This guide was created specifically with active duty, National Guard, and Reserve component service members in mind, as well as their spouses and dependent children. Some of the resources in this guide may also be applicable to veterans, however, the South Dakota Department of Veterans Affairs has separately put together detailed information about state resources available for veterans and their families.

We understand how stressful and busy a military service-connected move can be, so we wanted to make this guide as dynamic and informative as possible. Therefore, much of the content includes links to webpages where additional assistance can be found. We did this so that you can become familiar with South Dakota’s state government (and to make it easier to find the up-to-date resources you need online). HISTORY & CULTURE

SOUTH DAKOTA AIR AND SPACE MUSEUM

Just outside Ellsworth AFB, this museum offers free admission and showcases military aviation history with aircraft displays and exhibits. It’s a great way to learn about the base’s legacy. Check website or call ahead for hours.

THE JOURNEY MUSEUM AND LEARNING CENTER

I n Rapid City, this museum explores the Black Hills’ history, from Native American culture to the pioneer era. Interactive exhibits make it fun for kids. It’s a 5 minute drive from downtown Rapid City.

ICONIC LANDMARKS

MOUNT RUSHMORE NATIONAL MEMORIAL

A 30-minute drive from Rapid City, Mount Rushmore is an American icon. Explore the visitor center, walk the Presidential Trail, and catch the Evening Lighting Ceremony (seasonal). Admission is free, but parking fees apply.

BLACK HILLS STOCK SHOW AND RODEO

Held in Rapid City each late January/early February, this event features rodeos, livestock shows, and family activities. It’s a great way to experience local culture.

CUSTER STATE PARK BUFFALO ROUNDUP

Every September, watch cowboys and cowgirls herd the park’s bison during this iconic event. Plan to leave early and expect traffic on this day — travel may take one to two hours due to traffic. It’s a thrilling experience for all ages.

NEEDLES HIGHWAY (SD-87)

This scenic drive in Custer State Park offers stunning views, narrow tunnels, and granite spires. It’s perfect for a family road trip, especially in the fall.

BLACK HILLS VETERAN’S MONUMENT

This memorial, located within Memorial Park, was built in honor of Black Hills Veterans from WWI, WWII, Korea, Vietnam and Desert Storm/1st Iraqi War. The monument stands on a large stone donated by Crazy Horse Memorial® founder, Ruth Ziolkowski, and contains plaques to honor and remember the service and sacrifices of Black Hills veterans.

RAPIDS ID CARD

A RAPIDS ID card, or a Real-time Automated Personnel Identification System ID card, is a Department of Defense (DoD) identification card issued to military personnel, their dependents, retirees, and other eligible individuals. It serves as proof of identity and eligibility for accessing military benefits, privileges, and facilities.

Military Interstate Children’s Compact Commission

The Military Interstate Children’s Compact Commission is a partnership between the Defense Department and state governments that addresses some of the educational challenges of transitioning children of military families. The compact addresses eligibility, enrollment, placement, graduation and other key issues. The compact’s goal is to create a consistent policy in every school district and state that chooses to join.

As a resource, this benefit helps military-connected students by working to ensure a smooth transition from one duty station to the next. Reach out to MIC3 if you face education challenges when you move. The MIC3 can assist you with a range of issues related to a child’s education. If you are facing challenges at your new location with eligibility, enrollment, placement and graduation, reach out to the MIC3 for help.

Child Education Coalition

Military families, parents and educators can also access resources provided by the Military Child Education Coalition, which supports all military-connected children, youth and teens by educating, advocating and collaborating to resolve education challenges associated with the military lifestyle. Parents can find links to webinars, podcasts and stories on various education-related topics.

MCEC is the national advocate for Purple Star Schools, a program that supports military-connected children as they relocate to new schools due to a parent’s change in duty station.

Military children move frequently. The Purple Star School Program is designed to help schools respond to the educational and social-emotional challenges military-connected children face during their transition to a new school and keep them on track to be college, workforce, and life-ready. Military-connected refers to children of service members on active duty, and in the National Guard and Reserves.

Stagebarn Middle School is for students 5th through 8th grade. Grades 5th and 6th will be designed using an intermediate school model to assist with the transition from elementary school to middle school. IN-STATE TUITION

Veterans: Veterans that have established a permanent residence in South Dakota shall be granted resident status and are not subject to the 12-month residency requirement.

Active-Duty Military: Any person who is actively serving in the armed forces of the United States and is stationed in South Dakota will be classified as a resident for tuition purposes. This shall also apply to the dependents (spouse or children) of the active-duty personnel.

FREE TUITION FOR VETERANS

SDCL 13-55-2 to 13-55-5 Provides for certain veterans are eligible to take undergraduate courses at state supported universities or technical colleges without the payment of tuition provided they are not eligible for educational payments under the GI® Bill or any other federal educational program.

To qualify the veteran must:

• have been discharged under Honorable conditions

• be a current resident of South Dakota and qualify for in-state tuition

• must meet one of the definitions of a “veteran” as found in SDCL 33A-2-1 and 33A-2-2 which is as follows:

* served on active duty at any time between August 2, 1990 and a date to be determined

* received an Armed Forces Expeditionary medal or other United States campaign or service medal for participation in combat operations against hostile forces outside the boundaries of the United States, or

* has a service connected disability rated 10%, or more.

Eligible veterans may receive one month of free tuition for each month of “qualifying service” with a minimum of one, up to a maximum of four, academic years. Qualifying service is defined as: the amount of time served on active duty between the beginning and ending dates of the particular period of conflict or hostilities during which the veteran earned eligibility for this program.

FREE TUITION FOR CHILDREN OF VETERANS WHO DIE DURING SERVICE

SDCL 13-55-6 to 13-55-9 Provides for children who are under the age of 25, are residents of South Dakota, and whose mother or father was killed in action or died of other causes while on active duty, are eligible for free tuition at a state supported school, if the deceased parent was a bona-fide resident of this state for at least six (6) months immediately preceding entry into active service.

FREE TUITION FOR DEPENDENTS OF POW’S AND MIA’S

SDCL 13-55-9.2 to 13-55-9.6 Provides for children and spouses of prisoners of war, or of persons listed as missing in action, are entitled to attend a state supported school without the payment of tuition or mandatory fees provided they are not eligible for equal or greater federal benefits. The application for free tuition is available at the schools’ financial aids, veterans representative or registrars offices or, they can be obtained from the South Dakota Department of Veterans Affairs.

REDUCED TUITION FOR SOUTH DAKOTA NATIONAL GUARDMEMBERS

TSDCL 33-6-5 - 33-6-8.1 Provides for Guard members, who meet the requirements for admission, are eligible for a fifty percent (50%) reduction in tuition charges at any state supported school for undergraduate programs up to 128 credits and graduate programs up to 32 credits. OR,

one program of study, approved by the state Board of Education, at any state vocational school upon payment of fifty percent (50%) of the tuition charges.

The receipt of federal educational benefits does not affect eligibility for this program. To qualify the guardmember must:

1. Be a resident of this state and a member of the SD Army or Air Guard throughout each semester or vocational program for which he or she applies for benefits

2. Have completed required active duty for training

3. Attend 90% of drills and training periods and maintain a satisfactory academic grade level

4. Provide proper notice to the institution at time of registration for the term in which benefits are sought.

FREE TUITION TO CHILD OR SPOUSE OF SOUTH DAKOTA NATIONAL GUARDMEMBER DISABLED OR DECEASED IN THE LINE OF DUTY

Guardmember Disabled or Deceased in the Line of Duty

SDCL provides for free tuition to child or spouse of National Guard member disabled or deceased in line of duty. Any resident of this state who is less than twenty-five years of age and whose parent has died or has sustained a total disability, permanent in nature, resulting from duty as a member of the South Dakota National Guard, while on state or federal active duty or any authorized training duty, is entitled to free tuition at any state university. Any person who is a resident of this state whose spouse has died or has sustained a total disability, permanent in nature, resulting from duty as a member of the South Dakota National Guard, while on state or federal active duty or any authorized training duty, is entitled to free tuition and is entitled to attend any course or courses of study in any state university.

HONORARY HIGH SCHOOL DIPLOMA

SDCL 33A-2-34 provides for honorary high school diplomas for veterans who served during certain wartime periods. Eligible veterans include anyone who served on active duty at any time during the periods: December 7, 1941 to September 2, 1945; June 25, 1950 to July 31, 1953; or February 28, 1961 to May 7, 1975. As stated in the law, the school district selected by the veteran shall award the diploma to the veteran.

TAX INFORMATION FOR MILITARY MEMBERS

Members of the U.S. Armed Forces, including active duty, Reserve, and National Guard, have access to special tax benefits. South Dakota does not impose a state income tax, which simplifies filing for military families. However, federal taxes still apply, and military-specific provisions can affect your return.

TAX EXCLUSION FOR COMBAT SERVICE

If you serve in an IRS-recognized combat zone, you may exclude certain income from federal taxation. The IRS’s Publication 3, Armed Forces’ Tax Guide, is the authoritative source for military-specific tax matters.

REQUIREMENTS

You must be a member of the U.S. Armed Forces

Entitlement to the compensation must have accrued during a month you served in a designated combat zone or were hospitalized due to wounds, disease, or injury incurred while serving in a combat zone.

EXCLUDABLE INCOME - You can exclude:

Basic Pay: All pay for each month in a combat zone.

Reenlistment or Continuation Bonuses: If the agreement occurred in a combat zone.

School Loan Repayments: Pro-rated for months in a combat zone (e.g., 6 months in a combat zone out of a 12-month repayment period = 50% exclusion).

Imminent Danger/Hostile Fire Pay: All of this income.

Leave Benefits: Income from selling accrued leave earned in a combat zone. Awards and Incentives: Income from submissions made in a combat zone.

TAXES

NON-EXCLUDABLE TAXES

Military pay earned in a combat zone is still subject to Social Security and Medicare taxes, reflected on your W-2.

PERIOD COVERED

The exclusion applies for each month you served in a combat zone, including partial months (one day counts as a full month). If hospitalized due to combat zone injuries, the exclusion extends during hospitalization, but not beyond two years after leaving the combat zone.

LIMITS

Enlisted Members, Warrant Officers, Commissioned Warrant Officers: Can exclude all military pay for each month in a combat zone.

Commissioned Officers: Limited to the highest enlisted pay rate plus imminent danger/hostile fire pay per month.

MARRIED PERSONNEL

If both spouses are military and served in a combat zone, both may claim the exclusion for their respective months.

If only one spouse served in a combat zone, that spouse may claim the exclusion.

ACTIONS

No action is required to receive the exclusion — your military organization will automatically exclude reportable income on your W-2. If your W-2 does not reflect the exclusion and you believe you’re entitled, contact your military pay office to request a corrected W-2.

MOTOR VEHICLE DRIVER LICENSE

VEHICLE REGISTRATION REQUIREMENTS

South Dakota law requires all vehicles to be registered, but military members stationed at Ellsworth AFB have flexibility. You can register your vehicle in your home state or in South Dakota. Nonresident military members are not required to register in South Dakota if their vehicle is validly registered in their home state. To register in South Dakota, legal residents pay a license fee based on vehicle weight and year. Required documents include your title, registration, mileage, and, if applicable, a tax receipt from your previous state.

ON-BASE REGISTRATION

To register your vehicle on base, visit the Visitor Control Center at Ellsworth AFB’s Liberty Gate (main gate). Bring your military ID, vehicle registration, driver’s license, and proof of insurance.

DRIVER’S LICENSE REQUIREMENTS

South Dakota requires a valid driver’s license to operate a vehicle. Nonresident military members stationed in South Dakota can use a valid license from their home state. However, if you establish residency in South Dakota, you may need to obtain a South Dakota license within a few months of moving.

CDL “EVEN EXCHANGE” PROGRAM

Current or recently separated military members (within one year of separation/retirement), including Reserve and National Guard, with experience in a qualifying Military Occupational Specialty (MOS), can apply for a South Dakota Commercial Driver’s License (CDL) through the “Even Exchange” program. This waives knowledge and skills testing requirements. You’ll need to submit a Military Skills Test Waiver application, verified by your commanding officer, to the South Dakota Driver Licensing Program. If approved, you have 30 days to process the waiver at a Driver License Exam Station.

SAFETY REGULATIONS

South Dakota traffic laws apply both on and off base:

Seat Belts: Mandatory for all occupants. You’ll be ticketed and fined if not secured.

Child Safety Seats: Required for children under 5 years or 40 pounds; children ages 5-18 must use a car seat or safety belt.

Motorcycles: Helmets and eye protection are required.

Hands-Free Devices: Use of cell phones or digital devices while driving is restricted, but hands-free devices are permitted. Hands-free devices must be used while operating a motor vehicle on all military installations.

LEGAL

Military service can create legal and financial challenges for service members and their families. The following resources provide protections and support, covering everything from legal protections to navigating the military justice system.

SERVICEMEMBERS CIVIL RELIEF ACT (SCRA)

The SCRA offers financial and legal protections for active-duty service members, including National Guard and Reserve members, and their families. These protections cover a range of issues, from mortgages to voting rights. Because SCRA details can be complex, contact the nearest legal assistance office — such as the one at Ellsworth AFB — for personalized guidance.

KEY PROTECTIONS

Reduced Interest Rates: Creditors must cap interest rates at 6% on debts incurred before active duty, including credit cards, car loans, and some student loans. For mortgages, this rate extends one year after active duty. Creditors may challenge this if your ability to pay isn’t materially affected by service.

Postponement of Foreclosures: No foreclosure or seizure of property for nonpayment of a pre-service mortgage is valid during or within nine months after active duty without a court order. Contact legal assistance immediately if you miss a payment.

Deferred Income Taxes: The IRS and state authorities must defer income taxes due before or during military service if your ability to pay is materially affected. No interest or penalties apply. See the “Taxes, Motor Vehicle, and Driver License Inquiries” section for more tax details.

Eviction Prevention: You and your family cannot be evicted for nonpayment of rent without a court order if the monthly rent is below a certain threshold (contact legal assistance for current limits). Courts must grant a 90-day delay or adjust obligations if military service affects your ability to pay.

Protection Against Default Judgments: In civil or administrative proceedings filed against you during active duty, the court must appoint a lawyer to represent you and grant a 90-day stay if your defense requires your presence.

Postponed Civil Court Matters: If military service prevents participation in civil proceedings (e.g., divorce, foreclosure), you can request a 90-day stay, with potential for an additional 90 days.

Protection for Small-Business Owners: Nonbusiness assets and military pay are protected from creditors for business debts while on active duty.

Termination of Leases: You can terminate residential, agricultural, professional, or business leases if you enter military service, receive permanent change of station orders, or deploy for 90+ days. Provide written notice and military orders to the property owner.

Termination of Automobile Leases: You can terminate a car lease if called to active duty, receive overseas PCS orders, or deploy for 90+ days.

Termination of Phone Service: You can terminate cell phone or phone exchange contracts if relocating for 90+ days to an unsupported area due to military orders.

Prevention of Repossession: Property cannot be repossessed for nonpayment during or prior to military service without a court order.

Life Insurance Protection: Insurers cannot terminate coverage or raise premiums due to military service, though age-based premium increases in term insurance are not covered.

LEGAL

Suspension of Professional Liability Insurance: Professionals (e.g., healthcare, legal) can suspend liability insurance during active duty, with no premiums due. Reinstate within 30 days of release.

Voting Rights: Your state voting residency remains unaffected by military service, as does your spouse’s.

MILITARY JUSTICE OVERVIEW

The Uniform Code of Military Justice (UCMJ) governs the military justice system, enacted by Congress with procedural rules outlined in the Manual for Courts-Martial (MCM). Understanding this system can help navigate legal proceedings.

KEY PROTECTIONS

Serious offenses (e.g., rape, indecent assault, drugs, larceny) are investigated by agencies like the Army’s Criminal Investigation Command (CID) or Air Force Office of Special Investigations (AFOSI).

Less serious offenses are handled by military or security forces.

Minor offenses may be investigated by the service member’s immediate commander through a preliminary inquiry.

COMMANDER’S OPTIONS

Commanders have discretion in handling offenses and may:

Take No Action: If the accused is innocent, evidence is inadmissible, or other reasons justify no prosecution.

Initiate Administrative Action: Corrective measures like counseling, reprimand, or involuntary separation, which are not punitive.

Use Nonjudicial Punishment (Article 15, UCMJ): For minor offenses, this involves a non adversarial hearing by the commander. The service member can request an open or closed hearing, consult an attorney, present witnesses, and appeal the decision. The commander must be convinced beyond a reasonable doubt of guilt. Maximum punishment varies by rank.

Proceed to Court-Martial: For serious offenses, commanders can refer charges to one of three levels:

(1) Summary Court-Martial: For minor offenses (enlisted only), presided over by a single officer. No right to counsel, but you may hire one.

(2) Special Court-Martial: Intermediate level with a military judge or at least three members and a judge. Enlisted members can request one-third enlisted representation. Includes a prosecutor, defense counsel, and optional civilian counsel (at your expense).

(3) General Court-Martial: The highest level for serious crimes, requiring an Article 32 investigation (similar to a civilian grand jury). Can consist of a judge and five members or a judge alone (except in capital cases). Enlisted members can request one-third enlisted representation.

LEGAL

TRIAL AND APPEALS

Courts-martial follow procedures similar to civilian trials, using military rules of evidence. Conviction requires proof beyond a reasonable doubt. Appeals start with the convening authority, who reviews the case. If a punitive discharge or confinement over one year is approved, the case goes to the Department’s Court of Criminal Appeals, then potentially to the Court of Appeals for the Armed Forces, and rarely to the U.S. Supreme Court.

VETERANS COURT PROGRAM

The Pennington County Veterans Court in Rapid City is a voluntary program that provides intensive case management to veterans who have substance abuse and/or mental health disorders related to their military service. The program is designed to help veterans rehabilitate by redirecting them from the traditional criminal justice system and providing them with resources and support to lead productive, law-abiding lives. Veteran’s organizations, attorneys and probation officers as well as various helping agencies can provide assistance in enrolling in this program.

FINANCIAL ASSISTANCE

Military families often need financial support during service, transitions, or unexpected challenges. The Black Hills region, alongside national programs, offers resources to help service members, veterans, and their families stationed at Ellsworth AFB and Camp Rapid manage their finances and plan for the future.

OPERATION FIRST RESPONSE

Operation First Response provides financial aid to wounded, injured, or critically ill active-duty service members, disabled veterans, and their families. SOUTH DAKOTA NATIONAL GUARD PAY AND BENEFITS

As a Guard member at Camp Rapid, you can expect competitive pay based on your rank, job, and education level. Pay increases with rank and years of service. You’ll be paid for all time served, including monthly drills (approximately two days), two weeks of Annual Training, and active-duty deployments. Guard members may also qualify for a housing allowance if they have dependents. Notably, bonuses or upgrades received while serving overseas are exempt from income tax.

SERVICEMEMBERS’ GROUP LIFE INSURANCE (SGLI)

SGLI offers low-cost term life insurance to eligible service members.

You may be eligible if you’re:

An active-duty member of the Army, Navy, Air Force, Space Force, Marines, or Coast Guard.

A commissioned member of the National Oceanic and Atmospheric Administration (NOAA) or U.S. Public Health Service (USPHS).

A cadet or midshipman of the U.S. military academies.

A member, cadet, or midshipman of the Reserve Officers Training Corps (ROTC) engaged in authorized training.

A member of the Ready Reserve or National Guard scheduled for at least 12 periods of inactive training per year.

A volunteer in an Individual Ready Reserve (IRR) mobilization category.

If you’re in non-pay status with the Ready Reserve or National Guard, you may still qualify if scheduled for 12 periods of inactive training and drilling for points rather than pay (premiums must be paid directly).

FINANCIAL ASSISTANCE

CONCURRENT RETIREMENT AND DISABILITY PAY (CRDP)

CRDP allows military retirees to receive both military retired pay and VA disability compensation, effective since January 1, 2004. This program phases out the VA disability offset, fully restoring benefits by January 2014. You’re automatically enrolled if eligible — no application is needed. You qualify if you’re:

A regular retiree with a VA disability rating of 50% or greater.

A reserve retiree with 20 qualifying years of service, a VA disability rating of 50% or greater, and have reached retirement age (typically 60, but reducible by three months for every 90 days of active service in a fiscal year if in the Ready Reserve).

Retired under the Temporary Early Retirement Act (TERA) with a VA disability rating of 50% or greater.

A disability retiree eligible for retired pay (not solely by disability) with a VA disability rating of 50% or greater.

RETROACTIVE PAYMENTS

You may be eligible for retroactive payments dating back to January 1, 2004, depending on your retirement date or when you reached a 50% disability rating. The Defense Finance and Accounting Service (DFAS) will audit your account, and if a VA retroactive payment is due, DFAS will forward the audit to the VA for processing.

INDIVIDUAL UNEMPLOYABILITY (IU)

If you’re rated by the VA as unemployable (IU) and receiving VA disability compensation for IU, you’re eligible for full concurrent receipt of both VA compensation and retired pay, effective October 1, 2008, and retroactive to January 1, 2005.

MILITARY RETIREMENT PAY

Military retirement pay varies based on four plans: Final Pay, High-36, REDUX, and Blended Retirement System (BRS), plus disability retirement. Your plan depends on your Date of Initial Entry to Military Service (DIEMS):

Final Pay: DIEMS before September 8, 1980; uses final basic pay.

High-36: DIEMS from September 8, 1980, to July 31, 1986; uses the average of the highest 36 months of basic pay.

REDUX: DIEMS from August 1, 1986, to December 31, 2017, with an election for REDUX; High-36 reduced by 1% per year under 30 years of service.

BRS: DIEMS on or after January 1, 2018, or opt-in; uses High-36 with a 2.0% multiplier.

MULTIPLIER

For Final Pay, High-36, and BRS, each year of service adds 2.5% to the multiplier (e.g., 20 years = 50%). REDUX reduces this by 1% per year under 30 years (e.g., 20 years = 40%). Disability retirement uses the higher of the disability percentage (up to 75%) or years of service times the plan multiplier.

All plans except REDUX receive an annual COLA based on the Consumer Price Index (CPI). REDUX COLA is reduced by 1%.

Everyone faces tough challenges in life. That’s why the Air Force Aid Society (AFAS) is here. The Air Force Aid Society is the official charity of the U.S. Air Force. Through the years, AFAS has become increasingly effective in helping individuals with personal emergencies – as well as extremely useful when used by commanders to help solve personnel problems in their units.

SURVIVORS BENEFITS PLAN (Military & Family Readiness Center)

The Survivors Benefit Plan (SBP) counselor is mandated to meet with retiring service members to provide a brief of survivor benefits and life insurance benefits. Service members must attend at least 120 days prior to their retirement effective date. SBP is a government program which makes it possible for retiring members to ensure that after their death, their eligible survivors will receive a portion of their military retired pay in the form of a monthly annuity. The SBP was structured so that a surviving spouse cannot outlive the annuity, and it has Cost-ofLiving Adjustments (COLAs) incorporated so the annuity increases with inflation.

An active-duty member who has eligible dependents is automatically covered by SBP at the maximum level at no cost to the member while he/she remains on active duty. Prior to retiring, each member must decide whether to continue SBP coverage into retirement. The retired pay of those members who elect to participate is reduced by monthly premiums. The SBP is a unique plan: Government-subsidized premiums are deducted from a participating member’s retired pay before taxes. The SBP is the sole means for a member to continue a portion of their military retired pay to their eligible survivors. If a member chooses (with the concurrence of their spouse) not to participate in the SBP, an annuity cannot be paid.

The M&FRC is the liaison office for the Military and Family Life Counselor (MFLC) program here on Ellsworth AFB. MFLC’s are available to deliver short term, situational, problem-solving non-medical counseling services to all branches of the military and their families. MFLC support addresses issues that occur specifically within the military lifestyle and helps service members and their families cope with normal reactions to the stressful/adverse situations created by deployments and reintegration. The services of MFLCs are intended to augment existing military counseling services.

Military & Family Life Counselors offer:

• Completely confidential and private sessions, except for duty-to-warn situations

• Services provided to individuals, couples and families

• They are mandated reporters of child abuse, domestic abuse and other duty to warn situations
