Duterte, Robredo win in final… PAGE A2 t captured the admiration of millions of Filipinos tired of rampant crime and corruption with his street-level style of campaigning, delighting them with his expletive-laden speeches and promises of wiping out criminality within three to six months of being elected by killing tens of thousands of suspected criminals and dumping their bodies in Manila Bay, where the fish, he said, would grow fat from feeding on the corpses. From unknown to VP Robredo’s victory could be described as a come-from-behind win. She entered the vice presidential race as a virtual unknown, as she was a first-term representative of Camarines Sur province and was better known as the widow of former Interior Secretary Jesse Robredo. But during the campaign, her poll numbers climbed steadily until the last surveys before Election Day showed her and Marcos in a neck-and-neck race. At the start of the unofficial count of the votes by the election watchdog Parish Pastoral Council for Responsible Voting (PPCRV)
after the polls closed on May 9, Marcos, son and namesake of the late dictator Ferdinand Marcos, appeared to be headed for victory with a huge lead over Robredo. As the count progressed, however, Robredo surged and overtook Marcos, and the unofficial count ended last week with the administration candidate leading the senator by more than 200,000 votes. Record turnout The 2016 elections had a record voter turnout of 81 percent, the highest in the country’s three automated elections. There were 54.5 million registered voters this year. The transmission of results to the Comelec server was also the fastest recorded, with 70 percent of results transmitted just four hours after the polls closed at 5 p.m. on May 9. The Philippine population has grown since 2010, which also accounts for Duterte getting a higher number of votes. Under the rules of the NBOC, the canvassing panel will produce a joint committee report that it will submit to the joint
public session of the Senate and the House of Representatives for approval. The report will be presented by a member of the committee during the session, along with a resolution of both houses declaring the results of the canvass and proclaiming the President-elect and Vice President-elect. A speaker for each candidate will also be given the chance to speak for more than five minutes. Upon adoption of the resolution of both houses, the Senate President and the House Speaker will proclaim the President-elect and the Vice President-elect. Despite Go’s announcement that Duterte was not going to attend the proclamation, the mayor’s allies were bent on convincing him to show up and were optimistic that he would. Paola Alvarez, spokesperson for Duterte’s party PDP-Laban, said the mayor’s allies were talking to him about the matter. China claims 90 percent of the South China Sea, which is believed to be rich in oil and gas, its claims overlapping with those of Brunei, Malaysia, the Philippines, Vietnam and Taiwan. In a blog post published on Thursday, Symantec said it had “found evidence” that a Philippine bank “has also been attacked by the group that stole $81 million from the Bangladesh central bank and attempted to steal over $1 million from the Tien Phong Bank in Vietnam.” Reuters reported on the Symantec statement on Saturday. Symantec did not identify the Philippine bank or say whether any money was stolen, but said
the attacks could be traced back to October last year. Central Bank deputy governor Nestor Espenilla told Reuters that no bank in the country had lost money to hackers, although he did not rule out the possibility of cyberattacks. “We are checking if there are similar attacks on Philippine banks,” Espenilla said. “However, no reported losses so far.” He added: “It is one thing to be attacked. It is another to lose money.” North Korea blamed Symantec did not identify the hackers, but the United States
has blamed the attack on Sony on North Korea. Cybersecurity firm BAE Systems also said this month that the distinctive computer code used to erase the tracks of hackers in the Bangladesh Bank heist was similar to code used to attack Sony. “Malware used by the group was also deployed in targeted attacks against a bank in the Philippines,” Symantec said. “In addition to this, some of the tools used share code similarities with malware used in historic attacks linked to a threat group known as Lazarus.” Malware is a term for the “malicious software” surreptitiously

Symantec has identified three pieces of malware used in limited targeted attacks against the financial industry in Southeast Asia, with one found to have been connected to the Lazarus group of hackers. “Lazarus has been linked to a string of aggressive attacks since 2009, largely focused on targets in the US and South Korea,” Symantec said. “There is a pretty hard connection now to the Sony attacks and the actor behind them” and the Bangladesh heist, Eric Chien, technical director at Symantec, told Reuters in an interview. Chien said if North Korea was
responsible for the hacks on banks via the Swift (or the Society for Worldwide Interbank Financial Telecommunication) messaging network, it would represent the first known episode of a nation-state stealing money in a cyberattack. Swift alert Symantec said the attack on Bangladesh Bank triggered an alert by the Swift international payments network after it was found that the attackers had used malware to cover up evidence of fraudulent transfers. “Swift issued a further warning, saying that it had found evidence of malware being used against another bank in a similar fashion,” Symantec said. “Vietnam’s Tien Phong Bank subsequently stated that it intercepted a fraudulent transfer of over $1 million in the fourth quarter of last year. dicates that a ‘wider and highly adaptive campaign’ is under way targeting banks.” A third bank, Banco del Austro in Ecuador, was also reported to have lost $12 million to attackers using fraudulent Swift transactions. “However, no details are currently known about the tools used in this incident or if there are any links to the attacks in Asia,” Symantec said. Swift this week urged banks to bolster their security, saying it was aware of multiple attacks. Symantec said the discovery of more attacks “provides further evidence that the group involved is conducting a wide campaign against financial targets in the region.” “While awareness of the threat posed by the group has now been raised, its initial success may prompt other attack groups to launch similar attacks. Others apparently singing from the same hymn sheet include Togo, Afghanistan and Burundi. They are among the latest foot soldiers in “a public relations war” by China aimed at questioning international maritime rules, said Ashley Townshend, a research fellow at the United States Studies Center at the University of Sydney. The tribunal case, brought to the Permanent Court of Arbitration in the Hague by the Philippines, is highly technical and hinges on such issues as how international law defines “islands.” “There will be more and more countries and organizations supporting China,” Hua said. Similar announcements have become an almost daily ritual at China’s foreign ministry media
briefings, as it steels itself for what is widely expected to be an unfavorable ruling by the tribunal that could come within weeks. Beijing claims sovereignty over almost the whole of the South China Sea, on the basis of a segmented line that first appeared on Chinese maps in the 1940s, pitting it against several neighbors. But it is also a party to the UN Convention on the Law of the Sea (UNCLOS). Manila accuses Beijing of flouting the convention and has called for the tribunal, set up in 1899, to rule on the row. “By cobbling together a group of nations that share its views, Beijing’s aim is to show that there is a genuine debate over the legality of the Philippines’ legal challenge,” Townshend said. “It is trying to build a counternarrative to push back against the mainstream international consensus on maritime law.” Beijing did not provide a full list of China’s backers on the issue. But other than its main diplomatic partner Russia, few heavy hitters have come out in support, with Beijing’s neighbors – many of them unnerved by its increasingly assertive behavior – notably absent. Many of those disclosed so far are poor African countries, and Bonnie Glaser, a senior Asia advisor at the Center for Strategic and International Studies, described the names as “mostly composed of smaller, inconsequential nations.” In some cases the claimed support has been short-lived. Fiji and EU member Slovenia both quickly denied Chinese foreign ministry statements that they were backing Beijing, with Ljubljana saying: “We do not take sides on the issue.” Zhu Feng, an international relations expert at Peking University, told AFP: “I don’t really feel that China’s recent public diplomacy activities have been very successful.” Beijing, he said, “needs to develop its diplomatic activities and fight for more supporting voices.” But China’s options are limited. “While China has built odd coalition partners stretching from Russia to Mauritania and Venezuela to Gambia, the Philippines counts on support from the US, Japan, Australia, Britain and others, including respected global bodies like the EU and G7,”

Report: Asian American economic clout growing NEW YORK CITY — Asian Americans’ impact on the US economy is growing and shifting, according to a new report by the consumer information firm Nielsen. “Asian-Americans: Culturally Diverse and Expanding Their Footprint,” a Nielsen study reports that Asian Americans are starting businesses, creating jobs and contributing to the U.S. economy, with a current $825 billion in consumer buying power, which is expected to rise to $1.1 trillion by 2020. As the fastest-growing U.S. population segment with an expanding geographic footprint in the Midwest and South – beyond traditional immigrant enclaves in the West and Northeast – Asian American impact on consumer preferences is rippling across mainstream America, with farreaching implications for brands and marketers. Nielsen’s report highlights through a regional lens the different ways in which Asian Americana are exerting cultural and economic influence on the

structional Quality Commission (IQC) came as a welcome surprise to BLHS Executive Director Cecilia Gaerlan, prime mover of the campaign to revise the history curriculum framework for California high school students. “I was not in the room and was not sure of the outcome until after I was told of it,” a stunned Gaerlan said on May 19. “I could not believe it at first until I was literally shown what was voted upon.” Gaerlan recalled that during the March 24 meeting, the IQC only accepted two of BLHS recommendations including making the point that the Filipinos were part of the U.S. Army. At the most recent meeting, the IQC approved everything that the BLHS recommended, including the point that Filipino troops were part of the US Armed Forces in
the Far East (USAFFE). The revision of the high school history curriculum is now in the final stage, in the hands of the ten members of the State Board of Education (SBE) headed by Board President Michael Kirst. The board is expected to consider the recommendations in July. The BLHS recommendations adopted by the IQC for Grade 11 U.S. history curriculum included the following: • Filipinos comprised the majority of the U.S. Armed Forces in the Far East (USAFFE); • Filipino and American troops of the USAFFE, despite suffering from massive disease and starvation and fighting without any air support, delayed Japan’s 50-day timetable for conquest by defending Bataan for 99 days; • The Bataan Death March, which forced around 75,000 prisoners to march some 60 miles

panies valued at over $1 billion with the potential to become publicly traded on the stock market, 19 were founded by Asian American immigrants. • In the U.S. Census’ recently released Survey of Business Owners, the number of Asian American-owned businesses grew by 24 percent between 2007 and 2012 and claimed the highest percent sales increase (38 percent) of any racial or ethnic group. • Of the 11.6 million Asian Americans in the workforce, about 70 percent are employees of for-profit businesses, 12 percent are government employees, 7 percent work for nonprofits, and 9 percent are self-employed, while 1 percent are unemployed. Unique Culinary Tastemakers and Environmentally Sustainable Consumers
• Seventy-nine percent of Asian Americans agree they prefer cooking with fresh food rather than canned or frozen food. On average, Asian-Americans purchase 69 percent more fresh seafood, 72 percent purchase more fresh vegetables, and 29 percent purchase more fresh fruits than the general population. AsianAmerican shoppers say they are more likely to buy and pay more for recyclable and eco-friendly products than the general population. • More and more consumers of other races and ethnicities are adopting Asian-American cooking styles and habits. Items such as soy milk, seaweed, Asian curries and many others are entering mainstream markets. Tech Titans and Content Consumers • Nearly half of Asian Americans watching English TV also
watch TV in an Asian language (dual-language viewers). • Asian Americans outpace the general population in ownership of all three major Internet personal devices: smartphones, household computers and tablets. Online purchasing sentiment outpaces the general market, as well. • Asian Americans take the lead in using multimedia devices, averaging almost twice the minutes per day of the general population; they spend half the time on live TV as the general population. Additionally, Asian-American households have a much lower rate of DVR usage (43 percent) than the general population (62 percent). Sixty-eight percent of Asian-American households have subscription video on demand (SVOD) services, a 21 percent higher rate than the general population. n

He explained that the BLHS started out not have much experience in the political process, but today they have proved themselves capable of working effectively within the political process. Gaerlan was quick to caution that only after the curriculum template is created will the lessons on Filipinos in WWII be actually taught. “In theory, each school district is supposed to create its own curriculum template after the framework is approved,” Gaerlan explained. “However, foreseeing the challenges of doing so, including lack of resources, we will be creating a curriculum template that can be used by the different school districts.” Gaerlan cautioned further: “The more monumental task is not only in the creation of this template, but also in convincing the high school districts and the history teachers to implement this. Approval of the history curriculum framework is only the beginning. Much more work ahead in the coming years.” Sobredo added that the process of getting materials approved for K-12 and through the IQC is very slow, cumbersome and, “quite frankly, a bit frustrating.” “But this is all part of the political process, and it also assures
that all voices are heard before the Commission. So, yes, we would like the process to go faster, but that is not the case. Democracy moves along at a very slow pace,” Sobredo lamented. Sobredo also disclosed that his colleagues at Sacramento State University are already starting work on instructional materials so that when the textbooks are finally approved there are some available.
“For the book chapter that I wrote on Filipinos in California, I made sure that the key points recommended by the BLHS group are also included,” Sobredo disclosed. Asian Americans and Pacific Islander (AAPI) soldiers have served the U.S. for over 200 years, beginning with Filipino soldiers in the Battle of New Orleans during the War of 1812. Due to our nation’s history of racial discrimination, AAPI soldiers have often dealt with hostile environments during and after their service. JapaneseAmerican soldiers fought nobly in WWII despite the mass internment of their families, and Filipino WWII Rep. Ted Lieu veterans are still dealing with the denial of benefits and fighting for recognition of their efforts. Earlier this month, the Obama Administration implemented a program that allowed family members of Filipino-American veterans to immigrate the U.S. to support and care for them. These families had previously waited for decades in the immigration backlog, and their experiences highlight the need for comprehensive immigration reform as well as the need for AAPIs to make their

EACH year, we celebrate Memorial Day to honor those who gave their lives serving in our armed forces. The holiday is particularly close to my heart because I’m a veteran and also because it comes at the end of Asian Pacific American Heritage Month. My parents immigrated to the United States when I was 3 years old, and became successful small business owners thanks to their hard work and perseverance. After I attended college and law school, I decided to give back to my country by serving on active duty with the U.S. Air Force. Over the course of four years, I met countless brave service members from diverse backgrounds, carrying their own immigrant family stories who were unquestionably committed to defending our nation’s principles. But there’s a troubling new development in our national politics today threatening to tarnish the memories and stories of those men and women. In light of the anti-immigrant and anti-Asian sentiments expressed by Donald Trump, the Republican nominee for president, it is especially important to remember the rich diversity of the courageous

At a time when Donald Trump threatens progress by continually delegitimizing and insulting the immigrant experience, the Democratic Party’s commitment to keeping families together extends from young undocumented children and their parents to senior citizens in need of home care. As part of an effort to ensure just treatment of all current soldiers, I co-sponsored a bill introduced by my colleague Rep. Judy Chu that would require every branch of the military and the Coast Guard to report on their anti-hazing efforts. Rep. Chu experienced a personal tragedy when her nephew took his own life after being subject to violent hazing during his service. Her legislation also aims to ensure that those in the armed services will not face discrimination in their ranks because of race, sex, religion, orientation or creed. Unfortunately, we have yet to see that same commitment from Mr. Trump, who regularly incites violence through race-baiting and divisive rhetoric that re-opens the deep wounds our nation
has worked so hard to heal. Trump has made belligerent claims to build a wall on the U.S.-Mexico border and engage in a trade war with China. His presidential run correlates to an uptick of bullying in schools, and teachers have reported a rise in anti-immigrant and anti-Muslim feelings in students, as well as fear of the future if Trump were to be elected. Trump’s vows to dismantle key strategic agreements around the world has also alarmed world leaders. And his policies and rhetoric threaten to make our children and our soldiers less safe at home and abroad. On this Memorial Day, and as we mark the end of Asian Pacific American Heritage Month, we remember the many who have sacrificed their lives to protect our great country and fight for our freedom and prosperity. We must not elect, as our next Commander in Chief, a man whose lack of judgment would make our nation less safe and secure. Donald Trump would only divide us. Foxes guarding the hen house REMEMBER “C5 at Taga”? For the benefit of those with Street short memories, in January 2010, with the presidential campaign in Talk full swing and Sen. Manny Villar leading in the surveys on presidential aspirants, the Senate debated a report recommending the censure of Villar “for improper GreG b. MAcAbentA and unethical conduct.” Villar, who owns one of the biggest real estate development conglomerates in the country, allegedly channeled public works funds to build a C5 extension through his firms’ property. According to media, Villar used his position as Senate Finance Committee Chairman and as Senate President to benefit his firms at the expense of the Filipino taxpayers: “The report said the government spent P6.2 billion on the C-5 road extension project, including the realigned P4.28 billion for the extension project, the P1.8 billion spent for the original project but was wasted due to the realignment, and the reportedly overpriced payment of P141.2 million in right-of-way payments for Villar’s real estate companies.” It was a classic case of the fox guarding the hen house. A mischievous wordsmith promptly punned Villar’s campaign slogan, “Sipag at Tiyaga” (Industriousness and Diligence) into “C5 at Taga” – “taga” being a Tagalog idiom for getting a cut or making money out of something. Villar lost to a candidate perceived as his exact opposite, that is, a virtual Knight in Shining Armor, Benigno S. Aquino III (ironically, Aquino lost much of that luster during his tenure). Now comes president-elect Rodrigo Duterte, he who rode to victory as another Knight in Shining Armor, vowing to slay the dragons of criminality and corruption, even if he has to dump the thieving corpses into the Manila Bay. And what has been one of his first acts as presumptive dragon-slayer? He announces the appointment of newly reelected congressman Mark Villar, son of the elder Villar, as Secretary of the Department of Public Works and Highways (DPWH). Remarked a pundit, Duterte is sending the Villars back to the hen house. The appointment has disappointed many of Duterte’s trusting supporters who voted for him on the promise of “change.” They now have the uneasy feeling that they have been short-changed. Of course, Duterte’s near-fanatical loyalists are bristling at what they call “premature judging” of their idol. They insist that things will eventually work out well and that Duterte will take his oath of office with a team that is capable, qualified and raring to deliver on his promise of dramatic reforms. To be fair, none of the announced “appointments” may be considered final. Duterte has been known to do a multiple about-face on his campaign vows, decisions and policy statements, and there is every possibility that his more sensible advisers will make him see the light. And speaking of seeing the light, one of Duterte’s closest friends and a generous financial supporter has taken a dim view of the appointments. Mike Abe, speaking on behalf of Pastor Apollo Quiboloy of the Kingdom of Jesus Christ, has characterized Duterte’s process of selecting key officials as “turo-turo” (literally, point-point): “’Turo-turo lang. O, ikaw ang secretary dito, ikaw ang may hawak dito. Nawala na ‘yung proseso. ‘Yun ang ikinagugulat ng mismong malalapit kay Mayor,” Abe told Rappler.” (It’s just pointpoint. You be secretary here, you be in charge of this. There is no process. That’s what shocked those close to Mayor.) One would have expected some kind of formal vetting process for something as important as selecting individuals for some of the most important
positions in government. For perspective, following is what prospective appointees to high-level US government positions have to go through, as digested from an official document: “CALLED TO SERVE: THE PRESIDENTIAL APPOINTMENT VETTING PROCESS The rewards of public service as a high-level presidential appointee include the opportunity to serve one’s country, pursue important policy goals, and help shape historical events. In order to serve as a presidential appointee, however, candidates must first successfully navigate two complex political processes: nomination by the President and confirmation by the United States Senate. Both processes entail extensive vetting of professional credentials and a host of personal background issues. “Top Five Vetting Priorities (of) Individuals who are interested in a presidential appointment are 1. Tax Issues (including paying employee taxes for undocumented nannies) 2. Ethics and Financial Disclosure Requirements. 3. Litigation, investigations, and other legal proceedings. 4. Publications and Organizational Affiliations. 5. Medical, Family, and Personal Issues.” If the same vetting process were to be applied in Duterte’s selection of cabinet appointees, would Mark Villar qualify? Conflict of interest would certainly be a major issue. For that matter, would lawyer Salvador Panelo, who appears to have been tapped as presidential spokesman, be considered acceptable? Panelo’s reportedly weird sartorial tastes and lack of charm in dealing with the media may be the least of his problems. Worst of all is that he is the defense lawyer of the Ampatuans in the case involving the massacre of 57 persons in Maguindanao, 32 of them journalists. And talk about conflict of interest, how about conflict of national security interests? Duterte has announced his intention to reserve four key cabinet portfolios for nominees of the Communist Party of the Philippines-New People’s Army: the Department of Labor and Employment (DOLE), Department of Social Welfare and Development (DSWD), Department of Agrarian Reform (DAR) and Department of Environment and Natural Resources (DENR). More than the other cabinet offices, these four are primarily populist and would seem to be ideal for a group that has its roots in the masses. Assuming that the CPP and the NPA, after decades of conflict with the government, are still as ideologically committed to correcting social injustice and uplifting the lives of the working class, it is doubtful that it has reversed its avowed goal of overthrowing the government and curtailing US influence on our country’s economic, political and military affairs. While the NPA invokes an ideology that resonates with the poor, with labor and with the landless in the rural areas, the cadres are in fact operating in a manner no different from the Mafia, engaging in the protection racket and making millions in the process. This should be apparent to Duterte because, according to a report, “The NPA obtains significant amounts of money from the Davao region. The military estimates that the NPA collected 39.5 million pesos ($890,000) there in 2010, nearly half of the 95.5 million pesos ($2.15 million) it raised from revolutionary taxes throughout the country during the year. Most of the funds are collected in the Compostela Valley, where there are many mines. In 2009, the military estimated that the province could provide the group with as much

as 20 million pesos ($460,000) per month.” According to the same report, “the NPA has increased (the) tax levied on mining companies from 15 million pesos ($340,000) to 20 million pesos ($450,000) a month.” Imagine how it will be when the CPP and NPA assume control of the DOLE, DSWD, DAR and DENR budgets. Without discounting the temptations for personal enrichment, there exists the very real prospect of raising billions to pay for troops and armaments to match the firepower of the Armed Forces of the Philippines. Just as serious a threat is the increased capability offered by the key posts to win the battle for the hearts and minds of the masses. Indeed, placing these departments under the control of a group sworn to overthrow the government is not just assigning the foxes to guard the hen house, it is allowing a Trojan horse to be wheeled right into the center of power. The latest news is that Jose Maria Sison has signed an “interim peace agreement” with the
Aquino government that the incoming Duterte administration can simply ratify. It is interesting to note that this is the first time that Sison has agreed to sign such an agreement and that the National Democratic Front of the Philippines (NDFP) has not even made an issue of the NPA remaining in America’s roster of terrorist organizations. With a foot in Malacanang – as Duterte promised Sison before the elections – why, indeed, would the CPP-NPA or the NDFP care about being in America’s shit list? In fact, their attitude is the other way around. This early, they are now demanding that Duterte should put the US in the Philippines’ shit list. As a first step. they want Duterte to rescind the Enhanced Defense Cooperation Agreement (EDCA) and the Visiting Forces Agreement (VFA). In other words, Yankee go home. You can almost hear China’s officialdom cheering in the background and speeding up preparations for total control of the South China Sea. MANILA — The Philippines will be among the first of 50 countries to benefit from a new multilateral initiative that aims to boost preparedness to natural disasters of vulnerable nations. The Global Partnership for Preparedness (GPP), a group of six entities, aims to disburse up to $500 million in financing over five years to ensure nations have “minimum level of readiness” against calamities. “We know investment in preparedness saves lives and dollars and thus makes financial and economic sense,” National Treasurer Roberto Tan said in a joint statement last Tuesday, May 24. “Crises such as those from natural disasters and effects of climate change should no longer spin out of control,” he added.
Tan represented Finance Secretary Cesar Purisima as chair of the Vulnerable 20 (V20) nations, a group of calamity-susceptible countries that have since expanded to 43 members. The V20 signed the partnership with the World Bank, World Food Programme, Food and Agricultural Organization, United Nations Development Programme (UNDP) and United Nations Office for the Coordination of Humanitarian Affairs. Under the partnership, between $100 and $130 million will be disbursed within two years to V20 founding members. The rest will be spent three years after to cover 30 others. Aside from the Philippines, other 19 original V20 members countries to get funding first are Afghanistan, Bangladesh, Barbados, Bhutan, Costa Rica, Ethiopia, Ghana, Kenya, Kiribati,

Ferdinand “Bongbong” Marcos Jr. said he is deeply grateful for the statement of presumptive president Davao City Mayor Rodrigo “Rody” Duterte favoring burial of his father late President Ferdinand Marcos at the Libingan ng mga Bayani. “It has always been our family’s position that it is our father’s right under the law to be buried there being a soldier and a former President of this country,” the younger Marcos said. “We would like to thank President Duterte for this kind, rightful and healing gesture,” he added. On Monday evening, Duterte said he will allow the burial of the late president Marcos, possibly on his 99th birth anniversary on September 11, in an effort to “erase hatred” among Filipinos. He said the burial is not a hero’s burial but recognition of Marcos’s service as a soldier. Duterte also mentioned that

PRESUMPTIVE Presidentelect Rodrigo “Rody” Duterte was urged on Tuesday to begin early in his term the shift to a federal form of government, as support for it would still be strong early in his administration. Former Sen. Aquilino “Nene” Pimentel Jr. made the call to the incoming president as he and fellow advocates began their bid to educate people about federalism, which Duterte promised to bring about under his administration. “It’s good if it’s done immediately because the glamour of the president will still be fresh in the minds of the people. It’s easier to convince people now than later,” Pimentel told reporters at Club Filipino in San Juan where he and newly elected Batangas Gov. Hermilando Mandanas led a forum on federalism. However, Duterte’s actual timetable differed from Pimentel’s suggestion, according to Senate Majority Leader Alan Peter Cayetano, Duterte’s running mate who was said to be helping him craft his legislative agenda. Cayetano told Senate reporters on Monday the Duterte administration planned to start the motions for shifting to federalism in

the “middle of (his) term.” He said Duterte wanted a “massive consultation” since he noted that “federalism” was not a simple issue. Aside from the executive branch, Cayetano said they would “either operationalize the consultative mechanism of the committee on local governments or of peace and reconciliation (in Congress) or the joint executivelegislative consultative body” to undertake the consultations. “But the target is to time the plebiscite with the 2019 (midterm) elections,” he added.
Told that Duterte was planning a plebiscite on federalism in 2019, Pimentel said this might be too late, but it was really up to the incoming administration as he was just voicing an opinion. Pimentel said he had not presented the federalism proposal he was pitching to Duterte although people close to the incoming president were aware of it. For his part, Mandanas said there was a need to rush the shift to a federal form of government because “we have to deliver basic services as soon as possible.” n

DETAINED Senator Jinggoy Estrada has asked the Sandiganbayan to allow him to leave detention, saying he would pack his things up at the Senate as he is nearing the last day of his term as a legislator. In a motion filed before the anti-graft court Fifth Division, Estrada told the anti-graft court that he would personally supervise during office hours the “segregation of his personal and office equipment” in the last few days of the Senate session. Estrada said his things need to be turned over to the Senate custodian of property and equipment. He added that his personal equipment, belongings and documents need to be removed with his presence and supervision. In his request, Estrada asked that he be allowed to attend the last days of session – from May 30 to June 2 – between 10 a.m. and 6 p.m. “for the purpose of winding up of his affairs at the

WHEN two relatively sweet, wholesome faces enable to project themselves convincingly in a primetime TV series deemed naughty and sexy, it’s chemistry at work. Highly-cited drama actor Dennis Trillo and equally-beloved Heart Evangelista found themselves a good combination as stars of “Juan Happy Love Story,” a romantic comedy of a series that features a chic boy and a family-oriented woman in a marital situation that is both problematic and fun. The word play on the title alone, as Dennis plays skirt-chas-
ing businessman Juan and Heart a feisty, wife-material Happy, suggests that viewers need not be worried about dealing with heartbreaking plots and nearly impossible dramatic twists. Instead, spectators are on for some tickling sequences and titillating scenes crafted in sheer-fun, non-offensive style. The series began airing on GMA Telebabad last May 16, exactly a week after the National Elections that also bid goodbye to the publicly draining campaign. Thus, it is actually serving as a much-needed refresher for viewers who got tired watching politicians throw insults and accusations at each other.

1. Preheat oven to 325 degrees. 2. Make the crust: In a stand mixer, combine the crust ingredients and mix on low speed until well blended. Spread evenly in an 8 x 8-inch baking pan. Press the crust down evenly in the center with your fingers, but the let the edges rise up along the sides of the pan just a bit, almost like a tart shell. 3. Bake crust at 325 degrees for 15-20 minutes or until golden brown on top. It won’t be completely done. 4. Make the filling: In a large glass mixing bowl, whisk the filling ingredients. Don’t whip or overbeat. 5. Pour the filling over the partially baked crust. Return to oven for another 20 minutes or until the filling is set (when you shake the pan, the filling should jiggle and hold, not run like water). 6. Allow to cool for at least 20 minutes. 7. Sprinkle with powdered sugar. Cut into squares and serve.

There is a funny thing about golf. It is more than strong shots or strong hands, beautiful knee action, smooth and self assured putting attributes or strokes. A tough player hides it well by acting nonchalant, whistling and laughing in the middle of tournaments. But in his mind, he is always calculating the next shot, never panicking when things got a little tough. I remember that early morning at Tagaytay highlands International Golf Club which then the biggest local golf lure. The members organized warm hearted welcome for former President Fidel V. ramos and the King of Malaysia Yang de Pertuan aging Azlan Sha, who jointly inaugurated the club. The club has its own unbelievable charm and beauty, offering eye catching views at almost every turn. The two honored guests then proceeded to play an 18-hole game with boon companion, on

Governor-elect H. I. “Dodo” Mandanas of the Province of Batangas calls on all the local government units (LGUs) of the Philippines that they have no less than P800 billion claim from the national government (nG) arising from their unreleased just share from the national Internal revenue Taxes collected since 1992 to 2015. This legal, moral and just claim of the LGUs was brought to the attention of the PNoy Administration in 2011 by then Congressman and Chairman of the Committee Ways and Means, Dodo Mandanas. However, after several exchanges of letters and documents, and meetings with concerned agencies and Cabinet members, Mandanas was replaced as Chair of the Committee on Ways and Means. President Aquino announced on national television that Chairman Mandanas was replaced because he was advocating the automatic release of the entire just share of LGUs, also known as Internal Revenue Allotment (IRA), which already amounted to P500 billion then. Mandanas filed the P500-billion case in the Supreme Court in January 2012. The case was already submitted for resolution and favorable decision is expected sometime soon. Essentially, Mandanas contends that the NG is withholding and misusing part of the IRA for NG programs instead of automatically releasing the entire amount to the LGUs in accordance with relevant provisions of the Constitution, Local Government Code, National Internal Revenue Code, and even earlier decisions of the Supreme Court on the automatic release of IRA filed by Governor Mandanas and then Senator Nene Pimentel in 2003. Incidentally, the LGUs have already received back pay of P60 billion on that case filed by Governor Mandanas. Governor-Elect Mandanas and Senator Pimentel contend that the viable lifeline of Local
Autonomy, which can be effectively implemented in the Philippines with the Federal form of Government, is the full and true enforcement of the Internal Revenue Allotment provisions. And the automatic release of the P800 billion illegally withheld and misused IRA by NG will effectively start the Federal System of Government, concretely manifesting the political will and firm determination of the administration to move towards inclusive, sustainable, and meaningful development. The present administration still has time to rectify the gross injustice done to the Filipino people. On the other hand, the Supreme Court and/or the incoming administration will have the monumental opportunity to make the dramatic paradigm shift needed by the Filipinos to realize our ideals and aspirations, and promote the Common Good.

Driving tourism growth through effective marketing slogans Tourism is a big business. The tourist market is getting broader, changing and becoming more competitive. understandably nations and individual cities are constantly battling for their share of the huge tourism market to sustain the economic viability of attractions that bring in tourists and travelers – whether they are pristine beaches, ancient monuments, or natural wonders. To attract more tourists, destinations, strive and outdo one another in trying to be different through destination branding. The Philippines, in fact, is among those countries that are investing heavily in tourism promotions and marketing efforts in the hope of attracting more visitors to the country. officials of the current administration have been quoted in various news reports as saying that tourism is one of the highest economic drivers of the Philippine economy, next to the iT and semi-conductor industries. Data confirms that tourism is an important sector of the Philippine economy, contributing 7.8% to the country’s GDP in 2014. in 2001, the Department of Tourism, with richard Gordon as the secretary, launched “WoW PHiLiPPiNEs” campaign, which focused on attractions to be experienced in the country. The marketing campaign generated foreign visits reaching a little over 3 million in 2007. Notwithstanding what the “WoW Philippines” campaign accomplished in creativing
awareness and interests from prospective travelers, DoT under then Tourism secretary Albert Lim launched “Pilipinas Kay Ganda” tourism slogan in 2010. The special preview, which was done in 3D and was attended by 700 guests, reportedly costs Php4.8 million. unfortunately, the slogan was much-criticized and maligned for its negative connotations and was pulled out only a week after it was launched. in January 2012, Tourism secretary ramon r. That year, the Philippines drew in 4.27 million visitors – a record high for the country, but still a little below the target of 4.6 million visitors. in 2014, DoT, through its marketing arm, the Tourism Promotions Board unveiled a new campaign the “Visit Philippines Year 2015 (VPY2015)”, with the aim of attracting some 6 millions visitors. The target was later on downscaled to 5.5 million. At the end of 2015, the country recorded 5.36 million tourist arrivals. (source: uN World Tourism organization’s World Tourism ranking 2015) However, the success of a brand or marketing slogan cannot be measured overnight. it takes years of sustained awareness campaign and a variety of aggressive marketing strategies before the desired objective is achieved, which is to drive tourists to specific destinations. That is why many countries and destination cities do not change their slogans. india for example, has been using its slogan for the past 10 years. on the other hand, a few including the Philippines has a penchant for coming up with new slogans on a regular basis. With the change in administration coming on July 1st, so will there be the changing of guards in the Cabinet and other appointed positions in the different government agencies. Each of the new appointees is up for a big challenge to fulfill the promises that Team Duterte made during the campaign. Given that the tourism helm is about to change hands, we are wondering if the tourism target of 10 million tourists for 2016 still remains or will be downgraded to an attainable figure. in addition, there are other questions in our

inquiring minds: Who will be the new tourism head that will be tasked to steer the country’s tourism industry? Will he or she share the vision of the “it’s more Fun in the Philippines” campaign? Will the new tourism chief maintain the existing brand and strengthen the country’s competitiveness? or will he or she launch a new campaign to sustain the country’s tourism efforts? in many cases, making changes is the first thing incoming leaders do in an attempt to convey that they are doing something new or different from what their predecessors did. in the case of tourism, we hope that whoever will be the new bosses will realize that they do not own the brand that promotes the Philippines. rather, they are temporary custodians of a strategy that captures the country in a positive light. it is worth noting that tourism is a big spender, too. specifically, changing slogans is costly and complicated. Although we
are not privy as to how much money the government agency spent to adopt a tourism slogan, launching new campaign can be very expensive. if a foreign brand consultant is hired, the cost could increase to several million dollars, not to mention the fact that previous brochures and other printed promotional materials identifying the old brand or slogan will be wasted completely. such multi-million dollar spending can, of course, be justified if the slogan attracts more foreign visitors. But, what if a new slogan or brand does not fulfill its purpose? Changing slogans or brands not only cost millions but can also can have a negative impact because they can alter the image and identity of the country. To avoid the prospect of spending millions of dollars, maybe our new set of leaders under the new administration should look into putting in place legislations to regulate spending on new campaigns. Effective marketing slogans
have been proven to drive tourism growth. The challenge is how to sustain the interests of the travel and tourism market. We hope that whoever the next tourism head will be, will see the wisdom that it is not the constant changing of marketing slogans or branding that draws in the tourists. Your Immigration Solution Rafael ToRRes and nancy MilleR NEWS has broken recently that Immigration and Customs Enforcement (“ICE”) is preparing to launch a new set of nationwide raid operations in conjunction with the statement of Secretary Jeh C. Johnson of the Department of Homeland Security (“DHS”) issued in early January of this year. This means that DHS is preparing to affirmatively go after people in certain categories and take them into custody. Those who have not ever been in Removal Proceedings will find themselves in Immigration Court where the lawyers from DHS will attempt to persuade the Immigration Judge to order them removed. Those with existing Removal Orders will face execution of those orders – meaning that DHS will take the necessary steps to remove them from the United States. Secretary Johnson and other authorities from the DHS have repeatedly emphasized that the raid operations will focus on enforcing removal against individuals in the highest priority categories outlined in the DHS’ November 20, 2014. And who are the people in the highest priority categories? They include all persons present in the United States without lawful presence who pose a danger to national security based on terrorism, espionage, and/or criminal street gang activity; those who have been convicted of a felony or significant misdemeanor; those who entered the United States unlawfully after January 1, 2014; those who are apprehended at or near the border of the United States (because the assumption is that they are recent arrivals); and those who have been issued a final order of removal on or after January 1, 2014 and do not have a pending appeal in their case. One need not be convicted of terrorism, espionage or gang ac-

tivity to be a priority. DHS suspicion will be enough. Additionally, DHS has its own definition of a significant misdemeanor and their definition may include crimes that the one suffering the conviction may not consider significant. Moreover, an individual with a removal order issued many years ago but whose final appeal was dismissed after January 1, 2014 is a priority. As is obvious from the short description above, the specified categories include “terms of art” meaning words that are interpreted within an immigration law context rather than as ordinarily used. However, even for one included in these categories, hope is not lost. Options may be available that would allow the person to remain in the United States and obtain lawful status. It may be possible to fight against the DHS assertion that the individual is removable. Even one who is removable may be eligible for a waiver. Post-conviction relief may be available for one convicted of a crime. And relief that was not available at the time the removal order was issued may be available today if one can get their case reopened. Reeves Miller Zhang & Diza believes that it is critically important for our community to understand the extent of the rights available to any undocumented person within the borders of the United States. For over 100
years, the United States Supreme Court has ruled that the Constitution of the United States applies to all persons within the borders of the country, even if the person is present in the United States unlawfully. In general, undocumented persons enjoy constitutional protections of their freedom of speech, equal protection of the laws, their right to due process, their right to an attorney, as well as protection against unlawful search and seizure and against self-incrimination. These are just some of the constitutional protections available to undocumented persons. The right to due process, protection against unlawful search and seizure, and protection against self-incrimination are extremely important before, during, and after an ICE raid operation. But the best time to determine one’s rights and explore options is before becoming the subject of an ICE raid. One who is a priority for removal needs to know what the law requires of them and what their rights are when ICE comes knocking at the door. Are they obligated to open the door? Is the answer the same whether the officer has a warrant or does not have a warrant? Is the person being questioned required to speak to the officer? Does the right against self-incrimination apply? Are there times when it does not apply? What about the

Minding Your Finances Atty. rAymond BUlAon ARE you currently struggling with high mortgage payments? Did you get your loan modified in the past but now have a new hardship based on changed circumstances? If so, this is an important article that you MUST read. If you’re one of the many people who got approved for loan modification many years ago under the HAMP Program, chances are that you obtained a low interest rate of 2% for 5 years and then your interest rate is set to increase after that time period. Other homeowners either did not qualify under HAMP and so were given by their lender an in-house modification with less favorable terms or the interest rate given by their lender under HAMP was much higher than 2% from the start. Studies show a high percentage of default even after modification. From what I’ve seen personally, these defaults could have been for a number of reasons: (a) the homeowner’s changed financial circumstances after modification (b) the homeowner decided that he or she still couldn’t afford the modified payments after all although income has remained the same and (c) the homeowner was never interested in keeping the home on a long term basis to begin with

Warning: Homeowners struggling with mortgage payments now have limited time to apply for government loan modification and simply wanted a loan modification “to buy more time” to stay in their home. Again, these have been my personal observations only- there could be other reasons. But for those who have remained current since their modification, they are now facing a new challenge as they approach the fifth year of their modification. Unless their income has increased in the last 5 years, there’s a good chance that they will not be able to afford the higher payments after the 5-year period under HAMP. Quite often, our conversation goes something like this: “My father (or mother) is in a nursing home in California, has a home and some assets in the bank. My parent’s medical bills are $8,000 a month. The nursing home gave me your name and told me you could help.” My first question is usually “Do you have power of attorney for your parent?” If the answer is yes, we can usually help the family preserve assets and protect the family home . If the answer is no, then my next question is “Does your parent still have mental capacity?” If the answer is in the affirmative, there is no problem because we can execute the Power of Attorney at that time. UNDER the Filipino World War II Veterans Parole (FWVP) policy beginning June 8, 2016, USCIS will allow certain beneficiaries of approved family-based immigrant visa petitions to request a grant of parole so that they may come to the U.S. as they wait for their priority date to become current. The policy recognizes the contributions of Filipino veterans who served in World War II, and allows relatives of such elderly Filipino veterans and their spouses to come to the U.S. to provide care and support for them. USCIS will consider requests for FWVP parole submitted for certain relatives who are the beneficiaries of approved familybased immigrant visa petitions filed by Filipino veterans or their surviving spouses. If the request for parole is approved, the beneficiary and his/her immediate family would be allowed to come to the U.S. and live in the U.S. while waiting for their priority date to become current, at which point they would be allowed to adjust to permanent resident status. Those who may request parole under FWVP are persons 1) who are the beneficiaries of an approved I-130 Petition (including spouse and children); 2) whose petitioning relative is residing in the U.S. (or if deceased, was residing in the U.S. at the time of death); 3) who are waiting for their priority date to become current under the Department of State’s visa bulletin; and 4) whose petitioning relatives have established they are either Filipino World War II Veterans or are the surviving spouse. Under FWVP, the Filipino World War II veteran must have served in World War II as a member of the Philippine Army, a recognized guerilla unit, the Philippines Scouts, or within any other component of the U.S. Armed Forces of the Far East (USAFFE). USCIS will review government records to verify the Filipino World War II veteran’s military service. The petitioner who requested parole for his relative beneficiary under FWVP will be provided an opportunity to establish the World War II service if it cannot be found in government records. When the petitioning relative in the U.S. is the Filipino World War II veteran, individuals who obtain parole under FWVP include beneficiaries under any family-sponsored preference category. When the petitioning relative in the U.S. is the surviving spouse of a Filipino World War II veteran, only individuals who are the child, son, or daughter of the surviving spouse who is also the child, son, or daughter of the Filipino World War II veteran can seek parole under FWVP. In cases where the petitioning relative is deceased, a beneficiary may seek parole under FWVP but first must seek humanitarian reinstatement of the approved I-130 filed on the beneficiary’s behalf. Once the I-130 is reinstated, the beneficiary may seek parole under FWVP. It is important to note that the above requirements are preliminary requirements for eligibility under FWVP. The grant of parole by USCIS under FWVP is made on a discretionary, case-by-case basis. In addition, following the first 4 years of FWVP’s implementation, USCIS will evaluate whether FWVP should be phased out at the end of 5 years. It is accordingly recommended that you promptly seek the advice and assistance of an experienced attorney, who can confirm eligibility and present facts in support of the favorable exercise of discretion by USCIS in granting the parole request. *** Darrick V. It is important that your Power of Attorney says “durable.” A “durable” power of attorney is a power of attorney that remains effective upon the principal’s becoming incompetent or incapacitated. You can be emotional (and should be) about issues raised by the agent. This can create animosity that raises the temperature in the room, one that can work against you. 4. Some taxpayers tend to be chatterboxes when they get nervous. Others appear cool from our coaching but talk-a-talk as soon as they get comfortable. They volunteer more than what is asked for. This could only mean trouble: more issues, mas problemas. And just between you and me, I cannot work my magic when you are around. The auditor tends to be formal. I tend to be formal. I dare not trade issues when you are there. Your presence is a hindrance to my effectiveness, an obstacle to the agent’s willingness “to work it out.” So why attend? Why You Should Attend: 1. You are a convincing witness. 2. You present yourself rather well even in times of adversity. 3. You are a convincing fellow. 4. You are a credible witness. 5. Your presence helps win the
case. 6. You exude an aura of your trustworthiness. 7. Your presence is crucial to win the battle. 8. Evidence has been lost and your oral testimony can sway the auditor to believe that such evidence truly existed. If you are this type of person, consider attending. But in my five decades of IRS work, you are indeed a rare creature that comes around once in a blue moon. My advice is, unless you are that rare breed, sign that power of attorney and leave it to the professionals. Try to be “normal” at this time of your life, even if you are not so most of the time. Is real estate property purchased prior to marriage considered community property in a divorce? 665. Other expenses associated with the property are not considered in the calculation such as mortgage interest, taxes, and insurance. In essence, the real property would accumulate both a separate property and a community property component by the date of separation. The appropriate remedy in this situation where separate property is subsequently paid with community funds is “apportionment.” The process of apportioning between the separate and community property component is laid out in the Marriage of Madsen. In that case, the court determined the ratio or percentage in which the mortgage loan principal was reduced during the marriage and applied that percentage to the appreciation of the real property during the marriage. The community property com-
ponent would then consist of the reduction in the mortgage loan principal during the marriage plus the portion of appreciation during the marriage applying the ratio discussed above. In the Marriage of Madsen, the real property was purchased by the husband for $38,300 prior to the marriage. The original mortgage was $30,000. By the time the husband got married, the house was now worth $65,000 while the mortgage has gone down by $7,000. Both the appreciation of $26,700 and the mortgage reduction of $7,000 would be separate property since it occurred prior to marriage. Marriage of Madsen (1982) 130 CA3d 426, 181 CR 910. However, the court threw out her case and she had to go to “arbitration.” She said she lost because the arbitrator was biased and she could not appeal. My company is now asking me to sign an “arbitration agreement.” What should I know about arbitration? A: Arbitration is a procedure to resolve disputes without filing a complaint in court. The disputing parties refer the case to a third party (the arbitrator) who reviews it and makes a decision that is legally binding on both sides. By signing an employment arbitration agreement, the employee is agreeing to settle any claim against the employer be-

Should employees give up their right to be heard in court? fore an arbitrator and not before a judge or a jury. This means the employee cannot file a lawsuit in court to resolve the claim. Court proceedings are public, with the case being heard either by an impartial judge or an independent jury. An arbitration proceeding is a private process in which an arbitrator is hired by the parties to make a decision regarding the dispute. The process and its results are generally confidential and not disclosed to the public. The parties are bound by the arbitrator’s decision and the losing party cannot appeal. Arbitration is most commonly used in commercial disputes, where the disputing parties are all business entities and have equal bargaining powers. The use of arbitration in employment disputes, may be problematic. Arbitration in an employment situation is not usually the product of negotiation but is practi-
cally imposed on the employee. The employee needs the job. The company may not give the job unless the employee agrees not to sue the company in court when disputes arise. Employees often automatically sign these types of agreements, without understanding the consequences. The New York Times reported the impact of arbitration on regular employees. Below are some of the horror stories: Deborah L. Pierce, an emergency room doctor, brought a sex discrimination claim against the employer that had fired her. She had evidence that the employer had a pattern of denying women partnerships. However, she was blocked from court and forced into private arbitration. The arbitrator was not a judge but a corporate lawyer. When Dr. Pierce showed up one day for a hearing, she noticed the arbitrator having a friendly coffee with the head of the com-

Debt Relief atty. lawRenCe yanG CLIENT is 52, still young by any standard. He has got it all together. He has no credit card debt or bank debt. He doesn’t own a house but owns a mobile home that he lives in with a fair market value of $45K. He’s pretty happy living in the camper because he can drive it anywhere he wants to when he feels like it. Last week he spent a week in Yosemite enjoying fresh air and nature’s beauty. The week before that, he spent a couple of days hunting rabbits in Arizona with his camper in tow. He still works as a commissioned salesman when he feels like working, grossing about $30K a year. He has a beautiful fiancée who loves him for who he is since he doesn’t really have much in his name in this world. So what kinds of financial problem can someone like this have? He made the mistake of acting as a guarantor on a commercial lease for his friend. His friend owns a business, which requires commercial space. The lease on the space is $20K monthly. It’s a five-year lease with three more years to go. His friend’s business was doing well until recently. You know how businesses go. You make money, breakeven or lose money. The first situation is the best. The second situation give you a fighting chance, after all, no money are being lost because the business is able to pay for all of its expenses. But the last situation sucks. Unless you have deep pockets, losing $10K a month means losing $60K in six months. You know what I mean. This deficit has to be financed by new capital from stockholders or from bank loans. Since you know

You tell the banks that the situation will change if this happens or that happens. But nothing happens; you just continue to lose money. Client is thinking that friend’s business is facing some headwinds that may eventually force his friend to shut it down. If the business is shut down, the commercial lease won’t be paid and guess who is holding the bag for the next three year’s lease of $720K? Fortunately for client he qualifies for a Chapter 7 wipe out of the $720K commercial lease guaranty. He will keep all his assets, including his mobile home, and his 2015 MB E 320. With this $720K liability out of the way and out of his life, client can become productive again, a beneficiary of the Chapter 7 fresh start. I understand that he plans to start a new life with his beautiful bride as soon as the court discharges his $720K personal guaranty liability. This potential liability for a quarter of a million dollars is what hounds client from the time he wakes up to the end of the day, every day. Now what kind of life is that when you have to worry about getting sued for $720K just because you signed a lousy guaranty to help your friend out? Not the good kind. It’s a bad kind of life and pretty soon, you have to decide if you want to face this problem squarely and get rid of it so you
can get back to enjoying your life. God, the one True God, Yahweh, the God of Moses and Israel, of Abraham and Jacob, my God, who sent His only Son, Jesus Christ, to die for our sins, because He loved us so, did not mean for us to live life under the burden of so much debt! Jesus said that He came that we may have life and have life more abundantly! And when I say Jesus Christ, I refer to the one and only Son of the one True God, I mean Jesus Christ, who is true God of true God, consubstantial with the Father, begotten, not made. Jesus, who came down from heaven, humbled Himself and became man, conceived by the Holy Spirit without human intervention, in the womb of our Blessed Mother Mary, to die for our sins on the cross, so we can have a chance to spend eternity with our God, the Father, the Son, and the Holy Spirit, and our loved ones, in paradise. I refer to our Lord and Savior, our redeemer, our shepherd, the prince of peace, the king of kings, the way, the truth and the light. If you are ever terminally ill and unable to make your own decisions, your agent named in a healthcare power of attorney would be able to make decisions for you according to your wishes (i.e. when extraordinary life saving measures should and shouldn’t be used). While everyone should have these documents as a part of their estate plan, you have to be careful when creating them, as with all legal documents. You are giving someone access to your bank accounts and the power to make financial and
real estate transactions for you; you should make sure your attorney-in-fact is a person that you trust completely like a spouse, child, or good friend (even though they are legally obligated to act in your interest, not theirs). One way to protect yourself is to make your power of attorney “springing,” which means it does not become effective upon incapacity, as determined by a licensed physician not related by blood or marriage under penalty of perjury. In other words, as long as you have capacity, you haven’t given anybody the right to sign your name until it “springs” into action. While no one enjoys thinking about the worst case scenarios
of life, executing these two simple documents can save you and your family a lot of trouble in the future. The ratio at which community funds paid down the mortgage ($9,200) during the marriage to the original purchase price ($38,300) amounts to 24.02%. This percentage of the property appreciation during the marriage of $117,500 ($28,223.50) plus the reduction in mortgage balance during the marriage ($9,200) would constitute the community component of the real property. The rest was the husband’s separate property. The husband in that case was awarded his separate property component of the real property plus one half of the community property component. The Madsen apportionment method is also applicable to situations where a community real property is later transmut-

The firm, American Health Lawyers Association, responded that it was not its responsibility to verify the “abilities or competence” of its arbitrators. If the case had been heard in civil court, said the report, Dr. Pierce would have been able to appeal, raising questions about testimony, destruction of evidence and potential conflicts of interest. Do this in remembrance of me…This cup is the new covenant in my blood. Do this, as often as you drink it, in remembrance of me.” For as often as you eat this bread and wine and drink the cup, you proclaim the death of the Lord until he comes. (Cor. 11:26) There are times when I go to Mass on weekdays without being the presider. I would sit with people in the pews and quietly enjoy the liturgy. I would look forward to listening to the readings and the homily of the priest. And even if the preaching is not sublime, I would still find words to muse over and to apply in my own life. But what I also find most nourishing and healing is when we come to the Liturgy of the Eucharist—the time of “transubstantiation” and “communion” when the bread and wine become the Body and Blood of Christ. For us Catholics, this is the most sacred moment, the period when we not

he sexually harassed her and she had no legal recourse in court. Employees who are bound by arbitration agreements are deprived of their rights to have their day in court. Our love for the Eucharist
only remember and enter again into the eternal sacrifice of Jesus Christ but also receive him in His Body and Blood. It’s that time when we Jesus becomes intimately part of us, and we become one with him. It’s a profound experience of God’s presence in our lives. That is why the Mass is one of Christ’s amazing gifts to us. It’s like an inheritance that God had given us, like the ring that my mother gave me before she died as a remembrance of her undying love for me. In the same way, the Eucharist would always be a remembrance of God’s eternal love for us. This Sunday is the Solemnity of the Body and Blood of Christ, which we also call the Feast of Corpus Christi. It’s a day to profoundly appreciate this Sacrament and to grow in a better understanding of it. It’s a mystery of our faith as Catholics. For us who grew up celebrating this Sacrament, it’s a sanctifying grace that we never get tired of celebrating and receiving. The Eucharist has inward and outward effects on us. Not only that it gives us peace, nourishment, and healing, it also moves us to bring peace, mercy and love to those around us. When we receive Jesus’ gift of self in the Eucharist and transform ourselves into be-
ing the same gift for others, we are the visible presence of the Kingdom of God. This truth is also the reason why I appreciate the gift of the priesthood. We thank God for the priests and bishops that Christ commissioned to celebrate the Eucharist with the People of God no matter how imperfect they are. Every time we celebrate the Mass, we go beyond the foibles of the priest or the bishop. We know that they are celebrating this Sacrament in the person of Christ. May the Eucharist fulfill our spiritual and physical yearnings! MANILA— Amid criticisms that credit rating upgrades only benefited the rich, the Aquino administration said on Thursday, May 26 that its budget discipline saved ordinary Filipinos nearly P70 billion. “Fiscal sustainability has been an essential pillar in building our country’s resiliency to external shocks and our stronger macroeconomic fundamentals,” the Department of Finance (DOF) said in a statement. “And this has concrete impact on the money we hold,” the agency added. By its estimates, the agency said local companies saved between P52 and P157 billion from low inter-
est rate financing as a result of the Philippines’s higher credit ratings. Consumers, meanwhile, generated additional purchasing power worth P23 to P68 billion during the same period. The government saved an average of P118 billion as well. MANILA—Construction activities across the country are expected to remain busy in the next four years, with the local construction industry seen growing more than half by 2020. A report by London-based Timetric’s Construction Intelligence Center (CIC) showed the Philippine construction industry is seen to grow to $47 billion by 2020 from $30.2 billion last year on a compound annual growth rate of 9.22 percent. According to the report, the rate of construction growth in the Philippines will remain relatively high until 2020, fueled by greater focus on infrastructure improvement and the continued expansion of residential and commercial buildings.
“Favorable government policies with regards to public-private partnership (PPPs) will also play an important role,” it said. Likewise, the entry of a new administration this year is not seen as an impediment in the continued growth of the industry. “The change in government in the Philippines, with the presumptive president-elect Rodrigo Duterte coming to office later this year, is not expected to derail the economic growth agenda, and the large-scale infrastructure development program, funded through PPPs, will continue to be promoted,” Timetric’s CIC lead economist Danny Richards said. This was despite the fact that employment increased from 38.4 million in January 2015 to 39.2 million in January 2016, while the number of unemployed Filipinos supposedly fell from 2.7 million to
2.4 million in the same period. Unemployed workers are dropping out of the labor force or potential new participants are not bothering to join the labor force, or both,” it added. The group cited neoliberal economic policies as the culprit behind the “worsening jobs situation” in the country “that have stunned Filipino industry and kept local agriculture backward,” which it said was aggravated by “growing labor flexibilization and contractualization.”

THE United States Department of Defense still uses eight-inch floppy disks in its system that coordinates the country’s nuclear forces, according to a report from the US Government Accountability Office (GAO). “Federal legacy IT investments are becoming increasingly obsolete: many use outdated software languages and hardware parts that are unsupported,” the GAO report read. The GAO further reported that some agencies still use systems that are at least 50 years old including the Departments of Treasury, Defense and Veteran Affairs. The report revealed that the strategic automated command and control system of the US Defense runs on a 1970s computing system. This system coordinates the operational functions of US nuclear forces including intercontinental ballistic missiles, nuclear bombers and tanker support aircraft.
A report from the US Government Accountability Office showed that the Department of Defense still uses floppy disks for the system that coordinates the country’s nuclear program.
The agency, however, is planning to update its system by the end of 2017. Meanwhile, the US Department of Treasury still uses assembly language code, a computer language initially used in the 1950s. “The agency has general plans to replace this investment, but there is no firm date associated with the transition,” the report said. The Office of Management and Budget (OMB) recently initiated to modernize, retire and replace the US government’s old IT systems.
It has drafted guidance which requires agencies to identify, prioritize and plan to modernize legacy systems. “However, until this policy is finalized and fully executed, the government runs the risk of maintaining systems that have outlived their effectiveness,” the GAO said. The GAO initiated the study on aging legacy systems to assess agencies’ spending, evaluate the oversight of legacy investments and assess the age and obsolescence of federal IT.

Instead, Finance Secretary Cesar Purisima had called for a “holistic” approach to tax reform, which his agency repeated on Thursday with its own proposed tax amendments. The comprehensive tax reform package, which will bring in at least P164.5 billion in additional revenues, will be handed over to the next DOF chief Carlos Dominguez for consideration. “We cannot reverse these hard fought gains... While it is easier to pass popular spending bills without paying for them, fiscal responsibility means making tough calls to protect our future,” the DOF said.
