FROM OUR PRESIDENT Dear AAGO Members This year marks the 50th Anniversary of the Association! I am both honored and excited to be serving a second term as President as we come together in celebration of this monumental milestone. Over the past two years, our industry has faced its fair share of challenges. Despite this adversity, our resilience has prevailed and because of this, the Association continues to flourish. In 2021, we experienced incredible growth exceeding 213,000 units in membership. We ramped up our advocacy efforts, working to cultivate deeper and more meaningful relationships with our local elected officials. We expanded our education offerings by focusing on curriculum development that received national recognition. We made a commitment to uplift underrepresented voices in our industry and in doing so, were named the National Apartment Association’s 2021 Innovation in Diversity and Inclusion top grant recipient. For the past 50 years, we have been fortunate to have a strong band of volunteer leadership that, working alongside staff, has long primed the Association for success. Thanks to some very strategic decision making, in 2007, Chip Tatum joined the team as Director of Education & Government Affairs. His forward thinking, innovative creativity, and humble civility led to his promotion to Association Executive in 2014. A rather household name, Chip helped redefine success and has played an instrumental role in many pivotal initiatives that have paved the way for the association’s transformative growth over the years. In October, Chip was selected to serve as the Florida Apartment Association’s Executive Vice President and assumed his role in January. While we were sad to say goodbye, we were excited for him to take this next step in his career and look forward to reaping the benefits of all he will accomplish at the state level. The next 50 years are at our fingertips, and this is our moment to shine. Every two to three years, our volunteer leaders come together to conduct Strategic Planning. This is an opportunity for association leaders to workshop, strategize, and brainstorm new goals, projects, and initiatives. As luck would have it, we will host Strategic Planning in late January and are thrilled to have the opportunity to lay the foundation for generations of association leadership to come. STUDENT SPOTLIGHT Chip O'Kelley Area Manager|First Communities Management

This past year has been a whirlwind of changes for me but in the best way possible. Having just passed my exam to obtain my CAM, I feel incredibly grateful for everyone who has impacted me in this new phase of life. The education through our associations has prepared me for where I have been and where I am going. Starting with the leadership Lyceum program through the FAA that better prepared me for the roles that I served when I was Secretary and Education Chair for SWFAA (South West Florida Apartment Association) and as a delegate on the board for FAA. I have realized the importance of being an active part of my local association and all the opportunities they have provided for personal growth in our industry. This experience has given me an appreciation and a strong commitment and belief in all of the organization's work from local boards such as AAGO, FAA & NAA. These training and tools that have been passed down through the associations have prepared me as I take on a new role with my company, First Communities as an area manager beginning in December. The information and experience have helped me succeed at spreading First Communities' mission of “Creating relationships and meaningful moments with all who walk through our doors”. I look forward to the new year, and serving on the AAGO board of directors for 2022 and am excited about the opportunities it will provide to continue to allow me to grow as I get ready to take on my next certification, CAPS. Potholes 1-0-1 By PotholeRepair.com

e can all agree that potholes are ugly and can destroy the curb appeal of a property. Potholes also expose property owners and managers to liability for personal injuries and vehicle damage that can result. The fact is that the asphalt on parking lots and roadways are the single largest capital expense for property managers and potholes are a recurring problem for all of us. We decided to learn more about what causes potholes, what can be done, and what are the modern best practices in the industry to address potholes and asphalt management. WHAT CAUSES POTHOLES? Water and gravity are the main culprits behind most potholes. Gravity helps water from rain and melting snow to find its way beneath the asphalt to erode the earth at just the right spot, leaving a void and setting the stage for the asphalt above to crack or buckle. In cold weather areas, the water beneath the asphalt can freeze and expand, further deteriorating the condition of the asphalt and the earth beneath. It turns out that no potholes start out big. They all start out nice and small and then weather and continued use make it worse, allowing in more water, causing more erosion, further deteriorating the damaged area. WHAT TO DO? {do nothing} Some property managers elect to do nothing until the damage grows large enough to warrant hiring a paving company to repave the entire lot or to cut out and replace the damaged asphalt. Calling out a paving company to do anything generally requires large capital expenditures because they must send out a crew of 8-10 people along with millions of dollars worth of equipment. Such repairs are usually loud and disruptive, requiring property managers to give notice to tenants and close sections of the effected lot. {apply cold patch} The property management industry is generally reactive when it comes to potholes. At a rate of about $40 a piece, maintenance crews typically apply a DIY cold patch (a cold bag of material you can buy at Home Depot) to fill potholes on their parking lots and roadways. The problem is that water continues to seep in and cause more erosion of the earth beneath, making such repairs temporary at best. The damaged asphalt will continue to 30

deteriorate and get worse with weather and continued use. INDUSTRY BEST PRACTICES Seeing as how parking lots and roadways represent such a huge capital investment for most all property managers, we wondered about modern approaches to asphalt management. A survey of various Departments of Transportation reveals consistent advice that property owners ought to be proactive when it comes to potholes, advising that if the damage is not properly corrected in a timely manner, the damages will get worse and may cause more potholes to form. The same DoT officials express frustration that the public sector is still too reactive, consuming over 95% of their available budgets on reactive capital, locking them in a never-ending cycle that does not allow them to proactively maintain their own pavement. If property managers can catch and properly repair minor asphalt damage early, this will greatly extend the life of the pavement. To be durable however, a cold patch just won’t work. Such repairs require a hot asphalt mix to enable a heat seal between the repair and the surrounding pavement so that water cannot seep through. Maintenance contracts are another trend in the industry. Property managers obtain maintenance contracts covering landscaping and other building services, fleets and vehicles, and HV/AC systems. Why not for asphalt maintenance? At least one company, PotholeRepair.com, provides professional pothole repair services and offers strategic asphalt management, including regular inspections of your property and detailed reporting to identify and document problems. We can all agree that potholes suck. But managing asphalt and potholes are a fact of life for most property managers. It turns out that there are new and better approaches to consider when you have a pothole – and more strategic ways for property managers to manage and maintain their parking lots and roadways. Be proactive. Inspect your property and repair damaged asphalt, properly and in a timely manner, or it will get worse. The good news is that if you take a proactive approach to managing your asphalt, you can greatly extend the life of your pavement.

AAGO Foundation hosts first-ever Thanksgiving Food Drive In an effort to support two of its Charity Partners - the Orlando Dream Center and The Sharing Center - the Foundation garnered the support of nearly 90 member apartment communities each of which graciously volunteered to collect food donations.

An official Food Drive kick-off announcement was made in late September and Friends of the Foundation Committee members quickly delivered signage to participating apartment communities. Collections ran from October 5 through November 5 and said collections were sorted and distributed to Foundation Charity Partners the following week.

WHAT YOU NEED TO KNOW ABOUT THE CITY OF DAYTONA BEACH'S SOURCE OF INCOME ORDINANCE Disclaimer - The information outlined below is for reference purposes only and is not intended to serve as nor constitutes legal advice. Effective Date - January 1, 2022 Key Provisions - Sec. 54-28. Violations. (a)(1) In October of last year, the City of Daytona Beach passed an antidiscrimination, income source ordinance. The AAGO Government Affairs Team was able to work with one of the City Commissioners to get the word 'delay' inserted into the ordinance. In instances where the public assistance program would otherwise require a housing provider to experience a delay in rents, a housing provider is not in violation of the ordinance if he/she decided to move forward with a different prospect. Per the Ordinance, It shall not be a violation of this section for a landlord to refuse to rent a unit where reduce, delay, or waive the public assistance program requires the landlord to reduce, rents, or other lease-related fees such as security deposits (provided that such rents or other fees do not violate subsection 2 below); or where the public assistance program requires the landlord to conduct repairs, maintenance, or improvements to the leased premises that exceed applicable provisions of the Land Development Code, including the property maintenance code, or the requirements of this Code." A LANDLORD’S LIABILITY FOR FAILURE TO REMOVE MOLD Landlords have to keep their properties “ship shape” and in good repair, etc. One of the easiest items on the “to do list” that can be overlooked is mold. Sometimes it’s hard to see on first blush and other times it’s mistaken for wear and tear, discoloration, etc. By: Kevin Knight A recent Florida case emphasizes the importance of ensuring that there is an orderly program for mold detection and extrication. This article will consider the case of Huggins v Siegel (Fla. 1st DCA September 15, 2021). THE HUGGINS FACTS: The Huggins rented a house from Siegel from August 2015 through December 2017. Before they moved in and during the rental period, the Huggins complained about potential water intrusion and mold. Siegel refused to have the house inspected and the Huggins hired their own mold inspection company. The inspection report indicated that multiple mold types, including two toxic molds -- aspergillus and penicillium -were present in the home. After receiving the mold report, Huggins vacated the property. THE LAWSUIT: Huggins sued Siegel and asserted that Siegel’s negligence in failing to inspect and remove the old exposed Mrs. Huggins to dangerous mold. At the time of occupancy, Mrs. Huggins was pregnant with one of Huggins’ children. Throughout Mrs. Huggins’s pregnancy, ultrasounds showed

that the child was forming two kidneys, but when the child was born it had only one kidney (i.e., renal agenesis). The child also exhibited indications of brain injury. Mrs. Huggins suffered severe emotional distress as a result of her newborn’s issues. THE EXPERT ISSUE: In order to prove their case, the Huggins retained a medical expert to testify about causation. About a month before pretrial, Siegel filed a motion to strike the expert. Huggins argued that Siegel’s motion was “too late.” The trial court denied Huggins’ lateness argument and also found that the expert was not qualified to testify on causation. Siegel requested summary judgment based on the Huggins’ inability to prove causation and their case without a medical expert. The Huggins conceded this point, Siegel was granted summary judgment and the Huggins appealed. THE APPEAL: The appellate court considered Huggins’ expert’s background. The court noted that he was a board certified, licensed physician in the specialty of obstetrics and gynecology and the subspecialties of reproductive

endocrinology and embryology. Noting these credentials, the court highlighted that Huggins retained the expert as a causation expert to testify that the mold in Siegel’s rental home caused their child’s renal agenesis and brain injury. The appellate court found that he was not qualified to testify as to causation because he lacked the experience and knowledge to connect the mold to the child’s medical conditions. Huggins’ expert testified that he treated a patient with an unborn child with renal agenesis during his training, but his current practice specializes in infertility, and he does not typically treat patients like Mrs. Huggins. The expert also testified that he has never been involved in cases involving the disappearance of a kidney in an unborn child, or cases where a kidney was observed but later disappeared before birth. Additionally, the expert never attempted to link mold to unilateral renal agenesis before this case and he never presented on the topic of mold in the developing kidney. Finally, the expert admitted that he is not a mold expert and knowledge of mold growth is outside his specialty. Additionally, he was unable to find scientific or medical literature directly linking mold to kidney disappearance in humans.

There was another expert (mold) who testified that he believed within a reasonable degree of scientific probability that mold existed in Huggins’ home while the child was in utero, but he was unable to determine the quantity of mold that was present or whether the property would have passed a mold inspection. He based his belief that the mold was there for the relevant period because of his basic knowledge and common sense that mold doesn’t grow overnight. The appellate court opined that EVEN if Huggins’ medical expert had relied on the mold expert’s report, which he did not, he did not have enough independent knowledge or additional expert information to determine whether the mold was the cause of the child’s renal agenesis and brain injury. Without this expertise, experience and research or experiment(s), the medical expert “could only” speculate on the issue of causation. Thus, the court confirmed that the trial court properly struck the expert. CONCLUSION: The Huggins’ case emphasizes that a landlord’s failure to inspect and eradicate mold can have dire consequences for the tenants and landlords…..if the proper expert is retained to connect the causal dots between the presence of mold and the injuries that occurred.

CONSIDER YOUR GOALS AND FOCUS YOUR MULTIFAMILY CONTENT When writing content for your property, you might be eager to write about all the great luxuries your community can provide. Our suggestion? Slow down. While this is certainly important information that deems some exposure, this should not be the focus of every piece of content you write. Instead, take careful consideration of your goals and buyer persona in order to create content that converts. Apartment marketing has historically been viewed as a cost center rather than a business builder. The perception is that marketing is necessary, but also expendable. It’s often diminished to an apartment logo or a flowery brochure. When you need to tighten the belt … goodbye marketing! However, what most people don’t realize is that multifamily marketing is what drives the industry and keeps it afloat when times are tough or when the economy shifts. Content marketing especially can be a significant differentiator for your property and help you edge out the competition when leveraged appropriately.

LET YOUR RESIDENTS GUIDE YOUR CONTENT The creation of powerful content is where your personas and knowledge of your buyer’s journey come into play. People don’t drive around in search of a “For Rent” sign or buy the latest newspaper for rentals in the area. Today, digital promotions are the most effective ways to reach your consumers. Personas will help you drive the right customers to your blog, webpage, social media, and offers. You don’t want to attract just anyone; you want to attract people who will be interested in what you have to offer. Using your personas will help you create custom content that will appeal to their personalities, demographics, and needs. Here is where understanding the buyer’s journey becomes useful. Knowing where your target residents are in their journey when they are coming to your site, and how to help them move along their journey is important. Rather than focusing on promoting your property, focus on your target residents’ needs instead. Every interaction a persona has with your content should be tailored to the stage they reside in in the buyer’s journey. Let’s take a baby boomer, for example. He’s nearing retirement and sits down at his computer to search for “Best retirement cities in the country with golf all year round.” If I’m a residential resort community that practices content marketing, I’ve already anticipated what my best prospects will be searching for. Throughout the past few months, I’ve been blogging about relevant topics, including a recent blog post that highlights cities across the country with the best golf courses and ideal weather. I’m not directly selling my property, but rather I’m educating on what’s out there. My blog answers the questions of my target audience, who may be searching for answers online. The idea is that through education, transparency, and thought leadership, I have an excellent

platform through which to tell prospective customers about my property.

ALWAYS CONSIDER THE BUYER’S JOURNEY Another factor in campaigns is considering the buyer’s journey. Always write content for each stage of the journey, rather than just focusing on sales. What if a potential buyer reaches your site before the purchasing point, and is still gathering information on his or her options? For people at this awareness stage of the buyer’s journey, sales-focused content can be an agitation and mask any content that serves up information relevant to their needs because the potential buyer feels like they’re being “sold to” rather than “educated.” For instance, you don’t want a “Buy Now!” banner to be the first thing they see on your site, but rather accessible information about your property, its amenities, and the area surrounding the property. Content that takes both your personas and the buyer’s journey into consideration will be more relatable and effective.

GO AGAINST THE GRAIN TO DRIVE NEW LEADS ltimately, personas and the buyer’s journey lead to great content that drives new apartment leads to your property. The multifamily industry is competitive, making it crucial for your community’s content to go against the grain. Make an effort to stand out among the clutter by creating content; while many properties are taking to this method, it’s important to stay creative and provide unique, resident-specific content that highlights your community’s personality. While it can be tempting to want to present the maximum information that speaks to your property and reflects the positive aspects of your community, the best methodology is to hold off. Content is the core of how we are perceived online, and creating content that converts is the key to continuing quality lead generation for your property. By following a persona-driven content strategy those leads can become a reality.
