A Message from the Chair
W
e are now in the month of November, and my mind is drawn to our traditional Thanksgiving holiday and the customs that surround this annual occasion. We all have memories of learning the history of the early Pilgrims and the indigenous people that lived here before the Pilgrims arrived. The history of America's beginnings can bring a variety of opinions regarding how the history should be presented, but we can all agree we are thankful that history created early America, and we can be thankful for ABC.
are also extremely thankful for our Apprenticeship-sponsoring member companies who send and encourage these students with the needed professional and financial support to make the education possible. It is very fulfilling to see the ABC vision of a successful training program being realized right here in Central Pennsylvania. This is the “It” factor at work– let the appreciation roll! In November, we can also be thankful for our right to vote. This upcoming election season gives us the opportunity to alter the direction of school boards and local governments – a critical piece of the grassroots efforts to make significant and effective changes for good. Sadly, many voters sit out the ‘off year’ elections, but that is not a good idea. This is our opportunity, as involved voters, to have a greater-thannormal influence on governance in our home communities, and it is very much needed this year. Please do not sit out this important election – be informed and be involved because our future depends on it! Thank you for using your influence and your vote to change our nation for better. As someone wise once said, “All that is needed for evil to prosper is for good people to do nothing!”
Currently, there are certainly some challenges in America that test our feelings of gratitude – inflation is becoming a real issue, and we are dealing with a shortage of supplies and workers. It becomes difficult to keep our minds in the right place and to be thankful for the many positives that we do have in America. So, let me challenge all of us this month to keep our minds on the good things and give the ‘not so good things’ to our Heavenly Father, as He knows and sees everything. Let us look at how we can give thanks this November: Did you know that the week of November 15-19 is National Apprenticeship Appreciation Week? What a great time for us to celebrate and be thankful we have over 350 registered apprentices in our classes. Wow! That 350-registeredstudent metric has held steady with last year, and 2019 was a record-breaking year! Now, here is a plug for those Heavy Equipment folks who love raw horsepower and the sound of a diesel digging dirt. New Heavy Equipment Operator classes begin in January 2022, and you still have time to be involved with the program! This year, we hope to have Level 1 and Level 2 classes running, so sign up your employees and ensure they learn how to safely operate that heavy equipment.

A Time to
Celebrate!
A
s we leave October and move into November, we have many things within our industry that we are celebrating. October was designated as Careers in Construction Month, and that is certainly something to celebrate. We want to thank and honor you, the great individuals that make your career in construction. Without you, our country grinds to a halt. Without you, there is no need for trade associations like ABC. Each October, in addition to thanking and honoring our construction professionals, we seek to educate students, parents, and educators on the types of careers that can be achieved within the industry. We invited the public to see these careers in action at our annual local craft competition. This event determines which apprentice is the "best of the best" within each trade here at ABC Keystone. I am excited for the team that earned the opportunity to compete in ABC's National Craft Competition in March 2022. The Keystone Chapter team will represent their trades, employers, and the Chapter very well. For the fourth straight year, we hosted our fall session of Construction Wars during Careers in Construction Month. This middle school career exploration event saw over 150 students experience hands-on activities, and it was a great introduction to what our industry has to offer career-seekers. Construction Wars is made possible because of the many volunteers that not only assist during those days, but also share their real-life experiences to help these young minds gain a grasp on the many career paths that exist. As we move into November, we will celebrate National Apprenticeship week during November 15-19. For those of you who don’t know, our founders saw fit to start the culture of apprenticeship training in 1968. We graduated our first class of apprentices in 1972, and we have graduated students every year since. This year, we celebrate our current 352 students in the program

who have decided to make construction their career of choice. We thank the members that sponsor these young people and who have such a strong commitment to the industry. Our apprenticeship program is expanding! I am pleased to announce that we received approval from the PA State Apprenticeship Council for a new trade program, Assembler–Pre-Engineered Metal Building. This new two-year program will bring ABC Keystone’s number of trades supported by apprenticeship to eleven. Additionally, ABC Keystone has been asked to take on the registered apprenticeship that is needed by the Central PA Chapter. As a result, the Trust and the Apprenticeship Committee have begun strategic planning to make sure we continue to improve and meet our member’s needs and the needs of Central PA. ABC Keystone is a leader in workforce development. That’s what Careers in Construction Month in October and National Apprenticeship Week in November are all about. We first must get individuals interested and engaged in the industry. Once you, our members, employ them, we need to provide the tools you need to advance your employees' career paths. Join me in celebrating and honoring these fine individuals that have decided to join our great industry.

Workforce Development Update:
ABC Keystone Celebrates Careers in Construction! By: Stephanie Larkin, VP of Education, Safety & Workforce Development
S chool is back in session, and that means workforce
development opportunities are in full swing. September featured the start of a new pre-apprenticeship class and a new proprietary curriculum, Safety 360. This enhanced program is designed to increase a student’s exposure to applied math and provide additional context to construction safety, taking the total program hours from 60 to 84. Graduates will receive a completion certificate from ABC Keystone and an OSHA 30-Hour Construction credential. The fall class is also piloting a new schedule that divides training into two-hour segments, three days a week. The Fall Construction Wars events concluded the first week of October. More than 150 students from 16 different schools took advantage of the hands-on career awareness and exposure opportunity. Many thanks to our new carpentry sponsor, Bench Dogs, for preparing and providing our benches, and to our faithful station sponsors: H. L. Wiker, James Craft & Son, Inc., Brubaker, Inc./HAJOCA, and The Witmer Group. And of course, a huge shout out to our volunteers and group leaders, without whom this event wouldn’t be possible or nearly as fun! Another Successful Start to Apprenticeship Classes Fall is a great time of the year! Not only does the fall bring crisp, cool weather, but the season also begins a new school year. ABC Keystone is excited that another year of apprenticeship classes has begun, and this year, we are educating 350 apprentices. The addition of four full-time apprenticeship instructors allows us to continue to enhance the quality of training for our apprentices and for their companies. September-October Update: At the beginning of the year, the Trainee Handbook and apprenticeship requirements are reviewed with each class. Apprentices were reminded of the DOL requirements of classroom hours as well as provided information regarding submitting monthly OJT hours. New this year was discussion on awareness of suicide in construction. Students were provided a list of potential signs and resources for themselves and/ or others with whom they may work. We promote PPE in construction, and our apprentices’ mental health is another form of PPE for all. Highlights from Carpentry & Electrical Classes: • Carpentry 1: Discussing building materials, fasteners and adhesives. • Carpentry 2: Working on blueprints and drawings; using the iPads and Procore to answer questions while reviewing the prints for the ABC building addition. • Carpentry 3: Working on properties and reinforcing of concrete; reviewing math concepts for determining volumes and putting that into cubic yards to order concrete. • Carpentry 4: Working on site layout and differential leveling, including the math site layout, angular and distance measurement; using the auto level and the builders level to read elevations and make temporary benchmarks in the yard at the ABC building. This class started with the manhole and worked 5
toward the building to see if they could get close to the difference in elevations that was shown on the drawings. The best out of two classes was within 3/16” of the elevations depicted on the prints. • Electrical 1: Reviewing OSHA electrical safety on ladders and stairways, including common electrical safety concerns and proper use of ladders. • Electrical 2: Discussing lockout/tagout and understanding the NEC Vol. 1 – articles 200, 210 and 215, including use and identification of grounded conductors and branch circuits. • Electrical 3: Understanding the NEC volume 1 – articles 400, 402 and 404 – flexible cords/cables, switches, receptacles, switchboards, and panelboards. • Electrical 4: Discussing leadership topics such as personal branding, developing basic leadership skills, taking responsibility, and staying on top of your game. Electrical 4 also started practicing their prep for the journeyman exam covering electrical circuits and understanding alternating current. We'd like to remind you that companies with apprentices in the ABC program are encouraged and welcomed to send representatives to attend classes. Also, we encourage you to have monthly (or at least quarterly) reviews with your apprentices. Discuss what they are learning and how they are applying that knowledge to the job. Can I Use a Price Escalation Clause In My Construction Contract?
W
ith the impact of COVID-19 wreaking havoc in the supply and demand chain, construction materials have skyrocketed in price, and in some cases, have caused painfully long lead-times for materials. Contractors skilled and experienced in quoting a fixed fee or a guaranteed maximum price (GMP) are leery giving such quotes without some cushion to absorb the risk in these steep price increases. As a result, many contractors have been scrambling to put price escalation clauses in their standard construction contracts. These price escalation clauses give the contractors the cushion they need to move forward with a project.
What is a price escalation clause?
An escalation clause allows a contractor to impose price increases in materials upon the owner after a contract has been signed, thereby shifting the risk of absorbing the price increases from contractor to owner. These clauses are typically used where there is a lump sum/ fixed fee or GMP contract, especially where the duration of a construction project is long and complex, so that there can be an adjustment to the price to be paid by the owner if there are sharp increases in the price of materials or labor. These clauses are not necessary where you have a time and materials contract because the owner already takes on the risk of having to pay higher prices due to fluctuations in the market during the construction project.
How should I negotiate such clauses?
Contractors may have some difficulties inserting such clauses in a lump sum/fixed fee or GMP contract if an owner insists that he or she wants the price guaranteed even if there are excessive increases in material costs or labor. These owners will especially resist an escalation clause that pushes the risk of the price increase completely on the owner. That said, most owners recognize the impact of the pandemic on the construction industry and may be willing to work with a contractor to accommodate these 7
price increases. In addition, a contractor who educates and informs his owner as to the unstable economy, material shortages, and the need for such a clause will have a better chance to include it in the contract. One way to make the escalation more palatable to an owner is to have the contractor absorb the price increase up to a certain percentage, as it normally would do in a more stable economy with a fixed fee or GMP contract, and then have the owner pay for any increases above that percentage. Another method is to have the owner and contractor just split the difference in the price increase. An owner may also want to offset the escalation clause by also including a de-escalation clause so that the owner can benefit from any price decreases. Another consideration is to have a maximum percentage increase that the owner will pay so that the owner knows there is a limit to the price increase.
What is the best way to use an escalation clause?
When there is a substantial price increase, the contractor should provide notice to the owner and provide evidence of the price increase, substantiated with dates and prices from the original quote and the current quote. The contractor should prepare the change order for the price increase using
the formula in the escalation clause so that he or she can see the impact of the price increase on his or her budget for the project. This will aid the owner to make an educated decision as to whether or not to procure the materials or perhaps consider substitute materials with a lower price. Either way, the contractor should have the owner sign the change order before ordering the higher priced materials so that there is no question that the owner agreed to pay the higher price. This will make for a better case before a judge or an arbiter if the owner refuses to pay for the price increase.

What are some other considerations in using these clauses?

Be ready for the owner to require you to order materials in advance to keep prices down. The owner will want to see that a contractor is diligent in staying ahead of the market and protecting the owner from being blindsided with exorbitant price increases. Be ready for these clauses to be used only for certain materials. The owner may want more stability in the pricing
Be ready with a reliably drafted clause. While the American Institute of Architects (AIA) does not provide a sample escalation clause, the ConsensusDocs have a sample escalation clause that can be used. And, of course, reach out to your attorney to have him or her draft a clause so that you can be steady in an unstable market.

Advocacy Update By: David G. Greineder, IOM ABC Pennsylvania Director of Government Affairs
I
n the lobbying world, staff cannot be successful without the commitment, support, and service of our members. Thank you for your dedication and commitment to this association. We know there are powerful and influential forces at the highest level of government opposed to free enterprise and the merit shop philosophy – even freedom! Without you, they would be successful. Because of you, ABC has successfully blocked bills that would negatively impact your business and moved the needle on efforts to pass legislation beneficial to the merit shop. Keep up the good work! This month, voters across the Commonwealth will elect leaders to local government. These seats are just as important – in many respects may be more important – than state and federal office. As part of ABC Keystone’s new three-year strategic plan, staff will be putting a program together to encourage and recruit candidates interested in running for office. We understand it can be a daunting and overwhelming process, so we want to ensure anyone that is interested in pursuing office has all the information they need to be successful. We need good candidates to step up and support free enterprise – could that be you? Turning to the state level, issues important to the merit shop are not easy. To be successful, it takes all of us moving in the same direction, building mutual support, teamwork, and partnerships. We continue to do just that. At the end of October, ABC of Pennsylvania partnered with the five chapters to host our annual Free Enterprise Day. The day kicked off with a briefing on policy priorities, followed by meetings with members of the Senate Labor & Industry Committee. ABC members did a fabulous job educating key members of the legislature on three key issues: 1. House Bill 536: This bill lowers the “default” journeyworker-to-apprentice ratio to 3:1 and establishes a process by which the State Apprenticeship and Training Council would set ratios by trade, which would be equal between union and non-union employers.

Thankful for Your Advocacy 2. Senate Bill 749: This bill would provide guidance to employers on how to advertise for positions, and how to manage hiring, drug testing, and jobsite safety under the medical marijuana law. 3. Suicide Awareness in the Construction Industry: ABC members took the time to advise lawmakers of the seriousness of suicide in the construction industry, which, unfortunately, has one of the highest suicide rates compared to other industries. We believe education and awareness are crucial tools that can assist in combating suicide rates. Increased public and employer awareness of the warning signs of suicide and appropriate and effective intervention strategies can help reduce suicide deaths. Free Enterprise Day wrapped up with an engaging conversation with Commonwealth Partners on the upcoming governor’s race. While it is still too early in the process to identify the political party candidates, it’s never too late to build the war chest. We need a substantial amount of money to combat the forces that seek to fight against the business community. If you are interested in getting in the game, reach out to ABC at davidg@abcpa.org. We need everyone to roll up their sleeves and take part. November is also a time to give thanks. I want to thank every ABC member for their support and confidence in our advocacy work. Our ongoing successes are truly a team effort. Most of you know that my deputy director, Austin Cawley, recently left ABC of Pennsylvania for a new opportunity. While he is no longer with ABC, I would be remis not to offer my thanks to him for his service. As we approach 2022 and beyond, I look forward to working with ABC’s leaders, chapters, and members to advance and defend the principles of the merit shop. We have much more to do! ABC Keystone Member Barley Snyder Attorneys Receive Top Awards
Barley Snyder partner Salvatore Anastasi was named as a top attorney in the region. Philadelphia-based publication, The Daily Local News, named Anastasi to its “Best Lawyers 2021 Readers Choice Awards” of Chester County in July, and Main Line Today, based in Newtown Square, named him to its 2021 “Top Lawyers Around the Main Line and Western Suburbs.” The Central Penn Business Journal has named Barley Snyder partner Peter Faben to its annual "Forty Under 40" list. Forty Under 40 recognizes professionals 40 years of age and younger who have been successful in the central Pennsylvania area. Honorees, chosen by the Central Penn Business Journal editors, were selected based on professional accomplishments, community service and commitment to inspiring change. Michael Beakes, Environmental Health and Safety Manager at Gooding Group, LLC, retired from active-duty army after 23 years of service as a Combat Engineer Paratrooper. Beakes holds a bachelor’s degree in Occupation Safety and Health from Columbia Southern University and has nine years of Environmental Health and Safety experience in construction and general industry. Josh Buohl, joining Gooding Group as a Junior Estimator, graduated in 2017 from Penn State Berks with a Degree in Business. During his college career, Josh spent his summers working for GSM Roofing. In 2018, Buohl began a banking career at Ephrata National Bank but soon decided that was not the ideal career path. This decision led him back to GSM Roofing where he was hired on as a Junior Estimator. Lindsay Briggs joins Gooding Group, LLC from Freedom Village at Brandywine, where she was the Director of

Mowery Hires Barnhart, Heller, Mattern, and Stough
Mowery, a construction company based in Mechanicsburg, Pennsylvania, is proud to announce the addition of four new team members including Joseph Barnhart, Zack Heller, Shawn Mattern and Kaitlin Stough. Joseph Barnhart joins the Mowery team in his role as project superintendent. In his new role, Barnhart will be responsible for scheduling, overseeing, and motivating an on-site workforce; coordinating subcontractors and material suppliers; and managing cost control and projections. Barnhart has over 20 years of experience in the construction industry and has earned multiple safety certifications. Zack Heller and Shawn Mattern join the team in their roles as carpenters. Lauren Bergman was named to Warehaus' Leadership Team as Chief Marketing and Employee Engagement Officer. Lauren will provide vision, leadership, and oversight to diverse communication, marketing, recruitment, and retention strategies that support Warehaus’ mission, vision and values. Lauren previously served as Marketing Director and has been with the Warehaus team for four years. Danielle Lee is named Director of Creative Services and Operations. Meet Lindsey! What role do you play in your organization? I work as a Client Service Agent at E.K. McConkey & Co., Inc. in our Surety department. I assist my construction clients with their bonding needs from prequalification letters to consents of surety to license and permit bonds.
By reviewing each request, I can also provide more accurate pricing to include with their bid estimate. I enjoy educating my clients so they can better understand how surety fits into their processes and why. Behind the scenes, I ensure that our department has what it needs readily available to handle any requests that we receive.

What was the best concert you have ever attended?
My favorite concert was Twenty One Pilots. I’ve attended eight of their concerts in the past nine years.
Where is your favorite place in the world?
I love Pittsburgh, and I grew up about an hour and a half outside the city. I usually go for a week around the Fourth of July to visit my best friend. It’s a tradition to attend the Riverhounds game on the 4th. If you have the opportunity to attend a game, I highly recommend it. Highmark Stadium has some of the best views of the city. I’m also a passionate Pittsburgh Penguins fan. There’s just something so welcoming about Pittsburgh.
