After the hague-based UN international arbitration tribunal decided in favor of the Philippines’ claims over the disputed West Philippine sea (south China sea), President rodrigo Duterte is planning to start bilateral talks with China and is eyeing former President fidel ramos to attend them on his behalf. “Ang sabi niya (Duterte told that), we’ll start the bilat-

foLLoWING petitions from filipinos, Google has updated its map to remove the Chinese name of the disputed scarborough shoals and put its internationally-recognized name instead. Previously, the service referred the shoal as part of China’s Zhongsha island chain. An online petition posted in Change.org demanded the service to stop identifying the shoal as part of Chinese territory. “China’s sweeping claim of south China sea under their 9dash line purportedly historical
boundary is illegal and is creating tension among nations,” the petition read. “Google maps showing this is part of Zhongsha island chain gives credence to what is plainly a territory grab that peace-loving nations should stand against.” After engaging in a stand-off in 2012, China took control of scarborough shoal, forbidding any filipino fishermen in the shoal. the Philippines filed a case at the Permanent Court of Arbitration (PCA) in 2013, but China refused to take part in the proceedings. After deliberations, the PCA declared that an arbitral tribunal has ruled in favor of the Philip-

proved before the plan to award the medals can move forward. But with the Senate’s overwhelming approval of S. 1555, it is expected to build momentum and gather more bipartisan support in the House. The CGM is the highest award bestowed by U.S. Congress to an individual or group who performed a significant achievement that has an impact on American history and culture. “Other groups like the Tuskegee airmen, Montford Marines, Navajo Code Talkers, Women Air Service Pilots, Japanese American Nisei and Puerto Rican soldiers have been formally recognized by the U.S. with the CGM for World War II service,” said Cecilia Gaerlan, Executive Director of the nonprofit organization, Bataan Legacy Historical Society (BLHS) in a statement. “Filipino World War II veterans are equally deserving of this honor.” FilVetREP was formed last year to obtain national recognition of Filipino WWII soldiers

French prosecutor Francois Molins has identified the driver as 31-year-old Tunisian, Mohamed Lahouaiej Bouhlel, a delivery truck driver. Authorities said that the truck was loaded with weapons and hand grenades. The police have searched two locations in Nice on Friday, July 15 including an apartment where Bouhlel lived. They have also detained Bouhlel’s wife. Among the dead were 10 children and teenagers, according to Molins. Two Americans were killed in the attack: Sean Copeland, 51, of Austin, Texas and his 11-year-old son, Brodie Copeland, according to The Austin American-Statesman. Hollande and other French government leaders met with survivors at the Pasteur Hospital in Nice. China is claiming its right over the West Philippine Sea, citing its so-called nine-dash line. But according to United Nations Convention on the Law of the Sea (UNCLOS), which China
ratified, the said nine-dash line overlaps the Philippines’ exclusive economic zone (EEZ). Duterte also commented on China’s statement in which it warned that it has the right to set up air defense. “So (we have to be) careful. According to CNN, Pence called Trump’s attacks on an Indiana-born judge of Mexican heritage “inappropriate”and called Trump’s proposal to temporarily ban Muslims from entering the U.S. “offensive and unconstitutional.” Yet, Pence is still onboard with the Trump campaign. “I served in Congress for 12 years. I’ve been a governor for three and a half years. I haven’t agreed with every one of my Republican colleagues or Democrat colleagues on every issue, but I’m supporting Donald Trump because we need change in this country,” Pence said. “I believe he represents the kind of strong leadership at home and abroad that will, to borrow a phrase, make America great again.” Clinton called Pence a “potential disaster for America” on Twitter. parole, the beneficiary is permitted to temporarily reside and work in the US while waiting for their immigrant visas to become available. The parole allows for three years of residency, but the applicant may reapply for parole. Beneficiaries include the immediate family of the veteran – spouses, children and siblings – whom a Petition for Alien Relative (Form I-130) was filed. They do not have to be Filipino, and they can be located anywhere in the world, not just the Philippines. The veteran must also be recognized by the Department of Defense as a Filipino veteran that fought for the United States during WWII. Additionally, the veteran must be/have been a US citizen or lawful permanent resident that maintained primary residency in the US. Family members may still apply if the veteran has passed away as long as he/she had filed the Form I-130 for said family member. Although the FWVP program doesn’t guarantee permanent residency, it brings family members to the US faster, said Allison Kent, USCIS associate counsel for the Office of Chief Counsel. Kent added that due to the complexity of immigration and each family’s unique situations, the process of granting parole is discretionary. “All of these determinations are so case-by-case it really depends on the circumstances,” Kent said. Emmanuel A. Salomon, commissioner of the Veterans Affairs Commission of the City of Carson and a 20-year veteran of the
US Army, said that he hopes the program will fulfill the needs of Filipinos, noting that many WWII veterans who have already passed away had applied for other benefits but never received them due to issues with their visas. Similarly, Carson Councilmember Elito M. Santarina hopes that the program will be sustainable. He also hopes that it will fulfill its promises of uniting as many Filipino families as possible. “This is a great way to really serve the veterans and the families of our veterans because we have to admit that they have been neglected,” Santarina told the Asian Journal. “This is something that is long overdue, so I hope this is something that is going to really be implemented.” The USCIS recommends seeking advice from licensed attorneys or civil rights and legal organizations like Asian Americans Advancing Justice – Los Angeles (Advancing Justice - LA) to avoid running into fraudulent immigration lawyers. Stephanie Kwan, branch chief of the International Operations Division of the USCIS, told the Asian Journal that the program was created to honor the 260,000 Filipino soldiers that fought in WWII and recognize their “extraordinary contributions and sacrifices and hopefully provide a way for their family members sooner to provide care and support for them during this time in their lives.” The program was first announced in a White House report in July 2015, which laid out plans to make the legal immigration process more efficient. “The parole program is a part of the broader common sense steps that the president has
taken to address the gaps in our immigration system,” said Tom Wong, WHIAAPI advisor. It coincides with a discontinued program President Barack Obama introduced in 2009 called the Filipino WWII Veterans Compensation Fund which gave onetime lump sums to qualified veterans. Wilfredo U. Credo, a Filipino WWII veteran, had applied to that program but was denied. He, however, plans to apply for the FVWP to bring family members from the Philippines to the US. Credo, 92, dedicated two years of service during the war and had fought in the frontlines of combat. “I want to petition my stepbrother if that’s possible,” Credo told the Asian Journal. Attendees and government officials alike acknowledged that the program’s introduction 70+ years after the war is long overdue. But many expressed appreciation for the program and hope that it will effectively cater to the veterans and their families. “We are very thankful for the concern for the veterans because the days are numbered. They are more than 90 years old, and it’s better late than never,” Filipino Veterans Foundation member Romeo Bejo announced at the session’s close. Congress releases new material on Sept. 11 attacks
CONGRESS released eight previously classified pages on Friday, July 15, which discuss a potential connection between the 9/11 hijackers and Saudi Arabia. Tour de France to continue as planned despite Nice attack
THE Tour de France continued as scheduled with a time trial Friday, July 15, despite the attack on Nice a day prior. Friday’s time trial was a 23-mile leg, which toom place only about 200 miles or three and a half hours away from Nice by car. “Today, we want to pay homage to the victims with dignity,” Tour director Christian Prudhomme said, according to the Associated Press. “We have been asking ourselves if the race should continue, and after consulting with authorities, we have decided that it should. The Tour de France will continue in a subdued and solemn manner.” The publicity caravan that usually precedes the riders playing music and distributing gifts rode silently, according to the Washington Post. LOS ANGELES — The Wage Justice Center and Asian Americans Advancing Justice-Los Angeles (Advancing Justice-LA) on Thursday, July 14 reached a $5 million class action wage and hour settlement on behalf of nearly 400 immigrant Latino and Korean American port truck drivers against a port trucking company comprised of intertwined corporate entities. “When I chose to stand up and fight for fair wages for myself and my co-workers, I was fired,” says Mariano Saravia, a former driver for QTS, Inc. “It’s been a long, hard road, but I’m happy that we will see some of our stolen wages, and more importantly, that drivers are no longer held captive by agreements that exploited us in order to benefit the company.” The company, QTS, Inc., and its related entities including LACA Express and Win Win Logistics misclassified their drivers as independent contractors in order to deny them their rightful compensation, and then hid behind purported bankruptcy protections to avoid liability for wage theft and other exploitative business practices. The parties reached a settlement after the drivers followed the company into bankruptcy court and asked the court to act in the interest of justice by consolidating the assets of all of the related business entities in order to overcome the company’s disingenuous claims of poverty. “The settlement is the first
to successfully attack this dual scheme of misclassification and corporate shell games that is endemic in the port trucking industry,” stated Nicole Ochi, supervising litigation attorney from Asian Americans Advancing Justice-Los Angeles. “Unfortunately, misclassification is the port industry norm. Nearly twothirds of all port truck drivers nationally are misclassified as independent contractors, resulting in an impoverished, mostly immigrant workforce. We are proud that with this settlement, hundreds of drivers will be rightfully compensated, and we hope this case sends a strong signal to other drivers that they can win if they fight back.” By classifying the drivers as independent contractors but controlling them like employees, companies are able to evade taxes as well as shift all the costs of operating their businesses to the drivers, including the cost of trucks, gas, maintenance and repair, and insurance, leaving drivers with poverty wages. These high weekly deductions operate like debt bondage, forcing the drivers to work dangerously long hours to eke out a living. “The trucking company dictated how much I got paid, which loads I took, and from whom, yet they denied that I was their employee,” says Victor Vitela, a former driver for QTS, Inc. “I was forced to work 80 or more hours per week, sacrificing my health and my family relation-
ships in order to make just a few hundred dollars after all the expenses they took out of my paycheck.” As counsel for the port truck drivers, Wage Justice Center and Advancing Justice-LA filed papers with the Los Angeles Superior Court on July 14, seeking preliminary approval of the $5 million class settlement and an end to the drivers’ three-yearlong fight for fair pay and accountability, over half of which has taken place in bankruptcy court as the defendants played paper games with business names and assets in an attempt to avoid liability. In one instance, the defendant QTS, Inc. filed for debtor bankruptcy protection, stalling the drivers’ case, on the same day that QTS, Inc.’s former President James Kang created a new corporation, which took over all of the debtor’s accounts and drivers. “The defendants in this case filed for bankruptcy to try to avoid paying our drivers their hard-earned wages,” said Jay Shin, senior staff attorney at Wage Justice Center. “But we were not ready to concede the millions of dollars stolen from our drivers. We doggedly followed them into bankruptcy court and used innovative legal theories to hold the companies liable.” Judge Berle of the Los Angeles Superior Court will hear Plaintiffs’ motion for preliminary approval of the class settlement on August 12, 2016 at 10 a.m. n

WWII in the Philippines in the new curriculum framework for US history
NEARLY 75 years since the beginning of America’s involvement in World War II, history was made on Thursday, July 14, when the California State Board of Education (SBE) approved the inclusion of World War II in the Philippines in the revised history curriculum framework for the state. This seminal part of WWII history will be included in the Grade 11 U.S. history (Chapter 16) curriculum framework. The approval by the SBE is the culmination of many years of hard work from the Filipino community. In 2011 AB199, legislation sponsored by Fiona Ma and Leland Yee was passed by the California legislature which “encourages for the inclusion of the role of the Filipinos during WWII in the history/social sciences curriculum for Grades 7-12.” In 2014, the Bataan Legacy Historical Society (BLHS) started working with the Instructional Quality
Commission (IQC) of the California Department of Education to implement AB199. With the support of State Superintendent Tom Torlakson, BLHS was able to expand the scope of the proposed curriculum framework to include World War II in the Philippines. On May 19, 2016, the IQC’s History Social Sciences Committee approved all of the recommendations made by BLHS. Chapter 16 of the Grade 11 U.S. History will include the following: The Philippine Commonwealth; the creation of the United States Army Forces in the Far East (USAFFE) comprised of Americans and a majority of Filipinos; the disruption of the timetable of the Imperial Japanese Army by the USAFFE Forces despite suffering from massive disease and starvation and fighting without any air support; the Bataan Death March and the thousands of ca-
sualties; the role of the Filipino and American guerrillas during the liberation; the American soldiers who were transported in hell ships to labor camps in Asia; the Battles of Leyte Gulf and the destruction of Manila. This will be the first time that WWII in the Philippines will be taught to high school students in California and even in the United States. California’s new history curriculum framework can become the model for teaching this seminal point of WWII history in the U.S. BLHS has formed a curriculum steering committee to create a sample curriculum template that schools can use to implement Chapter 16 of the Grade 11 U.S. History. BLHS is also organizing an exhibition that will open on October 15 at the War Memorial Performing Arts Center and a conference on October 29 at the San Francisco Main Library. n

AFTER the UN-backed Permanent Arbitration Court in The Hague ruled that China has no historic title to the South China Sea, Indonesia reacted by announcing a boost to its external defenses. Jakarta said it would improve an airstrip, construct new ports, and deploy drones, warships, surface-to-air missiles and a fighter jet to the Natuna Islands, where Indonesian forces have clashed in recent months with Chinese coast guard personnel escorting Chinese fishermen. The Natunas lie outside the “nine-dash-line” maritime territory claimed by China, which the arbitral tribunal ruled has “no legal basis.” The Indonesians previously said they had no dispute with China, but they have built up their capability to defend their territorial waters and 200-nautical-mile exclusive economic zone. As China rapidly constructed artificial islands in disputed waters, however, its fishermen, always escorted by armed state personnel, ventured even beyond the nine-dash-line, all the way to Indonesian waters. The Philippines does not have Indonesia’s external defense capability, having neglected to build up defense self-reliance while under the US security umbrella. With too many other current funding priorities, the Philippines cannot hope to match the military capability of most of its neighbors. But the Philippines can invest in beefing up its civilian maritime patrol capability. The Bureau of
Fisheries and Aquatic Resources, which is under the Department of Environment and Natural Resources, and the Philippine Coast Guard under the Department of Transportation need more vessels, trained personnel and resources such as drones to effectively patrol Philippine waters. The country has one of the most extensive coastlines in the world. I still remember the tears and the anguish I felt when I saw the exhibit, “Breach of Peace: Photographs of Freedom Riders,” by Eric Etheridge on April 2010 at the Skirball Museum in Los Angeles. Included were photographs taken
by Joseph Postiglione (1922-1995), an American born in Italy. He took photos of young black men and women inside a burning Greyhound bus on May 14, 1961. That day, May 14, 1961, was a quiet Mother’s Day in Anniston, Alabama, described by the companion Road to Freedom book: “A Greyhound bus travelling from Atlanta to Birmingham, carrying fourteen passengers (including reporter Moses Newson, covering the Freedom Rides fro the Baltimore Afro-American) pulled in to the terminal, where the station doors had been locked shut. The bus was immediately set upon by a mob led by a local Klansman named William Chappell, its tires slashed and windows smashed. There were no police in sight. When law enforcement finally arrived (after approximately twenty minutes), they gave the bus a cursory inspection for damage and ordered the driver, O.T. Jones of Birmingham, to leave the terminal, escorting him to the town limits, where the vehicle was left to the mercy of the following mob. The bus limped along the highway for about six miles before being forced off the road on the outskirts of Bynum by a convoy of cars and trucks that had grown to forty or fifty in number. The bus was stormed by the mob, the passengers were trapped inside, and the bus was firebombed. It was a scene of carnage. Postiglione captured the drama in a shocking series of pictures that until recently was known only through a handful of photographs that he made available to the news services. Two pictures were sold to AP and UPI and seven were reproduced the following
day in the Anniston Star.” What happened next? A young 12year-old girl Janie Miller offered water to these passengers, even as she was taunted by the Klansmen to stop. Her kindness was met by more threats, until her family had to leave and seek refuge elsewhere. When the black bus riders went to the local hospital, doctors refused to treat them. “They were eventually rescued in the dead of night by a squadron of cars sent by Rev. Fred Shuttlesworth, pastor of Sixteenth Street Baptist Church in Birmingham.” I was more horrified when the exhibit’s photos showed dogs intentionally unleashed on African Americans, Clorox bleach intentionally poured into the swimming pool while an African American woman swam, and fire hoses collectively unleashed to brutalize these American citizens. Many African Americans sacrificed their lives to obtain human and voting rights for us, folks of color. After all, only Caucasians were deemed American citizens until a series of case law broadened that definition. Blacks were lynched and hanged on trees pursuing freedom. Homemade bombs were commonly set off in black homes and churches by the Ku Klux Klan. On Sept. 15, 1963, four girls were killed: Addie Mae Collins, 14 years old; Denise McNair, 11 years old; Carole Robertson, 14 years old and Cynthia Wesley, 14 year old and 14 injured in a bomb blast at the 16th Street Baptist Church in Birmingham, Alabama, as reported by CNN.com. Inside the church were some 200 church members with some attending Sunday school classes before the 11am service. The bombing of the Baptist Church was the third in 11 days. Alabama George Wallace sent out 500 National
Guardsmen and 300 state troopers to this city joined the next day by 500 police officers and 150 sheriffs’ deputies. It was not until May 16, 2000, when a grand jury indicted Bobby Frank Cherry and Thomas Blanton with eight counts each of first-degree murder. Cherry was found guilty after two years and was sentenced to four life terms. On Nov. 8, 2004, he died in prison. The images of the Skirball Museum disturbed me and to this day, I vividly remember them. A week after seeing that exhibit, I went to the California’s African American Museum. There, I saw a facsimile of a boat that carried the slaves, packed like sardines in the lower deck of the ships. I went inside to feel what it was like and saw the chains and the dog collars used. It was a feeling of horror -- the same feelings triggered when I saw another exhibit at the Japanese American National Museum. There, different colors of sand were on display, symbolizing the different internment camps in the West, where over 127,000 Americans of Japanese descent were imprisoned during World War II. Their crime? Nothing. Their common feature: all were American citizens of Japanese ancestry, suspected of being WWII enemies. In fact, the 442nd Infantry Regiment became the most decorated platoon of the war, with eight Presidential Unit Citations and 21 Medal of Honors. With a theme of “Go for Broke,” the fighting unit was almost entirely comprised of American soldiers of Japanese descent who proudly and valiantly served. Back then, Voting Rights were not recognized for all Americans, and for a long time, only white Americans were considered citizens. A 1790 Naturalization Act defined American citizenship as limited to only “free, white persons.”
Armenians who came in this early period were designated whites and gained citizenship with the help of anthropologist Franz Boas. But, in 1922, Takao Ozawa could not become an American citizen, though he was born in the U.S., as he was not considered legally white, but a Mongoloid, according to Race: the Power of an Illusion by PBS. Yes, for a long long time, Americans born here in the USA, with Japanese ancestors, including African-Americans were treated with disgust, animosity and inhumanity, yet their responses were the opposite, dignify themselves even more. The Myth: “all that is white is right, black is wack” to #Icantbreathe On August 26, 2014, OWN aka Oprah Winfrey Network televised the intervention done by Iyanla Vanzant. We must interrupt the pattern, Eric Garner of Staten Island. John Crawford of Ohio. Trayvon Martin in Florida. Dante Parker of Victorville, California, Michael Brown of Ferguson. And two days later after Michael Brown was killed, Ezzell Ford of Newton in Los Angeles, California. The worst part of these unjustified killings was that they were done by police officers in uniform. In Eric Garner’s case, he was unarmed, selling cigarettes by the unit. Instead of the police talking him down and diffusing the incident, they all decide to march in on him and with a tactical maneuver, put him in a chokehold that ultimately killed him as he kept saying, “I can’t breathe.” This was all documented on videotape, yet the grand jury decided no indictment for the policemen. Robredo dismisses conspiracy theories on her husband’s death by dana

VICE President Leni Robredo dismissed conspiracy theories surrounding the death of her husband, former Interior and Local Government (DILG) Secretary Jesse Robredo, saying she believes that his death was an accident. Posts circulating online theorized that Jesse’s death was planned after he purportedly discovered the connection between the illegal drug trade in the country and Philippine National Police (PNP) top brass, along with other top government officials. Speculations also indicated that Jesse was investigating Chief Superintendent Joel Pagdilao, former chief of the National Capital Region Police Office (NCRPO).
Pagdilao is one of the five generals President Rodrigo Duterte accused to be involved in illegal drug trades in the country. However, the vice president refuted these claims, saying she is certain that her husband died in an accident. “Sigurado ako na ‘yong nangyari sa asawa ko, aksidente (I’m sure that what happened to my husband is an accident),” Leni said on Thursday, June 14, according to reports from Inquirer. Jesse Robredo was killed in a plane crash along the Masbate coast in August 2012. Reports from Inquirer stated that after his death, DILG Undersecretary Rico Puno, Pagdilao, and several other police officers barged into Jesse’s condominium to “secure classified documents” that he kept. “Alam ko na may mga iniimb-
estiga siyang mga issues, pero hindi ko alam kung kabahagi doon si General Pagdilao (I knew that he was investigating some issues but I do not know if General Pagdilao is involved),” she said in an ABS-CBN report. “Hindi ko rin alam kung kasama siya do’n sa mga nag-attempt na pumasok sa condominium unit namin the day after the crash, (I also do not know whether he is one of those who attempted to enter our condominium unit the day after the crash),” she added. Instead, “Hands-Up, See Me.” Most recently in the past month, the nation again witnessed killings at the hands of police officers: Alton Sterling in Baton Rouge, Louisiana and Philando Castile in Falcon Heights, Minnesota. Hands-Up, See Me At the Beverly Hills Farmers Market, one morning, I saw a Latino American record producer shooed away and told not to sit next to a white elderly man. The white guy said, “This is my chair,” when he was sitting on one already. I saw the hurt in this Latino man’s eyes. I waved at him and loudly, “Here, please sit next to me.” I wanted to neutralize the bigotry and it resulted in me getting the most profound spiritual lesson of all times: “That when you are born and survived the first year even without your parents nurturing you, the Universe’s angels were taking care of you.” At the same market, I saw a white volunteer stop an African American man from gathering recyclables in a trash container. The white guy said, “This is my trash can. Stay away from here. Go back to your neighborhood.” I was sitting next to the trash can. I stood up and said, “Listen, this trash can belongs to the City of Beverly Hills. It is for all of us to use. You both can gather recyclables from this trash can. You do not have to dehumanize him and pointed to the black man.” The white man was perturbed but the rest of the folks sitting in the tables clapped. They said, “thank you for standing up for that poor fellow.” On Facebook, Third Paran posted this: While
watching the Ken Burns documentary on jazz, I couldn’t help but be struck by the following quote from Wynton Marsalis and how it applies to what is happening now, after the non-indictments in the #MichaelBrown and #EricGarner cases. There’s a long way to go yet in the struggle, and sometimes there’s a stubborn refusal to go at all where we all feel we must go. And you wonder why. “Race is … for this country, the thing in the story, in the mythology, that you have to (address) for the kingdom to be well. And it’s always something you don’t want to do–it’s always that thing that’s so much about you confronting yourself … And the question of your heroism and of your courage and of your success in dealing with this trial is ‘Can you confront it with honesty?’ And DO YOU confront it and do you have the energy to sustain an attack on it? … The more we run from it, the more we run into it.” Not all white folks are racist. Kuwait establishes minimum wage for maids by Klarize

KUWAIT has become the first state in the Gulf region to set a minimum wage for its estimated 600,000 domestic workers, most of whom are overseas workers from Asia. The minimum wage is set at 60 dinars (roughly $200 USD) a month, according to a decree issued by Interior Minister Sheikh Mohammad Khaled Al-Sabah. Al Jazeera reported that the decree also promised other rights, including a weekly day off, guaranteed overtime pay, 12hour working days with rest periods, 30 days of paid leave annually and an end-of-service benefit when the contract ends. Kuwait becomes the first Gulf country to regulate the domestic work industry through legislation. Over 2.4 million domestic
workers serve homes across the Gulf, and with the exception of those in Kuwait, they are not protected by labor legislation. Human rights watchdogs like Human Rights Watch (HRW) have documented the widespread abuses towards domestic workers, especially imported workers like overseas Filipino workers (OFWs). They have reported sexual and physical assault, unfair wages, long and continuous working periods, no rest days and no avenues to rectify their rights. Many organizations have urged the government to reform labor laws to include protections for domestic workers. Additionally, they have called to a reform of the kafala system. The kafala system is a form of sponsorship used across the Gulf regions meant to manage the migration system and monitor over-
seas domestic workers. However, it prohibits workers from moving on to a new job before the end of their contract upon the discretion of their employers. In turn, many are unwillingly trapped in their jobs, many of which are abusive. This system has been criticized by organizations as a form of forced labor, or even slavery, according to Al Jazeera. In 2014, labor bureaus in the Gulf and Asia have collaborated and agreed on several initiatives designed to protect the foreign workers and improve working conditions. On Wednesday, July 13 HRW said that employers of domestic workers in Oman are abusing their workers. HRW said it interviewed 59 domestic workers and some had said that they were forced, or trafficked, into the system. n

However, the charges against the former vice president were later filed upon the expiration of his immunity from suit. According to reports from Inquirer, the Ombudsman said documents show that Binay Sr.
and Jr. approved the Bids and Awards Committee resolutions, notices of awards, contracts and payments using unnumbered/ undated disbursement vouchers and obligation requests despite the anomalies. The Binays awarded the contract to Mana Architectural and Interior Design (MANA) despite the allegedly lack of public bidding, and approved of P11.97million payment despite the anomalies. However, Salgado said that this is just a diversionary move

Marcos camp deplores Smartmatic for seeking media ban in ‘clarificatory presentation’ of the AES THE camp of former Senator Ferdinand “Bongbong” Marcos Jr. on Thursday, July 14 deplored the move of Smartmatic to exclude members of the media from its “clarificatory presentation” of the Automated Election System before Manila Prosecutors’ Office. This developed after Smartmatic personnel, instead of filing their Rejoinder to the complaint filed against them, filed a manifestation and motion to hold a clarificatory presentation to explain the AES and the other technical aspects of the case without the presence of any other party including the media. Lawyer Adrian Aumentado, counsel of former Abakada Rep. Jonathan Dela Cruz, political advisor of Senator Marcos, said it is highly irregular why Smartmatic would want to ban the media from attending the clarificatory presentation of the AES when the case filed is all about transparency. “To exclude the media from the clarificatory presentation is tantamount to denying the public’s right to know the processes used in THEIR election. We are for transparency and that is what this case is all about and we just find it highly unusual that the media would be excluded from such presentation when it is after all a clarificatory hearing,” Aumentado pointed out. During the hearing, the panel of prosecutors also expressed surprise by such move. When a member of the Smartmatic team said they were merely concerned about the logistical and practical requirements if members of the media were around, the panel said such would not be a problem since they can always arrange for a place for everyone including the media to be accommodated. Aumentado also expressed surprise that Smartmatic would be the one to initiate a clarificatory presentation when the initiative should be coming from the panel of prosecutors. He also asked to be given a period to file their opposition and/or manifestation to the motion. The panel, however, said the move would give them a chance to clarify certain technical as-
pects of the case without prejudice to whatever motion the former Senator’s counsels may file on the matter. They then set the clarificatory presentation to July 21, 2016 at 1:30 p.m. Dela Cruz had filed charges for violation of Section 4(a) of the Cybercrime Prevention Act of 2012 or R.A. 10175 against Smartmatic personnel Marlon Garcia, a Venezuelan national and head of the Technical Support Team; Elie Moreno, an Israeli national and Project Director, Mauricio Herrera, a Panamanian national and Neil Banigued, member of the Technical Support Team; and Comelec IT experts led by Rouie Peñalba, Nelson Herrera and Frances Mae Gonzalez for their act of “intentionally altering computer data, without right and altering and interfering with the functioning of a computer and computer network by inputting, deleting and altering computer data and program, without right or authority.” Dela Cruz said their act of changing the script of the Transparency Server on the night of the elections at the height of the transmission of votes without authority constitutes a clear violation of the said law. cused the respondents of misleading the prosecutors when they claimed in their respective counter-affidavits that the change they made in the system in the Transparency Server cannot be considered illegal access because the latter is not part of the Automated Election System (AES). “By so doing, respondents are attempting to mislead this Honorable Office thru technical illustrations irrelevant to the present controversy,” Dela Cruz said. He said such contradicts their earlier admission that “the AES is made up of several components, namely the election management system (EMS), the VCM, the CCS and the Transparency Server.” Dela Cruz added that respondent also “deliberately omitted” the fact that RA 8436 as amended or the law authorizing Comelec to use the AES had expanded the definition of the system to include the “transmission of election results and other electoral processes.” The respondents are also charged with a separate case for the violation of the Automated Election Law before the Comelec over the script change. The case is also undergoing preliminary investigation. n

ISIS recruits Southeast Asians through newspaper by Klarize

THE Extremist group Islamic State (ISIS) has launched a new Malay-language publication in an effort to gain support among jihadists in Southeast Asia, according to Malaysian newspaper Berita Harian. Called Al-Fahitin (Arabic for “The Conqueror”), the newspaper was launched in the southern Philippines on June 20 and has been distributed to Malaysia, Indonesia, Brunei, Singapore, southern Thailand and in parts of Mindanao where many of the Filipino Muslims there speak the Malay language. CNN Indonesia reported that ISIS has its own sector of Malayspeaking correspondents from Indonesia, Malaysia and the Philippines called Katiba Nusantara. Jasminder Singh and Muhammad Haziq Jani, terrorism analysts at Nanyang Technological University in Singapore, co-authored a research paper last month called “Al-Fatihin: Islamic State’s First Malay-Language Newspaper”, which detailed the purposes of the newspaper, which were to serve Southeast Asian jihadists and recruit new ones. They also analyzed the underlying effects of introducing such a publication to the region.
“Al-Fatihin’s tagline (“The newspaper for Malay-speaking migrants in the Islamic State”) drives the point that, no matter the differences and nuances in language, identity and origins, Southeast Asian jihadists have [a] common logos and as such, all Malay-speaking jihadists should act as one,” said Singh and Jani. The paper detailed the first issue of the newspaper, which was 20 pages long and focused on the month of Ramadan and the act of jihad, also known as the “holy struggle.” The issue also included a threepage message from the late Abu Ayyub al-Masri, Egyptian insurgent and former al-Qaeda leader in Iraq, encouraging insurgents to “continue their jihadist activities, search for martyrdom and kill and crucify the polytheists, disbelievers, oppressors and transgressors.” The use of the Malay language was an effective strategy for recruitment because it allows for the organization to “disseminate [ISIS] propaganda” to a broader audience in an effort to unify the jihadist population in the region. “Al-Fatihin buttresses [ISIS] messages calling on militant groups in Indonesia and the Philippines to unite and pledge their allegiance to Abu Bakr Al-Baghdadi,” the paper read.
An anonymous security expert told Berita Harian that the newspaper can be seen as a warning that Malay-speaking territories are in ISIS’s sight. “This psychological campaign means that the terrorists have a big objective, which is to expand their influence among people who understand the Malay language,” said the expert. The source added that based on the way that the language is being used, the writer(s) and/or editor(s) may be from Southeast Asia. Two days after Al-Fahitin was launched, ISIS released a video claiming the Philippines as its territory and told its supporters in Southeast Asia to travel to the country if they can’t make it to Syria, according to Singaporean newspaper Strait Times. The Philippine military reportedly dismissed the video as “mere propaganda,” according to Strait Times. Over the last few years, there has been growing speculation that the Philippines is ISIS’s next target. Southeast Asian militant groups have already pledged allegiance to ISIS, like the Abu Sayyaf in Mindanao and Mujahideen in eastern Indonesia. An upsurge of jihadist activity from Abu Sayyaf, has raised concern over ISIS’ influence in the country. n

DONITA Rose breaks her silence about the reports that she is separated from her husband Eric Villarama. On the Tuesday, July 12, episode of podcast program “Good Times with Mo,” Donita speaks up about her marriage after a caller asked her about an Instagram post of her husband with another woman. The former MTV VJ admitted that it was true and she knew about it after her guesting in the same show, which was a few days ago. “A lot of people have been asking and I’ll talk about it when I’m ready,” she replied to the caller. “But for the time being, I’ve just been advised to not say anything about it until something specifically happens. So I’m just waiting and I promise to let you know when I’m ready.” She denied that it was their long distance relationship that ended their 14 years of being together. Donita said their relationship has been on the rocks until they finally decided to part ways two years ago. “Now I guess he made it official when the other day, I found out that he came out with a post of...I guess his profile picture is with the girl,” she said about her separation with Villarama. “We did talk about it, we talked about it the other day and he apologized to me.” Donita said she’s not ready to go into the details on what happened to their marriage because she’s in the process of healing.

It’s amazing how Gary Valenciano has proven true to his reputation as Mr. Pure Energy even after he has passed the halfcentury mark (but doesn’t look it). Besides its healing effect, music may as well be an elixir of youth. Haven’t you noticed that among his peers (age bracket), only Gary can multi-task, for more than 33 years regaling music-lovers both here and abroad and being visible in television and “live” shows — that is, despite his being, as we all know, a diabetic since he was 14 and dependent on shots of insulin. Due to insistent public demand and to commemorate his 33rd anniversary in the business (and the 30th anniversary of his management company, Manila Genesis Entertainment and Management, Inc.), Gary is mounting what is touted to be “the fourth and most exciting installment” of his critically acclaimed and commercially successful “Gary V Presents.” Being diabetic, how do you avoid getting hypoglycemic during a concert (how much sugar do you have to take to sustain your energy)? “Wow, that’s a good question. the normal (sugar) level of any diabetic is between 80 to 120. I should be about 170 to 180 before I perform because any form of exercise and cardio will burn the glucose immediately. so, if I come out in a concert or a performance and my blood sugar is about 180, I’m good for the next eight to nine songs. “But to keep it like that, it’s a hit or miss. so sometimes, it’s about 200 or slightly above 200 but it will come down after a while. to maintain that, again it’s hit or miss — especially when I’m on stage because sometimes my sugar does go down, sometimes I do hypo when I’m on stage. And I’m very open and very honest with my audience while I’m suffering it. I tell them talaga, after a song: ‘Guys can you excuse me, my sugar level is going down and I need to take something.’ “It doesn’t happen all the time but it does happen every once in a while. I take juice in the middle (of a concert) — and I make it all part of the show and I present to them (the audience) what is real and it’s not to threaten anybody or to make them feel bad for me or to generate anything like that — I just have to be honest because that’s my health, and it has to come first.” What three songs come closest in describing the essence of a Gary Valenciano? “It would have to be songs of mine because other songs only

Your Immigration Solution Devin Connolly & nanCy Miller A NON-citizen who is granted lawful resident status based on marriage will receive conditional permanent residence if the marriage on which the green card is based is less than two years old at the time the application is approved. Conditional resident status is nearly identical to permanent resident status. The major distinction is that the conditional resident’s status is only granted for two years. It automatically expires on the second anniversary of the application’s approval. In order to prevent the automatic termination of status, the conditional resident and the petitioning spouse are required to file a joint petition in the 90-day period preceding the second anniversary of the date the non-citizen became a conditional resident. A joint petition requires the conditional resident and spouse to prove that their marriage is bonafide or real. This is not the same as legal. A marriage may be legal but not bona fide. Bonafide refers to a marriage between two people who had the intent to establish a life together when they entered the marriage. The opposite is a sham marriage, which is entered into solely for the purpose of obtaining an immigration benefit. The former is valid. The latter is not. The U.S. Citizenship and Immigration Service (USCIS) will obviously only remove the conditions on a person’s residency when that person has sufficiently demonstrated they are in a bonafide marriage. The conditional resident and spouse must therefore provide sufficient documentation to support their claim that their marriage was bonafide. The joint petition must also prove that the parties are still living together as a married couple. It is a sad reality that marriages sometimes end before they
Removing the conditions on your green card reach their second anniversary. In some cases, the marriages end due to the death of a spouse. In other instances, they end due to irreconcilable differences between the parties. In both cases, joint petitions are no longer possible. Thankfully, the USCIS allows the conditional resident to request a waiver of the joint filing requirement. The Immigration and Nationality Act permits requests for waivers to be granted in the following situations: (1) the marriage was entered into in good faith but the qualifying marriage has been terminated; (2) the noncitizen will suffer extreme hardship if removed to their native country; and (3) the marriage was entered into good faith but the non-citizen was subject to battery or extreme cruelty during the marriage. A good faith waiver requires the conditional resident to demonstrate that the marriage was not entered into solely for immigration benefits. Rather, they must prove that they entered into the marriage with the intention of creating a life together with their ex-spouse. An alien is not eligible for the waiver until the marriage is legally terminated. Separation is not enough. The divorce must be final. While waivers of the joint petition do not have the same two year filing requirement, failure to file will open the non-citizen to the possibility of being placed in removal proceedings. However, being placed into proceedings
does not preclude the possibility of seeking the good faith waiver. The process is more complicated but, certainly, do-able. An extreme hardship waiver requires the conditional resident to establish that they would suffer extreme hardship if deported from the U.S. The USCIS will only consider hardship to the conditional resident that arose during the conditional status period. USCIS assumes that returning home will have difficulties. Therefore, the conditional resident must show that the hardship would be beyond the norm. Examples of hardship include separation of family members, inability to treat medical conditions in the home country, lack of employment opportunities, political unrest, repercussions of natural disasters and more. Identifying the hardship is Step 1. Showing why the effect is extreme is the essential Step 2. Finally, a conditional resident may also request a waiver of the joint filing requirement based on the extreme cruelty they were subjected to by their spouse. Extreme cruelty may, but does have to, refer to physical violence. Psychological and emotional abuse are also forms of extreme cruelty. Emotional abuse can be very subtle. That makes it harder to prove. Often, expert evaluations are helpful in this regard. We briefly mentioned the possibility of the marriage end-

Community property is ½ mine. That motorcycle is community property because my husband bought it at the time when we were married and living together as husband and wife. That credit card debt of $5000.00 is also a community debt because it was also incurred when we were married and living together as husband and wife. Therefore, I’m stuck. I now have a ½ of a motorcycle and possibly a $2500.00 debt that I never wanted. Another example is pensions and/or retirement plans. Even though the monies are not going to be distributed until retirement, that “bank” is accumulating. Because it is accumulating during the time I am married to someone, then that “bank” is ½ mine and ½ my husband’s. Of course, the community will only have the portion of accumulation from the date of marriage to the date of separation. Not before and certainly not after. Do I need a premarital agreement before getting married? Barrister’s Corner Atty. Kenneth uRSuA ReyeS IN the absence of a premarital agreement, the general community property presumption under California family code section 760 controls which provides “ ….all property, real or personal, wherever situated, acquired by a married person during the marriage while domiciled in this state is community property.” Family Code §760. This becomes a problem if you are the spouse that has the substantially higher income or the one who accumulates the majority of the assets during the marriage. You are called in family law lingo “the in spouse.” The other spouse (or in our lingo also called the “out spouse” gets a half interest on everything accumulated during the marriage even if the asset is under your name alone or it was accumulated solely due to your sweat and hard work. The out spouse, who stayed at home most of the marriage, gets a one half interest on all the accumulations during the marriage under California community property law. For example, if you opened a savings account during the marriage under your name alone for which you religiously and diligently stash away 25% of your earnings during the marriage while your spouse blows away his/her salary during the marriage, your spouse still gets a half interest in the money you saved in your savings account. Another example would be if you purchase a piece of real property during the marriage under “your name alone”
and have your spouse sign a “quit claim” deed, your spouse may still have a claim for a half interest in your real property. Another example would be if you owned a business prior to marriage, but due to your hard work, long hours of labor, and efforts, the business grew exponentially during the marriage, your spouse may still have a claim for an interest in the business. Signing a premarital agreement may serve as added protection to the future “in spouse” and a hurdle for the future “out spouse” by avoiding or altering the applicability of California community property law to assets 1) already owned by each and 2) to property and income to be acquired or earned during their marriage. Home health aides and Preventing abandonment of your other household employees green card due to travel abroad are entitled to overtime
Q: I AM a registered nurse in the Philippines but I have not yet obtained a license in California. However, I am working as a ‘private nurse’ to a bed-ridden patient in Los Angeles. My duties are mainly nursing duties – tube feedings, inserting catheter, tracheal suctioning, observing and recording vital signs, administering therapies prescribed by doctors, etc. I am a live-out employee and work a 12-hour shift, 7 days per week. I am paid a flat daily rate for all work hours. What are my rights? A: You are a non-exempt, hourly employee entitled to overtime pay. This means, for all work beyond 8 hours per day or 40 hours a week, you must be paid one and a half times your regular hourly rate (“time and a half”). For all work beyond 12 hours per day or beyond 8 hours on the seventh consecutive day, you must be paid two times your regular hourly rate (“double time”). You are also entitled to one hour additional pay at your regular rate if you were not provided any of your two 30-minute uninterrupted meal periods, and one additional hour of pay at your regular rate if you are not provided at least three 10-minute rest periods. Another issue that may arise for employees who work in private households has to do with the difference between live-in and live-out employees. Live-in employees are those who live
at the employer’s house. Liveout employees are those who go home after their daily work is done. The computation of a household employee’s overtime hours would depend on whether the employee is live-in or not. A live-in employee may be employed as much as 12 hours per day, provided that the employee has at least three hours free of duty during the 12 hours span of work. Such off-duty hours need not be consecutive. If a household employee is required to work during scheduled off-duty hours, or the employee’s work goes beyond 9 hours per shift, then the employee must be paid at the rate of one and one-half (1 ½) times the employee’s regular rate of pay (“time and a half”) for all these excess hours worked. A live-in employee must have at least 12 consecutive hours free of duty during each workday of 24 hours. If the employee is required to work during the 12 consecutive off duty hours, then the employee must also be paid time and a half for all hours worked. A live-in employee generally must be allowed a one day off (of not less than 24 hours) after 5 consecutive days of work in a workweek. If the employee is required to work for a 6th or even a 7th consecutive day in the workweek, the employee must be paid time and a half for hours worked up to and including 9 hours. Live-in employees who worked in excess of 9 hours on

the sixth and seventh workdays shall be compensated at double the employee’s regular rate of pay (“double time”). The overtime compensation for ‘live-out’ employees is computed in the same way as that of a regular non-exempt employee who works in other occupations. This means ‘live-out’ household employees must be paid time and a half for all hours worked that are more than 8 hours in a day or more than 40 hours in a week. Hours worked more than 12 hours in a day or more than 8 hours on the 7th consecutive day must be paid double time. Correctly distinguishing between the two groups of employees makes a difference in the employee’s ability to recover overtime. (2) The right to buy, sell, use, transfer, exchange, abandon, lease, consume, expend, assign, create a security interest in, mortgage, encumber, dispose of, or otherwise manage and control property.(3) The disposition of property upon separation, marital dissolution, death, or the occurrence or nonoccurrence of any other event.(4) The making of a will, trust, or other arrangement to carry out the provisions of the agreement.(5) The ownership rights in and disposition of the death benefit from a life insurance policy.(6) The choice of law governing the construction of the agreement.(7) Any other matter, including their personal rights and obligations, not in violation of public policy or a statute imposing a criminal penalty. However, the right of a child to support may not be adversely affected. Family Code §1612(b). Premarital agreements that are entered into voluntarily by par-
ties who are each represented by independent counsel and aware of the effect of the agreement, a post 1985 premarital waiver of post dissolution support does not offend contemporary public policy and is not per se unenforceable. Fam.C. § 1612(c); Marriage of Pendleton & Fireman (2000) 24 C4th 39, 53–54, 99 CR2d 278, 288–289; Marriage of Facter (2013) 212 CA4th 967, 981, 152 CR3d 79, 90. Under both the Uniform Premarital Agreement Act and prior law, the spouse claiming the agreement is invalid or not enforceable bears the burden of proof on that allegation. Family Code. § 1615(a); Marriage of Bonds, supra, 24 C4th at 27, 99 CR2d at 269; Marriage of Iverson (1992) 11 CA4th 1495, 1502, 15 CR2d 70, 74–75; However, the UPAA (as amended effective 1/1/02) deems that a premarital agreement was not executed voluntarily unless the court makes five prescribed findings provided for under Family Code. § 1615(c)
(1) The party against whom enforcement is sought was represented by independent legal counsel at the time of signing the agreement or after being advised to seek independent legal counsel, expressly waived, in a separate writing, representation by independent legal counsel. (2) The party against whom enforcement is sought had not less than seven calendar days between the time that party was first presented with the agreement and advised to seek independent legal counsel and the time the agreement was signed. (3) The party against whom enforcement is sought, if unrepresented by legal counsel, was fully informed of the terms and basic effect of the agreement as well as the rights and obligations he or she was giving up by signing the agreement, and was proficient in the language in which the explanation of the party’s rights was conducted and in which the agreement was written. A GREEN card holder can travel outside the US and return with some limitations. If a green card holder is outside the US for an extended period of time, he may be considered to have abandoned his permanent resident status. Brief travel (such as for a vacation) normally will not affect permanent resident status. However, abandonment of permanent resident status is a potential issue for green card holders who have to leave the US for an extended period of time (over 1 year) for one reason or another, such as to finish studies or work abroad. In such situations, how can a person avoid losing his green card? If a person plans to be outside the US for an extended period of time (over 1 year), an application for a reentry permit must be filed. A reentry permit establishes that one did not intend to abandon his green card, and it allows one to apply for admission to the US after being outside the US for up to 2 years without having to obtain a returning resident visa. Reentry permits are normally valid for 2 years from the date of issuance. A permanent resident can re-apply for subsequent reentry permits. Each subsequent reentry permit would be valid for 2 years. As aforementioned, if one is outside the US for an extended period of time without a reentry permit, he may be considered to have abandoned his green card. If a permanent resident has been outside the US for more than 1 year and attempts to re-enter the US, he may be referred to an Immigration Judge to determine whether he has abandoned his permanent resident status. An application for reentry permit should be filed at least 60 days prior to the contemplated extended trip outside the US. While a person does not have to be present in the US at the time his reentry permit application is approved, it is important to file it with sufficient time prior to the trip to allow time to receive the biometrics notice after the application is filed, and have biometrics taken. An applicant must provide his biometrics while in the US. If an applicant leaves the US before biometrics are taken, the USCIS may deny the application. What if a permanent resident has already left the US and either has 1) been outside the US for over 1 year or 2) been outside the US for over 2 years with an expired reentry permit? The Department of State on its website advises to apply for a Returning Resident Visa. To qualify for a Returning Resident Visa, you must show a valid reason why your stay abroad was extended, and that the reason for the extended stay was beyond your control or for which you were not responsible. Another (perhaps better) option would be to re-enter the US--if US customs denies admission due to abandonment of your green card, you will have an opportunity to argue before an Immigration Judge here in the US that you did not abandon permanent resident status. Obtaining a green card often is a difficult process. For some, it takes many years. It is accordingly important to take all steps necessary to maintain permanent resident status once attained. If you plan to be away from the US for an extended period of time, or have been away from the US for an extended period of time without a reentry permit, or a reentry permit that has expired, it is recommended that you consult with an experienced attorney. *** Darrick V. incomplete emergency Chapter 13 petition. The clerk looks for the credit counseling certificate and he says he doesn’t have one. Nevertheless, the clerk accepts the incomplete petition, which doesn’t have credit counseling, and has no schedules and gives him a list of deficiencies that have to be filed within 14 days otherwise his case will be dismissed. So today, he ends up in my office and asks me to take over the case as his lawyer. Although I agree to help him out, I had to explain to him that he has to give a satisfactory explanation to the court why he did not do credit counseling before he filed his case. If the court believes that the facts he alleges amount to exigent circumstances, the court may let him proceed with the case. Otherwise, his case will be dismissed for lack of pre-filing credit counseling. On the other hand, if client had a disability that prevents him from taking credit counseling, he would be exempt from requirement. Although client is legally blind, that may not qualify as a disability to
exempt him from the requirement to take the course because this course is also given over the phone. To be sure, many judges do not consider a foreclosure an exigent circumstance because the foreclosure process takes at least four months to complete before the house can be auctioned off in a non-judicial foreclosure proceeding. In any event, aside from explaining why he did not do credit counseling within 14 days from filing date, client still has to do credit counseling within 30 days from filing date assuming the court agrees that he was faced with exigent circumstances that prevented him from doing credit- counseling pre-filing. As you can see, you have to go through a lot of hoops if you don’t do credit counseling pre-filing so why even get into this dire situation in the first place. Therefore, make sure you do credit counseling first before you file for bankruptcy, any kind of bankruptcy so you don’t have this kind of problem to deal with. And avoid filing incomplete petitions. and obligations relinquished shall be memorialized in writing and delivered to the party prior to signing the agreement. The unrepresented party shall, on or before the signing of the premarital agreement, execute a document declaring that he or she received the information required by this paragraph and indicating who provided that information.(4) The agreement and the writings executed pursuant to paragraphs(1) and (3) were not executed under duress, fraud, or undue influence, and the parties did not lack capacity to enter into the agreement.(5) Any other factors the court deems relevant. Homeowner files last minute Chapter 13 without credit counseling 13 as load mod is denied
Atty. LAwrence yAng CLIENT is 59 and single. He has a decent job where he makes $4K a month gross. He doesn’t owe any credit card debt. He only owes 3 secured debts. He owes a mortgage on his house for $400K plus he has arrears of $83K on this mortgage. His mortgage payment is $2K a month, which means that he has not paid his mortgage for 41 months or 3 ½ years. He tells me that he has been working with a nonprofit consumer advocacy group (whatever that means) to get the bank to give him a loan modification on his mortgage. Apparently, he’s been trying to get the loan modified since 4 years ago and received multiple prior denials. This explains why he hasn’t paid his mortgage for 4 years. Finally, the bank sets the foreclosure sale date for July 6, 2016. Whoever he is talking to at the non-profit consumer advocacy group tells him that he has to file a Chapter 13 to stop the foreclosure on July 6. Unfortunately, he is not told that he has to do credit counseling first before he can file for Chapter 13. On July 1, without a lawyer, he files his

On choosing the better part other’s company by being fully present to one another and by listening to each other’s life stories. In a world now filled with social media and technology, we seem to put less value on meaningful presence and conversations. Even at dinner, we look at our cell phones to see text messages, Instagram and Facebook posts, instead of engaging in delightful conversations. We don’t realize that the more healing and wholesome experiences of life are the times when we listen and are fully present to one another. The Gospel this Sunday reminds us to choose the “better part” as we live our daily lives. While Martha kept herself busy in the kitchen, her sister, Mary, sat beside Jesus at his feet listening to him as he spoke. Then, Martha complained to Jesus why Mary was not helping her with the household chores. To this remark, Jesus responded, “Martha, Martha, you are anxious and worried about many things. There is need of only one thing. Mary has chosen the better part, and it will not be taken from her.” The “better part” that Mary chose was to be fully present to Jesus and to listen him speak. It was a value that Jesus brought up to Martha in the midst of their hectic family life. Meaningful presence is what we all need in the midst of our busy lives. It’s a state of being that does not loathe work or oth-
er activities at all, but rather promotes wellness so that we can be “better” with our jobs and responsibilities. It’s what we need to feel connected with fellow human beings. It’s what our souls long for to be at peace. The world will be a better and safer place if we promote meaningful presence and conversations. Perhaps, the reason why the world is in such bad shape today is that of our inability to be mutually present to one another—listening to each other’s needs, respecting one another’s ways and boundaries, and responding to one another’s wants. In this culture of violence, all religions and countries must promote meaningful presences and respectful conversations. MANILA—Fitch Ratings has warned geopolitical tensions in Asia Pacific, including the recent decision of the Permanent Court of Arbitration at The Hague on the maritime dispute between the Philippines and China, could cause significant economic and political instability. In a report, Fitch said maritime disputes in the West Philippine Sea underscore the growing importance of geopolitics in shaping the international policy agenda of countries in the region. It said shifts in the regional and global balance of power mean geopolitical risks would remain prevalent in the long term. “These risks have the potential to cause significant economic and
political instability, though are not currently a direct ratings driver for sovereigns in the region,” Fitch warned. It pointed out the diminishing US geopolitical influence and strength in Asia in the past decade, concurrent with China’s efforts to expand its presence are fundamentally changing the region’s security paradigm. “Recurring frictions among states are likely to be a consequence of the changing geopolitical dynamics. Recent territorial disputes involving China, the Philippines and Vietnam in the South China Sea are a case in point,” it said. On Tuesday, July 12, the Hague-based Permanent Court of Arbitration ruled that China’s claim of historic rights in about 90 percent of the resource-rich South China Sea has no legal basis. MANILA—Another partnership looms between the camps of Manuel V. Pangilinan and Ramon S. Ang as talks for a possible deal in power generation have started. In a disclosure to the Philippine Stock Exchange on Thursday, July 14, San Miguel Corp. (SMC) said it is discussing with Manila Electric Co. (Meralco) a possible investment of up to 49 percent in South Premiere Power Corp. (SPPC). SPPC, an affiliate of SMC, is the independent power producer administrator (IPPA) of the 1,200-
megawatt Ilijan power plant in Pangasinan. Ang is the vice chairman, president and chief operating officer of food-to-infrastructure conglomerate SMC while Pangilinan chairs power distribution giant Meralco. “We offered to sell 49 percent of Ilijan power plant to Meralco and we are in talks but we can only close the deal once the court case which we have filed against PSALM has been resolved,” Ang told reporters after the annual PAGE D3

Clark Green City takes position as magnet for foreign investments by Richmond

MANILA—Clark Green City is positioning itself as an investment magnet for the country as more foreign investors are expressing interest to be part of the development of the new metropolis, stateowned Bases Conversion and Development Authority (BCDA) said. In an interview yesterday, BCDA president Arnel Paciano Casanova said the agency is in talks with investors from different countries which have expressed interest in Clark Green City. “Before the elections there was much interest coming from Japan, from Singapore, and even from Europe, particularly France. We are also encouraging the US to further increase their investments in Clark,” he said. Casanova said BCDA is more optimistic in finalizing agree-
ments with these companies and government-owned corporations now that the elections are over and the new administration has settled. “After the elections and now that everything is settled then we would pursue talks again and encourage these investors to come in and participate in Clark Green City. Hopefully we come up with an agreement in the next few months,” Casanova said. “We’re very positive because President Duterte’s advocacy is development outside the capital. So in spreading the development outside Metro Manila, Clark Green City is the next best thing that could happen in this development with the scale, the kind of technology we’re putting in, and the kind of investments we’re bringing in which is global in scope,” he added. According to Casanova, Singaporean investors are looking
at industrial estate development and urban development for Clark Green City, while those from France are eyeing investments in logistics, food and agriculture. Clark Green City is a 9,450hectare development expected to be the country’s first smart, green and disaster-resilient metropolis. At full development, the metropolis is targeted to have some 1.12 million residents, 800,000 workers and contribute a gross output of approximately P1.57 trillion per year to the national economy or roughly four percent share in gross domestic product. BCDA is initially working on the development of a 288-hectare parcel of Clark Green City with local property giant Filinvest Land. Casanova said the timing of the bidding for a new portion of land would depend on market condition as BCDA’s sights are currently focused on the success of the initial 288-hectare development.

According to the court, China’s construction of artificial islands in disputed areas was a violation of the Philippines’ sovereign rights. The reclamation also aggravated the territorial row and caused “irreparable” harm to the marine environment, the tribunal added. The Philippine government, which challenged the legality of China’s expansive territorial claim in 2013, has welcomed the ruling and is now studying its next move. China dismissed the decision as “null and void” and maintained that it would not diminish its territorial sovereignty in the South China Sea. He said the ruling is “purely political” and would not have a direct effect on his business. An owner of an advertising firm
who refused to be named, believes that China has reasons for rejecting the ruling. “That ruling was expected. So was the reaction of China. Are they in favor? Cannot be answered by a yes or no quickly. Fair? Yes. But why China is doing that is because there’s a reason,” the advertising firm owner said. “China wants to be a world power and it believes that America is hindering that,” he added. ‘Good Philippine-China ties necessary’ “The effect on business depends on the next move of the government. (President) Duterte had said that if the Philippines wins and China doesn’t want to budge, he is open to bilateral talks.” The United States has vowed to remain neutral on the dispute but American officials have repeatedly criticized China’s aggressiveness in the South China Sea. Some Chinese-Filipino entrepreneurs believe the Philippines and China should settle their differences diplomatically, noting that many raw materials and products are made in Beijing. “There should be a middle ground,” said Lilian Tan, a shop owner in Binondo, Manila. “Almost all of the things we use are from China so we have no choice,” said Roland Chua, a drug store owner in Manila. Trader Keisuke Chan also welcomed the ruling but believes some important questions have to be answered. “I am in favor of the ruling. Even if I am Chinese, I was born in the Philippines and I’m already a Filipino citizen,” Chan said. “There are many resources there (in South China Sea) and supposedly that is the reason why China is also claiming the area…The question is do we have the capability to tap those resources so we can achieve economic development?” “Is there an assurance that every Filipino will benefit?”

MANILA—The National Economic and Development Authority (NEDA) is in discussions with the Department of Energy (DOE) on the possibility of making it attractive for building owners in business districts to use solar power. Socioeconomic Planning Secretary Ernesto Pernia said increased use of solar power in business centers would help reduce the country’s power requirements. “Solar power and renewables are faster to implement than coal fired power plants but also has limited power capacity and are space intensive,” he said. “But solar panels can be strapped on rooftops. So if solar panels are installed in buildings in Makati and Manila, that would be a lot of relief on our power supply requirements,” he added. He said Energy Secretary Alfonso Cusi has not opposed the idea.

“I’ve been talking to the DOE secretary already and he does not seem to be averse toward it,” said Pernia. This still being a plan, Pernia said there are no identified financing mechanisms for the program yet. The DOE, however, has an existing program for providing solar power for at least 100,000 households in the country. In September last year, the NEDA board approved the Access
to Sustainable Energy Program of the DOE which would provide households electricity and energy services through a grant assistance of solar home systems and rural power generation facilities. The project cost of P4.89 billion is financed through official development assistance. Pernia, however, said it would be more feasible if this would be done for commercial buildings whose owners could afford the cost.

Earlier this week, Meralco president Oscar Reyes said the company is in “very early discussions” with the San Miguel Group for a possible deal for the Ilijan power plant. “It’s in very early stage (of discussion). We’re just taking a look at what it is,” he said. However, SMC said the possible deal with Meralco is still subject to the resolution of the pending case lodged by SPPC against the PSALM. “An appropriate disclosure shall be made in the event a definitive agreement is concluded between the parties,” it said. SMC, through its power subsidiary SMC Global Power Inc., filed a legal case against PSALM for the “intentional breach of contract” by terminating the IPPA agreement for the Ilijan plant with SPPC. PSALM said it terminated the IPPA agreement after SPPC failed to pay the outstanding generation

MINING lobby Chamber of Mines of the Philippines refuted the statement of Environment Secretary Regina Paz Lopez that “the poorest areas in the Philippines are mining areas.” “We do not cause suffering in areas where we operate, contrary to Lopez’s belief. In fact, we ease these sufferings by complementing the government’s delivery of social services and by implementing our environmental protection and enhancement programs,” COMP executive vice president Nelia Halcon stressed. Citing data from the Philippine Statistics Authority 2015 First Semester Poverty Statistics, Halcon said the 10 poorest provinces in the country are Lanao del Sur with 74.3 percent poverty rate; Sulu, 65.7 percent; Sarangani, 61.7 percent; Northern Samar, 61.6 percent; Maguindanao, 59.4 percent; Bukidnon, 58.7 percent; Sultan Kudarat, 56.2 percent; Zamboanga del Norte, 56.1 percent; Siquijor, 55.2 percent; and Agusan del Sur, 54.8 percent. “None of these provinces play host to mining firms,” Halcon said. On the other hand, the mining towns of Benguet in the Cordillera Administrative Region (CAR) posted a low poverty incidence rate according to the PSA report in 2012. Itogon, which hosts Benguet Corporation and Philex Mining Corporation, posted a poverty
incidence rate of 4.8 percent; Mankayan, which hosts Lepanto Consolidated Mining Co., 6.2 percent; and Tuba, which hosts Philex Mining Corporation, posted a 4.6 percent poverty rate. In CAR, the industry sector, including mining and quarrying, contributed most to the 2012 regional economy with P108.23 million compared to the agriculture sector’s contribution of P21.8 million. The services sector contributed P74 million. . Updated figures of PSA-CAR show that in 2014 the industry sector contributed P25.3 million to the regional economy while agriculture contributed P25.3 million and services contributed P89.6 million. Mining and quarrying is the second largest contributor to CAR’s industry sector, she added. Meanwhile, Caraga Region benefited the most from mining taxes according to the December 2015 report of the Philippine Extractive Industries Transparency Initiative Report. Caraga was able to collect P106.9 million from the different extractive companies operation in the region. The other top four regions that benefited from mining revenues are Regions VII, V, II and CAR. But it was the Province of Cebu that posted the highest in tax shares, collecting around P93 million. For the first half, the BSP said the net inflow of hot money slipped 9.1 percent to $580 million from $638.38 million in the same period last year. The BSP said the country still managed to book a net inflow of foreign portfolio investments despite profit taking by investors, concerns about the slowdown of the Chinese economy, and the continued softening of oil prices in the world market.
Inflows fell 29.8 percent to $8.45 billion from January to June versus the $12.04 billion in the same period last year that included large inflows for stock rights offering by two holding companies, two universal banks, and a property firm. The bulk or 83.8 percent of the investments registered in June were in companies listed at the Philippine Stock Exchange (PSE), while the remaining 15.7 percent went into peso-denominated government securities. The BSP reported that transactions in PSE-listed companies booked a net inflow of $260 million while peso-denominated debt papers yielded a net inflow of $80 million. Major sources of foreign portfolio investments are the United Kingdom, US, Singapore, Hong Kong, and Luxemburg.

The electric vehicle (eV) industry needs more battery producers in the absence of a major supplier to meet the growing demand. Rommel Juan, president of electric Vehicle Association of the Philippines (eVAP), said there is a growing demand for batteries in the country. “For deep cycle lead acid batteries, we already have our worldclass Motolite batteries which are proudly Philippine-made. Trojan batteries from the USA are also very much active in the Philippines already. “But for lithium ion batteries which are now increasingly gaining popularity among local electric vehicle players, there is still no major supplier, much more manufacturer, who has come in,” Juan said. “We badly need a major lithium ion battery provider to set up shop and even do local assembly in the Philippines,” he added. eVAP members are looking for partners that can further grow the industry and spread the use of electric vehicles. “We are actively pushing for the adoption of electric vehicles for public transport… such as eVs to replace the smoke-belching jeepneys and the tricycles. The eV industry may reach its full potential if there are more options for batteries in the country, particularly for the superior lithium ion batteries. “These batteries are the cornerstone of one of the most important eV infrastructure, the battery charging and swapping stations. We need these to make eV fleet operations more viable,” Juan said. This year, the association said seven foreign eV companies have set up shop in the Philippines to
take advantage of the eV market potential. MANILA—The Philippines posted the highest mark in overall business optimism across 36 Asia Pacific economies in the second quarter of the year, results of a quarterly global business survey showed. The Grant Thornton International Business Report (IBR) revealed overall business optimism in the country surged 38 points to 94 percent during the April to June 2016 period, way above Asia Pacific’s average business optimism of 28 percent. however, the report said such bullishness may contract in the coming months with UK’s decision to leave the european Union (eU) and possible implications of the country’s arbitration saga with China. Aside from overall business optimism, Philippine firms are also among those which expect exports to increase over the com-
ing year. The business outlook for exports in the Philippines rose to 20 percent from 18 percent the previous quarter. Other economies that registered increases were Thailand (from six percent to 16 percent) and Japan (from one percent to 12 percent). Business outlook for exports in countries such as Australia, Singapore, New Zealand and Malaysia, meanwhile, recorded declines during the quarter. “As the world becomes more interconnected, exports becomes an important source of growth for large parts of the Asia Pacific business community. This is why it is good to note that despite a global backdrop of economic, social and political uncertainty, for large parts of the community, plans to export more are increasing,” P&A Grant Thornton chairperson and CeO Marivic españo said.
