Industry Partnership with Valencia Community College & Talent Pipeline Development Maxcene Robuste, Carroll Maintenance Team Member of the Year Diligent, dedicated, and determined are just a few words that describe Maxcene Robuste. A recent graduate of Valencia College's Apartment Maintenance Technician Program (AMT), and Carroll's Maintenance Team Member of the Year, Robuste's charismatic passion for and commitment to his career is the epitome of if you love what you will never work a day in your life. We had the pleasure of sitting down with Maxcene to ask him some questions and learn more about his time in the AMT program, the influential role it has played in his current position with Carroll, and the hard work he has and continues to pour into his career and the apartment industry. Meet Maxcene Robuste In pursuit of a better life and the opportunity to establish a career for himself, Robuste emigrated from Haiti to central Florida in 2015. Although eager to jump-start his career, he took a position at a local hotel chain to support himself while working to expand his horizons. Robuste knew the opportunities that formal education could afford him and was determined to seize them. Like many others, Maxcene stumbled upon and into the industry unknowing of the potentials lying ahead. A close friend introduced Maxcene to Valencia College’s Apartment Maintenance Technician (AMT) program recruiter, Glenni Perez.

Perez walked Maxcene through the program curriculum in detail and shared his industry experience. It was not long after that Maxcene decided to enroll in the AMT program.

Shortly after graduating from the AMT program, Maxcene was offered a three-month internship with Carroll. Putting his newly acquired certifications and skills to use, Robuste had the unique opportunity of working at a handful of Carroll communities over a three-month span. Fulfilling the final piece of his career puzzle, Robuste was able to gain invaluable experience that inevitably solidified his career path. "I got so much out of my internship. I gained hands-on experience and perspective that not many maintenance professionals may have going into their first real job. If you are part of an onsite team, you do not really think about how an onsite team at some other community operates. Come to find, you can be doing similar jobs, but in two completely different ways." Robuste said. Carroll was thoroughly impressed with Robuste and upon completion of his internship, offered him a full-time position. Now, just shy of a year in his full-time role, Maxcene was named Carroll's Maintenance Team Member of the Year. 12

Always be the hardest working person in the room. During his interview, when asked what characteristics or qualities set him apart from the crowd, Robuste said prides himself on being just that. "I am a hard worker. Each day, I come to work and try to learn something new or find a way to improve on something I know already know. I want to be constantly improving."

Foot in the Door: Valencia's AMT Program Valencia Community College offers a variety of accelerated skills training courses, one being the Apartment Maintenance Technician (AMT) Program. Spread out over 10 weeks, students learn core skills and foundational knowledge that prepares them for a career in apartment maintenance. In addition, graduates complete the program with a handful of recognized and, most often times, required certifications including their EPA 608, CAMT, CPO, and OSHA 10. When we sat down with Maxcene, we asked him how the AMT Program helped him pursue his career in the Apartment Industry. He said that the [program] gave him the opportunity, skills, and connections he needed to get his foot in the door. "The AMT program gave me all of the baseline knowledge and skills I still use today. Having no prior industry experience, I was able to gain the knowledge and skills I needed to fix a variety of appliances, understand how to properly use technology to follow up on work orders, and much more. The program was the jump-start of my career." Robuste said his memory from the program was when he passed his first certification. "It showed me that all of my hard work was paying off. I'll never forget that day."

When Hard Work Pays Off: Maintenance Team Member of the Year Just a year into his full-time role, Robuste is honored to have been nominated and named Carroll's Maintenance Team Member of the Year. Receiving this recognition, Robuste says he feels like his hard work is starting to pay off and can not wait to see what his career's future holds. "To be recognized and receive a trophy for my hard work and dedication is so special to me. This has motivated me to work even harder. We currently don’t have a supervisor for my department so I am motivated to lead by example and show I am the man for the job. I would like to personally thank the Carroll management team along with my all of coworkers for this accolade. It is an absolute pleasure to work here!" We all reap the benefits of good work efforts and dedicated employees that go above and beyond to make communities feel like home and industry feel like family. We are honored to have had the opportunity to join Carroll in sharing and celebrating Maxcene's achievement. Co-Founded by Keli Lynch-Wright and her son Ashton Wright, Hatching hope was created to support residents that end up displaced from their homes due to fire or other disasters. The 2021 FAA Virtual Legislative Conference!

As the first-ever virtual Legislative Conference held by the Florida Apartment Association (FAA), this year's conference was especially unique. Members from all over the state joined their local affiliates virtually to caucus, discuss, and advocate on behalf of the multifamily apartment industry. Conference veterans and newcomers alike gathered around the Zoom room to meet with their state lawmakers and discuss our 2021 legislative priorities. Our members came to their meetings poised, professional, and prepared. Ready to discuss and answer questions about complex issues both impacting and important to our industry. We could not be more proud of all of their advocacy efforts.

What are our 2021 Legislative Priorities? 1. Protect and Preserve the Sadowski Affordable Housing Trust Fund A long-time legislative ask, we are urging the Legislature to use all Housing Trust Fund monies for Florida's housing programs, as well as, to provide resources for local rent relief funds. We encourage the Legislature to pass SB 510 (Hooper) and HB 13 (Killebrew) which would prevent the Legislature from diverting any cash balances in the Housing Trust Fund for other purposes.

2. Establish COVID-19 Liability for Housing Providers The pandemic has presented unprecedented threats of legal liability as housing providers' and other businesses continue to perform essential operations. We encourage the Legislature to pass SB 72 (Brandes) and HB 7 (McClure) to provide reasonable COVID-19 liability protections for businesses, including housing providers. 3. Tax Incentives for Affordable Housing This would give local governments another tool in their toolbox to address the need for affordable housing. Some local governments are unsure of their ability to provide tax incentives for affordable housing based on current statute as written. We encourage the Legislature to pass SB 674 (Rodriguez) and HB 563 (Rodriguez) to give local governments the green light to waive or reduce property taxes for affordable housing. 4. Clarify Fire Radion System Requirements Florida Statute 633.202 was amended in 2016 to give local government broad discretion to regulate fire radion systems for buildings within their jurisdiction. This has led to implementation inconsistencies and unintended consequences for property owners across the state. We are encouraging the Legislature to pass HB 587 (Snyder) to clarify fire radio system requirements for new and exsisting buildings.

THERE WAS A CROOKED MAN WHO WALKED A CROOKED MILE AND GOT AN EVEN RESULT…. When we grew up, we were read the story of the “crooked many who walked a crooked mile. Little did we realize that this story might bear fruit many years later with some literary adjustment. How about a “non crooked man” who didn’t walk a mile but did “walk a crooked sidewalk?” What then? What happens when the man happens to be a tenant and the crooked sidewalk is on the property where he lives? This article will examine the case of Kelley v Sun Communities, 2021 WL 37595 (M.D.Fla. January 5, 2021) which involves an all too common landlord/tenant matter.

THE KELLEY FACTS: Richard Kelley lived in Royal Palm for eight years at the time of his accident. While walking his dog on a sidewalk, he tripped and fell on an uneven sidewalk joint. He sued Sun Communities as the owner of Royal Palm. He asserted that Sun was negligent for failing to maintain the sidewalk in a safe condition. Sun failed to see the “error of its ways” and denied Kelley’s assertion of negligence. During the course of discovery in the case, several facts became apparent. 1. Royal is a 55-and-over mobile home community in Haines City, Florida.

7. Kelley had previously notified Royal’s maintenance technicians of his concerns over the sidewalk’s condition. Id. at 46–47. Such “notifications” were only in passing conversations and he had never formally complained in writing nor had anyone else to his knowledge. 8. On the accident date, it was a clear afternoon in May 2017.

2. Kelley lived in Royal for eight years before his trip.

9. Kelley’s trip and fall occurred on the return trip to his home.

3. Kelley would walk his dog around the neighborhood each day using the same route:

10. He characterized his trip and fall as a “lapse of concentration.”

(A) down the 20 yards of sidewalk in front of his home;

11. As a result of his trip and fall, he injured his left knee, had surgery and subsequent physical therapy.

(B) across a wooden footbridge to an open field; and

ROYAL’S MOTION FOR SUMMARY JUDGMENT: Based on the facts above, Royal argued that it was entitled to summary judgment because Royal was not negligent, had done nothing wrong and the uneven sidewalk was not a dangerous condition.

(C) Kelley and his dog would then turn around and walk the same route back home. 4. Kelley was quite familiar with Royal’s grounds at Royal Palm; 5. Kelley had never tripped during any of his previous walks 6. Even so, Kelley thought the sidewalk needed

repair, especially one joint between two of the concrete slabs which was uneven and slightly raised.

THE COURT’S RULING ON ROYAL’S SUMMARY JUDGMENT MOTION: The Court agreed with Royal and granted Royal’s Motion For Summary Judgment. The Court finds that the uneven sidewalk joint was not a dangerous condition. Therefore, the Community did not

breach its duty to maintain the premises in a reasonably safe condition. In making its ruling, the Court noted that: 1. To sustain a premises liability action based on a landowner’s negligence, a plaintiff must prove the standard elements of a negligence claim: duty, breach of duty, proximate causation, and damages—with the added element that the landowner had possession/control of the premises when the alleged injury occurred 2. A landowner owes an invitee to the premises two distinct duties. The landowner must (1) “warn [the invitee] of concealed dangers which are or should be known to the owner and which are unknown to the invitee and cannot be discovered through the exercise of due care”; and (2) “use ordinary care to maintain its premises in a reasonably safe condition.” 3. The Community admits that it owed Kelley both duties but contends it is entitled to summary judgment because it did not breach either duty as a matter of law. The Community asserts that the uneven sidewalk joint was an open and obvious condition—relieving any duty to warn—and was not inherently dangerous—meaning it did not constitute a violation of the duty to maintain the premises in a reasonably safe condition. 4. Indeed, the Community had no duty to warn Kelley. A landowner has no duty to warn when a potentially dangerous condition is open and obvious, or when the plaintiff had actual knowledge of the condition. 5. Several other Florida appellate court opinions have held that a cracked or deteriorated sidewalk can constitute a dangerous condition or can at least raise a factual dispute over whether the landowner breached its duty to maintain the premises. These cases, however, are distinguishable. In each of these cases, the courts described the sidewalk as severely cracked, deteriorated, or otherwise in a state of disrepair. Based on evidence presented

regarding the condition of the sidewalks, including photographs of the sidewalks in Lotto and Middleton, the courts found that issues of fact remained over whether the landowners could have expected that residents would continue to use the sidewalk, encounter the cracked and uneven portions, and suffer harm as a result. 6. But this is not a case of a dilapidated or deteriorated sidewalk. The photograph in the record makes this clear. Aside from one uneven seam, the sidewalk appears to be an otherwise pristine walking surface and not unreasonably hazardous. 7. A more similar case is Kersul v. Boca Raton Community Hospital, Inc., 711 So. 2d 234, 234 (Fla. 4th DCA 1998). But it too is distinguishable. There, the plaintiff tripped and fell over an uneven sidewalk joint on the hospital premises. The trial court entered judgment for the landlord. The appellate court reversed finding there was conflicting evidence over whether the danger posed by the uneven sidewalk was “open and obvious.” Id. There is no such conflict in this case. 8. In sum, the Community did not breach any duty it owed Kelley. The section of the sidewalk Kelley tripped over was an open, obvious, and otherwise harmless condition. The law imposes on a landowner the duty to mitigate unreasonable hazards on the property. It does not require the landowner to foreclose all risk that an invitee will injure himself during an inattentive moment. The Court likewise will not impose such a burden on the Community. MORAL OF THE STORY: Buy a camera for when things go bad. Or someone else tells you it went bad. Start “snappin” the moment the “bad thing happens.” And don’t stop until you get enough (as that scholar Michael Jackson told us in song) that it’s apparent what happened and how it happened. It might spell the difference between a long, protracted lawsuit that ends in a trial on damages and a lawsuit that “goes nowhere” because pictures don’t lie since “every picture tells a story, don’t it? (as Rod Stewart assured us in song).

The saturated multifamily market is making it ever-more challenging for brands to stand out with a unique voice or selling point. For apartment marketers, a lot of effort goes towards differentiating your community from the rest of the multifamily properties in your market. This generally includes frequent social media posts and an updated apartment website focusing on onsite amenities and features. However, there is one important aspect that can be overlooked: branding. Developing a brand identity is an essential element when setting yourself apart from the competition. Identifying who your brand is and who it relates to sets the foundation for building a strong brand that will stay consistent — from the brand’s digital presence all the way down to its business cards. The Essential Keys to a Brand Identity A brand identity is the meaning behind your logo and other apartment marketing elements. It tells potential and current residents who you are and what you represent. This includes the branding materials created by your company that convey your personality, and include logo, colors, fonts, and positioning statement. Without a brand identity, you run the risk of confusing your target audience because you lack a consistent image that is easily identifiable and relatable. The keys to a good brand identity are to make it distinct, memorable, scalable, cohesive, and easy to apply. It is important to carefully consider each element of your brand identity, and pull inspiration from companies that have had great success with their identities. Interbrand’s Best Global Brands 2019 names the Top Ten Global Brands as: 1. Apple 6. Samsung 2. Google 7. Toyota 3. Amazon 8. Mercedes-Benz 4. Microsoft 9. McDonald’s 5. Coca-Cola 10. Disney The above brand list likely brings instant perceptions to your mind — likes and dislikes, experiences, how they make you feel. While these are the most iconic brands in the world, they didn’t start out that way. They reached those levels slowly and painstakingly over time. Building a strong multifamily brand identity requires consistency and repetition. For the most successful brands, the brand

experience delivers on consumer expectations time and time again. How to Develop a Brand Identity If you do not see the value in establishing a strong brand for your multifamily business, you can be sure someone else is doing it for you. As CEO of Amazon Jeff Bezos says, “Branding is what people say about you when you’re not in the room.” Without a clear message, you open yourself up to the public dictating what your brand is. Not responsive enough online? They may think you are hiding something. No clear values set? They may think you have no consideration of social consciousness or a vision. Research and Discovery The first step to creating a brand identity is research and discovery. As with any good marketing element, it takes understanding your audience and their needs, wants, and values. Understand what appeals to them, and make sure to include relatable elements in your brand identity. Reevaluate Your Existing Brand Reevaluate your existing brand by considering the elements that have been successful and those that haven’t, and learn from the process. Research your direct competitors to see how they identify their properties and who their target audiences are. By digging into your own existing brand elements, those of your competitors, and the needs of your audience as the first steps in developing a brand identity, you will be better positioned to create something strong and unique. Identify Your “It” Factor & Capitalize On It While many management companies follow an apartment marketing plan from the top, it is critical to identify your “it” factor at the property level. Perhaps you are ecofriendly with green amenities and a lush community garden, or maybe you boast modernity with tech-driven equipment and amenities. Discover if there is a strong key element that sets you apart from the rest of the competition and capitalize on it. The Impact of a Multifamily Brand Identity After you have spent time brainstorming and developing a strategic brand identity, it’s time to put it to use. A strong multifamily brand identity is vital when differentiating you from your competitors and gaining awareness. The multifamily space can get crowded and you are probably competing for similar residents as other properties; a brand identity can help you stand out. Ultimately, a well-thoughtout brand identity will resonate with potential residents and drive them to your property, resulting in more initial leases and higher revenue. april/may/june 2021

Apartment Demand in Greater Orlando By Jordan Brooks ALN Apartment Data

Although 2020 was undoubtedly a turbulent year for multifamily, apartment demand began to rebound from its dismal levels in the spring and summer during the latter half of the year. Fortunately, this resurgence has continued through the first two months of 2021. In fact, multifamily demand for the Greater Orlando area was higher in January and February of this year than in that same two-month period for any of the last five years.

Class B properties also saw an increase in net absorption, though not quite to the same extent as in the top tier. Approximately 550 net units were leased that were previously unoccupied, an improvement of 70% from January and February of 2020.

With this in mind, let’s take a closer look at the demand picture from these first two months of the new year for Greater Orlando. In doing so, only conventional properties of at least 50 units will be included.

In the lower two tiers gains were realized as well. For Class C, 200 more units were absorbed this year than in the same period last year. This represented an increase of more than 90%, and all told, more than 400 net units were absorbed in the first two months of the year. For Class D properties, only around 30 net units were absorbed. Even so, this is a clear improvement from last year when nearly 200 net rented units were vacated in the period.

Overall Demand Net absorption, defined as the net change in the number of rented units for a period of time, was a little more than 1,600 units so far in the new year for the area as a whole. As already stated, this compares favorably to recent years. This was especially the case compared to 2020, when net absorption for the first two months of the year totaled barely more than 500 units. By taking the number of units absorbed as a percent of total market stock, we can adjust results for market size. By this criterion, Orlando places just outside the top 20 markets nationally -- in the number 21 slot to be exact. Price Class View One perspective from which some apartment demand differences can be more clearly identified is from that of price class. ALN assigns each conventional property of at least 50 units to a price class A through D based on average effective rent per square foot percentile rank in a market. Class A demand rebounded most compared to the same portion of last year. Just more than 600 net units were absorbed in the top tier after only about 150 net rented units were added last year. This strong resurgence in demand was timely because new supply volume also increased in the period.

Submarket View A few specific areas stood out from the larger market regarding apartment demand. The first of these was the Kissimmee submarket south of Orlando. More than 450 net absorbed units in the first two months of 2021 was more than double the total from those months last year. Another region of Greater Orlando that stood out was the Hunters Creek – Dr. Phillips – Airport submarket south of downtown Orlando. In this region, net absorption of around 400 units was double that of last year. One other area of interest should be mentioned regarding multifamily demand. The DeLand – Orange City submarket is a small one, and so the approximately 60 net absorbed units does not appear to be of particular note. However, the area suffered a net loss of rented units in the same portion of 2020 almost as large as this year’s gain. Additionally, when evaluating the same size-adjusted metric for demand based on submarket unit count that was previously mentioned at the market level, this area had the second-highest value among the 13 ALN submarkets for Greater Orlando.

Takeaways The apartment demand picture for Greater Orlando is a brightening one. The resurgence that began last year has continued into the new year. More than that, the positive results are not particularly concentrated in only one price class or in just a couple of submarkets. In some respects, improvement in demand for Class B properties somewhat lagged the other tiers. This could be an indication that the price sensitivity dynamics that emerged last year are still very much at work. Residents that can afford Class A rents have enjoyed elevated lease concessions in those properties (though changes are emerging there as well) while some of the more price conscious residents have opted for the savings of Class C properties. Out of Orlando’s 13 submarkets, only one, the Clermont area, underperformed in demand compared to the same portion of last year. Even there, the difference was less than 100 units. It is certainly an encouraging sign to see such widespread improvement across the market as a whole so far in 2021. Looking ahead, the new construction pipeline will not be slowing in 2021. As a result, it will be important to maintain

the positive demand results from the start of the year. With the continued rollout of the COVID-19 vaccine and the level of economic re-opening the state has managed to maintain thus far, that prospect appears favorably positioned.
