MESSAGE FROM THE CHANCELLOR
HEADER SUB-HEADER
Welcome to this important day in the life of the University of the Western Cape. Today we celebrate you, our graduands, and we honour the discipline and perseverance that have brought you to this point. We also acknowledge those who have supported you along the way, especially your parents, guardians, families, friends and loved ones. Reaching this day has taken sacrifice and determination. For many of you, the journey has not been easy. There were pressures and moments of uncertainty. But you continued, and today we recognise what you have achieved.
You enter the world at a time of great complexity. Across the globe, many societies are living with conflict and socioeconomic strain. Many are also affected by division. Here in South Africa, we continue to face inequality, unemployment and the unfinished work of building a more just and inclusive society. These issues influence the daily lives of millions of people, especially those who continue to live on the margins. Yet there is still hope for humanity in those who continue to care for others and for the world we share.
That is why your education is so important. It is indeed for personal advancement, but it is also for service. It is part of the work of restoring dignity and widening opportunity. It is also for helping to build communities in which people can live with hope. Your degree is an achievement to be proud of, but it also comes with responsibility. As UWC graduates, you are part of a university guided by courage and critical thought. It is also a university with a strong sense of social purpose. Whatever path you follow from here, I hope that will remain with you. Use what you have learned with integrity. Do so with generosity and a clear sense of justice.
Ubuntu recognises that our lives are bound up with those of others. In a time when many people still feel excluded or unheard, that understanding still holds. The world needs graduates who are capable and thoughtful about how they use their knowledge and how their choices affect others. Congratulations on all that you have achieved. May you go forward with confidence and a sense of responsibility to others. God bless.
Daarom is jou opleiding so belangrik.
In ’n tyd wanneer baie mense steeds uitgesluit of ongehoord voel, geld daardie begrip steeds.

Dear Graduands,
MESSAGE FROM THE RECTOR
HEADER SUB-HEADER
Few moments in university life speak more clearly to the purpose of higher education than graduation. It is a time to celebrate achievement. It is also a time to recognise discipline and perseverance, and to acknowledge the support of families, friends, lecturers and mentors who have walked this journey with you.
Your graduation comes at a time when South Africa, and the world, continue to face serious challenges. We are living through a period of socioeconomic pressure and technological change. It is also a period affected by conflict, persistent inequality and climate instability. We are living through a complex time in which public trust and social justice remain urgent concerns. These realities form part of the world you are entering as graduates. Amid these issues, it remains possible to act with purpose and to help build a better future.
For that reason, your qualification is significant both as a personal achievement and as a public good. A university education equips you with knowledge and skills. It also develops your judgement, your ethical sense and your capacity to work with others in addressing the challenges of our time. At UWC, we believe that higher education should prepare graduates who can think critically, act responsibly and contribute meaningfully to society.
You have reached this day through sacrifice and determination. Many of you had to overcome various obstacles. That experience will have influenced what you know and who you are becoming. The strength you have shown in completing this journey will serve you well. As UWC graduates, I hope you will take with you a strong sense of social purpose and thoughtful engagement. Use your education with purpose and in ways that widen opportunity for others. In a society still facing deep inequality, that responsibility should be taken seriously. Congratulations on your achievement. We wish you every success in the years ahead.
PROF ROBERT J. BALFOUR RECTOR AND VICE-CHANCELLOR UNIVERSITY OF THE WESTERN CAPE
Om daardie rede is jou kwalifikasie betekenisvol, beide as ’n persoonlike prestasie en as ’n openbare bate.

Prospects And Legal Considerations For Open Banking In Africa
Description:
This thesis examines the potential and legal implications of Open Banking in Africa through case studies of Nigeria, the United Kingdom, Australia. The thesis addresses the numerous legal, regulatory, and institutional issues that are critical for establishing a strong Open Banking regime from an African perspective. The study argues for a regulatory model suited to African contexts, a specialised unit within the regulator devoted to regulating the significant risks of Open Banking, and a cross border framework unconstrained by data localisation. The study offers recommendations to strengthen the Open Banking eco-system in Africa. A draft Model Law on Open Banking was developed to assist policy-makers and regulators in countries without Open Banking schemes.

The constitutional right to adequate housing and shelter in Uganda: problems and prospects
Description:
The candidate examined the constitutional right to adequate housing in Uganda, through the prism of the experience of women as an exemplar of a distinctly and particularly affected group. The thesis provides the first comprehensive examination of the right to adequate housing for women in Uganda. It demonstrates additional insights into the special challenges experienced by vulnerable and marginalised groups, such as women, in fully enjoying this right on an equal basis with others. The candidate suggested practical ways in which this right can be better promoted, protected and fulfilled.

Childhood statelessness in Kenya: an appraisal of legislative compliance with international human rights law obligations
Description:
Statelessness affects all continents. This under-researched topic on childhood statelessness in Kenya examines the extent to which the State has complied with its international human rights law obligations on children’s right to a nationality and the challenges hindering its full realization. It posits that childhood statelessness arises in both non-migratory contexts impacting children from ethnic minority groups and non-indigenous communities, and migratory contexts affecting Somali children born in protracted refugee situations in Kenya. Using a doctrinal legal research methodology, it systematically analyses international instruments on the children’s right to a nationality, citizenship laws, and case laws, and proposes a child rights-based approach. It makes a significant scholarly contribution to understanding childhood statelessness from colonial times to the present.

A critical legal examination of South African standards on director responsibility and liability when approving financial statements in view of evolving global standards
Description:
South Africa has hitherto experienced various financial reporting/accounting scandals such as the Masterbond; the Steinhoff International; VBS; Tongaat Hulett Sugar Ltd scandals, inter alia. Inspired by these challenges, this thesis set out to (i) investigate whether South Africa adequately governs director responsibility and liability when approving financial statements, and (ii) to interrogate the effectiveness of the enforcement mechanisms for directors’ financial reporting standards. While evidence of plausible financial reporting standards in the Companies Act 71 of 2008 was established, the study identified worrying gaps in the mechanisms for enforcing the said standards. Drawing from international best practices, the study makes firm proposals, ‘custom-made’ for the South African context, to enhance the quality of the financial reporting standards and to improve effectiveness of enforcement mechanisms.

Legal Considerations for Adopting Central Bank Digital Currencies for Cross Border Payments in the Southern African Development Community Region
Description:
The thesis examines the legal and institutional foundations needed for the implementation of a cross-border central bank digital currency (CBDC) for the SADC region. It finds that although the SADC Real-Time-Gross-Settlement System and the Transactions Cleared on an Immediate Basis payment scheme have improved payments, they face limits in access, currency reliance, regulatory consistency and technical readiness. A cross border CBDC can enhance participation, speed and transparency and complement current systems. The research concludes that an interoperability model best aligns with SADC’s integration goals. The thesis identifies legal gaps in regional instruments and proposes reforms, emphasising that a CBDC is feasible only through gradual, coordinated and legally grounded development.

Towards robust regulatory frameworks for fintech regulation in South Africa
Description:
This thesis reassesses South Africa’s financial regulatory framework in the context of the Fourth Industrial Revolution and rapid FinTech growth, accelerated by COVID 19. While FinTech enhances access, efficiency and cost-effectiveness in financial services, it introduces new risks to soundness, stability, and customer protection. The research evaluated international best practices, and the benchmarks set by standard-setting bodies and other Twin Peaks jurisdictions. The thesis proposes practical regulatory and policy measures, including a draft Joint Standard for the Regulation of FinTech in South Africa. The thesis further advocates for principle and rules based approaches focused on technological outcomes to ensure that South Africans benefit from evolving Fintech advances.

UWC GRADUATION ATTIRE
MEANING AND SYMBOLISM
HEADER SUB-HEADER
The three proteas symbolise Teaching, Culture and Education.
The stepped pattern represents the steps that lead to the Greek temple. This is the international symbol for academia and our recognition that we are a part of it.
The laurel leaves indicate competition and victory.
The diamond-shaped protea petal represents strength of character, ethics and faithfulness to oneself and others.
The continuous pattern that extends from the front to the back speaks to Respice Prospice, which means to look back, to look forward. Take what is good from the past and build the future.
The beaded effect is meant to reflect African craft and creativity.
The colours that make up the band are derived from those that represent the seven Faculties that make up the University.
