Our reliance on safe infrastructure cannot be underestimated.

From the tragic bridge collapse in Baltimore, Maryland, to the devastation caused by Hurricane Helene in the Southeast, we have seen stark reminders of the importance of engineering in the past year – as well as the need to modernize and maintain our infrastructure. Not a day goes by where our lives are not impacted by the advancement in engineering – whether it be civil, electrical, mechanical, aerospace, structural or environmental. And that’s why the work of ACEC New York is so important.

From Albany to New York City, this organization is laser-focused on creating a productive environment where our member firms and thousands of their employees can thrive – both professionally and personally – and together, we can improve the way millions of New Yorkers live, work and build. We are dedicated to solving workforce issues by driving change through elected officials, government agencies and industry partners to create additional pathways for a new generation

of engineers who can continue the work ahead – and enhance the built environment around us.

ACEC New York has achieved tremendous success in the past year to bring members together, engage with our elected leaders and government partners and present the reasons why our work is directly tied to economic growth, job creation and a productive society. Led by John T. Evers, ACEC New York is one of the state’s leading industry associations, and it is an honor to serve as the organization’s Chair of the Board of Directors.

From supporting the implementation of congestion pricing to highlighting the need for a stronger workforce, ACEC New York has championed engineers of every discipline, and I am confident the stage is set for greater success in the year ahead.

PRESIDENT AND CEO

Engineering plays an integral role in all aspects of our daily lives – from safe water systems to sound building construction – and the members of ACEC New York represent some of the world’s largest and most prolific firms that have enhanced the quality of life for millions of New Yorkers.

Our mission is to support the engineering community by highlighting the importance of their critical work, facilitating relationships with all levels of government and making it easier to conduct business with public and private stakeholders. For more than a century, ACEC New York has served to protect the interests of New York State’s engineers, and this past year was no exception. From upstate to downstate, we hosted 39 events and conferences, strengthening connections with key regulators while sharing new ideas and innovations that are moving our industry forward. We distributed more than $106,000 in college scholarships and have met with state leaders to discuss new ways to increase the number of students pursuing careers in engineering.

With the launch of New York City’s congestion pricing program – thanks to our support – the Metropolitan Transportation Authority (MTA) will be

in a better position to fund its capital plan, leading to new opportunities for infrastructure improvements systemwide. With an aging transportation network, our member firms have advocated for significant upgrades that will ensure the safety, sustainability and efficiency of the entire system.

In the year ahead, we plan to work more closely with ACEC National to secure additional federal funding and incentives while engaging with local leaders on proposed legislation designed to streamline the construction process. It is an election year in New York City, and we will be monitoring the campaigns closely and providing updates as necessary.

INTRODUCTION

The role of the engineer is one of the most important functions in our society. Engineers play a critical role in maintaining, monitoring and upgrading our infrastructure so we can live, work and travel in a safe manner – every minute, every hour and every day. That’s why funding for major infrastructure projects was one of the ACEC New York’s top priorities in Fiscal Year 2025, and thanks to thecommitment of our staff and our members, our voice is being heard in cities and communities across the state.

Funding and improving infrastructure not only make New Yorkers safer and more productive,but it is the most direct way to improve the economy. That’s why we support robust investment across all sectors including transportation, energy and the environment. This will create jobs, reinforce New York’s standing as the Empire State and global center of trade and finance and improve the economic well-being of all New Yorkers.

We supported the proposed 2025-29 MTA $68.4 billion capital plan and NYSDOT $32.8 billion capital plan. In preparation for the 2025 budget session, ACEC New York joined with other likeminded construction, business and municipal organizations to call for an increase of $800 million for NYSDOT “core” projects to prevent a significant erosion of the capital program because of inflation and material cost escalation.

Thank you to all of our government partners and elected officials who answered our calls, took the time to meet with us in person and understand why we are fighting so hard for the safety of our infrastructure – and the safety of our state.

SUPPORTING OUR ENGINEERS

ACEC New York serves as the unified voice of New York’s consultant engineering community, and that role is critical to ensuring the work of our members is recognized and respected by elected officials, government partners and community leaders.

That’s why our organization is focused on bringing several issues to the forefront of conversations with our government leaders – so they can understand the importance of sound engineering and the need to modernize our infrastructure. Over the past year, we have submitted testimony on a number of important topics, coordinated individual PAC

contributions and authored several New York State legislative memos supporting our positions.

In 2024, our team focused on the implementation of the congestion pricing program, which was designed to support the Metropolitan Transportation Authority’s long-term capital program over the next several years. Our members believe in congestion pricing because we know it was developed and researched with input from leading traffic engineering experts. The impetus for the current program was the Move NY plan propose by our member Sam Schwartz which called for a fresh look

at the congestion pricing concept.ACEC New York was the very first organization to endorse the much-needed program, and we trust it will address a myriad of important issues facing the City’s highly populated, high traffic, geographically constricted business and residential areas.

Despite a temporary pause, the program was fully implemented thanks to the diligent work of our members, business partners and fellow advocates –proving the power of our advocacy work. Congestion pricing is reducing the number of vehicles in

Manhattan and improving air quality while providing a dedicated revenue stream for the MTA. With upgrades of its aging network of subways, buses and railroads, this much-needed plan will bolster the system’s reliability, accessibility and efficiency for generations to come – leading to greater private-sector investments, now and in the future.

OUR NEW YORK STATE LEGISLATIVE PRIORITIES INCLUDE:

INDEMNIFICATION. S.4591(COONEY)A.7379 (VANEL)

This bill seeks to eliminate broad-form indemnity and duty to defend clauses in contracts for public works. Amendments have been made to address concerns raised in the veto message (2018) and to clarify the scope and intent of the bill. Our position remains the same: Contracts for public works should not include uninsurable provisions requiring indemnification and defense for claims and damages outside a design professional’s own negligence.

QUALIFICATIONS-BASED SELECTION (QBS) EXPANSION. S.4577(COMRIE)/A.5520 (HYNDMAN)

This legislation requires public authorities to procure engineering and professional design services on a qualification’s basis.

Repeated studies show that design services procured through QBS lead to lower public contracting costs across the board.

GEOLOGY CLARIFICATION. S.620(STAVISKY)/ A.2571(MCDONALD)

Remedies an unintended consequence of the 2014 licensure of professional geologists. This bill would allow grandfathered engineering firms to obtain a certificate of authorization for Professional Geology if at least one Professional Geologist serves as an officer or director on their board.

“ENGINEERS” EMERGENCY RESPONDER ACT. A.4680(EACHUS)

Enacts the New York emergency responder act limiting the liability of A/E/C professionals providing emergency services during a declared State emergency.

Similar to the case of indemnification, this bill would limit liability to actions of negligence or misconduct during emergency responses.

STATUTE OF REPOSE.

S.2146(COONEY)/A.4907(PRETLOW)

Establishes a limitations period of 10 years post-project completion for third party tort claims involving wrongful death, personal injury and property damage actions.

OUR NEW YORK CITY LEGISLATIVE

PRIORITIES INCLUDE:

CONTRACT AND CHANGE ORDER REGISTRATION. Adopt best practices to accomplish contract registration within 90 days. Expedite change order registration to be completed with 60 days.Pilot use of Contingency Fund for design contracts.

PRIORITIZE PASSPORT. Fully implement the PASSPort digital procurement platform, including necessary funding to improve contracting process transparency and to pay vendors efficiently.

MWBE. Address barriers to participation on city projects and set project-specific goals based on actual available licensed professionals. Foster relationships to broaden the universe of participating consultants.

ALTERNATIVE PROJECT DELIVERY METHODS

Improve procurement models to include Progressive Design-Build and use best practices.

FEDERAL FUNDING. Maintain infrastructure spending as a critical component of public safety and for a sustainable, equitable future. Ensure robust implementation of Ballot Proposition 5, which amended the City Charter to require more detail in the annual needs assessment of City facilities to inform capital planning.

RECRUITMENT AND RETENTION OF STAFF. Adjust City policies that interfere with the recruitment and retention of qualified personnel in the public and private sectors needed to deliver the City’s infrastructure projects.

BUILDING CODES. Assess and promptly adopt innovative and technically sound best practices from around the country and the world, especially for emerging energy technologies.

SUSTAINABILITY AND RESILIENCY. Ensure that New York remains a leader of sustainable and resilient design practices and requirements using the best available science and engineering.

Government Affairs veteran Mike Burridge joined us in late 2024 as our New York State Director of Government Relations, and his positive impact is already being felt across our organization.

With more than 17 years of political experience, Mike has been working closely with our committee chairs, attending state and regional meetings and focusing on driving the priorities of our 2025 legislative program through his lobbying efforts in Albany and Washington, DC. Prior to ACEC New York, Mike served as the Director of Government Affairs for the American Institute of Architects (AIA) New York State for more than a decade, as well as the New York State Assembly. FALL CONFERENCE

Hundreds of the state’s top engineering professionals and thought leaders met to discuss the latest trends and challenges facing the industry at the 2024 Fall Conference.

Held at The Otesaga Resort Hotel in Cooperstown, members participated in the organization’s first DWMBE showcase, toured the National Baseball Hall of Fame and attended keynote addresses from Ken Meifert, Vice President of Sponsorship and Development of the National Baseball Hall of Fame and Museum and Dr. Don Levy of the Siena College Research Institute.

At the three-day event, members heard from the one of the state’s leading authorities on infrastructure development including New York State Department of Transportation Commissioner Marie Therese Dominguez, New York State Office of General Services Commissioner Jeanette Moy, New York State Dormitory Authority President and CEO Robert Rodriguez and Port Authority of New York and New Jersey Deputy Chief Engineer Amanda Rogers, PE, CCM, LEED AP.

Empire State Development’s Executive Vice President of the Division of Minority & Women’s Business Development Jason Myles Clark also delivered a keynote address on creating new opportunities with Disadvantaged Minority and Women-Owned businesses throughout the state.

2025 WINTER CONFERENCE

The Winter Conference is the premier business event of the ACEC New York educational and networking calendar.

More than 500 engineering professionals and exhibitors attended this conference at the Albany Capital Center, which featured presentations from state agencies – including the Port Authority of New York and New Jersey, the MTA, Office of General Services, the Dormitory Authority and others –concurrent tracks for CFOs/business managers, as well as up-and-coming engineering professionals (“Emerging Leaders”) and HR professionals.

Members were able to attend stakeholder meetings related to our legislative agenda, design-build and media relations. In addition, the Infrastructure Policy Networking Reception featured key legislators, leaders from other state industry associations, and we were proud to honor state Senator Leroy Comrie as Legislator of the Year thanks to his continued support of our industry.

BAYONNE BRIDGE. PRESENTER: ROGER HAIGHT, PE, SENIOR VICE PRESIDENT | WSP USA.

The longest steel truss arch span in the world when it opened in 1931, the Bayonne Bridge was designed by Othmar Ammann. In order to maintain the economic vitality of the ports, the original 150-ft navigational clearance needed to be raised to 215 ft for mega container ships passing through the widened Panama Canal. The bridge roadway was raised while maintaining vehicular as well as shipping traffic. Senior Project Manager, Gannett Fleming.

MTA PARK AVE VIADUCT. PRESENTERS: FIROOZ PANAH, PE, DBIA, VICE PRESIDENT ENGINEERING AND EBAD HONARVAR, PE, PHD, PROJECT ENGINEER, AECOM.

This presentation focused on the design aspects of the replacement of Park Avenue Viaduct during weekends, and the challenges the design and construction team had to overcome to deliver the project.

ENGINEERING ETHICS IN NEW YORK.

PRESENTER: DOUG HALSTROM, PARTNER | L’ABBATE, BALKAN, COLAVITA & CONTINI.

This presentation explored the NYS governmental entities responsible for addressing ethical complaints, as well as a variety of ethical issues facing engineers.

GATEWAY HUDSON TUNNEL PROJECT.

PRESENTERS: TIM GIANFRANCESO, PE, VICE PRESIDENT AND MICHAEL TRABOLD, PE, VICE PRESIDENT & SENIOR PROJECT MANAGER AECOM, AND PIYUSH PATEL, PE, DEPUTY CHIEF TECHNICAL OFFICER, GATEWAY DEVELOPMENT COMMISSION FOR THE HUDSON TUNNEL PROJECT.

The Gateway Hudson Tunnel Project (HTP) will provide two new tracks under the Hudson River into Penn Station and transform both commuter and intercity rail service along the Northeast East Corridor (NEC) and in the region.

NAVIGATING THE MEDIA LANDSCAPE: A GUIDE TO DELIVERING YOUR MESSAGE.

This presentation focused on strategies and tactics to elevate a firm’s public profile through story development, media engagement and digital presence, followed by a panel discussion with media experts discussing the state of media in today’s society.

ARTIFICIAL INTELLIGENCE AND ADVANCED COMPUTING SOLUTIONS FOR THE FUTURE OF TRANSPORTATION: VISION AND CHALLENGES. PRESENTERS: DR. RUIMIN KE, ASSISTANT PROFESSOR AND DR. JACK REILLY, PROFESSOR OF PRACTICE, RENSSELAER POLYTECHNIC INSTITUTE.

This presentation explored the impact of artificial intelligence and how advanced computing are transforming transportation through applications such as autonomous vehicles, advanced traffic management and advanced traveler information systems. Enhanced efficiency and safety can result, but ethical concerns and data privacy risks were some challenges posed.

REHABILITATING FOR RESILIENCY IN THE FACE OF MAJOR STORM EVENTS, PRESENTERS ALVARO BUENDIA, PE, SECTOR MANAGER, NEW YORK RAIL + TRANSIT AND KYLE FREDERICK, PE, CONSTRUCTION MANAGER, TYLIN.

In 2012, the 207th Street Yard in Manhattan, which houses critical infrastructure for the A & C subway lines, was significantly damaged by Superstorm Sandy. TYLin is working closely with MTA’s New York City Transit department to rehabilitate and create resiliency for the facility and its neighboring tunnels. This presentation explored the lessons learned and solutions developed to successfully complete this project.

HONORING PROFESSIONAL EXCELLENCE

More than 670 consulting engineers and clients attended the American Council of Engineering Companies of New York’s (ACEC New York) 58th annual Engineering Excellence Awards Gala at the New York Hilton Midtown.

Awards were presented to 110 projects in the following categories: studies, research, and consulting services; building/technology systems; structural systems; surveying and mapping technology; environmental; waste and storm water; water resources; transportation; energy; industrial and manufacturing processes and facilities; and special projects. Each year, ACEC New York recognizes exemplary individuals for their leadership, commitment, innovation and service to the consulting engineering industry and the greater New York community.

The awardees are selected for their achievements and support in furthering the council’s mission, their active participation at the city, state and national levels of the organization and their civic and humanitarian contributions. Note: awardees are NOT limited by region - any firm can submit a nomination.

ACEC New York recognizes member companies for significant milestones of service – 50, 75, 100, 125 and 150 years, etc. These companies have been able to provide outstanding, long-term engineering services that benefit the profession and the community.

CAPITAL REGION CANSTRUCTION AWARD

ACEC NEW YORK WINS HUNGER HERO AWARD FOR MOST FOOD DONATED

On Tuesday, May 6, 2025, ACEC New York Communications Manager Jen Waterbury attended the Capital Region CANstruction exhibit opening and awards in Albany, where President & CEO John Evers had earlier served as a judge. That evening, ACEC New York was honored with the Hunger Hero Award for donating the most food by a participating team.

Each year, ACEC New York forms a Hunger Hero team to sponsor a CANstruction sculpture at our Winter Conference. The 2025 sculpture resulted in a donation of 2,796 pounds of food to The Food Pantries for the Capital District. We extend our sincere thanks to Jill Shorter—President of Capital Region CANstruction, Senior Associate and Marketing Director at Ryan Biggs | Clark Davis, and Chair of the ACEC New York PR Committee—for her outstanding leadership and commitment to addressing food insecurity in the Capital Region.

2025 EMPIRE AWARD

The Empire Award honors the top-ranked project in the Engineering Excellence Awards Program that was designed and built in New York State.

COMPLICATED EXCAVATIONS AT ONE OF THE WORLD’S BUSIEST INTERSECTIONS

TSX Broadway is located within one of the busiest intersections of Times Square in New York City, which is commonly referred to as “The Crossroads of the World.” The goal of the TSX Broadway project was to replace most of an outdated hotel with a state-of-the-art hotel and to build a retail mall under an existing landmarked theater.

The entrant developed unique and complex support-of-excavation and foundation support designs for the following conditions:

• Temporarily supporting city streets, existing building vault spaces surrounding the site and an adjacent subway tunnel.

• Supporting a 17-foot-deep excavation extending below the foundations of a 17-story adjacent building.

• Using "Support-of Excavation" caissons to "brace" the rock below the hotel's super-column footings.

• Using drilled high-capacity-caisson foundation elements to support the new hotel super columns.

• Analyzing and designing the maximum-allowed unbraced length for both the temporary and permanent caissons for various loads.

These design schemes allowed for simultaneously excavating rock for an additional below grade level for retail space, while supporting and demolishing a hotel building and lifting a landmark theater 31 feet.

CONCEPTOR AWARD

The “Grand Conceptor” Award signifies the year’s most outstanding engineering achievement. All projects considered by the national competition must first be entered through one of ACEC’s 51 state and metropolitan Member Organizations.

SEVERUD ASSOCIATES CONSULTING ENGINEERS FOR SPHERE

Sphere, a 516-ft-diameter semi-spherical building rising 366 ft above ground, is a fully immersive entertainment venue located in Las Vegas seating 17,600 guests beneath a domed roof and media plane. It is the largest spherical structure in the world.

ACEC NEW YORK PAST CHAIR HONORED FOR ACEC NATIONAL EEA SERVICE

Andrew (Andy) Ciancia, PE, LEED AP, Senior Consultant at Langan Engineering, Environmental, Surveying, Landscape Architecture and Geology and past Chair of ACEC New York, was honored at ACEC National's Engineering Excellence Awards gala on May 20, 2025, for his service to the awards committee.

Andy has served as Chair of the EEA National Committee for 18 years. His leadership and commitment have been instrumental in shaping and expanding the EEA program into what it is today. ACEC New York congratulates Andy on this honor and thanks him for his dedication to celebrating excellence in engineering.

ENGINEERING THE FUTURE

To promote the profession to the next generation, award outstanding engineering students and help New York retain promising young talent, ACEC New York administers a very successful statewide scholarship program.

Since the program’s inception in 2002, the council has awarded more than $1.4 million collectively to more than 460 high-achieving engineering students attending New York State colleges and universities. In 2025, we are distributing scholarships to 34 students across New York State – providing critical educational support that better ensures they will pursue an engineering career.

ACEC New York also extends our scholarship program to second-year community college students, in addition to our long tradition of supporting the future of the profession with cholarships awarded to third- and fourth-year engineering students.

A committee created to support public outreach activities, highlight the work of ACEC New York and its member firms and communicate the goals and policies established by ACEC New York. With the growing need for infrastructure improvements statewide, this committee is focused on highlighting areas where funding should be directed in order to safeguard our communities and better protect New Yorkers.

WORKFORCE DEVELOPMENT

A committee focused on developing critical systems and strategies to attract the industry’s future workforce to the field of engineering.

Through public outreach and advocacy efforts, members are exploring ways to retain and advance current talent and address public policy issues that impact hiring and recruitment.

SUPPORTING THE NEXT GENERATION

In 2024, NBC New York aired a segment on ACEC New York’s annual scholarship program designed to encourage New York’s college students to pursue careers in engineering.

Reporter Gus Rosendale interviewed then-Chair Arthur J. Alzamora, Jr., PE, LEED AP, about the nationwide shortage of engineers and ACEC New York’s efforts to reverse that trend.

UPGRADING OUR TRANSPORTATION NETWORK

In 2025, City and State New York published an op-ed by John T. Evers about the need to increase the budget for the state Department of Transportation in order to improve the deteriorating conditions of roads and bridges statewide.

“Without any significant, long-term investment, New York’s above-ground transportation network will soon reach a crisis level, impacting local economies, job creation and the quality of life in communities statewide,” John wrote.

An additional $800 million was eventually included in Governor Kathy Hochul’s Executive Budget, allowing such key projects to move forward.

THE YEAR AHEAD

The coming year is a pivotal moment for New York’s engineering community.

We will be able to fully evaluate the positive impact of congestion pricing while identifying critical infrastructure projects that need to begin in order to enhance our transportation systems and better safeguard residents across the Empire State. With additional funds now dedicated to our infrastructure, our member firms will be working closely with our government partners to design and develop new projects – from repairs of our deteriorating roads and bridges to upgrading our aging subway tunnels.

Following our participation at the ACEC 2025 Annual Convention in Washington, D.C. in May, we will be

monitoring the upcoming elections statewide while working with our colleagues at the federal level to ensure our voice continues to be heard.

As populations continue to increase and our cities evolve and expand, the work of the engineer has never been more important. It is imperative that our members have a seat at the table as leaders in business and government strive to enhance our quality of life with new policies, new technology and new cutting-edge equipment. And that’s why ACEC New York is essential – because our mission is to shine a light on the mission of our members.
