the top two issues for her this election cycle. Trump has been castigated for anti-immigration stances and has called out the National Guard as a caravan of mostly Central Americans migrants winds its way toward the U.S.-Mexico border. Gillum, who is black, and his supporters have repeatedly accused DeSantis of racism. The day after the Aug. 28 primary election, DeSantis drew widespread criticism for saying that Florida needs to build on the success created by Scott and not “monkey this up” by electing Gillum. “This is a country of immigrants, and not one Republican

will stand up against Trump,” Kohen said. The environment and education are also important for the retiree. Immigration – and DeSantis’ proximity to Trump – is also the major concern for Weston Wynton, who said he moved from Jamaica to South Florida 15 years ago. “I don’t support Trump and his corrupted, small-minded way of looking at immigration,” Wynton, 55, said. Gillum “is smart, intelligent and has an agenda that will benefit the people,” according to Wynton. “That is why I voted for Andrew Gillum. Not because he is black,” he said. While Gillum anecdotally appeared to have solidified support among Democrats in Broward, their enthusiasm for U.S. Sen. Bill Nelson – who’s in a heated battle against Scott – was tepid. “I’m very conflicted,” Kohen said of Nelson. “I know he’s been here a long time. I don’t see him campaigning on things that he’s accomplished.” But De Paula, a self-described “conservative Democrat,” wasn’t torn at all. Her face lit up when asked about the Senate race. “I love Rick Scott,” she said, adding that she’s heard about the governor – who’s been in office since she was a 10-year-old – throughout her school days. Back at the Wings Plus parking lot, Frank McCrory said he voted for Clinton two years ago because he was “kind of scared of Trump.” But Gillum’s policies are even more frightening, according to the 64-year-old Miami Lakes retiree. “I don’t think raising taxes on corporations or Medicare for all is a good thing,” McCrory said, adding that Gillum “seems like a nice guy, but obviously has some clouds over his head.”

TALLAHASSEE – In the closing days of Florida’s high-stakes races for governor and U.S. senator, President Donald Trump and former President Barack Obama will try to rally the Republican and Democratic faithful in the state. Trump will hold rallies Wednesday in Lee County and Saturday in Pensacola, while Obama will appear Friday in Miami, according to announcements from Trump’s campaign organization and the Florida Democratic Party. The locations of Trump’s rallies are a sign that Republicans are trying to motivate conservative voters to go to the polls to support GOP gubernatorial candidate Ron DeSantis and U.S. Senate candidate Rick Scott in the Nov. 6 elections. Southwest Florida and the Panhandle are two party strongholds where Republicans look to run up large vote margins. Meanwhile, Southeast Florida is where Democrats have long looked to run up big numbers, and Obama’s trip to Miami is aimed at turning out voters for gubernatorial candidate Andrew Gillum and U.S. Sen. Bill Nelson. “President Obama knows what’s at stake in this election – protections for people with pre-existing conditions, funding for public schools, and leadership to restore our environment,” Gillum said in a prepared statement released Monday morning by the Florida Democratic Party. “With President Obama’s help, we’re going to bring it home for Florida this November.” Trump’s Florida appearances are part of a series of rallies across the country in important states. That includes rallies scheduled this week in Missouri and West Virginia, which also have closely watched U.S. Senate races. “President Trump is expected to discuss the booming economy, his tough stance on immigration, free market solutions for health care, and more,” his campaign organization said Sunday in announcing the Pensacola rally. “He will also remind Floridians of the critical need to get out and vote for the GOP in the midterm elections.” Trump will appear at 7 p.m. Wednesday at Hertz Arena in Estero, just outside Fort Myers, and at 6:30 p.m. Central time Saturday at Pensacola International Airport, according to his campaign organization. Obama will appear Friday at Ice Palace Films Studios in Miami, with the Florida Democratic Party saying full details will be released later in the week. The visits by Trump and Obama will come shortly after their vice presidents also campaigned for top-of-the-ticket candidates in the state. Vice President Mike Pence appeared Thursday at a rally for DeSantis in Jacksonville – another region that has been a Republican stronghold. The state’s agriculture industry sustained an estimated $2.5 billion in damage from Hurricane Irma in September 2017, topped by a $761 million hit to the citrus industry, the Department of Agriculture and Consumer Services said last year. In Michael, the most serious impacts occurred in Bay, Calhoun, Franklin, Gadsden, Gulf, Jackson, Liberty and Washington counties. The university’s calculations were gathered from farmers and aerial images captured by drones. The state’s cotton industry took the biggest hit, estimated at $51 million, as the storm came ashore as the harvest was just getting underway and about 90 percent of the crop

was still in the field. Peanut growers are expected to see losses of $22 million, as more than 245,000 acres were impacted, with field corn losses at $5 million and oat crops at $600,000. Greenhouses and nurseries suffered an estimated $39 million hit, while another $9 million in losses is projected for growers of vegetables and melons, $4 million for fruits and $3 million for tree nuts, including pecans. The study said a “significant” number of livestock animals went missing after the hurricane, including beef cattle, deer, horses and hogs. On Oct. 19, the Department of Agriculture and Consumer Services estimated the timber industry lost nearly 3 million acres of forestland in 11 counties from Michael. Timber operations in Bay, Calhoun, Franklin, Gadsden, Gulf, Holmes, Jackson, Leon, Liberty, Wakulla and Washington counties sustained damage, along with such things as pulp mills and sawmills, according to the Florida Forest Service, which is part of the department.

GROUPS SEEK TO EXTEND SUPREME COURT SELECTIONS By LLOYD DUNKELBERGER NEWS SERVICE OF FLORIDA TALLAHASSEE – The application process for three upcoming vacancies on the Florida Supreme Court should be extended until at least early January, according to new legal arguments. The League of Women Voters of Florida and Common Cause are asking the Supreme Court to order a nominating commission to extend the application deadline and halt a current nomination process in light of a court order issued this month. The Supreme Court unanimously ruled on Oct. 15 that the winner of the Nov. 6 governor’s election --- between Republican Ron DeSantis and Democrat Andrew Gillum --- has the “sole authority” to appoint the replacements for justices Barbara Pariente, R. Fred Lewis and Peggy Quince, who are leaving the court in early January because they have reached a mandatory retirement age. In a filing on Friday, the League of Women Voters and Common Cause asked the state’s highest court to order the Supreme Court Judicial Nominating Commission to reopen the application process and extend the deadline to at least Jan. 8, which is when the new governor will take office. The court in the Oct. 15 decision ruled a 60-day period for making appointments after the nominations have been certified by the nominating commission “begins to run only when the governor with the authority to appoint has taken office.” The emergency petition also asks the court to prohibit the nominating commission from taking any other action on the court vacancies and is asking the court to prohibit Gov. Rick Scott from “taking any further action related to the commission

or its membership,” other than preserving public records. The nominating commission, whose nine members were all appointed by Scott, set an Oct. 8 deadline for applications for the three court vacancies. That resulted in 59 applications being filed by judges and lawyers seeking appointment to the court. The commission has announced it will interview the applicants over a period of four days, Nov. 3 and Nov. 4 in Miami, and Nov. 8 and Nov. 9 in Tampa. It would then advance a certified list of potential justices to the new governor for consideration. When that list can be certified by the nominating commission is the subject of a Nov. 8 hearing at the Florida Supreme Court. “By stopping the process now, the court will ensure that its remedy will be effective and the new governor can fulfill his duties,” attorneys for the League of Women Voters and Common Cause argued in the new filing. “Halting the process now

is especially warranted to protect this court’s jurisdiction to provide a meaningful remedy because (the nominating commission members) have demonstrated that they are not restrained by what they know the law to be.” The petition said the applicant pool is likely to expand if the deadline is extended until January, noting only 11 women, six African-Americans and six Hispanic applicants are in the current pool. “The current applicant pool is woefully thin on female and black applicants, right at the time that the only female and-or black justices are leaving the court,” the petition said. The petition also raises questions about Scott’s continued role in the process, despite the Oct. 15 ruling that said he has no authority to make the appointments. Scott set a Nov. 10 deadline for the certified list of nominees. “Even though the (nominating) commission has known Gov. Scott has no power to impose a deadline, it has faith-

fully sought to follow the deadline he ordered,” the petition said. “There is no vetting for Gov. Scott to do in this case, and the only involvement his office should have in these matters is to make sure it preserves all records in its possession relating to the nomination of appellate judges during his tenure.” The petition also raised the question of whether the process has become “tainted” through the actions of the nominating commission and Scott. “More broadly, the circumstances related in the statement of facts above tend to foster the risk of an increasing public perception that the commission’s proceedings are tainted with partisanship and (are) part of Gov. Scott’s plan to usurp or at least unfairly restrict the ability of the person the people elect to make these appointments based on his own preferences instead of those of Gov. Scott,” the petition said. The allegation of a “tainted” process could become important if Gillum is elected as the next governor. Some lawyers involved in the appellate process said it could provide a basis for rejecting the initial list from the nominating commission. Others argue that the new governor will have to make his choices from whatever list is advanced by the nominating commission. The appointments to the seven-member Supreme Court are being watched closely because they have the potential to tilt the judicial direction of the court for years to come. Pariente, Lewis and Quince are part of a liberal bloc, which now holds a slim 4 to 3 majority, that has thwarted Scott and the Republican-dominated Legislature on numerous occasions since the governor took office in 2011.

The 1st District Court of Appeal in August upheld a circuit judge’s ruling that the so-called “pre-reveal” games are illegal slot machines. But Blue Sky Games, which developed the games, and Jacksonville-based Gator Coin, which leased the games to businesses, have filed notices that are a first step in asking the Supreme Court to take up the issue, according to information posted Monday on appeals-court

dockets. The legal wrangling began when the Florida Department of Business and Professional Regulation’s Division of Alcoholic Beverages and Tobacco ordered two businesses to remove the machines, prompting challenges from Blue Sky Games and Gator Coin. Supporters of the games have contended that the machines are legal because they include a “preview” feature that advises players of the outcome of the games. But regulators and other critics have argued the preview feature doesn’t matter because the “random number generator” used to create the games equates to the definition of slot machines, which are games of “chance,” under

state law. Also, a key issue has been whether the slotmachine law applies to playing a single game or a series of games. While the outcome of the first “pre-reveal” game is known in advance, a player at the outset does not know the results of subsequent games. The appeals court upheld a ruling last year by Leon County Circuit Judge John Cooper, who originally sided with Blue Sky Games and Gator Coin but then reversed himself. The reversal came after the Seminole Tribe of Florida, which became involved in the case, asked Cooper to reconsider his initial decision. The tribe operates casinos that include slot machines.
