MANAGEMENT TRACK A Community/Apartment manager is responsible for the overall management of the community and to preserve and increase the value and integrity of the properties and to meet the financial objectives of the ownership and management. The Management Track is designed to enhance the skills that you need to complete the job of Community Manager. LEADERSHIP DEVELOPMENT The Leadership Development program offers blended learning from group activities to instruction in conventional classroom settings. CERTIFIED POOL OPERATOR, CPO Through the National Swimming Pool Foundation, AAGO is an approved provider of the CPO certification. This is a 2-day course which includes the certification exam.

Audience: Maintenance, Suppliers EPA REFRIGERANT HANDLING CERTIFICATION The Federal Clean Air Act, Section 608, requires that persons who service air conditioning and refrigeration systems containing certain refrigerants be certified under an approved Federal Environmental Protection Agency (EPA) approved course. Through the ESCO Institute, AAGO is able to offer this Universal Certification.

Suppliers are important liaisons to the multifamily housing industry. This program is designed as an opportunity for suppliers to hear the everyday challenges faced by the apartment manager customer. The CAS program is ideal for new salespeople as well as veterans of the industry. The Certified Apartment Supplier (CAS) course includes: Required Coursework: • Management of Residential Issues • Risk Management • Financial Management • Fair Housing CAS Prerequisites: You must have: completed the Supplier Success course; worked in the apartment industry for at least 12 months in a supplier role; successfully complete the four required courses (which total 26 hours); and meet all examination requirements within 24 months of declaring candidacy for CAS.

2019 Committee and Council Descriptions AAGO relies heavily on volunteer leaders from all walks of the apartment industry to execute its annual events and ensure the continued success of the organization. Committee volunteer opportunities provide AAGO members with valuable network channels, meaningful relationships with peers, and insight to the central Florida market. All AAGO members are invited to volunteer on the committee (or committees!) that best suits their talents and interests. Typically, the committees listed below meet on a monthly basis at AAGO. Unless otherwise noted, committee meetings are open to all AAGO members. If you would like to discuss your talents and how they could be best utilized at AAGO or if you would like to sign up to volunteer, please contact the AAGO staff liaison listed underneath the committee description!
Friends of the Foundation Committee: This committee assists with the AAGO Foundation’s philanthropic efforts, which include but are not limited to: Apartment Industry Job Shadow Day, the Charity Golf Tournament, the Summer Party Rock & Bowl Night, events with community partner organizations and the annual Toys for Tots drive. It focuses on fundraising in order to help the AAGO Foundation Charity Partners reach more people in need. It also provides hand-on experiences through volunteering time and giving assistance to those in the local community with a goal of bettering their lives. If you want a great experience networking with those in the industry who have a shared passion for helping others then this is the committee for you. AAGO Staff Liaison: Dominica Hurst, Office Manager/Bookkeeper dominica@aago.org Membership Committee: This body seeks to recruit new AAGO members and enhance the association’s reach in the central Florida Market. Development of apartment housing is critically needed in order to keep up with the influx of people moving to central Florida. This group meets on a regular, but not monthly, basis to discuss emerging issues of broad industry concern. Terri Dawkins
On April 19th, I attended the Leasing 101 course with AAGO. The instructor, Desiree, was absolutely amazing and such a great teacher. We kicked off the class by introducing ourselves and discussed what we hoped to gain from the course. I mentioned that I wanted to be able to be quicker at problem solving and to sell more effectively against my competition. Prior to attending Leasing 101, I tried to reflect on my consternations as a leasing professional. I recognized my apprehension with getting over objections and feeling more confident when doing my job. Desiree’s help in conjunction with the course materials of Leasing 101 helped me properly address and work towards moving past my workplace worry. Leasing 101 pushed me out of my comfort zone, giving me the opportunity to work with some of my market competitors. This allowed me to improve and sharpen my skills/ knowledge through direct discussion and feedback with others in the same capacity as myself. I thoroughly enjoyed this aspect of the class because I was able to expand my professional network. Upon completion of the class, I felt refreshed and filled with confidence. I left no longer fearing rejection from potential prospects and feeling much more equipped in my ability to be a successful and knowledgeable leasing professional. I’m so excited to take my career to the next level and move up the ladder with Timberland Partners. I’m already looking for opportunities to take more classes through AAGO. In the future, I’m hoping to participate in classes such as, advanced leasing and future leaders. I think that participating in these classes would allow me to further shape, develop, and reflect on my career goals, while giving me a well-rounded, solid foundation that will place them just within my reach. We read it, we hear it, we experience the effects of it, and we are an industry rising to address the challenge. Without even skimming the headlines above, we know that housing affordability in the central Florida market is far from a recent phenomenon. This crisis has been a topic of conversation for quite some time now, but when does talk turn to action? Widespread misconceptions about what affordable housing truly is, have led many citizens to associate the phrase “affordable housing” with large-scale public housing projects. This misbelief brings fierce opposition to new development, and apartments in general, as citizens left and right voice their discontent to local lawmakers about the potential burdening socio-economic effects “affordable housing” will impose on their community. Contrary to popular belief, affordable housing can take on a multitude of forms. Most commonly, affordable housing refers to market-based incentive programs such as the Low-Income Housing Tax Credit (LIHTC), and privately-owned housing that has the eligibility to receive a local, state, or federal subsidies or incentives. This allows for the market rent or purchase price to be brought down to a pre-determined and agreed to “affordable” level most commonly based on a percentage of the AMI (area median income). If you take a minute to envision these other not so frequently thought of forms, the only outlier between an affordable unit and the unit you live in becomes the price tag. Suddenly, it’s no longer finding a solution to affordable housing, it’s finding a solution to housing affordability. According to the Orlando-Kissimmee-Sanford Housing Market Analysis (HMA), the central Florida housing market is developing less than 1/3 of the units needed to keep up with rental housing demand. Breaking down the numbers, there are 31 affordable and available rental units for every 100 low-income renter households. As housing affordability and apartment availability continues to plummet, central Florida’s population is sky-rocketing. A recent study released by the Orlando Economic Partnership projects that 1,500 people per week will be to move the central Florida area over the next ten years. That’s an additional 780,000 people that will need housing accommodations. According to the U.S. Census Bureau, Orange County ranks #7 out of 4,000 counties in largest amount of population growth. Sustainable, market friendly solutions to the housing affordability crisis must be deliberated, discussed, and implemented. Now, springing into action, stakeholders involved in this long-existing discussion must take into account a multitude of variables and changing market trends that will play a major role in shaping the future socio-economic well-being of central Florida.

We are experiencing unprecedented levels of population growth, as well as, unprecedented demand for rental housing. Couple this with our almost nonexistent vacancy rates and increasing rents, we simply cannot keep up with demand. However, this is not just a central Florida housing market issue. We have begun spotting similarities in various housing markets across the state, as well as, across the country. A once long-dreamt piece of the “American dream” of settling down and buying a home is no longer on the forefront of American minds. The reality of the situation is that people are making an active choice to live in apartments. Apartment communities are convenient, they provide flexibility to residents, and we need to champion programs that bring more inventory into the market for our current and future residents. As the conversation of affordability continues to expand, we must offer solutions that provide our housing markets the opportunity to grow and flourish. Recommending and/or implementing “resolutions” that simply shift the component of affordability from the suppliers to the consumers, or vice versa, will not provide us with any viable long-term solutions. Gearing our efforts towards proposing sustainable, market-friendly incentives will present a stable foundation for the central Florida housing market to flourish and grow.

Lee Steinhauer, Government Affairs and Legal Counsel Osceola Sales Tax On May 21st, Osceola County held an election in an attempt to increase their sales tax by one penny to fund necessary transportation infrastructure. County officials claim the tax would raise $67 million annually which would go towards addressing the County’s well documented traffic woes. According to County officials, over 40% of the sales tax would be paid by non-county residents, as opposed to raising property taxes for the same purpose, which would leave Osceola residents and businesses to bear the burden. However, voters rejected the sales tax increase leaving Osceola County’s infrastructure problem unsolved. Inclusionary Zoning (IZ) Central Florida municipalities are increasingly exploring inclusionary zoning (IZ) to address housing affordability. IZ mandates new residential developments make a certain percentage of units affordable to low- or moderate- income residents, by offering units below market rate. Although this may sound good in theory, countless case studies demonstrate IZ increases the unaffordability of housing by driving up development costs and causing housing supply overall to drop. This past FL legislative session, FAA priority legislation HB 7103/SB 1730 passed the House and Senate and is awaiting the Governor’s signature. This important legislation places limitations on IZ. Significantly, a FL municipality mandating IZ must now provide incentives to fully offset all costs to the developer of its affordable housing contribution. As such, local governments can no longer force development through IZ to offer units below market rates without offsetting compensation. This represents a significant win for the industry, and for housing affordability generally. Emotional Support Animals (ESA) Despite the tremendous advocacy efforts by FAA members, unfortunately, FAA priority legislation HB 721/SB 1128 reducing Emotional Support Animal (ESA) Fraud and Abuse was not voted upon by the legislature before the end of session. Unfortunately, any legislation left unvoted on at the end of Session “dies”. However, FAA has every intention of refiling the ESA bill for the 2020 legislative Session.

Dear Harry, We have had trouble in the past when residents have been able to break their leases due to military orders. One actually broke her lease a few months ago and moved only a short distance away to base housing. Is there any way we can prevent this from happening or charge a lease break penalty? We are at 100% occupancy with a waiting list right now. If I have other qualified applicants, can I deny someone in the military? Signed: “Screening in St. Cloud” Dear Screening, Laws are in place which prohibit any type of discrimination against servicemembers or individuals who later decide to go into active duty with a branch of the military. Under Florida Statute 83.67(3), the landlord is specifically prohibited from discriminating against a servicemember in offering a dwelling unit for rent or in any of the terms of the rental agreement. Servicemembers have a number of special early termination rights under Florida and federal law not afforded to other individuals, but the landlord’s decision not to rent to a servicemember cannot be based upon these additional rights. The penalties for violating Florida Statute 83.67 are severe, including but not limited to a 3-month rent penalty and exposure to the servicemember’s attorney’s fees. Improper attempts to assess early termination charges against servicemembers who legitimately invoke early termination rights under state or federal law, or attempts to create special penalties under the lease for servicemembers who exercise their legal rights, will also expose the landlord to serious potential liability. Dear Harry, According to our company guidelines, if we have a married or single couple applying for residency, as long as one of the two applicants meets our financial requirement criteria, we will approve them for occupancy, but only put the approved individual on the lease as a signer with the other down as an occupant. sometimes we get requests by one party to be the lease signer, but the other wants to be listed as an occupant only. Recently we were filing an eviction, and our attorney told us that all adults should be lease signers regardless of who is approved. Is there any danger in only having the qualified person sign the lease? Signed: “Leasing in Leesburg” Dear Leasing, It is crucial that all adults are lease signers. While it may seem logical to have a person on the lease only as an occupant, it is not advisable. An occupant has all conferred rights of the tenancy but none of the responsibilities. If the non-signing occupant fails to follow the lease, you will only have recourse against the individual signing the lease. Sometimes, the lease signer vacates the premises leaving the adult occupant behind, or a restraining order is obtained against the lease signing resident. While it may seem that you can easily have the occupant removed, it actually becomes more difficult and complicated, as you now must file an eviction against a person that is not in occupancy of the apartment, and it is unclear what legal maneuvering the occupant may try to pull. It can get even more complicated if the lease signing resident dies. We have even seen situations in which the lone signer is inadvertently released, making for a very bad eviction situation in which no one is arguably responsible. More commonly, you may accept rent from the adult occupant, resulting in a quasi-landlord/tenant relationship being created, which can later complicate an eviction action. Unless the adult is a child of the resident or is in some way incompetent to sign the lease, all adults should always be lease signers, even if one does not meet your financial criteria. Dear Harry, One of our residents claimed that his car was damaged by our landscaper. Small rocks or stones supposedly thrown by the landscaper’s weed eater chipped the paint on one side of his new car. Our resident gave us an estimate from

the auto body shop for $450.00 to have the paint chips repaired, and my regional manager approved this with the condition that we would pay the shop directly once the repair was complete. I emailed all this information to the resident, who demanded that he be paid directly. Our resident was not happy with our response, never got the chips repaired, and is now suing us in small claims court. We were just served with paperwork, and a pretrial conference is set in four weeks. Should we fight this? Will we win? Signed: “Chipped in Chuluota” Dear Chipped, You can attempt to fight, but you will almost certainly lose. Once you told the resident that you would pay for the damages, you pretty much admitted liability, or at a minimum, obligated yourself to the resident. Conditioning the payment upon the resident getting the repair done first, with your property paying the repair shop directly, was unreasonable. If you were to get into a car accident, the at fault driver’s insurance company would be required to pay you directly, regardless of whether you decided to pocket the money or get the repair done. In the future, try not to allow situations to escalate to this level. Not only will you most likely have to pay the resident the $450.00, but since the resident filed the small claims action, you will also have to pay his costs of filing the case. If you want to fight, you most likely will be able to attend the pretrial conference without an attorney. If the apartment community is owned by a corporation, an officer of the corporation must attend, or an officer of the corporation must provide written authorization for an employee of the corporation to deal with all phases of the defense. In the end, you will have just wished that you cut a check and made this all go away. Dear Harry, One of our residents has an unauthorized occupant in her unit. We saw the unauthorized occupant all the time,
and this went on for two months. The unauthorized occupant even had the nerve to come into our office, complaining that the air conditioner in the unit was not cooling properly. We served a Seven-Day Notice to Cure for the unauthorized occupant, and the next month, since there was no attempt to get rid of the occupant, we served a Seven-Day Notice of Termination. We sent both notices to our attorney, and to our surprise, he said we don’t have a case. It seems that since we accepted rent in the month that we sent the file to the attorney, we somehow caused a problem. To make matters worse, upon some investigation, we actually had accepted rent from the unauthorized occupant in the form of a money order that was left in our drop box. Are we stuck with this unauthorized occupant? Signed: “Accepting rent in Apopka” Dear Accepting, You may indeed be stuck. Filing an eviction for an unauthorized occupant is ironically one of the most difficult cases, as you must prove the person is actually “living” there. The fact that you, another staff member, or another resident sees the person there all the time is not definitive proof that the person is actually residing in the unit as an unauthorized occupant. The resident will simply claim that he visits frequently. You did indeed make matters far worse by accepting rent during a continuing noncompliance, and moreover, by accepting rent from the person you believe is an unauthorized occupant. Once you decide to move forward with a Seven-Day Notice to Cure for a noncompliance, if the noncompliance is not rectified, you SHOULD NOT accept rent. If you do, you will not be able to file an eviction that month, and worse yet, maybe never. The concept is “waiver”. By accepting rent with knowledge of a continuing noncompliance, you have “waived” your right to terminate for that noncompliance. Let’s hope the lease is almost up so that non-renewal is a good option.

WHY LANDLORDS LIKE SURE FOOTED TENANTS One of the more common type of complaints arising out of landlord tenant scenarios is the “trip and falls” which is only outnumbered by the “slip and falls.” This article will examine a few recent cases which highlight why landlords like “sure footed tenants”: Clark v North Gables Building, LLC, Miami Dade County Case No: 13-3384 (Judge Anitonio Arzola October 17, 2018): Clark was 83 years of age and tripped and fell on a staircase inside the Defendant’s building. Clark asserted that the stairs were uber dangerous. In particular, he urged that they were too steep, lacked appropriate hand rails, had insufficient contrast and didn’t meet Code. Defendant argued that the fall was caused by Clark’s own negligence. The building was built in 1942 with staircases on either end and an elevator in the middle.The staircase have cement banisters that didn’t reach all the way to the ground. Clark claimed that his hand was on the banister as he walked down but he was not able to grasp the banister when it ended. He stated that there was one additional step after the banister ended and this caused Clark to fall. The applicable Code was the 1971 South Florida building code which required banisters to have griprails on each side. Clark stated that the 4” x 6” cement banisters didn’t meet Code. As a result of his fall, Clark suffered a femoral neck fracture requiring surgery and an “endoprosthetic” hip replacement. Clark claimed that he never fully recovered and was unable to fully care for his disabled son. He requested over $700k in damages. Defendant argued that even if the handrails violated the Code, the Defendant was unaware of the violation. Defendant also argued that Clark was not looking down and simply missed a step. It was pointed out that Clark had prior vision problems and could have used an elevator. Clark asserted that he didn’t know about the elevator and that he walked stairs to maintain his physical fitness. VERDICT: Clark was found 40% at fault and the Defendant was 60% at fault. Clark was awarded a gross verdict of $275,140 which reduced to a net $165,084 verdict. Arnado v The Graham Companies, Miami-Dade Case No: 14-22236 (Judge Rodney Smith September 19, 2018): Arnado sued Graham based on the allegation that Graham had allowed a dangerous condition in Arnado’s apartment. In particular, there was a

leaky bathtub that didn’t drain properly and this caused Arnado to slip and fall in his bathroom. Arnado testified that he was standing in water in the bathroom, reached for a towel and his feet slipped in the standing water. Arnado ripped the towel rack off the way and struck the porcelain soap holder. The soap holder stabbed him in the back and he was treated for a back laceration. Graham asserted that it did nothing wrong By: Kevin Knight and any problems were caused by Arnado’s negligence. Graham noted that Arnado and his wife had filled out a move in form noting that the bathtub was not properly draining. Graham asserted that they had fixed this issue a month later. Graham further argued that they had received no complaints from Arnado thereafter. VERDICT: The jury found Graham totally liable 100% and awarded Arnado $179,689. Marcus v Lang Management Company, Southern District of Florida Case No: 13-4258 (Judge Jaimie Goodman) Marcus asserted that Lang had negligently mopped the floors and failed to warn of the condition. As a result of Lang’s negligence, Marcus slipped and fell. Lang asserted that it was obvious that Lang was mopping the floors and Marcus had just failed to be cautious. When her feet slipped, Marcus struck a table and landed on the floor. Marcus suffered a rotator cuff tear of the right shoulder which she claimed was caused by the fall. Marcus also asserted that she aggravated a preexisting disc herniation in her cervical spine. As a result of her injuries Marcus had a neck surgery and a shoulder surgery. Lang indicated that its employees used large, noisy buckets on wheels. As such, Lang stated that Marcus was negligent for failing to take notice of the mopping. Lang also asserted that Marcus’ neck and shoulder conditions predated the accident and were no different after the accident. VERDICT: The jury found Lang 90% negligent and awarded $264,852 to Marcus which was reduced by Marcus’ 10% negligence. BOTTOM LINE/CONCLUSION: Landlords have to either be very sensitive to potential trip and fall and slip and fall hazards. Alternatively, landlords should make sure that their rental applications state “ONLY SUREFOOTED TENANTS NEED APPLY!” (kidding)…

Downtown Orlando Development Activity
Based on all the activity in downtown Orlando, we thought it would be a good time to give you a summary based on our observations. As of May 2019, there are 2,863 units that have either been approved or are in the process of being approved by the Municipal Planning Board “MPB” in all 7 areas of downtown that are illustrated in Figure 1. As shown in Table 1 below, of the 1,598 Apartments currently under construction in Downtown Orlando, 846 units are being added to the Parramore area, almost doubling the existing apartment inventory. The northeast area of Parramore is known as Creative Village which includes the new downtown Valencia/UCF Campus scheduled to open this August bring another 7,700 new students to downtown Orlando. Surprisingly, there are currently only 622 residential units in the entire downtown area that are in lease up. Obviously, if you’re an operator in downtown, you can pull the latest market rent and occupancy data from the AAGO/MyRentComps Online Market Survey. Even if all 2,863 units that are in the approval stage were built, Downtown Orlando would still only have a total of 14,775 residential units. Interesting 5-Year Downtown Apartment Growth Summary From 2013 to 2018, Downtown Orlando averaged approximately 464 new units per year which is arguably far less than what this market can absorb with its job base. Prior to 2013, the Downtown Orlando residential areas consisted of mainly Condos and Senior Apartments. Since 2013, rental apartments lead the new construction activity as we saw the rental; inventory grow from 4,030 to 6,644 as of today. The Unexpected Benefits of a Green Property By Ashley Tyndall Today’s renters have come to expect a level of sustainable features in their apartment home, from on-site recycling to energy-efficient appliances, in addition to more unique features like sustainable landscaping and bike-sharing stations. Green features that were once considered a potential “fad,” are now practically a requirement. According to the 2018 AMLI Residential survey, 83 percent of renters consider living in a green community as beneficial to their health, and 59 percent are even willing to pay more for this kind of designation. From short- and long-term investment returns to increased resident retention, there are many benefits for going green. Some studies even show that commercial and residential green buildings command up to 30 percent higher rent than non-sustainable buildings. Occupancy rates can also rise up to 23 percent higher for LEED apartments. Lower Construction & Maintenance Costs It’s no secret that sustainable living can lower energy and water bills. What is lesser known is that green features can increase durability measures, thus reducing long-term maintenance costs through improved moisture management. Efficient design can also lower construction costs by avoiding excessive waste and material use. For example, efficient construction techniques eliminate non-essential materials and provide structural integrity, which can provide more room for insulation and reduce costs. Save Water Owners can also limit storm runoff, lower irrigation costs and landscape maintenance, and lessen the impact on waterways through sustainable site-development practices. Additionally, waterefficient designs often lower owner costs for outdoor and common areas, as well as resident utility costs. Smart irrigation controllers ensure your plants are watered and verify that your systems are performing correctly. There are also opportunities to use native plantings and replace turf with drip irrigation. Improved Air Quality By using sustainable materials and new installation techniques, the building can benefit from enhanced indoor air quality and lower transmission of sound and odors between units. Eco-friendly construction methods and materials also reduce contaminants introduced into the apartment air thanks to low levels of volatile organic compounds in sealants, coatings, paint, and adhesives. 44

Further, some apartments are promoting high air quality by automatically tracking and adjusting temperature and humidity for occupants. Automatic temperature adjustments reduce the need to heat or cool an apartment by utilizing tempered air from outside. This not only helps increase resident comfort and create a healthy living environment, but it also enhances energy efficiency. Higher Resale Value Several studies have demonstrated that apartments and buildings near public transportation are often more valuable than similar properties without close access to rail lines, subways, and bus routes. Green homes within walking or biking distance of stores and popular attractions can also command higher rent, resident retention, and higher resale value. For example, many communities offer covered bicycle storage, on-site bicycle repair shops, or partner with a bike-sharing service as a convenience to their residents and to reduce greenhouse gas emissions. Some properties are also prioritizing onsite fitness studios, business lounges, and game rooms to prevent residents from having to drive off community grounds to access these activities. From refrigerators that monitor residents’ hydration levels, to smart homes that analyze a unit’s air quality, technology is continually advancing and making it easier for apartment communities to incorporate green features into their units. Sustainable living not only promotes healthy lifestyles but also increases energy efficiency and cuts costs.
