County moves to alert residents of annexations Officials say Cumming has acted irresponsibly By PATRICK FOX pat@appenmedia.com FORSYTH COUNTY, Ga. — In a possible display of holiday giving, the Forsyth County Commission is taking steps to help the City of Cumming alert residents about annexations. Cumming officials were put on the spot Nov. 16 when a group of county
residents showed up before the City Council to complain about a proposed rezoning for an adjacent property they didn’t know had been annexed into the city. Southern General Development Corporation had sought a rezoning to allow some 176 residential units on the 78-acre parcel on Pilgrim Mill Road which had been annexed into the city in 2019. The matter was deferred until Dec. 7, but council members, including Mayor Troy Brumbalow, said the city should do more to inform citizens about newly
annexed property and any changes in zoning planned for the land. County Commissioners on Nov. 23 said they’d be happy to help. The county has taken a hard stand against what it has termed a land grab by the city over recent years. Since 2019, Cumming has extended its city limits by almost 500 acres through more than a dozen separate annexations, according to the Georgia Department of Community Affairs.

Felony charges leveled in July death of infant FORSYTH COUNTY, Ga. — Three arrests were made in the death of a 6-week-old infant who died in an Ashley Drive residence on June 2. The infant boy’s custodial parents were arrested Nov. 12 and charged with involuntary manslaughter, criminal negligence and drug charges. His birth mother was arrested four days later in Cumming and has been charged with reckless abandonment. Deputies responded to the June call for an unresponsive baby and spoke to 32-year-old Caitlyn Diamond Swinks, the infant’s custodial mother. Swinks said she fed the baby and put him to sleep between her and the custodial father, Nathaniel Weldon Gravley, a 33-year-old Canton man. The couple fell asleep and woke up to find the baby lying on its side unresponsive, deputies said. Officers searched the Ashley Drive residence and found heroin, prescription medications and drug paraphernalia. Investigators also obtained a search warrant to draw Gravley and Swinks’ blood for toxicology testing. Gravley and Swinks both face charges of involuntary manslaughter, two counts of cruelty to children-second degree criminal negligence, reckless conduct, possession of heroin and possession of methamphetamine. Swinks was also charged with possession of diazepam, according to the Sheriff’s Office. Deputies on Nov. 16 arrested Andrea Sue Hitchcock, 42, the infant’s biological mother. She was charged with reckless abandonment: child under 1 resulting in death. Her involvement in the child’s death was not immediately clear.

Motorcyclist accused of fleeing traffic stop
FORSYTH COUNTY, Ga. — A Johns Creek motorcyclist who escaped one traffic stop was pulled over by a deputy along Ga. 400 on Nov. 16. When an officer tried to pull over two motorcycles with improper plates, both drivers sped away. Another deputy managed to track down one of the motorcycles and pull it over, according to the Sheriff’s Office.. The officer asked the driver, identified as 20-year-old Gabriel Callahan Choukri, why he was driving recklessly and sped away from the first deputy’s traffic stop. Choukri couldn’t provide a reason, according to deputies. He was arrested for fleeing and attempting to elude for a felony offense, reckless driving and several trafficrelated charges.
Deputies nab two men seen racing on Ga. 400 FORSYTH COUNTY, Ga. — Deputies spotted two Roswell men they say were drag racing along Ga. 400 at speeds that eclipsed 100 mph on Nov. 17. Enrique Barrera Jr., 22, and 21-year-old Efren Cervantes-Barrera Jr., were both charged with racing and failure to maintain lane. The suspects live at the same address, according to arrest records. Their relationship was not clear. An officer spotted the two men racing northbound on Ga. 400 from Peachtree Parkway. The vehicles swerved off road into gores, on-ramps and emergency lanes as the officer gave chase. The cars continued to race side by side and quickly hit speeds above 100 mph, according to deputies. Officers were eventually able to stop the vehicles near Pendley Road and took both men into custody.

Andres Olivas, 26, of Esther Drive, Gainesville, was arrested Nov. 9 on Waldrip Road for possession of cocaine and exhaust system violation. Jose Ramirez-Martinez, 42, of Howell Circle, Duluth, was arrested Nov. 9 on Peachtree Parkway for DUI, following too closely, possession of an open alcohol container by driver and driving without a valid license. Rachel Ann Wackenhut, 24, of Burts Crossing Drive, Dawsonville, was arrested Nov. 10 on Hendrix Road for possession of methamphetamine, possession of heroin, possession or purchase of controlled substance, possession of drug-related objects and possession of firearm or knife during the commission of a felony. Jason Arthur Dutremble, 53, of Highland Gate Drive, Cumming, was arrested Nov. 10 on Bethelview Road for DUI and failure to yield right of way while turning left. Michael James Harden, 38, of Golden Sands Drive, Cumming, was arrested Nov. 10 on Browns Bridge Road for possession of methamphetamine and weapon receipt, possession or transfer by convicted felon. Marcus Shaw Nellums, 51, of Skyridge Drive, Woodstock, was arrested Nov. 10 on Ga. 400 for DUI and failure to maintain lane. Rick Wayne Hurst, 63, of Hemingway Lane, Roswell, was arrested Nov. 12 on Peachtree Parkway for DUI and failure to obey traffic control device. Madison Alexandria Bishop, 25, of Castleberry Village Circle, Cumming, was arrested Nov. 13 on Ga. 400 for DUI and failure to maintain lane. Kristina Leigh Robinson, 56, of Knight Road, Gainesville, was arrested Nov. 13 on Old Keith Bridge Road for possession of methamphetamine, loitering and prowling and possession of drug related objects. County advances applications for office/warehouse zonings Chamber official says construction will grow local jobs BY PATRICK FOX pat@appenmedia.com CUMMING, Ga. — County Commissioners approved three items Nov. 18 designed to foster greater economic growth in Forsyth County. The action came after an endorsement from the Forsyth County Chamber of Commerce on the first of the three items dealing with land use issues. Native Development Group was seeking a zoning change and a change in conditions for a proposed warehouse along Atlanta Highway at Pendley Road. The developer was seeking a rezoning from Commercial Business District to Restricted Industrial District on the 6.6-acre property. The firm plans to build a 90,000-square-foot office/warehouse with 100 parking spaces with conditional use permits for an open storage yard with parking to conduct around-the-clock business hours. The proposal received approval from the Forsyth County Planning Commission Oct. 26. Speaking in favor of the request, Scott Evans, senior technology project manager for the Forsyth County Chamber of Commerce, said the development is the type of construction the county needs. He said current data shows that about 80,000 people — almost onethird of the population — travel outside the county for employment each day.
“This year we had so much commercial real estate being sucked up that we made a pivot and started working with more developers,” Evans said. The chamber official also spoke in favor of another request, this time for a rezoning from Agricultural to Restricted Industrial District with variances to allow for office/warehouse buildings on a site west of Crossroads Road and east of Ga. 400. Plans are to construct a 15,000 and a 27,500-square-foot office/warehouse building on a little over 1.5 acres. Tommy Hughes, managing broker with Hughes Commercial Real Estate, said his firm has already built a number of buildings in the south end of the county. “We feel there’s a tremendous need for this type of product,” he said. Commissioners also approved a sketch plat for Engineered Parts Servicing to build a 20,720-squarefoot expansion onto its existing 76,000-square-foot office/manufacturing facility with 49 parking spaces on 5 acres on Grassland Parkway. “They need a little extra room and keep growing and make this facility usable for the foreseeable future,” Zieg said. Engineered Parts Servicing produces metal fasteners, mostly for automobiles. Jeff Harris, co-owner of the company, said the family-operated company has been in Forsyth County since 1986. “Forsyth has been a great place to grow, so we want to keep it going,” Harris said. “Our biggest challenges going into next year is, obviously space, and people – like everybody.”

JOHNS CREEK, Ga. — Hundreds gathered at Newtown Park Nov. 13 for the grand opening of The Wall That Heals, a half-scale replica of the Vietnam Veterans Memorial in Washington D.C. Saturday morning’s ceremonies, hosted by the Johns Creek Veterans Association and the City of Johns Creek, served to honor Vietnam War veterans and those who lost their lives in the war. After leading attendees in the Pledge of Allegiance, retired U.S. Army Sgt. Roger Wise spoke about the power of the memorial. “It’s a wall that heals or starts the healing process,” Wise said. “Every time I’m in Washington [D.C.], I go to the wall, and there’s always somebody kneeling down, talking to it, laughing, crying, healing.” Wise continued, sharing a story about his most recent visit to the wall in Johns Creek and how a young man whose father was killed in Vietnam before he was born finally felt as though he had met his father after seeing the memorial. “That’s the power of this wall,” Wise said. “That’s the power of this memorial walk.” Mayor Mike Bodker was the first to deliver official remarks, thanking veterans, the Veterans Association, the Recreation and Parks Department and all who contributed to bringing the wall to Johns Creek. “This is a project of honor, tribute and love which so many have worked on to bring to fruition,” Bodker said. “Today
is the day that we celebrate and honor service and hear from the residents and veterans who helped consecrate these grounds and memorial.” Bodker then awarded President of the JCVA, Lt. Col. Mike Mizell with a proclamation from the Fulton County Commission, honoring the dedication of the memorial. Mizell shared a brief history of the memorial, recounting its three-day visit in Johns Creek in 2017, before being permanently installed last year. Mizell then recited the poem, “A Soldier’s Honor,” which details the sacrifice made by those who serve. Mizell also spoke of the debt owed to those who risk their lives in the military. “We can never be grateful enough for the sacrifices that they’ve made, and we are humbled by their willingness to put their lives aside for the benefit of ours,” Mizell said. Finally, Mizell spoke directly to the veterans. “To my brothers and sisters, the Vietnam veterans, Vietnam-era veterans, to all veterans: welcome home. And welcome to your memorial park,” Mizell said. Georgia Military Veterans Hall of Fame inductee Capt. Tommy Clack, who was wounded May 29, 1969, along the Cambodian border, also delivered remarks. “I am blessed that but by the grace of God I know I would be listed on panel 23 west, line 13,” Clack said. He went on to speak about how Vietnam War veterans were treated after the

Residents speak against plan for housing development in Cumming Neighbors say rezoning has been kept a secret By TIFFANY MORGAN newsroom@appenmedia.com CUMMING, Ga. — Opponents of a proposed 176-unit housing development on Pilgrim Mill Road turned out Nov. 16 to tell Cumming City Council members they’d been kept in the dark. “We were never told about the annexation,” Rich Willits of Emerald Springs subdivision said. “This will absolutely adversely affect the property values in the area if this goes through.” Willits said the signs placed to announce the rezoning hearing were not visible to him or his neighbors in the subdivision and placed “inconspicuously” on purpose. In its letter of intent to the city, the developer, Southern General Development Corporation, said the 78-acre parcel had recently been annexed into the city and designated for low-density residential. Original plans called for constructing 205 residential units, varying from single-family detached to townhomes, on the property. The townhomes were later removed from the mix,

The application also includes open space areas designated for the development and amenities, such as a pool.
City Councilman Christopher Light said after listening to resident comments at the public hearing, the city’s process for rezoning needs to be adjusted to give residents better opportunities to respond. Council members will be looking for different ways in the future to make residents more aware on different rezoning projects. Light said any information about their rezoning projects and other public hearing items should be clearly stated. “My goal is to make sure that questions get answered before they come to us [during the public hearing],” Light said. Cumming Mayor Troy Brumbalow said as he oversaw the council come to a decision, it is important to note that they are looking for better methods to advertise rezoning items in the future. “I really appreciate all of the public participation,” Brumbalow said. “We can and will do better to get more community involvement on any rezonings.” Councilwoman Linda Ledbetter made a motion to deny the rezoning application, but that measure failed due to lack of a second. Instead, the council voted to postpone any action on the matter until the Dec. 7 work session.

Construction set to pick up at Southern Post project By CHAMIAN CRUZ chamian@appenmedia.com ROSWELL, Ga. — After sitting idle for four years, Southern Post in historic downtown Roswell, formerly known as the Southern Skillet, celebrated the groundbreaking and demolition of the existing building in March 2020 before dozens of residents, developers, elected officials and community stakeholders. Then the COVID-19 pandemic hit, delaying construction for months on end. Now, Armada Hoffler Properties Director of Marketing Chelsea Forrest said the mixed-use project is gearing up to continue with construction within the next few weeks. Armada Hoffler Properties is a Virginia-based real estate investment trust with four decades of experience developing, building, acquiring, and managing office, retail and multifamily properties primarily in the MidAtlantic and Southeastern United States. In October 2020, Armada Hoffler Properties announced it had reached an agreement with commercial real estate development firm S.J. Collins Enterprises and purchased their interest to fully control the development of the Southern Post. The 260,000-square-foot mixed-use project consists of 128 luxury apartment units, nine townhomes, 95,00 square feet of creative loft office space, 40,000 square feet of retail space and 600 parking spaces with a parking deck. If all remains on schedule this time around, it is expected to open in summer 2023. Armada Hoffler Properties recently announced new tenants Belux Coffee and Azotea Cantina are joining DaVinci Donuts, Silla Del Torro and Ponko Chicken. Belux Coffee was founded in 2015 in Cumming and delivers premium specialty coffee beans and manual brewing equipment. It has a coffee shop in Alpharetta. Meanwhile, Azotea Cantina is a Mexico-City inspired taqueria with an outpost in Atlantic Station. Overall, the project is meant to honor the City of Roswell’s historical charm and serve as a gathering spot for residents. The project’s architecture will incorporate elements that have been used throughout Roswell’s historic district with the addition of modern components,

Housing market predictions for 2022 Brought to you by – BILL RAWLINGS, Senior Vice President & Managing Broker, North Atlanta Office Atlanta Fine Homes Sotheby’s International Realty Somehow, the year is RAWLINGS almost behind us -- and so is 2021’s wild ride for housing. The 2021 housing market was a tough one for home shoppers. Low rates and increased flexibility from working remotely put many firsttime homebuyers on the map. But limited inventory, skyrocketing prices and fierce bidding wars made housing harder to come by. But things may soon level out to a more ‘normalized’ market. We could see competition start to taper off, and price growth begin to moderate. In short, 2022 should be a better market for buyers.
1. Foreclosures Will Climb Despite the financial struggles many have faced during the pandemic, foreclosures have been largely nonexistent during the past 18 months, thanks to a nationwide foreclosure ban. The moratorium expired in July, though, and foreclosure rates have already started to climb as a result. While actual volume is still well below historical norms, foreclosures will likely continue to creep up as the new year rolls around. 2. Home Price Increases Will Begin to Slow We are still in a seller’s market. Buyers shouldn’t anticipate being able to negotiate on the price of a home. Sellers have the upper hand and can expect short home listings and multiple, competitive bids. But it looks like the coming months will be easier for buyers than earlier this year. Although prices won’t fall, they will
almost certainly increase by less than they did during the market’s historic 2021 run. With less competition, buyers may have more flexibility to add contingencies to their offers. And they may find it slightly easier to get an offer accepted. 3. Mortgage Rates Will Increase COVID-19 brought historically low interest rates that made it cheaper to borrow money than ever before. Buyers knew that such a chance would likely never come again and raced to lock in loans. Those record-low rates, however, have already started inching up and continue to climb. According to Freddie Mac, the average rate for a 30-year fixed mortgage rose from 2.86 percent during mid-September to 3.10 percent by mid-November. 4. Inventory Should Improve One of the biggest hurdles this year has been tight inventory. Demand
for housing was there, but for-sale listings weren’t. But recent reports have shown an ongoing rise in available listings. While next year probably won’t mark a huge turnaround on the inventory front, buyers should see some relief. By most accounts, 2022’s housing market should be a little closer to normal than it was this year. While we likely won’t see a complete 180, investors and buyers should face fewer battles when purchasing a property. The housing market is not known for being simple to predict. That is why it pays to have a trusted professional in your corner. Rick White, who was deployed to Vietnam in 1967 at age 19, shared the personal numbers behind the statistics about the war. “During those Vietnam-era years, there were over nine million men and women serving in uniform worldwide,” White began. “On this wall there are a total of 58,317 names including eight women… They represent over 58,000 families and fellow warriors that grieve for them… the youngest here was 15… the oldest was 63.” On the memorial wall White said there are 40 sets of brothers and three sets of fathers and sons. There are 1,564 names of those lost from Georgia. “My friends and buddies that are here [on the wall] are numerous, and they include my medic who died in my arms,” White said. “There are many other young soldiers that were in my care and my responsibility that are on this wall. One of my best friends from Officer Candidate School and another, my OCS roommate are on this wall.” White said that more than 10% of his training school class’ names are on the wall because they deployed during the high casualties of the Tet Offensive. White then listed the names of 13 friends he lost in the war. “These 13 names are but a tiny fraction of the huge number on this wall, but by saying their names out loud, this
is my way of honoring them and serves as a representation for all those names that today will go unspoken,” White said. White shared the story of one of his lost friends and spoke of the sacrifice from each service man and woman. He then conveyed his thoughts about the power of the memorial wall. “This wall, this holy wall is truly the wall that heals,” White said. “It, and the Vietnam Veterans Memorial Wall in Washington… provide for me and I hope for all Vietnam vets and the loved ones of those that have fallen, an almost inspirational, soothing salve as we reverently approach its shining black surface and touch the names of those that have served and that we have loved.” White continued. “Each time I see this wall, I feel the presence of the men under my charge that I had lost in Vietnam, and I feel an almost quiet sense of calm and release,” White said. “It says my fallen brothers are telling me that they are at peace and rest, and they know that their platoon leader and their company commander, their friend, their brother, their fellow warrior did his best to protect him. And someday, we will all rendezvous on that final heavenly objective.” The ceremony’s special guest speaker was Jim Knotts, CEO of the Vietnam Veterans Memorial Fund. Knotts is an Air Force veteran of the Persian Gulf War. Knotts’ recounted the stories of several men and women listed on the memorial wall, introducing them to the guests. “These are all people who now, are a permanent part of your community,” Knotts said. To conclude the dedication ceremony, veterans built the soldier’s cross, and a Marine Corp Honor Guard performed a 21-gun salute. The Honor Guard’s bugler also performed “Taps.” Finally, Mizell and Bodker shared the ceremonial scissors and officially cut the ribbon on the memorial. State revives trout hatchery with modern equipment

Here’s some great news for Georgia’s trout fishing community! Long-anticipated renovations have been completed at the Burton Trout Hatchery, located in Rabun County on Moccasin Creek next to Lake Burton, and the hatchery is open
once again. This hatchery, located approximately 20 miles north of Clarkesville on Ga. 197, is one of three stateoperated hatcheries which supply trout to Georgia’s public waters. It was constructed in the late 1930s and renovated in the late 1970s. In recent years, it has produced about 300,000 trout (rainbows and browns) annually, accounting for roughly a third of the trout stocked in Georgia’s streams, making it an important contributor to the state’s overall trout fishing program. But time takes a toll on everything, including trout hatcheries, and it had become clear that this one needed some work. Its concrete raceways were
deteriorating. Its offices were old and, in the words of Georgia DNR, “dilapidated.” It needed better storage space for equipment as well as climate-controlled storage for trout food. The hatchery also needed a better way to deal with drought. In the past, periods of severe drought meant that the hatchery’s fish had to be moved to some other facility or, in extreme cases, stocked before they were ready to go into the wild. The recent renovations at the hatchery gave the facility the proverbial new lease on life. “We are so excited to get this renovated facility open so we can get back to the business of raising quality trout to better serve the angling public,” noted John Lee Thomson, Georgia DNR’s trout program coordinator. Early in the design process, Thomson and other Georgia fisheries personnel visited five hatcheries in Wyoming to learn how that state was able to raise trout under relatively dry conditions. “They raise a lot of trout production,” he says, “but they don’t have a lot of water.” One key, the team learned, was the use of round trout rearing tanks
instead of the more familiar linear raceways. The circular tanks use significantly less water than do more traditional linear raceways, greatly reducing the impact of drought, and an added plus is that water leaving the tanks is cleaner and can be used in other parts of the hatchery. The renovated Burton hatchery is making good use of this round-tank approach to rearing trout. The site now includes eight 16-foot-diameter trout rearing tanks which are housed in a new trout production building. Almost all of the water flowing from the new round tanks is cleaned and reused in downstream raceways to further enhance the hatchery’s ability to deal with drought conditions. A state-of-the-art oxygen injection system is now in operation too. This system ensures that there is plenty of oxygen in the water, further enhancing the site’s trout-rearing capabilities. Together, Thomson said, those improvements “allow us to raise a lot more fish with a lot less water.” The new facility also features a climate-controlled feed storage building and a new dam and water intake structure on Moccasin Creek, the source of the water which flows into
the hatchery. Other improvements include a new office building, a new warehouse, and a new on-site residence, plus new paving in the parking area and a new boat ramp. County commissioners say they want to step up efforts to alert residents what the city is doing and that, based on past experience, annexed property may become the site of highdensity development in the future. County Commission Chairwoman Cindy Jones Mills said that when the Pilgrim Mill annexation was proposed back in 2019, the city said nothing would change to the property’s use, which at the time was zoned for lowdensity single-family residential. “I feel like these taxpayers are not being represented,” Mills said. Willits told Cumming council members at the Nov. 16 meeting that no one in his neighborhood knew about the annexation two years ago, and they were hard pressed to find out about the rezoning application. Willits told county commissioners Nov. 23 that signage about the rezoning, a legal requirement, had been placed off the main roadway. He said there was little he could do about it now, but other county landowners need to be warned.
County officials said that while the Pilgrim Mill property was beyond their control, they would intensify efforts to notify other property owners about Cumming’s future efforts to annex land. “The best we can hope to do is inform our residents,” County Commissioner Alfred John said. Commissioner Todd Levent said the city’s actions over the past two years of absorbing county-controlled land, then changing its use to allow for highdensity development is an insult to the thousands of residents who participated in drawing up the Forsyth County Comprehensive Land Use Plan.
