ARI Mobile Column Lifts and Drive-On Lifting Systems ll ARI-HetraTM lifting systems are warranted for a period of five (5) years from date of new system purchase forallStructuraland A Mechanicalparts.(StructuralandMechanicalpartsincludetheframebody,gearboxandmechanicalball-screwcomponents.)Electronics andnon-Structuralpartsarewarrantedforaperiodoftwo(2)yearsonnewsystems. Warrantedpartsorcomponentswillbereplaced or repaired at the discretion of ARI-Hetra and parts replaced under the warranty periodcarrytheremainingbalanceoftheoriginal manufacturer’swarranty. StructuralandElectricalPartswarrantiesincludefirst(1)yearlaborandtravel. Replacementpartsorrepairs performed outside the warranty period carry a 60 day replacement period warranty. ARI Heavy Duty Accessories llARI-HetraTM brandedaccessoriesandcomponentsarewarrantedforaperiodofone(1)yearfromdateofpurchase. Thisincludes, A butisnotlimitedto,RefurbishedLifts,Stands,LiftAccessories,andRemoteControl. Warrantyincludeslaborandtravelorreturnand replacement exchange. ARI Wheel Service Products ll ARI-HetraTM branded Heavy Duty Wheel Service products including but not limited to Tire Changers, Balancers, Inflation Cages, A HydraulicJacks,BrakeLathes,andBrakeHandingproductsarewarrantedforaperiodofone(1)yearfromdateofpurchase. Warranty includes labor and travel or return and replacement exchange. ARI Exhaust Extraction Products llmechanicalandstructuralcomponentsoftheARI-HetraTM ExhaustExtractionSystemsarewarrantedforaperiodofone(1)yearfrom A date of purchase during which time warranted partswill be replaced or repaired at the discretion of ARI-HetraTM without charge. llARI-HetraproductsshouldbeinstalledandservicedbyARIPhoenixInc.trainedandauthorizedservicepersonnel.Thiswarrantyshall A notapplyunlesstheproductisinstalled,operated,usedandmaintainedinaccordancewithARI-HETRAspecifications,assetforthinthe ARI-HETRA’s“Operation&ServiceInstructions”(Manual).Thewarrantydoesnotcovernormalmaintenanceoradjustments,damageor malfunction due to improper handling, improper installation, abuse, misuse, overloading, negligence, unsuitable power sources, carelessnessornormalwearandtear. UnauthorizedrepairsattemptedorcarriedoutbynonARI-HetraTM authorizedservicepersonnel willvoidthewarrantyanditscoverageperiods. AllwarrantiesareexpresslyconditioneduponusebyBuyerofonlysuchreplacement partsasaremanufacturedorprovidedbyARI-Hetra. Afterexpirationoflaborandtravelwarrantieswhilepartswarrantiesarestillin effect,partswhicharethoughttobedefectivemaybereturnedtoARI-PhoenixIncviaanRMA(returnedmaterialauthorization)with freight charges to be reimbursed in the event that ARI Phoenix Inc. determines the part(s) were defective. T HEFOREGOINGL IMITEDWARRANTIESAREEXCLUSIVE,ANDAREINL IEUO FALLOTHERWARRANTIES,W HETHERW RITTEN,O RALO R IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY AS TO MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE. T ITS DISCRETION, ARI MAY PROVIDE O NLY PARTS AND REMOTE SUPPORT FORPRODUCTSW HICHARELOCATEDO UTSIDEO FTHE A CONTINENTAL UNITED STATES. T HE SOLE AND EXCLUSIVE REMEDY FOR BREACH OF WARRANTY SHALL BE LIMITED TO REPAIR, CORRECTION OR REPLACEMENT UNDER THE LIMITED WARRANTY ABOVE. IN NO EVENT, REGARDLESS OF THE FORM OF THE CLAIM OR CAUSE OF ACTION (WHETHER BASED IN CONTRACT, INFRINGEMENT, NEGLIGENCE, STRICT LIABILITY, OTHER TORT OR OTHERWISE), SHALL ARI-HETRA’S LIABILITY TO BUYER AND/OR ITS CUSTOMERS EXCEED THE PRICE TO ARI-HETRA OF THE SPECIFIC GOODS MANUFACTURED OR SERVICES PROVIDED BY ARI-HETRA GIVING RISE TO THE CLAIM OR CAUSE OF ACTION. BUYER AGREES THAT IN NO EVENT SHALL ARI-HETRA’S LIABILITY TO BUYER AND/OR ITS CUSTOMERS EXTEND TO INCLUDE LIQUIDATED, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. THE TERM “ CONSEQUENTIAL DAMAGES” SHALL INCLUDE, BUT NOT BE LIMITED TO, LOSS OF ANTICIPATED PROFITS, LOSS OF USE, LOSS OF REVENUE AND COST OF CAPITAL.
