aving been a member since 1989, ABC Keystone has time and again demonstrated that our dues are not just an overhead charge, but an investment in the construction industry. Over the years, I have spent hours at ABC Keystone education events, monthly meetings and political events. ABC has always looked to educating its members not only on construction topics, but also other skills such as management and HR training and has kept us abreast of political activities that impact our businesses.

Nothing is better than hearing from our members. Our president, David Sload, received an email from one member talking about the benefits their ABC membership over the past couple of years during the COVID and supply chain issues. He also mentioned ABC’s fight against government overreach with COVID mandates and appreciated ABC fighting for contractors. Your ABC membership comes with things you may not know you receive. A core value has been and continues to be “We are passionate about free enterprise advocacy, workforce education and training and business-to business connections, career pathway development and instilling a safety culture – in all sectors of the construction industry.” Our values, mission and vision are listed on our website. This core value is seen in the issues the staff and volunteers have worked on in the past several months. The staff have made great strides on expanding pre-apprenticeship programs with schools and other partners. The staff and volunteers have worked on Re-entry issues with different workforce development boards to help understand the barriers that need to be addressed. They continue to educate legislators on issues that are important to the construction industry and what needs to done to move those issues forward. And when the government tries to overreach, they protect our rights by challenging those rules in court. But they also work with different departments and agencies to understand and clarify the rules and regulations to make sure our members are compliant. It is a delicate balancing act to identify and fight the battles where we have a chance of making a difference and finding where we need to work with the regulations and help our members understand those regulations. We have received some pushback from members saying we did not go hard enough after COVID regulations and we should sue the

Celebrating Within Our Industry

ctober is Nationally designated as “Careers in Construction Month.” Keystone traditionally highlights what we do for the industry and our members through all our marketing efforts. Therefore, I want to recap some of the exciting things that happened as well as the number of members that took advantage of the things we offer. By the time October arrives, we are full gear into the start of our apprenticeship year. So far for the 20222023 school year we have 392 students in seven trades. That number will grow as we have yet to begin Heavy Equipment and our new Assembler, Pre-Engineered Metal Building programs. These classes begin later than the others. Once these two programs kick off, we will be training over 400 apprentices. As part of our workforce development efforts, we hosted our annual fall “Construction Wars” program. This year we hosted 220 middle school students from 23 schools. Will any of these young people be future apprentices? While we don’t know, if we don’t expose them to the trade, they may never come our way. Over the last 4 ½ years we have hosted over 1600 middle schoolers. We hosted our annual construction craft competition to determine who from Keystone would represent us at the National ABC convention in March 2023. Twelve of the top students from three trades competed and I believe Keystone will have a great team representing us in March.

The winners were: Plumbing: Richard Barnhart, Frey Lutz Corp. Carpentry: Matthew Flores, Benchmark Construction Company, Inc. Electrical: Evan Williams, Haller Enterprises Additionally, to celebrate the trades and the fine work our journeypersons perform, we held our first team competition. The winner of that competition was Benchmark Construction. They also will be going to the National convention to compete against other teams from around the country. Of course, in addition to getting young people into the industry and getting them started on a career path, continue to educate and upskill them. Keystone saw 249 members participate in Education and Safety classes. Our members worked hard this month, but they also had some fun and networking, as 419 members participated in our clay shoots and tailgate party. Fun was had and a lot of great networking occurred. October, a great month at Keystone to celebrate our industry. Over 1,300 people engaged with us and their fellow industry colleagues. This is your industry, and you have much to celebrate and be proud of.

Apprenticeship Update

Craft Competiton, Careers in Construction, National Apprenticeship Week

all is always a busy time at ABC Keystone with the start of Apprenticeship classes in September, the annual Local Craft Competition, Careers in Construction Month in October and National Apprenticeship Week in November. The 2022-23 Apprenticeship year began September 7th with new Apprentice Orientation. More than 150 new apprentices and company reps attended the event, starting their education and the requirements of registered apprenticeship. The 2022-2023 Apprenticeship Trust budget was based on enrolling 392 apprentices and we’re happy to report that goal was met, and 394 apprentices are attending classes at Keystone. We applaud and recognize each of these apprentices for their commitment and dedication to their chosen trade. October was Careers in Construction Month and Keystone ABC held many events and gave presentations to increase our partnerships and the public’s awareness of the many construction career opportunities. Cindy DeWire and Amber Schnader, Warfel Construction Co., presented pre-apprenticeship and co-op opportunities to teachers and schools in State College at the statewide PCEA Conference. Garden Spot High School brought 19 co-op students to the Keystone facility to tour the building and learn about registered apprenticeship. We appreciate these opportunities and are always looking to work with other schools and industry professionals to continue to make all individuals aware of the vast construction career paths. The 8th Annual National Apprenticeship week will be observed the week of November 14th. During this week, ABC staff will be recognizing our apprentices and providing baked treats for them as a small token

of appreciation for being in our program and making their education and priority in their career path. “I personally thank each apprentice for their commitment and having the opportunity to meet and work with each of them,” said Cindy DeWire, Director of Apprenticeship. Advocacy Update Being Thankful By: David G. Greineder, IOM ABC Pennsylvania Director of Government Affairs

s you know, ABC Pennsylvania is comprised of four regional chapters with nearly 1,400 member companies who collectively employ over 65,000 Pennsylvanians. Our advocacy efforts do not come without the commitment and participation of our members – and we have a lot to be proud of in 2022. Thank you for your dedication and support to this association. As we look back at our work this past year, I wanted to preview a few of our accomplishments so we don’t lose sight of what we accomplished. We had an active year providing detailed input on legislative proposals, collaborating with coalition partners on various bills, and holding successful events. Our notable accomplishments include: • ABC Eastern Pennsylvania successfully tabled local ordinances in Allentown and Abington Township that would have cut out contractors from public work bids; • ABC Eastern Pennsylvania successfully challenged the City of Philadelphia in stringent new interpretations of apprenticeship standards that would have stripped licenses of registered apprentices; • ABC PA successfully defeated a bill that would have required contractors to register with the state in order to conduct business; • ABC PA successfully blocked a bill that would have required contractors to be listed on building permits under the direction of the building code official; • ABC PA successfully stalled a bill that would have added additional requirements to contractors under the E-Verify law; • ABC PA testified before the House Labor & Industry Committee on apprenticeship rules;

Advocacy Update • ABC PA chapters hosted roundtables with Republican and Democratic members of the House Labor & Industry Committee on apprenticeship ratios; • ABC PA held a successful Legislative Summit, where all chapters provided input on a strategic plan for 2023-24; • ABC PA provided information to ABC members on candidates running for state and federal office; • ABC PA board members submitted and published letters to the editor on energy policies; • ABC PA co-signed coalition letters on energy policies; • ABC PA commented on regulations that would impact the commercial construction industry; • ABC PA successfully engaged chapters and put together robust strategic plans.

As we approach 2023, do not get totally distracted by the election. ABC has a future and a purpose no matter who wins and who loses. By the time you read this article, we should know who the next U.S. Senator and governor will be. We will also know which political party controls the General Assembly, and who won over 50 open seats. Next year, ABC PA will be focused on meeting these new elected officials and educating them on who we are and what we do. It will certainly be a wild and interesting new year. Buckle up!

Non-compete Agreements M

any industries use non-competition agreements, also known as non-compete agreements, as a means to protect company information from a departing employee. In fact, some of you reading this may be subject to one. A non-compete agreement is a contractual restriction on an employee’s ability to compete with a former employer. The benefits of a properly drafted non-compete agreement are obvious: to protect the company from a key employee taking sensitive company information to a competitor or using that information to start his or her own competing company. However, under Pennsylvania law, overly broad non-competes are often considered unenforceable, so they need to be narrowly tailored to protect the legitimate business interests of an employer. While the concept of non-compete agreements is fairly straightforward, drafting an enforceable agreement that adequately protects your company can be challenging. The first step to drafting an enforceable non-compete agreement is to identify which employees should be subject to the restriction. As a general rule, non-compete agreements should not be used for all employees. Instead, employers should identify key personnel in the company that have regular and consistent access to trade secret or confidential company information or those people within the organization that have unique or special skills specific to the business. Once the key personnel are identified, the non-compete terms should be well thought out. In Pennsylvania, non-compete agreements must be reasonable in both duration and geography. This can mean that the terms will differ between key personnel. For example, a CEO may be prohibited from competing with a former employer

for a period of 2 years within 200 miles of company headquarters. That same duration and geographic scope may be unreasonable for a project manager who works solely in the Central Pennsylvania market. The scope of the agreement should also be limited to the type of business the employer engages in or is reasonably expected to engage in. A sales representative for a specialty trade subcontractor should not be contractually prohibited from accepting a sales position in a completely different industry. It is also important to clearly identify when and under what circumstances the non-compete is triggered and explain how the employer is to be compensated for the employee’s breach of the agreement. Traditionally, non-compete agreements are included in an employment contract that is reviewed and signed upon acceptance of employment. However, circumstances arise where, at the time of hiring, it is unclear how valuable that employee will become to the organization. In Pennsylvania, non-compete agreements entered into after the employment relationship has already begun are permissible, but only if offered in conjunction with a promotion, raise, bonus, etc. Unlike other jurisdictions, the promise of continued employment in exchange for an employee’s acceptance of a non-compete agreement will render the non-compete unenforceable. When considering whether non-competition agreements can help your company, remember that one size does not fit all. Unfortunately, many companies resort to the use of online templates for cost saving reasons. However, a poorly drafted non-competition agreement is at risk of being unenforceable, leaving your company unprotected from the departing employee.

Spotlight Meet Joe! Tell us about the role you play in your organization:

As an Account Manager for Graphtech, I am responsible for guiding our clients so they can spread their messages to their audiences both creatively and effectively. Introducing new products and ideas to customers to help them achieve their goals and streamline their communications also plays an important role in my day-to-day. Educating new and existing customers on how our services can benefit them both professionally and financially is something I incorporate into my everyday routine.

Why do you wake up and go to work every day?

We have such a great, responsible team that cares about the wants and needs of our customers. Going above and beyond to meet deadlines and exceed expectations are just a few of the reasons that keep us successful. Meeting new people daily and exploring new opportunities for different projects certainly keeps me engaged.

How has your involvement in ABC Keystone provided you value in your professional life?

Learning more about the industry has helped with talking points when meeting with clients. Understanding more of the struggles and processes within the industry has also been a benefit when working with clients on their needs. The networking events have also always been great and conversations had both at events and within committee meetings have been impactful.

Which hobbies do you enjoy?

I love to be outdoors. Camping and fishing are what I love to do most. Local trout streams or getting on the Susquehanna River is where I try to be when I have some spare time. I also try to get to as many live events I can, whether that’s games or concerts. Trying new and local restaurants and breweries are a hobby of mine as well.
