WHEN Alyssa Duarte was still in high school, she worked two jobs: waitress at Applebee’s and weekend dog-walker. Still managing to earn stellar grades, Duarte aimed to attend a prestigious university. MANILA, Philippines - The military yesterday ruled out any possible coup against President Duterte. Armed Forces of the Philippines (AFP) spokesman Brig. Gen. Restituto Padilla said the President’s showing of genuine concern for members of the uniformed services has earned him the full respect and admiration of all soldiers. “A coup against the President by the military is highly unlikely. It will not happen. No other commander-in-chief has shown his genuine concern for members of the uniformed service like he had,” Padilla said. Survey says Filipinos trust US, not China

IT appears the majority of Filipinos have opposite sentiments as President Rodrigo Duterte tilts away from the Philippines’ traditional ally the United States and leans toward China. The latest Pulse Asia poll found that 76 percent of 1,200 adult respondents had trust in the United States, while 23 percent expressed distrust and 1 percent were undecided. Sixty-one percent distrusted China, while 38 percent expressed trust and 1 percent undecided. Seventy percent trusted Japan while a majority distrusted Great Britain (55 percent) and Russia (58 percent). UN, EU also trusted

NEW YORK — Few Filipino Americans know the name George T. Conway III. The husband of Kellyanne Conway, senior adviser to President-elect Donald Trump, he has never been active in the Filipino American community and it was only recently that his Filipino heritage had even been made public. So when it was reported last week that Conway is on the shortlist of nominees for U.S. solicitor general, Filipino Americans greeted the news with a mix of surprise and skepticism. “I didn’t realize that he is Filipino American,” said Rudy Asercion, chairman of the National Organization of Filipino-American Republicans and an elected member of the San Francisco Republican Party Central Committee. “My wife says that his mother is Filipino, but we are still not sure about that.” Yet, as a devoted Republican, Asercion was brimming with pride at the news. “This is very telling that a Filipino should be raised up [under a Republican administration],” he said. Whenever the nation’s leader is a Democrat, he added, “it doesn’t do anything” for the community. Conway, if appointed and approved by the Senate, would achieve the highest public office that a Filipino American holds and would be the first AsianAmerican solicitor general. While a majority of Filipino Americans vote Democrat, a survey last October found that among registered Asian American vot-

ers, Filipino Americans showed the most support for Trump. Conway’s name was little mentioned during the presidential campaign, though it was reported that he did make donations to the Trump campaign, as well as to previous GOP presidential candidates. A long-time partner at the New York-based law firm Wachtell, Lipton, Rosen & Katz, according to his biography on the firm’s website, Conway graduated from Yale Law School in 1987, after attending Harvard College. Throughout his career, Conway has represented high-profile clients, including the National Football League and tobacco maker Philip Morris. He also played a minor role in the 1998 impeachment of President Bill Clinton. Health claims on the rise for kids with Type 2 diabetes, obesity-related conditions by Julie

IT’S no secret that American children have gotten fatter in recent decades. Now a new study joins earlier research showing the consequences: A sharp rise in insurance claims for youth with Type 2 diabetes, high blood pressure and other conditions more often associated with older adults. Claims for Type 2 diabetes — formerly known as “adult-onset” diabetes — among young people aged 0 to 22 years old more than doubled between 2011 and 2015, according to an analysis of a large national database of claims paid by about 60 insurers. At the same time, claims for prediabetes among children and youth rose 110 percent, while high blood pressure claims rose 67 percent. Sleep apnea, a condition where a patient temporarily stops breathing while sleeping, rose 161 percent. The findings “not only raise quality-of-life questions for children, but also the … kind of resources that will be necessary to address this emerging situation,” said Robin Gelburd, president of the nonprofit Fair Health, a national clearing house for claims data that offers free medical cost comparison tools to consumers and sells data to insurers and health systems. To be sure, the analysis is certainly not the first to note a rise in obesity or Type 2 diabetes in this age group; nor does it explore the possible reasons behind the apparent increase in claims. One factor in the rise could simply be increased awareness and testing for the problem, while variations between states could reflect differences in patient ethnicities, how doctors practice, insurance rules or all of those factors. “We try to give a big picture and welcome others to look under their hood for details,” acknowledged Gelburd. But the analysis is different than some earlier research because it uses a database of actual claims for about 150 million people, all of whom have private insurance. The study focused on a subset of youth: Those who had a diagnosis of obesity or Type 2 diabetes. Researchers analyzed claims data tied to those patients to determine what other conditions they experienced and the medical services provided to them. Claims data is considered a good research tool because it reflects services actually provided. But, conversely, the Fair Health analysis is also limited because it does not include claims submitted by Medicaid or other government programs, so it doesn’t represent a true cross-section of the population. Even with those limitations, the findings “are frightening,” said Stephen Pont, a pediatrician and medical director of the childhood obesity center at Dell Children’s Medical Center in Austin, Texas, who did

not work on the analysis. “The vast majority of kids should never have high blood pressure or diabetes or sleep apnea. Now we’re seeing those consequences in kids,” he said. “That will result in shorter lives and lower quality of life.” The solution, he added, cannot be found solely in the doctor’s office, but many insurers hamstring efforts to help children by limiting medical coverage of efforts to combat obesity. Most don’t cover related costs such as those for weight management programs until a complication such as high blood pressure is developed, he said. To keep the Fair Health statistics in perspective, it’s important to note that Type 2 diabetes only affects a small number of children. The Centers for Disease Control and Prevention estimates that only 0.25 percent of all children suffer from the condition. But when it does hit, patients must go on medication, often for life, and can suffer serious health problems, including blindness and kidney failure. The Fair Health analysis found that during the four years that were analyzed, the number of claims tied to an obesity diagnosis among youth aged 0 to 22 also rose, jumping 94 percent in infants and toddlers to as much as 154 percent among 19 to 22year-olds. That contrasts with CDC findings that the prevalence of obesity among children and youth aged 2 to 19 years old remained relatively stable from 2011 to 2014. Fair Health researchers suggested a possible reason for the difference is that its dataset does not include Medicaid, the state-federal health program for low-income residents. (Diabetes disproportionately affects lowincome populations.) Geographically, the study found a range of claims among the states, which also surprised some outside researchers. States with a high prevalence of claims for Type 2 diabetes included Ohio, Pennsylvania, North Dakota, Utah and South Dakota. Some states on the lower end of the scale didn’t seem to reflect their overall health statistics. Louisiana and Alabama, for example, appeared to have a lower number of claims for Type 2 than many other states, despite generally appearing at the bottom of state rankings across a variety of health measures. “How does one interpret the difference between a low claim state like Louisiana and a high claim state like Ohio? Something is happening here,” said Dennis Bier, professor of pediatrics in Houston at Baylor College of Medicine, who also did not work on the study. “Does that mean doctors in Louisiana are not making enough claims for diabetes?” Gelburd said the Fair Health data was adjusted for each state, but the analysis did not have access to ethnicity or socioeco-

nomic data, so those variables were not factored in. How demographic and other variables impact the findings is worth exploring, said Bier. Has there been a sudden change in the development of Type 2 diabetes? Or, conversely, does the uptick in the Fair Health data reflect a change in medical practice or awareness of the condition? Perhaps there are state insurance rules in one state that require more medical coverage for obesity than others, driving

the differences. But no matter the underlying causes of the increase noted in the analysis, Bier said it is well known that the longer children remain obese, the more likely they are to get diabetes. THE United Nations Population Fund (UNFPA) on Friday hailed President Rodrigo Duterte’s intervention to provide free contraceptives to poor women as a “new momentum” in the provision of family planning services in the Philippines. But Executive Order No. 12, signed by Mr. Duterte on Monday, faces hurdles, with conservatives and religious leaders preparing possible challenges. In a statement issued late on Thursday, the UNFPA said Mr. Duterte’s order was a “major push” for the government’s family planning program, which has been hindered by opposition from the Catholic Church and prolife organizations. Critically important “The full and immediate implementation of the Responsible Parenthood and Reproductive Health Law is critically important for the government to deliver on its family planning program,” said Klaus Beck, UNFPA country representative. Beck said Mr. Duterte’s order would “lend new momentum to the implementation of the law as it demonstrates the highest level of support to the measure.” Mr. Duterte issued the order on Monday, directing government agencies to ensure free access to contraceptives for 6 million women who could not obtain them because of poverty. Economic Planning Secretary Ernesto Pernia said on Wednesday that the intensified drive to make contraceptives available and ensure “zero unmet need for family planning” was important to reduce poverty. Pernia said the government’s target was to cut the poverty rate from 21.6 percent in 2015 to 14 percent or 13 percent by the end of Mr. Duterte’s term in

2022. According to EO 12, out of the 6 million women with unmet needs for modern family planning, 2 million have been identified as poor. The 2 million women should have access to contraceptives by 2018, and all the rest thereafter, the order said. EO 12 also directed government agencies to locate couples with unmet family planning needs, mobilize agencies up to the village level and partner with civil society in intensifying the drive. Mr. Duterte’s directive did not mention a Supreme Court order issued in June 2015 restraining the Department of Health (DOH) from distributing a contraceptive implant that opponents of the RH law considered abortifacient. The Supreme Court also directed the Food and Drug Administration (FDA) to put on hold the renewal of licenses for other contraceptives, directing the agency to call public hearings as part of the licensing process. The government has appealed the ruling. “The government cannot continue to tolerate this delay in judgment because time is of the essence as far as the implementation of the [RH] law is concerned,” Pernia said on Wednesday. He said 11 Filipino women die each day from complications of pregnancy and delivery and the law would reduce maternal deaths and teen pregnancies in addition to enabling families to have the number of children they want. Full support In its statement on Thursday, the UNFPA expressed concern that the Supreme Court order might hinder full implementation of the RH law, but said it would support the government and its civil soci-

ety partners in the provision of reproductive health services. “[The] UNFPA has been working with local governments in ensuring that access to quality reproductive health services, including family planning, will be available, especially for the poorest and disadvantaged communities who need these services most,” it said. Juan Antonio Perez, executive director of the DOH’s Commission on Population, on Wednesday said if the contraceptives were made available to the 6 million women with unmet family planning needs, contraceptive prevalence rate would increase to 65 percent, from the current 40 percent. Population growth The Philippines’ population, now at 104 million, is growing at a rate of around 1.7 percent yearly, but the growth may be lowered to 1.4 percent if the family planning campaign is fully implemented, Perez said. About 25 percent of the population live in poverty. Millions of poor women have no access to contraceptives partly because the government’s family planning program runs on a shoestring budget of P500 million. This could change, however, as EO 12 directs government agencies to put in funds for the family planning program in their 2018 and 2019 budgets, Perez said. That would enable the government’s family planning budget to increase four-fold to the ideal level of P2 billion, he said. Survey: Health a major concern of most Pinoys HEALTH was deemed the most urgent personal concern of majority of Filipinos at the end 2016 but concern about being a victim of crime rose despite the anti-crime stance of the Duterte administration, results of a Pulse Asia survey showed. Increasing wages topped the list when it comes to national concerns that should receive immediate attention from the government, the survey, conducted last Dec. 6- 11, found. The Pulse Asia report, released on Wednesday, Jan. 11, also said most Filipinos approved of the Duterte administration’s work in addressing all urgent national concerns included in the survey, except for one—controlling inflation, which was regarded a priority by a third of the respondents. For the personal and national concerns survey, Pulse Asia asked 1,200 respondents, who are voters aged 18 and above, to cite up to three urgent concerns from lists provided. They were also allowed to mention other concerns not included in the lists. The survey used a margin of error of plus-or-minus 3 percentage points. Staying healthy and avoiding illnesses was cited an urgent personal concern by 63 percent while 44 percent said having a secure and well-paying job or source of income, 41 percent said finishing school or providing schooling for children and another 41 percent said having enough to eat on a daily basis. Other urgent personal concerns included avoiding being a crime victim (38 percent), having some savings (38 percent) and having a house and lot (34

The levels of concern on these personal issues were mostly unchanged except for the concern about schooling, which declined seven points from 48 percent in 2015 to 41 percent in 2016 and the concern on being a victim of crime which increased eight points from 30 percent to 38 percent. Majorities across geographic areas (54 to 68 percent) and socioeconomic classes (58 to 67 percent) considered staying healthy an urgent personal concern. With regard to national issues, the most urgent concern was increasing workers’ pay (45 percent) while 31 to 34 percent cited controlling inflation, reducing poverty, criminality, creating more jobs and fighting corruption in government. Other urgent concerns, cited by 6 to 23 percent were

Freedom of informed choice PRESIDENT Duterte has made a laudable move in signing Executive Order No. 12, thereby reviving the moribund Reproductive Health Law. policy into the administration’s national poverty reduction and social protection programs. And PhilHealth will “implement benefit packages that ensure maximum benefits for family planning services.” In an ideal world, Mr. Duterte did not have to resort to this EO. The law he is trying to reinvigorate was passed by Congress and signed by then President Benigno Aquino III back in December 2012. The issue of an official reproductive health policy codified in law had been the subject of an intense, 14-year-long debate and struggle, with the Catholic Church and various so-called “prolife” groups mounting sustained and fierce opposition. This, despite survey after survey showing that the majority of Filipinos are in favor of legislation that would make it easier for them to access family planning services, including the use of artificial contraceptives—the main beef of the Church and its allies, which insist that a number of such contraceptives are abortifacients. Before the ink was dry on the newly signed law, its opponents took the issue to the Supreme Court. Certain provisions of the law were subsequently invalidated in 2014, and then the whole matter skidded to its current standstill condition when the high court issued a temporary restraining order specifically on the certification of contraceptive implants in July 2015. It’s been a year and a half since then, but the high court is seemingly in no hurry to resolve the case. Meanwhile, it has found the time to allow

This is not just because Mr. Duterte is fulfi lling a campaign promise. As presidential candidate, he said he would fully implement the RH Law, and in his fi rst State of the Nation Address, he reiterated his position, saying it “must be put into full force and effect so that couples, especially the poor, will have freedom of informed choice in the number and spacing of children they can adequately care and provide for, eventually making them more productive members of the labor force.” The EO he has signed makes it crystal-clear with a self-explanatory title: “Attaining and Sustaining Zero Unmet Need for Modern Family Planning Services through the Strict Implementation of the Responsible Parenthood and Reproductive Health Act, Providing Funds Therefore and for Other Purposes.” Aside from the directive to appropriate a budget for this policy push, the EO essentially refocuses a large section of the government machinery to fleshing out the mandate of the law. For starters, it orders the Departments of Health and of Interior and Local Government, along with the Commission on Population and other relevant government agencies, to work with local government units on RH programs and initiatives—and to monitor their compliance. The Department of Education is directed to craft “gender-sensitive and rights-based” sexuality education for inclusion in the school curriculum, while the Department of Social Welfare and Development is tasked to fi nd ways to integrate the

California previously had installed actor Ronald Reagan who became one of America’s presidents and was even bestowed the Presidential Medal of Freedom with distinction. What happened? Demand and Supply BOO CHANCO IT is tough trying to figure out what’s going on these days with all the fake news turning up on social and traditional media. I fi nd it disturbing that some otherwise responsible newspapers would report on obviously fake news in a handsoff manner as if to give it the benefit of the doubt. Elections happened eight months ago but for the die-hard followers of PDutz and Mar Roxas, it is as if the campaign season is still going on. I see no practical reason to keep the country divided through a battle of misinformation. Fake news poses a danger to

us all. The hysteria generated by fake news could project the image of an unstable country that’s too dangerous for investors, local or foreign. As it is, Bloomberg reports that the peso, “Southeast Asia’s worst-performing currency of 2016 is in for another tough year with President Duterte’s spending plans seen boosting imports just as rising US interest rates spur capital outflows.” Furthermore, Bloomberg points out that ING Groep NV predicts “this year will be the fi rst in about a decade when the amount of money Filipinos send home from overseas will be lower than the trade deficit.” The government, Bloomberg reports, is forecasting a 10 percent jump in imports in 2017, compared with a four percent rise in remittances.

A forecaster told Bloomberg he “is penciling in a rate of P51.50 to P52 per dollar by the end of 2017… But that’s barring any unforeseen events,” the analyst told Bloomberg. “What can affect the peso locally will be politics.” Indeed, even BSP Governor Amando ‘Say’ Tetangco admitted during his talk with members of the Tuesday Club that political noise is an economic risk factor for 2017. He said we ought to have more discernment on what constitutes political noise. A good example of political noise is the so called #LeniLeaks. I read through the e-mails constituting the so called #LeniLeaks that are supposed to be hard evidence there is a conspiracy to unseat PDutz. I see no such conspiracy, at

Out of an $800 million budget, Long Beach Unified has cut $170 million over the past four years and anticipates cutting another $80 million this year. Nevertheless, Steinhauser says Governor Schwarzenegger helped install flexibility in the funding process that forestalled layoffs, until this year. ‘I’ve always appreciated that his door and that of his staff was always open.’” So, while not much reform can be attributed to the governor, he exposed the need to change the impasse of the budget, requiring 2/3 votes, instead of just a majority. With the 2/3 supermajorities, the minority stalled the budget process, and these few Republican legislators managed to stop the functioning of the state government, solely on their capricious terms, hence the incentive for teamwork was missing resulting in an abusive power play. Recall Richard Riordan’s eight years as LA’s mayor? “The conventional view of many of his contemleast on the part of VP Leni. Indeed, VP Leni has said in no uncertain terms that unseating PDutz is bad for the country. I am glad Justice Secretary Aguirre agrees with my evaluation. He said he has not yet seen any law violated in the exchange of e-mails thus far made public. “As long as they do not violate the law, there is nothing wrong with it, nothing wrong to dream,” Aguirre said last Monday. The DOJ chief is not even sure the so-called #LeniLeaks can be characterized as a conspiracy. I personally see #LeniLeaks as a brazen attempt to demonize the VP enough to make her unworthy of her position. This is probably in reaction to the supposed threat to PDutz and/or to prepare the way for BB Marcos. The threat is to unseat VP Leni, not PDutz. The attacks on VP Leni have

Bill Boyarsky on April 16, 2015, wrote about their entangles, “When I criticized him in a column, he’d call my home early in the morning to complain and I would argue back. During a huge fire, I blasted him for praising Los Angeles firefighters and ignoring the many others who had come from all over the state to fight the flames. I said he was acting as if he were a provincial small town hack. The next morning, the phone rang. ‘I read your column this morning,’ Riordan said. ‘Oh,’ I said, preparing for a fight. ‘You were right,’ he said.” But, you know what else I attribute to Richard Riordan? He simplified garbage collection and actually promoted recycling and composting of green waste. Now, the system produces enough compost

Never mind the point of a La Salle professor about father and son being private citizens now because they are still combatants anyway and still fair targets. But I can’t believe

If this is the quality of thinking behind VP Leni, the social media warriors on the other side will have them for breakfast. VP Leni will be minced meat in a matter of weeks. As for US-based lawyers Ted Laguatan and Rodel Rodis and Loida Nicolas, I wouldn’t worry too much about them. They are probably just trying to make their lives exciting in their senior years to off set the onset of Alzheimer’s. They have no means of galvanizing support from the military, which is essential, or from the general population which still adores PDutz with 83 percent approval. On the other hand, they are dual citizens, also Filipinos who have the right to comment on issues of public interest. And it is

PNP nets P3.7-B worth of drugs in 6-month war MANILA, Philippines – The Philippine National Police has seized hundreds of thousands of sachets of marijuana and shabu since the Duterte administration began its war on drugs. In a span of six months, the authorities netted a total of over P3.7 billion worth of ille-

gal drugs in 18 regions of the country. Statistics from the PNP National Anti-Illegal Drug Monitoring Center (NAIDMC) showed that around 95,000 sachets of shabu and 113,000 sachets of marijuana were recovered from July 1, 2016 to Jan. 12, 2017.

Christian Bables of ‘Die Beautiful’ on his unexpected win and newfound fame by RICKY

ALL of a sudden, people are talking about newbie actor Christian Bables, thanks to his awardwinning performance in “Die Beautiful” for which he won the Best Supporting Actor award at the Metro Manila Film Festival 2016. In an interview after the awards night, the newly-minted awardee said his passion for acting was rejuvenated with his win and he is very thankful to director Jun Lana who gave him the break to play the role of Barbs, Paolo Ballesteros’ best friend in the film, which won the Most Favorite Movie and Best Float trophies in the festival. He also thanked those who believed in him as a performer—that he can be a credible actor given the right vehicle. Christian is a straight guy but was very good in his role as transgender in the film written and directed by Jun Lana. He made it

a point to clarify that the characters they played (he as Barbs and Paolo as Trisha) are not gay but transgender women. “I think emotionally I was already prepared for the role since I have been acting since 2011 so the pain that Barbs felt, I was able to parallel easily. Physicality-wise, I did immersions and interviews.

I talked to my friends from the LGBT community so I could study their common denominator and their liabilities,” he said. When asked why he was emotional in his acceptance speech, Christian said that not even in his wildest dreams did he imagine winning Best Supporting Actor. Neither did he imagine that he would ever set foot on the MMFF stage during the awards because he is a nameless newcomer. “It was like everything flashed back as I was delivering my speech. Finally, there was someone who believed in my talent. I thought my passion for acting had ended pero hindi pa pala.” Will this win open opportunities? “I really hope so. With God as my witness, what I feel in my heart right now is that hope to get a project that can quench my thirst for acting–that will fire my passion even more. The fame and all this is unexpected,” Christian expressed.

DO we seriously think writing is all joy? It is also half pain. Sometimes it is pain that makes us write. Think about the atrocious solitude of a room that gradually becomes a prison, like a torture chamber. The fear of the blank page that stares at you mockingly, the torment of the word you didn’t find and if you did, it rhymes with the adjacent word. It is the martyrdom of a sentence that limps — of the metrics that fall apart, the structure that struggles of the page that bores, paragraphs that you must dismantle and rewrite, rewrite, rewrite until the words seem like food that recedes from the famished mouth of Tantalus. Cooped inside and giving up the outside world, the blue, the green the pleasure watching the sky into an abyss of an invention expressed through words and committed to a papery essence; a creative work polluted by human inconsistencies and duplicities, whether written with a smile on the lips and a tear in the eyes. It is a monkish discipline, a hero’s sacrifice and Colette was right when she said it is also a form of masochism — a crime against ourselves, a felony, that should be punished by law like the other

Today, I wish to transfer my thoughts on paper: I navigate through the treacherous water of the longed: for novel and only the good Lord knows what port it will lead me. I’m aware that a novel doesn’t yield its many secrets immediately — it locks within itself a mine of hypothesis; a myriad of good and bad surprises, so everything is possible, including the worsts. The characters are imaginary. They are so even when they are inspired by some model or alleged models. I listen, I spy, I steal from reality, then I correct it to such a

degree that often. I no longer remember who the original was. However, they represent only a part of the human samples the novel will offer. It will be full of life — not a silent or black and white show — but an inexhaustible rainbow of colors; an unending concerto of noises, a phantasmagorical chaos of voices and faces and creatures whose actions intertwine to weave the charms of events that determine the individual’s destinies. Do I exaggerate? Or am I just succumbing to the rhetoric of enthusiasm, to the utopias of the neophyte? The novel has always attracted me because it is a vessel in which one can simultaneously pour reality and fantasy, dialectics and poetry, ideas and feelings that provide a truth more true than real truth. Call it a reinvented, universalized truth in which everybody can identify and recognize himself because, whatever story it recounts and what times or space a story unfolds, it’s about men, human beings. And no matter how a story (lived or invented) concludes, whether or not we’ve divined how it will conclude, there’s something disquieting in the curtain that recalls the precariousness of life, its unrepeatability and its inevitable and ineluctable goal. And let’s not forget, the writer is always entitled to a certain amount of wrong.

Do you have a stomach ulcer? Health@Heart PhiliP S. Chua, MD, FaCS, FPCS WHAT is a stomach ulcer? A stomach ulcer, also known as a gastric ulcer or peptic ulcer, as the second part of the name suggests, is a “wound, an open sore,” in the mucosa (inner wall) that penetrates the muscle layer of the stomach or of the duodenum (the first part of the small intestine attached to the stomach). The main symptom is typically burning, gnawing or hunger pains in the epigastric (stomach pit) area, often relieved by food or antacids. What causes a stomach ulcer? There was a time when stomach acid hypersecretion (due to stress, spicy food, alcohol, tobacco, etc.) was universally accepted in the medical community as the cause of gastric ulcer disease. A brilliant Australian physician, Dr. Barry James marshall, who was ridiculed by his colleagues in the scientific world for postulating that peptic ulcer disease was caused by a bacterial infection (Helicobacter pylori organism), ingested the organism himself and developed acute peptic ulcer disease, proving to the medical community in 1984-85 that his postulate was correct. multicenter studies following his treatise proved that he was right. marshall has radically revolutionized the understanding of the disease, its diagnosis, and most importantly, its treatment. How did this change the treatment? Before marshall’s discovery, gastrectomy (cutting part or whole of the stomach out) was very common as a treatment for peptic ulcer disease. Today, with appropriate triple antibiotic therapy, peptic ulcer disease is effectively managed, transforming a former surgical disease to a medical disease. occasionally, however, surgery may still be needed for severe bleeding peptic ulcer disease but this is not as common today, with proper antibiotic treatment. How does the H. pylori bacteria cause ulcers?

There are theories as to how this organism causes peptic ulcers. H. pylori produces urease, an enzyme that catalyzes urea to ammonia. The ammonia, which enables the bacteria to survive the acidic environment in the stomach or duodenum, also causes erosions into the mucosal lining and causes epithelial damage. Cytotoxins from the bacteria also damage the epithelium. The organism also produces mucolytic enzymes (protease and lipase) that lead to the degradation of the mucosa, making the epithelium more vulnerable to acid damages. Also, cytokines produced in response to the inflammation may damage the mucosa and lead to ulcer formation. Do aspirin and arthritis medications cause peptic ulcers? Yes, aspirin and nsAiDs (non-steroidal arthritis medications) are known to cause peptic ulcers and severe bleeding. The irritation is both local (on the mucosa of the stomach) and systemic (inhibiting prostaglandin production adversely affecting mucosal defenses, and thinning the blood), leading to ulcerations and hemorrhage. Is alcohol bad for those with peptic ulcers? Yes, most definitely. The same thing is true with cigarette smoking, chocolate, tea, coffee, spicy foods, which are also irritants for the stomach. They increase hydrochloric acid production in the stomach, which bathes and damages the stomach mucosal lining, making it more susceptible to the H. pylori bacteria. milk, which used to be prescribed decades ago as a part of peptic ulcer therapy, is now avoided since it also causes “rebound” acid production and slows ulcer healing. Do children develop peptic ulcers? Yes, but it is relatively uncommon among children compared to among adults. About 15 percent to 20 percent of abdominal pains in children is due to peptic ulcer. most primary peptic ulcer disease in children are seen in the ages between 8 and 17. The pains usually wake the child from sleep, and are sometimes aggravated by eating. About 25 percent of these pediatric patients have bleeding ulcers. Peptic Ulcer due to H. pylori infection is not very common in children. Any persistent

abdominal pains in children warrants prompt medical consultation. How is the diagnosis made? After a good history-taking and physical examination, the physician can already make a strong presumptive diagnosis of peptic ulcer disease. Fiberoptic gastroscopy (a lighted magnifying flexible scope passed through the mouth down to the stomach used to view its inside) is today a part of the state-ofthe-art investigative tool in the diagnosis of peptic ulcer disease or malignant tumor (cancer) of the stomach. Bacterial cultures may likewise be taken to check the presence of Helicobacter pylori organism. Through the scope, cytology (microscopic examination of cancer cells), cultures for bacteria and tiny biopsies may be done to make a diagnosis. What are the possible complications of peptic ulcer disease? Hemorrhage is the most common complication, leading to vomiting of blood or blood in the stools, coloring them black, anemia, weakness or even dizziness and syncope (passing out spells). Perforation of the wall when the ulcer “eats” the entire thickness of the stomach wall, creating a hole, allowing stomach contents to spill into the abdominal cavity causing peritonitis (severe inflammation and infection). inflammation from peptic ulcer involving the stomach outlet into the duodenum can cause spasm and scar that blocks this outlet, causing vomiting. stomach cancer has been reported 3 to 6 times more common in peptic ulcer due to H. pylori infection. Gastric lymphomas have also been linked to this bacteria. Are TUMS and ROLAIDS safe for ulcer pains? Tums, Rolaids and other overthe-counter self-proclaimed “treatment” for peptic ulcers or hyperacidity are quite popular among lay people. These will not cure hyperacidity or peptic ulcers. if the symptoms persist, it is most prudent to seek medical consultation. Remember, peptic ulcers can have lifethreatening complications if not properly treated, and cancer of the stomach must be ruled out as the cause of the symptoms. What is the treatment? PAGE B5

NANcy Miller As we said when we realized that Donald Trump had been elected president, we know what he said his intentions were during the campaign but what he actually plans to do remains to be seen. so, what has happened since then? And what indications do we have about his plans for the immigrant community? Let’s begin by focusing on the president-elect’s prospective appointments (nominations) to cabinet positions that directly affect immigrants. These nominations must, of course, be confirmed by Congress but with both houses of Congress in the hands of the Republicans, the appointees may not be in for a hard fight. President-elect Trump has nominated John F. Kelly to be secretary of the Department of Homeland security (DHs). General Kelly is a retired United states Marine Corps General and the former commander of the United states southern Command (UssOUTHCOM), the United Combatant Command responsible for American military operations in Central America, south America and the Caribbean. He previously served as the commanding general of the Multi-National Force – West in Iraq and the commander of Marine Forces Reserve and Marine forces North. It has been said that the Trump transition team was drawn to Kelly because of his southwest border experience. He lists his political party affiliation as Independent. so, what does that tell us about how Kelly would run DHs and what his policies and primary concerns would be? Essentially nothing. Assuming his nomination is approved, we will have to wait and see what his priorities are. President-elect Trump’s other

Of course, the Attorney General deals with many issues besides immigration. How he will balance those issues (assuming he is confirmed) remains to be seen. After all, bankruptcy is often the last resort for most people when no other options exist. But how

FACT: Debt settlement companies are everywhere, often telling you things that are not true. You see them advertising in newspapers, on Tv and on the internet. I am sorry to say but a lot of these companies are “scams,” for lack of a better term. On Sunday, January 15, 2017, at 3:30 pm, a mass sponsored by Santo Niño Cruzada USA, will be held at the Cathedral of Our Lady of the Angels to celebrate its 30th year anniversary of the solemn Feast of Santo Niño, the Divine Infant Jesus. The Southern California Sinulog Dance Co. will perform traditional Sinulog dances after the mass. Although the devotion to the Divine Infant has roots in Europe, Filipinos are known for their fervent devotion to the Infant Jesus, celebrating with religious and civic activities. As a result, Filipino immigrants brought their Santo Niño to the United States to be their spiritual recourse, assistance, and protector. Kenneth UrsUA reyes Domestic violence is abuse perpetrated against a spouse, former spouse, cohabitant, former cohabitant, a girlfriend, a boyfriend, the mother or father of your child, your child. Family code section 6211. Abuse is not limited to the actual infliction of physical injury or assault. Family code, § 6203(b). A court may issue an order enjoining specific acts of “abuse” (§ 6218, subd. (a)), which are defined as, among other things, behavior that could be enjoined under section 6320. (§ 6203, subd. (d).) section 6320, in turn, permits a court to enjoin a party from engaging in various types of behavior, including “disturbing the peace of the other party.” (§ 6320, subd. (a).) “[t]he plain meaning of the phrase ‘disturbing the peace of the other party’ in section 6320 may be properly understood as conduct that destroys the mental or emotional calm of the other party.” (in re marriage of Nadkarni (2009) 173 cal. App.4th 1483, 1497, 93 cal. Rptr.3d 723 (Nadkarni ).) the phrase includes “destroying the mental or emotional calm of [a former spouse] by accessing, reading and publicly disclosing her confidential e-mails.” (id. at p. 1498, 93 cal.Rptr.3d 723.) the expansion of the term “disturbing the peace” to cover accessing, reading, and publicly disclosing electronic communication has profound effect in every divorce and family law case. in Nadkarni, a former wife alleged that her ex-husband had accessed her private email account while she was away on a business trip, then attached copies of the emails to documents filed in proceedings regarding custody of their teenaged children. in re marriage of Nadkarni (2009) 173 cal.App.4th 1483, 1497, 93 cal.Rptr.3d 723. she sought a permanent restraining order, but the trial court denied it without a hearing after finding that the DVPA did not cover situations in which there was no physical harm alleged. the appellate court reversed and remanded the matter to the trial

court for a hearing. it held that the definition of abuse under the DVPA is not limited to the infliction of physical injury or assault. id. at pp. 1498, 1501, 93 cal.Rptr.3d 723. in marriage of evilsizor and sweeney, husband’s actions in releasing and threatening to release personal data downloaded from wife’s cell phone constituted “disturbing the peace of the other party” and thus “abuse” which warranted restraining order. in re marriage of evilsizor and sweeney (2015) 237 cal. Why did i marry him? i didn’t know that things were going—i didn’t know. Yeah. it’s been incredibly challenging to live with.” she further testified that she had suffered shock and embarrassment and feared for her safety because of the disclosure. evilsizor also was concerned about sweeney’s threats to reveal information to the internal Revenue service about “things [she] didn’t

do.” the court concluded in the evilsizor case that even if sweeney legally obtained evilsizor’s information, an issue left unresolved, it was authorized under the DVPA to enjoin the disclosure or threats of disclosure of the information to protect evilsizor’s peace of mind. the court ordered sweeney be “prohibited from using, delivering, copying, printing or disclosing the messages or content of [evilsizor’s] text messages or e-mail messages or notes, or anything else downloaded from her phone or from what has been called the family computer except as otherwise authorized by the court.” sweeney also was prohibited from trying to access or otherwise interfere with evilsizor’s internet-service provider accounts or socialmedia accounts. text messages, e-mails, social media, and other electronic communication has become a common and inseparable part of today’s lifestyle. Accessing, reading, and publicly disclosing electronic communication of an ex, spouse, or sgnificant other has profound effect in every divorce and family law case. Writ of mandamus relief for unreasonable delay in pending immigration filings A commoN question that is asked by a person who has a pending immigration petition or application is “how much longer until Uscis makes a decision?” the question is understandable, in that an unreasonable delay in the Uscis’ adjudication of a petition or application can have adverse effects, including loss of employment and employment opportunities, possible termination of employment, and difficulties in obtaining student and credit loans. While an immigration filing is pending, the typical response by Uscis upon inquiry is that further time (usually 90 or 180 days) is needed to make a decision. However, often that 90 or 180 days that Uscis needs to make a decision turns into months and sometimes years. What option does a petitioner or applicant have to compel the Uscis to act on his or her case? Pursuant to the mandamus and Venue Act of 1962, a Writ of mandamus action can be filed in the Us District courts to compel the Department of Homeland security (DHs) and the Uscis, DHs’s bureau, to act on a petition or application for which adjudication has been unreasonably delayed. the statute allows for an “action to compel an officer of the United Darrick V. Tan, Esq. states to perform his duty.” the legal duty for Uscis to promptly act on a pending petition or application can be found in the Administrative Procedures Act (“APA”), 8 Usc sec. 1571, and 5 Usc sec. 555(b). these statutes form the basis of Writ of mandamus relief. the APA gives the court authority to “compel agency action unlawfully held and unreasonably delayed.” the policy for processing immigration applications is set forth under 8 Usc sec. 1571, which states that “the processing of an immigration benefit application should be completed no later than 180 days after the initial filing of the application.” Further, 5 Usc sec. 555(b) states that “within a reasonable time, each agency shall proceed to conclude a matter presented to it.” A typical case in which Writ of mandamus relief is a viable option is in a green card application based on marriage. i have had several inquiries in recent months concerning delays in processing of these cases. typically, the green card applicant along with his or her Us citizen spouse is interviewed by a Uscis officer and at the end of the interview, the green card applicant is advised that additional time is needed by Uscis to make a decision. the timeframe given to make a decision is 180 days; however, more than 180 days pass and no decision is made. the applicant then seeks to get updated status of the application via an infopass appointment, and is advised that the case is still under consideration and more time is needed. in such a case, a writ of mandamus can be filed in Federal court to compel the Uscis to act on the application. often, a decision is made on the case after the Writ of mandamus is filed in that the unreasonable delay is brought to the attention of the Uscis. A prompt decision is often made by Uscis after filing to avoid the use of government resources in having to defend the meritorious action. it is important to keep in mind that Writ of mandamus relief is available to a variety of pending petitions and applications, not just green card applications based on marriage. to determine whether Writ of mandamus relief is a good option in your pending immigration case, it is recommended that you seek the advice of an experienced attorney. *** Darrick V. mARY Burns worked as the women’s basketball coach at san Diego state University (sDsU) for 16 years, and was considered the “winningest coach in sDsU women’s basketball history.” However, during her tenure, Burns lodged several complaints to the school regarding unfair treatment of the women’s basketball program, because the school “prioritized men’s sports over women’s basketball.” on April 16, 2013, Burns was told: “to resign, retire, or be fired.” she was told that she was being fired because she “allegedly struck a subordinate” during a game. When she denied intentionally striking anyone, Burns was told that if she was fired, she could lose her retirement benefits. Faced with this “choice,” Burns retired. she tried to find work as a women’s basketball coach, but prospective employers chose not to hire her after talking to sDsU. Burns later filed a lawsuit against the university for wrongful termination and retaliation. Burns argued that she was a whistleblower who reported on the school’s violations of anti-sex discrimination laws. At trial, the university claimed that it fired Burns for elbowing an

assistant coach during a game, and due to an internal investigation by the university that uncovered an alleged “history” of Burns mistreating subordinates. Burns argued that elbowing the assistant coach was an accidental contact on a crowded bench, and that the investigation was “a sham” so that the university can have a reason to fire her. employees have the right to report violations of the law. california’s anti-retaliation law protects whistleblowing employees who complain within a company about unlawful practices. if an employee is fired because of whistleblowing activities, he or she may have a claim for retaliation. in order to succeed in such a claim, the employee must prove all of the following: 1) the employee engaged in a protected activity, such as claiming wages due, reporting discrimination, or standing up against violations of the law 2) the employer knew or believed that the employee engaged in such protected activity. 3) the employee was fired, demoted, or denied benefits as a result of the protected activity 4) the employee’s protected activity caused the employer to fire, demote or deny benefits to the employee. the jury had to decide whether Burns engaged in a “protected activity” by complaining about sex discrimination, and that this was a substantial factor in her firing. if the jury found in favor of Burns, the jury then had to

decide whether she would have been fired anyway for a business reason. the jury found that Burns engaged in several protected activities. in one instance, she complained about how the men’s basketball team was on its fifth set of game uniforms halfway through the season while the women’s team still had not received travel sweat suits ordered months earlier. the jury further found that her complaints were a substantial factor in her dismissal. As to whether Burns would have been fired anyway (for allegedly mistreating subordinates), the jury voted 9-3 that she would not have been fired for this reason. employees who prove they were wrongfully terminated may recover loss of earnings, emotional distress, and in certain cases, attorneys’ fees and punitive damages. the jury awarded Burns $3,356,250.00 in damages. *** The Law Offices of C. Chapter 7 to discharge Alexander Pantig, Esq.: Competent, reliable legal representation credit card debt, loans

Debt Relief Atty. LAwrence yAng The client is 64, a young senior. I say young because I consider seniors in their 60s as still active and robust. except for more white hair, they still feel like they are 30. The problem with being in the 60s is that 70 is just around the corner. Now when one becomes 70, after ten years you become 80. In your 80s, your hoping that Putin’s anti-aging pill is already in commercial production. Putin is 64 right now, just like this client. he has a pharmaceutical company in Russia that is doing in-depth research on mitochondria cells that focus on delaying aging and extending human life to 130. So, maybe this is why PeOTUS Trump wants to be his best friend. I wouldn’t mind being his best friend either if the Russian company actually makes this pill available for humans in the next 10 or even 20 years, I might still be around to benefit from it. The client says that his net income is $3,500 and that he is separated from his wife. his rent is $600 for a room. he sends money to his brothers and sisters in his country of origin. The problem is that he owes $30K in credit card debt. he pays a minimum of $1K a month for the credit cards. he also has a car payment of $350. We don’t have to do more calculations here. The minimum payment of $1K for credit cards is almost a third of his next income. That is just way too much. he wants to get rid of his credit cards now that he is 64 so he can start saving some money. Well, it’s a little late to start saying money now but at least with the discharge of all of his credit cards, he can save $12K in the next 12 months, and $24K next year, then $36K, and then $48K. So when he turns 69, just before he becomes 70, he can have $50K saved up which he can use any way he wants. This is a lot better than keeping these cards, paying them $50K for the next four years, then still owe them the same principal of $30K when he turns 70. So, this is really a no-brainer, isn’t it? Would he rather have $50K in cash and not owe anything

at the age of 69, or throw away $50K in minimum payments and still owe $30K credit cards at age 69? he asks if his brother, whom he used as a reference for a personal loan and did not sign a personal guaranty, is legally liable for his debt if it is discharged in bankruptcy; of course not. The brother can only be made liable for his debt if the brother signed a written personal guaranty. Without a signed personal guaranty, the brother used as a reference cannot be sued because he has no legal liability to the creditor of the client. Next, the clients are husband and wife who are 72 and 71, respectively. The wife made sure that I understood that she was only 71 and is one year younger than her husband who is 72. Yes, I got that. One year makes all the difference. I told her that I stopped counting 20 years ago and advised her to do the same. It’s useless to keep counting, what’s the big deal anyway? Who wants to know that you are now one year closer to leaving this earth; certainly not yourself. Look at the picture of the Indonesian guy who is the oldest man alive at 145. I mean what can you do at 145? You’re practically a cadaver and blind. Can’t hear anything. The quality of life is just zilch. Clients owe $46K in credit card debt. Their social security is $3K a month. Rent is at $1,200. They have $1,800 left but their credit cards need a minimum of $1,500. how are they going to eat and pay for other necessities if they continue to pay $1,500 for credit cards? They can grow their own vegetables in their backyard -- if they had one. They rent an apartment with no backyard. husband says that he has all kinds of muscle pain and has a pacemaker, so that kills his plan to drive for Uber so he can raise another $,1500 to pay for their credit cards. he says they have already lived a full life, having traveled all over the world, using the cards. But they have paid the cards for the last 20 years a total of $360K, yet they still owe the very same $46K of credit cards today. I told them that they should

have done their Chapter 7 20 years ago, so today they would have $360K in their portfolio earning them at least 5 percent or $1,500 a month, or $18K a year. That certainly helps now, instead of paying them a small fortune and still owing them the same amount of $46K. Should have gotten rid of these cards a long time ago. They decide immediately to file for Chapter 7 to discharge the $46K of credit cards. Peace of mind without credit card payments is what they need now at 72 and 71. The last clients were business owners. They are also seniors at 60 and 61. The owned a business that closed down in 2007. When the business closed, the company, which is an S corporation, owed an SBA loan of $49K, which is now $89K because of the accrued interest. SBA started to garnish the wife’s wages last week. She didn’t like the garnishment. I can’t blame her -- who wants to get your hard earned wages taken at the rate of 25 percent of gross? As PeOTUS says, that is a “bigly” deduction, NOT FAIR! And NOT NICe! In addition, they owe $90K of credit card debt plus another $30K of unsecured business debt. They ask if it makes sense to settle the accounts owed. I say what for? With a Chapter 7, you can wipe out all of the $210K debt, start fresh again with zero debt, all it costs is the attorney & filing fees, which are very reasonable. The settlement at half, for instance, would still cost $120K, which they don’t have. I mean, the settlement is very expensive compared to Chapter 7 legal fees. You wipe out $240K for almost not cost except legal fees. That’s the American way. Look at PeOTUS, his companies filed bankruptcy four times and he still the president-elect. That is one smart dude. VeRY SMART!

THE World Bank expects the Philippine economy to grow by an average 6.8 percent in the next three years amid heavy infrastructure and consumer spending, and strong remittances and services exports. “In the Philippines, growth is projected to accelerate to 6.8 percent on average in 2017-19, supported by ongoing infrastructure projects, strong consumption, buoyant inflows of remittances, and strong revenue from services exports,” the Washington-based lender said in its Global Economic Prospects report released Wednesday, Jan. 11. It forecasted Philippine gross domestic product (GDP) to grow by 6.9 percent this year from an estimated 6.8 percent last year. For 2018, the World Bank said the economy could expand by 7 percent before moderating to 6.7 percent in 2019. The government’s GDP target growth range this year is 6.5 percent to 7.5 percent. For 2018 and 2019, it targets GDP growth to be within 7 percent to 8 percent.

The government plans to hike the country’s infrastructure budget – combining national and local projects – to increase to P1.898 trillion by 2022 from P861 billion in 2017, or to about 7 percent of GDP from 5.4 percent. Asia to ease Growth in the East Asia and Pacific region was projected to ease to 6.2 percent in 2017 from an estimated 6.3 percent in 2016 as China slows and the rest of the region picks up. Output in China is anticipated to slow to 6.5 percent in the year from 6.7 percent in 2016. SIx banks from Asia are interested in setting up operations in the Philippines, Bangko Sentral ng Pilipinas (BSP) Governor Amando Tetangco Jr. said at the annual reception for the banking community held Tuesday night. “We thank Congress for its full support of initiatives liberalizing foreign entry into the banking system. This eventually became law, specifically RA [Republic Act] 10574 and RA 10641. On the latter, we are happy to report that nine banks have entered the Philippine banking industry thus far, with six more banks expressing interest,” he said. On the sidelines of the reception, BSP Deputy Governor Nestor Espenilla Jr. said the details and the requirements are still being worked out. He did not identify the banks. The banking sector began attracting foreign players after the RA 10641, or the Act Allowing the Full Entry of Foreign Banks in the Philippines, was passed in July 2014. The law lifted the prevailing equity limit of 60 percent for foreign partners and allowed 100 percent ownership of the voting shares in an existing domestic bank. Foreign banks may operate in the Philippines as a branch or a wholly owned subsidiary, with the BSP taking into consideration strategic relationships and reciprocity rights in accepting applications. A separate assessment by regulators in the banks’ respective countries of origin is also a requirement. In his speech during the event, Tetangco said the Philippine bank-

Total assets of the banking industry reached P13.2 trillion, up over 12 percent from November 2015, while deposits increased by more than 13 percent to P10.1 trillion, an all-time high. “In other words, ladies and gentlemen, the Philippine banking sector not only survived 2016, it continued to thrive,” the central bank chief noted. Stress tests indicated that banks can withstand extreme shocks in both credit and market risks, while third party analysts also have positive reviews concerning the banking industry, he said. “For instance, the Philippines is the only banking industry within Asia Pacific that was given positive outlook by Fitch Ratings in 2016. Meanwhile, Moody’s recognized our banking industry as the only one within Asean [Association of Southeast Asian Nations] that has a stable outlook on all rating factors – operating environment, asset quality and capital, profitability, funding and liquidity,” he said. “Indeed, our banking sector is sound, stable, and continues to be a source of strength for our economy. The Philippine economy has recorded 71 quarters of uninterrupted growth. Our banks helped nurture this virtuous cycle for our economy,” he added.

Car industry grows 24.6% in 2016, exceeds target by Raadee

THE Philippine automo tive industry ended 2016 on a high note, with a 24.6 percent increase in the number of vehicles sold compared to the previous year, as sustained economic growth and various events and promotions continued to drive consumer demand. In a joint report released on Tuesday, the Chamber of Automotive Manufacturers of the Philippines Inc. (Campi) and the Truck Manufacturers Association (TMA) said their members sold a total of 359,572 units in 2016, up from the 288,609 units registered

in 2015. “We are very glad that we were able to surpass the target this year. Successful introductions of new models complemented by various events and promotions enabled us to meet the increasing customers’ demands in an expanding Philippine market,” Campi President Rommel Gutierrez said. The figure exceeds the group’s target for the year of 329,300 units and is certain to meet the 2016 combined target with other industry players of 370,000 units, the report said. For the Passenger Car (PC) segment, the report said 133,188 units were sold during

the year, an increase of 14.4 percent from the 2015 total sales of 116,381 units, while the Commercial Vehicles (CV) segment posted total sales of 226,384 units, representing a 31.4-percent increase from the 172,228 units sold in 2015. The report said Toyota Motor Philippines Corp. retained its lead with a 44.14-percent share of the market. Mitsubishi Motor Philippines Corp. captured 17.08 percent market share while Ford Motor Co. registered 9.37 percent, Isuzu Philippines Corp. had a 7.61-percent market share, and Honda Cars Philippines Inc. had 6.45 percent market share.

MANILA — The country’s coconut farmers are set to withdraw their petition filed before the Supreme Court (SC) which resulted in a temporary restraining order (TRO) on the utilization of the P75-billion coconut levy fund. The Confederation of Coconut Farmer’s Organizations of the Philippines (CONFED) has announced that they are willing to take the necessary steps to withdraw their petition, which was said to be directed against the previous administration. “We believe that we have at last a government that means business for the benefit of coconut farmers and the development of the industry. We are willing to withdraw our petition before the court to give PCA (Philippine Coconut Authority) a freer hand in governance,” CONFED executive director and spokesperson Charlie Avila said. The coco levy fund amounting to P75 billion were taxes imposed on coconut farmers mandated by Presidential Decree 755 in 1975. The taxes were supposed to be used for the construction of projects designed for the benefit of coconut farmers but were instead used to buy a large percentage of the bank now known as the United Coconut Planters Bank under Danding Cojuangco.

Avila noted that the CONFED has full support and trust to the current administration as to the disposition and PCA’s legal mandate to manage the fund for the development of the local industry. “Our government then may not now just do with the funds as it pleases because the funds do not belong to the general funds. They are special funds. Nor even can the farmers claim the funds in an absolute sense of ownership to do with as they please because these funds that came from them are still theirs only for a given purpose. The precise nature of these funds is therefore one of dual ownership,” Avila explained. In 2015, the SC has stopped the implementation of Executive Orders (EO) 179 and 180 of former President Benigno Aquino III aimed at managing the coco levy fund. EO 179 provides for the inventory, privatization and transfer coco levy assets in favor of the government. EO 180, meanwhile, mandates the transfer of the fund to the government for an “Integrated Coconut Industry Roadmap Program.” “The coconut industry is one of the major industries that support the national economy. It is the state’s concern to make it strong and secure source not only of the livelihood of a significant segment of the population, but also export earnings the sustained growth

of which is one of the imperatives of economic stability,” CONFED Chairman Efren Villasenor said. Meanwhile, PCA Administrator Avelino Andal welcomed the decision of the coconut farmers to withdraw their petition. “I am extremely happy for the coco farmers and the industry that it serves with the development that one of the seemingly major stumbling block to the early disposition of coco levy fund is hopefully and finally resolved with the CONFED declaration of withdrawal of the TRO,” Andal said. “With this development, President Duterte can now dispose without much legal impediment considering that he promised the electorate, the farmers in particular, that he will release the coco levy fund,” he added. Furthermore, Avila emphasized that the fund must be regarded as public trust funds because they were the result of taxation. The CONFED is the unified group of coconut farmers’ organizations nationwide which is composed of the Philippine Association of Small Coconut Farmer’s Organizations, the Pa m b a n s a n g Ko a l i s y o n n g mga Samahang Magsasaka at Manggagawa sa Niyugan and the Coconut Producer’s Federation. It represents more than 95 percent of the organized coconut farmers sector in the country.
