FROM OUR PRESIDENT AAGO Members It seems like I have been ending each week for the last 18 months with… “Well, that happened.” While this year may have been fraught with both challenges and opportunities we have proven that this industry is innovative, dynamic, and prosperous. And, in spite of what might seem like a constant string of “groundhog days,” our volunteer leaders and AAGO team members have been diligently preparing the association and the industry for success well into the future… I’m including a few sneak previews of these ongoing efforts below. AAGO turns 50 next year (even though we don’t look a day over 30). The 50th Anniversary Task Force, Co-Chaired by Lee Rogers and Debbie Gentry, is excited to celebrate our past and provide members with a vision for the next 50 years! Look for a special tribute and kick off of our 50th anniversary festivities at the Golden Key Awards this year on December 4th. If you have any special memories, stories, or photos you would like to share please send them to us FiftyYears@aago.org. 1,926 - that’s how many donuts were delivered in our August member outreach blitz organized by our Membership and Special Events Committees! In the words of the great philosopher, Homer Simpson, “mmmmm donuts.” Thank you to our Committee leaders Sarah Hawthorne, Jen Bell, Mallory Hoffmeyer, Michelle Lippai and all of the committee members who beat the streets to show appreciation for our members and promote upcoming events! Donut worry if you missed out this time as more engagement opportunities are in the works. Last month we also announced our 2021 Volunteers of the Year! Each year selecting folks for this recognition is like picking the perfect unicorn from a herd of unicorns. Congratulations to Mallory Hoffmeyer with RangeWater, our Management Volunteer of the Year and Josh Keller with RealFloors, our Supplier Volunteer of the Year! An additional shout out to my former colleague, Lori Agudo with Royal American, on her recognition as the AAGO Foundation Volunteer of the Year! We are looking forward to featuring Mallory, Josh, and Lori at The Golden Key Awards in December. You can learn more about these deserving super star volunteers in this issue of The Key. In May, the Board of Directors established the Diversity, Equity, & Inclusion Committee (DEI) as a standing entity as a demonstration of our commitment to foster an association where a diverse array of voices are lifted, supported, and celebrated. The DEI Committee, Chaired by Ricardo Alicea, has hosted a number of crucial conversations including the “Coffee Club” and most recently the Industry Influencers Series. This effort has not gone unnoticed, and we are excited to announce that AAGO was selected as an NAA Diversity & Inclusion grant recipient in September! The $10,000+ received will be matched by the AAGO Board and used to create a DEI Leadership Certificate in partnership with Valencia College’s Peace & Justice Institute, and to provide resources to bolster the DEI Plan of Work. I could not be more proud of the progress our association, our members, and our industry has made despite the odds this year. There are too many recent accomplishments and initiatives to feature in one letter, and that’s a pretty good problem to have! The best way to be “in the know” is to be involved in volunteering on a committee or offering your time and talent to the association. There is a place for everyone no matter your position, priority, or passion! Thank you for supporting AAGO and for the role you play in providing quality rental housing to residents throughout central Florida. I look forward to seeing you at Maintenance Appreciation this month at The Fun Spot (you know it will be awesome, because FUN is literally in the name) and at The Golden Key Awards in December! The CAPS designation speaks to my commitment to unwavering superior professionalism, upholding industry standards, and continued learning – merits that will boost my professional credibility. I am, however, driven by individual stories and the collective impact made on clients and the community. AAGO Awarded $10,600 NAA Grant
Grant Supports Diversity, Equity, & Inclusion (DEI) Campaign
THE ROI OF DEI AAGO and the Diversity, Equity, and Inclusion Committee are elated to announce that the association was selected as the top recipient, of three total grantees, of the National Apartment Association (NAA)'s 2021 Innovation in Diversity and Inclusion Grant Recipients sponsored by The Home Depot Pro. The grant gives us [the association] the ability to bolster momentum of our DEI efforts and further demonstrate our commitment to impacting lives and lifting the voices of underrepresented segments of the apartment industry. Over the last year and a half, our Diversity, Equity, and Inclusion committee has been hard at work putting together its 2021-22 Plan of Work. This grant provides the resources needed to advance, fund, and execute a few of the committee's top initiatives at the caliber they deserve. The committee workshopped its Plan of Work and identified priority projects that, if accomplished, would render the most tangible impacts for the industry and those underrepresented. The grant will be utilized to carry out the DEI Committee's Plan of Work including: Launch a Diversity, Equity, and Inclusion Leadership Academy
The association will be partnering with Valencia College's Peace and Justice Institute to develop a DEI "Leadership Academy." The Academy and its curriculum will be offered to AAGO members at no cost and facilitated by experts specializing in diversity, equity, and inclusion.
Conduct a Demographic Survey of Association Membership
The association will commission a research firm to conduct an anonymous demographic survey of AAGO membership in an effort to more thoroughly understand the diverse backgrounds of central Florida's industry workforce.
Our DEI committee will begin putting these projects in motion by the end of the year and additional information about their progress, timelines, and ways to get more involved in them will be made available via the AAGO website. We are eager to get to work on our 2021-22 Plan of Work and excited to utilize this funding to take our efforts and impacts to the next level. The AAGO Foundation’s Annual Fundraising event was a major SUCCESS. We raised $12,582 which was matched by an anonymous donor for a total of $25,164. IN OTHER NEWS BOD Approves Creation of Government Affairs Council During the August 2021 Board of Directors meeting, creation of the AAGO Government Affairs Council was formally approved. Its creation will play a crucial role in helping take our advocacy efforts to the next level. The Government Affairs Council will work alongside the AAGO Government Affairs Team and help formulate official positions on issues and identify and rank them by priority. With a multitude of evolving challenges and shifting political landscapes, approval of the GAC could not have come at a better time. The Council is currently "under construction," but will be made up of 12 industry leaders who serve in either a multisite role (property management) or have 5+ years of industry experience (supplier partner/professional service firm.) LANDLORDS RETURNED TO PRE COVID BUSINESS AS USUAL EVEN THOUGH COVID HASN’T RETURNED TO “PRE-COVID” STATUS Two very recent decisions by the U.S. Supreme Court are going to have a huge impact on tenants paying rent and landlords being able to evict. This article will review the cases of Chrysafis v Marks and Alabama Association of ReaLtors v Dept of Health and Human Services. By: Kevin Knight THE ULTIMATE RULINGS:
argued that the Center for Disease Control had reimposed the moratorium on evictions for properties participating in
CHRYSAFIS V MARKS: In this case, the plaintiff sought an injunction from the enforcement of Part A of the Covid Emergency Eviction and Foreclosure Prevention Act (CEEFPA). The court noted that part A of CEEFPA generally allows a tenant to “self certify” that they have a financial hardship and the landlord can’t contest it. The Court found that this violates the rule that “no many can be a judge in his own case.” As such, the Court granted the

WHY A SELF HELP EVICTION IS NEVER A GOOD THING EVEN IF THE COURTHOUSE IS “FROZEN” A lot of Florida landlords (and everywhere else for that matter) are very frustrated that the courthouse appears “frozen” for nonpayment evictions. There’s certainly a fear with the rise in Covid Delta variant cases that the courthouses will become even more locked down to nonpayment evictions than with the original Covid restrictions..
Coupled with the number of tenants who have racked up a large amount of unpaid rent, there’s a certain landlord mentality that maybe self help eviction is an “option to the courthouse.” It’s not. The recent case of Powers v Whitcraft 2021 WL 3084907 (Fla. 4th DCA July 21, 2021) makes this abundantly clear. We’ll consider the Powers case and learn from its cautionary tale. THE POWERS FACTS: Powers placed an ad on Craigslist seeking to rent a room for her and her teenage daughter. Whitcraft responded to the ad and advised that Powers and her daughter could stay with him in a house that he was renting for $600/month and ½ of the utilities. After moving in, Powers accused Whitcraft of acting inappropriately to Powers’ daughter. Powers contacted the police and the police came to the home to investigate. Whitcraft requested that the police remove Powers and her daughter from the home which the police declined. Whitcraft then elected to leave the rented home himself. After Whitcraft left, Powers woke a few days later to the electricity and water being shutoff and locks being placed on their boxes by Whitcraft. Powers called the police and she and a neighbor cut the locks in the police officer’s presence. A few days later, Powers came home and discovered the electricity was not work, that the landlord had entered the home and left the refrigerator door open. This spoiled Powers’ food and “soured” her on living in the home. The very next day Powers discovered that the water wasn’t working. THE POWERS SUIT: Powers had enough of Whitcraft’s actions and filed suit against Whitcraft pursuant to Section
83.67(1), Florida Statutes, which provides that: a residential landlord “shall not cause, directly or indirectly, the termination or interruption of any utility service furnished the tenant, including, but not limited to, water ... electricity ... or refrigeration, whether or not the utility service is under the control of, or payment is made by, the landlord”). Powers claimed that Whitcraft violated her rights 5 different ways which would amount to a recovery of $9k (3 months of $600/month rent x 5 violations). THE POWERS LAWSUIT TAKES A TWIST: The trial court determined that Powers didn’t prove that a landlord tenant relationship existed between her and Whitcraft and ruled in Whitcraft’s favor! POWERS COUNTER PUNCHES WITH AN APPEAL: Not satisfied with the trial court’s ruling in Whitcraft’s favor, Powers appealed the decision to a higher court (i.e., the District Court of Appeal). DCA DETERMINES THAT POWERS IS WHAT SHE CLAIMS TO BE: The DCA sided with Powers that she had a landlord tenant relationship with Whitcraft, was therefor a tenant and was entitled to seek recovery under Section 83.67. The DCA returned/remanded the case to the trial court to determine if Powers proved the landlord violated Section 83.67 and to determine the amount of damages to be awarded if Powers prevailed. MORAL OF THE STORY: A self help eviction creates an avenue of financial recovery for a tenant who may have not paid rent for several months. It hardly seems worth it. Even if the courthouse doors appear “frozen”, better to wait to evict than to indirectly or directly force the tenant to vacate.

About 88% of respondents claim they would use a pet care service and 73% are interested in home cleaning. Your marketing approach also needs to reflect these service-based amenities. While everyone loves a sparkling infinity pool, what really attracts and retains residents is knowing they live in an apartment community that cares about their specific needs and has an on-site security guard, an after-hours call number for maintenance emergencies, concierge services like dry cleaning and package delivery, and so much more. 44

MAKE IMPROVEMENTS BASED ON RESIDENT FEEDBACK No apartment community is perfect, and property managers can’t please everyone. However, the properties that don’t listen to their residents or make improvements will see the highest turnover. Negative feedback, left unanswered, has the power to turn into negative word of mouth.
