It’s a soggy day outside of the studio with rain coming down in fits and bursts. The humid air is miserably thick, making hair and clothes stick uncomfortably – but it does not dampen spirits. They are undaunted. As the ladies file in, decked out in their full regalia – corsets, horned helmets, wiffle-bats and roller skates – it’s plain to see they are a tight-knit group. Their rapport is infectious. They banter back and forth trading gibes as they help each other into the rest of their elaborate costumes. They speak freely and openly about their day, their lives, and the upcoming events. It’s obvious in the way they support and cheer each other on as they are photographed that this is more than just fun and games for them. The Pensacola Roller Gurlz aren’t just a team, they’re family – a sisterhood – and they are as loyal as they are fierce. There’s no doubt that the dedication and drive these women have for their sport plays a large part in the success of the Running of the Bulls event held each year during the Fiesta de San Fermin at Seville Quarter. They

are the life-blood of the event and the energy they bring to the cause has really delivered a boom to the fundraiser. “We get bigger and better every year,” Roller Gurl Susan Carter, a.k.a. Smacker Jack Suzie, said. Last year, the Running of the Bulls saw over 300 registered runners and, according to the Roller Gurlz, this year’s event is already off to a promising start. “We’re already sitting at 109 runners,” Carter said. With registration still open until tomorrow July 19, that number is expected to go up the closer it gets to race day. For the past several years, the proceeds of this event have gone to the USO of Northwest Florida and this year will be no different. The event raised $7,000 dollars for the organization last year and the Roller Gurlz are aiming for at least $10,000 this time around. The choice to support the USO is a no brainer for the team. The military is the backbone of our community here, so giving back to them only serves to make the community that much stronger. “The USO strengthens

America’s military service members by keeping them connected to family, home, and country, throughout their service to the nation,” Dana Cervantes, senior director for the USO of Northwest Florida, said. Each year, the money the Running of the Bulls event raises goes toward maintaining the USO’s operations in the area. The boost they receive from the proceeds has been a very big help to them in recent years and they would like to see that continue and grow. “The proceeds raised from the event help stock our four USO centers in NWFL with much needed snacks, drinks, and supplies,” Cervantes said. “Last year, USO Northwest welcomed over 191,000 military guests through the doors of those four centers located at NAS Pensacola, Corry Station Pensacola, PNS International Airport, and the Destin-Ft. Walton Beach Airport. Running of the Bulls is a fun way for the community to give back to our service members.” Clearly, the Running of the Bulls

is not just fun and games. Sure, it’s a blast and participants enjoy it, but at its heart, the event is so much bigger than that. The Running of the Bulls has become a local tradition rooted in the spirit of giving and community building. It’s about making a difference and the Pensacola Roller Gurlz are leading the charge. Mark Murray joins Santa Rosa County as assistant county administrator Santa Rosa County commissioners welcomed ret. USN Capt. Mark Murray at the board’s regular meeting July 12. He joined the county as the new assistant county administrator July 16. Murray retired from active-duty with the U.S. Navy in April 2018 after 27 years, most recently serving as commander for Training Air Wing Five onboard NAS Whiting Field. A native of Rochester, N.Y, Murray earned a bachelor of science degree in Aerospace Engineering from the University at Buffalo in 1990. He earned his commission in 1991 through the aviation officer candidate school and was designated a naval aviator in 1992. Murray is a 2002 graduate of the Air Command and Staff College in Max-

well AFB where he earned a master of military Operational Art and Science Degree. He is also a 2014 graduate of the Dwight D. Eisenhower School for National Security and Resource Strategy where he earned a master of science in National Security and Resource Strategy. He and his wife Ashley have three children Nolan, Caroline and Lauren. Murray was selected from a pool of approximately 40 candidates. In his role, he will assist County Administrator Dan Schebler in planning, developing and directing major programs and projects for the county. Additionally, his responsibilities will include carrying out directions, policies, orders, resolutions, ordinances and regulations of the board of county commissioners.

Escambia County Jail Job Information Fair set for July 27 The Escambia County Corrections - Jail Division is hosting a job information fair from 9 a.m. to 2 p.m. Friday, July 27 at the Escambia County Jail located at 2935 N. L St. in Pensacola. The correctional facility is currently accepting applications for corrections officer trainees, certified corrections officers and medical professionals including: • Corrections Officer Trainee – High school diploma or equivalent, minimum age of 20. No certification is necessary, but applicants must be willing to complete Corrections Basic Recruit School, which will be provided at no cost as outlined in the employment contract. Accepted applicants will receive $13.75 per hour training pay and $15.12 per hour after graduation/state certification. The next course is tentatively set to begin the first week of October. Apply by Sunday, Aug. 19 online. • Corrections Officer – High school diploma or equivalent, minimum age of 20, and one year of experience performing work as a certified corrections officer/detention deputy; or, an equivalent combination of education and experience If you are certified in corrections in another state, a federal agency, or military, or if

Optimist Park is Santa Rosa County’s most recent recreation area to receive an all-inclusive renovation. The soonto-be popular playground now features a “lumber mill town” theme with ADAfriendly equipment depicting elements of the area’s history of river and rail transportation. The 17.8-acre park, located off Old Bagdad Highway at the corner of Parkmore Plaza in Milton, reopened with a public ribbon-cutting ceremony Monday, July 16 at 4 p.m. New pour-in-place rubberized surfacing makes the play area accessible for those of all abilities. ADA-friendly play structures are designed for two age groups: two through five and five through 12. Two shade structures and four benches offer a comfortable area for rest. An ADA-compliant sidewalk system provides interconnectivity

throughout the majority of the facility, which also features two baseball fields, a pavilion and a dog park. “We are excited to open another new all-accessible facility for our citizens and their families,” Santa Rosa County Commission Chairman Bob Cole, District 2, said. “We invite the public to join us in the ribbon-cutting celebration on Monday to see this beautiful new park for themselves.” The project cost of $300,000 was funded through the local option sales tax and District 2 recreational dollars. County crews completed the demolition and construction projects while contractors installed equipment and paved the parking lot. ADA upgrades to the walking track and restroom improvements are on schedule for future enhancements.

County Seeks Public Input for Living Shoreline Project at NAS Escambia County has received funding from the Gulf Coast Ecosystem Restoration Council as a result of the Deepwater Horizon Oil Spill for the design and permitting of a large-scale living shoreline project in Pensacola Bay. Escambia County considers public involvement a key component of this project and is seeking public input about the project design. Public comments received as a result of this survey will be used by the design team to guide the development of the overall conceptual design. The project will include three separate areas around Naval Air Station Pensacola: one adjacent to White Island in northwestern Pensacola Bay, and the

The goal of the project is to create 24,800 linear feet of rock and oyster reef breakwater and to create 205 acres of marsh and submerged aquatic vegetation habitat at these three sites. Living shorelines address erosion by providing long-term protection, reducing wave energy and restoring vegetated shoreline habitats through strategic placement of plants, rock and oyster reefs. Living shorelines also stabilize sediment, improve water quality, and enhance habitats for oysters, fish, shrimp, crabs, birds, sea turtles and other estuarine species. West Florida Public Library to Host Free Jazz Film Series

University of West Florida undergraduate students are working as teams to come up with solutions to problems critical to national security as part of an eight-week pilot course that launched June 18. The class, Hacking for Defense, or H4D, originated at Stanford University in 2016. UWF is the first institution in the state of Florida and one of only 12 universities in the country to offer the course. “The idea was that UWF could be a unique player in this H4D community because of our geographic proximity, but also our connectivity to some of our military partners,” Dr. Donovan Chau, director of strategy and engagement for the UWF Division of Research and Strategic Innovation, said. As part of the course, one student team is working to solve a problem concerning logistical issues at Eglin Air Force Base as it relates to situational awareness and safety at the range. The other team will tackle a potential cybersecurity problem for the U.S. Department of Energy’s Y-12 National Security Complex in Oak Ridge, Tenn., focusing on how to mitigate insider threats. “The students will not just learn how to work on a team to solve difficult problems, they have to learn how to communicate with one another, how to present on a regular basis, how to be professional, critical thinking and not only understanding a problem but

also offering a solution,” Chau said. “We want them to really experience the process because it’s about the time that each of the student teams put in and the teamwork and process they go through.” Dr. Dallas Snider, an associate professor in the Department of Information Technology, is the lead instructor for the course. Snider said the students who are enrolled in the course come from a number of fields of study such as business, computer science, information technology and biomedical sciences. Sophomore Gabriel Thompson is part of the team tasked with solving potential cybersecurity problems at the Y-12 National Security Complex. “I have a deep passion for artificial intelligence and the problems that they present will be solved by those,” Thompson said after listening to a presentation on some of the security issues that face the complex. “I firmly believe after listening to all of this that A.I will play a pivotal role.” Each team is required to run their own blog that documents their experiences and progress in the course. A major emphasis of the course is for students to try to go outside of the classroom, if possible, and meet with members of the agencies for which they are trying to solve the problems. “That’s a huge part in anything is understanding the customer,” Snider said. Baths Offered by Humane Society Bowser needs a good, long bath and a flea treatment to get through the dog days of summer. The Pensacola Humane Society continues its 2018 doggie bathe-in season July 21, from 9 a.m. to 2 p.m. Bathe-ins offer low-cost dog bathing and flea dips during the warm weather season, and groomings are available on a first come, first served basis. Events are held the third Saturday of the month until October. Additional days will be held Aug. 18, Sept. 15 and Oct. 20. Charges for baths and groomings are based on the dog’s weight. Bring your own towels or you may rent a towel for a one dollar donation. The Pensacola Humane Society is located at 5 North Q Street. Clifford the Big Red Dog to “Hit a Home Run for Early Learning” at Blue Wahoos Stadium Families are invited to help “Hit a Home Run for Early Learning” at the WSRE Imagination Station at Blue Wahoos Stadium Aug. 5, starting at 4 p.m. There will be fun children’s activities and appearances by Clifford the Big Red Dog, and each child will receive a free book, while supplies last. The Imagination Station is located outside the stadium near the box office. Clifford will also be inside the stadium in time for a pre-game “Fun Run for Reading” around the bases and to throw a ceremonial first pitch when

the Pensacola Blue Wahoos play the Montgomery Biscuits. “That will be ‘Bark in the Park’ night when Wahoos fans can bring dogs to the game, so we’re bringing every kid’s favorite, larger-than-life, four-legged friend, Clifford,” Jill Hubbs, director of WSRE Educational Content & Services, who will share early childhood education resources with parents during the event, said. The WSRE Imagination Station is a free early learning activity center for parents to engage with their children in hands-on

activities using PBS KIDS educational resources, including computer games, books and toys. Regular hours are 9 a.m. to noon Monday through Saturday and during Pensacola Blue Wahoos home games, opening an hour before the first pitch. “Clifford the Big Red Dog” is an animated television series produced by Scholastic Entertainment, who recently announced a fall 2019 relaunch of the multiple Emmy-winning preschool series based on the best-selling books by Norman Bridwell. Jazz Pensacola and the West Florida Public Library will present a free “Jazz Film Series” Sundays throughout July at the downtown library, 239 N. Spring St. All films begin at 1:30 p.m. and feature a brief introduction and a jazz discussion by Jazz Pensacola members and library staff. In addition, filmgoers can enjoy free refreshments and a Jazz Room exhibit. Jazz Pensacola President Fred Domulot, a popular session drummer and long-time music educator, will demonstrate the use of the drum kit and introduce “The Gene Krupa Story.” As an introduction to “Paris Blues,” renowned pianist/vocalist Crystal Joy Albert will perform some jazz tunes and share some personal experiences about her career in Boston, New York, Harlem and Miami.

The Jazz Film Series is designed to increase public awareness of the Jazz Room collection, which began in the 1980s when LPs were transitioning to CDs, Vickers says. Today, the Jazz Room houses a curated selection of approximately 1,200 books, CDs and movies about the history, performance and culture of jazz in its many forms. Other special features of the room include a listening station where patrons can sample a variety of jazz styles, music books with play-along CDs and jazz-related artwork donated by library users. “Eugene Fischer, then director of the library system, expressed an interest in having a jazz collection,” Vickers said. “So, the Jazz Society of Pensacola lent its funds and expertise. The Friends of the West Florida Library graciously offered to match donations of the Jazz Society. Floridatown Park renovations underway

Another theme in the testimony and discussion on Thursday was that many individuals like Cruz are identified as having mental or behavioral problems but there is often little communication between entities like schools, community mental health programs, the juvenile justice system, law enforcement agencies or health-care programs like Medicaid. “That’s the cornerstone of what we’re trying to do here because after the fact everybody knew he (Cruz) was going to do it sometime. But none of the dots ever got connected in advance,” said Polk County Sheriff Grady Judd, a commission member. “How do we create a process or a system where we can get all of this individual data together and break down silos and make sure they get services and then we are able to follow their ebbs and flows in the process?” Judd asked. Max Schachter, a commission member whose 14-year-old son, Alex, was among the 14 slain students, called the gaps in the state’s mental health system “horrible.” “That’s a concern of

mine that we could have more of these attacks if we don’t address these issues. It’s very disconcerting to hear that all of these agencies don’t talk. There’s all these silos of information. It’s never going to get fixed if we are not communicating,” he told reporters during an afternoon break. Ute Gazioch, director of mental health and substance abuse for the Department of Children and Families, said ideally individuals should be receiving treatment before they reach the point where they are being sent to a crisis-stabilization unit under the Baker Act. “The more we can do early on working with families and children, the quicker we can intervene, I would hope we wouldn’t have that many (Baker Act) contacts,” she said. She also said individuals who are released after a Baker Act examination should be given a “discharge” plan, saying it may be something that needs to be re-emphasized. University of Central Florida President John Hitt, who retired last month, earned $1.28 million, according to the survey published Sunday by The Chronicle of Higher Education. University of South Florida President Judy Genshaft earned $1.18 million, and University of Florida President Kent Fuchs earned $1.1 million, the survey showed. In its annual survey of some 250 public college and university presidents, The Chronicle said the three Florida university leaders were among a dozen public school presidents who earned more than $1 million in 2016-2017. Compensation packages averaged $560,000 for all public university presidents. The pay packages included base pay but also other compensation such as performance bonuses, housing allowances, vehicles and deferred compensation plans. Other Florida university presidents in the top 100 of the survey included John Thrasher of Florida State University at $634,437, Mark Rosenberg of Florida International University at $619,739 and John Kelly of Florida Atlantic University at $608,573. The survey included partial-year salaries for presidents at Florida A&M University and the University of West Florida. But a more complete Florida presidential-

pay survey was produced during UCF’s search for its new president this year. Based on 2016-2017 data, University of North Florida President John Delaney, who has retired, earned $766,121, according to Sibson Consulting. Florida Gulf Coast University President Wilson Bradshaw, who has also retired, earned $686,525. Florida Polytechnic University President Randy Avent earned $538,517. Florida A&M President Larry Robinson earned $443,907. University of West Florida President Martha Saunders earned $432,915. And New College of Florida President Donal O’Shea earned $357,250, according to the Sibson survey. The Chronicle also surveyed compensation packages for 570 presidents of private colleges and universities. Among the Florida presidents in the top 250 in the private-school survey was University of Miami president Donna Shalala, who has retired and is running for Congress, at $1.47 million. With the statewide school system receiving more funding for mental health services, Carroll also said it will be important for the schools to coordinate with community mental health providers, noting that students spend more time in their homes and communities than in school. TALLAHASSEE – Florida is halting payments to a company upgrading the SunPass toll-collection system until all the changes in the $287 million project are deemed “fully operational.” The Florida Department of Transportation announced Monday it is withholding payments to Maryland-based Conduent State & Local Solutions as work continues on the SunPass Centralized Customer Service System, which was expected to be completed June 11. “The contract with our vendor includes a number of robust provisions related to performance and failure to meet obligations,” the department said in a statement that did not indicate how much money the state still owes Conduent or the number of payments remaining. Department spokesman Ed Seifert said Conduent has not submitted invoices for reimbursement since June 11. The contract to incorporate all back-office operations into a single operation was awarded in November 2015. Conduent’s 1,575-page contract outlines that $5,000 a day in “liquid damages” may be imposed for each day from the “go-live” date that work fails to be considered completed. Transportation Secretary Mike Dew called the delays “completely unacceptable.” “The department anticipates and expects that Conduent will continue to improve the operations of the SunPass call center, the website interface, the functionality of the mobile application interface and the availability and reliability of SunPass Plus, so that SunPass customers are provided the premium level of service they are entitled to ex-

pect,” Dew wrote in a letter Monday to Conduent President David Amoriell. Amoriell advised the state last week that the company had already made “substantial improvements in recent weeks and will continue to strive for your complete satisfaction.” The issues remaining from the upgrade include the effectiveness of the SunPass website and mobile application; issues related to multiple charges being applied through the payment processing system; and problems with the expanded SunPass Plus application at airports, which was slow or unavailable in responding to airport gate systems when customers entered or exited parking facilities. As part of the conversion, SunPass Plus parking has been expanded from Orlando International Airport to include Miami International Airport, Fort Lauderdale-Hollywood International Airport, Palm Beach International Airport and Tampa International Airport. Amoriell said double charges against customers are being reversed, with letters prepared to notify customers. “We will commit that customers will not be overcharged,” Amoriell wrote. As for the website, Amoriell wrote that an independent third-party vendor has been hired to identify ways to further improve the system. Despite the assertions to complete the work, no completion date has been set. The state continues to catch up on the backload of toll transactions --- at least 100 million --- that occurred after work on the upgrades began on June 5. As of Monday, more than 46 million transactions had been processed, starting with the oldest. The state is trying to process about 8 million transactions a day, double the daily average of toll transactions.

COURT TO MOVE FORWARD WITH ‘JANE DOE’ ISSUE IN GUN CASE By JIM SAUNDERS THE NEWS SERVICE OF FLORIDA TALLAHASSEE – A federal appeals court Monday cleared the way for considering a dispute about whether two teens can remain anonymous in a challenge to a new Florida law that raised the minimum age to buy rifles and other long guns. The 11th U.S. Circuit Court of Appeals issued a two-page document that said it “appears that this court has jurisdiction to consider this appeal,” though it said a final determination on that jurisdiction will be made later by a panel of judges who will hear the anonymity issue. The appeal stems from a ruling in May by U.S. District Judge Mark Walker that a 19-year-old Alachua County woman, identified as “Jane Doe,” could not remain anonymous as a plaintiff in a National Rifle Association challenge to the gun law. The NRA also sought to add to the case a 19-year-old man, identified as “John Doe,” who could be affected by the law. After Walker’s ruling, the NRA went to the Atlanta-based

appeals court seeking to allow the teens to remain anonymous. The appeals court, however, raised a question about whether it should consider the anonymity matter and said that if “it is determined that this court is without jurisdiction, this appeal will be dismissed.” The NRA contended the appeals court has jurisdiction over the anonymity issue. Also, Attorney General Pam Bondi’s office, which has objected to the teens remaining anonymous, agreed that the appeals court could take up the dispute. The anonymity issue is rooted in a federal lawsuit that the

NRA filed March 9 after Gov. Rick Scott signed into law a sweeping school-safety measure that included new gun-related restrictions. The legislation was a response to the Feb. 14 shooting at Parkland’s Marjory Stoneman Douglas High School that left 17 students and faculty members dead. In part, the law raised from 18 to 21 the minimum age to purchase rifles and other long guns. After filing the lawsuit, the NRA moved to add the two teens to the case but sought to keep their identities private. NRA attorneys argued in a brief filed June 27 in the appeals

court that the teens feared “that being publicly named in and associated with the case would subject them to harassment, intimidation, threats, and potentially even physical violence.” It also pointed to numerous harassing and threatening emails and phone calls received by prominent NRA lobbyist Marion Hammer since the shooting in Parkland and the filing of the lawsuit. “The context of this case – and of Jane Doe and John Doe’s request to remain anonymous – cannot be understood apart from the tragic February 14 shooting at Marjory Stoneman Douglas High School and its aftermath,” the NRA’s lawyers wrote in the brief. “That event not only led to the enactment of the ban (on people under 21 buying guns) challenged in this case; it was the catalyst for a nationwide effort to restrict the possession and use of firearms. Funded by a group of anti-gun organizations, activists have barnstormed the country advocating restrictions on the right to keep and bear arms.” In ruling against the anonymity request in May, Walker

wrote that if “it were entirely up to this court, this court would not hesitate to grant the NRA’s motion.” But Walker indicated he was bound by previous legal decisions. Based on precedent, “this court finds that mere evidence of threats and harassment made online is insufficient to outweigh the customary and constitutionally-embedded presumption of openness in judicial proceedings,” Walker wrote. “This is especially true where the targets of such threats and harassment are not minors and where the subject at issue does not involve matters of utmost intimacy.” While the NRA and state await action from the appeals court on the anonymity issue, the underlying challenge to the law signed by Scott has largely remained on hold. After the anonymity issue is resolved, Walker will consider the legality of the gun restriction. Meanwhile, Hammer filed lawsuits Friday in state and federal courts against five men she says have targeted her with harmful emails and phone calls since the massacre in Parkland.

But it’s unclear whether Friday’s moves by the health department will appease critics – including legislators, patient advocates and marijuana industry operators – who have blasted the agency for delays in issuing new licenses. Florida’s medical marijuana industry has been mired in controversy since its inception in 2014, when lawmakers legalized non-euphoric cannabis and authorized five licenses. The already intense competition for the licenses intensified after voters approved a constitutional amendment in 2016 that broadly legalized medical marijuana. A law passed last year, aimed at implementing the constitutional amendment, required health officials to issue 10 new licenses, including to applicants who had legal challenges pending as of

January 2017 or who had scored within one point of the highest-ranked applicants in five regions. Health officials initially said Nature’s Way was ineligible for a license because its aggregate score of 2.8833 was not within one point of the 4.4 received by Costa Farms, which was granted a license for the Southeast region in 2015. But as he had previously done in an unrelated challenge, Van Laningham found that health officials’ ranking of the applicants – the method used to determine which ones would get licenses – was not the same as scoring the applications. “To repeat a point that cannot be stated enough, it is impossible to determine a quantifiable ‘point’ difference between the rankings of Best and, e.g., Fourth Best,” he wrote in the lengthy opinion that included pages of mathematical analysis and charts. The health agency’s licensure Friday of Nature’s Way means that 14 licenses have been issued. It also shrinks the number of available licenses, because six of the 10 licenses authorized under the 2017 law have already been doled out. One of the new licenses not yet issued must go to a black farmer who was part of class-action lawsuits, known as “Pigford” cases, about discrimination by federal officials.

The new law also required health officials to give preference for two licenses to applicants who own facilities that were used to process citrus, the subject of at least one lawsuit. Because of the litigation regarding the citrus preference, the department is holding off on accepting applications for the remaining two licenses, according to a news release issued Friday. But the state is moving forward with a process for four new licenses ordered under a different part of the law, which requires health officials to grant four licenses after at least 100,000 qualified, eligible patients have enrolled in a statewide database, a benchmark that was recently surpassed. “The Florida Department of Health is committed to ensuring qualified patients have safe, reliable access to low-THC cannabis and medical marijuana,” agency officials said in the release. “In an effort to continue to expand availability of this treatment, the department will accept applications for registration as a medical marijuana treatment center through a new rule. This new rule addresses the Pigford class license and the four additional licenses available upon reaching 100,000 patients, as outlined by the Florida Legislature in 2017.”

The Office of Medical Marijuana Use had originally planned to issue the four licenses spawned by the increase in the number of patients to applicants who were “runners-up.” But the agency has yet to begin accepting applications for the new licenses. The Office of Medical Marijuana Use is asking the Legislature for more money as it prepares for an influx of applications in a state where one license – tied to an operator that had not yet begun selling cannabis – recently sold for $53 million. Less than two weeks after the state’s new fiscal year began July 1, the office is asking the Joint Legislative Budget Commission for nearly $13.3 million in additional money to cover its expenses this year. The request includes more than $7.3 million to handle what health officials, who have contracted with the firm KPMG to process and score the applications, estimate will be up to 400 applications, with an estimated price tag of $18,354 each to review, according to documents posted on the commission’s website. The health department, which is currently fending off at least 10 legal or administrative challenges, is also estimating it will need an additional $1.5 million for current and future lawsuits, and $3.4 million for a seedto-sale tracking system.

A managed-care plan owned by the North Broward and South Broward hospital districts is fighting a state decision to eliminate it from providing Medicaid services to some of Florida’s sickest children. The South Florida Community Care Network has filed a challenge to the Florida Department of Health’s decision last month to award a contract to a subsidiary of Tampa-based WellCare Health Plans to manage the Children’s Medical Services program. In its filing with the state, South Florida Community Care Network – which operates as Community Care Plan – asked that the contract with WellCare be stayed until it

can reach an “amicable agreement” with the Department of Health. If the department and Community Care Plan cannot reach an agreement, the filing requests that the dispute be referred to state administrative court. Community Care Plan bid to operate the Children’s Medical Services managed-care program in South Florida, including heavily populated Palm Beach, Broward and Miami-Dade counties. But the Department of Health, which is in charge of the Children’s Medical Services program, granted a sole award to WellCare. Community Care Plan’s “best and final offer was superior to the best and final offer supplied by WellCare,” Tallahassee attorney Frank P. Rainer, with the Broad and Cassel firm, wrote in the filing last week. Rain-

er said the decision to award the contract to WellCare is clearly “erroneous, contrary to competition, arbitrary and capricious and violate(s) law.” Among other things, Community Care Plan disputes that a sole award to WellCare can be legal because federal law – as well as the Medicaid waivers that authorize managed-care programs – require patients to have a choice of at least two health plans. In addition to a procurement process for the Children’s Medical Services program, the Scott administration in the last year has rebid broader statewide Medicaid managed-care programs and created a statewide dental managed-care program. Those decisions by the state Agency for Health Care Administration also have drawn challenges.
