AmID a rising demand for domestic work and an unprecedented elder boom, a new report from the UCLA Labor Center has found that an estimated 2 million households in California hire domestic workers for childcare, house cleaning and home care services. the report, “Profile, Practices and Needs of California’s Domestic Work employers,” was based on 501 randomly-dialed phone surveys throughout the state and is the first comprehensive study of domestic work employers. It illustrates the dependence of Californians on domestic work and that the industry still lacks standards normally implemented in other workplaces because the work is happening inside the home.

“In our survey, we found that 49 percent of employers didn’t research or look up information when they devised the terms of employments like pay, hours, and benefits,” said saba Waheed, research director at the UCLA Labor Center and co-author of the report. “the lack of clear standards leads to wide variations in work and pay arrangements. furthermore, according to our study, employers value domestic work and need more support.” Among key findings in the study include: 54 percent of Californians hire domestic workers for housecleaning support; 27 percent hire for homecare support; and 19 percent hire them for childcare support. At present, the Philippines is ranked 103 out of 189 countries on The World Bank’s Ease of Doing Business Ranking for 2016.
Although the Philippines has lifted its position significantly on this ranking under President Aquino, from 136 in 2012 to 103 in 2016, the ranking of the Philippines is still far below some other Southeast Asian economies, notably Singapore, which is ranked first globally, Malaysia which is ranked 18th, and Thailand which is ranked 49th, he noted. “Improving the business environment for foreign investment into manufacturing and infrastructure will be a critical challenge for the incoming Philippine government administration, in order to boost manufacturing exports and employment,” he added. Biswas further said one of the more important economic priorities for the next government would be to tackle the high level of poverty that still persists in the Philippines. support of a broad coalition of supporters and partners. Binay’s spokesperson Rico Quicho added that the surveys, which show Binay declining in ratings, did not reflect the support for Binay on the ground. According to the latest Pulse Asia survey conducted April 26 to 29, Binay placed fourth with 17 percent, down one percent from the previous survey conducted April 19 to 24. Davao City Mayor Rodrigo Duterte, meanwhile, retained his lead at 33 percent among 4,000 respondents, followed by administration candidate Mar Roxas and erstwhile front-runner Sen.
Grace Poe in a statistical tie at 22 percent and 21 percent, respectively. Sen. Miriam Defensor Santiago got only two percent. The survey has a margin of error of plus-or-minus 1.5 percentage points. Four percent remains undecided. Binay used to lead in the surveys, until the corruption allegations caught up with him when the Office of the Ombudsman indicted him for malversation, graft and falsification of public documents over the alleged overpricing of the Makati car park building when he was mayor.

Rural poverty in some regions is a key public policy challenge, the IHS economist said, stressing that these problems have been aggravated by current dry weather conditions because of the El Niño effect, which have resulted in severe drought in parts of the southern Philippines, resulting in food shortages and severe hardship for the rural population in some areas.
“Therefore, ensuring that the benefits of rapid economic growth do reach a wider share of the population will be a crucial policy priority for the next administration, and key strategies to reduce poverty will be to accelerate foreign investment inflows into manufacturing and infrastructure development,” he said. Meanwhile, Biswas said increased investment in agricultural infrastructure and irrigation technology, as well as insurance schemes for farmers will help to boost rural incomes and mitigate
risks associated with extreme weather events such as drought or typhoons. “The next administration will also need to ensure that trade and investment liberalization are high priorities on its policy agenda, through bilateral and regional trade and investment initiatives with key partners such as the Asean+3 nations as well as the EU [European Union] the US and India,” he added. was an enormous victory for not only this generation, but also for many generations to come who will not suffer the deadly impacts of tobacco.” Also approved in the package were measures that place restrictions on where people can smoke and the sale of electronic cigarettes. The bills have been praised as the “most expansive” effort to control tobacco use in California in more than 10 years. The package received support from health groups including the American Cancer Society, American Heart Association, California Medical Association and American Lung Association. Supporters also pointed out that tobacco is the leading cause of preventable death and is responsible for the deaths of up to 34,000 Californians each year. In the package, Brown, however, vetoed a bill that would have
allowed counties to seek voter approval of local tobacco taxes to pay for healthcare expenses for individuals with tobacco-related illnesses, the Los Angeles Times reported. “Although California has one of the lowest cigarette tax rates in the nation, I am reluctant to approve this measure in view of all the taxes being proposed for the 2016 ballot,” Brown wrote in his veto message for a bill authored by Assemblyman Richard Bloom (D-Santa Monica). An exemption for the legal smoking age exists for individuals in active military, who will still be allowed to purchase cigarettes at the age of 18. In response to the bills, the tobacco industry has threatened to seek a referendum that would reverse the smoking age and lift the restrictions on e-cigarettes. Lawmakers, as a result, have made it harder to qualify a referendum.
Opponents of Brown’s approval, including the Smoke-Free Alternatives Trade Association, which represents electronic cigarette makers, criticized the passage of the bills on Wednesday. It said it would work to educate voters about the industry. “California took a step backwards today by reclassifying vapor products as tobacco,” the association said in a statement. “Stigmatizing vapor products, which contain no tobacco, and treating them the same as combustible tobacco while actively seeking to economically penalize smokers attempting to switch is counterproductive to public health.” A 2015 study by the Institute of Medicine estimated that boosting the tobacco purchase age to 21 will result in 200,000 fewer premature deaths between 2000 and 2019, and 50,000 fewer deaths due to lung cancer for people born in the same time period. Green added. “In doing so, we not only affirm our commitment to one another but also return to Sts. Peter and Paul its voice and it is our hope that through this bell, the church will speak to the community for many generations to come.” San Pedro Bell History “It is said that the history of West Point is the history of America. The bell is part of that,” said Sonny Busa, a community leader representing the US-Philippine Society and the West Point Society of the Philippines. “The return of the bell is a manifestation of the strong bilateral ties between the United States and the Philippines,” he added. In 1833, Father Mariano Garcia, assistant priest of Bauang, La Union was given a large bell by the province’s Lieutenant-Governor, D. Mariano Balancio and a Lieutenant D.D. Hilario Calica. The 834-pound bell, an alloy of gold, silver and copper, was baptized and named San Pedro. It was almost destroyed during the

California DMV automates voter registration with a two-step system LOS ANGELES — The California Department of Motor Vehicles (DMV) has taken the necessary first steps toward improving voter registration services offered online and at its 174 field offices across the state. Until now, if someone wanted to register to vote through the DMV, they had to fill out a separate voter registration card. Under a new automated system, the basic voter registration questions are integrated into the DMV’s forms to apply for a driver’s license or identification card -- however, especially for Limited English Proficient (LEP) voters, other important questions must be answered
in a second, optional step. More specifically, beginning this month, people who are eligible and affirmatively choose to register when applying for or renewing a driver’s license or identification card at a DMV field office will have their voter registration information sent electronically to the California Secretary of State. Voters may provide additional information, such as language and vote-by-mail preference, at a second, optional step. Voter registration services will be offered in English and nine other languages (Chinese, Hindi, Khmer, Korean, Japanese, Spanish, Tagalog, Thai, and Viet-
namese). Those renewing their license or identification card online will be able to register to vote or update their voter registration through an integrated link to the California Online Voter Registration system. While the automated system is an important step forward, one part of the new process could cause problems, especially for limited English proficient voters. In order to sign up for translated election materials and political party affiliation or to become a permanent vote-by-mail voter, the prospective registrant will need to complete follow-up

The bell was one of the things they seized in the town of Bauang, La Union,” explained Busa, a retired Department of State foreign service officer. “They heard a rumor that the insurgents, the insurrectos were making artillery out of church bells, so they took the town’s bell.” Thomas Barry, a West Point graduate from the Class of 1877 served in the Philippines during the Philippine-American War and subsequently became the 27th Superintendent of the Military Academy. Through cooperative efforts in the Philippines, Barry was instrumental in sending the bell to West Point in 1915. The bell remained in the church belfry for 44 years unhung and unrung only to be discovered during the 1959 expansion of the chapel. Before being shipped to the Philippines, the bell stayed outside the chapel on a base which was designed in the 1980s and funded by the West Point chapter of the Daughters of the U.S. Army. On November 10, 2015, the pastor of St. Peter and Paul Church in Bauang wrote a letter to the Military Academy Superin-
tendent, requesting the Academy to return the bell to its home in the Philippines. “Gen. Caslen read the letter and they conducted an investigation. Their historians verified this claim and the conclusion is that the bell belongs to the people of Bauang. He made a moral and ethical decision to return it,” explained Busa. “Now, the bell will be on its way home. We can very well call it our Balikbayan Bell.” Last January 28, 2016, Lieutenant General Robert Caslen, Jr. wrote back to Fr. Ronald Chan obliging his request. “I have a special interest because it is going back to the Diocese of San Fernando,” added Consul General de Leon, who added that his father is from the town of San Juan, the town after San Fernando. Bauang is part of the Diocese of San Fernando. Community Response “It is very heartwarming. I am so elated because this bell is going back to Bauang, which was our vacation place then. I didn’t want to miss this opportunity,” said Josephine Gopiao of the Philippine American Foundation for Charities (PAFC), an organization based in Northern Virginia. She joined a group of community leaders who drove from Washington, DC and Maryland
to attend the bell’s send-off. Members of the group sang ‘Bayan Ko’ after Busa delivered his speech. Filipino and some Filipino-American cadets joined members of the community in the singing. “I am very happy that the bell is going back home, this is an important part of our history,” said Don Stanley Dalisay, one of only two Filipinos from the Philippines who are currently enrolled at West Point. “This highlights the strong relationship between the United States and the Philippines especially considering our jaded history. We’ve fought against each other before, now we’re allies in the Asia Pacific region.” Dalisay comes from the town of Tingloy, Batangas. He is a junior cadet at West Point taking up economics and operations research. He spent a year as a plebe at the Philippine Military Academy as a part of the GabayLaya Class of 2016. “This bell (San Pedro) was incidental. The group is trying to get the Balangiga Bells back and that is why they have been communicating with me. Admiral McKinnon told me that he heard there’s another bell at West Point so he told me to look into it and do some research,” Dalisay explained. The group he was referring to is the group of Rear Admiral Dan McKinnon, Dennis Wright and other U.S. Navy veterans who have been heavily involved in getting the Balangiga Bells of Samar back to the Philippines. The cadet went to the library to do his research but he stumbled on a dead end as there was nothing about San Pedro bell. West Point officials just took photos of the bell and sent it to the group and the Balangiga historian in Leyte, Dr. Rolando Borrinaga who was able to trace the origin of the bell and cross reference the Spanish inscription on the bell with records of parishes. Armed with that information, Father Chan of Sts. Peter and Paul wrote that letter to the US Military Academy Superintendent Robert Caslen. OXNARD, Calif. – Farm worker Maria Flores’s face breaks into a broad smile when she is told that soon her 14-year-old Mexico-born daughter, Ana, will be eligible for the state’s full-scope Medi-Cal program, under the Health For All Kids program set to launch May 16. Most importantly for Flores it will mean the teenager can soon have much-needed dental care. “Every time we take her to the dentist we have to pay from our pocket and we really can’t afford it,” Flores, an undocumented, fruit packaging plant worker here says in her native Mixteco through an interpreter. “It’s hard to pay because we make so little.” Flores’ emphasis on dental care is echoed by four out of the five farm worker women – almost all undocumented — interviewed on a recent Saturday afternoon gathering at a local elementary school organized by the Oxnardbased Mixteco Indigena Community Organizing Project (MICOP). Farther north, in the farming
community of Reedley outside of Fresno, mothers attending an ESL class for parents at the Jefferson Elementary School say the same thing. And at a day laborer center in Hayward, California, parents say they would be willing to set aside their fears over outing themselves as undocumented if their children would become eligible for dental care via MediCal, which is California’s name for Medicaid, the health insurance program for low-income people. Eligibility vs. access But eligibility for dental care and access to dentists are two separate issues. Assemblymember Jim Wood, Dem-Healdsburg, who was once a Denti-Cal (the dental arm of Medi-Cal) provider, says: “Beneficiaries are often frustrated to find out that having insurance coverage does not equate to easy access to care.” A scathing report released recently by the Little Hoover Commission (LHC), an independent oversight state agency, blasted the Denti-Cal program as being “dysfunctional” and having too few dentists in its network. “In California, we have kids’
teeth rotting out of their heads,” LHC Chairman Pedro Nava is quoted in a news report. Nava said that because of its “dreadful” low reimbursement rate — 35 percent of the national average of $61.96 per patient, a rate that has not been raised since 2000 — California dentists want nothing to do with DentiCal, making it virtually impossible for the more than 13 million current Medi-Cal enrollees, including 5 million children, having few places to use their coverage. In 11 of California’s 58 counties, there are no Denti-Cal providers at all, or no providers willing to accept new patients, according to a 2014 state audit. In Ventura County, for example where Flores and her family live, 53,000 kids are enrolled in DentiCal, but only 86 dentists accept it. Alpine County does not have a single dentist and in Imperial County, there is only one dentist for every 4,166 people, according to a UCLA Center for Health Policy Research report. Neglect The Hoover report says the blame for Denti-Cal’s shortcomings could be shared by the state

His Filipina employee Teresita Villaseñor, 56, formerly worked at a home in Hawaii where she took on 24-hour shifts and ate dog food. Villaseñor has worked for Schnair for about 18 months and works four 12-hour shifts per week with overtime pay and three days off. During a trip to New York, Villaseñor was also provided allowance. “[Robert] is the person I [look] up to right now, so I’m very, very proud [and] it’s not all miserable,” she said. Schnair, a Beverly Hills resident who formerly had a furni-
ture factory that employed 400 workers, said it’s important to treat domestic workers properly. “They have a life to live and they have obligations,” he said. As domestic work advocates work toward establishing an infrastructure for the industry, among measures being pushed for includes Senate Bill 1015, which would permanently establish overtime pay for domestic workers. Aquilina Soriano Versosa, executive director of Pilipino Workers Center, a non-profit organization serving Filipino workers, said there also needs to be more training in providing proper care for patients, such as those with dementia and Alzheimer’s.
But even with the problems associated with fixing the current system for domestic work, Versoza said the elder boom should be viewed as a blessing rather than a crisis. “Living longer means that we have more time to get to spend together, to learn new [skills], to love each other,” she said. “The question is how we want to live and age...Now is the time to ensure government policies and long-term care system actually reflect and support the realities of 21st century families so that families have the care that they need and then they can go and still participate in the community, in the economy and live full lives.” n

Department of Health Care Services — the agency that runs the program — the legislature and the Governor’s office. Decades of neglect and strategic misdirection have caused the DentiCal program to deny hundreds of thousands of people the oral health care they need. Assemblymember Wood says “the legislature has made it clear through multiple hearings that restoring Denti-Cal rates [to prerecession rates] should be made a priority. Unfortunately, so far it has not been a priority for the administration and the Governor.” In the last couple of years, California has come up with innovative ways to change its bleak dental health landscape, one of which is its Virtual Dental Home Demonstration Project. The sixyear program currently operates in 50 mostly underserved locations throughout the state. Traveling dental assistants Dental hygienists and assis-
tants travel to different sites performing such basic procedures as taking X’rays and installing temporary fillings that arrest early decay and scaling. If significant work is required, the patient is referred to a dentist. According to the University of the Pacific’s Arthur A. Dugoni School of Dentistry, which operates the Virtual Dental Home pilot program, more than 30 percent of Californians are unable to meet their oral health needs through the traditional dental care system. Some 54 percent of Medi-Cal-enrolled children received no dental care in 2012 and even fewer received preventive care services. Initially funded mostly by grants from non-profits and trade associations, since January of last year, virtual dental home procedures have been paid for by Medi-Cal. More recently, California implemented the Dental Transformation Incentive program, aimed

A fundamental right
THE Philippines joins the international community in marking World Press Freedom Day with one positive development: all the presidential candidates have committed to support the passage of the Freedom of Information law in the next Congress. Their commitment jibes with the theme chosen by the United Nations for this special day, observed every May 3: “Access to information and fundamental freedoms: this is your right!” As even the administration that has championed the so-called straight path has shown, however, it’s a long way from a best-efforts pledge to actual delivery of a promise. Especially when the commitments are given in the heat of a tough election campaign. FOI measures have been kicked around in Congress for many years now, with rejection usually given at the final moment, after the proposal has hurdled nearly the entire legislative gauntlet. Unreasonable and self-serving applications of a right of reply have also ensured the death of FOI bills. It is interesting to note that 2016 marks the 250th anniversary of the first freedom of information law, which still covers modern-day Sweden
and Finland. It’s no coincidence that both are among the most advanced economies, ranking high in transparency and governance. This year also marks the 25th anniversary of the Windhoek Declaration detailing press freedom principles. Apart from the FOI law, World Press Freedom Day 2016 is also dedicated to enhancing measures for the protection of journalists from censorship and surveillance overreach as well as from online and offline attacks. Do we even care to live a righteous life? Must we practice ethical decision making when inappropriate conduct is popularized by reality television? Do we even care if our government has ethical, honest public officials with qualified experience? Do we evaluate public officials’ actions to reflect our citizens’ interests? I was taken aback when TIME Magazine’s front cover depicted an African-American boy with this headline: “The Poisoning of An American City: Toxic Water. Sick Kids. And the incompetent leaders who betrayed Flint.” We sensed an upsurge of national outrage that after 18 months, the Michigan state government reversed its inappropriate decision of switching the water supply from Lake Huron to the Flint River to 15,000 service lines, which was described by CNN as a “notorious tributary that runs through town known to locals for its filth.” The residents reported seeing brown water from their tap. It was not sewage, but iron from Flint River, “considered 19 times more corrosive than Lake Huron according to Virginia Tech researchers,” as reported by CNN. With high iron content, the water mains got corroded. A simple solution of adding an anti-corrosive agent, phosphates, would have cost $100 a day, but the health effects came to be known to Dr. Mona Hanna–Attisha, who saw a cluster of patients with rashes and hair loss. Further testing of the water revealed not just iron but also lead, a neurotoxin, which, according to CNN, causes skin lesions, hair loss, vision loss, memory loss, depression, anxiety and learning disabilities. Flint has experienced an outflow of jobs since the car manufacturing industry left the city. As jobs left, so did families, that 15 percent of houses today are boarded up. About 100,000 live here, with the poverty rate at 40 percent. To solve this drinking water crisis, the federal and state governments have now switched back to Lake Huron as the supply source and handed out
water filters and hundreds and thousands of drinking water bottle. Three officials who tampered with the lead results have been served with arrest warrants. One official, Mike Glasgow, saw how lead results went up when the supply source was switched to the Flint River, yet he cooperated with the state Department of Environmental Quality officials. He alleges that Steve Busch and Mike Prysby called him to conceal lead levels higher than federal limits. Glasgow is now cooperating with the State’s Attorney General’s office in exchange for a felony being dropped to no contest plea to a misdemeanor charge. Will we see justice served to the citizens and children of Flint, Michigan? I hope so and with President Barack Obama’s visit, I hope to see our whole nation’s attention turn to Flint until the full resolution of changing pipes, testing of the affected children and exposing them early to preschool education to reverse any developmental disabilities from drinking the water. Hopefully, parents will stay vigilant in monitoring their children. Four families have joined forces to file a class action lawsuit against the government officials of Flint. Dishonest brokers of power and chaos We have many dishonest brokers of power and chaos, insisting that we ignore the laws, rules, regulations, and ethics and even deaden ourselves to the possible effects of the obnoxious, politically incorrect Donald Trump in the highest government office. But it is not just his mouth, which offends me. It is his thinking that he is a mighty above all thing human -- that he feels entitled to look down on Mexicans and to claim that they are mostly drug dealers and criminals, and that Muslims must be banned from America when close to 2 million are integrated in the American life, including fighting for American freedom in wars. Craig Considine wrote on Huffington Post about some of these decorated American heroes, who happen to be Muslims. “Muslims served in the U.S. military under the command of General George Washington, who was Commander in Chief of the Continental Army during the American War for Independence. While it makes sense to negotiate peace with the NPA, Duterte’s idea of a “coalition” grants the latter undue belligerent status. Are Duterte and Sison envisioning “power sharing”along the template that marked the dirty wars in Central America? Have we heard a single expression of outrage from the top brass of the Armed Forces of the Philippines or of the Philippine National Police over what Duterte and Sison said? Nada. Nothing. Zilch. Why is the silence of the military brass so deafening? Aquino has just appointed a new Acting AFP Chief of Staff, Lt. Gen. Glorioso Miranda. Will he choose to ignore Duterte’s in-your-face defiance – nay, in-your-face insult - of everything that the men under his command have been fighting and dying for? By the way, is former President Fidel V. Ramos, a former defense chief and former AFP chief of staff, still convinced about supporting Duterte despite his being a Communist coddler? No peep from Ramos, either. Duterte has told the US and the Australian ambassadors to shut up and has threatened to sever relations with the two countries if he ever assumes the presidency – because they protested his depraved remarks concerning a slain Australian lay minister. Meanwhile, here’s how a rabid pro-Duterte columnist in a major daily spun Duterte’s slamming of the foreign diplomats: “It is not really the Duterte remark on a beautiful Australian that offends. What offended the American and Australian ambassadors and the Filipino elite was that an obscure, uncouth, ill-mannered, common Filipino should break their stranglehold on the Filipino nation…That was the context of the anger against Duterte.” This columnist – who happens to be a woman - chose to completely ignore Duterte’s psychotic remark about wanting to ravish a rape and murder victim and chose instead to twist the topic to a purported foreign “stranglehold on the Filipino nation.” If you’ve ever heard a more non sequitur commentary, this one was it. And this person is sup-
posed to be an opinion maker? Good grief!!! Maybe Duterte – who is not famous for thinking before he lets bile spew out of his mouth – doesn’t realize the implications of his threat against the US and Australia. But surely the captains of Philippine commerce and industry understand the consequences of being dubbed a pariah in the international community. But have we heard even a word of caution against such a reckless actuation by someone who would be president of the country? Some Duterte fanatics have argued that the US and Australia need the Philippines as much as we need them and that they would never abandon our country, whatever the aggravation. These simpletons fail to see that turning the screws on our hapless country does not necessarily mean letting go of their strategic position here. They’ll just make life more miserable for the Filipino people, with greatest impact on the masses. And talk about the masses, it appears that there is a growing wave of support for Duterte among them because of the fantastic belief that he will rid the country of criminality and corruption in three to six months. And not just the masa – even supposedly intelligent individuals from the so-called Class ABC have been taken in by the double-talk. Apparently spurred by extreme frustration over the incompetence of the current administration and the endemic corruption in Philippine society, these people are willing to believe anything. No amount of logical explanation seems to convince them that Duterte’s promise is no better than that of a sideshow medicine man. As a matter of fact, on the basis of the fantasy of a crime-free and corruption-free government, they are willing to forgive Duterte for his profanity, his boorishness, his immorality and his oft-announced murderous tendencies. These people can’t even understand the fact that crime cannot be eliminated by someone who is, himself, guilty of criminal behavior, and justice cannot be dispensed by someone who has no respect for the rule of law. And about the promise of a corruption-free society, Duterte’s rabid admirers cannot see that Duterte’s mind, mouth, attitudes and entire being are so corrupt that he makes the hustlers at Customs and BIR look like altar boys. So how else do you convince the Duterte fanatics that voting their idol to Malacañang is like selfflaggelation and like banging one’s head against a stone wall? How do parents stop an emotionally disturbed child from doing drugs? How do they dissuade a daughter from running off with that married dirty

old man? How do you keep a whole nation of fanatics from pushing the country off the cliff? The exhortations of the Catholic hierarchy doesn’t seem to help. In a nation of Catholics, it has become fashionable for Catholics themselves to accuse the clergy of hypocrisy. It is also taken for granted that the Catholic Bishops Conference has more bark than bite and can never rally a Catholic vote. The activist women’s groups are up in arms against Duterte for making light of rape and debasing feminine dignity - but will their efforts be enough to stir the outrage of women voters? How do you convince a blinded, mesmerized, unthinking people – not just the so-called poor but also the wealthy and supposedly enlightened – that delivering the country into the hands of Duterte is virtual suicide? How do you make their simplistic minds see the light? Then the other day, I stumbled upon a posting on Facebook by a certain Mike K. Cohen. It seems that in Cohen’s view, dealing with simpletons may also require a simplistic explanation of the consequences of a Duterte presidency, particularly that part about severing ties with the US. I quote the post, as follows: “A few people are smiling about the bravado of a comment of Rody Duterte on severing ties with US if he wins. The impact of that short list:

Wong’s lawyers turned over $4.63 million last April 1 and another P38.28 million last April 4 to AMLC executive director Julia Bacay-Abad. Bangladesh Ambassador John Gomes witnessed the turnover. Through his lawyers, Wong turned over another P200 million to the AMLC last April 18 and the remaining P250 million yesterday. The entire P450 million represents a debt paid by Gao to Wong. Last April 5, Wong committed to return the entire amount, which he said was money stolen from the Bangladesh central bank. He asked the Senate Blue Ribbon committee for 15 to 30 days to raise the money. “May 5 is the last day of the 30 days that I had requested from the Senate Blue Ribbon committee to return the P450 million,”
he said in a statement in Filipino. “So now one day before the deadline, I am returning the shortage of P250 million.” Wong said he borrowed P200 million from Solaire Resort and Casino, while the rest was borrowed from “well-meaning” friends. “It was not easy to come up with this amount,” he said in Filipino. “Many friends helped me raise the money. They saw that I have been pinned down so they volunteered. The first P200 million that was returned came from Solaire. It was used to pay my debt, which they loaned me again.” Wong said he is returning the “dirty funds” because his conscience is clear. “I would like to show that my conscience is clear,” he said in

MALACAÑANG is mourning the death of former Foreign Affairs Secretary Domingo Siazon. “We pause in tribute to Domingo Siazon, former secretary of foreign affairs (1995-2001) and Philippine ambassador to Japan (1993-1995 and 2001-2010),” presidential spokesperson Edwin Lacierda said in a statement on Wednesday, May 4. “Respected by his colleagues in the foreign service, his peers abroad, and by presidents and the public alike, he belonged to the second generation of career diplomats who served with professionalism and who rose according to merit,” he added. Lacierda called Siazon, who served under former President Joseph Estrada’s Cabinet, “a cultured, urbane man.” He said the secretary left behind a record of “distinguished service” to the country and that he had brought honor to the Philippine flag wherever he
served. “We extend deepest sympathies to his family at this time of profound loss,” Lacierda said. Siazon’s son Dan posted on Facebook early Wednesday
that his 77-year-old father had passed away. He said his father was a “statesman, career diplomat, but more importantly, a loving husband, father and grandfather.” n

MANILA – An impeachment complaint against Chief Justice Maria Lourdes Sereno and eight other justices of the Supreme Court (SC) who ruled in favor of Sen. Grace Poe’s presidential bid was presented to the House of Representatives on Wednesday, May 4. The House did not accept the complaint of Teofilo Parilla for lack of endorsement from any member of the chamber, which is required by law. Parilla told journalists he is a resident of San Andres, Manila engaged in political consulting. He refused to name any client he is representing. He accused Sereno and Justices Lucas Bersamin, Alfred Benjamin Caguioa, Francis Jardeleza, Marvic Leonen, Jose Mendoza, Diosdado Peralta, Jose Perez and Presbitero Velasco Jr. of violating the Constitution and betraying public trust for declaring Poe qualified to run in the presidential race. Meanwhile, Poe is optimistic that Sereno and the eight jus-
tices can withstand any impeachment complaint that may be filed against them. “I believe the Supreme Court will be able to defend their ruling,” Poe said on the sidelines of her campaign sortie in Lucena City, Quezon. While she respects the filing of the impeachment case, Poe cited the positive outcome of the SC decision, which recognizes the rights of foundlings in the country. “If there’s anything good that came out with my candidacy, it is the recognition of foundlings as citizens of the state. Is it disadvantageous to give equal rights to every child found abandoned in our country?” she said. Unlike other presidential candidates who are facing corruption charges, Poe said she did not steal from the people nor strip any individual of their integrity. “These people who threaten impeachment are selfish and are only thinking of the candidates they are supporting,” Poe said. The SC had reversed a decision of the Commission on Elections (Comelec) disqualifying Poe for her citizenship and lack of residency.
The high tribunal said the Comelec committed grave abuse of discretion when it disqualified Poe from the elections, but did not rule on the issues of citizenship and residency. Parilla said the SC should have first resolved the issue on Poe’s citizenship and residency before declaring that the poll body committed abuse of discretion. On citizenship, he said seven justices – Sereno, Bersamin, Jardeleza, Leonen, Mendoza, Perez and Velasco – shared the view that Poe is a natural-born Filipino. Five justices – Estela Bernabe, Arturo Brion, Antonio Carpio, Teresita de Castro and Bienvenido Reyes – believed Poe is not. Parilla said Caguioa and Peralta refused to decide on Poe’s citizenship, while Justice Mariano del Castillo did not give his opinion. On Poe’s residency, Parilla said Sereno, Bersamin, Jardeleza, Leonen, Mendoza, Perez and Velasco opined that the senator has complied with the 10-year residency requirement. But Bernabe, Brion, Carpio, De Castro, Del Castillo and Reyes believe otherwise. n

In a separate statement, Tan said that “despite having been cleared of any wrongdoing, as president and CEO of RCBC, I take full moral responsibility for this sad incident in the history of the bank.” “With a heavy heart, I feel the time has come for me to move on and provide my services elsewhere,” he added. Tan was implicated in the issue after the bank’s former Jupiter Street branch manager Maia Deguito said he asked her to “take care” of valued client Kim Wong, a casino junket operator whose Chinese client was said to have brought in funds that were later found to have been stolen from the Bangladeshi central bank. Tan has denied this accusation, and filed civil and criminal cases against Deguito and her lawyer for libel and perjury. Tan joined RCBC in 2007, overseeing the expansion of RCBC’s network from 294 branches in 2006 to 475 as of March 2016; ATMs, from 257 to 1,405; and customer base from 800 thousand to 7.32 million. Last year, RCBC posted a net income of P5.1 billion, up 16.3 percent from 2014. In a statement, Tan expressed his gratitude to the shareholders,
officers and customers of RCBC. “As I move on to new things, I am confident the bank will continue on the path of growth, with the strong and capable hands of senior management led by Mrs. Dee,” he said. RCBC’s investigation headed by its external lawyers and SGV & Co. cleared Tan of any knowledge, involvement or participation in the unauthorized transfer to RCBC of the funds stolen from Bangladesh Bank. “As shown by RCBC’s own investigation, the allegations of my involvement in the current money-laundering issue are unfounded and baseless.” Tan added, “Despite my resignation, however, I am committed to help uncover the truth, not only to clear my name but also to bring justice to the Bangladeshi people.” An earlier disclosure to the Philippine Stock Exchange showed that RCBC’s total deposits declined 7 percent to P317.4 billion as of end-March from P342.5 billion at end-2015, representing a decline of P25.1 billion at the height of the money laundering scandal. n

MANILA — China wants a “new chapter” with the Philippines regardless of the decision of the Permanent Court of Arbitration under the United Nations on the South China Sea case, a Chinese diplomat said. Chinese Ambassador to the Philippines Zhao Jianhua said that the two countries should focus on “areas that we can benefit.” “Of course, we have differences. We hope that we can handle it properly and we should not let the focus be these differences,” Zhao told members of the press on the sidelines of the celebration of the 25th anniversary of the European Union-Philippines relationship. The Chinese diplomat added that China and the Philippines should instead focus on its bilateral relationship. Zhao cited that China was able to resolve its territorial disputes with Russia and Vietnam through bilateral dialogue and negotiation. “It did take a very long time for China and Vietnam to reach an agreement over land border, with Russia nearly half a century but these are treaties. MANILA — A Chinese diplomat has asked politicians and media outlets in the United States and the United Kingdom to stop meddling in the South China Sea dispute. “The issue of the South China Sea is being ramped up by those in the US and the UK who accuse China of causing tension in the region. They proclaim the principle of free navigation and overflight but in reality their prejudice and partiality will only increase tension,” Chinese Ambassador to Britain Liu Xiaoming said in a signed letter to The Times. Liu stressed in his letter that China was the first country to discover and name the islands and reefs in the disputed waters. The Chinese diplomat claimed that more than 40 of the islands in the region are being illegally occupied by other countries. “China’s construction on its own islands and reefs is a matter for us. These actions are not targeted at any other country,” Liu said.
Liu also denied that there is a threat to the freedom of navigation and overflight in the region as more than 100,000 vessels pass through the sea unimpeded every year. The diplomat defended China’s position of rejecting the arbitration filed by the Philippines under the United Nations Convention on the Law of the Sea, stressing that it has made a declaration in 2006 to exclude compulsory arbitration on sovereign disputes and maritime delimitation. “Some countries outside the South China Sea claim to be taking no side in sovereignty disputes, but that are actually doing all they can to get involved. The military vessels and planes they sent to the region and the accusations they throw at China only encourage certain countries in the region to behave even more recklessly, increasing the tension,” the Chinese diplomat said. Liu reiterated that nations should desist from “meddling and muddling” in the sea dispute as it would pose a threat to regional stability and world peace. n

The most demanding view of motherhood is this romanticized notion: that no woman is complete or fulfilled unless she has kids. In addition to this, the world’s view about motherhood is that she must remain the best primary caregiver of her children, devote her entire physical, emotional and intellectual well-being 24/7. This old perception seem to celebrate motherhood on the surface, but in reality promulgates a standard for mothers that is almost beyond reach. however, mothers of today are more progressive, skipping the 1960s feminine mystique. Now, mother can do work outside the home, set up a business, report the news, wear a stethoscope or sell real estate. She is able to go with the terrain of breaking down barriers, by starting with one brick in the wall of her motherhood. She can also choose to have her own ambition and career, raise children

THE thought of flying halfway across the world for more 12 hours is sometimes too daunting for many people. Paintings of various creatures grace the temple walls, while stone statues of mystical creatures stand guard on the temple grounds. Citizens from India, Thailand, Philippines, Vietnam and Indonesia who have a valid visa or hold a permanent resident certificates from US, Canada, Japan, UK, Schengen countries, Australia or New Zealand are also eligible to avail and participate in the Free Half-Day Tour. Remember, however, that you must have a valid travel documents, such as your passport and a completed immigration disembarkation card. The Taiwan Tourism Bureau and China Airlines make it easy for passenger to participate in the Free Half-Day Tour. All you have to do is book a tour upon your arrival at the airport at the designated Tourist Service Center in the Arrival Lobby. One thing to keep in mind: passengers can join only one tour
during each stopover. It is also worth nothing that the tour is offered on a first come, first serve basis, with each tour limited to 18 passengers. For group application of four passengers or less you may email your application to the airport at cks@tbroc.gov. tw within 10 to 5 working days prior to your departure date. However, for bigger group of five passengers or more, the application must be sent directly to Taiwan Tourism Bureau’s head office at tinghung@tbroc.gov. tw within one month or 14 days prior to departure date. Wi Spa: an urban sanctuary in the heart of La THINK of a spa and the immediate perception is an air of pretense and privilege that only a select few can indulge in, given the exorbitant prices. However, if you live in Los Angeles, Korean spas have sprouted up, contributing to the idea that pampering oneself and affordability are not mutually exclusive. Though the options are abundant, among the best is Wi Spa, known as the “Disneyland of Korean day spas.” While there
are no shiny bells and whistles to it, the spa certainly lives up to its reputation as an urban sanctuary, and it’s family-friendly too. Prior to venturing into a Korean spa, one must understand the significance it plays in Korean culture: a communal place for friends and families to gather, bathe and receive the therapeutic benefits rooted in ancient bathhouse traditions. Conveniently located in between Koreatown and Downtown,
Wi Spa itself is an expansive, multi-level facility (48,000 square feet, to be exact) that blends the bathhouse tradition with the modernity of marble and glass interiors. It is open 24/7, so you can go anytime, even on a whim. Enter Wi and the process of unwinding begins. For starters, valet parking is complimentary to relieve you of the stress of having to find parking, especially when there are a lot of guests checked in. With the $25 admission fee, you gain full access to amenities like a fitness room, pools, showers, saunas, a restaurant, and the rooftop deck. A wristwatch is given as your locker key and form of identification during your stay. The rush of cramming in the day spa experience and trying out all the rooms is practically gone, as you are welcome to stay for hours on end. There are spaces to lounge in between services and even designated “sleeping rooms” for those who want to doze off in peace. Wi is divided into gender-specific floors, where the spa and other facilities are located, as well as locker rooms and changing areas. For Korean spa newbies, it’s best to take a shower once you get settled in to wash away the day’s grime (dirt and the tubs do not make a great combination) and to ensure you get the maximum benefits of anything you decide to do, like sweating it out in the sauna. Outside the bathing areas, you’ll find changing rooms, complete with vanities and toiletries. And take this as a fair warning to expect nudity from guests of the same gender, but any judgments and awkwardness should be left at the door. If you want to treat yourself further, the spa offers a menu of body treatments at the fraction of the price tag you’d find at a spa
elsewhere in the city. Better yet, if you purchase a treatment worth $110 or more, the entrance fee is waived. The usual spa treatments, like acupressure massages, facials, manicure/ pedicure, can be booked by reservation. But one must try the full-body scrub, perhaps Wi’s signature offering. Based on the traditional Korean technique of buffing, the scrub entails a procedure of sloughing off dead skin cells with an exfoliating towel, as you lie down on a table and get doused with water every so often. It may take a few minutes to get accustomed to the intensity, but the person (of the same gender) administering the service repeatedly asks you if you’re doing fine. The service can last 35 minutes ($30) or can be reserved as a $90 package complete with the scrub, aroma oil massage, a face mask and hair shampoo, which all lasts for 90 minutes. Depending on one’s pain tolerance, the impression afterward may vary, but you’ll feel cleaner after the dead skin is washed off to make way for the lasting effects of radiating, supple skin. On the co-ed floor (called the Jimjilbang, which translates to “bathhouse”), guests are required to wear the yellow T-shirt and khaki shorts received upon check-in. There you’ll find families and couples convening at one of the five specialty sauna rooms, noshing on Korean cuisine staples at the full-service restaurant, or taking in fresh air on the rooftop deck. The floor also features a kid’s area, a library and computer room. It’s worth noting that the five sauna rooms—Bulgama, Salt, Clay, Jade and Ice—boast unique characteristics that contribute to the detoxification and healing powers. The Bulgama is set at 231 degrees, inviting guests to lie down somewhere between 10 to 15 minutes to sweat out toxins
from the body; Salt features minerals to purify and strengthen the body; layers of clay improved from Korea are placed in the Clay sauna to aid in lymphatic stimulation and heavy metal detoxification; the Jade room is hot to relieve any tension and stress; and the Ice sauna is recommended to end your visit to cool the body’s temperature, tighten the skin and improve circulation. If you felt like you’ve detoxed enough from technology, free Wi-Fi is provided throughout the building to bring you back from your moment of zen, as are TVs
in lounge areas. Before you leave, don’t forget to take another shower and close out your tab. Ho And nAncy Miller US Citizenship and Immigration Services (USCIS) has released long-awaited policy guidance for adjudicating O nonimmigrant petitions in cases where comparable evidence is introduced as an alternative standard. The government grants O-1A and O-1B visas to those individuals of objectively “extraordinary ability” in the fields of science, education, business, athletics or the arts. Ballet dancers and choreographers, Olympic champions, movie and TV production crew, pioneering researchers and professors, innovative artists and designers, fine dining chefs and Nobel Prize laureates are just a few examples of individuals who can be eligible for an O visa. For many, the challenge of a successful O petition is convincing the government that the body of achievement submitted rises to the level of “extraordinary ability” and relates to the requested period in the United States. Normally, the beneficiary can demonstrate “extraordinary ability” by submitting evidence listed in the regulations—such as awards, publications, and other widely recognized distinctions—that prove that the individual is operating at the highest level in their field. In some cases, demonstrating extraordinary ability in particular fields does not neatly comport with the list of acceptable evidence. For those individuals, the “comparable evidence” provision exists as a catch-all umbrella for USCIS to accept equivalent forms of evidence not enumerated in the regulations. However, in order to even use this provision, petitioners have had to first establish that the majority of the listed criteria do not readily apply to the beneficiary’s occupation. Once that case is made, only then will USCIS consider the comparable evidence provided. USCIS’ new guidance firmly does away with this numerically
O Visa: New guidance for individuals of extraordinary ability driven requirement. USCIS will now consider equivalent, comparable evidence in support of the beneficiary’s claim of extraordinary ability instead of disregarding it if they believe other means listed in the regulations would suffice. By interpreting the regulations in a more open manner, the government acknowledges that extraordinary ability in an occupation can fit more than one conventional measure of achievement. Comparable evidence can now be considered on equal footing with the other listed evidence in the regulations rather than a last resort alternative after other avenues have been exhausted. By allowing comparable evidence to be more readily considered in adjudications, the government has expanded the scope of O visa eligibility to be more fair and inclusive. In this day and age, innovative or unconventional occupations that nonetheless entail extraordinary ability should be eligible for O visas and the government’s new guidance concurs with this new reality. In the policy memo, USCIS lays out how officers should now adjudicate O visas when a beneficiary wishes to use comparable evidence. If a particular criterion in the regulations does not apply to the beneficiary’s occupation, the comparable evidence provision can then be used to provide additional relevant evidence even if other listed means are available.
Before, USCIS officers would deny O visas on the grounds that the other listed evidentiary means were not exhausted. Now, the guidance states that summary denial should not result in those grounds. Some guidelines apply for employing comparable evidence. First, the petitioner must explain why a particular evidentiary criterion is not easily applicable to the beneficiary’s occupation. Second, the petitioner must give an argument for why the submitted comparable evidence is equivalently significant. Third, even with the revised acceptance of comparable evidence in O visa adjudications, petitioners must still take care to satisfy O eligibility requirements under the regulations. Additionally, the standard of review for establishing eligibility requirements of the O-1A and O-1B remains a preponderance of the evidence—the petitioner must show that what it claims is “more likely true” or “probably” true. Nevertheless, this is undoubtedly good news for those individuals of extraordinary ability who may have less recognizable accolades of excellence. Although we will have now have new considerations on how to approach O-1A and O-1B petitions, USCIS’ guidance shows that the government is willing to take a less rigid position on these nonimmigrant

1. YOUR legal marital status is determined as of December 31 of each year. Even if you were married for the previous 364 days if you were divorced on the 365th day of the year, you are considered unmarried for the entire year. 2. You can file single only if you receive a final decree by the end of that year. If you do not receive a decree by the end of the year, you cannot file as a single taxpayer. A couple living under a legal separation agreement but without any court decree is not legally separated for tax purposes because such an agreement could be abrogated by the parties upon reconciliation and resumption of cohabitation. 3. If you don’t get the final decree by end of year and you cannot get together without fighting, then you are forced to file married separately (higher rates, folks). 4. You may file as head of household to take advantage of lower tax rates if you paid more than half the costs of maintaining your home for your child (provided your spouse did not live with you from July 1 to December 31). By so doing, you may claim the standard deduction even if your spouse itemizes on a separate return. 5. Community property states require that community income be split unless you live apart for the entire year (the following are community-property states:

Because of the income tax consequences of divorce on both parties, you have to plan four areas of concern: child custody, property settlement, child support, and alimony. 7. A problem arises when there is no clear-cut distinction between alimony (deductible by payor, taxable to recipient) and child support (neither deductible nor taxable). Payments are merely described as “family support.” Alimony must terminate on the death of the recipient. Most family support agreements do not include a provision for support to terminate on the death of the payee; therefore, payments fail to qualify as alimony and become nondeductible/nontaxable child support. 8. If the divorce decree does not specify who is entitled to the dependency exemption, the parent with the custody for the greater part of the year gets it. The noncustodial parent must attach form 8332 to the tax returns. (Tip: If you are the non-custodial parent, have your spouse sign Form 8332 for all future years while you are at it instead of fighting for it every single year in the future. 9. No gain or loss is recognized on property transfers that are incident to a divorce. This rule applies when properties are transferred within one year after the marriage ends or even within six years if it is made under a divorce or separation instrument. 10. Before you insist on keeping the house, consult your tax
adviser on new rules on the exclusion of gain on the sale of personal residence. 11. Palimony payments to a live-in companion do not qualify as alimony. It’s not income to the recipient and not deductible by the payer. Palimony may even be subject to gift tax. 12. A problem arises when an employee’s retirement plan is distributed to the ex-spouse. Distributions made to you as an employee are taxable to you while distributions made to your spouse are taxable to him/her. In a community property such as California, the IRS has ruled privately that a participant employee is not taxed on the spouse’s interest. (Tip: Guard against paying tax on what your ex-spouse receives by including such provision in a Qualified Domestic Relations Order (QUADRO). Remember also that early distribution to your spouse is exempt from the 10% excise tax penalty. Your ex-spouse can also rollover distributions from an IRA to defer taxes.

Five benefits of establishing a revocable living trust

THERE is never the perfect time to think about who you would like to inherit from your estate in case you pass away or at least who among your closest friends (BFFs) and family members are even deserving of inheriting from your estate. In doing so, you should also think about which vehicle you plan to use in implementing your estate plan. One of the best vehicle in implementing your estate plan is a revocable living trust. Five major benefits of establishing a revocable living trust are: Your estate can avoid the time, cost, and hassle of going through the probate court process. If you pass away without a will (intestate) in California, one of your close family would have to file a petition in probate court to probate your estate. Your estate will be divided and distributed according to the California probate code rules of intestate succession. Even if you have a will when you pass away, your family would still need to file a petition in probate court if your estate is worth over $150,000 and go through the probate process. This can become a circus if certain beneficiaries contest the validity of the Will or the distribution of the estate. Your estate will pay for attorney’s fees, probate referee fees, appraisers and other experts, CPA fees, etc. If people contest the case, your estate would end up paying legal fees to defend the estate in litigation. The entire process can take anywhere from 9 months to years depending on the contentiousness of the probate case. With a revocable living trust, your trustee or successor trustee if you were the initial trustee, would administer the trust and
distribute the estate according to the trust document without having to open a probate court case. If the trust is funded with all your assets, it is possible to administer and distribute the trust assets without any Court involvement at all. This process is a lot faster than going through probate. Your estate is not public record When you file a probate case, the public has access to your probate case file. The public will know the assets of the estate including the values of those assets. If the Will is admitted into probate, the terms of the Will is open to public scrutiny. Establishing a revocable living trust makes your estate affairs private. Strangers do not have access to the terms of your living trust. Only certain beneficiaries and possible heirs can request a copy of the revocable living trust after you pass away. You can dictate who will inherit from your estate If you pass away without a Will, your estate will be divided and distributed in Probate Court following the rules of intestate succession in the California probate code. Certain relatives will be entitled to a share of your estate even if you feel they are not deserving. By establishing a revocable living trust, you can designate who you want to inherit from your estate. You can designate what and how much each one will received from your estate after you pass away. The assets distributed to each beneficiaries does not have to be equal. The people you designate as beneficiaries of your living trust does not even have to be close family members. You can designate anyone as a beneficiary, with certain exceptions, of your estate. You can structure your estate to minimize estate taxes If your estate is valued above the estate tax exemption, establishing a trust can allow you to divide up your estate into smaller sub trusts to minimize the overall

visas. Overall, USCIS asserts that it will assess the petition on both the quality and quantity of evidence offered. Arbitrary dismissal of good, probative evidence, which aggrieved past O-1 hopefuls, should hopefully be an uncommon occurrence. A final version of the policy memorandum should be released by the end of this year. Throughout the time that Olivares worked for CDG, she was often subjected to offensive sexual comments and conduct from Dason. Dason told Olivares sexual jokes, made comments about her body, leered at her, and inquired about her sexual habits. Dason would inappropriately touch Olivares on her arms, her bare knee, and stare at Olivares’ breasts in a sexual way on many occasions. Once, Dason grabbed Olivares buttocks. When Olivares objected, Dason apologized, and promised not to do it again. However, a few months later, Dason again grabbed her buttocks on two separate occasions, and on one occasion, her breast. Olivares had complained to her manager several times about Dason’s conduct but the harassment did not stop. Olivares confronted Dason about his unwelcome touching. In re-
sponse, Dason stated that Olivares has an attractive smile and it was hard for him to stay away. He apologized, and promised to try not to behave inappropriately. Olivares, a woman in her early twenties, fresh out of dental school, with a young daughter she was supporting on her own, could not afford to lose her job and so tried to keep working in this environment. In January 2013, Olivares requested a raise from the company but Dason, the company owner, told her that he would give her a raise if she agreed to go to Las Vegas with him when his wife was out of the country. Olivares was forced to quit. She then sued the employer for wrongful termination and sexual harassment. Courts have recognized two types of sexual harassment. The first type is called quid pro quo harassment. This harassment typ-
ically exists when submission to a sexual conduct is made a condition of employment benefits, such as a promotion, a pay increase, or a job itself. In Olivares’ case, Dason offering to give her a raise in exchange for her going with him to Vegas may be considered quid pro quo harassment. The second type involves harassment created by a “hostile environment.” This claim may arise where unwelcome sexual conduct unreasonably interferes with an employee’s job performance or creates an intimidating, hostile or offensive working environment, even if it does not lead to tangible or economic job consequences. In the Olivares case, Dason’s unwelcome and offensive sexual comments and inappropriate touching of Olivares despite her requests to stop created a hostile work environment for Olivares, even if there

This question is what we should ask one another and ourselves as we celebrate Ascension Sunday. For it seems that an “enlightened heart” is what each of us needs to move on with hope in our lives. An “enlightened heart” is one that has witnessed the truth and the wisdom of God and now believes in their power to save and transform the world. In the case of the disciples of Jesus Christ, it was the person of Jesus—his life, death, and resurrection—that their hearts had witnessed as truth and wisdom. For this Truth and Wisdom, the disciples were willing to offer their lives in service to God and His people. In the Gospel this Sunday, Jesus would never have moved on to ascend to his Father if he wasn’t sure that his disciples had never witnessed and believed in this Truth. He wouldn’t entrust to them the mission of his Father to go out to the whole world to proclaim and teach the truth

Debt Relief Atty. LAwrence yAng I GOT my senior’s week last week. Two different seniors, both over 80 came to see me for different reasons. The first was 83. He was in good health, just a little stooped. Still works full time and receives social security. Wife receives a small social security. He and his wife live with their son, so they have no mortgage or rent expense, which is good. He has a new car and pays a car loan of $400. He wants to keep the car. He has an old car that he used as collateral for a high interest loan. He does not want to keep the old car because the high interest loan requires $500 a month at 50% annual interest. Yes, that’s pretty high interest for a secured debt. His problem is $35,000 of credit card debt that he has kept current for the last 15 years, paying $1,000 a month. He though it wasn’t such a great idea keeping them current in the last 15 years because he already forked over $180,000 in the last 15 years to keep them current, and surprise! He still owes the same $35,000 now. He thought he certainly would have been happier now if he had that $180,000 in his pocket. He could take his wife, his sweetheart of 60 years cruising all over the world and pay cash for those cruises. His wife wanted to take a cruise to the Greek isles and the Mediterranean coast, maybe spend a couple of days in Barcelona, enjoying the artwork of Dali and the whimsical architecture of Gaudi. He wanted to see the office of the Philippine tobacco company, which was in Barcelona when the Spaniards were still lording it over the islands. He said his grandfather worked for that company his whole life and all he got from it was a gold plated watch and a gold plated cigar. Not even a good pension that he could live with. Why was your grandfather a Spaniard, I asked? He was an illustrado, he said, with a moustache that made him look like Pancho Villa. I asked him if he could still speak Spanish and he said “Claro que si, senor abogado.” In fact, he told me that he still had many relatives in Barcelona, that’s why he wanted to bring his sweetheart to visit, and he wanted to meet all his Spanish relatives. Well, I told him that if you had gotten rid of your $35K of credit card debt 15 years ago with a Chapter 7 petition, then today, you could actually buy a condo in the south coast of Spain, and retire there with your sweetheart for a quarter of the cost of living in LA. Instead of being able to retire there with a fully paid condo overlooking the tranquil Mediterranean, you now have to get rid of your $35K of credit card debt, and live in a tiny room with your son. Think about the opportunity you missed to live in the South coast of Spain now, just because you wanted to keep your $35K of credit cards current for 15 years. And even if you prefer to live here in LA, the $180K of cash in your pocket, well managed, can give you an extra $700 of income a month which you can use to indulge what you and your wife want to do now. Otherwise, you wake ip everyday and just stare at each other, or watch TV the whole day. Not really an exciting way of living your golden years, is it? He chooses to file a Chapter 7 to get rid of $35K credit cards even though it’s way late. Better late than never. The second senior is 80. His
wife passed away recently. They have no children but have a lot of relatives who owe him money. He and his wife were generous in lending a helping hand to their relatives when they were younger. $50K to a cousin who wanted to buy a UPS store. $40K to a brother who wanted to buy a restaurant. You know what I mean. The money lent has stacked up over the years and have not been repaid. He feels unsecure now because he has maintenance expenses now, which are escalating. Just the caregiver costs $2K a month. Well, the problem of course is that it’s easy to lend out money, but it’s very difficult to collect. First off, would be to file lawsuits to collect. So, at least you end up with money judgments that accrue legal interest at 10% yearly. In addition, placing judgment liens on real property can enforce these money judgments, wages can be garnished, and bank accounts can be levied. This is a lot better than waiting for his beloved relatives to start paying him back, which knows when. The truth is, which is better left unsaid, beloved relatives are probably waiting for client to kick the bucket so they can forget about paying him back. After all, he won’t need cash in heaven, would he? Nope. The third client is a young senior at 58. She is a single mom with a good paying job as a registered nurse. She has two kids in college who need support. Her problem is $50K of credit card debt. The choice is making minimum payments of $1,500 a month to visa and MasterCard, or giving the $1,500 to her college kids to help them pay their rents in out of state colleges. It’s a no brainer. Client decides to discharge her $50K of credit card debt with a Chapter 7 petition. “This poor man cried out, and the Lord heard him, and saved him out of all his troubles. The Rodel G. without your petitioning spouse’s participation
A PERSON who obtains his/her green card via marriage to a US citizen spouse, and who is married for less than 2 years has conditional permanent resident status. A conditional permanent resident has a green card that is valid for 2 years. In order to continue to have permanent resident status after 2 years, the conditional permanent resident and his/her US citizen spouse must file an I-751 Petition to Remove Conditions on Residence during the 90 days before the expiration of the green card. 8 CFR 216.4(a)(1) But what if things don’t work out with the US citizen spouse after getting married, and the conditional permanent resident can no longer get the participation of his/her US citizen spouse in filing the I-751 petition? In such a case, the conditional permanent resident may seek an I-751 waiver of the joint filing requirement. In order to qualify for an I-751 waiver of the joint filing requirement, the conditional permanent resident must show that the marriage upon which his/her status was based was: 1) entered into in good faith, and 2) terminated. 8 CFR 216.5(a)(1)(ii) With respect to the required showing that the marriage was entered into in good faith, the conditional permanent resident must show that his/her marriage was not a “sham.” A marriage is considered a “sham” if, when they married, the couple did not intend to establish a life together. An intent to obtain something other than or in addition to love and companionship (such as a green card) from that life does not make a marriage a sham. Matter of Soltan, A76 888 125 (BIA 2001). Documents such as joint bank and credit card statements, and photos that demonstrate that the marriage was entered in good faith should be presented. Also, in order to qualify for an I-751 waiver of the joint filing requirement, the conditional permanent resident must show that the marriage was terminated. By “terminated,” the USCIS requires a valid, formal divorce judgment. An I-751 waiver of the joint filing requirement cannot be approved in cases where the conditional permanent resident is legally separated or in divorce proceedings that are still pending. It is worth noting that if the conditional permanent resident and his/her US Citizen spouse live in California, a valid divorce judgment must be obtained in the California courts. I have had numerous California-resident clients in the past who have obtained a “quick” divorce judgment in Nevada only to face USCIS scrutiny after presenting the Nevada divorce judgment in support of an I-751 waiver request (since one must be a Nevada resident to obtain a divorce in Nevada). The Census quarterly reports will have a new racial category for AAPIs starting in July 2016. Previously, AAPI data was aggregated under the category of “other” ethnic groups in these reports, AREAA explained. With support from AAPI legislators and community leaders, AAREA initiated a “No Other” campaign, asking the Census Bureau to create a unique category for AAPI homeownership in the quarterly report. “This historic change is the result of tireless work on part of many individuals and organizations, particularly AREAA
members and chapters who campaigned hard to be heard throughout the country,” said Vicky Silvano, AREAA National Chair. “We thank the Congressional Asian Pacific American Caucus, especially Congressman Honda for his support and guidance throughout the process, the White House Initiative on Asian American and Pacific Islander (WHIAAPI) as well as community and business partners. MANILA—The country’s commitment to slash carbon emissions nearly three fourths by 2030 is likely to take its toll on the economy, the Philippine Chamber of Commerce and Industry (PCCI) said. The country’s largest business organization said it sees a 70-percent carbon emission cut too high for industries, small and medium enterprises, and consumers. In a letter to Climate Change commissioner Emmanuel de Guzman, PCCI president George Barcelon said his group supports a government initiative to cut carbon emissions and promote environmental sustainability, but how the government plans to achieve its 70 percent commitment could affect the growth of the economy.

MANILA—The Philippines must sustain the robust growth of its economy across three to four administrations—with progress shared equitably—for it to be considered a developed nation within 25 to 30 years, said Philippine Competition Commission chairman Arsenio Balisacan. In a roundtable discussion with The Star’s business section Monday, May 2, the former socioeconomic planning secretary said a level playing field in business is key to ensuring the sustainability of the country’s economic growth. “We’ve had a quite respectable economic performance, a 6.2 percent growth average in six years. That is not something that you can easily dismiss,” said Balisacan. “But a country growing at six percent annually is not expected to sustain that growth if it is not inclusive,” he added. Balisacan said the lack of a competitive environment in an economy would disrupt its growth potential. “So the issue of sustainability is crucial. There is also enough empirical evidence that countries that have no competitive environment, where the benefits are not shared broadly, tend to crash. This growth has to be sustained

PCCI asked the commission for the specific mitigation options that would lead to the 70-percent cut, noting that the 40-percent reduction supported by the private sector is already the threshold by which industries could reduce their carbon emissions. “We are very much concerned on how this 70 percent commitment will impact on industries especially those in the manufacturing sector and the small and medium enterprises,” Barcelon said, as he urged the government to assess the effect of a high target for gas emissions on the national economy. MANY people were ordered removed/deported “in absentia” (in their absence) because they did not appear at their removal hearing. However, if they were not properly notified of the hearing date, there could be hope to have the case reopened and have the removal/deportation order canceled. By law, an alien must provide the government with their current address and let the government know if they move or have a change of address. But, if the government then sends the hearing notice to an old or incorrect address, this could be a basis to have the case reopened. There was a recent court case, where an alien was picked up and provided the immigration officer with her current address. The immigration officer issued a Notice to Appear (NTA), listing her previous address, and then later sent a notice of the date and time of the hearing to that same old address. Naturally, the alien failed to appear at the hearing, because she never received the notice. The court held

that because the government sent the hearing notice to the old address after the alien had notified the government of her current address, it was improper to have her ordered removed in absentia. If you have been ordered removed, but did not receive proper notice, you should consult with an attorney, who can evaluate your case and advise you on the best course of action. However, be aware of the following: • If you received a hearing notice sent to your current address, but were just too afraid to go to the hearing, this ruling would not necessarily apply to you, as it deals with situations where the person did not receive notice. • The government would want written proof you notified them of your current or new address (i.e. certified letter, AR-11, etc.), versus your mere “verbal” testimony, such as “I made a phone call and told the person I moved. But I did not get their name and there is nothing in writing to prove my story.” (However, in the above case, the alien verbally provided the immigration officer of her new address. But written proof is better and stronger).
• If you will seek to reopen your case, it would be a good idea that you already have a “form of relief” available to you, or an immediate way to get a green card, such as you may have married a US citizen, your U.S. born child is now over 21, etc. It may not do any good to have a case reopened if you do not have a way to get a green card at that time. This is because the judge may reopen the case, due to your lack of notice, and just re – order you removed. • It is also important to evaluate the reasons you were originally placed in removal/deportation, such as did you overstay, or did you commit a serious crime? That is why it is best to first have an attorney evaluate your case, gather and package the appropriate proof and documentation, and

The Philippines would sustain its robust economic growth this year given its strong and resilient domestic demand, the International Monetary Fund (IMF) said Tuesday, May 3. In its regional economic Outlook for Asia and the Pacific report, the multilateral lender kept its gross domestic product (GDP) growth forecasts for the Philippines of 6 percent this year and 6.2 percent in 2017, faster than last year’s 5.8-percent expansion. “The modest uptick in growth is expected to be driven by the
continued strength of domestic demand, which will more than offset the drag from net exports,” the IMF said. In the next two years, “domestic demand will benefit from higher public consumption and investment growth, but private demand is also expected to remain buoyant, helped by low unemployment, low oil prices and higher workers’ remittances,” according to the IMF. The rollout of public-private partnership or PPP projects to address the lack of public infrastructure in the country would bolster private investments as well, the
IMF added. Net exports or external trade as a whole would remain subdued in the near term, although the Philippines was seen being impacted minimally by the slowdown in the Chinese economy, the lender said. “Spillovers from China are and will continue to be smaller than in other parts of the region,” the IMF said. It noted that last year, despite the impact of lower net exports, real GDP growth remained robust in the Philippines, with domestic demand benefiting from favorable terms of trade.

MANILA—The Department of Tourism (DOT) has set a new target of 6.5 million tourist arrivals for this year as the government continues to bank on key and emerging source markets. The new target is eight percent higher than the earlier projection of six million arrivals by yearend. Tourism receipts are also expected to hit $6.5 billion. “No doubt, we would definitely exceed our original six million target. We are looking up to 6.5 million,” Tourism Undersecretary Benito Bengzon said. According to DOT data total arrivals for the first quarter reached 1.6 million, up 15 percent from a year ago. “The first order of the day is taking stack of where we are and what has happened and then identify where we want to go,” he added. DOT has considered the “It’s More Fun” brand as one of the shining moments of the tourism sector as it made its impact in the global set-up. “Generally, we’ve made our mark. So, the better strategy is to build on the success of the brand,” Bengzon said. The tourism sector contributes eight percent to the country’s total gross domestic product and is the third largest dollar earning industry of the Philippines next to semiconductor and BPO (business process outsourcing) industries. Its contribution is seen to reach 10 to 12 percent in the next three to five years.

THE European Union (EU) has committed to further strengthen partnership with the Philippines for the coming years, particularly boosting economic ties and promoting peace and progress in Mindanao. Ambassador Franz Jessen, head of EU delegation to the Philippines, said EU will continue its strong ties with the Philippines to help the country unleash its potential. “This is the time we think about the Philippines. This is the country with a great people, with great potential, and of course we are trying to work with you to unleash this potential and use it in the best possible way,” Jessen said. “We started very far from each other. The Philippines and EU also signed the Partnership and Cooperation Agreement (PCA) in 2012 to form wider relationship between the two parties, especially enhancing trade and investment relations through free trade agreement (FTA). In fact, the Philippines and EU launched for FTA negotiations in December 2015, with first formal discussions being eyed next month in Brussels. “We can be more ambitious looking forward so we move to FTA,” Jessen stressed. “What we can do is to work with you through FTA, between governments, to make sure they understand what it takes to get more EU investments to the Philippines,” he added. MANILA—The Villar family’s Starmalls Inc. is expected to be a major growth driver for Vista Land on the back of an aggressive expansion plan that will more than double its leasable office and mall space by 2018. This is according to listed financial services company COL Financial, which sees Starmall on a steady growth path to 2018. “We forecast EBITDA (earnings before interest taxes depreciation and amortization) to grow at a compounded annual growth rate of 14.15 percent and net income to grow an average of 10.4 percent annually,” COL Financial analyst Richard Laneda said in a report. Starmalls plans to increase its mall portfolio by expanding its existing malls and opening new malls in different areas. To further power the expansion, Starmalls also plans to take advantage of the strong BPO sector by putting up offices beside some of its malls. “This year, Starmalls will add 350,615 square meters (sqm) of GFA, 220,000 of which area already open. They plan to add 135,000 sqm of GFA in 2017 and another 300,000 sqm of GFA in 2018, bringing total GFA to 1.3 million sqm by end of 2018,” the report noted.

Moving forward, COL said that for this year and succeeding years, Starmalls would be a significant growth driver for Vista Land. “Not only will its revenues grow faster than real estate sales but being a higher margin business, Starmalls will also accelerate the growth of EBITDA and net income. We forecast Starmall revenues to grow at a CAGR of 40.30 percent from P2.62 billion in fiscal year 2015 to P7.23 billion by full year 2018. This is a lot higher than our CAGR estimate of 4.5 percent for
the real estate segment for the same period. Together, total revenues are estimated to grow at a CAGR of 9.45 percent from 2015 to 2018. Nonetheless, the higher growth of the higher margin malls business will translate to faster consolidated EBITDA and net income growth for the company,” COL said. Vista Land completed this year the acquisition of 88.34 percent of Starmalls as part of its strategic business move that would accelerate Vista Land’s transition to a fully integrated developer.

Shell unveils ultra energy-efficient concept car Osamu Goto and Gordon Murray team up for the Shell Concept Car
SHELL has unveiled a concept city car which, if it were ever to go into production, could deliver material reductions in energy use in the road transport sector. Here’s the news from Shell: The three seater car is tangible proof of energy efficiency improvements that can be achieved by using cutting edge technology available today through a process of “co-engineering” whereby vehicle body, engine design and lubricants are all created together. Independent testing and a rigorous life-cycle study shows that Shell’s Concept Car would deliver a 34 percent reduction in primary energy use over its entire lifecycle when compared to a typical city car available in the UK. The Shell Concept Car would use around half the energy required to build and run than a typical small family car available in the UK and 69 percent less than that of a typical sports utility vehicle available in the UK. The Shell Concept Car is a total rethink of the Gordon Murray Design T.25 city car produced in 2010 for which Shell produced a prototype oil to improve the vehicle’s energy efficiency. The new car is the result of a co- engineering collaboration between world leading vehicle, engine and lubricant designers, with each of the three elements of the vehicle tailored to work optimally with each other. It takes a holistic view on energy reduction focusing on design material selection; reduced energy demand via aggressive downsizing, and streamlining while enhancing the efficiency of energy delivery through innovative engine design and lubricant formulation to minimise the impact in terms of overall energy lifecycle use. The car’s gasoline consumption has been measured using a range of vehicle testing protocols covering both steady state and urban driving styles. Sample test results include a steady state consumption of 2.64Litres per 100km [38km/ Litres] at 70kph and an improvement of 4.67g CO2/km on the New European Driving Cycle (NEDC) from the use of bespoke lubricants, equivalent to a 5 percent improvement in fuel efficiency compared to standard lubricants available in the UK.

THE COUNTRY’S flag carrier, Philippine Airlines (PAL), has been certified to be compliant with international standards on ground safety and operations. According to International Air Transport Association (IATA) country manager Roberto Lim, PAL is the third airline in the Asia-Pacific to have been given by his organization a certificate of implementation of IATA Ground Operations Manual (IGOM).
In a statement he said, it was “proof of PAL’s compliance to best practices and standards in its ground operations.” Ground operations involve all aspects of aircraft handling at the airport, including aircraft movement and preparing planes for safe takeoff or landing. The IATA presented the IGOM to PAL and PAL Express officials through IATA Airport, Passenger, Cargo and Security-Asia-Pacific regional manager Richard Tan and Lim.

(SMIC), the country’s largest conglomerate, has reported significant progress in its sustainability practices which involves its operations, social development programs and environmental conservation efforts. Among its key initiatives in 2015, climate change adaptation became one of its top priorities, with the SM Group taking a leadership role in spearheading the United Nations Private Sector Alliance for Disaster Resilient Societies (UN ARISE) initiative in the country. SM and its subsidiaries signed the commitment, enjoining other Philippine companies to help raise awareness and to implement projects in disaster risk reduction. Hans T. Sy, president of property arm SM Prime Holdings Inc., sits as the only Filipino in the 12member board of UN Arise. The SM group also showed progress in sustainable operations, particularly in the areas of energy efficiency, water management, waste management and greenhouse gas (GHG) emissions. In 2015 for instance, despite continued growth in its footprint to 7.3 million square meters in the Philippines, SM Supermalls consumed a monthly average of energy intensity of 41.5 MJ/sqm
(megajoules per square meter), from 43.3 MJ/sqm in 2014. It also continued to recycle the water used in all SM Supermalls so 3.9 million cubic meters out of the 13.1 million cubic meters of water consumed in 2015 was reused. This is equivalent to the amount of water in over 1,500 Olympic-sized swimming pools. The SM malls also recycled and reused 38 percent of its solid waste materials. And given its various means to achieve energy efficiency, the malls prevented additional emissions of about 110,000 tons of CO2 (carbon dioxide).
