HOW DID YOU GET STARTED IN THE INDUSTRY?

MANDY:

My husband has been in the industry for over 15 yrs and 8 yrs ago we decided to open our own company.

SHEENA:

I started in the student housing industry in 2006. Seeing other college students my age tour apartments, work in a professional setting, and receive an apartment discount seemed like an amazing job, and I was determined to somehow become a leasing agent for the community where I lived. I interviewed, got the job, and was given an opportunity to work in leasing, where I was recognized amongst my peers for providing great customer service and for being a top leasing agent in the company for several years. From here I realized that my passion was serving others, and 18 years later, I am still passionate about what I do.

I got started in the Restoration industry in August of 1992 with a Servpro franchise in Virginia.

I got started in the industry I think it was like 2007. Working with my mother, she always had rental properties in Tallahassee FL. that always needed work done. From there I went on to bigger and better things for myself and my family. I was living in Jacksonville, FL. Career Strategies 2014 was the company that gave me my big break. Jennifer gave me the first crazy experience of a lifetime. Working as a temporary employee I began to shine, in a short period of time. Getting hired full-time with South Oxford. Climbing up the ladder, I became the Assistant Supervisor of Maintenance.

The office furniture business was slow, so I went online and applied for a job in the multifamily industry. I have been a maintenance technician for over a year now.


Q:

ARE THERE INDIVIDUALS WITHIN THE MULTIFAMILY INDUSTRY WHO HAVE INSPIRED OR MENTORED YOU?

MANDY:

No. However, there are individuals that I do admire.

SHEENA:

There are several individuals that have inspired me along the way, but two that have had the most influence on my career. Early in my career, I had a Property Manager who fostered an environment of empowerment, and mentorship and had confidence in me to take on tasks beyond my leasing duties. She created opportunities for me when at the time, I didn’t know Property Management would be a career for me. I had a Regional Manager who encouraged me to get involved with the local Apartment Association and always encouraged servant leadership and the importance of giving back. He is someone who has always been in my corner to uplift, and help cultivate my individual growth and achievement, and who will mention my name in a room full of people. Their leadership has truly inspired me and has helped mold me into the person I am today.

RASHID:

As I have provided Restoration Services in the Multifamily industry for over three decades, I have met lots of great people that have inspired me. In the past, I was able to travel to multiple cities to participate in the (NAA) National Apartment Association conventions. I’ve worked with great owners, managers, and their staff to complete successful projects.

BARRICK:

The people who helped me out the most was Jennifer the manager for Career Strategies. She was really right there in the mix of things encouraging me to stay focused. Also, I can't say enough about this guy. But Mitchell Boyd, we worked together for a couple of years. He always pushed me to to do more, be more. He believed in me at the hardest of times.

JAMES:

My boss Luis always help me and shows me a lot more of the work.

Q:

WHAT BRINGS YOU JOY?

MANDY:

Volunteering, reading, traveling and spending time with my family

SHEENA:

Spending quality time with my husband and children. I also enjoy volunteering and serving my local community, using my voice for the greater good, and helping others in any capacity.

RASHID:

My family as well as giving my all in my long career brings me the most joy in my life. I’m always excited to see what the next day is going to bring.

BARRICK:

Well, my joy and peace come from building furniture and really just building things or fixing things period. The beauty of art is being able to use your hands. Seeing the reaction you get from a complete stranger or someone you know is very pleasant. Just knowing I made someone's day by being courteous and kind brings me joy.

JAMES:

My boss Luis always help me and shows me a lot more of the work.

Q:

ONE THING YOU WOULD TELL YOUR 13-YEAR-OLD SELF, WHAT WOULD IT BE?

MANDY:

Don't be afraid, there's a big world out there to explore and not to spoil it for you, you will be better than good.

SHEENA:

What people think of you has little importance. But what you think of yourself is most important. Don’t compete with anyone but yourself.

RASHID:

If I could go back and tell my 13-year-old self, it would be: Keep God first in your life and no matter what things look like, stay strong and keep your faith.

BARRICK:

It's going to be okay. Life has its own way of showing up. As long you can produce a positive impact and let God shine upon you. Your Imperfections will become your greatest perfection. The world is one big portrait, filled with all different colors, shapes and sizes.

JAMES:

Keep working hard.

Q:

WHAT IS YOUR DEFINITION OF SUCCESS?

MANDY:

Success to me is doing what you love and being authentic while doing it.

SHEENA:

Success is making an impact at work, in my community, and seeing those who I have managed or mentored reach their professional goals.

RASHID:

My definition of success is setting goals, aligning with like-minded individuals, and working hard every day reaching your goals successfully.

BARRICK:

My definition of success is the knowledge that I've received along the way in life. Defining how I make a great investment in myself. Empowering others to challenge themselves to strive for excellence. Always giving a helping hand. Building better business by educating people in their craft, because when they are successful I am successful.

JAMES:

Happiness.

When tenants fail to pay rent, most landlords post three-day notices to “pay rent or quit” without thinking much about what they’re doing. Recently, a landlord in South Florida was “awakened” to paying a little more attention to this “routine

The trial court agreed with TN and dismissed KAC’s lawsuit with prejudice (i.e. can’t be refiled again). The court noted that Section 83.56 requires landlords to deliver a 3-day notice to tenants. Additionally, the Court in a prior case had granted the

practice.” This article will examine the case of KAC 2021-1,

landlord’s motion to dismiss the case and had pointed out that

the posting of the notice was proper:

31 FLW Supp. 447a, Broward County Court Case No: 23-1418 (Judge Louis H. Schiff October 27, 2023).

THE JONES FACTS: Jones was a tenant at True North (“TN”) and apparently failed to pay his rent. TN posted on Jones’ front door a 3-day notice to pay rent or quit pursuant to Section 83.56, Florida Statutes. This notice was posted outward so that anyone “walking by” could see and read the Notice. Jones found disfavor with TN’s manner of posting the notice outwardly and assigned his right to sue TN to KAC 2021-1, LLC (“KAC”). KAC filed a lawsuit asserting that TN had committed an “abusive debt-collection practice pursuant to Section 559.72, Florida Statutes, by posting the 3-day notice “outwardly” so that the “whole world could see it.” TN defended its posting of the Notice by generally stating that: (1) Florida’s Residential Landlord and Tenant Act required that the notice be posted in this outwardly manner; (2) TN’s actions

This Court in KAC 2021-1, LLC, as Assignee of Kanesha Stokes v. Yoss Prashkovsky, LLC, Case No. CONO 22-008130 (71) (Feb. 27, 2023) in an almost identical case as the one at bar, granted defendant's motion to dismiss the statement of claim with prejudice for alleged violations of the FCCPA relating to the posting of a 3-Day eviction notice pursuant to section 83.56, stating that said posting was proper. In KAC v. Prashkovsky, this Court wrote, “the accepted definition of ‘posting' means to ensure the notice is immediately visible, akin to something being posted on a bulletin board, and that posting the notice face-down does not advance the purpose of the statute.” Further, this Court wrote, “the Defendant is protected by the ‘litigation privilege' which provides immunity for actions that occur in judicial proceedings.” This Court then concluded, “Defendant is immune from liability due to the litigation privilege. . .if the legislature intended the 3-Day notice to be posted backward or face down, then it was up to the legislature to state [the] same in the statute.” Here, KAC comes before the Court to argue the same as it did in KAC v. Prashkovsky, without there having been no appellate cases, statutes, or rules that have reversed or changed the February 27, 2023 decision of the Court.

The trial court also found that KAC lacked standing to sue because KAC was not a debtor that owed TN any sum. Finally, the trial court found that Jones’ assignment of his potential right to sue TNwas invalid because purely personal claims cannot be assigned.

TN also asserted that KAC did not assert that the information on the notice was disclosed to any person other than Jones and his family or that Jones’ name was posted “before the general public

CONCLUSION: The Jones case offers a landlord several arguments supporting the notion that the posting of a three day notice pursuant to Section 83.56, Florida Statutes, does not violate Florida’s Consumer Debt Collection statute.
