"Beginning April 1, 2022, foreign nationals may enter the Philippines without need for an entry exemption document; provided that they comply with the applicable visa requirements and immigration entry and departure formalities," Ablan said during a Palace press briefing. Ablan said they must be fully vaccinated against COVID-19, and possess acceptable proof of vaccination, except only for minor

children below 12 years old traveling with their fully vaccinated foreign parents. These foreigners, Ablan said, must also present a negative reverse transcription-polymerase chain reaction test taken within 48 hours or a negative laboratory-based antigen test taken within 24 hours, prior to the date and time of departure from the country of origin/first port of embarkation in a continuous travel to the Philippines. THE United States continues its alliance with the Philippines in protecting its territory and is helping to increase its capability to man the West Philippine Sea against foreign intrusions, a U.S. official said Friday, March 25. According to Heather Variava, Chargé d’Affaires ad interim of the U.S. Embassy in the Philippines, the Balikatan Exercise between Filipino and American soldiers would help boost the country’s defense team. Variava made the remark during a turn-over ceremony of outboard engines to the Philippine National Police (PNP) 2nd Special Operations Unit-Maritime Group (SOU-MG) at Honda Bay here on Friday afternoon. “We continue to support the Philippines in expressing and establishing its rights. LOS ANGELES County is opening a new front in the war on poverty, offering $1,000 a month for the next three years to 1,000 people in its poorest neighborhoods, housed or unhoused, citizens or not, to spend however they see fit. In the country’s most populous county, where 25% of the children live in poverty, the guaranteed income program, named “Breathe,” is the largest, longest-lasting one yet in the United States. It’s funded by 2021’s federal

American Rescue Plan Act. Attached to it is a confidential research component, funded by The California Endowment, seeking a “sweet spot” of maximum effectiveness for future programs. Like any government assistance program, there are eligibility requirements, but speakers at the briefing emphasized their hope to “flip the script” of shaming and patronization that has characterized too many wellintentioned programs before. “We are pushing the envelope,” Mitchell said, describing the “vast, broad” cross-section of eligible applicants, and the trust that they will know best how to use the money — “whether it’s quitting that second part-time job so they can help children with homework after school, or hiring tutors to help their kids address the learning gap of the past two years. “If it’s a trip to the San Diego Zoo, that’s ok too, because we all know what those cultural experiences mean for kids in their overall health and well-being. We are trusting these individuals to know what’s best for them and that they’ll spend it in a way to help themselves out of poverty. That’s the whole point.”

“This is the kind of daring, innovative, disruptive leadership one gets to see when women are in charge in this country,” Ross said. Of those who meet the program’s requirements, 1,000 individuals will be randomly chosen for those monthly tax-free debit-card disbursements. But for the research component of this pilot project, both those 1,000 and others not chosen will be asked to participate in confidential, twice-annual surveys and interviews by West’s University of Pennsylvania researchers and provided gift cards for their time and trouble. The information they give will be kept confidential from local staff, said West, who is currently running 31 studies of guaranteed income programs across the

country. The primary model cited for Breathe was in Stockton, where former Mayor Michael Tubbs initiated a program that provided $500 a month for a year. That and similar programs have all been well reviewed. “Across the country, guaranteed income has already proven to reduce poverty, improve the long-term well-being of families and give residents living on the edge of a fiscal cliff the support they need to breathe a little easier,” Mitchell said. “This helps the whole community,” Supervisor Kuehl said. “When families do well, their whole neighborhood, their whole community is shown to do better as well. When they have room to breathe, they’re more able to positively contribute to the

community.” “We know that poverty is bad for your health.” Ross noted, explaining why, as leader of California’s largest health foundation, he would be supportive of a guaranteed income pilot program. “If you want to predict someone’s life expectancy, ask them for their zip code,” he said, for that and “their health status based on issues of poverty and housing and transportation, clean air and clean water and those kinds of things. So that’s why we’re involved.” The link to apply online can be found at breathe.lacounty.gov, or in Spanish at respire.lacounty.gov. The site includes income eligibility limits for different household sizes and a feature that allows you to tell if your address is within one of the target communities. Besides English, the online application can be completed in another 20 languages, and oral translations into another 30 will also be available. Organizers hope the research will help determine the “sweet spot” at which such programs — national policy in some countries, but still rare in the United States — can best break what Mitchell described as “the systemic inequities and structural racism that help perpetuate poverty and have led to many of our communities being unable to build generational wealth.” “In my heart of hearts, I hope that this program will help inform federal, state, and local policy around our requirements for entitlement programs,” she said. 

Since March of last year, approximately 9,960 residents considered homebound were vaccinated in L.A. County. The number of residents in Los Angeles County who are homebound and unable to access vaccination services outside the home is estimated to be between 10,00015,000. This estimate is based on an examination of medical claims data by several public and private health care plans in the county that was requested by Public Health. For the week ending March 5, 2022, 102 homebound referrals were received by the Homebound Project. Of these, nearly 90% were vaccinated within two weeks and nearly 80% lived in under-resourced communities. An additional 231 residents who were unable to travel to vaccination sites were also served by other providers for the same week ending March 5. Of these, more than 60% resided in under-resourced communities. Also, this week, Public Health began contacting more than 1,000 social service agencies that work with seniors or the homebound and provided them with information on how to request homebound services for their clients and if they needed a mobile vaccine team. These efforts will continue for the next few weeks. For assistance on homebound services, the Public Health Vaccine Call Center is available at (833) 540-0473 between the hours of 8 AM and 8:30 PM seven days a week for information on COVID-19 vaccines. Residents can also visit the “How to Get Vaccinated” section at VaccinateLACounty. com for more information. “We continue to extend our deepest sympathies to everyone mourning the loss of a loved one from COVID,” said Dr. Barbara Ferrer, PhD, MPH, MEd, Director of Public Health. “Protecting the County’s most vulnerable residents also means expanding our outreach services and bringing the vaccines to their homes if they are unable to travel. As the County sees growing cases of the more-infectious BA.2 subvariant, everyone, especially those who are at elevated risk or homebound, should be fully vaccinated and boosted, and Public Health thanks our partners who are working to provide access to these life-saving vaccines for these at-risk residents.” Public Health reported 21 additional deaths, and 889 new positive cases of COVID-19. Of the 21 new deaths reported today, two people were between the ages of 30-49, four people were between the ages of 50-64, five were between the ages of 65-79, and nine were aged 80 years or older. Of the 21 newly reported deaths, 18 people had underlying health conditions. Information on the one death reported by the City of Long Beach is available at www.LongBeach.gov. To date, the total number of deaths in L.A. County is 31,576. Public Health has reported a total of 2,829,091 positive cases of COVID-19 across all areas of L.A. County. Note that 291 additional cases have been added to the cumulative total of positive cases due to a backlog of cases from the surge. Today’s positivity rate is 0.7%. There are 350 people with COVID-19 currently hospitalized. Testing results are available for more than 11,651,000 individuals, with 22% of people testing positive. 

MANILA — Along with an overwhelming majority, the Philippines backed a strongly worded United Nations General Assembly resolution that condemns humanitarian abuses Russia has committed in Ukraine and demands an end to the war. In a tweet, Foreign Affairs Secretary Teodoro Locsin Jr. on Thursday, March 24 said the country would be voting for the non-binding resolution drafted by France and Mexico “on the heartless and cruel humanitarian consequences of the aggression against Ukraine.” The Philippines joined 140 other countries or almost twothirds of UN member states in approving the resolution, which was also sponsored by over 90 countries. In an earlier tweet, Locsin said the vote “expressed not just our solidarity with Ukraine, but our admiration for Poland whose capital Warsaw was the worst destroyed in World War 2 followed by Manila.” The vote came after the adoption of a similar non-binding resolution on March 2 that demanded Russia immediately cease its use of force—a vote that was approved

by virtually the same margin. It has been a month since Russia invaded Ukraine. According to the UN High Commissioner for Refugees’ operational data portal, over 3.67 million have fled Ukraine as of March 23. Majority or 2.17 million of those who left the country sought refuge in Poland, while the others are in Romania, the Republic of Moldova, Hungary, the Russian Federation, Slovakia and Belarus. UNHCR Commissioner Filippo Grandi, in a statement dated March 24, said the war is the “fastest-growing refugee crisis since the Second World War.” “An additional 6.5 million people have been displaced within Ukraine’s borders, and at least 13 million are estimated to be stranded in affected areas or unable to leave due to heightened security risks, destruction of bridges and roads, as well as lack of resources or information on where to find safety and accommodation,” Grandi said. Civilian infrastructure inside Ukraine has “been laid to waste,” forcing food, water and medicine shortages, the UNCHR said. It also mentioned that bringing in aid “remains dangerous and challenging.” The UNHCR, other UN agencies, the International

Committee of the Red Cross, and non-governmental organizations are bringing in humanitarian aid to Ukraine via emergency shelters, providing cash assistance, helping refugees cross borders, among others. Locally, the Philippine government has assisted more than 405 Filipinos to either fly back home or exit Ukraine. Foreign Affairs Undersecretary Sarah Arriola on Wednesday reported that 342 Filipinos have been repatriated, while 63 have been evacuated out of Ukraine. The Department of Foreign Affairs similarly expressed its "full support" for the International Court of Justice’s order issued March 16 requesting provisional measures under the Genocide Convention to prevent and punish acts of "genocide" committed in the Ukraine-Russia conflict. A "provisional measure of protection" is roughly equivalent to a restraining order. It also suggests the court has taken up the case as its top priority. The decision, in this case, orders for the immediate suspension of Russia's military operations in Ukraine, prohibits all Russian entities from furthering military actions and demands that Russia, along with Ukraine, refrains from action to aggravate the conflict. 

MANILA — Young Filipinos rallied outside and online on Friday, March 25 demanding politicians, especially those aspiring for the presidency, to take action to combat the worsening impacts of climate change. Filipino youth, whose lives have been upended by the pandemic and are threatened by the climate crisis, joined thousands of young people around the world who are part of the global climate strikes. In a Quezon City protest, members of Youth Advocates for Climate Action Philippines held placards reading “People not profit” as they called on candidates in the crucial May polls to put climate change and environment on the agenda. The Philippines is one of the most vulnerable countries to the impacts of human-induced climate change such as stronger cyclones, sea level rise, flooding, drought and biodiversity loss. But despite the magnitude of the crisis, climate change has been largely missing from the election campaign. “We are in a state of emergency, and yet most of our candidates don’t even seem concerned about the climate,” said Jon Bonifacio, national coordinator of YACAP. “In the face of climate change, we need and deserve better leaders who can commit to immediate climate action for the sake of the people and the planet,” he added. The Intergovernmental Panel on Climate Change recently released a report that called on countries to strengthen measures that will help people cope in a warming world. Buying votes

ARTICLE 22 of the Omnibus Election Code or Batas Pambansa 881, passed in December 1985, defines vote-buying as “any person who gives, offers or promises money or anything of value … in order to induce anyone or the public in general to vote for or against any candidate or withhold his vote in the election, or to vote for or against any aspirant for the nomination or choice of a candidate in a convention or similar selection process of a political party.”

As accusations of vote buying are hurled, the Commission on Elections announced it would create a task force that will handle complaints involving the offense. The Comelec stressed that it wanted “concrete evidence” instead of mere media reports to back the accusations. It is uncertain if video clips of money being handed out by politicians or their supporters to rally participants, all of them wearing the campaign shirts of particular candidates, would constitute “concrete evidence.” A task force is being formed to go after offenders, composed of the Department of Justice, police, military and the Comelec’s gun ban committee. The Comelec is urging the public to report possible cases of vote buying. But with the poll body emasculated in many aspects of its mandate, there are doubts on whether it can actually pursue complaints. Comelec officials themselves have warned that candidates for local posts accused

of vote buying might say the local campaign has not yet officially started so they can still give away whatever they want. One local executive claimed the distribution of ayuda to his constituents merely coincided with the campaign rally scheduled that day of a national candidate. Election watchdogs, on the other hand, say if cash distributions coincide with rallies for national candidates, any person including a noncandidate can be held liable for vote buying under BP 881. Those accused of the offense can be expected to strongly fight the charges. Penalties under BP 881 range from imprisonment of one to six years without probation, deprivation of the right to vote, and perpetual disqualification from public office. Apart from actual cash handouts, the country has been warned by monetary and anti-money laundering authorities that vote buying could be

going digital. Specific acts that could indicate this type of election offense have been provided by the authorities to banks and financial service providers.

There are enough laws to discourage vote buying and penalize offenders. As in most laws in this country, what is needed is proper enforcement. (Philstar.com)

Filipinos’ fight vs corruption: What happens when a presidential candidate seems to be part of the problem and not the solution? The Fil-Am Perspective GEL SANTOS-RELOS ORRUPTION has been the chronic illness that has plagued the Philippines for a long time, and in each and every election cycle, we hear candidates for president vow to end corruption and yet the problem has persisted and the prognosis did not look good. In fact, corruption has become systemic, and its toxicity has been eating up most part of the Philippine government from top to bottom. Corruption has been the very reason why the rich become richer and the poor become poorer. People in government have been accorded with public trust to make sure that it serves the people well with the taxpayers’ money entrusted to the public officials, in order to deliver basic services to the people. Public officials vow to represent the interest of the people and make the government the equalizer to give those who are poor and less privileged access to quality education, good healthcare and job opportunities that will help lift their family up from poverty and despair. In a healthy democracy, erring corrupt public officials are held

accountable for their actions. They are fired, imprisoned, impeached, barred from ever running for public office again. We know that the health and wellness of Philippine democracy has reached its terminal stage when the government officials who were charged and convicted in criminal courts of abusing their power to enrich themselves have made their way back to power without shame nor remorse. And perhaps the biggest blow to our system has been self-inflicted when the public officials tasked to protect the integrity of our democracy have abandoned the checks and balances requirement of the Constitution and allowed the bereaved family of the Dictator Ferdinand E. Marcos, who we ousted through the People Power of 1986, has found its way back to power as elected government officials - from Imelda Marcos to Imee Marcos to Bongbong Marcos. After Bongbong Marcos lost to Leni Robredo for the Vice Presidency in 2016, the family contracted the services of Cambridge Analytica to “rebrand” the Marcos Family. They sure did great PR work, revised history and make the Marcoses the “victims” and the heroes, and their political nemesis — the Aquinos and the Liberal Party became the villain. Their investment paid off. Bongbong became an early favorite to become the 17th President of the Philippines.

Shortly after the son of the dictator filed his certificate of candidacy to run for President, he found himself running against Leni Robredo again. Robredo initially did not want to run for President but with Bongbong formally declaring his intention to go back to Malacañang, Robredo heeded the calling to run against Marcos to save our democracy. The campaign of Bongbong Marcos doubled down on the use of fake news, paid trolls to discredit Leni Robredo. Everything seemed to be working in his favor, his leading the polls despite of Robredo running against him made him the front runner, until the official start of the campaign season. As Leni Robredo endeared herself to the Filipino people as she and her running mate Kiko Pangilinan went around the country talking about their platform of “gobyernong tapat” para “angat buhay lahat” [clean honest government to lift the lives of all Filipinos] in their caravans and political rallies, the truth about Bongbong Marcos and his family has also found its way out to the people’s awareness despite the Marcoses attempt to conceal and deny the facts about the corruption of the Marcos family and their minions. Filipinos petitioned the COMELEC to disqualify Marcos from running for President but the COMELEC leadership appointed

by Rodrigo Duterte ruled to trash the petition after the retirement of COMELEC Commissioner Rowena Guanzon. Guanzon were among those who have been vocal about her stand that Marcos should be disqualified for moral turpitude, a position that was shared by Former Supreme Court Justice Antonio Carpio and Former PCGG Commissioner Ruben Carranza, among others, who were knowledgeable about the law and the Marcos Family’s transgressions against the Filipino people. Through investigative reports, fact checking and the boldness to bring the truth out to the public, we learned that Bongbong Marcos did not only fail to pay his income taxes for several years when he was Vice-Governor and later Governor of Ilocos Norte, he was also the key administrator of the Marcos heirs who owe the Philippine government P 203 Billion in estate taxes with interests and penalty since Marcos’ death in 1989. We also found out that the Marcos family still owes the Philippine government P 125 Billion ill-gotten wealth. So the total amount being stolen from the Filipino people that should otherwise go to providing help and services to the people now stands at P398 Billion. Justice Carpio and Former BIR Commissioner Kim Henares warned that if Marcos wins, we

may never be able to collect that money that the Marcoses owe us, especially with Bongbong’s expressed intent to “recreate” the PCGG which he said was antiMarcos. The Marcos Family and their cohorts have been calling these reporting fake news despite the evidence, in their desperate attempt to keep the Marcos Loyalists. They also doubled down on fabricating fake news to scare the people away from Robredo, with the help of no less than President Rodrigo Duterte himself, red tagging Robredo and many of her supporters. After all, his daughter Sara is running as VP of Bongbong Marcos. Bongbong Marcos and his campaign as well as the Trapos in government especially the family dynasties, have also been projecting their own corrupt election practices on to Robredo’s campaign when they were the ones who were violating election rules against vote buying, hakot and other dirty political tactics, even paying people to pose for pictures pretending to be Leni supporters getting paid just to give the suggestion that Leni is corrupt as well. These were all documented on video but COMELEC has not acted on these violations up to now. Bongbong Marcos said “Yung corruption, talagang hindi matitigil yan, as I keep

reminding everyone, corruption is not a Filipino condition. It is a human condition… At a high level of government, ang talagang kailangan ay mamili ka ng magaling na tao na alam mong hindi corrupt”. That is exactly the problem because Bongbong seems to be part of the problem, and not the solution, to chronic corruption. And that is also exactly why the pink wave of Leni Robredo and Kiko Pangilinan’s advocacy for “Gobyernong Tapat” has shifted the momentum to their campaign, going full speed toward the finish line on May 9, 2022. Then, and only then, can we put an end to IMPUNITY : exemption from punishment, harm, loss, or freedom from the injurious consequences of an action. Marcos Jr. presidency: Three possible scenarios

RICHARD HEYDARIAN LET me first be absolutely clear: Nothing is final until it’s finalized. Rarely is anything predetermined in the realm of men, who are extremely susceptible to wild swings in opinion. And human agency often trumps social engineering. Lest we forget, supporters of duly-elected Vice President Leonor “Leni” Robredo have had their signature show of force and conviction in recent weeks. Collectively, hundreds of thousands of passionate supporters have attended opposition rallies this month alone. Leni has been picking up crucial endorsements even among politicos from within the ruling party. The next two weeks will be extremely crucial to determining the final contours

of the 2022 presidential elections. In short, many things can still change before we enter the final stretch of arguably the most important elections in contemporary Philippine history. In order to better understand the stakes involved in the upcoming race, however, we need to examine political prospects for the country if the current frontrunner maintains his lead until Election Day. So, dear reader, let me begin with a familiar figure: Not former dictator Ferdinand Marcos Sr., but instead Russia’s modern czar Vladimir Putin. History will likely judge the Russian president based on his unprovoked and disastrous invasion of Ukraine, which has valiantly withstood the invading forces with shocking success. But decades before Putin became the absolute strongman of a Eurasian colossus, he oversaw the construction of 21st-century

authoritarianism, which has influenced leaders from Hungary and Turkey to, yes, even the Philippines. President Duterte once described Putin as his “favorite hero.” Throughout his first decade in power, the Russian leader established what journalist Fareed Zakaria famously described as an “illiberal democracy”: A system whereby elections are regularly held, thus creating a facade of democratic contestation, but constitutionalism, rule of law, and civil liberties are steadily undermined by a reactionary regime. Should Ferdinand Marcos Jr. become the next president, it’s more likely that the Philippines moves toward what political scientists call “hybrid regimes,” combining elections with illiberal politics, rather than old-style dictatorship. Nevertheless, the precise contours of any Marcos Jr. presidency would depend on

three major factors, namely his (i) margin of victory and, accordingly, potentially newfound sense of personal destiny (ii) factional politics and personalistic jostling within the ruling regime, and (iii) external pressure/encouragement from international partners, especially Washington and Beijing but also Brussels, London, Tokyo, Canberra, and, yes, even Moscow. Accordingly, there are three potential scenarios ahead. For now, let me just provide a preliminary analysis since the race is far from over, and there is just so much one can fit into a short column. The first scenario is the least expected one, meaning the transmogrification of the current frontrunner from a relatively laid-back, avuncular figure into a self-assertive and ambitious political figure. As Russian journalist Masha Gessen explains, one of Putin’s greatest secrets to success is

that everyone underestimated him before his ascent to power. Should Ferdinand Marcos Jr. win with massive and unprecedented margins and cultivate reliable superpower partners overtime, I won’t be surprised to see a different and more self-assured side of him. Aside from the abovementioned “maximalist” scenario, there is also the “cartel scenario,” whereby the House of Marcos will effectively co-rule with the House of Duterte and other key power brokers. Thus, instead of a more personalistic and unpredictable regime, centered around Marcos Jr. and his inner circle, what we may get is more of predictable, gradualist, “consociational” leadership, where key decisions are made based on consensus-building and compromises among several pillars of reactionary power in the Philippines. The final scenario is a more “minimalist” Marcos Jr.

presidency should he win with far narrower margins and, crucially, face a determined and cohesive opposition, as well as concerted pressure from flagship democracies. Time and again, we have seen how the current frontrunner is willing to recalibrate his positions, including on the West Philippine Sea, when faced with significant pressure from both the public and key rivals. Not to mention, his preference for a less bloody version of the incumbent’s socalled “war on drugs.” In short, nothing is predetermined with either these elections or even, should current trends stand, a Marcos Jr. presidency. The struggle for the future of the Philippines is far from over. MANILA — Metro Manila mayors running for reelection or other local posts remain the most preferred candidates in the upcoming elections, a survey conducted by RP-Mission and Development Foundation Inc. (RPMD) showed. The survey result was released on Thursday, March 24 – a day before the start of the official campaign period for those running for local positions. In Quezon City, Mayor Joy Belmonte is leading with 68 percent of support among survey respondents, compared

to the 30 percent obtained by her closest rival, Anakalusugan party-list Rep. Mike Defensor. Pasig City Mayor Vico Sotto obtained the support of 62 percent of survey respondents from the city, compared to 35 percent who said they support Vice Mayor Iyo Bernardo. In Marikina, Mayor Marcy Teodoro had 56 percent of support, compared to the 43 percent of former mayor and Rep. Bayani Fernando. Other incumbent Metro Manila mayors who are leading in their respective races are Makati’s Abby Binay (98 percent), Las Piñas’ Imelda

Aguilar (95 percent), Pateros’ Mayor Ike Ponce III (87 percent), Pasay’s Emi-Calixto Rubiano (90 percent) and San Juan’s Francis Zamora (96 percent). THE Philippine Coast Guard (PCG) has confirmed the increasing presence of Filipino fishermen in the disputed Bajo de Masinloc (Scarborough Shoal), seen as a "significant milestone in promoting maritime security and maritime safety". According to the PCG, it has monitored approximately 45 Filipino fishing boats conducting fishing activities in the waters off Bajo De Masinloc during intensified maritime operations from February 28 to March 5. "Seeing more Filipino fishing boats in Bajo de Masinloc is proof of our intensified efforts to safeguard Filipino fishermen

MANILA — Malacañang on Thursday, March 24 expressed confidence the next administrations will follow the pandemic recovery plan contained in Executive Order No. 166 signed by President Duterte this week. Acting presidential spokesman Martin Andanar clarified that the order, containing a 10-point policy agenda to accelerate and sustain economic recovery from the pandemic, is not a COVID-19 exit plan. “We do not share the view that this is the current administration’s exit plan for this forms part of the country’s preparation to build resilience under the new normal, which we are certain would be carried on by the succeeding administrations,” Andanar said in a statement. Andanar noted that EO 168, which formed the Inter-Agency Task Force for the Management of Emerging Infectious Diseases, was signed by the late president Benigno Aquino III in 2014 and was adopted by the Duterte administration. The IATF is the government’s pandemic policy-making body. “Unless Executive Order No.166 is modified or revoked, it would remain effective and operational,”

Andanar said. The order, signed by Duterte last March 21, enumerated 10 principles of the pandemic economic recovery plan – strengthen health care capacity, accelerate and expand the vaccination program, further reopen the economy and expand public transport capacity, resume face-to-face learning, reduce restrictions on domestic travel and standardize local government units’ requirements, relax requirements for international travel, accelerate digital transformation through legislative measures, provide for enhanced and flexible emergency measures through legislation, shift the focus of decision-making and government reporting to more useful and empowering metrics, and medium term protection for pandemic resilience. The policies were intended to sustain economic gains and minimize the long-term adverse effects of the pandemic, which has so far left more than 58,000 persons dead in the Philippines. All regions in the Philippines are now at minimal risk as COVID-19 case rates drop but health officials are urging the public and businesses to continue complying with health protocols like frequent hand washing, wearing of face masks, observing physical distance, and proper ventilation. 

Around 2.5 million Filipino families experienced hunger in end-2021 MANILA — With the Duterte administration coming to a close, new survey results by the Social Weather Stations suggest that over a tenth of all Filipinos or around 2.5 million families experienced being hungry amid the coronavirus pandemic at least once to end 2021. In a report of the results of its non-commissioned national survey, the SWS found that 11.8% of Filipino families, or an estimated 3.0 million, experienced involuntary hunger – being hungry and not having anything to eat – at least once in the past three months. The Fourth Quarter 2021 Social Weather Survey was conducted from the week of December 12 to 16, 2021, although the report on its results was only sent to the media on Friday, March 25. "The December 2021 Hunger rate is 1.8 points above the 10.0% (estimated 2.5 million families) in September 2021, but still lower than the 16.8% in May 2021 and 13.6% in June 2021," the report reads. "The resulting annual average Hunger rate for 2021 is 13.1% versus the record-high 21.1% for 2020. However, this is still above the 9.3% annual average for 2019, before the COVID-19

pandemic." The experience of hunger was also highest in Metro Manila at 22.8% of families. Hunger reportedly rose in all areas except in Balance Luzon while also rising among self-rated poor and food-poor families. The 11.8% hunger rate in December 2021 is the sum of 9.2%, or an estimated 2.3 million families who experienced moderate hunger and 2.6%, around 657,000 families, who experienced severe hunger. Moderate hunger refers to those who reported experiencing hunger “only once” or “a few

times” in the last three months. Severe hunger referred to those who said they experienced it “often” or “always” in the last three months. The survey was conducted using face-to-face interviews of 1,440 adults with sampling error margins of ±2.6% for national percentages, and ±5.2% for Balance Luzon, Metro Manila, the Visayas, and Mindanao. Kenneth uRsuA Reyes THE COVID-19 pandemic is a scary reality which affects everyone globally and has shut down the global economy. Individuals over 60 years old and individual that are immune compromised are more at risk of having serious complications with this virus. Individuals are dying all over the world in exponential numbers. Although we cannot completely control how our bodies and immune system would respond to this virus, we can prepare our finances and estate in case the worst happens to make sure our loved ones are properly provided for. Legally, there are several

ways you can do this. 1. Create a Living Trust If you pass away with at least $166,250 in gross assets and you do not have a living trust (even if you have a will), your beneficiaries would have to open up a probate case before title to the assets can pass to them. When I say gross asset, I mean regardless of how much debt you owe on them. For example if you own a house valued at $350,000 at the time of your death, it does not matter that your mortgage balance is $300,000, a probate case has to be opened in order to pass title to that property. The same is true with other types of assets such as owning a business, a professional practice, bonds, equities, etc. This is a very low threshold to exceed specially in California where real estate prices, even after the economic crisis, remains in the upper end of the curve among the 50 states. Commencing a probate case

is expensive and a very slow process. Someone qualified will have to file a Petition with the probate court to have someone appointed as executor or administrator. The Petitioner’s attorney gets paid a statutory rate for attorney’s fees commencing with 4% of the gross estate. The probate referee will have to be paid for appraising the assets of the estate. If it is necessary to post bond, the premium on the bond would have to be paid as well. There is also the cost of administering the estate such as selling some of the assets to satisfy the estate’s obligations and to divide the estate according to the will or the intestate line of succession if there is no will. The entire process could take up years specially if certain beneficiaries and creditors file certain claims. The probate court file would be public record. On the other hand if you have PAGE B5

If your average monthly income is lower than the median, Chapter 7 may be for you. If your income is higher than the median, Chapter 7 is still a possibility, but there is an additional step. You have to pass what’s known as “the means test”, a mathematical formula for calculating your disposable income and determining whether it is high enough to help pay off some of your debts. If the court believes that you are in a position to pay a certain portion of your debts through Chapter 13, then whatever amount you can afford will be good enough and you don’t necessarily have to pay everything in full. Chapter 13 can be the most effective way to consolidate all your debts into one low monthly payment while paying 0% on your credit card and other unsecured debts. As I mentioned above, in a lot of cases, most debts are only paid a small percentage of the actual amount, resulting in significant reduction- a reduction of 50%

or more is not unusual. So, for the sake of this discussion, let’s say that you owe a total of $50,000 in credit card debts but you can only afford to pay $400 per month. BAlAGtAS I STILL think of last Sunday’s (March 20) Old Testament Reading on God’s presence through a burning bush. It’s a powerful image of God’s luminous presence, love, mercy, and wisdom. It burns continually; it cannot be consumed. As human beings, we cannot fully comprehend him. Yet, like Moses, we approach him with fear and reverence. Our hearts seek him. As St. Augustine says, “Our hearts are restless until they rest in God. “ That happens to us. We wake up at night or early in the morning with a deep longing to understand God’s ways and wisdom. We long for his mercy and forgiveness. We want his intervention in the things of the world. We may not see him face to face. We may not comprehend his ways, but he became

accessible to us. He showed us his unconditional and eternal love through the person of Jesus—the heart and mind of Jesus. In Jesus—his ministry, life, death, and resurrection, we have come to know the will and desires of God. One of my favorite scenes in the Gospel is the time when the resurrected Christ showed himself to the apostles, particularly to Thomas. Jesus said to Doubting Thomas. “Come near me. Touch the wounds on my hands and my side to see that it’s me. Don’t be unbelieving, but believe! Here we find God who wants us to enter into his divine life. We’re not just meant for the things of the earth. We’re meant to dwell in God’s presence and un-consuming love. That’s why God is so patient with us. He waits. He does not cut or uproot us right away; he grants us many chances to change. Should I create a will and... PAGE B2 a living trust, your estate can avoid the entire court system and court supervision. In certain situations, the process may also save you estate taxes which may be substantial if your assets exceed a certain threshold. Basically, you and/or your spouse can be named as the initial trustee of the trust while you are alive. The trustee is the person who manages the trust. This means you retain control of all your assets the same way as if you never had a trust. For revocable trusts, you can later on, at any time during your lifetime, revoke the entire trust if you change your mind. The assets held in your living trust will be managed by the trustee and distributed according to your directions without court supervision and involvement when you pass away. This can save your heirs time and money. Since the trust would not be under the direct management of the probate court, your assets and their value and your beneficiaries’ identities would not become a public record. Your heirs and beneficiaries would still have to be notified about the living trust and advised, among other things, of their right to obtain a copy of the trust. Having a trust is also beneficial in case you become incapacitated. The person you name as successor trustee can step up and manage the assets in your trust on your behalf. 2. Power of Attorney A power of attorney designates another individual the power to manage your financial affairs on your behalf. You can limit this power and define what the scope of the power you are giving your attorney in fact. A power of attorney is also revocable if you decide to cancel the power you have given this individual. By giving another person the power of attorney, you do not lose the power to manage your financial affairs. You can continue to make financial decisions on your own affairs. 3. Durable Power of Attorney for Healthcare A Durable Power of Attorney for Healthcare allows your to designate specific individual to

have the power to make healthcare decisions on your behalf incase you no longer have the capacity to make decisions for yourself due to health conditions. You can define the scope of your agent’s authority. This is also revocable if you change your mind in the future. Your agent will have the authority to access and review your medical records and sign any authorization on your behalf. This is helpful incase you are unable to make healthcare decisions for yourself. 4. Last Will and Testament A Last Will and Testament allows your to designate how your assets will be distributed after you pass away. This allows you to customize how your estate will be divided and distributed. Transformative years “Those were the years that helped you shape as a person and a young lady. Back then, everyone had insecurities… everyone was trying to figure themselves out. If there are bullies, ignore them. They’re just jealous because you have something they don’t have,” he said. Julia joked that she was never bullied in school. Our employer told us both to sign an “exit form” and a “release.” We were told that we would not get our final paycheck if we do not sign these documents. Is this legal? A: If an employee was discharged (i.e., fired or terminated) from work, the employer must immediately pay all compensation due at the time of termination. Wages include any earned and unused vacation pay. The employer should pay the employee “at the place of discharge.” If the employee resigned (i.e. quit) from work, the employer must pay all compensation due to the employee within 72 hours of the resignation. An employee who resigned without 72 hours’ notice may generally request that their final wages be mailed to a designated address. If the employee gave more than 72 hours’ notice of resignation, then all compensation due to the employee must be paid on the employee’s last day of work at the location where the employee worked. An employer shall not require the employee to sign a release of the employee’s rights to any wages that are due and earned by the employee, unless those wages have been paid. Some employers hold their employee’s final paycheck “hostage” until the employee signs a release or some type of employment separation form that contains a release. This conduct is prohibited by law. The employer also cannot require an employee, as a

condition of being paid, to execute a statement of the hours they worked during a pay period, which the employer knows to be false. A release signed by the employee under these circumstances may not be enforced. It may be a misdemeanor for an employer to engage in this unlawful conduct. The employer has the obligation to make sure that the employee receive their payment. If the employer says it will mail the employee’s paycheck, the employee must consent to such an arrangement. If the employer sent the final paycheck by mail without the employee’s

Pahrump, areas outside Las Vegas eyed by home developers as land prices increase By RealtoR

REAL estate in the gaming capital of the world, Las Vegas, continues on its upward trend as the area’s population continues to grow. With construction projects on the horizon and with it more jobs and employment opportunities, Las Vegas home buyers are feeling the crunch when it comes to searching for affordable homes. The frenzy for home buying in the area has taken its toll on prospective homeowners as many compete for available, affordable homes. A recent article even stated that some builders have put buyers on waiting lists, and that buyers have had to contend with raising of prices, overbidding and lottery draws. That is probably the reason why home builders will be looking at areas outside of Las Vegas to develop new homes, especially since per square foot costs in these areas are cheaper when compared to Las Vegas. Take a look at Pahrump, which is about 62 miles west of Las Vegas. Easily a drive of about an hour or less, it is an area where a person employed in the world’s gaming capital can drive to and from work, and still enjoy the comforts of a quieter, peaceful neighborhood, and far from bustling traffic, crime and other problems associated with big cities. Today’s Pahrump is no longer a backwards place. Still an unincorporated town, Pahrump has currently an estimated population of nearly 48,000 from the latest Census data (by comparison, in 2000, the town had an estimated population of just under 25,000), and has many major stores that can be seen in big

towns like Walmart Supercenter, Albertson’s, Safeway, Home Depot and Dollar General, as well as a variety of businesses that serve its burgeoning population. Aside from these, Pahrump is also site to the Front Sight Firearms Training Institute and Spring Mountain Motor Sports Ranch. It also has wineries, casinos, drugstores, many restaurants, and legal brothels. Public education is administered by the Nye County School District. Although land prices in Pahrump may not be as low as was decades ago, it is still an affordable alternative to the rising real estate prices in Las Vegas. Plus, real estate in Pahrump has appreciated about 155% over

the last ten years alone, according to latest data available, which puts the unincorporated town in the top 10% nationally for areas whose real estate values have appreciated exponentially. Due to this, many observers see Pahrump as being one of the best long-term investments that people can make in the United States over the past decade and into the future. Despite a downturn in the housing market, Pahrump’s real estate portfolio has continued to appreciate. Millions of dollars are being pumped into construction projects in Pahrump which will greatly benefit the town. Permanent residence for crewmen

A COMMON issue for which persons have consulted with me is whether any avenues towards permanent residence exist for a person who entered as a “crewman.” Under INA Section 245(c)(1), a person who enters the US as a “crewman” is generally barred from adjusting his status to permanent residence. Analysis of this issue must begin with determining whether one is actually a “crewman,” who is barred from adjustment. A “crewman” is defined as a person “serving…in a capacity required for normal operation and service on board a vessel, …or aircraft, who intends to land temporarily and solely in pursuit of his calling as a crewman and to depart from the United States with the vessel or aircraft on which he arrived or some other vessel or aircraft.” INA Section 101(a) (15(D). A “crewman” under this definition is assigned a “D” visa classification, but is often issued a dual C-1 transit/ D crewman visa. Because of this, a common misperception exists that a C-1 visa classification is designated for crewmen, and that a person who entered the US under a C-1 classification is by definition a “crewman,” therefore barred from adjusting his status to permanent resident. However, it is important to keep in mind that if a person entered on

Legal Advice Atty. DArrick tAn a C-1 transit visa, he may not be a “crewman” and may be eligible to adjust status. Further, the facts of a particular case regardless of letter classification of one’s visa upon entry may also be considered. Next, if considered a “crewman” under the above definition, one may file for adjustment of status to permanent residence and get his green card in the US if he is covered by INA Section 245(i). To be covered under INA Section 245(i), one must be the beneficiary of a visa petition or labor certification filed on or before April 30, 2001. If the petition was filed between January 14, 1998 and April 30, 2001, physical presence in the US on December 21, 2000 is also required. If not covered under INA Section 245(i), a “crewman” would need to obtain his immigrant visa at a foreign consular post. Traditionally, persons who were unlawfully present in the US for more than 1 year, and who had to obtain their immigrant visa at an overseas US consulate were subject to

an unlawful presence bar from returning to the US for 10 years. That person would be able to seek a waiver of the unlawful presence bar after leaving the US, but if denied, he would be left outside of the US, and away from his family for 10 years. Under the Provisional Waiver program, a person can apply for and get a decision on the waiver of the unlawful presence bar without leaving the US. If the waiver is approved, the applicant can leave the US with some assurance that he will obtain his immigrant visa at the US consulate post and quickly return. Spouses and minor children of US citizens are eligible for provisional waiver relief (under President Obama’s recent executive actions, the relief will soon be expanded to include spouses, sons or daughters of permanent residents, and sons and daughters of US citizens). *** Darrick V. Clients with failed businesses using credit cards & business loans need debt relief

FIRST client is 34. She is recently married and now has a one-year old son. She used to be employed making a gross of $50K yearly. At the same time, she was doing a home-based business using credit cards to finance the purchase of goods for people who had no credit. She would use her cards to purchase a gift card and give that to the end buyer. The end buyer would use the gift card to purchase say a TV set, or furniture set. Then end buyer would pay her back in installments, plus a certain extra margin as her profit for providing the service of acting as a financing intermediary to enable the end buyer to obtain the desired merchandise. Theoretically, this business model could work but is very risky. The risk that client assumed of course is that the end buyers may not pay her back on time, or may not pay her back at all. They can just say, well, we bought this TV set with a gift card, so client just gave them the gift card for free, to get away from their agreement to pay her back so she can pay back her credit cards. Let’s just say that client is young and has no business experience at all and is too trusting of people. She actually did not get the end buyers herself. She had an in between person, an “up-line” who did the recruiting of end buyers, and I believe, this “up line” also collected the payments from the end buyers and turn over the collections to her. To make a long story short, the end buyers defaulted on payments and consequently, client is left holding the bag of credit card debts. She now owes, would you believe, $300K of credit cards! That’s a lot of credit card debt. For any person, let alone a young one in her thirties to owe a ton of credit cards is like being put in a prison cell with the key thrown away. Just imagine the minimum payment required on $300K of credit cards. That’s at least $10,000 a month of minimum payments every month just to keep the $300K current every month! Without question, client needs a fresh start in life without these credit cards hounding her every day for payment. We would expect questions from the Chapter 7 trustee as well as maybe the US trustee on how she racked up so much credit card debts. But as long as she is telling the truth about what happened, that she used those credit cards, the law favors giving her a discharge to free her from those debts so she can get a fresh start in life without accumulated debt. That’s why Chapter 7 is called the “fresh start” law. Everyone wants to be productive again. How can she be productive again if she has to give $10K a month to her credit card masters just because her business failed? That’s cruel and unjust punishment. It’s like torture every day for the rest of her life.

Debt Relief

Atty. LAwrence yAng Second client is 69 and a widow. Would you believe she bought six expensive cars costing at least $100K each! That’s $100K for each car. She owes a total of $800K in car loans! These are expensive cars, large Mercedes Benzes and Lexus, SUV’s and large sedans. They are all purchased with car loans, not leased. Her business model was to rent these high-end cars to people who want to use them temporarily maybe to show off to some people that they have an expensive car. These people would pay her rent to use the cars; then she would the rent to pay back the car loans plus make her profit. This plan is also flawed because the renter may just decide not to pay the rent, or just run away with the car. Renter is authorized to use the car but has no liability for the car payment. It’s a sweet deal for renter, and a

All these renters are now driving all over the country and getting all kinds of toll tickets from different states, and guess who gets the bill for all the traffic violations for six expensive cars? Not Donald Trump for sure. Third client is 55. She bought a restaurant for $80K about 5 years ago. Unfortunately, the restaurant has been losing money every year. Surprise! The minute she forked out her purchase payment for the restaurant, it starts to lose money. And now, some employee wants to sue her, a job related injury. If she gives up the restaurant, the landlord will sue her to collect 3 more years of unpaid rent at $50K per year, or total of $150K. Fortunately, she signed the lease as an officer of the company which owns the restaurant, and did not sign as an individual lessee, and did not sign as an individual guarantor of the lease, otherwise, she would also be personally liable for the $150K unpaid lease. So, the company that owns the restaurant needs to file Chapter 7 to get out of the lease and the workmen’s comp claim. Of course, with Trump’s trade wars, a lot of importers here a re g o i n g t o n e e d bankruptcy relief soon. Either that or the Yuan is devalued by 25% to offset tariffs. A long and protracted trade war could happen and plunge the entire world into chaos and re c e s s i o n . N o b o d y wins. Nowadays, this is really a sad fact. Bankruptcy is the only realistic and effective solution for accumulated debt. Chapter 7 is used to wipe out unsecured debt completely. Chapter 13 and 11 are used to reorganize and/or consolidate financial affairs, or to save a house from foreclosure, or to resuscitate a business. Walt Disney did Chapter 7 twice before his Disney-empire became successful. Yes, that’s true.
