The Sales/Leasing and Marketing tracks are designed to give you the skills you need to communicate the benefits of your product and service and to respond to a potential customer’s buying signals. AAGO education CERTIFICATION PROGRAMS

The Apartment Association of Greater Orlando is proud to offer several nationally recognized certification programs to its members. These programs are taught by certified instructors and testing is done on site. CERTIFIED POOL OPERATOR, CPO Through the National Swimming Pool Foundation, AAGO is an approved provider of the CPO certification. This is a 2-day course which includes the certification exam.

• Financial Management • Research Prequisite: You must have worked in the apartment industry for at least 12 months; successfully completed the nine courses listed below (which total 55 ½ hours)and meet all examination requirements within 12 months of declaring your candidacy for CAM.

Audience: Maintenance, Suppliers EPA REFRIGERANT HANDLING CERTIFICATION The Federal Clean Air Act, Section 608, requires that persons who service air conditioning and refrigeration systems containing certain refrigerants be certified under an approved Federal Environmental Protection Agency (EPA) approved course. Through the ESCO Institute, AAGO is able to offer this Universal Certification. Audience: Maintenance, Suppliers NATIONAL APARTMENT ASSOCIATION DESIGNATION PROGRAMS The multi-family housing industry is growing. Competition is fierce and multi-family housing professionals face more challenges than ever before. You can’t afford to overlook the benefits of an industry designation. Education programs and designations sponsored by NAAEI are the premier offerings for multi-family housing professionals. Each course and program has been carefully crafted and tailored to meet the ever-changing needs of today’s multi-family housing professional.

The National Apartment Association Education Institute (NAAEI) offers this nationally recognized designation for Multi-site supervisors and experienced apartment managers with a CAM, ARM or RAM designation. CAPS training covers: • Legal Responsibilities and Risk Management • Financial Management • Property Performance Management • Property Evaluation and Due Diligence

AAGO education • Effective Leadership Prequisite:you must have worked as a multi-site supervisor for 24 months or be a CAM, ARM or RAM designate in good standing with 24 months of management experience; successfully complete the five courses listed below (which total 40 hours); and, meet all examination requirements, within 24 months of declaring your candidacy for CAPS.

Suppliers are important liaisons to the multifamily housing industry. This program is designed as an opportunity for suppliers to hear the everyday challenges faced by the apartment manager customer. The CAS program is ideal for new salespeople as well as veterans of the industry. The Certified Apartment Supplier (CAS) course includes: Required Coursework: • Management of Residential Issues • Risk Management • Financial Management • Fair Housing Time: 9:00 am- 5:00 pm for each module Cost: $549 Member $649 Non Member 10% off for A-APASS CEC: 6 CAS Prerequisites: You must have: completed the Supplier Success course; worked in the apartment industry for at least 12 months in a supplier role; successfully complete the four required courses (which total 26 hours); and meet all examination requirements within 24 months of declaring candidacy for CAS.

STATE On January 31st, over 40 AAGO members traveled to Tallahassee for the Florida Apartment Association’s (FAA) Legislative Conference. While in our state Capitol, AAGO members met one-on-one with members of the Florida Legislature and their staff to discuss a variety of policy issues. Please join AAGO in thanking all of the members who traveled to the Capitol for this annual advocacy opportunity. Their willingness to be a voice for the industry made a positive impact on all of the public policy issues FAA and AAGO are tracking this legislative session. This year’s Legislative Conference focused on defending the Sadowski Affordable Housing Trust Fund, promoting renters insurance, and protecting doorstep trash services.

As we approach the end of this year’s session, below is a brief recap of the items to watch in 2018.

Sadowski Affordable Housing Trust Fund The Senate’s proposed budget would fully fund affordable housing and allocate $120 million to affordable housing projects. On the other hand, the House budget proposes only $74 million in funding for affordable housing programs that benefit Florida’s most vulnerable populations (The elderly, homeless, and those struggling economically). Before the end of this year’s session, the two chambers must come to an agreement regarding affordable housing resources.

Renters Insurance Senate Bill 678 and House Bill 467 would require apartment communities to specify whether or not they require their residents to carry renters insurance and what types of coverage must be secured. House Bill 467 is currently on first reading on the House Floor. The Florida Apartment Association supports this legislation because it will reduce misunderstandings between apartment communities and residents with regard to responsibility and liability in the event of property damage due to natural disaster or other emergency event.


AAGO Advocacy Doorstep Trash Services AAGO members who traveled to the Capitol on January 31st were lucky enough to see their advocacy in action firsthand when House Bill 529 passed the Florida House. If signed into law, this legislation will clarify the legality of the trash collection services in Florida’s Fire Prevention Code.

ADA Reform Passed the U.S. House of Representatives

On behalf of the AAGO Legislative Committee and Board of Directors, thanks to everyone who took time out of their busy schedule to reach out to members of Congress about this legislation. Now, NAA will focus on securing the votes needed to pass this legislation in the U.S. Senate. AAGO members will be making the push to support this legislation at NAA’s “Advocate” Conference in March when they travel to Washington, D.C. to meet with federal policymakers on a variety of issues.

On February 15th, H.R. 620 passed the U.S. House of Representatives by a 225-192 vote. If signed into law, this legislation will help to curb ‘drive-by’ lawsuits under the Americans with Disabilities Act. According to the National Apartment Association (NAA), over the course of three days, members reached 55% of the U.S. House of Representatives to share their support for the bill. There is no doubt that this grassroots advocacy from AAGO members and other NAA affiliates helped get this fill across the first finish line in the House. This is why every call and email sent to your legislators is

RECENT VERDICTS IN LANDLORD TENANT SCENARIOS We tend to focus on verdicts in factual scenarios that do arise, or could easily arise, in a landlord/tenant scenario. Seems to make the most sense; offering the proverbial “cautionary tale” of what not to do/do to avoid a similar legal “castrophe.” We continue: Harris v. PBH Mayport, LLC, Duval County Case No: 16-2015-CA-2989 (July 17, 2017): Plaintiff was a 42 year old tenant who allegedly complained about a crack in one of the stairs leading from the second floor to the first floor. According to the Plaintiff, the Landlord inserted a screw into the tread, rather than replacing it. Within a month after she made the complaint, the tread bowed upwards. This reduced the distance between steps and led to the Plaintiff falling approximately seven steps as she was descending. As a result of the fall, Plaintiff suffered an aggravation of a lumbar herniation which then required extensive treatment. The Landlord countered by asserting that the Plaintiff failed to walk with adequate care and was also negligent. At trial, Plaintiff offered the opinion of an expert architect that the Landlord’s installation of the screw worsened the

tread issues on the stairs and violated the applicable housing codes. Plaintiff claimed that she had done nothing wrong and was not negligent. Plaintiff had a prior, long-term history of lower back problems By: Kevin Knight which she was just a dull ache. Records revealed that she had received injections and chiropractic treatment prior to the accident for her lower back. Plaintiff claimed her fall caused her to need more injections and several radio ­frequency ablation procedures (i.e., burning the nerves to decrease or eliminate pain sensation). Plaintiff asserted that she would need significant care in the future. Plaintiff claimed that her injuries impacted her pre accident job duties of working with disabled clients, including at least one Special Olympian. Plaintiff did not make a wage loss claim and testified that she was a single mother of three children ages 12-21. VERDICT: The Jury obviously liked the Plaintiff, found the Landlord 100% liable and awarded the Plaintiff $2,280,000. Piotroski v Freed, Miami-Dade Case No: 2015-1337-CC05 (May 16, 2017):

Plaintiff was a tenant who made some repairs to her unit after the Landlord orally promised to reimburse her for the repairs. Plaintiff contended that the Landlord breached his agreement by failing to pay for the repairs made by the Plaintiff.

Defendant argued that the parties had agreed that Plaintiff would be given a $2,600 credit only and that Homeowners’ Association had a separate agreement for the Association to pay for repairs not covered by Defendant. VERDICT: The jury found for the Plaintiff on both unjust enrichment and quantum meruit claims. Plaintiff was a warded damages of $8,000 on each claim. Plaintiff had sued the Landlord asserting breach of contract, unjust enrichment and quantum meruit. BOTTOM LINE: These two cases illustrate/confirm that landlords should: (1) get every agreement in writing; and (2) make sure that any repairs are professionally/ responsibly performed. In the Harris case, a “simple screw” installed improperly led to a $2 million dollar verdict….which amount could have bought a lot of repairs (and even a few screws to boot!).

Organize, Don’t Agonize: Simplifying Trial Preparation You were reasonable. You made concessions. This should be a simple dispute to resolve. However, the tenant has different plans. Trial is imminent. The dreaded email with the attached Notice of Hearing always elicits the same response: a sigh, and a seemingly endless flood of legal questions. Understanding how to prepare for trial can ease this anxiety, and improve chances of a favorable outcome.

testify. Walking through the issues with your attorney, and identifying the best person to testify for each issue, should be part of the trial preparation.

Florida Rules of Evidence: Testimony and Hearsay It can be frustrating to participate in a court hearing, and not understand the formalities (that sometimes seem to fall outside the realm of “common sense”). A little insight into the Florida Rules of Evidence puts things in perspective. A roadblock to presenting evidence to the court is “hearsay.” Hearsay is not a legal term that can be easily summarized. The definition itself is carefully crafted. Hearsay is “a statement made out of court that is offered into court as evidence to prove the truth of the matter asserted.” The legal theory is that most statements out of the courtroom are deemed untrustworthy; and therefore, are not allowed. This begs the question, “How do we get any evidence in front of the judge?”

The Payment Ledger: Records of Regularly Conducted Business Activity The most common reason for an eviction proceeding is non-payment of rent. The payment ledger is the star piece of evidence in this matter. The ledger should have a chronological accounting of the rent that came due, and all the payments made. The amounts due should be clear and definite. The person testifying to the ledger needs to have a healthy understanding of the software used, how the accounting is kept, and explain any irregularities if they exist. The payment ledger is considered a record of a “regularly conducted business activity.” The business activity is collecting rent, and the ledger is a business record. “Records of regularly conducted business activity” are a statutory provided exception to hearsay. Your attorney will ask you to identify the record, and will specifically ask if the record is kept “in the regular course of business.” After your affirmative response, you jump the hearsay hurdle, and are in the door. Payment ledgers can be offered as evidence.

The Property Manager is the quintessential jack-of-alltrades, but some of those duties have to be delegated. The Property Manager should not be the “point person” for court appearances if there is someone more qualified to testify. The person collecting the rent is the best person to testify about rent collecting. The person preparing and posting the Notice to Pay, would be best suited to testify to the notice. In a deposit dispute, the person that conducted the walk-through at move in, and the person that conducted the walk-through at moveout, may not be the same person. Ideally, both would

The Notice to Pay (aka The Three Day Notice) The Notice to Pay is another crucial piece of physical evidence. Make sure to know (1) when it was posted; (2) the rent due date on the notice; and (3) confirm that the rent was not paid during the notice to pay period. If partial rent is paid, a receipt must be issued, and a new Notice to Pay posted with the new amount and date due. Make sure to be able to clearly discuss the steps taken in the issuing of the notice or notices. Notices to Pay are generally accepted under the records exception discussed above, but some judges require that the person that

posted testify. It would be worth following up with your attorney about that possibility, and touching base with the person in the office that does the notice preparation and posting. The Lease Agreement: Where It Begins Everything starts with the lease agreement. The breach of that lease is what brought us all together. It also deserves some pre-trial attention. The lease is the first line of defense in any Landlord/Tenant dispute. The lease states the amount of monthly rent, when the rent is due, and when rent is considered late. There are paragraphs dedicated to what is considered rent (late fees, utilities, amenities, etc.). Pages are dedicated to rules and regulations. A good once-over of the lease in preparation for trial will help keep things fresh for recall, and keep the flow of the trial moving forward if required to specifically point out provisions in court. The Time-Line of Events: Tying it All Together Litigation is not cheap, but there are ways to assist your attorney, and cut down on significant attorney fees during trial preparation. When it appears that trial is unavoidable, there is a knee-jerk reaction to scoop up any and every piece of information related to the litigated situation. This results in a sizeable “data dump” on your attorney. The attorney and her paralegals sift through emails and notices; payment ledgers and seven day notices to cure; maintenance requests and application files. Some of the information is electronic, and some paper. Sometimes all of it is relevant, and sometimes very little is needed. What does an attorney do with all this information? A well-prepared attorney constructs a time-line to make sense of the data, and make the evidence presentable to the court. This time-line is appropriately papered with the corresponding emails, notices, letters, and ledgers. This is a lot of billable attorney time, but there may be someone better suited for this time-line construction – the person that lived it; i.e. The personnel

that communicated the most with the problem tenant. This person would have the most accurate recollection of receiving and recording the documentary evidence. Enlisting this person to help construct the time-line would result in the most accurately reconstructed timeline, and decrease attorney fees. Secretly, your attorney will thank you. Trial Preparation Checklist A better understanding of a few rules of evidence and a short explanation of key testimony points make the entire process more palatable. And, everyone can always benefit from a brief checklist: 1. Make sure the correct person from the office is present to testify to contested issues. 2. Bring a written payment ledger, and be able to account for everything on the ledger. 3. Be familiar with the lease, and be able to identify the provisions by paragraph. 4. Be familiar with the Notice to Pay. 5. Bring any other documentation to support contested issues (i.e. maintenance records, notices to cure, etc.). 6. Why Real Estate is Ready for Content Marketing By Ashley Tyndall Real estate is a game of risks and rewards. It’s a strategic bet by each developer that each project will generate the buyers, leasees, or tenants necessary to yield a return on their investment. In today’s crowded market, it’s never been more important to differentiate your property and generate leads (and ultimately customers). Marketing in real estate has historically been viewed as a cost center rather than a business builder. The perception is that marketing is necessary, but also expendable. It’s often diminished to a building logo or a flowery brochure. When you need to tighten the belt… goodbye marketing! The glaring oversight is that real estate marketing rarely differentiates between its audiences (whether by generation, geography, or lifestyle); nor does real estate marketing leveraged as a tactic for achieving measurable business goals. Let’s take a quick glance at the current environment… What does marketing in real estate currently look like? • One size fits all. When was the last time you were excited about wearing a piece of clothing that says “one size fits all?” Historically, real estate has used a copy-paste strategy when marketing apartments. It recycles old messaging and doesn’t take into account the resident or the lifestyle. • It seldom harnesses new technology. Direct mail? Brochures? Sales speak? The rise of technology and a new age of consumerism has made some of these traditional promotional techniques extinct. The industry has seldom taken advantage of digital platforms, despite these being used by their target audience. • It lacks measurement. With new technology comes the ability to track, trace, and affect the bottom line. What kind of ROI is your marketing producing? What is content marketing? Traditional marketing focused on disruptive tactics. TV commercials and radio programs have become less effective with the invention of the DVR and internet radio—not to mention, today’s consumers are averse to traditional sales speak. Content marketing or inbound marketing takes a drastically different approach. Content marketing meets prospective customers by providing helpful information about the topics they’re already searching for. Let’s take a baby boomer, for example. He’s nearing retirement and sits down at his computer to search for “Best retirement cities in the country with golf all year round.” If I’m a residential resort community that practices content marketing, I’ve already anticipated what my best prospects will be searching. Throughout the past few months, I’ve been blogging about 44

relevant topics, including a recent blog post that highlights cities across the country with the best golf courses and ideal weather. I’m not directly selling my property, but rather I’m educating on what’s out there. My blog answers the questions of my target audience, who may be searching for answers online. As highlighted above, you are not blanketing the market with collateral material and wasted dollars that may land on the doorsteps of folks no where near the buying process. It is a strategic alignment of tactics that surround your business goals. The inbound technology allows you to see real-time data on valuable metrics. By monitoring increased traffic to your site, you can determine the amount of visitors that have further engaged: How many qualified leads did we drive? How many of those leads turned into tenants or customers? From there, you can associate dollars spent for dollars earned—direct ROI. • It meets your best prospects where they are. Increasingly, all generational cohorts are using the internet and social media to do research for all of life’s buying decisions, big or small. With the ease of gaining information at their fingertips, your prospective clients are expecting you to provide this information through this conduit.
