Back to Basics By Amanda Gill Baseball season is now in full swing. The best players in the league trained hard during spring training just to prepare for the challenges of another season. Regardless of how many successful seasons a team has played, each year the athletes take time to get back to the basics during spring training. During this time, players refine their skills on the field, build comradery as a team, and strengthen their minds. The time and dedication the team members exhibit during these mundane and seemingly endless training sessions shape the athletes for a successful season. There are many lessons we can learn from the way professional athletes prepare for baseball season. Below are a few parallels for you to consider as you seek to shape your team for a successful quarter, season, or the year ahead.

Never under estimate the power of getting back to the basics. When was the last time you and your team sat down to discuss your business’ mission and how each person plays a specific role to achieve this important goal? In the workplace, there is nothing more critical than your company’s mission and vision for success. Every team (No matter how successful) needs a refresher regarding the “why” behind your day to day operations. Similar to the way teams recalibrate during spring training, make sure that you take time out of your busy schedule to ensure your team understands your mission and feels inspired to carry out your company’s vision.

Root, root, root for the home team! Never underestimate the power of positivity in your organization. Your willingness to celebrate the little victories your team achieves along the way will pay big dividends on the score board.

Remember there is always room for growth. The greatest athletes and teams stay motivated to continuously improve and enhance their skills. Similarly, success in the workplace is dependent on the ability to strive for more. As a leader, you should exemplify the desire to improve and share this passion with your team members. MVP’s should be celebrated. Each season, players lay it all on the field but there are some that rise above expectations. These players are known as MVP’s among their teammates and coaches. These individuals deserve to be celebrated for their skills, leadership, and dedication to the team. MVP’s in the workplace are equally valuable and it is important that these individuals know how special they are and the important skills they bring to the table each and every day.

Train for the long game. There are nine innings in baseball, which requires players to be on top of their game for an extended period of time. Similar to these athletes, the members of your team need to be training for the long game. What skills will they need to take their careers and your company to the next level? What professional development opportunities will set your team apart from the competition? These are all important questions to consider as you evaluate your team. 12

AAGO education CERTIFICATION PROGRAMS

The Apartment Association of Greater Orlando is proud to offer several nationally recognized certification programs to its members. These programs are taught by certified instructors and testing is done on site. CERTIFIED POOL OPERATOR, CPO Through the National Swimming Pool Foundation, AAGO is an approved provider of the CPO certification. This is a 2-day course which includes the certification exam.

• Financial Management • Research Prequisite: You must have worked in the apartment industry for at least 12 months; successfully completed the nine courses listed below (which total 55 ½ hours)and meet all examination requirements within 12 months of declaring your candidacy for CAM.

Audience: Maintenance, Suppliers EPA REFRIGERANT HANDLING CERTIFICATION The Federal Clean Air Act, Section 608, requires that persons who service air conditioning and refrigeration systems containing certain refrigerants be certified under an approved Federal Environmental Protection Agency (EPA) approved course. Through the ESCO Institute, AAGO is able to offer this Universal Certification. Audience: Maintenance, Suppliers NATIONAL APARTMENT ASSOCIATION DESIGNATION PROGRAMS The multi-family housing industry is growing. Suppliers are important liaisons to the multifamily housing industry. This program is designed as an opportunity for suppliers to hear the everyday challenges faced by the apartment manager customer. The CAS program is ideal for new salespeople as well as veterans of the industry. The Certified Apartment Supplier (CAS) course includes: Required Coursework: • Management of Residential Issues • Risk Management • Financial Management • Fair Housing Time: 9:00 am- 5:00 pm for each module Cost: $549 Member $649 Non Member 10% off for A-APASS CEC: 6 CAS Prerequisites: You must have: completed the Supplier Success course; worked in the apartment industry for at least 12 months in a supplier role; successfully complete the four required courses (which total 26 hours); and meet all examination requirements within 24 months of declaring candidacy for CAS.

ESSENTIAL LEARNING TRACKS: LEADERSHIP DEVELOPMENT The Leadership Development program offers blended learning from group activities to instruction in conventional classroom settings. AAGO’s Leadership Development Program will help teach you the essential skills and techniques you need in order to look at challenges from a different perspective. The program will focus on assessing each attendee’s leadership competencies and the gaps that exist. Instructor Spotlight Lindsey Rivett AAGOʼs world class educational opportunities are made possible by countless volunteer instructors who share their valuable time and talents with students. This month, we sat down with veteran instructor, Lindsey Rivett to talk about her experience teaching at AAGO.

Amanda: How long have you been teaching for AAGO? Lindsey: Iʼve been teaching at AAGO for eleven years now. Amanda: What do you enjoy most about teaching classes at AAGO? Lindsey: The enthusiasm you get from your students when they are truly engaged in the material and the learning process! Amanda: What is your favorite memory as an instructor? Lindsey: I was teaching a review for the Certified Apartment Manager (CAM) designation program and a few students were having difficulty with the financial portion of the material. I could tell they really needed some extra attention and after a majority vote, our class took on a very different path. We devoted the rest of our class to the financial components of the CAM and collectively ensured EVERYONE was on the s ame page and felt confident in the material. After the class, a few students approached me and gave me the most heartfelt and sincere thank you as they now felt the confidence they were lacking before the class to really excel during the final exam. Amanda: Why do you think it is important to continue learning as an industry professional through the classes provided by AAGO? Lindsey: Our industry is ever evolving and in order to be successful at anything, we should humble ourselves and know that there is ALWAYS something more we could do, learn, or adapt to. We owe it to our residents, our associates, and ourselves to be the very best at what we do and that can only be achieved through continued education and a commitment to excellence! Amanda: What are you looking forward to next? Lindsey: I am super excited to be involved in the second year of the Future Leaders program. The module that I teach is called “Decision Making.” It is always so rewarding for me to look out at the students and see the light bulb go off. Last year, UDR had three attendees in this program and I am proud to announce that two of them went on to win Golden Key Awards for their respectful roles. I canʼt wait to see what this class brings!

Maintenance Appreciation This year, AAGO held its first ever Maintenance Appreciation night! In case you missed it, we took over the entire second floor of the ACE CafĂŠ in downtown Orlando. Attendees got to mix and mingle while enjoying a delicious BBQ buffet and craft beer tasting. Whether they were playing cards with friends, enjoying a good game of darts, or trying their hand at cornhole, our Maintenance Teams had a blast! Our exhibitors went all out with the 2018 AAGO Trade Show “Decades” theme. We saw groovy dudes, totally rad chicks, and mad cool décor! Attendees cheered as their fellow apartment staff won cash prizes ranging from $250 to $1,000, just for attending the show. Games and prize drawings at the 175 supplier exhibitors’ booths drew in attendees for fun and conversation. AAGO Expands its Advocacy Program In May of 2017, AAGO leadership conducted a Strategic Planning session. One of the needs the association identified was the desire to hire an advocacy partner to assist the association with its local advocacy efforts. In response to this need, AAGO conducted a thorough search for a third-party lobbyist.

AAGO collected requests for proposals from several talented lobbying firms, which made the Selection Committee’s task of picking the perfect candidate a very difficult task. AAGO was pleased to select the Gray Robinson firm to represent the association in central Florida. AAGO will be working with Chris Carmody and Robert Stuart, who have strong background in real estate and represent a variety of associations throughout Florida. This new partnership with Gray Robinson demonstrates the association’s steadfast commitment to preserving the interests of the multifamily industry at the local level. We hope you will join the association’s grass roots advocacy program by getting involved in our robust strategy to connect with local policymakers and stop bad policies before they are signed into law. In addition to AAGO’s growing advocacy program, there’s been a significant amount of action at the local level. Thankfully, AAGO never takes a break from advocating on behalf of the apartment industry. Below are a few brief highlights from AAGO’s advocacy efforts that may be of interest to you.

Seminole County Threatens Development The apartment industry has long been an easy target for local governments looking to finance special projects or essential services without raising property taxes for homeowners. This practice is incredibly shortsighted from a policy perspective because these costs are inevitably, passed on to renters. In an era where the need for affordable housing is on the rise, these practices can stifle development and drive up the cost of housing. Seminole County’s recent educational impact fee proposal is just one example of this behavior in the central Florida region. Shortly after the New Year, AAGO became aware of a new Seminole County Educational Impact Fee proposal that was adopted by the Seminole County Board of County Commissioners. Some of the changes, severely threatened multifamily development projects underway in Seminole County. Once AAGO was alerted of the


AAGO Advocacy county’s plan to raise fees for developers, members and association staff sprang into action. In March, AAGO staff and members of the Developers Council attended the Seminole County Commission meeting to voice concerns regarding the new impact fee structure and petition the Board to grandfather in exiting projects into the current fee structure. Thankfully, after extensive debate the Commission members voted in support of AAGO’s requested change. Although there is more work to be done, AAGO was grateful the association was able to protect projects already in the pipeline by ensuring they can utilize the current fee structure.

Osceola County Votes to Raise Fees by 87 Percent Similarly, Osceola County recently increased its school

impact fees by 87 percent in March. Once we became aware of Osceola County’s plans, AAGO joined forces with the Greater Orlando Homebuilders (GOBA) and asked the commission to reconsider this policy change and the impact it would have on housing affordability. Despite hearing the association’s concerns, Commissioners voted to increase the per-unit cost for multifamily projects from $6,088 to $11,362, which amounts to an 87% increase. Unfortunately, situations like these are all too common in central Florida. AAGO needs members like you, now more than ever to take an active role in advocating on behalf of the industry in the local community. JUST A FEW VERDICTS TO CONSIDER In keeping with our continuing “theme”, we consider a few verdicts: Heike v SR Singh Enterprises, Broward County Case No: 16-11472 (November 26, 2017): FACTS: Heike suffered a fall down on a defective stair case at a property owned by Singh Enterprises. Heike suffered a series of injuries to his and cervical spine that ultimately resulted in his death. Heike’s four sons sued for wrongful death and for the loss of his companionship, instruction and guidance. At trial, the sons claimed that the stairs were unfit for use and not built to code and lacked various safety features. VERDICT/SETTLEMENT: Prior to the jury rendering their verdict, the case was settled with each of the four sons receiving $500k and $11k being paid for medical and funeral expenses. Henkle v Cumberland, Federal District Court for the Southern District of Florida Case No: 16-CV-14248 (July 13, 2017): FACTS: Henkle sued Cumberland because he tripped and fell over the curb flare (side) of a handicapped ramp. Henkle also contended that the curb flare was the same color as the parking lot surface and didn’t meet the Building Codes. Henkle contended that it was defective and poorly designed and dangerous. Cumberland denied that the

ramp was dangerous. As a result of the trip and fall, Henkle had cervical disc herniations and shoulder derangement. Henkle underwent a triple-level cervical fusion. He also claimed an arthroscopic shoulder surgery was performed because of the trip and fall. He sought over $300,000 in past medical expenses.

Henkle testified that he was taking an empty coffee cup to a trash can located in the front of Cumberland’s location when he tripped over the side of the handicap ramp (curb flare) and fell. Cumberland stated that Henkle was a regular customer of the store, was familiar with the ramp condition and failed to watch where he was walking. Cumberland also asserted that Henkle’s neck and shoulder conditions were not causally related to the fall and his treatment was not reasonable or necessary. VERDICT: The jury found no negligence on Cumberland’s part which was a legal cause of injury to Henkle. Connell v Pressley Palm Beach County Case No: 12-1948 (August 9, 2017): FACTS: Connell asserted that Pressley negligently created a dangerous condition in their home in the form of a raised bathroom threshold. Connell stated that she tripped and fell for that reason. At the time of the trip and fall, Connell was attending a party at the Pressley home.

Connell claimed that the threshold exceeded ½ inch high and violated the applicable building code. Further, the threshold had 90 degree angles and was made of the same material as the tile floor. As such, it was hard to see. As a result of her trip and fall, Connell suffered a right shoulder fracture and had surgery. She claimed that she would need a total shoulder replacement in the near future. Connell requested that the jury award in excess of $500k to her. Pressley argued that Connell had been to the Pressley

home on several occasions, was aware of the raised threshold and never had a problem using the bathroom. They asserted that she wasn’t looking down and failed to watch where she was walking. Pressley also asserted that Connell had a successful recovery and wouldn’t need a shoulder replacement in the future. VERDICT: The jury found no negligence on Pressley’s part which was a legal cause of loss, injury or damage to Connell. CONCLUSION: These cases illustrate the need for landlords to trouble their properties constantly and to anticipate what might present itself as a potential hazard for tenants.

Fair Housing Act: A Lesson in Recognizing a Reasonable Accommodation Request Your front office is stocked with the proper attorney approved request forms in the correct folder. They are neatly filed away in a color-coded organized cabinet. Staff is informed and can identify the form. They will even provide a pen. A copy of the request form is publicly posted on the community board, and available online. In your office there is no conceivable reason for any qualified resident to encounter even the smallest hurdle when requesting a reasonable accommodation under the Fair Housing Act. The forms are everywhere! The procedure is rock solid. But what happens when the tenant does not follow your fool proof procedure? Fair Housing Act The passing of the Fair Housing Act (FHA) just celebrated its 50th anniversary on April 11, 2018. Title VIII of the Civil Rights Act of 1968 is commonly known as the Fair Housing Act and was meant as a follow up to the Civil Rights Act of 1964. The continuing goal of the FHA is to prevent discrimination to certain protected classes in housing. In 1988, those with disabilities were added to the list of protected classes, and codified in the Americans with Disabilities Act of 1990. This is where reasonable accommodations entered into our discussion. Reasonable Accommodation A protection afforded under the FHA is the right for tenants with disabilities to request reasonable accommodations. These accommodations can be applied to rules and policies, established practices, or offered services. A reasonable accommodation modifies a rule, policy, established practice or offered service to allow the person with a disability an equal opportunity to enjoy a dwelling. There are nuances regarding who is eligible, what is considered reasonable, and what proof is needed. Legal 40

tomes are written about all those aspects. Let us not even mention emotional support animals! This discussion today is regarding a qualified person requesting a reasonable accommodation. The lesson is they may not make the request the way you want them to make it. The point that is often lost in the over-preparedness of the front office is that the tenant is not required under the FHA to fill out your form to make an accommodation request. The tenant does not even have to put it in writing. Sometimes we have to read between the lines. The Carpet Policy The following is an example I came across that spotlighted the issue of requesting an accommodation, and a useful illustration that not all people express themselves the same way. I encountered a situation with a new carpet policy, and a disabled tenant named Ruth in an electric wheel chair. Being confined to an electric wheelchair, there was no debate that Ruth had a known and visible disability. Per the property’s policy, after a lease renewal, a new carpet request can be submitted for review. After her fourth renewal, Ruth put in a request for a new carpet. Ruth complained that her current carpet was old and the edges were frayed. The office responded quickly, and examined the carpet. The edges were repaired, and the carpet cleaned. It was determined the carpet still had a lot of life in it, so the actual request for the replacement was denied. Everything was noted in the tenant’s file, and the open request was closed. A few months pass, and the same request was made by Ruth. Again, she stated the edges of the carpet were frayed, and she insisted that she was entitled to a new carpet because she had lived there for five years. Again,

the carpet is cleaned, and the edges repaired. The request for an entire new carpet was denied. A short time thereafter, there is no glowing review on Yelp extolling the helpfulness of the office, but instead, an FHA complaint was filed. Ruth alleged that she requested new carpet per the policy as an accommodation for her wheelchair. A brief investigation revealed that Ruth’s electric wheelchair wheels were getting caught up in the carpet. She would come to an abrupt halt, and she would be stuck for hours struggling to free her electric wheelchair wheels from the entanglement of the frayed carpet. This came as a huge shock. No accommodation request form was every filled out and handed in to the front office. The tenant was provided with an accommodation request form when she signed her lease, and every renewal thereafter. There were forms readily available at the front desk, and posted in common areas. However, the FHA does not require the request in writing. No property can require tenants to take extra measures to request an accommodation. The old adage, “You can lead a horse to water” comes to mind. This tenant was afforded every opportunity to fill out a form for her accommodation, but still went another route. And under the FHA, that may have been acceptable. The Resolution The multi-family complex did stand by the defense that they were completely unaware of the need for the new carpet as an accommodation for a disability. They insisted the request was because the carpet was old, and lease renewal time afforded that request opportunity. However, they did agree that this was a reasonable request, and did immediately install new carpeting and added plastic transitions to further prevent the fraying. The tenant was satisfied and life moved on, but there was a lesson to be learned. At some point, there should have been a tiny red flag waving in the distance. There

was a lot of attention given to this carpet. Ruth was dogged in her insistence for the new carpet under the existing policy. If the right questions were asked – for instance, “Why are the corners fraying?” – maybe the carpet’s interference with the tenant’s mobility would have been discovered preventing the dread of receiving an FHA complaint, and having to expend attorney fees to respond to the complaint. It may seem that mind reading is a requirement under the loose standards for requesting an accommodation, but that is a bit of an exaggeration. Digging a little deeper however, may be revealing. Communication is key. And not everyone communicates the same way. 1) Was an accommodation brought up in casual conversation? In our above example, did the tenant ever mention issues with her chair’s mobility in another context? Did her chair ever stall on the carpet in the office? 2) Is there a procedure in place if a verbal request is made for the accommodation? 3) Is maintenance as well as the front office aware of the procedure of verbal accommodation requests? Take the time to ask questions. It is time well spent. There is still always more to learn, and more preparedness that can be implemented. A good place to start is understanding FHA accommodations. It is paramount to remember that no matter how easy and user friendly your procedures may be, it is not a guaranty that your tenants will use them, or be required by law to do so.

In the graph to the left, the Overall Occupancies have continued to increase in all counties during the last few years. True to form, four of the five counties increased from 1st Quarter 2017 to 1st Quarter in 2018. Only Osceola has saw a slight decrease in Overall Occupancy this year (from 97.32% to 96.98%). County wide dips in occupancy can be caused by many things but it appears that in this case they can be attributed to rents being pushed and new construction being delivered. This could be as 13.67% of Osceola’s units are less than 5 years old. Regardless of the occasional dips, market wide occupancies have remained over 93% since the beginning of this analysis, and over 95% since 2015 From the 160,000 units participating in the 1st Quarter AMSTR, the overall occupancy for the 5-county AAGO area is 97.13%. This is up from the 96.95%

recorded in the 1st Quarter of 2017. How Old or New is the Apartment Inventory in Your Area? Nearly 10% of the apartment inventory in one of the five AAGO counties is 5 years old or less. Additionally, there is a submarket in Orlando where 38% of the inventory is older than 30 years while 29% is less than 5 years old. As marketers in commercial real estate, we know that advertising works, but there is not usually a one-to-one correlation between ad dollars spent and revenue. So how do we prove that our efforts are actually worth it? Marketing analytics is the measuring and analyzing of your marketing mix to track your return on investment (ROI). Luckily, in our digital marketing-driven world today, we have more resources than ever to collect these analytics in order to not only back our marketing strategy but also increase our ROI. Websites and Blogs and Social, Oh My! If you have not been using marketing analytics in the past, this may seem daunting, but don’t panic! There are many tools available to use: Google Analytics Create a free Google Analytics account to track your website or app. This is a great tool to collect the demographics and behavior of your site visitors, as well as track what they are searching the your site, what they’re clicking on the most, and how long they’ve spent on each page. Facebook, Twitter, and Instagram Social media sites such as Facebook, Twitter, and Instagram have their own analytics, if you transform your multifamily property’s social account into a business account. Similar to Google Analytics, you can see your follower demographics, engagement behavior, and what times of the day they are most active on the app in order to better target your audience. These sites also allow you to track impressions, reach, and engagement, as well as conversions and clicks if you sent out advertisements. Hootsuite and Buffer If you are willing to spend a little bit of money, Hootsuite and Buffer are great applications to use to track all of your social media and website analytics on a single dashboard. You can save time and energy by scheduling posts out from a single app instead of having to log-in and out of multiple social accounts. HubSpot HubSpot allows you to wrap all of these analytics into one. With this tool you can schedule-out ads, social media posts, and blogs as well as track the analytics for all of them. Since many multifamily properties use a combination of different digital channels, using a single application to monitor and maintain your marketing and brand message is extremely helpful. Always stay up to date with the different tools and trends in marketing analytics. The digital world is constantly developing and pushing forward, so don’t get left behind! Patience is a Must Once you begin tracking your marketing efforts, stick with it. You will not see huge progress within the first week, or month, or even

quarter potentially. Yes, it is important to track the day-to-day items such as the conversion from a specific Facebook ad, or clicks on a CTA for your weekly blog post so you can see what performs best with your target audience. However, it is more important to track these analytics over longer periods of time in order to see real improvement in areas such as reach and engagement. For example, your Instagram account may receive 50 new followers in one week, but only 1 or 2 the next. This is not necessarily a reason to be concerned, as much as it is just a trend you should follow to find out WHY your followers didn’t increase as much one week over the next. Use strategies such as A/B testing and follow different social media trends to see where you can improve. The goal is to not get frustrated with your results. Stay patient and keep tracking. 5 Steps to Improve Your Analytics Methods Analytics are essential to the evaluation stage of any marketing strategy. However, if not collected diligently, they are of no use. Here are a few good practices to make habits that will increase your data’s relevance and improve your strategy’s effectiveness:

Nail down your needs. First, decide where you could use some improvement. Focus your efforts on a few specific areas such as social media engagement or website traffic in order to track relevant data for your multifamily property. Create SMART goals. In order to prove your analytics efforts are worth your time, you have to set goals that are specific, measureable, attainable, relevant, and timely. This way, you can continue to track your progress in comparison to your end goals. Consistency is key.
